Este libro, es el segundo de la serie La Cultura en el Uruguay: una mirada desde las Ciencias Económicas. Tal como señaló en el primer volumen, los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República realizan como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un (...) aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que el conocimiento adquirido termine olvidado en los fondos de la biblioteca de dicha Facultad, entre cientos de producciones monográficas. Al igual que en el volumen anterior, se pretende en éste, continuar mostrando los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales, en una línea de investigación que me enorgullece coordinar, y en la que vuelco cotidianamente mis mayores esfuerzos. Cabe señalar, que el primer libro trató sobre diversos temas vinculados a la Cultura, atendiendo a una clasificación clásica en la disciplina que divide -o solía dividir- el objeto de estudio en Patrimonio, Artes Escénicas e Industria Cultural, y por ende, abarcó temáticas diversas. En esta segunda entrega, y ante la imposibilidad de recoger la totalidad de los trabajos monográficos producidos en el lapso comprendido entre la edición del primer y segundo volumen, se optó por efectuar una selección temática en vez de cronológica, por lo que se muestran en este libro solamente los trabajos que atañen a la Gestión y Economía de los Museos, y a un tema estrechamente vinculado, por la injerencia que tiene uno en el otro, que es el análisis económico del mercado de arte, en este caso, por medio de subastas. Todos los trabajos aquí presentados fueron tutorados por mí, aunque no en exclusividad. Primando la excelencia académica, y entendiendo que varios de los temas tratados tenían una especificidad considerable, recurrí, tal como es usual en el ámbito académico, -que valora la discusión entre pares y la consideración de opiniones de especialistas- a la ayuda de diversos colegas para que estas monografías pudieran concretarse con el mejor nivel académico posible. La primera investigación que se presenta fue realizada por las Contadoras Ana Macias y Ma. Fernanda Rimoldi, titulada Museos, una visión desde la Gestión de Calidad. Dicha investigación, tutorada conjuntamente con la especialista en calidad Cra Sara Gerpe, buscó determinar si es aplicable el Modelo Iberoamericano de Gestión de Calidad en Museos, para lo que se consideró una muestra de 14 museos montevideanos. Dicho trabajo propició un premio de un concurso organizado por el Ministerio de Educación y Cultura, denominado Tu Tesis en Cultura, y por ende, no necesita más presentación. La Cultura en Uruguay: una mirada desde las Ciencias Económicas El segundo trabajo, titulado Sistema de Museos: Planificación Estratégica. Un diagnóstico previo, de las Cras Andrea de Armas, Cecilia Moreira y Valeria Palacios, trata sobre un caso de estudio de gran importancia para el atractivo turístico y patrimonial, como es el Sistema de Museos de Colonia de Sacramento, y realiza un diagnóstico enmarcado en la gestión estratégica de las organizaciones museísticas. Las conclusiones no son generalizables a otros museos que los que integran el Sistema de Museos de Colonia, sin embargo, la metodología empleada es fácilmente extrapolable a otros museos, tanto uruguayos como del exterior, que busquen comenzar el camino de la planificación estratégica. En tercer lugar, se expone la monografía de los Contadores Yamila Hernández, Sebastián Maidán y Ana Laura Mascheroni, que trata un tema crucial en los albores del siglo XXI como es la Responsabilidad SocialCorporativa. Este trabajo también se basa en un estudio de caso, y la organización bajo análisis es el Museo del Carnaval, museo que tiene una conducta innovadora que posibilita vincular el museo con programas pioneros en responsabilidad social en Uruguay. El trabajo se denomina Balance Social Museo del Carnaval y fue tutorado en forma conjunta con un referente en Responsabilidad Social Empresaria como es el Cr. Walter Rossi. El cuarto trabajo fue una producción de los Licenciados en Economía Tatiana Cóppola y Fernando González y se titula Museos en el Uruguay: Una visión económica. La investigación buscó la relación entre la variable visitante de una institución museística, y otras variables explicativas, como son la valoración del acervo, costos operativos, apertura horaria, entre otras, logrando probar que la variable relacionada a la captación de visitantes, para la muestra analizada, es la variable Difusión. Esta monografía la tutoré en forma compartida con el Dr. Gustavo Bouquet y el Lic. Raúl Ramírez, en una situación absolutamente atípica en el que el número de tutores supera el de estudiantes. Pero bien valió la pena la excepción en vista de los excelentes logros alcanzados. Para finalizar, se presenta la monografía titulada Formación de Precios de Pintura Nacional en Subasta: un Modelo y su Aplicación con la que accedieron al título de Licenciados en Economía Javier Chiossi y Matías De Vecchi. Se incluyó dicho trabajo en este volumen, que trata básicamente sobre museos, porque entiendo que el Mercado de Arte está indudablemente vinculado a la política de compras de los museos, en especial los contemporáneos. Cabe destacar que este trabajo contó con el apoyo de la Dra. Celina Gutiérrez, quien accedió a compartir la tutoría de un tema que escapaba mis posibilidades, logrando un excelente resultado. Merece señalar que cada trabajo original supera el centenar de páginas, y que por ende, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de las investigaciones realizadas, intentando adecuar la terminología y quitándoles el formato estrictamente científico -poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. También quiero señalar, que el prólogo del primer volumen, lo finalicé con la frase: “Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida” La Facultad ha comenzado un nuevo plan de estudio, en el que se eliminó la obligatoriedad de presentar una tesina o monografía como condición necesaria para obtener el título. No obstante, aún contamos con una decena de monografías que no han sido publicadas y que espero se concreten en el o los siguientes volúmenes de esta serie. (shrink)

Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. By giving sympathy a central role, Adam Smith’s Theory of Moral Sentiments (1759) can be regarded as one of the ‘enlightened’ moral theories of the Enlightenment, insofar as it widened the scope of moral consideration beyond the traditionally restricted boundary of human beings. This, although the author himself does not seem to have been aware of this fact. In this paper, I want to focus on two aspects which I think lead to this conclusion. First, by making sentience the requisite (...) to be taken into moral consideration, nonhuman animals in Smith’s moral theory can count as moral patients towards whom we should exercise the virtue of beneficence (if not justice). Secondly, Smith’s idea of morality as working in concentric circles –generating more stringent duties towards those closer to us– could explain and perhaps also justify our caring for some nonhuman animals, especially pets. Perception of time is susceptible to distortions; among other factors, it has been suggested that the perceived duration of a stimulus is affected by the observer’s expectations. It has been hypothesized that the duration of an oddball stimulus is overestimated because it is unexpected, whereas repeated stimuli have a shorter perceived duration because they are expected. However, recent findings suggest instead that fulfilled expectations about a stimulus elicit an increase in perceived duration, and that the oddball effect occurs because the (...) oddball is a target stimulus, not because it is unexpected. Therefore, it has been suggested that top-down attention is sometimes sufficient to explain this effect, and sometimes only necessary, with an additional contribution from saliency. However, how the expectedness of a target stimulus and its salient features affect its perceived duration is still an open question. In the present study, participants’ expectations about and the saliency of target stimuli were orthogonally manipulated with stimuli presented on a short (Experiment 1) or long (Experiment 2) temporal scale. Four repetitive standard stimuli preceded each target stimulus in a task in which participants judged whether the target was longer or shorter in duration than the standards. Engagement of top-down attention to target stimuli increased their perceived duration to the same extent irrespective of their expectedness. A small but significant additional contribution to this effect from the saliency of target stimuli was dependent on the temporal scale of stimulus presentation. In Experiment 1, saliency only significantly increased perceived duration in the case of expected target stimuli. In contrast, in Experiment 2, saliency exerted a significant effect on the overestimation elicited by unexpected target stimuli, but the contribution of this variable was eliminated in the case of expected target stimuli. These findings point to top-down attention as the primary cognitive mechanism underlying the perceptual extraction and processing of task-relevant information, which may be strongly correlated with perceived duration. Furthermore, the scalar properties of timing were observed, favoring the pacemaker-accumulator model of timing as the underlying timing mechanism. (shrink)

Andrea Cesalpino is an important figure in the history of science. He demonstrated that blood circulates into heart from veins and from the heart to arteries, paving the way to Harvey’s complete description of blood circulation. Moreover, he was the founder of botany as a systematic discipline, which he based, rather than on the observation of accidental similarities of plants, on the discovery of their vegetative-generative principle. In philosophy, he attempted to conciliate the immortality of the soul (i.e., the (...) form of the body) with the existence of a unique immaterial intellect, which is individuated and multiplied in the singular souls that participate to it. It is widely acknowledged that the Galilean Relativity Principle, according to which the laws of classical systems are the same in all inertial frames in relative motion, has played an important role in the development of modern physics. It is also commonly believed that this principle holds the key to answering why, for example, we do not notice the orbital velocity of the Earth as we go about our day. And yet, I argue in this paper that the precise content (...) of this principle is ambiguous: standard presentations, in both physics and philosophy, fail to distinguish between two principles that are ultimately inequivalent, the “External Galilean Relativity Principle” (EGRP) and the “Internal Galilean Relativity Principle” (IGRP). I demonstrate that EGRP and IGRP play distinct roles in physics practice (e.g., EGRP is connected to the concept of Galilean invariance, but IGRP is not) and that many classical systems that satisfy IGRP fail to satisfy EGRP. I further show that the Relativity Principle introduced by Einstein in 1905—which is not restricted to classical systems—also leads to two inequivalent principles, an external one analogous to EGRP, and an internal one analogous to IGRP. I conclude by noting that the phenomenon originally captured by Galileo’s famous ship passage is much more general than contemporary discussions in the philosophy of symmetries suggest. (shrink)

Imagine that we are on a train playing with some mechanical systems. Why can’t we detect any differences in their behavior when the train is parked versus when it is moving uniformly? The standard answer is that boosts are symmetries of Newtonian systems. In this paper, I use the case of a spring to argue that this answer is problematic because symmetries are neither sufficient nor necessary for preserving its behavior. I also develop a new answer according to which boosts (...) preserve the relational properties on which the behavior of a system depends, even when they are not symmetries. (shrink)

From the end of the twelfth century until the middle of the eighteenth century, the concept of a right of necessity –i.e. the moral prerogative of an agent, given certain conditions, to use or take someone else’s property in order to get out of his plight– was common among moral and political philosophers, who took it to be a valid exception to the standard moral and legal rules. In this essay, I analyze Samuel Pufendorf’s account of such a right, founded (...) on the basic instinct of self-preservation and on the notion that, in civil society, we have certain minimal duties of humanity towards each other. I review Pufendorf’s secularized account of natural law, his conception of the civil state, and the function of private property. I then turn to his criticism of Grotius’s understanding of the right of necessity as a retreat to the pre-civil right of common use, and defend his account against some recent criticisms. Finally, I examine the conditions deemed necessary and jointly sufficient for this right to be claimable, and conclude by pointing to the main strengths of this account. According to the orthodox view, one can appeal to the symmetries of a theory in order to show that it is impossible to measure the properties that are not invariant under such symmetries. For example, it is widely believed that the fact that boosts are symmetries of Newtonian mechanics entails that it is impossible to measure states of absolute motion in a Newtonian world (these states vary under boosts). This paper offers an overview of the various ways by which philosophers (...) have spelled out the connection between the symmetries of a theory and the alleged impossibility of measuring some properties (the variant ones). The paper will use the case of absolute motion as a case study, and will discuss a recent unorthodox view according to which this kind of motion can actually be measured in Newtonian mechanics. The paper ends by considering some avenues by which the discussion can be further developed. (shrink)

Narrowly understood, veganism is the practice of excluding all animal products from one’s diet, with the exception of human milk. More broadly, veganism is not only a food ethics, but it encompasses all other areas of life. As defined by the Vegan Society when it became an established charity in the UK in 1979, veganism is best understood as “a philosophy and way of living which seeks to exclude – as far as is possible and practicable – all forms of (...) exploitation of, and cruelty to, animals for food, clothing or any other purpose; and by extension, promotes the development and use of animal-free alternatives for the benefit of humans, animals and the environment”. There are two main moral justifications for veganism, both of which rely on a common assumption: that sentience, i.e., the capacity to feel pleasure and pain, is the necessary and sufficient trait to be morally considerable. In what follows, I present these two justifications and a third one which, although less popular, captures some core intuitions among vegans. I then present a challenge faced by veganism and two arguments that reject it as discriminatory, and briefly conclude. (shrink)

At the basis of modern natural law theories, the concept of the suum, or what belongs to the person (in Latin, his, her, its, their own), has received little scholarly attention despite its importance both in explaining and justifying not only the genealogy of property, but also that of morality and war.1 In this paper I examine Hugo Grotius's what it is, what things it includes, what rights it gives rise to and how it is extended in the transition from (...) the state of nature to civil society. I then briefly point out how bringing this concept back to the fore could help to illuminate the current discussion on the foundations of basic human rights, and to evaluate cases where these seem to clash with property rights. The importance of the working document is that it allows the analysis of the information and the status of cases associated with (SARS-CoV-2) COVID-19 as open data at the municipal, state and national level, with a daily record of patients, according to a age, sex, comorbidities, for the condition of (SARS-CoV-2) COVID-19 according to the following characteristics: a) Positive, b) Negative, c) Suspicious. Likewise, it presents information related to the identification of an outpatient and / or hospitalized patient, attending to (...) their medical development, identifying: a) Recovered, b) Deaths and c) Active, in Phase 3 and Phase 4, in the five main population areas speaker of indigenous language in the State of Veracruz - Mexico. The data analysis is carried out through the application of a data mining algorithm, which provides the information, fast and timely, required for the estimation of Medical Care Scenarios of (SARS-CoV-2) COVID-19, as well as for know the impact on the indigenous language speaking population in Veracruz. For this purpose, the following study zones are presented: a) Totonacapan Zone, b) Huasteco from the Tantoyuca Zone, c) Otomi from the Inxhuatlan de Madero Zone, d) Nahuatl from the Zongolica Zone, e) Nahuatl from the Chicontepec Zone, f) Nahualt from the Pajapan Zone and g) Popoluca from the Soteapan Zone. The purpose of this essay is to look at whether Aquinas teaches in De veritate [DV], q. 1, a. 4, that truth is a form inherent in things. I take up this investigation because I am examining Lawrence Dewan's account of Aquinas's teaching on truth.1 On Dewan's account, a significant development occurs in Aquinas's teaching as regards truth as it is found in things. Before the Summa theologiae [ST], Aquinas thought that in addition to truth being in the intellect, it (...) was also in things. In ST, most explicitly in I, q. 16, a. 6, Aquinas no longer thinks that it is in things, but only in the mind. When Dewan says that before the ST truth is "in things" and in the ST it is not "in things," in both cases, by "in things," Dewan means "as a form inherent in things." What exactly this means for Dewan will be gradually brought out as I examine the text Dewan thinks most clearly teaches that truth is a form inherent in things: DV, q. 1, a. 4. (shrink)

Winds of change, from the political perspective in Mexico, invite us to reformulate the methodological vision for the direction of public policy in the field of social development, directing their actions towards the construction of a methodological proposal that allows us to direct ourselves towards achieving higher levels of Well-being Social in our country, as a desirable objective of public policy and which is expected to be inclusive, participatory and democratic. -/- In this sense, it is important to recognize that (...) the current debate, in the academic and political sphere, questions what is being well? What is the life that is worth living? And that, additionally, the recognition of the satisfaction of life goals, at an individual and collective level, which invites us to reflect, if the current economic and social policy and strategy has produced results in what we envision as social welfare? Is a new approach necessary to solve the problem? What strategy should it be to consider the new methodological approach that seeks social welfare? And what components should be considered in the measurement of social welfare? This document is an invitation to review the concept of social welfare, as a proposal whose purpose is to correct the deficiencies or historical deficiencies suffered by the population, in the elemental enjoyment of social rights, a situation that causes social backwardness, marginalization, and that it is aimed at the impossibility of participating in the social decisions of the community and in collective decisions, such as: speaking, proposing, being heard and demanding compliance with fundamental human rights such as: health, food, housing, employment and security, among others. These deficiencies in the enjoyment of social and human rights are seen in the presence of social exclusion, and that together these social deficiencies explain the degree of multidimensional poverty suffered by the population in rural and urban areas. It is here that he invites us to reflect: what is the problem that social welfare seeks to solve? Multidimensional poverty, social exclusion, social backwardness or social inequality? And consequently, how to define the components to identify social welfare? -/- The document is made up of three sections: i) Social welfare: A retrospective look; ii) Social Welfare, an integrative view: The contribution of Sen, Naussbam, Rawls, Actis Di Pasquale and Keyes; and iii) Social Welfare: The recognition of limits in economic development -/- The first section presents a review of the proposals, which in the area of economic development have been presented since 1968 in the Human Condition Project, until the 2015 proposal of Sustainable Development Goals. -/- In the second section, the contributions of (Rawls, 1995), (Sen, 1982), (Nussbaum, 2011), (Keyes, 1998) , (Actis Di Pasquale, 2015) and (Actis Di Pasquale, 2017) are presented in order to present an integrative approach to the concept of social welfare. The problem of identity is central to epistemic transference. However, relative identity appears to be the only way to work out an epistemic useful notion of identity. Relative identity, on its part, is either parasitic on strict identity or not identity at all. If, on the contrary, we ought for a strict concept of identity capable of satisfying its requirements, we end up with a tautologic and epistemic worthless category. The paper provides an answer to this problem, which, while working (...) with a strict notion, shows how it might still serve epistemic purposes. In doing so, it shows how a formal reconstruction of our objectual world and the identities we refer to poses a workable model upon which our messy epistemic one acquires stability. In this paper, I accomplish a conceptual task and a historical task. The conceptual task is to argue that (1) Einstein’s Principle of Separability (henceforth “separability”) is not a supervenience principle and that (2) separability and entanglement are compatible. I support (1) by showing that the conclusion of Einstein’s incompleteness argument would still follow even if one assumes that the state of a composite system does not supervene on the states of the subsystems, and by showing that what Einstein says (...) in “Quantum Mechanics and Reality” (1948) strongly suggests that separability is not a principle about how subsystem states relate to the state of composite systems. I support (2) by showing that if separability was incompatible with entanglement, then Einstein’s argument would be incoherent in a trivial way. Thus, by arguing for (1) and (2) I directly challenge what has been, and still is, a very common reading of separability. The historical task is to offer the first detailed review of the different ways in which separability has been defined by physicists and philosophers in the last 60 years. Among other things, such a review distinguishes three different definitions of the principle, and shows that since the 1990s and up until the present date, it became standard to take separability (as presented by Einstein) to be a supervenience principle. Cotard syndrome is a clinical condition defined by the presence of nihilistic delusions. We report two patients with Cotard syndrome in whom anti-NMDAR encephalitis (ANMDARE) was confirmed. Both cases showed features of affective psychosis, developed catatonic syndrome, and worsened after the use of antipsychotics. 18F-FDG PET brain studies showed a bilateral hemispheric pattern of hypometabolism in posterior regions, mainly in the cingulate cortex and in the medial aspects of parietal and occipital lobes. A more severe hypometabolism was observed in the (...) right hemisphere of both patients. Both cases remitted with the use of specific immunotherapy for ANMDARE. (shrink)

Jesse Prinz's The Emotional Construction of Morals is an ambitious and intriguing contribution to the debate about the nature and role of emotion within moral psychology. I review Prinz's recent claims surrounding the nature of emotional concepts as ?embodied representations of concern? and survey his later arguments meant to establish a form of cultural relativism. Although I suggest that other theories of emotional representation (i.e. prototype views) would better serve Prinz's aims, the underlying meta-ethical relativism that results is well defended (...) and represents a significant advance for constructivist Sentimentalists. Abstracts The aim of the paper is to propose an alternative model to realist and non-cognitive explanations of the rule-guided use of thick ethical concepts and to examine the implications that may be drawn from this and similar cases for our general understanding of rule-following and the relation between criteria of application, truth and correctness. It addresses McDowell’s non-cognitivism critique and challenges his defence of the entanglement thesis for thick ethical concepts. Contrary to non-cognitivists, however, I propose to view the (...) relation between the two terms of the entanglement as resulting from the satisfaction of a previously applied moral function. In popular culture psychopaths are inaccurately portrayed as serial killers or homicidal maniacs. Most real-world psychopaths are neither killers nor maniacs. Psychologists currently understand psychopathy as an affective disorder that leads to repeated criminal and antisocial behavior. Counter to this prevailing view, I claim that psychopathy is not necessarily linked with criminal behavior. Successful psychopaths, an intriguing new category of psychopathic agent, support this conception of psychopathy. I then consider reactive attitude theories of moral responsibility. Within this tradition, psychopaths are (...) thought to be blameless as a result of their pronounced affective deficits. Psychopaths are considered morally blind because they lack the moral emotions that make us sensitive to moral reasons. I argue that, even if they are morally blind, psychopaths remain open to forms of blame stemming from non-moral reactive attitudes. These reactive attitudes remain appropriate because psychopaths can express hateful, disgusting, or contemptible non-moral values in their judgments. (shrink)

Gabriel Bonnot de Mably takes up the republican commonplace that the desire for esteem is what could motivate the fulfilment of duties of civic virtue. This commonplace, however, has become problematic through the discussion of the problem of human corruption in philosophers such as Blaise Pascal and Nicolas Malebranche. In this article, I will show that Mably takes this problem seriously. However, his critique of Malebranche’s solution to this problem and his critique of the economic reinterpretation of Malebranche’s concept of (...) natural order in the work of Le Mercier de la Rivière motivate his own republican defense of the moral value of the desire for esteem. What makes this defense plausible is his argument that distorted esteem derives from imagination that is distorted, not only as a result of natural factors, but in many cases rather as a result of misguided politics. El fenómeno de la corrupción es un cáncer que afecta a nuestro país y que es necesario erradicar; éste diluye las oportunidades de desarrollo económico y social, privilegiando la sola conjunción de intereses particulares, de actores políticos en acuerdos no legales en beneficio propio, los cuales derivan en actos de corrupción. Estudios recientes señalan que el nivel de corrupción presente en un sistema político está directamente relacionado con el tipo de estructura institucional que lo defina (Boehm y Lambsdorff, 2009), así (...) como de la ineficacia de los organismos de control (Casar, 2015; Cárdenas, 2010; Rojas, 2010; Carbonell, 2009; Restrepo, 2004), por lo que se requiere de la acción ciudadana para combatir la corrupción (Sandoval, 2010; Villanueva, 2006). Este trabajo, centra nuestra atención en la administración pública federal, presentando como propuesta para empoderar la acción ciudadana en el combate de la corrupción y en el Sistema Nacional Anticorrupción; la figura de Whistleblowers o generador de alerta ciudadana, desde dos principios fundamentales: i) reconociendo la obligación del ciudadano de informar sobre actos de corrupción y ii) el otorgamiento por parte de la autoridad de la protección de testigos. Estas dos acciones derivarán en dos resultados importantes: i) Consolidar la denuncia ciudadana para informar a la sociedad sobre actos de corrupción y ii) y el ejercicio de la libertad de la información a fin de que la sociedad este en posibilidades de ser informada sobre actos de corrupción. Estas acciones permitirán promover y consolidar una cultura de la denuncia de actos de corrupción que pueden ser constitutivos de delito como pilar fundamental en el Sistema Nacional Anticorrupción en México. In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

In the face of the criticism raised against Habermas distinction between morality and ethics and its universalist foundation of morality, it is argued that the priority of moral objectives results constitutively out of the normative reflection structure of the thinking subject, on which depend both the life objectives and corresponding social order in the specific contexts, as well as the personal ones; expanding, thus, the frame of the structurally constitutive in practical reflection. El ensayo ofrece una mirada histórico-crítica sobre las transformaciones que condujeron desde el kitsch de principios del siglo XX hasta el neokitsch contemporáneo: desde la génesis del kitsch hasta su afirmación como una de las manifestaciones más tangibles de la cultura de masas. Integrándose con (...) la estética posmoderna, el kitsch se transforma en neokitsch, una estética que utiliza el kitsch como su propia sintaxis en el complejo escenario de la estética contemporánea. /// -/- Kitsch is not just a category that has defined one of the possible aesthetic grammars of modernity, but also an anthropological dimension that has had different configurations in the course of historical processes. The essay offers a historical-critical look at the transformations that led from the early twentieth century kitsch to the contemporary neokitsch: from the genesis of kitsch to its affirmation as one of the most tangible manifestations of mass culture. Integrating with postmodern aesthetics, kitsch turns into neokitsch, an aesthetic that deliberately uses kitsch as its own syntax in the complex scenario of contemporary aesthetics. (shrink)

This essay proposes a new way to read José Martí's idea of "Nuestra América," one that focuses on the mode of the call for unity toward liberation and decoloniality. In particular, I offer the arguments for this Latin American unity that would define a collective form of resistance against our colonial past and present (Europe) and an imperialist future (USA). It can be argued that it is extremely difficult to translate the Cuban author's thought by itself to our contemporary struggles, (...) and that this notion runs the risk of being an outdated, naïve, and even detrimental reduction of a too complex racial reality. In this essay, I defend a way in which this notion is still relevant today by alluding to the mode of a decolonial return to one's own land in the works of Édouard Glissant and Gloria Anzaldúa. In these two authors I see elements of the criticism of a colonial rootedness and filiation, linking a decolonial attitude toward the land with a particular way of returning to it: one that challenges a mythical, pure territorial space, and also reimagines the temporality of the return by focusing on the present. With the help of this novel gesture of returning to the land, I argue that Martí's nuestra América voices a call for unity and independence that still has value beyond its undeniable shortcomings. We aim to generate a dilemma for virtual reality-based research that we motivate through an extended case study of Judith Thomson’s (1985) Bridge variant of the trolley problem. Though the problem we generate applies more broadly than the Bridge problem, we believe it makes a good exemplar of the kind of case we believe is problematic. First, we argue that simulations of these thought experiments run into a practicality horn that makes it practically impossible to produce them. These problems revolve (...) around concepts that we call “perspectival fidelity”and “context realism.” Moral dilemmas that include features present in the Bridge variant will, as a result, be practically impossible to simulate. We also argue that, should we be wrong about the practical impossibility of creating a VR simulation of Bridge, such a simulation must face an ethical horn which renders these simulations ethically impermissible to develop or use. For these reasons, we argue that it is virtually impossible to simulate the bridge problem (and other thought experiments with similar features) both practically and ethically in VR. (shrink)

By synthesizing research from psychology, economics, and philosophy, Propelled criticizes notions of well-being that overly focus on positive emotions and experiences. Against a tradition that has condemned boredom and frustration to be emotional obstacles that hinder human flourishing, Propelled shows that to live a good life we must experience and react appropriately to both. In addition, it argues that we need to anticipate, wait for, and even long for future events. Boredom, frustration, and anticipation are not unpleasant accidents of our (...) lives. Rather, they are vital psychological states that illuminate our desires and expectations, inform us of when we find ourselves stuck in unpleasant and unfulfilling situations, and motivate us to furnish our lives with meaning, interest, and value. Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

I argue that deep brain stimulation (DBS) is a bad approach for incarcerated psychopaths for two reasons. First, given what we know about psychopathy, empathy, and DBS, it is unlikely to function as an effective treatment for the moral problems that characterize psychopathy. Second, considerations of neurodiversity speak against seeing psychopathy as a mental illness in the first place.

The present proposal is an approach to the vision, cosmogony and philosophy of the Totonacapan people, and particularly with the inhabitants of the Totonacapan region in Veracruz Mexico, a town whose wisdom is manifested to this day, in the conservation of customs and traditions , as well as the hierarchy of collective desire that seeks health, well-being and peace in the region, are guides in the evolution of their cultural processes, where a closeness, respectful and deep with Mother Nature stands (...) out. This wisdom by the Council of Elders, transmitted to the new generations, by the Supreme Council of Totonacapan who seek share the basis to understand and conceive the current world, from the ancestral vision and cosmogony to identify their space, thought, spirituality and in the building your social context. In the Totonacapan region, the first pre-hispanic population concentrations were located around 1259 to 1311. Already by the year 1450, there is a record of incursions and the conquest of Totonaca territory, by the Mexica, establishing a relationship of domain and subordination. As a result of the presence of "Mexica" in the Totonaco territory, there was an imposition of customs and language, since in some areas they begin to speak in Nahuatl, resulting in the presence of a bilingualism (Nahuatl-Totonac) , situation that persists, until the encounter with the Spaniards in the year of 1519. At present, the Totonacapan region includes the area that extends from the Cazones River to the north, to the towns of Gutiérrez Zamora and Tecolutla, in the State of Veracruz in Mexico. 2 The importance of the document is that it constitutes an invitation to deepen and understand the vision of the inhabitants of Totonacapan, in the construction of their social context and their connection with nature, as part of an ancient culture, which creates and recreates their vision, in the search for the feeling of belonging and as an inheritance of the children of thunder (Tajin), as well as the need to preserve the benefits that nature itself offers them, seeking a peaceful and harmonious coexistence, in the social and environmental environment. However, the preservation of its history, tradition and philosophy of life, contrast with public policy strategies, particularly in the social sphere, and which are aimed at achieving economic development in the fight against multidimensional poverty and marginalization, all Once they have not incorporated into them, the feeling and living of the relationship between individual and nature, as the guiding axis, of the philosophy of the Totonacapan people. What is sustainability for the people of Totonacapan? What is social justice in the search for sustainability? And what is your concept of justice in sustainability and human development? From the vision and philosophy of the people of Totonacapan, as part of the history and tradition of the children of thunder "Tajin" and in whose worldview, he is responsible for regulating the rain, climate and life of the people of the region. How does the people of Totonacapan live and live in the face of the maelstrom of actions that, from public policy, that seek human development? How do you adjust, your way of life and how do you adapt to the requirements, which from the perspective of justice, are required to contribute to the objectives of the 2030 development agenda? This document is an effort to learn and recognize one of the most important millenary cultures in Mexico, in the construction of a more inclusive vision of the social development of the Totonacapan people, which invites us to reflect on the direction and scope of this response. This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)

In the commentary, a survey of the life and intellectual endeavours of Hartzing is provided.

The present paper deals with the ontological status of numbers and considers Frege ́s proposal in Grundlagen upon the background of the Post-Kantian semantic turn in analytical philosophy. Through a more systematic study of his philosophical premises, it comes to unearth a first level paradox that would unset earlier still than it was exposed by Russell. It then studies an alternative path, that departin1g from Frege’s initial premises, drives to a conception of numbers as synthetic a priori in a more (...) Kantian sense. On this basis, it tentatively explores a possible derivation of basic logical rules on their behalf, suggesting a more rudimentary basis to inferential thinking, which supports reconsidering the difference between logical thinking and AI. Finally, it reflects upon the contributions of this approach to the problem of the a priori. (shrink)

What is the relation between metaphysical necessity and essence? This paper defends the view that the relation is one of identity: metaphysical necessity is a special case of essence. My argument consists in showing that the best joint theory of essence and metaphysical necessity is one in which metaphysical necessity is just a special case of essence. The argument is made against the backdrop of a novel, higher-order logic of essence, whose core features are introduced in the first part of (...) the paper. The second part investigates the relation between metaphysical necessity and essence in the context of HLE. Reductive hypotheses are among the most natural hypotheses to be explored in the context of HLE. But they also have to be weighed against their non-reductive rivals. I investigate three different reductive hypotheses and argue that two of them fare better than their non-reductive rivals: they are simpler, more natural, and more systematic. Specifically, I argue that one candidate reduction, according to which metaphysical necessity is truth in virtue of the nature of all propositions, is superior to the others, including one proposed by Kit Fine, according to which metaphysical necessity is truth in virtue of the nature of all objects. The paper concludes by offering some reasons to think that the best joint theory of essence and metaphysical necessity is one in which the logic of metaphysical necessity includes S4, but not S5. This paper makes two essential claims about the nature of shame and shame punishment. I argue that, if we properly understand the nature of shame, that it is sometimes justifiable to shame others in the context of a pluralistic multicultural society. I begin by assessing the accounts of shame provided by Cheshire Calhoun (2004) and Julien Deonna, Raffaele Rodogno, & Fabrice Teroni (2012). I argue that both views have problems. I defend a theory of shame and embarrassment that connects both (...) emotions to “whole-self” properties. Shame and embarrassment, I claim, are products of the same underlying emotion. I distinguish between moralized and nonmoralized shame in order to show when, and how, moral and non-moral shame may be justly deployed. Shame is appropriate, I argue, if and only if it targets malleable moral or non-moral normative imperfections of a person’s ‘whole-self.’ Shame is unjustifiable when it targets durable aspects of a person’s “whole-self.” I conclude by distinguishing shame punishments from guilt punishments and show that my account can explain why it is wrong to shame individuals on account of their race, sex, gender, or body while permitting us to sometimes levy shame and shame punishment against others, even those otherwise immune to moral reasons. According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. (...) In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. In metasemantics, semantic dispositionalism is the view that what makes it the case that, given the value of the relevant parameters, a certain linguistic expression refers to what it does are the speakers’ dispositions. In the literature, there is something like a consensus that the fate of dispositionalism hinges on the status of three arguments, first put forward by Saul Kripke ‒ or at least usually ascribed to him. This paper discusses a different, and strangely neglected, anti-dispositionalist argument, which develops (...) some remarks first put forward by Paul Boghossian and Anandi Hattiangadi and revolves around the idea that semantic dispositionalists have no way to justify their privileging certain dispositions, the ones they take to be reference-determining, over all the others. After some background (Section 1) and a first presentation of the argument (Section 2), I discuss three ways a dispositionalist might try to answer it and find them all wanting (Section 3). (shrink)

The aim of this chapter is to articulate the ways in which our social standing, and particularly our socio-economic status (SES), affects, even transforms, the experience of boredom. Even if boredom can be said to be democratic, in the sense that it can potentially affect all of us, it does not actually affect all of us in the same way. Boredom, I argue, is unjust—some groups are disproportionately negatively impacted by boredom through no fault of their own. Depending on our (...) social position and self and others’ perceptions of our SES, we can experience it more frequently, more intensely, and in ways that either leave us incapable of alleviating it or push us to harmful and maladaptive responses to it. Hence, seen in a socio-economic light, boredom can become a serious threat to our physical and psychological well-being. Insofar as freedom to pursue and achieve one’s well-being is essential to human life and a primary concern of contemporary liberal societies, boredom should be considered to be a social justice issue. The disproportionately negative effects of boredom on lower SES groups indicate the profound ways that boredom affects individuals and further disadvantages those who are already in marginalized positions. Contrary to many historical accounts, boredom is not only the experience of the elite, the wealthy, or those with ample free time. In our current political, social, and economic climate, boredom is primarily the experience of the less privileged, the disadvantaged, and the marginalized. (shrink)

We define a formal semantics of conditionals based on _normatively ideal worlds_. Such worlds are described informally by Armgardt (Gabbay D, Magnani L, Park W, Pietarinen A-V (eds) Natural arguments: a tribute to john woods, College Publications, London, pp 699–708, 2018) to address well-known problems of the counterfactual approach to causation. Drawing on Armgardt’s proposal, we use iterated conditionals in order to analyse causal relations in scenarios of multi-agent interaction. This results in a refined counterfactual approach to causal responsibility in (...) legal contexts, which solves overdetermination problems in an intuitively accessible manner. (shrink)

It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

This paper explores an idea of Stoic descent that is largely neglected nowadays, the idea that an argument is valid when the conditional formed by the conjunction of its premises as antecedent and its conclusion as consequent is true. As it will be argued, once some basic features of our naıve understanding of validity are properly spelled out, and a suitable account of conditionals is adopted, the equivalence between valid arguments and true conditionals makes perfect sense. The account of validity (...) outlined here, which displays one coherent way to articulate the Stoic intuition, accords with standard formal treatments of deductive validity and encompasses an independently grounded characterization of inductive validity. In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . This paper aspires to meet a philosophical challenge posed to the author to give treatment to what was seen as a particularly nice Meinongian case1; namely the case of Galician Meigas. However, through the playful footpaths of enchanted Galician Meigas, I rehabilitate some relevant discussion on the justification of belief formation and come to some poignant philosophical insights regarding the understanding of possibilities. he territorial impacts of climate change will affect millions. This will happen not only as a direct consequence of climate change, but also because of policies for mitigating it—for example, through the installation of large wind and solar farms, the conservation of land in its role as carbon sink, and the extraction of materials needed for renewable energy technologies. In this article, we offer an overview of the justice-related issues that these impacts create. The literature on climate justice and territory (...) is vast and spans a range of disciplines, so we limit our discussion to a specific understanding of territory and a specific understanding of injustice that arises from its loss. We understand territory as a normative concept that describes a place under some agent's jurisdiction, where the agent is a politically organized collective and where the jurisdictional rights over that place secure a relevant degree of self-determination for that collective. Accordingly, we consider that the main injustice connected to the loss of territory due to climate change is the loss or undermining of the ability to exercise the collective right to self-determination, which requires some control over the place. This can happen if a territorial agent literally loses the ground where to stand as a direct effect of climate change, raising issues of justice in relocation; or if their place changes due to mitigation policies, affecting their use and understanding of territory, raising issues of justice in energy transition. This paper considers some uses of Free Indirect Discourse within non-fictional discourse. It is shown that these differ from ordinary uses in that they do not attribute actual thoughts or utterances. I argue that the explanation for this is that these uses of Free Indirect Discourse are not assertoric. Instead, it is argued here that they are fictional uses, that is, they are used with fictional force like utterances used to tell a fictional story. Rather than making assertions about the (...) actual world, these occurrences of Free Indirect Discourse introduce localized fictional scenarios from which audiences are meant to learn factual information. As such, they exhibit some of the ways in which the involvement of perspective in historical fiction has been shown to facilitate learning and retention of information. (shrink)
