Civil War

Throughout the Yemeni Civil War, western states have supplied weapons used in the indiscriminate bombing campaign conducted by the Saudis. In defence of their actions, British politicians have argued that they are exchanging weapons for influence, and using the influence obtained to encourage compliance with humanitarian law. An additional premise in the argument is that Britain is using its influence more benignly than alternative suppliers would use theirs if Britain were not on the scene. The idea is that Britain is (...) substituting itself for other, less scrupulous, interveners. I argue that, regardless of whether British substitution intervention could be justified in this way…, it is not in fact justified, because Britain has not plausibly used its influence to secure an amount of good sufficient to offset the various harms that its actions have created (or to discharge the expanded duties of rescue that greater influence entails). In addition, the article identifies the various forms that substitution intervention can take, and shows how the concept reveals hitherto neglected reasons to both support and oppose intervention in foreign conflicts. This article critically analyzes Rawls’s attitude toward envy. In A Theory of Justice, Rawls is predominantly concerned with the threat that class envy poses to political stability. Yet he also briefly discusses the kind of envy that individuals experience toward their social peers, which he calls particular envy, and which I refer to as peer envy. He quickly concludes, however, that particular envy would not present a serious risk to the stability of his just society. In this article, I contest (...) this claim by arguing that the principles that structure Rawls’s ideal society are likely to exacerbate particular envy to a politically risky extent. Section 1 reconstructs his account of envy, giving special attention to his belief that competition kindles envy between peers. Section 2 then examines the way in which Rawls often endorses rivalry within the body politic. I argue that the society governed by justice as fairness is, on account of this rivalry, likely to generate a politically problematic degree of particular envy. In Section 3, I invoke ancient Greece as an example of a society that was, as a result of its intense competitiveness, often imperiled by dangerously elevated levels of peer envy. I then survey the key institutional mechanisms by which the ancient Greeks sought to manage this hazardous emotion. It turns out, however, that most of these mechanisms would be unavailable to Rawls insofar as they starkly contravene his principles of justice. I conclude that if Rawlsians wish to establish a society that fosters rivalry, they would do well to reflect on the means by which peer envy can be effectively harnessed. (shrink)

Der vorliegende Forschungsband möchte der kulturelle Bedeutung der Ersten Republik und deren Leistungen einen gebührenden Platz einräumen. Während sich nämlich Wiener Moderne und Weimarer Republik heute einer fortdauernden Aufmerksamkeit erfreuen, sind die Kultur der Ersten Republik und hier vorab des soziokulturellen Laboratoriums Wien – vermutlich schon in der Wahrnehmung vieler Zeitgenossinnen und Zeitgenossen unterbelichtet geblieben. Versammelt sind Beiträge zur Volksbildung im Roten Wien, zu Architektur und Stadtplanung, zu neuen Diskursen in der Psychoanalyse oder zur Neuorientierung Musils nach 1918, die später (...) zu seinem epochalen Roman »Der Mann ohne Eigenschaften« führen wird. Was ihn von anderen Publikationen unterscheidet, ist ein komparatistischer Aspekt, der etwa im Vergleich zwischen der Revolution 1918 in Wien und Österreich und der (kurzlebigen) Räterepublik in Ungarn aber auch in der Analyse der ungarischen Medien in der Zwischenkriegszeit zum Ausdruck kommt. Durch diese erhellenden Vergleiche fällt neues Licht auf die spezifische Besonderheit der Ersten Republik und der Situation im Roten Wien. (shrink)

This paper examines Antonio Altarriba’s presentation of his deceased mother’s life-story in the graphic novel El ala rota (2016) claiming that the author’s personal trauma of mourning reveals the collective trauma of non-politically-engaged Spanish women throughout Spain’s 20th century. El ala rota contributes to the recovery of a new kind of memory by paying homage to a woman who was relegated to the private sphere and who herself believed her stories were not worth telling – a woman who was in (...) the back room of history and lacked the means and mechanism to chronicle her life. The paper demonstrates that, not only does the content of El ala rota give voice to those who did not have one, thus philosophically paralleling the aims of the Recovery of Historical Memory and the exhumations of mass graves in Spain, but also, that its specific form of comics calls attention to the way society engages with the recovery of historical and collective memory specifically with regard to gender. L'America e il mondo sono in procinto di collassare a causa dell'eccessiva crescita demografica, la maggior parte per il secolo scorso, e ora tutto questo, a causa della gente del terzo mondo. Il consumo di risorse e l'aggiunta di altri 4 miliardi di ca. 2100 crolleranno la civiltà industriale e porterà alla fame, alle malattie, alla violenza e alla guerra su scala impressionante. La terra perde almeno l'1% del suo suolo superiore ogni anno, così come si avvicina a 2100, la (...) maggior parte della sua capacità di coltivazione alimentare sarà andato. Miliardi moriranno e la guerra nucleare è tutt'altro che certa. In America, questo è stato enormemente accelerato dalla massiccia immigrazione e dalla riproduzione degli immigrati, unite agli abusi resi possibili dalla democrazia. La natura umana depravata trasforma inesorabilmente il sogno della democrazia e della diversità in un incubo di criminalità e povertà. La Cina continuerà a travolgere l'America e il mondo, finché manterrà la dittatura che limita l'egoismo. La causa principale del collasso è l'incapacità della nostra psicologia innata di adattarsi al mondo moderno, che porta le persone a trattare le persone non correlate come se avessero interessi comuni. L'idea dei diritti umani è una fantasia malvagia promossa dalla sinistra per distogliere l'attenzione dalla spietata distruzione della terra da parte della sfrenata maternità del terzo mondo. Questo, oltre all'ignoranza della biologia e della psicologia di base, porta alle illusioni di ingegneria sociale dei parzialmente istruiti che controllano le società democratiche. Pochi capiscono che se aiuti una persona che fai del male a qualcun altro, non c'è pranzo gratuito e ogni singolo oggetto che qualcuno consuma distrugge la terra in modo irreparabile. Di conseguenza, le politiche sociali ovunque sono insostenibili e una dopo l'altra tutte le società senza rigorosi controlli sull'egoismo crolleranno nell'anarchia o nella dittatura. I fatti più basilari, quasi mai menzionati, sono che non ci sono abbastanza risorse in America o nel mondo per sollevare una percentuale significativa dei poveri dalla povertà e tenerli lì. Il tentativo di farlo sta mandando in bancarotta l'America e distruggendo il mondo. La capacità della terra di produrre cibo diminuisce ogni giorno, così come la nostra qualità genetica. E ora, come sempre, di gran lunga il più grande nemico dei poveri sono gli altri poveri e non i ricchi. Senza cambiamenti drammatici e immediati, non c'è speranza di prevenire il crollo dell'America, o di qualsiasi paese che segua un sistema democratico. (shrink)

Monografia ta traktuje o ograniczaniu konfliktów w relacjach między segmentami społecznymi (takimi jak grupy etniczne, wspólnoty religijne), w których członkostwo opiera się na podstawach askryptywnych i kulturowych, a także między nimi a władzą centralną w Nigerii i Indonezji. Państwa te mają burzliwą historię niepodległego bytu, ogromne wieloetniczne i wieloreligijne populacje, duże gospodarki oraz zasoby surowców energetycznych. Jak wskazują liczne raporty, będą wkrótce należeć do najważniejszych w świecie. W Nigerii i Indonezji funkcjonują systemy polityczne oparte na tzw. power-sharing (współrządzeniu), tj. takie, (...) które za pomocą specyficznych formalnych i nieformalnych instytucji (rozumianych jako zespoły reguł) dopuszczają do udziału we władzy elity polityczne wywodzące się z różnych segmentów etnicznych i religijnych. Celem instytucji power-sharing jest budowanie pokoju i stabilności politycznej. Autor badań, których owocem jest ta praca, dokonał identyfikacji, wyjaśnienia i analizy roli oraz genezy najistotniejszych z nich, dowodząc zarazem, że w Nigerii i Indonezji współistnieją instytucje dwóch głównych modeli power-sharing, tj. konsocjonalizmu i centrypetalizmu. W konsekwencji wykazał, że międzysegmentowe współrządzenie w obu państwach ma charakter hybrydowy. Jest to poszerzenie empirycznej teorii power-sharing. Jej klasycy, Arend Lijphart (konsocjonalista) i Donald L. Horowitz (centrypetalista), nie przywiązywali większej wagi do możliwości implementacji instytucji dwóch modeli w ramach tego samego systemu politycznego. Tymczasem w Nigerii i Indonezji łączenie instytucji centrypetalnych i konsocjonalnych przyczyniło się do ograniczenia konfliktów. (shrink)

This is the first complete English translation and publication of Donoso’s carta de 24 de octubre, 1851, a letter encapsulating many of his views on revolution and decision. This remarkable letter, sent as a diplomatic missive while he was serving the Spanish crown in Paris, describes how Napoleon III––stuck between the 1848 constitution’s prohibition against his election and his impending coup that will crown him emperor––must gain the support of the liberal bourgeoise middle class if he is to maintain his (...) rule over France. The letter is also of great importance to Donoso and Schmitt scholars because it contains the first and only time Donoso uses the complete term “las clases discutidoras,” which, through Schmitt’s injudicious and repeated misspellings as “una clasa discutidora” has become famous for its characterization of the liberal bourgeoisie as the “discussing” or “disputing” class that is incapable of action at the precise historical moment when a decision is most direly needed to save the constitution from inner or outer existential threats. This essay examines Étienne Balibar's readings of Jacques Derrida and deconstruction. The text is framed as a review of two books by Balibar: 'Equaliberty' and 'Violence and Civility'. After describing the context of those readings, I propose a broader reflection on the ambiguous relationship between 'post-Marxism' and 'deconstruction', focusing on concepts such as 'violence', 'cruelty', 'sovereignty' and 'property'. I also raise methodological questions related to the 'use' of deconstructive notions in political theory debates.

With her new book, The Conceptual Foundations of Transitional Justice, Colleen Murphy has advanced novel, comprehensive and sophisticated philosophical accounts of both what severely conflict-ridden societies should be aiming for and how they should pursue it. Ultimately grounded on a prizing of rational agency, Murphy maintains that these societies, roughly, ought to strive for a stable and legitimate democratic polity committed to not repeating gross historical injustice and do so in ways that do right by victims. In this article, I (...) argue, contra Murphy, that achieving democratic rights to political participation should not be considered an essential aim of transitional justice, and that, in contrast, doing right by victims should be considered an essential aim of it, not merely an appropriate means to achieving other aims. In addition, I highlight an issue downplayed in Murphy’s book, namely, the need to make trade-offs amongst the aims of transitional justice, which becomes particularly pressing upon accepting that doing right by victims is one of them. I consider the implications of two globally influential love-centred value systems for how to respond to painful memories that are a consequence of large-scale social conflict. More specifically, I articulate a moral-philosophical interpretation of the sub-Saharan worldview of ubuntu, and consider what it entails for responding to such trauma. According to this ethic, one should strive to become a real person, which one can do insofar as one honours those capable of communal (or broadly loving) relationships, ones of identity and (...) solidarity with others. I compare the implications of this ubuntu ethic with those of prominent Christian principles such as the golden rule and the commandment to love one's neighbour, noting some similarities between them, but emphasizing differences. Salient topics addressed are reconciliation with others, reconciliation to one's situation, punishment and forgiveness. (shrink)

There are various ways of reducing conflicts and of stabilizing the political situation in states where society is made up of many different ethnic groups and religious communities, and where relations between these segments – or between them and the central government – are tense. A particularly important way is the establishment in those states of a political system based on power-sharing (PS), which allows members of various ethnic and religious segments to take part in the exercise of power. The (...) literature on the subject usually discusses two models of PS: consociationalism and centripetalism. A third model is encountered in practice, however, that of hybrid power-sharing (HPS), which combines the institutions of the first two. The main objective of this article is to explain the nature and origins of HPS. (shrink)

The battle of Little Bighorn in 1876 marked the beginning of the end of conflict between the U.S. and its military against the various Native American tribes west of the Mississippi River. Historians have given us various ideas of why Lieutenant Colonel Custer met with defeat. But none have noted, in connection with the November 3rd “secret meeting” between Grant and his generals, a movement of troops away from the Black Hills even before decisions were supposedly made to no longer (...) keep miners out of that sacred land. When we study attitude and orders in conjunction with what we know about these events, the idea emerges that the government knew that they couldn’t get the Indians to break the Fort Laramie Treaty unless they were attacked. Here, then, is a presentation of the possibility of deliberate defeat by the U.S. government and its military in order to take the Black Hills. (shrink)

In this essay I argue that Machiavelli does not hold that all deception is permissible in war. While Machiavelli claims that "deceit... in the conduct of war is laudable and honorable," he insists that such deceit, or ruses of war, is not to be confounded with perfidy. Any Lee's U.S. Civil War film, "Ride With the Devil," illustrates this difference. The film also illustrates the difference between lying as part of romance, which is permitted, and lying at the moment of (...) truth in a relationship, when admitting one's feelings, which is not. In this article, I present and critically analyze the main ideas of the Nigerian thinker, Ifeanyi A. Menkiti, on the future of the multi-ethnic state in Africa. Menkiti appears to consider that the basic condition for the successful coexistence of the various groups occupying the states of Africa is for relations between them to rest on just principles. Justice should involve the fair and equitable division amongst peoples of the burdens and benefits of living in a common state. To realize (...) this ideal, he proposes the creation in Africa of morally neutral, managerial states. He bases his plan in part on the ideas of John Rawls. Close analysis of Menkiti’s views shows that his vision of the minimalist state is only a temporary solution, which is to lead to the peaceful dismemberment of the current post-colonial model of multi-ethnic states functioning within the old colonial borders. The basic value of Menkiti’s thought rests in his reversal of the usual perspective on African states, as he considers that maintaining territorial integrity or achieving unity should no longer be considered a paramount necessity. Vardoulakis examines the concept of political theology in terms of the ancient greek term "stasis." The term "stasis" means both mobility and immobility. Vardoulakis explores these seemingly contradictory meanings generate a notion of agonistic politics that challenges perceived ideas about political theology.

This article discusses the rights enjoyed by irregular combatants in detention, that is, members of organized groups (who may be fighting an insurgency or engaging in terror attacks) who fail to qualify for POW status. The paradigmatic example of such a detainee would be an al-Qaeda agent.

The Black Panther Party is now commonly associated with violence; however, this was far from what they aimed to represent. The Party was aimed at total social and political reconstruction and, their larger point, creating an equitable society in which Black Americans could thrive. The criticism which the Party faced (and still faces) was through their use of “armed self-defense” and methods of political violence. From a philosophical perspective, many interesting questions can be considered when evaluating the morality of the (...) utilization of armed self-defense. In this paper, I will use Just War Theory to answer the question: can non-state actors be justified in their usage of violence against states? Specifically, I will claim that the Black Panther Party’s use of armed self-defense and political, physical violence was morally justified under an expanded just war theoretic. To do this, I will first analyze political violence and resistance to clarify how my account will understand the two and their potential overlap. Next, I will clarify Just War Theory and provide thorough discussion of the “competent authority” criterion and argue that select non-state actors can be competent authorities. Finally, I will apply my expanded just war theoretic to the case of the Black Panther Party and their use of armed self-defense. (shrink)
