Our reflections on LAWS issues are the result of the work of our research group on AI and ethics at the Informatics Center in partnership with the Information Science Department, both from the Federal University of Pernambuco, Brazil. In particular, our propositions and provocations are tied to Bianca Ximenes’s ongoing doctoral thesis, advised by Prof. Geber Ramalho, from the area of computer science, and co-advised by Prof. Diego Salcedo, from the humanities. Our research group is interested in answering two (...) tricky questions: What would an ethical AI be? And how can one guarantee that a given intelligent system will follow intercultural human ethical principles? (shrink)

O presente artigo almeja demonstrar que em Einleitung in die Logik und Erkenntnistheorie, de 1906/07, por meio de uma crítica ao ceticismo, Husserl promove uma mudança que será significativa no desenvolvimento posterior de sua filosofia: a introdução da εποχή. Ao contrário do ceticismo grego, tal conceito em Husserl, ao suspender o juízo, busca um dado indubitável: o ego. Isso proporciona com que Husserl supere o ceticismo, tanto em sua face dogmática (negação de possibilidade de todo o conhecimento), quanto crítica (suspensão (...) do juízo perante o alcance do conhecimento). Com isso, pode-se perceber que ao retomar um conceito cético da filosofia antiga, e opor-se ao relativismo, Husserl inaugura o seu primeiro esboço de uma filosofia pura, que adiante será concretizada, em sua última fase, como idealismo fenomenológico-transcendental. Entrevista concedida a partir da presença da filósofa em encontro realizado no dia 12 de dezembro de 2020 a convite do Grupo de Pesquisa, Ensino e Extensão em Ética Animal da Universidade Federal de Uberlândia para apresentação e discussão de sua obra “Galactolaria: mau deleite” (2012). Em nome da Revista Primordium, os discentes do curso de graduação e pós-graduação em Filosofia da UFU, Laís Oliveira Rios e Gustavo Henrique de Freitas Coelho, prepararam e conduziram a entrevista.

FISIOLOGIA DA REPRODUÇÃO BOVINA: 2 - ESTRO E SERVIÇO -/- -/- INTRODUÇÃO -/- -/- A identificação de vacas em cio (estro ou cio) é, sem dúvida, a prática mais importante no manejo da reprodução do rebanho leiteiro. Apesar dos avanços no conhecimento da fisiologia da reprodução a nível celular e molecular, a identificação de vacas em estro continua sendo o problema reprodutivo mais importante e o que mais causa prejuízos econômicos. Na indústria de laticínios no Brasil, seu impacto não foi (...) estimado, porém, a estimativa feita por países como os Estados Unidos onde se perdem 300 milhões de dólares por ano pode dar uma ideia, atribuída apenas à baixa eficiência na detecção de estros. Por que é cada vez mais difícil detectar vacas em estro? A resposta está relacionada aos aspectos intrínsecos da vaca leiteira moderna, associadas as práticas de manejo dos rebanhos atuais, caracterizados por possuírem grande número de vacas nos plantéis. -/- -/- 2.1 Como saber que uma vaca está em cio/estro? -/- -/- O comportamento estral é causado por um aumento no estradiol sérico produzido pelo folículo ovulatório. O aumento do estradiol provoca mudanças de comportamento e modificações na genitália externa e interna. A vaca mostra-se inquieta, sua vocalização aumenta, ela anda mais, tenta montar em outras vacas e aceita montar no touro ou em outra vaca, bem como urinam com mais frequência (micção frequente). A vulva fica levemente inflamada, à palpação retal o útero pode ser visto com tônus ou turgor (duro e contraído) e ao massagear o colo do útero observa-se que sai abundante muco cristalino da vulva. O mecanismo clássico proposto na regulação do estro é baseado principalmente no papel do estradiol; no entanto, estudos recentes indicam que o GnRH pode participar da regulação do estro ao nível do hipotálamo. O estro possui duração entre 8 e 18 horas e a intensidade do mesmo é afetada por fatores ambientais e intrínsecos a vaca moderna (figuras de 1 a 6). -/- -/- -/- Figura 2: A observação do grupo sexualmente ativo facilita a identificação das vacas em estro. -/- Figura 1: As vacas em estro formam grupos ativos (grupo sexualmente ativo) separados do resto das vacas. A conformação desses grupos facilita a observação do estro. -/- -/- A formação de grupos de vacas é um fator ideal para a detecção de vacas em cio, elas ficam juntas e começam a montar uma nas outras, a cheirar a urina de ambas etc. comportamentos que podem ser visualizados de longe pelo tratador e diagnosticado o cio o mais breve possível para o manejo reprodutivo adotado pela propriedade seja para monta natural ou controlada e/ou inseminações artificiais (IA) e artificiais em tempo fixo (IATF). -/- -/- Figura 3: O único comportamento positivo do estro é a aceitação da monta de outra vaca. É frequente que a vaca que realiza a monta também esteja em estro, o que só será afirmado até que ela aceite a monta de outra vaca. -/- -/- Figura 4: Cada monta dura de 5 a 7 segundos -/- Figura 5: A vaca leiteira aceita de 5 a 30 montas distribuídas entre 8 e 18 horas. -/- Figura 6: Além das mudanças comportamentais, os estrogênios causam alterações na genitália interna. Uma delas é a produção de muco cervical, que juntamente com o turgor uterino, constituem os sinais genitais do estro. -/- -/- O cio pode ser dividido em três fases, a inicial, a fase de cio verdadeiro e a fase final. O cio verdadeiro quando é observado, é caracterizado pelo momento em que a vaca aceita claramente a monta. Por sua vez, os sinais de início e final de cio se misturam, apresentam nervosismo e inquietação, cheiram e lambem a vagina e a urina de outras vacas, apoiam a cabeça na garupa de outras fêmeas etc. (figura 7). Uma das sugestões adotadas nas propriedades para facilitar a identificação do cio em um rebanho é realizada pelos funcionários com a utilização de um bastão ou fita de coloração da garupa das vacas. -/- Figura 7: Principais sinais que demonstram que a vaca está entrando em cio. BAIXE O PDF!!! -/- RESUMO -/- -/- < >Nos Estados Unidos, 300 milhões de dólares são perdidos devido à baixa eficiência na detecção do estro. A eficiência na detecção do estro no Brasil é de 40 a 50%. A meta de eficiência para detecção de estro é > 60%. Com a observação das vacas em dois períodos diários de três horas cada (manhã e tarde), consegue-se uma eficiência na detecção de estro de 80%. Menos de 20 por cento das vacas devem ter um intervalo de serviço duplo e nenhum de mais de 48 dias. A taxa de prenhez é obtida multiplicando-se a eficiência na detecção do estro pela porcentagem de concepção e dividindo por 100 (50 * 30/100 = 15%). A taxa de prenhez em rebanhos norte-americanos é de 15%. Nos Estados Unidos, para cada ponto percentual que diminui a taxa de prenhez, não há mais de US$ 12 a US$ 15 por vaca por ano. No Brasil, para cada ponto percentual que aumenta a taxa de prenhez, na faixa de 15 a 20%, é gerada uma renda anual adicional de $ 190 reais por vaca. Não mais que 25% das vacas devem estar vazias no 150º dia pós-parto. Não mais do que 8% devem as vacas ser cobertas no 250º dia pós-parto. 8% das vacas devem engravidar a cada mês. O estro ocorre 48 a 120 horas após o tratamento com PGF2α. 80% é a precisão na palpação do corpo lúteo. Quatorze dias devem decorrer entre duas injeções de PGF2α. Menos de 25% das vacas incluídas no programa de pré-sincronização devem chegar à IATF. No momento da ovulação, a primeira injeção de GnRH deve ser aplicada entre o quinto e o nono dia do ciclo estral. A inseminação cronometrada é realizada 14-16 horas após a segunda injeção de GnRH. O tratamento com dispositivos intravaginais liberadores de progesterona dura 12 dias. This collection highlights the new trend away from rationalism and toward empiricism in the epistemology of modality. Accordingly, the book represents a wide range of positions on the empirical sources of modal knowledge. Readers will find an introduction that surveys the field and provides a brief overview of the work, which progresses from empirically-sensitive rationalist accounts to fully empiricist accounts of modal knowledge. Early chapters focus on challenges to rationalist theories, essence-based approaches to modal knowledge, and the prospects for naturalizing (...) modal epistemology. The middle chapters present positive accounts that reject rationalism, but which stop short of advocating exclusive appeal to empirical sources of modal knowledge. The final chapters mark a transition toward exclusive reliance on empirical sources of modal knowledge. They explore ways of making similarity-based, analogical, inductive, and abductive arguments for modal claims based on empirical information. Modal epistemology is coming into its own as a field, and this book has the potential to anchor a new research agenda. (shrink)

The purpose of this paper is twofold: to discuss some challenging issues concerning Sextus’ works and outlook, and to offer an overview of the influence exerted by Sextan Pyrrhonism on both early modern and contemporary philosophy.

The radical evil. Notes on the revolt of masses. In his Religion within the Limits of Reason Alone, Kant speaks about a radical evil present in the human being, a tendency to place before the desire with regard to the rational duty, which is impossible to tear up by the roots from the human nature. In The revolt of the masses, Ortega also speaks about an evil that is anyway present in the so called mass-man, in each one of us, (...) and that is not to eradicate. The aim of this paper is to read the book of Ortega y Gasset in dialogue with Kant. (shrink)

This article is a commentary of the section 5.552 of the Tractatus, about the “experience” that is necessary to understand logic, from the point of view of the so called continental philosophy. In this commentary are tackled some questions: what is exactly this “experience”?; what does mean that logic is a speculative image of the world?; how are the relations between logic and metaphysics (the two components of philosophy, according to Wittgenstein)? All these questions lead us to the conception of (...) philosophy present in the Tractatus and to the role, so important, the two following problems play in this book: the reflection on the philosophical method and the transcendental character of being. Just for this it is necessary to take it seriously the opposition between speaking of something and speaking about something, employed in the final section and so clear in German as habitually mistranslated. In his account of Pyrrhonism, Sextus Empiricus talks about the disturbance concerning matters of opinion that afflicts his dogmatic rivals and that he himself was afflicted by before his conversion to Pyrrhonism. The aim of the present paper is to identify the distinct sources of doxastic disturbance that can be found in that account, and to determine whether and, if so, how they are related. The thesis to be defended is that it is possible to discern three sources of doxastic (...) disturbance and that two of them are to be explained by reference to the third, which is the real cause of mental distress. The paper also considers whether the thesis in question entails that there is no reason for the Pyrrhonist to suspend judgment across the board, but only to suspend judgment about evaluative matters. Cheating during examinations is triggered by peer influence. It makes every learner know and do what should not be done. Cheating during examinations defeats the purpose of understanding, applying and creating ideas as stipulated in the revised Bloom's taxonomy by Anderson. The study reported here was designed to delve into the reasons and aspirations of the respondents in their cheating engagement. Sixteen (16) key informants, selected using random sampling procedure among Junior and Senior High School learners of Roxas National Comprehensive (...) High School in Palawan during the months of June to October 2016, completed open-ended questionnaires and took part in the interview. NVivo software was used in the analysis of the themes that emerged from the data. This study discovered that friendship is manipulated, for it makes doing right things unacceptable and things to be avoided like cheating seem right and acceptable. The behavior about cheating during examination is deeply rooted in the culture of pakikisama (social acceptance/liking) and utang ng loob (debt of gratitude). If a learner does not share his or her answers, he or she will be labeled as walang pakisama (no concern).This paper then argues that honesty should not be just a policy; rather, honesty in this case, is the only policy. Condemning academic dishonesty must not merely rest in the enrollment forms, but by constant moral reminder and intervention of teachers who have a responsibility to hone learners' decorum on honesty and maturity. The reward system of science is the priority rule. The first scientist making a new discovery is rewarded with prestige, while second runners get little or nothing. Michael Strevens, following Philip Kitcher, defends this reward system, arguing that it incentivizes an efficient division of cognitive labor. I argue that this assessment depends on strong implicit assumptions about the replicability of findings. I question these assumptions on the basis of metascientific evidence and argue that the priority rule systematically discourages replication. My (...) analysis leads us to qualify Kitcher and Strevens’s contention that a priority-based reward system is normatively desirable for science. (shrink)

La présente étude a deux objectifs. Le premier est d’examiner les différentes formulations de l’objection de l’ἀπραξία telle qu’elle fut soulevée contre le scepticisme académicien et le pyrrhonisme, ainsi que les réponses à cette objection proposées par Arcésilas et Sextus Empiricus. Le second objectif consiste à évaluer la force de la version de l’objection de l’ἀπραξία selon laquelle le sceptique ne peut réaliser les actions rationnelles propres à l’être humain.

While most people believe the best possible life they could lead would be an immortal one, so‐called “immortality curmudgeons” disagree. Following Bernard Williams, they argue that, at best, we have no prudential reason to live an immortal life, and at worst, an immortal life would necessarily be bad for creatures like us. In this article, we examine Bernard Williams' seminal argument against the desirability of immortality and the subsequent literature it spawned. We first reconstruct and motivate Williams' somewhat cryptic argument (...) in three parts. After that, we elucidate and motivate the three best (and most influential) counterarguments to Williams' seminal argument. Finally, we review, and critically examine, two further distinct arguments in favor of the anti‐immortality position. (shrink)

The philosophy of perception has been mostly focused on vision, to the detriment of other modalities like audition or olfaction. In this paper I focus on olfaction and olfactory experience, and raise the following questions: is olfaction a perceptual-representational modality? If so, what does it represent? My goal in the paper is, firstly, to provide an affirmative answer to the first question, and secondly, to argue that olfaction represents odors in the form of olfactory objects, to which olfactory qualities are (...) attributed. In order to do this I develop an empirically adequate notion of olfactory object that is sensitive to the peculiarities of olfaction, and defend it against various objections. (shrink)

This discourse analysis aimed to expose the context of globalization in the face of COVID 19 pandemic. I contend to refute the notion that globalization is the same before and during the pandemic crisis. Moreover, I seek to bring out the contextual landscape of social and cultural changes as influenced by pandemic and how the conduct of globalization in terms of power struggle, digitalization, debt and geographies of blame, care, interdependence, infection, immunization, vulnerability and resilience are being redefined in its (...) optimum level. Aristotle's General Definition of the Syllogism may be taken as consisting of two parts: the Inferential Conditions and the Final Clause. Although this distinction is well known, traditional interpretations neglect the Final Clause and its influence on syllogistic. Instead, the aforementioned tradition focuses on the Inferential Conditions only. We intend to show that this neglect has severe consequences not just on syllogistic but on the whole exegesis of Aristotle's Prior Analytics I. Due to these consequences, our objective is to analyse (...) the General Definition's Final Clause and its consequences on syllogistic. We propose a reading of the Final Clause as an additional criterion for distinguishing some arguments as properly syllogistic ones and as a main theme which connects all parts of the Prior Analytics I into one coherent piece of work. Este artigo tem como objetivo apresentar as principais abordagens em que a psicologia social clássica norte-americana teorizou sobre o preconceito racial, o racismo e o antirracismo e, a partir delas, trazer os estudos críticos da branquitude como possibilidades para superar os limites identificados nessa corrente, que ora apresenta um indivíduo fora da estrutura, ora a estrutura sem indivíduos. Para isto, neste artigo definimos três abordagens propostas pela psicologia social norte-americana: teste de associação implícita (Greenwald & Banaji 2013); teoria do contato (...) intergrupal e racismo aversivo (Pettigrew 1997, Gaertner & Dovidio, 1986); e emoções específicas (Leach et al., 2002). A partir daí mostramos como os estudos críticos da branquitude se apresentam como uma síntese entre essas duas posições opostas, que oscilam entre o indivíduo e a estrutura. Nesta perspectiva, a estrutura se manifesta na própria experiência subjetiva do indivíduo, que se torna capaz de identificá-la em seu próprio campo experiencial. (shrink)

In this introductory chapter, I first offer an overview of the two themes addressed in the present collection - namely, disagreement and skepticism - and their connection, then present the purpose and content of the volume.

In this essay, I consider an evolutionary debunking argument (EDA) that purports to undermine the epistemic justification of the belief in the reliability of our belief-forming processes, and an evolutionary vindicating argument (EVA) that seeks to establish that such a belief is epistemically justified. Whereas the EDA in question seems to fall prey to crippling self-defeat, the EVA under consideration seems to fall prey to vicious circularity. My interest in those arguments and the problems they face lies in what they (...) might tell us about the possibly aporetic nature of reason. For, if we take the EDA and the EVA in question to consist of true or plausible premises and valid inferences at which we arrive through a meticulous use of reason, then their falling victim to either crippling self-defeat or vicious circularity might be regarded as a sign that, when we push rational reflection on the reliability, or lack thereof, of our belief-forming capacities to the limit, we end up in a situation of aporia from which there seems to be no escape. A multidisciplinary study of trust. The papers in this publication address the question of what generates, maintains, substitutes or collapses trusting relations.

O presente trabalho tem por finalidade analisar, a partir do livro V da obra Ethica Nicomachea, se a justiça poderia ser tomada como um meio que irá auxiliar os cidadãos a desenvolver plenamente as suas virtudes. Buscar-se-á fundamentar que é através da justiça que os bons cidadãos seriam formados, bem como o bom caráter seria cultivado. Analisar-se-á, também, ainda que minimamente, o que Aristóteles entende de fato por justiça, de que o justo seria dar a cada um o que lhe (...) é devido, o que merece, haja vista que essa afirmação traz consigo um peso muito grande, pois nos faz indagar sobre o que seria o devido de cada indivíduo, bem como quais seriam as bases relevantes do mérito. Isto é, se o justo é dar a cada um o que lhe é devido, cabe a nós nos perguntarmos de que forma e critério seria usado na distribuição. De certa forma, ao raciocinarmos sobre justiça e direitos, consequentemente temos de raciocinar sobre a finalidade, o objetivo, o telos das atividades que circundam a vida social na Pólis. Buscar-se-á discutir sobre os temas apresentados, porém não se tem por finalidade propor medidas para pôr um fim na discussão. (shrink)

In the midst of current social change and public debates regarding provision of reproductive health education and services in the Philippines, the need exists to understand the realities of teenagers and young adults’ lives and the challenges they face in finding the way sexual and reproductive well-being. Although a few studies have focused on quantifying unintended pregnancy and abortion in the Philippines, few investigations using qualitative research methods have been conducted to more fully explore and situate these phenomena. Unsafe abortion (...) through the use of abortifacients has been practiced since time immemorial. An estimated 26 million pregnancies are terminated legally throughout the world, and 20 million are terminated illegally, with more than 78,000 deaths. The Philippines, with a steadily increasing population that is approaching 100 million, faces significant challenges in the area of reproductive health. -/- . (shrink)

Desde os tempos mais remotos, busca-se por equilíbrio entre o delito e a punição. Este artigo estabelece uma relação entre o conceito de Justiça em Aristóteles e a proporcionalidade em matéria penal. Para melhor compreensão do tema, inicia-se o estudo pelos principais pontos da obra Ética a Nicômaco, especialmente o Livro V, que trata da Justiça. A partir de então, aborda-se o princípio da proporcionalidade e a forma pela qual os conceitos de Aristóteles influenciaram a concepção desse princípio. Ato contínuo, (...) investiga-se a realidade atual do sistema carcerário, sendo avaliadas as estatísticas produzidas pelos órgãos competentes. Por conseguinte, enfatiza-se o Estado de Coisas Inconstitucional para verificar a questão penitenciária à luz da decisão da Suprema Corte brasileira na ADPF n. 347/DF. Ao final, pondera-se acerca da forma pela qual se pune no Brasil para investigar se suas premissas respeitam ou não as balizas do conceito de Justiça aristotélico e o princípio da proporcionalidade. Para o desenvolvimento desta pesquisa, utilizou-se o método qualitativo, por meio da leitura de obras que obedecem ao eixo temático exposto nos objetivos e que permitem o fichamento do repertório selecionado. Além de ter sido analisada juriprudência, foram coletados dados do censo penitenciário. Finalmente, articulou-se o material consultado com as estatísticas do sistema prisional. Concluiu-se nesta pesquisa que o Poder Executivo é omisso e ineficiente para garantir os direitos dos encarcerados, não obstante todo o avanço normativo sobre o tema. Como se não bastasse, na prática forense brasileira a proporcionalidade não é mais que mera previsão abstrata. (shrink)

The question of whether the Pyrrhonist adheres to certain logical principles, criteria of justification, and inference rules is of central importance for the study of Pyrrhonism. Its significance lies in that, whereas the Pyrrhonist describes his philosophical stance and argues against the Dogmatists by means of what may be considered a rational discourse, adherence to any such principles, criteria, and rules does not seem compatible with the radical character of his skepticism. Hence, if the Pyrrhonist does endorse them, one must (...) conclude that he is inconsistent in his outlook. Despite its import, the question under consideration has not received, in the vast literature on Pyrrhonism of the past three decades, all the attention it deserves. In the present paper, I do not propose to provide a full examination of the Pyrrhonist’s attitude towards rationality, but to focus on the question of whether he endorses the law of non-contradiction (LNC). However, I will also briefly tackle the question of the Pyrrhonist’s outlook on both the canons of rational justification at work in the so-called Five Modes of Agrippa and the logical rules of inference. In addition, given that the LNC is deemed a fundamental principle of rationality, determining the Pyrrhonist’s attitude towards it will allow us to understand his general attitude towards rationality. Em meio à chamada “virada biológica” dos estudos aristotélicos, seguiremos a hipótese levantada por alguns comentadores de que a Poética de Aristóteles partilha do modelo biológico estrutural de seu pensamento, o que implica que também a poesia possuiria uma “história natural”. Sendo assim, o propósito deste artigo é o de pensar a comédia a partir deste paradigma. This paper approaches the current epistemological debate on peer disagreement from a neo-Pyrrhonian perspective, thus adopting a form of skepticism which is more radical than those discussed in the literature. It makes use of argumentative strategies found in ancient Pyrrhonism both to show that such a debate rests on problematic assumptions and to block some maneuvers intended to offer an efficacious way of settling a considerable number of peer disputes. The essay takes issue with three views held in the peer (...) disagreement debate: there is an objective fact of the matter about at least most controversial questions; we possess theory-neutral evidence bearing on those questions which grants us access to the truth of the matter; and many peer controversies are resolved by attending to which disputant has correctly evaluated the objective evidence. With respect to the first two views, it is argued that the belief in both objective facts and theory-neutral evidence is subject to fierce dispute, and should not therefore be taken for granted in the discussion of peer disagreement. As for the third view, it is argued that from either a first- or a third-person perspective, there seems to be epistemic symmetry between the disputants which makes it necessary to suspend judgment. Is skeptical theism tenable once one acknowledges, as proponents of that view do, one's cognitive limitations vis-à-vis religious matters? In this article, I aim to answer that question both by examining the apparent radical skeptical implications of the skeptical component of skeptical theism and by comparing this view with fideism and Pyrrhonism, which also lay emphasis on our cognitive limitations. My ultimate purpose is to determine which of the three stances it makes more sense to adopt once the limitations of (...) human cognitive powers are recognized. (shrink)

Neste artigo é defendido que 'os iluministas' não poderiam ser capazes de eliminar os preconceitos, como pretendiam, haja vista que atacavam o fenômeno do preconceito onde ele não estava, sendo o entrave no acesso à verdade apenas um efeito colateral do preconceito e não seu elemento central. Independente da possibilidade ou não de se eliminar os preconceitos, a estratégia adotada pelos filósofos desse período estava condenada ao fracasso. Para sustentar esta hipótese, primeiro será extraída uma noção geral do preconceito a (...) partir de autores do período do iluminismo. Em seguida serão estudados seus aspectos a fim de compreender a relação dos preconceitos com a realidade. Por fim se demonstra que o caráter dessa relação é acidental, não podendo o preconceito ser abolido por uma argumentação acerca da verdade das coisas. Este artigo não discute se é possível eliminar os preconceitos, apontando apenas o erro do método dos autores modernos. (shrink)

Several scholars familiar with Sextus Empiricus’s Pyrrhonism who have attentively read his Against the Ethicists have gotten the impression that something strange is going on in this book. For, at variance with the ‘official’ Pyrrhonian attitude of universal suspension of judgment, a number of passages of Against the Ethicists seem to ascribe to the Pyrrhonist both a type of negative dogmatism and a form of realism, which together amount to what may be called ‘moderate ethical realism’. Neste trabalho, investigo a possibilidade de compatibilidade entre o pessimismo filosófico e a compreensão da morte como um mal para quem morre. Por pessimismo filosófico, compreendo a doutrina filosófica que mantém como tese fundamental que a não-existência é preferível à existência, de modo que o pessimismo é tomado como a filosofia de que a vida não vale a pena ser vivida. Por mal da morte, me refiro à compreensão da morte como um dano para o indivíduo que morre, cujo pressuposto (...) em diferentes abordagens contemporâneas é o de que a morte só é um mal no caso de continuar existindo ser preferível a deixar de existir. Desse modo, o problema discutido é a aparente incompatibilidade entre a tese de que a não-existência é preferível à existência e a tese de que continuar existindo é preferível a deixar de existir. Busco demonstrar que essa (in)compatibilidade depende do modo como fundamentamos o pessimismo filosófico. Para tanto, examino dois argumentos para o pessimismo filosófico e suas implicações para o mal da morte: o argumento a priori de Arthur Schopenhauer e o argumento da assimetria de David Benatar. Concluo que o primeiro desses argumentos nos leva para a conclusão de que a morte não é um mal, mas que o segundo argumento compatibiliza o pessimismo filosófico e a compreensão da morte como um mal para quem morre. Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

Durante vários anos, Jean Héring (1890-1966) foi professor de teologia na Université de Strasbourg. Um fato pessoal que o marcou definitivamente, foi o privilégio de ter sido discípulo de Husserl, em Göttingen. Nesta oportunidade, também teve contato com outros representantes da fenomenologia, como Edith Stein, Adolf Reinach e Alexandre Koyré. No breve texto a seguir, datado de 1939, um ano antes da morte de Husserl, Héring relembra a sua chegada em Göttingen, no ano de 1909 e o modo como Husserl (...) impressionava os seus discípulos, pelo seu brilhantismo. Fato este que acompanhou Héring durante todo o restante de sua vida, impactando decisivamente em sua obra. (shrink)

A key premise of the kalam cosmological argument is that the universe began to exist. However, while a number of philosophers have offered powerful criticisms of William Lane Craig’s defense of the premise, J.P. Moreland has also offered a number of unique arguments in support of it, and to date, little attention has been paid to these in the literature. In this paper, I attempt to go some way toward redressing this matter. In this paper, we discuss two recurring themes in Sosa’s work, reexamined in Judgment and Agency (SOSA, 2015) from a new angle, i.e. the place and importance of reflection in the cognitive economy of the epistemic agent, and epistemic value. Regarding the latter, Sosa suggests that knowing full well, which necessarily involves reflection, has value because it contributes to human flourishing. Although Sosa’s “new virtue epistemology” appears very promising in explaining different intuitions regarding epistemology and demonstrating that it is possible (...) to join reliabilist and responsibilist accounts of virtue epistemology, we believe that solving the value problem requires further clarification in order to truly explain the value of knowledge. This chapter provides an overview and critical discussion of cosmological arguments for theism, with special focus on the Kalam argument and arguments from contingency.

El concepto de desarrollo humano del Programa de las Naciones Unidas para el Desarrollo (PNUD) surge en 1990 como una crítica a la consideración de la economía como el fin último de los esfuerzos del desarrollo. En la visión del PNUD, la economía es considerada un fin relativo, es decir, un fin y un medio para el desarrollo humano. Al considerar, por su parte, el fin del desarrollo humano, este es identificado con el ensanchamiento de las opciones y libertades de (...) que gozan los individuos. En este sentido, este concepto de desarrollo humano hace alusión a una práctica política más que a un entendimiento ético-ontológico del ser humano, evitando referirse a desarrollo humano entendido como un desarrollo del ser humano. Este artículo explora los antecedentes del concepto del desarrollo humano del PNUD y los fines que consideran estos enfoques previos. Se observa que la consideración subjetivista del PNUD proviene de la teoría de Amartya Sen, quien queda sujeto a la crítica objetivista de Martha Nussbaum al no considera un fin objetivo para los asuntos humanos, crítica que puede de igual manera aplicarse al concepto de desarrollo humano del PNUD. O presente artigo pretende explorar a máxima contida em Os irmãos Karamázov (se não há Deus, tudo é permitido?) à luz do pensamento de Immanuel Kant. Para tanto, se vale do pensamento de Dostoiévski apenas na medida em que ele serve como auxílio na apresentação da ideia de Deus e de sua relação com a posição do ateu. Tendo em vista a filosofia kantiana, buscamos não apenas a apresentação dessa ideia, mas também sua relação com o ato moral e com (...) a própria condição desse ato. Isso, portanto, resultará em Kant, uma resposta duplamente negativa à pergunta que reflete a posição ateísta de Ivan Karamazov. Pois Kant ao distinguir o ato moral por dever e conforme o dever, defende que recorrer a algo externo à razão (Deus) constituiria uma vontade meramente heterônoma. Portanto, o ato moral por excelência ocorre quando a ação é realizada de um modo unicamente guiado pela razão, com base num interesse puro, e isso conduz, por sua vez, à reprovação por parte de Kant da referida máxima presente na obra de Dostoiévski. Gibson defined affordances as action possibilities directly offered to an animal by the environment. Ambitiously, affordances are meant to show the inadequacy of the subjective-objective dichotomy in the study of cognition. Armed with similar concerns, some neo-Gibsonians recently thought of affordances as latent dispositions existing independently of individual organisms or whole species. It is no coincidence that critics had, on several occasions, objected that this theoretical stance dramatically neglects the role of the perceiver in the emergence of affordances. In this (...) paper, we provide a phenomenological characterization of the perceiver’s role in affordance perception. Specifically, we borrow from Husserlian phenomenology to characterize two features of affordance perception that can enrich our understanding of the individual’s engagement with the environment, namely, its affective and temporal aspects. Taking an everyday activity such as rock climbing as a case example, we show that phenomenological investigations, if not misinterpreted as mere introspection, can represent an ally for ecological psychologists. It is common in psychiatry and other sciences to describe an individual or a type of individual in terms of its disposition to manifest specific effects in a particular range of circumstances. According to one understanding, dispositions are statistical regularities of an individual or type of individual in specific circumstances. According to another understanding, dispositions are properties of individuals in virtue of which such regularities hold. This entry considers a number of ways of making each of these senses of disposition (...) more precise while discussing a number of dangers lurking in careless use of the concept of a disposition. Eshel Ben-Jacob’s manuscript entitled ‘Bacterial wisdom, Gödel’s theorem and creative genomic webs’ summarizes decades of work demonstrating adaptive mutagenesis in bacterial genomes. Bacterial genomes, each an essential part of a Kantian whole that is a single bacterium, are thus not independent of the environment as sensed; and a single bacterium is therefore a semiotic entity. Ben-Jacob suggests this but errs in 1) assigning autonomy to the genome, and 2) analogizing through computation without making clear whether he is doing so for (...) illustrative purposes or making committed ontological propositions. We reinterpret adaptive mutagenesis and related phenomena in ways both metaphysically rigorous and revealing. We conclude that bacteria are much farther removed from the ‘self-organizing’ world of inanimate process than from the Peircian world of signs; and a critical reappraisal of existing knowledge can enhance our understanding of selfhood, semiosis, and the roots of subjective experience. Besides the general agreement about the human capability of reflection, there is a large area of disagreement and debate about the nature and value of “reflective scrutiny” and the role of “second-order states” in everyday life. This problem has been discussed in a vast and heterogeneous literature about topics such as epistemic injustice, epistemic norms, agency, understanding, meta-cognition etc. However, there is not yet any extensive and interdisciplinary work, specifically focused on the topic of the epistemic value of reflection. This (...) volume is one of the first attempts aimed at providing an innovative contribution, an exchange between philosophy, epistemology and psychology about the place and value of reflection in everyday life. -/- Our goal in the next sections is not to offer an exhaustive overview of recent work on epistemic reflection, nor to mimic all of the contributions made by the chapters in this volume. We will try to highlight some topics that have motivated a new resumption of this field and, with that, drawing on chapters from this volume where relevant. -/- Two elements defined the scope and content of this volume, on the one hand, the crucial contribution of Ernest Sosa, whose works provide original and thought-provoking contributions to contemporary epistemology in setting a new direction for old dilemmas about the nature and value of knowledge, giving a central place to reflection. On the other hand, the recent developments of cultural psychology, in the version of the “Aalborg approach”, reconsider the object and scope of psychological sciences, stressing that “[h]uman conduct is purposeful”. En este trabajo se discute acerca de la posibilidad de llevar a cabo afirmaciones epistémicamente objetivas respecto del arte a partir de la filosofía de la sociedad de John Searle y de la epistemología del desacuerdo. Para ello se considerarán las distinciones ontológicamente objetivo/subjetivo y epistémicamente objetivo/subjetivo en relación con el arte como fenómeno relativo a la intencionalidad, señalándolo como ontológicamente subjetivo y epistémicamente objetivo. Luego se discutirá acerca del desacuerdo en torno a obras polémicas de arte y de la (...) disolución de tales desacuerdos al considerar la oposición entre creencia y aceptación según la propuesta de Jonathan Cohen. Finalmente, mostrando la posibilidad de generar acuerdos en torno al juicio de gustos, se señala el rol de las instituciones relativas al arte en nuestra comprensión del estatuto artístico de las obras polémicas. De esta manera, se pretende señalar que la apreciación de una obra como ‘arte’ es una cuestión objetiva dependiente de las instituciones que operan en nuestra sociedad. (shrink)
