The global water crisis is being exacerbated by climate change, even in the United States. Recycled water is a feasible alternative to alleviate the water shortage, but it is constrained by humans’ perceptions. The current study examines how residents’ water scarcity awareness and climate change belief influence their willingness to use recycled water directly and indirectly. Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of 1831 residents in Albuquerque, New Mexico, an arid inland region in the US. We (...) discovered that residents’ willingness to use direct recycled potable water is positively affected by their awareness of water scarcity, but only if they believe in the impacts of climate change on the water cycle. Meanwhile, the willingness to use indirect recycled potable water is influenced by water scarcity awareness, and the belief in climate change further enhances this effect. These findings implicate that fighting climate change denialism and informing the public of the water scarcity situation in the region can contribute to the effectiveness and sustainability of long-term water conservation and climate change alleviation efforts. The study investigated the effect of cognitive restructuring on junior secondary school mathematics test anxiety in Oshimili south L.G.A of Delta State. Two research questions and two hypotheses tested at 0.05 level of significance guided the study. Quasi-experimental research design was adopted for this study. The population for this study was a total of 1224 students. These comprised of all the JSS 2 students from Oshimili South Local Government Area of Delta State. Research sample consisted of 120 JSS 2 students (...) with high level of mathematics test anxiety selected through purposive sampling technique. The instrument adopted for this study was Maths anxiety rating scale-R. Data collected from the study were analyzed using mean and ANCOVA. Results obtained from the study indicated that Cognitive restructuring therapy (CRT) was effective on mathematics test anxiety of junior secondary school students. The results equally showed that Cognitive restructuring therapy was more effective on the female students’ mathematics anxiety than their male counterparts. Furthermore, the results indicated a significant difference in the post-test mathematics test anxiety mean scores of students treated with CRT and those in the control group. Also, there was significant difference in the post-test mathematics test anxiety mean scores of male and female students treated with CRT. Based on the findings of this study, some recommendations were noted. The researcher recommended, among others that Schools’ Guidance Counselors should be empowered to make good use of the cognitive restructuring technique, in counseling students who find it difficult to comprehend mathematics skills. This study was conducted to determine the effectiveness of utilizing the Dual-axis Solar Tracker in harnessing solar energy and storing it in lithium-ion batteries in terms of voltage and milliamps per hour gained. This study utilized two solar panel systems, the Static Solar Panel System and the Dual-Axis Solar Tracker and aimed to prove the significant difference generated by solar panel systems in terms of voltage and milliamps per hour. This study employed an Applied Experimental Research Design utilizing Arduino Uno, (...) light-dependent resistors, micro servos, and solar panels to create the Dual-Axis Solar Tracker. The data gathered from the electric quantities during the seven-day sun exposure were tabulated, analyzed, and computed using mean tests, standard deviation, and T-tests to find the significant difference between the two solar panels. Based on the analyses of the data, it was revealed that the Dual-Axis Solar Tracker was superior in terms of voltage and milliamps per hour generated compared to the Static Solar Panel System. Moreover, computations using the T-test found that in terms of voltage and milliamps per hour generated, there was a significant difference between the Dual-Axis Solar Tracker and the Static Solar Panel System. Based on the findings of the study, it is concluded that the utilization of the Dual-Axis Solar Tracker statistically increases the effectiveness of solar panels in harnessing energy generation. Amaç: Kanserle yaşayan bireylerin (KYB) bakımında, resmiyette görünür olmayan ve çoğunlukla herhangi bir profesyonel donanıma sahip olmayan, ama sürecin başından sonuna, hasta bireye eşlik eden bakım verenler kritik öneme sahiptir. Baş etmesi zor bir hastalık olan kanserle mücadele eden bireylerin bakımında, bakım verenler fiziksel, zihinsel ve sosyal birtakım zorluklarla karşılaşmaktadır. Bu araştırma, KYB’lere bakım veren, yakınlarının karşılaştıkları zorlukları gündeme getirmeyi ve ihtimam etiği perspektifinden, bakım verenlerin bakımına yönelik öneriler sunmayı amaçlamaktadır. Gereç ve Yöntem: Bu araştırma tanımlayıcı ve kesitsel olup araştırmanın (...) evreni Marmara Üniversitesi Pendik Eğitim ve Araştırma Hastanesi (MÜPEAH) Onkoloji kliniğinde takip edilen, 15 Mart-5 Nisan tarihleri arasında kemoterapi ünitesine ve servis hizmetlerine başvuran KYB’lerin bakım veren yakınlarıdır. KYB’lere bakım verenlerin umutsuzluk derecelerini tespit etmek ve bunu etkileyen faktörleri ölçmek için, veri toplama aracı olarak; sosyodemografik sorular, bakım alan bireyin hastalık derecesine yönelik sorular ve Beck Umutsuzluk Ölçeği sorularından oluşan bir anket elden dağıtılmıştır. Anket bakım verene yönelik sosyodemografik sorular 8, KYB’nin hastalığının durumu ile ilgili sorular 7, Beck Umutsuzluk Ölçeği 20 olmak üzere 35 sorudan oluşmaktadır ve yaklaşık 10 dakikada tamamlanmaktadır. Elde edilen veriler önce Microsoft Excel aracılığıyla dijitalleştirilmiş, ardından IBM SPSS 27.0.1 sürümüyle analiz edilmiştir. Verilerin analizinde Ki-kare, Fisher’s Exact testi ve Pearson Korelasyon analizi kullanılmış, istatistiksel anlamlılık değeri için p<0.05 kabul edilmiştir. Bulgular: Ankete katılan 151 bakım verenin 83’ü (%55,3) kadın, 67’si (%44,7) erkektir. Katılımcıların yaş ortalaması 40,09’dur. Bakım verenlerin %41,1’i umutsuzluk düzeyi ölçeğinde “minimal ya da yok”, %39,7'si "hafif düzeyde", %13.2'si orta düzeyde ve %6’sı “aşırı düzeyde” skorunu almıştır. KYB’lere bakım verenlerin demografik özellikleri ile umutsuzluk düzeyi arasında anlamlı bir ilişki bulunmamıştır. Bakım verenlerin yaşı, cinsiyeti, medeni durumu, gelir durumu ve bakım verme süresi ile umutsuzluk skorları arasında anlamlı bir ilişki bulunmazken, eğitim seviyesi ile umutsuzluk skorları arasında anlamlı bir ilişki bulunmuştur. Sonuç: Bakım verenlerin, umutsuzluk düzeyleri göz önüne alındığında, önemli psikolojik yükler taşıdığına ve bu yükün, özellikle bakım verenin eğitim seviyesi ile hastanın sağlık durumu arasında belirgin ilişkiler gösterdiğine ulaşılmıştır. Bu bilgiler ışığında, sosyodemografik özelliklerin bakım verenleri önemli ölçüde etkilediği görülmüştür. Bakım verenlerin duygusal yükleri, bakım alıcılarla olan ilişkileri ve bu sürecin hem bireysel hem toplumsal düzeyde getirdiği zorluklar ve sorumluluklar, ihtimam etiği kapsamında ele alınmıştır. Araştırma neticesinde bakım verenlerin karşılaştığı zorluklar ve ihtiyaçlarının daha geniş bir toplumsal ve etik perspektiften ele alınmasının gerekliliği ortaya konmuştur. Bakım verenlerin bakımına yönelik öneriler, duygusal destek; teorik eğitim ve bilgilendirme desteği; pratik ve uygulamalı destek; kaynak erişimi ve tahsisi; tanıma ve doğrulama başlıkları altında sunulmuştur. Nghiên cứu này xem xét tác động của du lịch, tiêu thụ năng lượng tái tạo và đổi mới công nghệ lên lượng phát thải CO2 tại Việt Nam trong giai đoạn 1995-2020. Ứng dụng mô hình phân phối trễ tự hồi quy (ARDL) kết hợp với phương pháp kiểm định đường bao về mối quan hệ đồng liên kết, nghiên cứu đã cung cấp các bằng chứng về mối quan hệ giữa các biến số này cả trong dài hạn (...) và ngắn hạn. Kết quả cho thấy, trong ngắn hạn lẫn dài hạn, du lịch có xu hướng làm tăng lượng phát thải CO2, trong khi việc tiêu thụ năng lượng tái tạo giúp giảm lượng phát thải. Đổi mới công nghệ cũng giúp giảm lượng phát thải CO2 ­ trong dài hạn, tuy nhiên chưa có bằng chứng về tác động này trong ngắn hạn. Một số khuyến nghị chính sách cũng được đề xuất dựa vào các kết quả nghiên cứu trên. [This study examines the impact of tourism, renewable energy consumption, and technological innovation on CO2 emissions in Vietnam over the period 1995-2020. Applying the autoregressive distributed lag (ARDL) model combined with the envelope test method on the cointegration relationship, the study has provided evidence of the relationship between these variables over the long term and short term. The results show that, in the short and long term, tourism tends to increase CO2 emissions, while renewable energy consumption helps reduce emissions. Technological innovation also helps reduce CO2 emissions in the long term, but there is no evidence of this impact in the short term. Shortages of new therapeutics to treat coronavirus disease (COVID-19) have forced clinicians, public health officials, and health systems to grapple with difficult questions about how to fairly allocate potentially life-saving treatments when there are not enough for all patients in need (1). Shortages have occurred with remdesivir, tocilizumab, monoclonal antibodies, and the oral antiviral Paxlovid (2) -/- Ensuring equitable allocation is especially important in light of the disproportionate burden experienced during the COVID-19 pandemic by disadvantaged groups, including Black, Hispanic/Latino and (...) Indigenous communities, individuals with certain disabilities, and low-income persons. However, many health systems have resorted to first-come, first-served approaches to allocation, which tend to disadvantage individuals with barriers in access to care (3). There is mounting evidence of racial, ethnic, and socioeconomic disparities in access to medications for COVID-19 (4, 5). -/- One potential method to promote equitable allocation is to use a weighted lottery, which is an allocation strategy that gives all eligible patients a chance to receive the scarce treatment while also allowing the assignment of higher or lower chances according to other ethical considerations (6). We sought to assess the feasibility of implementing a weighted lottery to allocate scarce COVID-19 medications in a large U.S. health system and to determine whether the weighted lottery promotes equitable allocation. Tuy nhiên, trong khoảng 10 năm trở lại đây, thế giới đã thường xuyên ghi nhận những vụ bê bối về đạo đức nghiên cứu tại Nhật Bản. Xem xét kĩ lưỡng nội dung chi tiết (...) các vụ bê bối có thể thấy Nhật Bản đang gặp phải những thách thức nan giải trong việc ngăn chặn và kiểm soát vi phạm đạo đức nghiên cứu. Một phần quan trọng của thách thức này là sự xung đột giữa một bên là những yếu tố có tính lịch sử và văn hóa, và bên kia là sự phát triển của công nghệ thông tin và xu hướng hợp tác quốc tế mở rộng. Nghiên cứu trường hợp của Nhật Bản có thể mang lại những bài học quan trọng trong việc xây dựng khả năng đào tạo và quản lí đạo đức nghiên cứu tại một nền khoa học mới hội nhập như Việt Nam. There are many similarities in both form and content between the path Diotima described in order to reach Beauty through Eros which we encounter in Plato's Symposion dialogue and the tenets of the Anatolian Sufism which is a religion of love. Rather than investigating whether there is any organic connec-tion between the two approaches or the channels through which such a connec-tion is established, this study aims to show the two approaches in light of each other. This paper focuses on Precision Public Health (PPH), described in the scientific literature as an effort to broaden the scope of precision medicine by extrap- olating it towards public health. By means of the “All of Us” (AoU) research pro- gram, launched by the National Institutes of Health in the U.S., PPH is being devel- oped based on health data shared through a broad range of digital tools. PPH is an emerging idea to harness the data collected for precision medicine (...) to be able to tai- lor preventive interventions for at-risk groups. The character of these data concern genetic identity, lifestyle and overall health and therefore affect the ‘intimacy’ of personhood. Through the concept of biological citizenship, we elucidate how AoU and its recruitment tactics, by resonating ‘diversity’, at the same time appeal to and constitute identity, defining individuals as ‘data sharing subjects’. Although PPH is called for; the type of bio-citizenship that is enacted here, has a particular definition, where participant recruitment focuses on ‘citizenship’ in terms of empowerment (front), it is the ‘bio’ prefix that has become the main focus in terms of research. i.e. biosubjectivities vs biocapital. This raises the question whether the societal chal- lenges that often underlie public health issues can be sufficiently dealt with based on the way ‘diversity’ is accounted for in the program. We suggest that the AoU still risks of harming underrepresented groups based on the preconditions and the design of the program. (shrink)

Cílem článku je podat kritický rozbor predikcí týkajících se budoucnosti sociálních věd, jak je formuluje Ladislav Kvasz pod záštitou svého projektu „formální epistemologie". Modelem dynamiky vztahů mezi obory na vědeckém poli nabízí Kvasz v otázce střídání paradigmat alternativu ke Kuhnově teorii vědeckých revolucí. Text zkoumá, na jakých základech je mechanismus změn u Kvasze vystavěn a co z toho plyne pro relevanci předpovědí z tohoto modelu vyvozených - především těch o sociálních vědách. K tomu slouží souběžné představení historické metody Michela Foucaulta, (...) který zdůrazňuje potřebu vyvarovat se zavádění falešných kontinuit ve zkoumání trajektorií vědeckých oborů, u kterých dochází ke zlomům v jejich epistemické struktuře. Zvláštní zřetel je kladen na souvislost predikcí s možnostmi odlišit epistemologicky a sociologicky uchopitelné prvky spojené s chodem vědy. Jako klíčový moment se tedy ukáže možnost práce se sociálně vědními obory pomocí jemných nástrojů, které Kvasz vyvinul na vědách exaktních. (shrink)

Stensen, the author of several letters usually published in the collections of Spinoza’s letters, played (...) a crucial part. The manuscript Vat. Lat. 12 838 is the only known editorial copy of Spinoza’s manuscripts and its origins are dated as early as 1675, i.e. before the publication of Opera posthuma. The comparison of its contents with the Ethics, published in 1677, points to many differences, most of which are typical mistakes, occurring probably either in Spinoza’s manuscript, or in the editorial copy, or else made by the typesetter and not expunged during the editorial proofreading. However, the editors emphasize the importance of some substantive differences of the text for the interpretation of Spinoza’s Ethics. The history of the manuscript and the circumstance it found its way to the library of The Holy Office and thence to the Vatican Apostolic Library enabled the editors to put forward some hypotheses concerning the circulation of Spinoza’s manuscripts in the period when the censure was issued against him after the publication of the Tractatus Theologico-Politicus. [his book discusses the theological views of Abū Isḥāq al-Ṣaffār d. 534/1139), within the framework of his comments on the meanings of Allah’s names, provided in his work titled Talkhīṣ al-adilla. Abū Isḥāq al-Ṣaffār is one of the Ḥanafite-Māturīdite scholars in the 6th/12th century. In his work titled Talkhīṣ al-adilla li-qawāʿid al-tawḥīd on kalām, he spared extensive space for al-asmāʾ al-husnā. Approximately one third of this work, published in two volumes, is devoted to al-asmāʾ al-husnā. An examination of the related section reveals that al-Ṣaffār explains many issues, particularly those related to the existence, unity and attributes of Allah, based on 175 al-asmāʾ al-husnā. He mentions some of the names that he does not include in the al-asmāʾ al-husnā section under separate headings. For example, the name al-Mutakallim is addressed within the context of the attribute of kalām and in relation to subjects, such as the khalq al-Qurʾān and i‘jaz al-Qurʾān. Upon the addition of these names to the list, the number names reaches 178. This means that half of the work deals with the subject of al-asmāʾ al-husnā. -/- al-Ṣaffār lists the divine names in alphabetical order and explains them semantically in the chapter of al-asmāʾ al-husnā. Then he goes on to clarify each divine name through a theological lens with a specific reference to the subject of kalām. In the pre-Saffar Ḥanafite-Māturīdite theological literature, there is no other work that addresses al-asmāʾ al-husnā in such an extensive way. -/- This book consists of three main sections. The first section titled “Methodological Framework”, elaborates on the focus, significance, purpose and method of the study, along with the sources used. The first part describes the political, social and religious status of Transoxiana (Mā-warāʾ al-Nahr) region and the cities of Bukhara and Marw, the sociocultural environment in which Saffar lived. The second chapter addresses various concepts, which promote the understanding of al-asmāʾ al-husnā, such as name, tasmiya, musammā, attribute and qualification in addition to the theological debates such as the number and iḥṣāʾ of al-asmāʾ al-husnā. Then, it provides information about the al-asmāʾ al-husnā literature produced in the pre- Ṣaffār period. The end of each chapter comes with a detailed table with the 178 divine names mentioned by al-Ṣaffār. In the third chapter, the author initially discusses the theological principles that al-Ṣaffār considered while explaining the essence of al-asmāʾ al-husnā. This section also determines and systematically categorizes the theological views and evaluations put forward by al-Ṣaffār while explaining the divine names in Talkhīṣ al-adilla. The tables with the divine names and the related discussions can be seen at the end of the discussion for each subject. The last section presents the conclusions reached, regarding the kalām method based on al-Ṣaffār’s understanding of the essence of al-asmāʾ al-husnā. The present study revealed that he made theological interpretations in 75% of the al-asmāʾ al-husnā and interpreted all theological issues ranging from the subjects of knowledge and existence to the Afterlife in connection with the al-asmāʾ al-husnā. In that famous art i c l e , Davidson put forw a rd the bold conjecture that meanings are satisfaction conditions, and that a Tarskian theory of truth for a language is a theory of meaning for that language. (...) In “Meaning and Truth,” Davidson proposed only that a Tarskian truth theory is a theory of meaning. But in “Theories of Me a n i n g and Learnable Languages,” he argued that the finite base of a Tarskian theory, together with the now familiar combinatorics, would explain how a language with unbounded expre s s i ve capacity could be learned with finite means ( Davidson    ). This certainly seems to imply that learning a language is, in p a rt at least, learning a Tarskian truth theory for it, or, at least, learning what is specified by such a theory. Davisdon was cagey about committing to the view that meanings actually a re satisfaction conditions, but subsequent followers had no such scru p l e s . We can sum this up in a trio of claims: Davidson’s Conjecture () A theory of meaning for L is a truth-conditional semantics for L. () To know the meaning of an expression in L is to know a satisfaction condition for that expression. () Meanings are satisfaction conditions. For the most part, it will not matter in what follows which of these claims is at stake. The United Kingdom's Parliamentary Bill 'Fraud Trials (Without a Jury) 2007', failed. Nevertheless, fraud trials without a jury do take place and there is much evidence to support this. Today the UK still does not support fraud trials without a jury, even though fraud in the UK today is the highest amount of fraud globally. The longer version of this paper is submitted here since it has become urgent that UK fraud trials be examined as a matter of urgency. On (...) page 87 of this complete paper (cut down for The Criminal Lawyer in 2008) a U.S study of 46 corporate fraud trials revealed that the defendants were CEOs, President, Chairman, Senior Vice Presidents, Chief Financial Officers, but only one entity reach trial stage. After the ce Arthur Anderson LLP v. United States, 544 U.S. 696 (2005), and the Lehman Brothers SEC case and the SEC v. Bank of America Corp., 653 F. Supp. 2d 507 (S.D.N.Y. 2009, and the Report by the U.S. Financial Crisis Inquiry on the 2008 financial crash, a global financial disaster was predicted and George Osborne, UK Chancellor pleaded for leniency for HSBC Bank frauds, threatening a global meltdown. The U.S. judiciary increased its volume of Deferred Prosecution Agreements and the UK followed suit. So, in year 2022, there is global financial meltdown and the UK has the highest rate of fraud in the world with few successful convictions. This paper is very relevant today as we must stop using deferred prosecution agreements and seek more convictions and harsh jail sentences for those financial fraudsters who have created this meltdown. -/- *When this paper was written, UK fraud was estimated at £40 million and some experts suspected twice that amount. Public discourse is often caustic and conflict-filled. This trend seems to be particularly evident when the content of such discourse is around moral issues (broadly defined) and when the discourse occurs on social media. Several explanatory mechanisms for such conflict have been explored in recent psychological and social-science literatures. The present work sought to examine a potentially novel explanatory mechanism defined in philosophical literature: Moral Grandstanding. According to philosophical accounts, Moral Grandstanding is the use of moral talk to seek social (...) status. For the present work, we conducted six studies, using two undergraduate samples (Study 1, N = 361; Study 2, N = 356); a sample matched to U.S. norms for age, gender, race, income, Census region (Study 3, N = 1,063); a YouGov sample matched to U.S. demographic norms (Study 4, N = 2,000); and a brief, one-month longitudinal study of Mechanical Turk workers in the U.S. (Study 5, Baseline N = 499, follow-up n = 296), and a large, one-week YouGov sample matched to U.S. demographic norms (Baseline N = 2,519, follow-up n = 1,776). Across studies, we found initial support for the validity of Moral Grandstanding as a construct. Specifically, moral grandstanding motivation was associated with status-seeking personality traits, as well as greater political and moral conflict in daily life. (shrink)

Antimicrobial resistance (AMR) is a global public health disaster driven largely by antibiotic use in human health care. Doctors considering whether to prescribe antibiotics face an ethical conflict between upholding individual patient health and advancing public health aims. Existing literature mainly examines whether patients awaiting consultations desire or expect to receive antibiotic prescriptions, but does not report views of the wider public regarding conditions under which doctors should prescribe antibiotics. It also does not explore the ethical significance of public views (...) or their sensitivity to awareness of AMR risks or the standpoint (self-interested or impartial) taken by participants. Methods: An online survey was conducted with a sample of the U.S. public (n = 158). Participants were asked to indicate what relative priority should be given to individual patients and society-at-large from various standpoints and in various contexts, including antibiotic prescription. Results: Of the participants, 50.3% thought that doctors should generally prioritize individual patients over society, whereas 32.0% prioritized society over individual patients. When asked in the context of AMR, 39.2% prioritized individuals whereas 45.5% prioritized society. Participants were significantly less willing to prioritize society over individuals when they themselves were the patient, both in general (p = .001) and in relation to AMR specifically (p = .006). Conclusions: Participants’ attitudes were more oriented to society and sensitive to collective responsibility when informed about the social costs of antibiotic use and when considered from a third-person rather than first-person perspective. That is, as participants came closer to taking the perspective of an informed and impartial “ideal observer,” their support for prioritizing society increased. Our findings suggest that, insofar as antibiotic policies and practices should be informed by attitudes that are impartial and well-informed, there is significant support for prioritizing society. In this article, I discuss prospects for democracy in the Middle East. I argue, first, that some democratic experiments—for instance, Egypt under Mohammed Morsi—are not in keeping with etymological and historical meanings of democracy; and second, that efforts to promote democracy, especially as exemplified in U.N. documents emphasizing universal rights grounded in Western traditions, are possibly totalitarian and also colonialist and hence counter to democratic ideals insofar as they impart one set of values as the only morally acceptable ones. A (...) respectful dialogue in which people from both regions strive to understand conditions giving rise to certain social practices would be more productive than morally superior attitudes, and help all to see areas where their respective cultures could be improved. I conclude by discussing concepts of democratic and pragmatic faith articulated by John Dewey and William James, arguing that democracy will continue to flounder in the Middle East so long as the basic trust implied in these concepts is lacking; and how Westerners might consider this a cautionary tale regarding social attitudes and public policies contrary to democratic life in their own countries. The present work posits that social motives, particularly status seeking in the form of moral grandstanding, are likely at least partially to blame for elevated levels of affective polarization and ideological extremism in the U.S. In Study 1, results from both undergraduates (N = 981; Mean age = 19.4; SD = 2.1; 69.7% women) and a cross-section of U.S. adults matched to 2010 census norms (N = 1,063; Mean age = 48.20, SD = 16.38; 49.8% women) indicated that prestige-motived grandstanding (...) was consistently and robustly related to more extreme ideological views on a variety of issues. In Study 2, results from a weighted, nationally-representative cross-section of U.S. adults (N = 2,519; Mean age = 47.5, SD = 17.8; 51.4% women) found that prestige motivated grandstanding was reliably related to both ideological extremism and affective polarization. Slot theory is the view that (i) there exist such entities as argument places, or ‘slots’, in universals, and that (ii) a universal u is n-adic if and only if there are n slots in u. I argue that those who take properties and relations to be abundant, fine-grained, non-set-theoretical entities face pressure to be slot theorists. I note that slots permit a natural account of the notion of adicy. I then consider a series of ‘slot-free’ accounts of that notion (...) and argue that each of them has significant drawbacks. Rules are meant to apply equally to all within their jurisdiction. However, some rules are frequently broken without consequence for most. These rules are only occasionally enforced, often at the discretion of a third-party observer. We propose that these rules—whose violations are frequent, and enforcement is rare—constitute a unique subclass of explicitly codified rules, which we call ‘phantom rules’ (e.g., proscribing jaywalking). Their apparent punishability is ambiguous and particularly susceptible to third-party motives. Across six experiments, (N = 1440) we validated (...) the existence of phantom rules and found evidence for their motivated enforcement. First, people played a modified Dictator Game with a novel frequently broken and rarely enforced rule (i.e., a phantom rule). People enforced this rule more often when the “dictator” was selfish (vs. fair) even though the rule only proscribed fractional offers (not selfishness). Then we turned to third person judgments of the U.S. legal system. We found these violations are recognizable to participants as both illegal and commonplace (Experiment 2), differentiable from violations of prototypical laws (Experiments 3) and enforced in a motivated way (Experiments 4a and 4b). Phantom rule violations (but not prototypical legal violations) are seen as more justifiably punished when the rule violator has also violated a social norm (vs. rule violation alone)—unless the motivation to punish has been satiated (Experiment 5). Phantom rules are frequently broken, codified rules. Consequently, their apparent punishability is ambiguous, and their enforcement is particularly susceptible to third party motives. (shrink)

The contribution focuses on philosophical issues of justice of positive law in the light of the social teaching of John Paul II. The analyses start with consideration of anthropological foundations of justice as virtue, develop with the reflexion upon justice of actions realizing justice and finally arrive at examination of the criteria of justice of law. -/- It is argued that relations between a human being and goods (ends of actions) form ontological basis of natural law and justice of actions (...) – orders and prohibitions are secondary in respect to these relations. An aim of just law (and natural law) is not preservation or restoration of abstractly understood moral order based on norms – orders and prohibitions) but integral development (good) of a person – a being possessing dignity. John Paul’s II philosophy of law takes advantage primarily of Thomas Aquinas’ approach to law and combines it with constructions which are typical for modern human rights protection. John Paul’s II conception of natural law is anthropocentric and bases on subjective rights thinking. Human dignity and human rights which derive from it provide basic criteria for the justice of law. Human rights as subjective rights disclose natural law which is understood as a set of goods for a human person. These goods are ends of actions and as such they determine actions and their forms. This point of view is compatible with Aquinas’ definition: “law is nothing but a rational plan of operation, and … the rational plan of any kind of work is derived from the end” (Summa contra gentiles, lib. 3, cap. 114, n. 5). -/- Positive (human) law which is not just has no normative power in this sense that it does not in itself provide reasons for concrete actions of a concrete actor. Sometimes there are moral reasons for following unjust law, however if its norm prescribes actions which are wrong in themselves (internally wrong) there is moral obligation to act contrary to such a legal norm. -/- Zasadniczym przedmiotem opracowania jest filozoficzna refleksja Jana Pawła II nad sprawiedliwością prawa stanowionego. Od strony konstrukcji teoretycznej, filozofia prawa Jana Pawła II jest osadzona przede wszystkim na koncepcji Tomasza z Akwinu łączonej z konstrukcjami typowymi dla współczesnej ochrony praw człowieka. To w godności i wynikających z niej prawach człowieka poszukiwać trzeba zasadniczych treściowych kryteriów sprawiedliwości prawa. Prawa człowieka jako prawa podmiotowe są podstawowym wyrazem prawa naturalnego, stanowiącego ontyczną podstawę sprawiedliwości i które pojmowane jest jako zespół dóbr dla osoby, zatem i celów kształtujących działanie. Perspektywa pojmowania prawa naturalnego jest antropocentryczna. Prawo stanowione, które nie jest sprawiedliwe, nie ma „mocy prawa”, przede wszystkim w takim sensie, że nie stanowi samo w sobie racji działania. Niekiedy, ze względów moralnych, niesprawiedliwe prawo wymaga posłuszeństwa. Jeśli jednak prawo stanowione daje uprawnienia do czynów wewnętrznie złych i nakazuje takie czyny, to nie tylko nie obowiązuje w sumieniu i nie jest racją działania, ale obowiązkiem jest postępowanie wbrew takiemu prawu. Can green growth policies help protect the environment while keeping the industry growing and infrastructure expanding? The City of Kitakyushu, Japan has actively implemented eco-friendly policies since 1967 and recently inspired the pursuit of sustainable development around the world, especially in the Global South region. However, empirical studies on the effects of green growth policies are still lacking. This study explores the relationship between road infrastructure development and average industrial firm size with air pollution in the city through the Environmental (...) Kuznets Curve (EKC) hypothesis. Auto-Regressive Distributed Lag (ARDL) and Non-linear Auto-Regressive Distributed Lag (NARDL) methods were applied on nearly 50-years’ time series data, from 1967 to 2015. The results show that the shape of the EKC of industrial growth, measured by average firm size, depends on the type of air pollution: inverted N-shaped relationships with NO2 and CO, and the U-shaped relationships with falling dust particle and Ox. Regarding infrastructure development, on the one hand, our analysis shows a positive effect of road construction on alleviating the amount of falling dust and CO concentration. On the other hand, the emissions of NO2 and Ox are shown to rise when plotted against road construction. The decline of CO emission, when plotted against both industrial growth and road development, indicates that the ruthlessness of the local government in pursuing green growth policies has been effective in this case. However, the story is not straightforward when it comes to other air pollutants, which hints at the limits of the current policies. The case of Kitakyushu illustrates the complex dynamics of the interaction among policy, industry, infrastructure, and air pollution. It can serve as an important reference point for other cities in the Global South when policies are formed, and progress is measured in the pursuit of a green economy. Finally, as an OECD SDGs pilot city and the leading Asian green-growth city, policymakers in Kitakyushu city are recommended to revise the data policy to enhance the findability and interoperability of data, as well as to invest in the application of big data. In finite probability theory, events are subsets S⊆U of the outcome set. Subsets can be represented by 1-dimensional column vectors. By extending the representation of events to two dimensional matrices, we can introduce "superposition events." Probabilities are introduced for classical events, superposition events, and their mixtures by using density matrices. Then probabilities for experiments or `measurements' of all these events can be determined in a manner exactly like in quantum mechanics (QM) using density matrices. Moreover the transformation of the density (...) matrices induced by the experiments or `measurements' is the Lüders mixture operation as in QM. And finally by moving the machinery into the n-dimensional vector space over ℤ₂, different basis sets become different outcome sets. That `non-commutative' extension of finite probability theory yields the pedagogical model of quantum mechanics over ℤ₂ that can model many characteristic non-classical results of QM. (shrink)

The results show that the shape of the EKC of industrial growth, measured by average firm size, depends on the type of air pollution: inverted N-shaped relationships with NO2 and CO, and the U-shaped relationships with falling dust particle and Ox. Regarding infrastructure development, on the one hand, our analysis shows a positive effect of road construction on alleviating the amount of falling dust and CO concentration. On the other hand, the emissions of NO2 and Ox are shown to rise when plotted against road construction. The decline of CO emission, when plotted against both industrial growth and road development, indicates that the ruthlessness of the local government in pursuing green growth policies is effective in this case. However, the story is not straightforward when it comes to other air pollutants, which hint at limits in the current policies. The case of Kitakyushu illustrates the complex dynamics of the interaction among policy, industry, infrastructure, and air pollution. It can serve as an important reference point for other cities in the Global South when policies are formed, and progress is measured in the pursuit of a green economy. Finally, as an OECD SDGs pilot city and the leading Asian green-growth city, policymakers in Kitakyushu city are recommended to revise the data policy to enhance the findability and interoperability of data as well as to invest in the application of big data. Does a political conception of human rights dictate a particular view of corporate human rights obligations? The U.N. “Protect, Respect, and Remedy” Framework and Guiding Principles on Business and Human Rights hold that corporations have only a responsibility to respect human rights. Some critics have argued that corporations should be responsible for a wider range of human rights obligations, beyond merely an obligation to respect such rights. Furthermore, it has been argued that the Framework relied on a political conception of (...) human rights, and this is what led to limiting corporate obligations to mere respect for human rights. In this paper, I explore and critically assess this general claim about political conceptions of human rights. This involves distinguishing different types of political conceptions of human rights, as well as specifying what makes a theory of human rights a “political conception.” In light of this clarificatory discussion, I argue that the general thesis is false; the mere fact that a theory offers a political conception of human rights does not necessarily entail any certain range of corporate human rights obligations. Finally, I identify some of the other aspects of a theory of human rights that do affect the range of corporate obligations it will prescribe. (shrink)

According to the standard interpretation of Lewis’s theory of predicate meaning (the U&N theory), the naturalness of meaning candidates should be stated metaphysically - as a length of definition in terms of fundamental properties. Recently, Weatherson has criticized the U&N theory and argued that the criterion of naturalness should be stated epistemologically - as the amount of evidence needed to form a belief. Despite the criticism, his attitude towards the U&N theory is quite relaxed. According to Weatherson, the U&N theory (...) can be used as a good heuristic for delivering the correct verdicts when doing applied semantics, i.e., when we try to determine the best meaning candidate for a particular predicate. In this paper, I try to show that the “good heuristic strategy” is of no use because A) there is no guarantee that the epistemological and the metaphysical criteria of naturalness deliver the same verdicts and B) even if they deliver the same verdicts, the difference in their theoretical backgrounds may affect arguments which rely on the verdicts. The difference will be shown by drawing on the example of Theodore Sider and his use of the U&N theory. (shrink)

En tercer lugar, damos cuenta de en qué consiste la denominada “superación del pragmatismo” por parte de Eugenio d’Ors y, por (...) último, señalamos las afinidades más relevantes de su pensamiento con algunas de las intuiciones más originales del pragmatismo de Charles S. Tato studie se zabývá zobrazováním alchymie v malbách, knižních ilustracích i v architektuře v období raného novověku. Na jednotlivých příkladech obrazů či ilustrací prezentuje různé aspekty alchymistova života i jeho práce. Nezabývá se symbolickou alchymickou ikonografií, ale zaměří se především na zobrazování prostředí a vybavení alchymických dílen i osobností samotných alchymistů. Soustředí se zejména na vyobrazení zařízení alchymických laboratorií, s nimiž se lze setkat jak u renesančních malířů, tak v ilustracích alchymických rukopisů a poměrně ojediněle i v české architektuře. Poskytuje (...) také pohled na vyobrazení vzniklá v souvislosti s literární kritikou alchymie. Alchymisté byli zejména v dílech předních evropských humanistů často záměrně zesměšňováni, kritizováni a označováni za blázny a zloděje. V závěru se zabývá vybranými příklady ze žánrového umění, kde byli rovněž alchymisté zobrazováni často satiricky, ale i s určitou úctou, jako vzdělaní učenci. Výtvarné umění raného novověku nám představuje různé aspekty života alchymistů a je v dnešní době jednou z možností, jak se přiblížit porozumění jejich vědeckým aktivitám. Jak však studie ukazuje, k těmto obrazovým materiálům je třeba přistupovat kriticky. (shrink)

Modern politika tanımlarında hâkim kavramlardan söz etmek olasıdır. Bu kavramlar arasında; iktidar, şiddet, hiyerarşi, güvenlik, kaynak dağıtımı öne çıkanlardır. Politika, birçoklarına göre, iktidarın ve gücün nasıl dağıtıldığı ve kullanıldığıyla ilgilidir. Politika, salt iktidarla ilişkili bir biçimde tanımlandığında, şiddet, politikanın etkili araçlarından birisi gibi görünür. Hatta daha ileriye gidilerek, şiddet, iktidarın dışavurumu olarak görülür. C. W. Mills’in, “siyaset iktidar mücadelesinden ibarettir; iktidarın nihai biçimi ise şiddettir” ya da Mao Zedong’un “siyaset, kan dökülmeyen savaş; savaş ise kan dökülen siyasettir” sözleri, siyaset ile (...) şiddetin birlikte düşünülmesinin en tipik örnekleridir. Hükmetme sanatı, iktidar elde etmek ve iktidarı azamileştirme biçiminde tanımlanan siyasetin, şiddeti meşru görmesi kaçınılmaz görünmektedir. Bu tanımdan hareket edenler, en iyi ihtimalle, meşru ve gayrı-meşru şiddet arasında bir ayrıma yönelirler. Bu ayrım da şiddetin politik bir etkinlik olarak meşrulaştırılmasını onaylar. Siyaseti, iktidar ve şiddet üzerinden tanımlayan hâkim yaklaşıma dönük eleştiriler de vardır. Siyaseti başka türlü tanımlamanın imkânı olup olmadığı sorusundan hareket eden bu yaklaşımlar, alternatif bir politika anlayışı ortaya koymaya çalışırlar. Bu tip politika anlayışına sahip düşünürlerin başında Hannah Arendt gelmektedir. Sahte ve sahici politika ayrımından hareket eden Arendt, sahici politikanın merkezine eylemi yerleştirir. Eylem, insanların kendilerini gerçekleştirmesini, sahici kılmasını, diğer insanlarla birlikte yaşamasını sağlayan süreçleri başlatma ve kesintiye uğratma yetisidir. Bu bakımdan politika, birlikte yaşama, kamusal meseleler hakkında tartışma ve ortak dünya için eylemde bulunma etkinliğidir. Kamusal alanda, eşitlerinin gözü önünde eylemde bulunma kişinin benzersizliğini göstermesine neden olur. Bu bakımdan, eşitlik ve çoğulluk politikanın koşuludur. Arendt, sadece eylemi değil, “söz”ü de politikanın merkezine yerleştirir. Arendt için politik yaşam, eyleme dökülmüş söz üzerine kuruludur. Politikanın söz ile ilişkilendirilmesi, açıktır ki, şiddeti dışlar. Arendt’e göre şiddet dilsizdir ve hiçbir zaman politikanın merkezi olan eyleme dökülmüş sözün neden olduğu süreç başlatma ve yaratıcı olma özelliğine sahip değildir. Bu çalışmanın amacı, politikayı Arendt’le birlikte yeniden düşünmenin, yeni bir politika tanımı için sağlayacağı imkânları tartışmaktır. (shrink)

Edmund Husserl obdržel v roce 1927 nabídku od Jamese Louise Garvina, britského editora Encyclopædia Britannica, ať napíše pro novou, tehdy čtrnáctou edici článek „Fenomenologie“. Garvin stanovil rozsah článku na 4000 slov a termín vydání na září roku 1929. Husserl pracoval na článku v časovém rozmezí mezi zářím a prosincem roku 1927, během kterého vyhotovil celkem čtyři verze. Husserl požádal o spolupráci na prvních třech verzích svého žáka Martina Heideggera, který toho času zastával profesorský stolec na univerzitě v Marburku. Heidegger strávil (...) v říjnu 1927 u Husserla několik dní, během kterých intenzivně pracovali na řečeném článku. Nicméně jejich spolupráce vedla ke vzájemnému profesnímu odcizení, protože práce na formulování článku dala vytanout nepřekonatelným obsahovým diferencím mezi oběma filosofy. Na základě Heideggerových nepřijatelných návrhů a připomínek Husserl nakonec sepsal finální, čtvrtou verzi článku již sám. Tuto poslední verzi čítající 7000 slov pak Husserl předal oxfordskému učenci Christopheru V. Salmonovi, který ji měl zkrátit a přeložit do angličtiny. Salmon sice v únoru roku 1928 opravdu dodal do redakce EB text čítající 3844 slov bez bibliografie, ovšem nejednalo se vpravdě o překlad, nýbrž dost svévolnou parafrázi. Tato podoba Husserlova článku se pak objevovala ve čtrnácté edici EB, jež se vydávala až do roku 1974, jen do roku 1956, kdy byla nahrazena článkem napsaným Johnem N. Findlayem. Původní podoba Husserlova článku byla poprvé zveřejněna až roku 1962 v rámci jeho sebraných spisů známých pod označením Husserliana, podle jejichž IX. svazku jsme vyhotovili předložený překlad z německého jazyka. Podle této edice rovněž uvádíme paginaci, která je uvedena v hranatých závorkách, přičemž stránkový přechod indikuje v textu umístěná značka |.U příležitosti 80. výročí Husserlova skonu, který připadl na rok 2018, bylo naším záměrem připomenout přínos a odkaz tohoto našeho krajana tím, že napravíme absenci překladu jeho patrně nejvíce instruktivního, přehledného a programového textu, který byť ve zkomolené podobě anglického „překladu“, po dlouhou dobu seznamoval učenou veřejnost s tím, co je to fenomenologie. Tato studie se zabývá dvěma spřízněnými jevy odehrávajícími se ve vědeckém prostředí. Jedná se o fenomén frustrace ve vědecké praxi a s ním spojenou touhu po rozpoznání vlastního výzkumu vědeckou komunitou a následně o otázku uznání od akademického společenství. Zmíněné fenomény jsou přitom úzce propojeny s ústředním tématem filosofie a sociologie vědy: kdo rozhoduje, co bude předmětem vědeckého bádání? Předkládaná studie nejprve představuje Mertonův mýtus o okamžitém rozpoznání vědeckého objevu a následně prostřednictvím exkurzu do oblasti ekonomie a na příkladech z (...) vědecké praxe poukazuje na jeho neplatnost. V závěru textu jsou společně s jejich dekonstrukcí navrhnuta možná řešení popsaných problémů. Text je také kritickým návratem ke dvěma studiím Josepha Agassiho, žáka Karla R. Poppera a tvrdošíjného zastánce kritického racionalismu, neboť právě Agassi ve svých dílech rozebírá dopady vědeckého vyloučení a neochoty naslouchat. (shrink)

Thanks to mounting discussion about projected technologies’ possibly altering the species mentally and physically, philosophical investigation of what human beings are proceeds robustly. Many thinkers contend that whatever we are has little to do with how we should behave. Yet, tampering with what the human being is may tread upon human rights to be whatever one is. Rights given in widely recognized documents such as the U.N. Declaration of the Rights of Indigenous Peoples assume what humans are and need depends (...) upon ontological assumptions about human existence. Godman turns to human ontology—just what kind of beings humans are (from an angle distinct from the other two books) and how these play into rights. She is concerned with how well the social sciences accord with what we are. Gunkel homes in on a more specific moral topic than Godman's general concern with identity’s role in rights: automata moral status and rights. He enjoins us to inquire into what human rights are before we take on the new technologies’ challenge to it. Schneider’s Artificial You, while not explicitly about rights, poses a rights quandary. Certain individuals with reputable resources and practical backing explicitly seek to evolve the species as they see fit. The urgency among these works concerns how we need a sharper idea of what we are, how we should act and be treated, and how our rights fare among potential human improvements. (shrink)

In two studies, we tested how the expression of civic hope in narratives and the perceived authenticity of civic/political actions relate to civic/political engagement. In a cross-sectional study of undergraduates (N = 230), the expression of civic hope predicted the perceived authenticity of civic actions (e.g., voting), which in turn predicted the motivation to engage in them. In a longitudinal on-line study that began 8 weeks prior to the 2020 U.S. Presidential election (N = 308 MTurk workers), overall expressions of (...) civic hope positively predicted the perceived authenticity of voting and the motivation to vote. In addition, expressions of civic hope positively predicted the perceived authenticity of voting, which in turn positively predicted the likelihood of reporting that one did vote. These findings indicate that a sense of civic hope and the experience of authenticity in political contexts may be important for democratic engagement. (shrink)

As an adherent to the U.N.’s Universal Declaration of Human Rights, the United States has made a commitment to social justice. As a part of this commitment, the U.S. maintains that the right to an education is both innate and compulsory. This paper addresses U.S. government’s failure to uphold its citizens’ educational rights, made clear by the inadequacy of the educational programs currently offered to juvenile offenders. Based on the findings of recent scholarly literature, this paper argues that both juvenile (...) and adult correctional institutions lack the resources necessary to provide proper educational instruction and adequately address the special educational needs of juvenile offenders. To help the U.S. maintain its commitment to social justice, alternatives to juvenile incarceration are proposed. (shrink)

The present study aimed to understand how status-oriented individual differences such as narcissistic antagonism, narcissistic extraversion, and moral grandstanding motivations may have longitudinally predicted both behavioral and social media responses during the early stages of the COVID-19 pandemic. Via YouGov, a nationally representative sample of U.S. adults was recruited in August of 2019 (N = 2,519; Mage = 47.5, SD = 17.8; 51.4% women) and resampled in May of 2020, (N = 1,533). Results indicated that baseline levels of narcissistic antagonism (...) were associated with lower levels of social distancing and lower compliance with public health recommended behaviors. Similarly, dominance oriented moral grandstanding motivations predicted greater conflict with others over COVID-19, greater engagement in status-oriented social media behaviors about COVID-19, and lower levels of social distancing. Insertar el fenómeno dentro del discurso es posible únicamente cuando se lo arropa conceptualmente. La metáfora cumple la función retórica cuando se aleja de su fenómeno en la vida empírica y surge en la vida simbólica como forma de expresión ulterior y conceptual respecto al fenómeno mentado. Las metáforas no son literales, sino que tienen un sentido figurado. Los límites de la metáfora en torno a la tecnología, en nuestro caso, se delimitan cuando el fenómeno no permite un segundo plano (...) retórico dentro del discurso en el que la metáfora tendría lugar. En este artículo trataré de demostrar por qué una metáfora no es útil en el lenguaje de taller o en el lenguaje técnico. (shrink)

Claude Tresmontant a su penser l’être en genèse, et il a cherché à renouveler la question de l’existence de Dieu, en en transformant la problématique en dialogue avec les sciences contemporaines. What does environmental ethics have to say about the urban context? Is the city an environment that has only negative value or is it possible, and in fact necessary, to develop ethical recommendations about how to design it? In this paper, I argue for the second of these disjuncts and sketch some ideas for an environmental city ethics. I try to show that the most important principle of such an ethics is procedural: anyone affected by a decision about the urban (...) environment must have the possibility to participate in the process of making it. This principle has certain preconditions and there are also limitations on its applicability. For example, it is plausible that there are certain ecocentric ethical obligations, which are valid independently of the implementation of the principle. I sketch an idea for how a city’s green areas can help to raise citizens’ awareness of these obligations. -/- ¿Qué se puede decir, desde la ética ambiental, acerca del contexto urbano? ¿Se trata de un ambiente únicamente con valor negativo o es posible, e incluso necesario, desarrollar recomendaciones éticas sobre cómo diseñarlo? En este texto argumento en favor de la segunda afirmación y esbozo algunas ideas respecto de una ética ambiental para la ciudad. Defiendo que el principio más importante es procedimental: toda persona afectada debe tener la posibilidad de participar en la toma de las decisiones sobre el ambiente urbano. Este principio tiene ciertas precondiciones y también algunas restricciones. Por ejemplo, es plausible pensar en obligaciones éticas ecocéntricas válidas independientemente de la implementación del principio.
