The paper delineates a new approach to truth that falls under the category of “Pluralism within the bounds of correspondence”, and illustrates it with respect to mathematical truth. Mathematical truth, like all other truths, is based on correspondence, but the route of mathematical correspondence differs from other routes of correspondence in (i) connecting mathematical truths to a special aspect of reality, namely, its formal aspect, and (ii) doing so in a complex, indirect way, rather than (...) in a simple and direct way. The underlying idea is that an intricate mind is capable of creating intricate routes from language to reality, and this enables it to apply correspondence principles in areas for which correspondence is traditionally thought to be problematic. In the Principles of Philosophy, Descartes attempts to explicate the well-known phenomena of varying bodily size through an appeal to the concept of "solidity," a notion that roughly corresponds to our present-day concept of density. Descartes' interest in these issues can be partially traced to the need to define clearly the role of matter in his natural laws, a problem particularly acute for the application of his conservation principle. Specifically, since Descartes insists that a body's "quantity of motion," defined as (...) the product of its "size" and speed, is conserved in all material interactions, it is imperative that he explain how solidity influences the magnitude of this force. As a means of resolving this problem, Descartes postulated an idealized condition of "perfect solidity" which correlates a body's "agitation" force (a forerunner of Newton's concept of non-accelerating, or "inertial" motion) with the interplay of its volume, surface area, and composition of minute particles. This essay explores this often misunderstood aspect of Descartes' physics, as well as the special function of idealized conditions in his collision rules. Contrary to those commentators who regard "perfect solidity" as a stipulation on bodily impact, this notion, it will be argued, is primarily concerned with the internal composition of macroscopic bodies, and only indirectly with their collision characteristics. Along the way, many of Descartes' hypotheses will be shown to display a level of sophistication and intricacy that, despite their essential incompatibility, belie several of the common misconceptions of Cartesian science. Can supervaluationism successfully handle indirect speech reports? This chapter considers, and rejects, Schiffer’s claim that they cannot. One alleged problem with indirect speech reports is that the truth of “Carla said that Bob is tall” implausibly requires that Carla said all of a huge number of precise things (i.e. that Bob was over n feet tall, for values of n corresponding to precisifications of “tall”). The paper shows why the supervaluationist is not committed to this. Vague singular terms (...) are no particular problem for supervaluationism within indirect speech reports, it is argued, but there remain some issues surrounding certain vague demonstratives. The supervaluationist has good responses available, however, and any remaining questions face all theories of vagueness and are more appropriately addressed within a theory of demonstratives rather than a theory of vagueness. Time has multiple aspects and is difficult to define as one unique entity, which therefore led to multiple interpretations in physics and philosophy. However, if the perception of time is considered as a composite time concept, it can be decomposed into basic invariable components for the perception of progressive and support-fixed time and into secondary components with possible association to unit-defined time or tense. Progressive time corresponds to Bergson’s definition of duration without boundaries, which cannot be divided for measurements. (...) Time periods are already lying in the past and fixed on different kinds of support. The human memory is the first automatic support, but any other support suitable for time registration can also be considered. The true reproduction of original time from any support requires conditions identical to the initial conditions, if not time reproduction becomes artificially modified as can be seen with a film. Time reproduction can be artificially accelerated, slowed down, extended or diminished, and also inverted from the present to the past, which only depends on the manipulation of the support, to which time is firmly linked. Tense associated to progressive and support fixed time is a psychological property directly dependent on an observer, who judges his present as immediate, his past as finished and his future as uncertain. Events can be secondarily associated to the tenses of an observer. Unit-defined time is essential for physics and normal live and is obtained by comparison of support-fixed time to systems with regular motions, like clocks. The association of time perception to time units can also be broken. Einstein’s time units became relative, in quantum mechanics, some physicist eliminated time units, others maintained them. Nevertheless, even the complete elimination of time units is not identical to timelessness, since the psychological perception of progressive and support-fixed time still remains and cannot be ignored. It is not seizable by physical methods, but experienced by everybody in everyday life. Contemporary physics can only abandon the association of time units or tenses to the basic components in perceived time. (shrink)

An object-based correspondence theory of truth holds that a truth-bearer is true whenever its truth conditions are met by objects and their properties. In order to develop such a view, the principal task is to explain how truth-bearers become endowed with their truth conditions. Modern versions of the correspondence theory see this project as the synthesis of two theoretical endeavours: basic metasemantics and compositional semantics. Basic metasemantics is the theory of how simple, meaningful items (e.g. names and concepts) (...) are endowed with their contributions to truth conditions, and compositional semantics is the theory of how the meanings of simple items compose to generate (among other things) the truth conditions of sentences. Understanding truth along these broad lines was once popular; it was first championed by Field (1972). However, the once-popular conception of its tasks included an over-ambitious view of basic metasemantics. It was thought that reference needed to be analyzed (or reduced a posteriori) in terms of more fundamental, non-semantic relations (e.g. causal relations, indication, or teleological relations, in the case of mental representation). Obstacles in providing such an analysis engendered skepticism towards this understanding of truth and eventually gave way to its deflationary competitors. This dissertation aims to defend the modern, object-based correspondence theory against its rivals—especially deflationism. Chapter one provides a historically-grounded overview of the theory. Chapter two identifies two points of contrast between the correspondence theorist and the deflationist: they employ different orders of explanation for the variety of semantic phenomena, and they (traditionally) take different attitudes towards the prospects of reduction. Situating the dialectic in this way allows me to develop a middle ground: a moderate version of inflationism that takes the inflationary explanatory structure and combines it with a non-reductive, pluralist approach to basic metasemantics. Chapter three expands on the details of this pluralist account of reference. Chapter four contrasts the view with another rival approach to basic metasemantics: metasemantic interpretationism. And finally, chapter five applies the theory to answer another question of broad philosophical interest: what role does our conception of truth play in inquiry about the world? (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Cassava and soybean flour were used to produce biscuits in different ratios in an attempt to substitute or replace wheat. Composite flour, made from a combination of cassava and soybean flour, was processed into biscuits using varying proportions. The ratios ranged from 10% to 50% soybean flour and 90% to 50% cassava flour. The proximate evaluation revealed that including 20% soybean flour in the cassava flour, making up 80% of the mixture, resulted in a significant level of protein and (...) other nutrients that closely compared to those found in 100% wheat flour. The protein and fat content increased significantly as the proportion of soy flour increased, leading to a corresponding decrease in the carbohydrate content of the analyzed biscuit samples. This study demonstrates that a blend of 80% cassava flour and 20% soy flour produced biscuits with good nutritional quality. The sensory evaluation and overall acceptance of the product showed no significant difference between the 80:20 blend and the control (100% wheat). (shrink)

Abstract The purpose of this paper is twofold: (i) we will argue that formal semantics might have faltered due to its failure in distinguishing between two fundamentally very different types of concepts, namely ontological concepts, that should be types in a strongly-typed ontology, and logical concepts, that are predicates corresponding to properties of, and relations between, objects of various ontological types; and (ii) we show that accounting for these differences amounts to a new formal semantics; one that integrates lexical and (...) compositional semantics in one coherent framework and one where formal semantics is embedded with a strongly typed ontology; an ontology that reflects our commonsense knowledge of the world and the way we talk about it in ordinary language. We will show how in such a framework a number of challenges in the semantics of natural language are adequately and systematically treated. (shrink)

Recent philosophical accounts of discrimination face challenges in accommodating robust intuitions about the particular way in which it is wrongful—most prominently, the intuition that discriminatory actions intrinsically violate equality irrespective of their contingent consequences. The paper suggests that we understand the normative structure of discrimination in a way that is different from the one implicitly assumed by these accounts. It argues that core discriminatory wrongs—such as segregation in Apartheid South Africa—divide into two types, corresponding to violations of relational and distributive (...) equality; and that a pluralistic view of the internal structure of each type should be adopted. This normative structure serves to appropriately vindicate the mentioned intuitions; it also contributes to clarifying the normative underpinnings of legal concepts associated with discrimination (including the distinctions between direct and indirect, or ‘disparate treatment/impact’ discrimination, and intentional vs. unintentional discrimination), and developing a more productive public discourse around allegations of discrimination. The e-value of a hypothesis H, ev, is a Bayesian epistemic, credibility or truth value defined under the Full Bayesian Significance Testing mathematical apparatus. The questions addressed concern the important issue of how the truth value of H, and the truth function of the corresponding FBST structure M, relate to (...) the truth values of its elementary constituents, Hj, and to the truth functions of their corresponding FBST structures Mj, respectively. It is a widely held view in philosophy that propositions perform a plethora of different theoretical roles. Amongst other things, they are believed to be the semantic values of sentences in contexts, the objects of attitudes, the contents of illocutionary acts, and the referents of that-clauses. This assumption is often combined with the claim that propositions have their truth-values eternally. In this paper I aim to show that these two assumptions are incompatible: propositions cannot both fulfill the mentioned roles and (...) be eternally true or false. Following Kaplan and Lewis’s Operator Argument, I argue that compositional semantic values of sentences in contexts do not correspond to eternal propositions. Thus, either we regard the non-eternal entities that in fact realize the semantic role of propositions as also fulfilling the remaining propositional roles, or we abandon the assumption that there is a unique realizer of all the roles. The Operator Argument has recently come under attack, mainly for its tense-logical assumptions. However, rejecting these assumptions is not a sufficient defense of the compatibility of the two claims, since the extensional alternative to the tense-logical framework does not allow us to universally retain eternal propositions as compositional semantic values of sentences either. It is universally acknowledged that, for St. Thomas, there is a distinction between human persons or supposits and their natures or essences. But it is usually thought that there is no parallel distinction between the angelic person or supposit and its nature. Yet, as this paper argues, Aquinas consistently puts forward just such a distinction. This paper surveys Aquinas’s arguments for the unique identity of God with his essence and the corresponding distinctions between created persons and their essences, showing in (...) the process how the distinction found in angels differs from that found in material substances. It is important to recognize the distinction between supposit and nature in angels not only for its own sake as it touches on his understanding of created persons—human or angelic—but also insofar as it sheds light on Aquinas’s understanding of divine simplicity and of other act-potency compositions in creatures. Everyday media consumption leaves no doubt that the perception of moving images from various media is characterized by experience and understanding. Corresponding research in this field has shown that the stimulus patterns flooding in on us are not only processed mentally, but also bodily. Building on this, the following study argues that incoming stimuli are processed not only visually, but multimodally, with all senses, and moreover affectively. The classical binding of a sensory organ to a medium, on whose delimitation the (...) common understanding of multimodality is based, is thus abolished. Can arguments for this assumption be found? Building on the research of cultural anthropologist Ernst Cassirer and his successors, the two American philosophers Susanne K. Langer and John M. Krois, and supported by research from the life sciences in which, in parallel, the arts also play an important role in understanding image formation, as in the work of Heinz Werner and, following on from this, in the more recent research of the child psychologist Daniel N. Stern in collaboration with mirror neuron research by the group of neuroscientists around Giacomo Rizzolatti in Parma, justifications for this will be provided. What the multimodal processing of film images is concretely based on will finally be made clear by means of an exemplary analysis of a video film by the Swiss artist Pipilotti Rist. It aims to prove, that the prerequisites for the thesis can only lie in the fact, that both the modes of perception (visual, tactile, auditory, olfactory, gustatory) as well as the medially conditioned modes of image formation are based on non-discursive, formal-abstract structures that are also processed affectively. At the same time, the analysis thus shows how the selection and composition of the vital experienced forms can provide information about the socio-culturally shaped self-image of the producer and the viewer. This study used a partial least squares structural equation modelling (PLS-SEM) to estimate curriculum management's direct and indirect effects on university graduate programmes' viability. The study also examined the role of institutional effectiveness in mediating the nexus between the predictor and response variables. This is a correlational study with a factorial research design. The study's participants comprised 149 higher education administrators (23 Faculty Deans and 126 HODs) from two public universities in Nigeria. A structured questionnaire designed by the researchers (...) was used for data collection. The questionnaire was duly validated with an acceptable scale and item content validity indices. The dimensionality of the instrument was determined using exploratory factor analysis (EFA). Convergent validity was based on Average Variance Extracted (AVE), whereas discriminant validity was based on Fornell-Lacker criteria and the Hetero-Trait Mono-Trait (HTMT) ratio. Acceptable composite reliability estimates of internal consistency were reached for the three sub-scales. Following ethical practices, the questionnaire was physically administered to respondents and retrieved afterwards. Smart PLS (version 3.2.9) and SPSS (version 26.0) programs were used for all the statistical analyses. This study uncovered significant direct and indirect effects of curriculum management on the viability of graduate programmes. Institutional effectiveness significantly impacted graduate programmes’ viability while mediating the nexus between curriculum management and graduate programmes’ viability. Curriculum management and institutional effectiveness jointly explained a significant proportion of graduate programmes’ viability variance. The result of this study proved that graduate programmes’ viability depends, to a great extent, on how much curriculum is managed and how effective institutions are with their services. The result of this study can enable institutions seeking to run viable graduate programmes to re-evaluate their curriculum management practices and the effectiveness of their services. (shrink)

In this paper we discuss a new perspective on the syntax-semantics interface. Semantics, in this new set-up, is not ‘read off’ from Logical Forms as in mainstream approaches to generative grammar. Nor is it assigned to syntactic proofs using a Curry-Howard correspondence as in versions of the Lambek Calculus, or read off from f-structures using Linear Logic as in Lexical-Functional Grammar (LFG, Kaplan & Bresnan [9]). All such approaches are based on the idea that syntactic objects (trees, proofs, fstructures) (...) are somehow prior and that semantics must be parasitic on those syntactic objects. We challenge this idea and develop a grammar in which syntax and semantics are treated in a strictly parallel fashion. The grammar will have many ideas in common with the (converging) frameworks of categorial grammar and LFG, but its treatment of the syntax-semantics interface is radically different. Also, although the meaning component of the grammar is a version of Montague semantics and although there are obvious affinities between Montague’s conception of grammar and the work presented here, the grammar is not compositional, in the sense that composition of meaning need not follow surface structure. The study area was a small lowland river valley (the Łęg river) located in the south-east of Poland. The object of investigation was the macrophytes of 10 river lakes with corresponding active river channel stretches of the same length as the cut-offs. The aim was to check the difference in species diversity between cut-off and active river channels. The second aim was to test the following hypothesis: vegetation of river lake has been shaped under the influence of contiguous river stretch (...) which has left a measurable mark in species abundance and composition. To test this, we checked whether a cut-off channel’s flora is more similar to flora of the contiguous river stretch, than to flora of a farther river stretch. During the course of the study it was found that the average species richness was approximately two times higher in the cut-off channels than in the river stretches. The number of the species exclusive for the river lakes was nine times higher in comparison with the river’s exclusives (not found in the cut-offs). The Shannon diversity index definitely spoke in favor of the river lakes. These results clearly show the significance of river lakes in maintaining biodiversity of aquatic ecosystems in a small river valley. We did not confirm our hypothesis concerning floristic relation between an active channel and its cut-offs. The floristic similarity between a given cut-off channel and the contiguous active river channel stretch is not stronger than the similarity between this lake and more distant river stretches. The cause of such a state of affairs may be high natural dynamics of investigated habitats and anthropogenic transformation of the river valley. (shrink)

This article arises indirectly out of the development of a particular approach, called ATT-Meta, to the understanding of some types of metaphorical utterance. However, the specifics of the approach are not the focus of the present article, which concentrates on some general issues that have informed, or arisen from, the development of the approach. The article connects those issues to the questions of metaphorical meaning and truth. -/- A large part of the exploration of metaphor in fields such as Cognitive (...) Linguistics and natural language Pragmatics takes metaphor to rest on complex mappings between a target subject matter and a source subject matter (see, e.g., Lakoff 1993, 2008). This is one main way in which some aspects of the source, generally including some structural aspects, can have parallels in the target. It is typical for much, and perhaps the whole, of the meaning of a metaphorical expression to be explained by means of these parallels. We will talk about “parallelism” rather than “isomorphism,” or even “analogy,” because “isomorphism” implies a strict one-to-one correspondence between items in the source scenario and items in the target scenario, and analogy theorists often hold that analogy rests on isomorphism. We wish not to prejudge the question of whether looser, messier forms of parallelism are sometimes needed. Also, we will talk about parallels rather than mappings, because our discussion will embrace the question of parallelism that may be discernible, albeit implicitly, in accounts of metaphor that are not presented as being based on mappings. Three main cases of such accounts are Relevance Theory (RT: e.g., Sperber & Wilson 2008, Wilson & Carston 2006), the categorization-based or "class-inclusion“ approach (Glucksberg 2008), and Ritchie’s (2006) CLST account (Context-Limited Simulation Theory). -/- One main issue we will address is that of substantial non-parallelism that can exist between source and target subject-matters in metaphor: more precisely, the issue that there may be source aspects that are exploited by the utterance and have a deep effect on metaphorical interpretation but that do not themselves have a natural parallel in the target subject-matter (although we will point out that artificial parallels can generally be created). This is part of a broader point that the content of metaphorical discourse should often be seen as being derived in a rather holistic way from several metaphorical bits of the discourse, which conspire to describe some source-domain scenario, rather than being derived by putting together metaphorical meanings of each metaphorical bit (even if each bit could in principle be assigned its own separate metaphorical meaning). As a result, we suggest that it is misguided to think of the propositions making up the content (or, if you like, "meaning“) about the target scenario that is being described is a matter of metaphorical meaning of specific grammatical units such as sentences, clauses or other constituents that a traditional semantic theory would assign propositional meaning to. Rather, grammatical units (that are to be taken metaphorically) have meanings in source-domain terms; content in target-domain terms is derived from the source-domain scenario depicted by those units and fleshed out through inference; and the target-domain content is only (in general) fuzzily relatable to particular grammatical units. This view is on a spectrum at whose extreme point we could place Davidson’s (1984) view that metaphors only have literal (i.e., source-domain) meanings, with other effects on the understander not being a matter of propositional content. However, on our view it is proper to take metaphorical discourse as having non-literal meaning, couched as a collection of propositions, among other things possibly; it is just that the propositions are not to be thought of (in general) as meaning of specific sentences, clauses or other grammatical units rather than of a possibly only fuzzily delineated piece of discourse. -/- A second main concern of the article is the question of how much, and what types of, inference are involved in the derivation of metaphorical meaning. While our own ATT-Meta approach accords with, amongst other accounts, Relevance Theory (RT) as to the centrality of inference in metaphor interpretation, we disagree with RT on its claim that metaphor interpretation is a matter of (a relatively high degree of) concept "broadening“ and (often) "narrowing“. We argue that almost all inference can in fact be theoretically re-described as concept broadening and/or narrowing, and what is left over should be included in the metaphor interpretation process anyway. Thus, the RT claim about broadening and narrowing really just says that inference, of unrestricted type, is involved in metaphor understanding, in accord with what ATT-Meta claims. (shrink)

The epistemological study and retrospection in fundamentals of sense perception and recollection is examined to understand the foundation of Memory. -/- This analysis is based on few simple tests from day to day experiences. With it, the well-known electroencephalography (EEG) signal data of individual's waking, dream and deep sleep states also analyzed. The examination establishes two fundamental discoveries: -/- 1: A “Self induced” brain wave, having content related to old term “ego”, I, Me and Myself, which corresponds to “Self Awareness”. (...) Recently, the relationship between evolutionary ecology and perceptual science has received renewed attention under perception-mediated selection, a mode of natural selection linking perceptual saliency, rather than veridicality, to fitness. The Interface Theory of Perception (ITP) has been especially prominent in claiming that an organism’s perceptual interface is populated by icons, which arise as a function of evolved, species-specific perceptual interfaces that produce approximations of organisms’ environments through fitness-tuned perceptions. According to perception-mediated selection, perception and behavior calibrate one another as organisms’ (...) capacities to experience and know the objects and properties of their environments lead to responses highlighting certain environmental features selected for survival. We argue this occurs via the Umwelt/Umgebung distinction in ethology, demonstrating that organisms interact with their external environments (Umgebung) through constructed perceptual schema (Umwelt) that produce constrained representations of environmental objects and their properties. Following Peircean semiotics, we claim that ITP’s focus on icons as saliency-simplified markers corresponds to biosemiotics’ understanding of perceptual representations, which manifest as iconic (resembling objects), indexical (referring), or symbolic (arbitrary) modalities, which provide for organisms’ semiotic scaffolding. We argue that ITP provides the computational evidence for biosemiotics’ notion of iconicity, while biosemiotics provides explanation within ITP for how iconicity can build up into indices and symbols. The common contention of these separate frameworks that the process of perception tracks saliency rather than veridicality suggests that digital/dyadic perceptual strategies will be outcompeted by their semiotic/triadic counterparts. This carries implications for evolutionary theory as well as theories of cognition. (shrink)

Karl Pearson is the leading figure of XX century statistics. He and his co-workers crafted the core of the theory, methods and language of frequentist or classical statistics – the prevalent inductive logic of contemporary science. However, before working in statistics, K. Pearson had other interests in life, namely, in this order, philosophy, physics, and biological heredity. Key concepts of his philosophical and epistemological system of anti-Spinozism (a form of transcendental idealism) are carried over to his subsequent works on the (...) logic of scientific discovery. This article’s main goal is to analyze K. Pearson early philosophical and theological ideas and to investigate how the same ideas came to influence contemporary science, either directly or indirectly – by the use of variant theories, methods and dialects of statistics, corresponding to variant statistical inference procedures and their specific belief calculi. Extruded polystyrene (XPS) otherwise known as a thermoplastic polymer has a closed cell structure and is often stronger, with a higher mechanical performance. XPS is a pressed material and is sold in different thicknesses ranging from 2 cm to 10 cm, thus having a weight that varies from 28 to 45 kg/m3 due to the force and pressure exerted on it. In general, XPS material has very low thermal conductivity and is resistant to bending. This material obtains typical values of (...) thermal conductivity between 0.025 and 0.040 W/m∙K., which means that it is ideal for surfaces that have to withstand weight, continuous traffic, etc. It is also resistant to moisture absorption and has a homogeneous density. Other characteristics of the material are good acoustic properties, easy assembly, and high durability over time. It should always be kept in mind that the surface where the thermal insulation will be applied must be leveled, cleaned, and dried. Primer is applied, before placing the thermal insulation on the surface. Then, XPS boards are placed on the surface, adhering to the corresponding mortar. This paper will deal with different cases of application of XPS tiles in the city of Tirana. A closer look at the resistance of this material from the day of application until today will be analyzed. The results during the observations showed high thermal stability of the material and no mold surface. EPS Expanded Polystyrene, otherwise known by the Dow Chemical trademark name STYROFOAM, is a lightweight product made from expanded plastic beads. It was first discovered by Eduard Simon in 1839 in Germany. EPS in its composition has 95% air and only about 5% plastic. This material is used because of its excellent properties, including good thermal insulation, good protective properties, and extremely lightweight. EPS is inert in nature and therefore does not result in any chemical reaction. EPS is durable, strong, and lightweight and can be used as an insulated panel system for facades, walls, roofs, and floors, as floating material in marine construction, and as a lightweight filler in road and railway construction. Different examples from the city of Tirana, of buildings where XPS and EPS materials are applied, are going to be analyzed, drawing conclusions. (shrink)

Aristotle differentiates between otherness (ἑτερότης) and difference (διαφορὰ). Otherness has no definite respect: one thing is other than another thing only because they are not the same. Every two things which are not the same are other than each other. Therefore, two things other than each other do not need something in which they are other than each other. Difference, on the other hand, has a definite respect and one thing is different from another thing in some respect. Thus, there (...) must be something identical whereby two different things differ. (Met. , I, 1054b23-27) Therefore, there is no difference between anything and the things outside its genus. (Met., I, 1055a26-27) 1) Difference Aristotle takes two things as identical things in which difference occurs: genus and species. All things that differ differ either in genus or in species. (Met., I, 1054b27-28) a) Difference in genus Two things are different in genus if they ‘have not their matter in common and are not generated out of each other,’ which means that they belong to different figures of predication. (Met., I, 1054b28-29) They have no way to one another and are too far distinct and are not comparable. (Met., I, 1055a6-8) b) Difference in species Two things are different in species if they have the same genus (Met., I, 1054b29-30) but are not subordinate one to the other. (Met., Δ, 1018a38-b7) 2) Contrariety Aristotle mentions five senses. In the first sense he calls contraries ‘those attributes that differ in genus, which cannot belong at the same time to the same subject.’ (Met., Δ, 1018a25-27) Three senses emphasize on having the most difference either in the same genus, the same receptive material or the same category, all similar to genus. The fifth sense also insists on having the greatest difference but mentions species besides genus as where difference occurs. (Met., Δ, 1018a27-31) It seems that Aristotle is more inclined to the second sense as his definition in Metaphysics, I, 1055a27-29 might concede: ‘The things in the same genus which differ most are contraries; for the complete difference is the greatest difference among these,’ though he agrees with the third sense too and regards those that differ most in the same receptive material also as contraries. (Met., I, 1055a29-30) In fact, Aristotle speaks of all kinds of contraries within, without or in genera: ‘All contraries must either be in the same genus or in contrary genera or be themselves genera.’ Their corresponding examples are white and black (in the same genus), justice and injustice (in contrary genera) and good and bad (themselves genera). (Cat., 11, 14a19-25) To speak generally, as one of the four kinds of opposition, contraries are those that cannot belong at the same time to the same thing. (Met., Γ, 1011b15-18) Thus, contrariety (ἐναντιότης) is complete difference (Met., I, 1055a16-17) and contraries are the extremes of things that differ in species for which generation takes place and have the greatest distance. (Met., I, 1055a8-10; Δ, 1018a38-b7) Since contraries have the extreme difference, there cannot be more than one contrary and extreme for each thing. (Met., I, 1055a19-21) Thus, the things in the same genus which differ most are contraries. (Met., I, 1055a27-28) Aristotle says that the meaning of calling two things ‘other in species’ is that they are contrary and this being other in species he posits versus being the same in species. (Met., I, 1058a17-28) Aristotle even calls ‘the difference between things which differ in species’ a difference that belongs only to things in the same species. (Met., I, 1058a26-28) The reason is that ‘all things are divided by opposites and … contraries are in the same genus … and every difference in species is a difference from something in something … Hence also all contraries which are different in species … are … other than one another in the highest degree- for the difference is complete-, and cannot be present along with one another.’ The conclusion is that ‘The difference, then, is a contrariety.’ (Met, I, 1058a8-16) There are some characteristics for contraries in Aristotle’s philosophy: a) One thing cannot have more than one contrary for there can be neither anything more extreme than the extreme, nor more than two extremes for the one interval. (Met., I, 1055a19-21) b) The primary contrariety is the contrariety between state and complete privation. (Met., I, 1055a33-37) Aristotle regards privation both as a kind of contradiction (Met., I, 1055b3-11) and as that of which contrariety is a kind: all contrariety is a privation but not all privation is contrariety. (Met., I, 1055b11-17) In fact, every contrariety involves a privation as one of its items (Met, I, 1055b17-19 and b25-29): ‘of the contraries, no less than of the contradictories, one is a privation- and a privation of substance; and privation is the denial of a predicate to a determinate genus.’ (Met., Γ, 1011b18-20) Nonetheless, the relation between contrary, privation and contradictory seems to be even more complex:’For within a single identical genus the contrary of a given attribute is either its privative or its contradictory; e.g. within number what is not odd is even, inasmuch as within this sphere even is a necessary consequent of not-odd.’ (PsA., A, 4, 73b21-24) c) A contrary cannot be an intermediate because otherwise it would not be a perfect contrary, which must be based on definition. (Met., I, 1056a12-14) d) Contraries always accept intermediates between themselves. (Met., I, 1056a14-15 e) ‘Contraries do not involve one another in their composition, and are therefore first principles.’ (Met., I, 1057b22-23) f) ‘All the inferior classes, both the contraries and their intermediates, will be compounded out of the primary contraries.’ (Met., I, 1057b31-34) g) None of the intermediables can be predicated of either of the contraries. (Met., K, 1063b19-22) h) Contrary propositions (as defined in OI, I, 7, 17b3-6) can never both be true because they state contrary conditions which cannot subsist at one and the same time in the same subject. (OI, II, 14, 24b7-) 3) Otherness in kind Aristotle also speaks of things other in kind (ἓτερα τῷ γένει) by which he means an otherness between things ‘whose ultimate substratum is other and one cannot be analysed to the other nor both into the same thing. His example of this otherness in kind is the otherness of form and matter. (Met., Δ, 1024b9-12) 4) Network of difference and wholism Aristotle speaks of a theory based on which the knowledge of each thing depends on the knowledge of its differentiae distinguishing it from every single other thing. Therefore, to know and define one thing we need to know the whole existence. (PsA., B, 13, 97a6-11) Aristotle rejects this theory based on the fact that ‘not every differentia precludes identity’ and, thus, many differentiae inhere in things specifically identical, though not in the substance of these nor essentially.’ (PsA., B, 13, 97a11-14) 5) Knowledge and difference There must be some kind of relation between knowledge and difference in Aristotle’s saying that sight, more than other senses, makes us know and bring in light many differences between things. Determiner phrases embedded under a propositional attitude verb have traditionally been taken to denote answers to implicit questions. For example, 'the capital of Vermont' as it occurs in 'John knows the capital of Vermont' has been thought to denote the proposition which answers the implicit question 'what is the capital of Vermont?' Thus, where 'know' is treated as a propositional attitude verb rather than an acquaintance verb, 'John knows the capital of Vermont' is true iff John knows that Montpelier is (...) the capital of Vermont. The traditional view lost its popularity long ago, because it was thought to rest on the controversial assumption that determiner phases embedded under a propositional attitude verb function semantically in the same way as the corresponding wh-clauses. Here we defend the traditional assumption against objections. We then argue that wh-clauses are not to be given a uniform treatment as indirect questions. When occurring under a propositional attitude verb, wh-clauses are better treated as having a predicate-type semantic value. We conclude by considering some possible objections to the predicate view. Adherence to such an approach in the development of public administration mechanisms increases the likelihood that in the case of their implementation in the country there will be positive changes, as they will indirectly take into account the availability of necessary resources. Information and analytical technology (...) to support decisions in the field of labor economics substantiates the development of the example of discharged military personnel social welfare. According to the content, the developed decision support information-analytical technology in the field of labor economics provides for the following components: formation of social protection mechanisms; development of a questionnaire on the use of the appropriate mechanism; statistical analysis of survey results (generation of empirical distributions of answers to questions relative frequencies; comparison of answers medians; correspondences analysis; factor analysis; analysis of hierarchies); meaningful interpretation; decision making. Donald Davidson was one of the most influential philosophers of the last half of the 20th century, especially in the theory of meaning and in the philosophy of mind and action. In this paper, I concentrate on a field-shaping proposal of Davidson’s in the theory of meaning, arguably his most influential, namely, that insight into meaning may be best pursued by a bit of indirection, by showing how appropriate knowledge of a finitely axiomatized truth theory for a language can put (...) one in a position both to interpret the utterance of any sentence of the language and to see how its semantically primitive constituents together with their mode of combination determines its meaning (Davidson 1965, 1967, 1970, 1973a). This project has come to be known as truth-theoretic semantics. My aim in this paper is to render the best account I can of the goals and methods of truth-theoretic semantics, to defend it against some objections, and to identify its limitations. Although I believe that the project I describe conforms to the main idea that Davidson had, my aim is not primarily Davidson exegesis. I want to get on the table an approach to compositional semantics for natural languages, inspired by Davidson, but extended and developed, which I think does about as much along those lines as any theory could. I believe it is Davidson’s project, and I defend this in detail elsewhere (Ludwig 2015; Lepore and Ludwig 2005, 2007a, 2007b, 2011). But I want to develop and defend the project while also exploring its limitations, without getting entangled in exegetical questions. (shrink)

Understanding, for Kant, does not intuit, and intuition—which involves empirical information, i.e., sense-data—does not entail thinking. What is crucial to Kant’s famous claim that intuitions without concepts are blind and concepts without intuitions are empty is the idea that we have no knowledge unless we combine concepts with intuition. Although concepts and intuition are radically separated mental powers, without a way of bringing them together (i.e., synthesis) there is no knowledge for Kant. Thus Kant’s metaphysical-scientific dualism: (scientific) knowledge is limited (...) to the world of phenomena—the world of appearance—while the thing-in-itself is unknowable because there is no intuition that can correspond to the it. This paper sets to cull Béatrice Longuenesse’s recent work on the first-person ‘I’ and put forth a novel Kantian approach to the first-person reference of mental states, working in the tradition of P.F. Strawson, Rudolf Carnap, and Wilfrid Sellars, while offering an empirical study of deafferentation to ground the thesis that the binding of representations is separate from phenomenal consciousness. Accordingly, we stake a kind of self-consciousness vis-à-vis the Fundamental Reference-Rule qua apperception that, while intimately connected to consciousness of one’s own body, apperception is nevertheless distinct from it and is, moreover, the condition for any use of ‘I’. We compliment neuroscientist Oliver Sacks’ research with Ned Block’s recent work on “no-post‐perceptual cognition” and attentional variation to couch Kant’s schema in perceptual psychology. We navigate Kant’s work on intuitions (viz. sensation, perception, and the empirical side of the cognitive faculties) and indirect realism/weak representationism first via Sellars’ naturalization of Kant’s inaccessible thing-in-itself, before challenging Sellars’ functionalist and inferentialist conception of perception and discursive intentionality. We ultimately endeavor to conceptualize the limit-conditions regarding our having reportable knowledge about our access to percepts and concepts. (shrink)

The representationist maintains that an experience represents a state of affairs. To elaborate, a stimulus of one’s sensorium produces, according to her, a “phenomenal composite” made up of “phenomenal properties” that are the typical effects of certain mind-independent features of the world, which are thereby represented. It is such features, via their phenomenal representatives, of which the subject of an experience would become aware were she to engage in introspection. So, one might ask, what state of affairs would be (...) represented by an illusory experience, that is, one to which no state of affairs in the vicinity of its subject corresponds? The answer, according to the standard defense of representationism (SD), is the same state of affairs that would obtain in its subject’s surroundings if it were veridical. (shrink)

But I add them, with no detriment to the doctrine itself. Starting from a philosophical perspective, which states that the living structures are actually a combination between matter and information, this article presents the results on an analysis of the bipolar information-matter structure of the human organism, distinguishing three fundamental circuits for its survival, which demonstrates and supports this statement, as a base for further development of the informational model of consciousness to a general informational model of the human organism. For this, it was examined the Informational System of the Human (...) Body and its components from the perspective of the physics/information/neurosciences concepts, showing specific functions of each of them, highlighting the correspondence of these centers with brain support areas and with their projections in consciousness, which are: Center of Acquisition and Storing of Information (CASI) reflected in consciousness as memory, Center of Decision and Command (CDC) (decision), Info-Emotional Center (IES) (emotions), Maintenance Informational System (MIS) (personal status), Genetic Transmission System (GTS) (associativity/genetic transmission) and Info Genetic Generator (IGG) related by the body development and inherited behaviors. The Info Connection (IC), detected in consciousness as trust and confidence can explain the Near-Death Experiences (NDEs) and associated phenomena. This connection is antientropic and informational, because from the multitude of uncertain possibilities is selected a certain one, helping/supporting the survival and life. The human body appears therefore as a bipolar structure, connected to two poles: information and matter. It is argued that the survival, which is the main objective of the organism, is complied in three main ways, by means of: (i) the reactive operation for adaptation by attitude; (ii) the info-genetic integration of information by epigenetic processes and genetic transmission of information for species survival, both circuits (i) and (ii) being associated to the information pole; (iii) maintenance of the material body (defined as informed matter) and its functions, associated to the matter pole of the organism. It results therefore that the informational system of the human body is supported by seven informational circuits formed by the neuro-connections between the specific zones of the brain corresponding to the informational subsystems, the cognitive centers, the sensors, transducers and execution (motor/mobile) elements. The fundamental informational circuits assuring the survival are the reactive circuit, expressible by attitude, the epigenetic/genetic circuit, absorbing and codifying information to be transmitted to the next generations, and the metabolic circuit, connected to matter (matter pole). The presented analysis allows to extend the informational modeling of consciousness to an Informational Model of Consciousness and Organism, fully describing the composition/functions of the organism in terms of information/matter and neurosciences concept. In this paper, we present a way to translate the metainferences of a mixed metainferential system into formulae of an extended-language system, called its associated σ-system. To do this, the σ-system will contain new operators (one for each standard), called the σ operators, which represent the notions of "belonging to a (given) standard". We first prove, in a model-theoretic way, that these translations preserve (in)validity. That is, that a metainference is valid in the base system if and only if its (...) translation is a tautology of its corresponding σ-system. We then use these results to obtain other key advantages. Most interestingly, we provide a recipe for building unlabeled sequent calculi for σ-systems. We then exemplify this with a σ-system useful for logics of the ST family, and prove soundness and completeness for it, which indirectly gives us a calculus for the metainferences of all those mixed systems. Finally, we respond to some possible objections and show how our σ-framework can shed light on the “obeying” discussion within mixed metainferential contexts. (shrink)

This study investigated innovation management and effectiveness of educational research in tertiary institutions in Cross River State. One research question and one null hypothesis were formulated to direct the study. The study adopted factorial research design. Census technique was adopted by the researcher in selecting the entire population of 80 participants from four (4) tertiary institutions in Cross River State. “Innovation Management Questionnaire (IMQ)” and “Effectiveness of Educational Research Rating Scale (EERRS) were used as instruments for data collection. The reliability (...) of the instruments was established through test-retest method and reliability estimates of .89 and .86 were obtained. The null hypothesis was tested at .05 level of significance using multiple regression analysis with the aid of SPSS version 21. Findings from the study established a composite contribution of 70.5% of data management innovations, research ethics management, provision of research grants to effectiveness of educational research (Adj. R2= .705). The findings of this study also established that; data management innovations, research ethics management, and provision of research grants jointly has a significant influence on effectiveness of educational research (F = 64.055, p <.05). Data management innovations was the highest predictor (β = .501, t = 7.778), followed by research ethics management ethics management (β = .311, t = 3.956), and provision of research grants (β = .291, t = 3.707) in that order. Based on the findings, it was recommended, amongst others, that educational research data (including coded data) should be effectively managed by tertiary institutions using both manual and computerized data management devices with corresponding appropriate retrieval systems. Modern generally accepted models of the growth of knowledge are scrutinized. It is maintained that Thomas Kuhn’s growth of knowledge model is grounded preeminently on Heidegger’s epistemology. To justify the tenet the corresponding works of both thinkers are considered. As a result, the one-to-one correspondence between the key propositions of Heideggerian epistemology and the basic tenets of Kuhn’s growth of knowledge model is elicited. The tenets under consideration include the holistic nature of a paradigm, the incommensurability thesis, conventional status (...) of a paradigm caused by pragmatist way of its vocabulary justification and even the basic instance – connection between Aristotelean and Newtonian mechanics. It is conjectured that an indirect influence of Heidegger upon Kuhn should be taken into account to explain the isomorphism. For instance, through the works of Alexandre Koyré admired by Kuhn. As is well-known, Koyré had close professional links with another Russian émigré – Alexandre Kojev – who presented in his 1933-1939 Paris lectures Hegel’s “Phenomenology of Spirit” seen through the cognitive lens of Heideggerian phenomenology. Formal semantic analyses often take words to be minimal building blocks for the purposes of compositionality. But various recent theories of morphology and syntax have converged on the view that there is no demarcation line corresponding to the word level. The same conclusion has emerged from the compositional semantics of superlatives. In the spirit of extending compositionality below the word level, this paper explores how a small set of particles (Japanese KA and MO, Chinese DOU, and Hungarian VALA/VAGY, MIND, and (...) IS) form quantifier words and serve as connectives, additive and scalar particles, question markers, and existential verbs. The main question is whether the meanings of these particles across the varied environments are highly regular, or they are lexicalized with a variety of different meanings that bear a family resemblance. This paper does not reach definitive conclusions, but it raises analytical possibilities using Boolean semantics and the semantics of alternatives. It also draws attention to systematic similarities and some differences between MO and DOU that have not been studied in the literature. (shrink)

The phenomenon of presupposition suspension can be analyzed in terms of explicatures and the corresponding non-presumptive interpretative reasoning underlying it. On the view presented in this paper, the polyphonic articulation of an utterance at different levels can be used to explain cases in which presuppositions are suspended. Presuppositional suspensions indicate that the presumptive reading does not hold and a different interpretation is needed. Utterances can display various types of polyphonic structures, accounting for the speaker’s and the hearer’s commitments. A speaker (...) can be held directly responsible for what he says, but he is committed only indirectly to what he presupposes, i.e. what is uttered by a second voice (the second utterer or enunciator) representing what the common opinion accepts to be true. The reconstruction of the pragmatic structure of an utterance is guided by a complex type of reasoning, which can be represented as an argumentative abductive pattern, grounded on hierarchies of presumptions. By comparing the possible presumptions associated with the explicit meaning and the contextual information, the hearer can find a best possible explanation of the intended effect of the utterance. The unity of consciousness has so far been studied only as a relation holding among the many experiences of a single subject. I investigate whether this relation could hold between the experiences of distinct subjects, considering three major arguments against the possibility of such ‘between-subjects unity’. The first argument, based on the popular idea that unity implies subsumption by a composite experience, can be deflected by allowing for limited forms of ‘experience-sharing’, in which the same token experience belongs to (...) more than one subject. The second argument, based on the phenomenological claim that unified experiences have interdependent phenomenal characters, I show to rest on an equivocation. Finally, the third argument accuses between-subjects unity of being unimaginable, or more broadly a formal possibility corresponding to nothing we can make sense of. I argue that the familiar experience of perceptual co-presentation gives us an adequate phenomenological grasp on what between-subjects unity might be like. (shrink)

Developing earlier studies of the system of numbers in Mundurucu, this paper argues that the Mundurucu numeral system is far more complex than usually assumed. The Mundurucu numeral system provides indirect but insightful arguments for a modular approach to numbers and numerals. It is argued that distinct components must be distinguished, such as a system of representation of numbers in the format of internal magnitudes, a system of representation for individuals and sets, and one-to-one correspondences between the numerosity expressed (...) by the number and its metrics. It is shown that while many-number systems involve a compositionality of units, sets and sets composed of units, few-number languages, such as Mundurucu, do not have access to sets composed of units in the usual way. The nonconfigurational character of the Mundurucu language, which is related to a property for which we coin the term 'low compositionality power', accounts for this and explains the curious fact that Mundurucus make use of marked one-to-one correspondence strategies in order to overcome the limitations of the core system at the perceptual/motor interface of the language faculty. We develop an analysis of a particular construction, parallel numbers, which has not been studied before, elucidating the whole system. This analysis, we argue, sheds new light on classical philosophical, psychological and linguistic debates about numbers and numerals and their relation to language, and more particularly, sheds light on few-number languages. This paper begins the last instalment of a six-part project correlating the key aspects of Kant’s architectonic conception of philosophy with a special version of the Chinese Book of Changes that I call the “Compound Yijing”, which arranges the 64 hexagrams (gua) into both fourfold and threefold sets. I begin by briefly summarizing the foregoing articles: although Kant and the Yijing employ different types of architectonic reasoning, the two systems can both be described in terms of three “levels” of elements. Starting at an unnumbered level devoid of any element (the tao or thing in itself), the system proceeds by elaborating a key fourfold distinction (or “quaternity”) on the first level, a twelvefold distinction on the second level, and twelve quaternities (grouped in four quadrants, each with a set of three quaternities) on the third level. Each set of three quaternities (i.e., each quadrant) on the third level corresponds to one of the four “faculties” of the university, as elaborated in Kant’s book, The Conflict of the Faculties. Previous papers have examined the correlations between three key quaternities that Kant defends in relation to each of three faculties (philosophy, theology, and law) and the 12 gua that correspond to that faculty in the Compound Yijing. The final step is to explore the fourth quaternity on the third level, the 12 gua corresponding to the medical faculty. The “idea of reason” in Kant’s metaphysics that guides this wing of the comparative analysis is freedom, and the ultimate purpose of this faculty of the university is to train doctors to care for people’s physical well-being, as free agents imbedded in nature. But this paper will focus only on the four gua that correspond to four basic concepts in Kant’s theory of medicine. The two quaternities in the “yin-yang” (medical) quadrant of the Compound Yijing that will be skipped here are as follows. First, Kant’s account of the idea of freedom itself, which gives rise to the area of traditional metaphysics known as rational cosmology, comes in the first Critique’s Dialectic, in the section on the Antinomy of Reason (CPR A405-567/B432- 595). There he examines four irresolvable issues: whether the world has a beginning in time; whether composite substances consist of simple parts; whether a causality of freedom operates in the natural world; and whether an absolutely necessary being exists. Later I will argue that these correspond to the quaternity consisting of gua 15, 22, 36, and 52. (shrink)

Background: Liver cancer is one of the malignant tumors worldwide, while the prevention and control situation is grim at present, and the diffusion of its early screening technology still faces some challenges. This study aims to investigate the influencing mechanism of perceived ease of use, organizational support mechanism, and industry competitive pressure on hepatic early screening technologies use by physicians, so as to promote the wider use of corresponding technologies. -/- Methods: Under the theoretical guidance of technology-organization-environment framework and mindsponge (...) theory, this study took hepatic contrast-enhanced ultrasound as an example, and conducted a cross-sectional questionnaire by randomly selecting physicians from Fujian and Jiangxi provinces in China with a high and low incidence of liver cancer, respectively. Structural equation modeling was used to determine the correlation among perceived ease of use, organizational support mechanism, and industry competitive pressure, as well as their impact on the physicians’ behavior toward contrast-enhanced ultrasound use. -/- Results: The hypothesis model fits well with the data (χ2/df = 1.863, GFI = 0.937, AGFI = 0.908, RMSEA = 0.054, NFI = 0.959, IFI = 0.980, CFI = 0.980). Under technology-organization-environment framework, the perceived ease of use (β = 0.171, p < 0.05), organizational support mechanism (β = 0.423, p < 0.01), industry competitive pressure (β = 0.159, p < 0.05) significantly influenced physicians’ use of hepatic contrast-enhanced ultrasound. Besides, perceived ease of use and organizational support mechanism (β = 0.216, p < 0.01), perceived ease of use and industry competitive pressure (β = 0.671, p < 0.01), organizational support mechanism and industry competitive pressure (β = 0.330, p < 0.01) were all associated significantly. -/- Conclusion: From the lens of information processing (mindsponge theory) and technology-organization-environment framework, this study clarified the social and psychological influencing mechanism of perceived ease of use, organizational support mechanism, and industry competitive pressure on physicians’ use of hepatic contrast-enhanced ultrasound. The results will directly propose recommendations for expanding hepatic contrast-enhanced ultrasound utilization and indirectly promoting other appropriate and effective health technologies diffusion within the integrated health system. This is my contribution to a symposium on Berit Brogaard's book "Transient Truths" in which I criticize her treatment of various linguistic phenomena related to tense.

The link between the high-order metaphysics and abstractions, on the one hand, and choice in the foundation of set theory, on the other hand, can distinguish unambiguously the “good” principles of abstraction from the “bad” ones and thus resolve the “bad company problem” as to set theory. Thus it implies correspondingly a more precise definition of the relation between the axiom of choice and “all company” of axioms in set theory concerning directly or indirectly abstraction: the principle of abstraction, axiom (...) of comprehension, axiom scheme of specification, axiom scheme of separation, subset axiom scheme, axiom scheme of replacement, axiom of unrestricted comprehension, axiom of extensionality, etc. (shrink)

This article aims to readdress Hans-Georg Gadamer's first encounter with Plato's philosophy through his earlier academic journey, the direct and indirect influence exerted by his celebrated mentors at the University of Marburg, and his early publications. For this, I will resort not only to his intellectual biography, but also to neglected texts of Gadamer, such as his 1922 doctoral thesis, reviews and articles published between 1924 and 1928, correspondence, both edited and unpublished, philosophical interviews, as well as archive (...) footage. I will seek to determine the role of his early mentors around Plato’s interpretation through the analysis of the evolution of Gadamer's theoretical positions in order to elucidate his critical reassessments. In the conclusions, I will make an attempt to deepen on Gadamer's process of reception, rupture and emancipation around the then-dominant interpretations of Marburg neo-Kantianism, especially on the link between the philosophy of Plato and Aristotle, as well as the transformative character of Gadamer’s approach to the phenomenology of Scheler and Heidegger, and his incursion into classical philology. The nature of the soul and its relationship with the body have always been a matter of concern for philosophers throughout the history of philosophy. Today, this and other related issues are discussed within the philosophy of mind under the name of mind-body problem. The issue of the mind-body problem, or the soul and its relation to the body, has received special attention in Islamic philosophy. One of the Muslim philosophers who extensively wrote on this issue was Sadraddin Shirazi, widely (...) known as Mulla Sadra. This paper examines Sadraddin Shirazi’s approach to the mind-body problem. It is known that historically, most philosophers regarded human beings as a composition of a material body and an immaterial soul. Although this dualistic approach to human beings has a long history, it became more popular due to French philosopher René Descartes’ endeavors. Generally, Muslim philosophers were also dualists, like Descartes. However, Sadraddin Shirazi, who was Descartes’ contemporary, rejects earlier philosophers’ theories on human nature. He claims that a human being, when it comes into existence, is material, while this material being gradually evolves into an immaterial being. The soul’s journey from material being to immaterial one becomes possible thanks to substantial motion. Shirazi’s famous theory on this issue is known as the soul’s corporeal origination and spiritual subsistence. Though this paper acknowledges Shirazi’s theory’s originality and coherence, it remains skeptical about the issue that whether his theory corresponds to dualism or monism. Now, after discussing Sadraddin Shirazi’s view on the issue, I can make the case that his corporeal origin soul theory is quite a revolutionary idea. In terms of the mind-body problem, even at the beginning, it solves the issue. Shirazi considers the soul bodily at its early stage. If the soul is not spiritual, then there is a material body and a material soul, and they can interact and unify. Therefore, there is no mind-body problem. However, then spirituality emerges, as do the mind-body problem. (shrink)

In a few texts, Thomas Aquinas says that the first operation of the intellect pertains to (respicit) “the quiddity of a thing” whereas the second operation pertains to “the to be itself of a thing” (esse). But Aquinas also says that quiddities are to the intellect as color is to the power of sight. Statements such as these seem to have led Jacques Maritain and Étienne Gilson to see esse as the proper object of the intellect’s second operation. Against this (...) conclusion, Fr Régis and Ralph McInerny have argued—using Aquinas’s In I Peryermenias, lecture 5—that since ‘is’ is a verb and ‘is’ signifies existence, but all verbs signify the first operation of the intellect, we must be able to form a concept of existence in the first operation of the intellect. This paper does three things. First, it analyzes the nature of the claim made by Maritain and Gilson. Second, it shows from internal textual evidence that “respicit ipsum esse rei” cannot mean what Maritain and Gilson take it to mean. The second operation of the intellect cannot have a proper object distinct from the object of the first operation, which is quiddities. Finally, this paper provides an alternative interpretation of In I Peryermenias, lecture 5, to the one given by McInerny. In that text, Aquinas does not speak about a particular concept of existence in the first operation of the intellect and signified by the verbs ‘is’ or ‘exists.’ Rather, he uses the word ‘esse’ in indirect speech to include generally any form or act joined to a subject by the copula, ‘is.’ Aquinas’s focus is not on what ‘esse’ or ‘est’ signifies, but on the mode in which it signifies (per modum actualitas) absent additional qualifying terms. The conclusion of this paper is that, although the esse contrasted with essence in Aquinas’s metaphysics corresponds to a concept in the intellect’s first operation, nevertheless, like the notions of blindness and of genus, this esse cannot fall properly within the intellect’s object. Some New Mechanists have proposed that claims of compositional relations are justified by combining the results of top-down and bottom-up interlevel interventions. But what do scientists do when they can perform, say, a cellular intervention, but not a subcellular detection? In such cases, paired interlevel interventions are unavailable. We propose that scientists use abduction and we illustrate its use through a case study of the ionic theory of resting and action potentials.

Peter van Inwagen’s answer to the Special Composition Question, call it Organicism, says the xs compose y iff the activity of the xs constitutes a life. What about suspended lives (i.e., cryptobiosis)? Suppose a cat is alive at t1, completely frozen at t2, then revived at t3. Is the cat alive while frozen? Plausibly no, which according to Organicism means the cat-qua-composite ceases to exist at t2. Intuitively, however, the same cat seems present at all of t1, t2, and (...) t3. To account for these intuitions, van Inwagen modifies his answer: the xs compose y iff the activity of the xs constitutes or results from a life. Alas, this modification permits problematic duplication cases where one collection of objects composes something, yet a duplicate collection does not. This prompts the search for alternative modifications that identify frozen organisms as composites without introducing duplication problems. A dispositional variant is proposed. (shrink)

In this paper, we will make explicit the relationship that exists between geometric objects and geometric figures in planar Euclidean geometry. That will enable us to determine basic features regarding the role of geometric figures and diagrams when used in the context of pure and applied planar Euclidean geometry, arising due to this relationship. By taking into account pure geometry, as developed in Euclid’s Elements, and practical geometry, we will establish a relation between geometric objects and figures. Geometric objects are (...) defined in terms of idealizations of the corresponding figures of practical geometry. We name the relationship between them as a relation of idealization. This relation, existing between objects and figures, is what enables figures to have a role in pure and applied geometry. That is, we can use a figure or diagram as a representation of geometric objects or composite geometric objects because the relation of idealization corresponds to a resemblance-like relationship between objects and figures. Moving beyond pure geometry, we will defend that there are two other ‘layers’ of representation at play in applied geometry. To show that, we will consider Euclid’s Optics. (shrink)
