  1. Perlocutionary Silencing: A Linguistic Harm That Prevents Discursive Influence.David C. Spewak Jr - 2023 - Hypatia 38 (1):86-104.
Various philosophers discuss perlocutionary silencing, but none defend an account of perlocutionary silencing. This gap may exist because perlocutionary success depends on extralinguistic effects, whereas silencing interrupts speech, leaving theorists to rely on extemporary accounts when they discuss perlocutionary silencing. Consequently, scholars assume perlocutionary silencing occurs but neglect to explain how perlocutionary silencing harms speakers as speakers. In relation to that shortcoming, I defend a novel account of perlocutionary silencing. I argue that speakers experience perlocutionary silencing when they are illegitimately (...)

In his Metaphysics of Morals, Kant famously wrote “The distinction between virtue and vice can never be sought in the degree to which one follows certain maxims…In other words, the well-known principle (Aristotle’s) that locates virtue in the mean between two vices is false.” Kant is not the first (or the last) thinker to take to task Aristotle’s doctrine of the mean, but he is representative of a line of criticism of Aristotle’s doctrine which argues that ethics is the realm (...)

Current events force upon Americans not only the duties of a citizen of a nation at war but also the conceptual challenge of understanding the nature of citizenship. In Aristotle and the Rediscovery of Citizenship Susan Collins argues that contemporary liberal political theory, based on presuppositions about the priority of the individual to the state, is incapable of responding to such an intellectual challenge. At least since the publication of John Rawls’ Political Liberalism (1993), contemporary liberal political theory has struggled (...)

In this essay, I argue that an immortal existence could be desirable. Taking the accounts of Williams and Smuts under careful consideration, I agree with Fischer that an immortal existence could be gratifying. When Fischer argues that it is unfair for Williams to posit that an immortal life must have self-exhausting pleasures and, overall, a better experience than mortal life, he gets to the crux of the argument for immortality: as long as there are positive categorical desires for the individual, (...)

Any modern reader of Aristotle’s Politics confronts the question of what a treatise on 4th century BCE political institutions can say to a contemporary audience. Some authors, confronted with such a question, choose to examine Aristotle’s Politics as a work in the history of political philosophy or classics worthy of careful study because of its place in the Aristotelian corpus, because of the light it sheds on ancient Greek history and political institutions, or because of its relation to other works (...)

Numerous scholars, philosophers, and experts in aesthetics have underscored the profound significance of a life enriched by the presence of beauty. Consequently, the appreciation of aesthetic experiences is considered pivotal for achieving self-discovery and self-transcendence (Howell et al. 2017). This study in moral, political, and legal philosophy contends that it is morally impermissible to circumcise male minors without a medical indication (nontherapeutic circumcision). Male minors have a moral anticipatory autonomy right-in-trust not to be circumcised. This right depends on norms of autonomy and bodily integrity. These norms generate three direct non-consequentialist arguments against nontherapeutic circumcision: (1) the loss of nonrenewable functional tissue, (2) genital salience, and (3) limits on a parental right to permanently modify their sons' bodies.

As anyone familiar with my own work would readily infer, I have virtually boundless admiration for Wayne Proudfoot’s Religious Experience. In fact, to be honest I think Religious Experience belongs together with Jeff Stout’s The Flight from Authority and David Hume’s Dialogues Concerning Natural Religion as the books that have most profoundly shaped my teaching and scholarship. More than the other two works, however, Religious Experience has informed my most basic attitudes about the point and proper pursuit of the shared (...)

There is an undeniable tendency to dismiss women’s sexual assault allegations out of hand. However, this tendency is not monolithic—allegations that black men have raped white women are often met with deadly seriousness. I argue that contemporary rape culture is characterized by the interplay between rape myths that minimize rape, and myths that catastrophize rape. Together, these two sets of rape myths distort the epistemic resources that people use when assessing rape allegations. These distortions result in the unjust exoneration of (...)

  44. Is Blameworthiness Forever?Andrew C. Khoury & Benjamin Matheson - 2018 - Journal of the American Philosophical Association 4 (2):204-224.
Many of those working on moral responsibility assume that "once blameworthy, always blameworthy." They believe that blameworthiness is like diamonds: it is forever. We argue that blameworthiness is not forever; rather, it can diminish through time. We begin by showing that the view that blameworthiness is forever is best understood as the claim that personal identity is sufficient for diachronic blameworthiness. We argue that this view should be rejected because it entails that blameworthiness for past action is completely divorced from (...)

  45. How to think about higher‐level perceptual contents.Daniel C. Burnston - 2023 - Mind and Language 38 (5):1166-1186.
The standard assumption for what perception must do in order to represent a “higher level” content—say, tiger—is that it must represent the kind as such. I argue that this “as such condition” is not constitutive of what it means for a content to be “higher‐level”, and that embracing it produces a range of unfortunate dialectical consequences. After offering this critique, I give an alternative construal, the “extended perceptual space” view of higher‐level contents. This view captures the phenomena targeted by the (...)

Standpoint theorists have long been clear that marginalization does not make better understanding a given. They have been less clear, though, that social dominance does not make ignorance a given. Indeed, many standpoint theorists have implicitly committed themselves to what I call the strong epistemic disadvantage thesis. According to this thesis, there are strong, substantive limits on what the socially dominant can know about oppression that they do not personally experience. I argue that this thesis is not just implausible but (...)

In my article "Even if the fetus is not a person, abortion is immoral: The impairment argument" (this journal), I defended what I called “The impairment argument” which purports to show that abortion is immoral. Bruce Blackshaw (2019) has argued that my argument fails on three accounts. In this article, I respond to his criticisms.

Long-standing neglect of the chemical senses in the philosophy of perception is due, mostly, to their being regarded as ‘lower’ senses. Smell, taste, and chemically irritated touch are thought to produce mere bodily sensations. However, empirically informed theories of perception can show how these senses lead to perception of objective properties, and why they cannot be treated as special cases of perception modelled on vision. The senses of taste, touch, and smell also combine to create unified perceptions of flavour. The (...)

The New Evil Demon problem has been hotly debated since the case was introduced in the early 1980’s (e.g. Lehrer and Cohen 1983; Cohen 1984), and there seems to be recent increased interest in the topic. In a forthcoming collection of papers on the New Evil Demon problem (Dutant and Dorsch, forthcoming), at least two of the papers, both by prominent epistemologists, attempt to resist the problem by appealing to the distinction between justification and excuses. My primary aim here is (...)

Inspired by recent breakthroughs in predictive modeling, practitioners in both industry and government have turned to machine learning with hopes of operationalizing predictions to drive automated decisions. Unfortunately, many social desiderata concerning consequential decisions, such as justice or fairness, have no natural formulation within a purely predictive framework. In efforts to mitigate these problems, researchers have proposed a variety of metrics for quantifying deviations from various statistical parities that we might expect to observe in a fair world and offered a (...)
