  1. Fairness and Utility in Tort Theory.George P. Fletcher - 1972 - Harvard Law Review 85 (3):537-573.
Professor Fletcher challenges the traditional account of the development of tort doctrine as a shift from an unmoral standard of strict liability for directly causing harm to a moral standard based on fault. He then sets out two paradigms of liability to serve as constructs for understanding competing ideological viewpoints about the proper role of tort sanctions. He asserts that the paradigm of reciprocity, which looks only to the degree of risk imposed by the parties to a lawsuit on each (...)

Cambridge: Cambridge University Press. pp. 195-221.
In this chapter we explore two important questions that we believe should be central to any discussion of the ethics and politics of cultural heritage: What are the harms associated with appropriation and commodification, specifically where the heritage of Indigenous peoples is concerned? And how can these harms best be avoided? Archaeological concerns animate this discussion; we are ultimately concerned with fostering postcolonial archaeological practices. But we situate these questions in a broader context, addressing them as they arise in connection (...)

In the first months of the COVID-19 pandemic, we created and implemented from November 2020 to February 2021 a monthly educational pilot program of philosophical management of stress based on Science, Humanism and Epicurean Pragmatism, which was offered to employees of 26 municipalities in the Prefecture of Attica, Greece. The program named “Philosophical Distress Management Operation System” (Philo.Di.M.O.S.) is novel and unique in its kind, as it combines a certain Greek philosophical tradition (Epicurean) that concurs with modern scientific knowledge. The Twin Earth thought experiment invites us to consider a liquid that has all of the superficial properties associated with water (clear, potable, etc.) but has entirely different deeper causal properties (composed of “XYZ” rather than of H2O). Although this thought experiment was originally introduced to illuminate questions in the theory of reference, it has also played a crucial role in empirically informed debates within the philosophy of psychology about people’s ordinary natural kind concepts. Those debates have sought to accommodate (...)

In this essay, I investigate if self-respect as Robin Dillon conceives of it in her essay “Self-Respect: Moral, Emotional, Political” can be taught if we presuppose Barbara Herman’s theory of moral education. For Dillon, self-respect is a nonpropositionally held and emotionally forged interpretive orientation that determines one’s understanding of oneself. Further, it cannot be reconstituted through reason if it has been damaged. The claim that reason cannot remedy a lack of self-respect in persons is at odds with Herman’s reason-based training (...)

A growing body of research has examined how people judge the persistence of identity over time—that is, how they decide that a particular individual is the same entity from one time to the next. While a great deal of progress has been made in understanding the types of features that people typically consider when making such judgments, to date, existing work has not explored how these judgments may be shaped by normative considerations. The present studies demonstrate that normative beliefs do (...)

In the early twentieth century, many philosophers in America thought that time should be taken seriously in one way or another. George P. Adams (1882-1961) argued that the past, present and future are all real but only the present is actual. I call this theory ‘actualist eternalism’. In this paper, I articulate his novel brand of eternalism as one piece of his metaphysical system and I explain how he argued for the view in light of the best explanations of (...)

Functionalism would be mistaken if there existed a system of deviant relations (an “anti-mind”) that had the same functional roles as the standard mental relations. In this paper such a system is constructed, using “Quinean transformations” of the sort associated with Quine’s thesis of the indeterminacy of translation. For example, a mapping m from particularistic propositions (e.g., that there exists a rabbit) to universalistic propositions (that rabbithood is manifested). Using m, a deviant relation thinking* is defined: x thinks* p iff (...)

After a brief history of Brentano's thesis of intentionality, it is argued that intentionality presents a serious problem for materialism. First, it is shown that, if no general materialist analysis (or reduction) of intentionality is possible, then intentional phenomena would have in common at least one nonphysical property, namely, their intentionality. A general analysis of intentionality is then suggested. Finally, it is argued that any satisfactory general analysis of intentionality must share with this analysis a feature which entails the existence (...)

Secondly, the paper situates the emergence post colonial critical perspectives generally using development in the South as a point of reference. The paper specifically focuses on feminist postcolonial critical perspectives on gender, race and class. Accordingly, the paper explicates the implications of intersectionality on the development discourse in the South and its multiplicative (...)

ABSTRACT: This 1974 paper builds on our 1969 paper (Corcoran-Weaver [2]). Here we present three (modal, sentential) logics which may be thought of as partial systematizations of the semantic and deductive properties of a sentence operator which expresses certain kinds of necessity. The logical truths [sc. tautologies] of these three logics coincide with one another and with those of standard formalizations of Lewis's S5. These logics, when regarded as logistic systems (cf. Corcoran [1], p. 154), are seen to be equivalent; (...)

Görres wrote of “this hospital of the human spirit (…), this charnel ground of the living, who like specters roam, wearing on their foreheads the faded and almost illegible traces of their former names.”1(1836, p. 9). Overdramatic prose, but unlikely to strike one as (...)

Robert Audi and Georges Rey have argued that self-deception does not bring about belief in the usual sense, but rather “avowal” or “avowed belief.” That means a tendency to affirm verbally (both privately and publicly) that lacks normal belief-like connections to non-verbal actions. I contest their view by discussing cases in which the product of self-deception is implicated in action in a (...)

  45. The Substance View: A Critique (Part 3).Rob Lovering - 2017 - Bioethics 31 (4):305-312.
In my articles ‘The Substance View: A Critique’ and ‘The Substance View: A Critique,’ I raise objections to the substance view, a theory of intrinsic value and moral standing defended by a number of contemporary moral philosophers, including Robert P. George, Patrick Lee, Christopher Tollefsen, and Francis Beckwith. In part one of my critique of the substance view, I raise reductio-style objections to the substance view's conclusion that the standard human fetus has the same intrinsic value and moral standing (...)

Tradução para o português de "Uma espécie de história de minha vida" (A kind of history of my life), ou Carta a um médico (A Letter to a Physician), uma carta escrita por Hume (1711-1776), endereçada em março ou abril de 1734 a um médico não identificado (segundo Norton provavelmente John Arbuthnot ou George Cheyne), na qual Hume pede alguns conselhos para continuar com o seu trabalho filosófico. O título atual é extraído do primeiro parágrafo.A carta foi escrita em (...)

continent. 1.1 : 3-13. / 0/ – Introduction I want to propose, as a trajectory into the philosophically weird, an absurd theoretical claim and pursue it, or perhaps more accurately, construct it as I point to it, collecting the ground work behind me like the Perpetual Train from China Mieville's Iron Council which puts down track as it moves reclaiming it along the way. The strange trajectory is the following: Kant's critical philosophy and much of continental philosophy which has followed, (...)

  48. Two-Way Powers as Derivative Powers.Andrei A. Buckareff - 2019 - In Michael Brent & Lisa Miracchi Titus (eds.), Mental Action and the Conscious Mind. New York, NY: Routledge. pp. 228-254.
Some philosophers working on the metaphysics of agency argue that if agency is understood in terms of settling the truth of some matters, then the power required for the exercise of intentional agency is an irreducible two-way power to either make it true that p or not-p. In this paper, the focus is on two-way powers in decision-making. Two problems are raised for theories of decision-making that are ontologically committed to irreducible two-way powers. First, recent accounts lack an adequate framework (...)

“There is no use in trying,” said Alice; “one can’t believe impossible things.” “I dare say you haven’t had much practice,” said the Queen. “When I was your age, I always did it for half an hour a day. Why, sometimes I’ve believed as many as six impossible things before breakfast”. Lewis Carroll, Through the Looking Glass. -/- It is a rather common view among philosophers that one cannot, properly speaking, be said to believe, conceive, imagine, hope for, or seek (...)

Preface/Introduction: The question under discussion is metaphysical and truly elemental. It emerges in two aspects — how did we come to be conscious of our own existence, and, as a deeper corollary, do existence and awareness necessitate each other? I am bold enough to explore these questions and I invite you to come along; I make no claim to have discovered absolute answers. However, I do believe I have created here a compelling interpretation. You’ll have to judge for yourself. -/- (...)
