O presente artigo tem por objetivo caracterizar as duas fases do pensamento bachelardiano intituladas diurna e noturna e o modo como determinadas noções que permeiam as duas etapas da filosofia do autor configuram uma comunicação recíproca entre elas, fazendo com que haja uma troca assídua de valores entre ambas as vertentes. Deste modo, tentar-se-á demonstrar o quanto o fluxo de uma fase a outra de seu pensamento denota um sentido de completude ao invés de desconexão, negação ou mesmo oposição. Conceitos (...) como descontinuidade, imagem e tempo orientarão nosso esforço em evidenciar tal complementariedade e aproximação entre as duas fases de pensamento de Gaston Bachelard. (shrink)

The initial foundations to the notion that Cometan's grandparents, Irene Mary Taylor and Derrick Taylor, should be recognised for their life as laypeople in the Roman Catholic Church first emerged in January 2020 and October 2021 respectively. The book explores the major remembered life events of Irene Mary Taylor, relates them to Catholic doctrine, and systematises them to form Irenianism, Irene Mary's eponymous Catholic system of thought. Cualquier propuesta de alternativa a la democracia representativa, sea para mejorarla, sea para sustituirla por otro tipo de forma política, debería de tomar en cuenta dos tipos de restricciones para que la alternativa en cuestión tenga mayores probabilidades de éxito. Al primer grupo de restricciones los llamaremos factores limitantes de la conducta humana, mientras que al segundo grupo los llamaremos funciones impropias de esa forma política, es decir, las funciones que no debería tener. Tanto los factores limitantes de la conducta (...) humana como las funciones impropias de una forma política son restricciones sobre lo que realmente, es decir, no utópicamente, podríamos hacer para mejorar a la democracia y en general a la gobernabilidad de las sociedades. Esas restricciones, que a continuación señalaré, constituyen los argumentos que me llevan a plantear la siguiente tesis: la democracia representativa puede y debe ser mejorada al reducir su alcance económico, político y social, pero continúa siendo una mejor opción de gobierno que cualquier alternativa, incluyendo la demarquía. What kind of reference (if any) do terms such as “pencil,” “chair,” “television,” and so on have? On the matter, a de-bate between directly referential theorists and descriptiv-ist theorists is open. It is largely acknowledged that natural kind terms (such as “water,” “gold,” “tiger,” etc.) are directly referential expressions (cf. Putnam,1975). That is, they are expressions whose reference is determined by their refer-ents' nature, independent of whether we know or will ever know what this nature is. However, it does not (...) seem like-wise convincing that all artifactual kind terms (like “pen-cil,” “chair,” “television,” etc.) semantically behave the same. Terms for artifactual kinds seem more likely to be subjected to a descriptivist view, that is, definable not by links to their extensions' nature but in terms of conjunctions or clusters of properties. In his celebrated “The Meaning of ‘Meaning’” (1975), Hilary Putnam originated the mentioned debate by arguing that artifactual kind terms also refer directly. Thus, the discussion ultimately revolves around establishing whether artifactual and natural kind terms are both directly referential expressions. The authors engaged in this debate have tried to argue in favor of (or against) Putnam's proposal by highlighting the similarities (or differences) between nat-ural vis-à-vis artifactual kind words and their respective ref-erents. Research has shown that the construction of visual representations may have a positive effect on cognitive skills, including argumentation. In this paper we present a study on learning argumentation through computer-supported argument diagramming. We specifically focus on whether students, when provided with an argument-diagramming tool, create better diagrams, are more motivated, and learn more when working with other students or on their own. We use learning analytics to evaluate a variety of student activities: pre and post questionnaires to explore motivational (...) changes; the argument diagrams created by students to evaluate richness, complexity and completion; and pre and post knowledge tests to evaluate learning gains. RESUMO A Transferência de Embrião (TE) em bovinos se trata de uma técnica mundialmente disseminada com objetivo de aumentar a capacidade reprodutiva da fêmea. Mantém vínculo direto com outras técnicas das biotecnologias da reprodução, como, a Ovum Pick-Up (OPU), Produção In Vitro e In Vivo de embriões (PIVE) e Transferência de Embrião em Tempo Fixo (TETF), sendo estas, técnicas que fazem parte de um processo, que vai desde a seleção de doadoras, passando pelo preparo dos embriões até sua inovulação em (...) receptoras criteriosamente selecionadas. Com seu avanço, várias tecnologias de manejo vêm sendo implantadas: formas no transporte de embriões, protocolos de sincronização de doadoras e receptoras, e protocolos de recuperação de oócitos para produção de embriões. Isto infundiu a tecnologia, porém, os investimentos previstos para a produção de um animal de alto mérito genético limita sua utilização. Contudo, esta análise abordou avanços tecnológicos essenciais para o sucesso da TE, incluindo novos protocolos, sexagem de embriões, além do uso de embriões congelados Direct Transfer (DT) e vitrificados. No entanto, é claro que o sucesso do procedimento está no processo como um todo, em destaque ressalta-se que é de grande valia que o profissional apto a executar a técnica esteja sempre preparado e atualizado garantindo qualidade, eficiência e sustentabilidade na pecuária. Esta revisão foi desenvolvida com o propósito de adquirir conhecimento teórico, de forma detalhada e crítica, nas técnicas e procedimentos de Transferência de Embriões em bovinos, incluindo a colheita, manipulação e implantação de embriões. Palavras-chaves: Bovino, doadora, embrião, receptora. ABSTRACT Embryo Transfer (ET) in cattle is a globally widespread technique aimed at enhancing the reproductive capacity of females. It is closely linked to other techniques in reproductive biotechnologies, such as Ovum Pick-Up (OPU), In Vitro and In Vivo Embryo Production (PIVE), and Timed Embryo Transfer (TET), all of which are part of a process that ranges from donor selection, through embryo preparation, to their inoculation into carefully chosen recipients. With its advancement, various management technologies have been implemented: including methods for embryo transport, synchronization protocols for donors and recipients, and oocyte recovery protocols for embryo production. Although technology has been infused, the anticipated investments for producing animals of high genetic merit limit its widespread use. However, this analysis addressed essential technological advances for the success of ET, including new protocols, embryo sexing, as well as the use of frozen-thawed (DT) and vitrified embryos. Nevertheless, it is clear that the success of the procedure lies in the entire process. Notably, it emphasizes the significant value of having a qualified professional who is always prepared and updated to ensure quality, efficiency, and sustainability in livestock farming. This literary review was developed with the purpose of acquiring theoretical knowledge, in a detailed and critical way, on the techniques and procedures of Embryo Transfer in cattle, including the collection, manipulation and implantation of embryos. In this paper I consider the essential role that public memory plays in the establishment and maintenance of the political arena and its space of appearance. Without this space and the shared memory that allows it to appear, Hannah Arendt argues, transience and finitude would consume the excellence of word and deed—just as the "natural ruin of time" consumes its mortal performer. The modern era displays a kind of mnemonic failure, however, a situation arising not only from technological developments that (...) "outsource" memory but from several normative breakdowns that Arendt describes as characteristic of modernity. The consequence is the individual's loss of personal, living access to the community's memories, and the community's own failure to engage in the difficult choice of what counts as worthy of preservation. In failing to ask this question, however, the community abdicates responsibility for establishing the shared norms by which it will govern itself in times of crisis. (shrink)

Célebre por um tipo de filosofia que se caracteriza pelas linhas de fuga e pela desterritorialização de um pensamento nômade, Deleuze se reconhece como um filósofo sistemático. Como todo sistema, uma filosofia sistemática se define por um conjunto de elementos que se compõem e se alinham de modo a conferir a ele uma coerência. O presente artigo pretende demonstrar como o conjunto da filosofia de Deleuze confere uma organicidade e verosimilhança a seu sistema de pensamento a partir da articulação entre (...) a imanência, o acontecimento e o conceito. Esta tríade atravessa todo o seu trabalho e irá caracterizar aquilo que Deleuze chama de heterogênese; uma tentativa de fazer com que a filosofia se desprenda dos estados de coisas e vá na direção das intensidades, levando o pensamento ao limite e à máxima potência. Queremos demonstrar o modo como Deleuze opera em seu sistema de forma a associar e criar aproximações entre elementos mais ou menos heterogêneos, ora criando zonas de aproximação, ora provocando afastamentos. During the 13th century, several logicians in the Latin medieval tradition showed a special interest in the nature of impossibility, and in the different kinds or ‘degrees’ of impossibility that could be distinguished. This discussion resulted in an analysis of the modal concept with a fineness of grain unprecedented in earlier modal accounts. Of the several divisions of the term ‘impossible’ that were offered, one became particularly relevant in connection with the debate on ars obligatoria and positio impossibilis: the distinction (...) between ‘intelligible’ and ‘unintelligible’ impossibilities. In this article, I consider some 13th-century tracts on obligations that provide an account of the relation between impossibility and intelligibility and discuss the inferential principles that are permissible when we reason from an impossible – but intelligible – premise. I also explore the way in which the 13th-century reflection on this topic survives, in a revised form, in some early 14th-century accounts of positio, namely, those of William of Ockham, Roger Swineshead and Thomas Bradwardine. ‘Pencil’, ‘Tiger’, ‘Christianity’. What kind of reference (if any) do these terms have? Do they have the same semantics? In his celebrated The Meaning of ‘Meaning’ (1975), Hilary Putnam suggests so when arguing that they have externalist semantics. However, this claim is highly controversial. A lengthy discussion has been going on the matter. So far, neither Putnam’s nor other defenses of Externalism proposed within this debate have actually succeeded in showing that the terms at stake (and their likes) are semantically (...) on a par. Here I examine further options left to the externalist. I conclude that, still, none is a viable alternative for defending that Externalism applies to the mentioned terms (and their likes). (shrink)

The article goes through the critical analysis of the rawlsian concept of original position, expressed by Habermas in 1995. Habermasian remarks on the original position aim to undermine the justifiability of such a concept as fundamental to the whole political theory. In fact, it is supposed to substitute the procedures of democratic deliberation with a well thought-out construction belonging uniquely to the theoretician. According to Habermas, substantive outcomes of procedures must be left out from political theory, whose task is to (...) set a standard for the best possible procedures, meaning a democratic framework in which all opinions and beliefs take part to the decision. Rawls approves the critique since from his point of view, no procedure is able to avoid the inclusion of some substantive contents. On such assumption he twists to Habermasian theory the same remarks, observing that it avoids substantive assumptions at political level, embodying them at the epistemic one. As a result, the article raises some issues about the desirability and feasibility of both theories, even considering which interpretation of the role of political philosophy they imply. (shrink)

El presente estudio analiza el avance del populismo penal en Ecuador, tomando en cuenta los últimos índices de violencia, las reformas constitucionales más recientes y los lineamientos para un correcto desarrollo de la política criminal. Se busca contribuir a un debate informado en la academia sobre este tema crucial para la seguridad pública y la justicia en el país, en este momento de coyuntura social en el que el populismo penal ha tomado auge en Ecuador. La presente investigación tiene como (...) objetivo desarrollar un método neutrosófico para la evaluación del avance del populismo penal en Ecuador. Se caracteriza por reformas legislativas que endurecen las penas, amplían el catálogo de delitos y restringen los beneficios penitenciarios. Si bien estas medidas pueden generar una sensación de falsa seguridad en la población, no abordan las causas estructurales de la criminalidad y, en muchos casos, tienen consecuencias negativas en los derechos humanos y la reincidencia delictiva. This essay examines the way in which the modal concept of necessity was discussed and analyzed in some eleventh- and early twelfth-century sources, such as Peter Damian’s De divina omnipotentia, Anselm of Canterbury’s Cur deus homo and several anonymous commentaries on Aristotle’s De interpretatione that were presumably composed in the first two decades of the twelfth century by logicians connected to William of Champeaux’s and Peter Abelard’s milieu. My aim is to offer a comparison of these different sources with respect (...) to their use of the Boethian distinction between two types or kinds of necessity, namely, the “absolute” or “simple” necessity that is involved in statements like “God is necessarily immortal” or “it is necessary for humans to be animals”, and the “conditional” or “temporal” necessity that is at stake when we say, for instance, that someone necessarily walks when he is walking. In this essay, I consider some logical treatises and commentaries from the first decades of the 12th century (many of which are still unedited) which contain a discussion on modalities and modal logic. After presenting a short catalogue of these sources and a description of their common features, I shall focus on some definitions of the modal term “necessarium” which are provided in them. As we will see, Abelard and logicians of his time advanced three different characterizations of this term: (...) necessity was either defined in terms of unavoidability (ineuitabilitas), or in terms of immutability and omnitemporality (impermutabilitas, sempiternitas), or again in terms of absolute necessity as opposed to conditioned one (necessitas absoluta vs. determinata). I argue that the temporal understanding of necessity in terms of omnitemporality, inherited from ancient sources and extensively used by Abelard and others in the first years of the twelfth-century, started to disappear in texts datable from around the 1120, perhaps due to several difficulties that were related to this definition when applied in logical contexts. I also discuss how the notion of necessitas determinata was used by Abelard’s contemporaries to qualify the modal status of present and past events, which were generally believed to be necessary only in a “weak” and harmless sense that did not prevent them from being contingent. -/- . Em A intuição do instante (1932) e A dialética da duração (1936), a problematização a respeito do tempo levantada por Bachelard, a partir das teses bergsonianas da duração, deixa de ser uma simples reinterpretação do conceito de tempo e passa a se encaminhar aos poucos para uma ruptura evidente com o bergsonismo. Neste artigo, trataremos dessa ruptura via a interpretação psicológica da duração feita por Bachelard, fato esse que automaticamente estabelece um contraponto com o psicologismo temporal bergsoniano, sobretudo em A (...) dialética da duração, onde ele irá forjar seu entendimento de consciência temporal e, por consequência, de memória. There is a dimension of rationality, known as structural rationality, according to which a paradigmatic example of what it means to be rational is not to be akratic. Although some philosophers claim that aesthetics falls within the scope of rationality, a non-akrasia constraint prohibiting certain combinations of attitudes is yet to be developed in this domain. This essay is concerned with the question of whether such a requirement is plausible and, if so, whether it is an actual requirement of aesthetic (...) rationality. Ultimately, this paper defends the view that aesthetics is no different from other domains in that it requires coherence between a subject’s mental states (in the aesthetic case, between what is judged and what is aesthetically liked). The concept of autonomy is central to many debates in aesthetics. However, exactly what it means to be autonomous in our aesthetic engagements is somewhat unclear in the philosophical literature. The normative significance of autonomy is also unclear and hotly debated. In this essay, I propose a method for clarifying this elusive concept by distinguishing three distinct senses or varieties of aesthetic autonomy: experiential autonomy, competence-based autonomy, and personal autonomy. On this taxonomy autonomy is a context-sensitive concept and autonomy applies (...) to several different moments or stages of aesthetic appreciation. La naturaleza del ordenamiento jurídico ecuatoriano contempla derechos fundamentales y busca implementar nuevos derechos que han ido surgiendo en los últimos años. Sin embargo, estas acciones deben respetar los derechos fundamentales ya establecidos, un área de particular tensión es el conflicto entre el derecho al acceso a la información, específicamente los procesos judiciales y el derecho al olvido. La investigación buscó, por tanto, analizar cómo Ecuador, a través de leyes como la Ley Orgánica de Protección de Datos Personales o el (...) Código Orgánico de la Función Judicial busca equilibrar el alcance e intereses de estos derechos; para ello se requirió al uso de leyes, normas y doctrinas para su análisis que, junto al método sintético-analítico, inductivo y deductivo sirvieron para comprender y delimitar de mejor manera los temas objeto de estudio y la información en general. La presente investigación tiene como objetivo desarrollar un método para la evaluación del derecho de publicidad de procesos contra el reconocimiento del derecho al olvido en un ecuador constitucional. Se examinó la implementación del derecho al olvido, definición de información pública y el principio de publicidad, concluyendo que, Ecuador enfrenta el reto de desarrollar un marco legal sólido que proteja tanto la transparencia y rendición de cuentas como la privacidad y la dignidad de las personas en la era digital. The paper Post-Trial Acces To Treatment (PTA) offers an insight into current corporate policies and corporate best practices relating to the provision of PTA in low and middle income countries based on company sources. In these countries there is a greater appeal for pharmaceutical companies to take responsibility for providing PTA. However, the practice of providing PTA is the exception rather than the rule.

Conceptions about the nature of scientific models held by science students frequently involve distorted views, with a tendency to consider them as mere copies of reality. Besides encompassing an untenable view about the nature of science itself, this misconstruction can effectively be a pedagogical impediment to learning. Objectives: We evaluate whether Mario Bunge’s epistemology might contribute to tackling issues related to the nature of models in science education contexts. De-sign: After identifying Bunge’s main model categories, we employ them to examine (...) aspects of the historical development of atomic models and contrast the resulting framework with issues about model conceptions in science education, as pointed out in the literature. Setting and participants: Due to this research’s theoretical nature, this study did not include human participants other than authors from the literature and the theoretical framework. Data collection and analysis: We per-formed a constant comparative analysis to identify patterns of meanings shared between the historical case and the theoretical framework. Results: Features of models pointed out by Bunge were identified in the development of atomic models and could provide consistent and explanatory viewpoints about key issues related to model conceptions in science education. Internal coherence is of great importance for how we think about appreciating objects of aesthetic worth. A disagreement between what we judge to be worthy and what we affectively favor can prevent us from properly grasping its value. However, it is also assumed in the aesthetic domain that our taste changes over time, jeopardising such coherence constraint. These changes can lead to a mismatch between new aesthetic judgments and old aesthetic preferences. This chapter explores a number of issues that emerge (...) from this tension. Using Taylor Swift’s re-recording as a case study, I will explore the relation between fan loyalty and personal authenticity, as well as the role of biographical taste in the reception of these newly recorded albums among Swift’s long-time fanbase. O intuito deste artigo é promover um debate em torno da obra República, de Platão, visando situar e estabelecer: 1) os argumentos do autor a favor de um modelo de pólis ideal; 2) as características do fazer político do Arconte enquanto comportamento dominante e eficaz dentre os líderes de governo da pólis, insurgindo contra o desejo de posse indevida (pleonexia) por parte dos homens que, se portadores do anel de Giges fossem, invisíveis, acreditariam, daqueles que estão ao seu redor, poder (...) reverter a seu favor qualquer tipo de liderança, sobretudo a soberana, passando então a encarnar, para Platão, a metáfora do homem injusto neste escrito; 3) elaboraremos, por fim, a definição de justiça, bem como a consciência individual in totum dos cidadãos que compõem a pólis e agem em prol do bem comum e funcionamento pleno da cidade, discernindo-os segundo a diferença de habilidade e posição hierárquica em relação a seus demais, produzindo o que podemos chamar de estrutura tripartite social e política, tanto da pólis quanto da alma, ambas, em plena harmonia, na teoria platônica. The purpose of this article is to promote a debate around Plato's work Republic, aiming to situate and establish: 1) the author's arguments in favor of an ideal pólis model; 2) the characteristics of Archon's political making as dominant and effective behavior among the leaders of the pólis government, insurgent against the desire for improper possession (pleonexia) on the part of the men who held the ring of Gyges and were invisible, which would believe, of those who are around him, (...) they may revert in their favor any kind of leadership, especially the sovereign one, and then embody for Plato the metaphor of the unjust man in this writing; 3) Finally, we will elaborate the definition of justice, as well as the individual conscience in totum of the citizens who compose the pólis and act in order to achieve the common good and full functioning of the city, discerning them according to the difference of skill and hierarchical position in the city in relation to their others, producing what we may call the tripartite social and political structure of both the pólis and the soul, both in full harmony in platonic theory. -/- . Human epistemic subjects cannot but employ imperfect and limited tools to gain knowledge. Even in the seemingly simple business of acquiring knowledge of the value of a physical quantity, what the instrument reads or perception tells more often that not does not correspond to real value. However, even though both our perceptual apparatus and measuring instruments are sensible to background noise, under certain conditions, collecting more information of the same quantity using the same tools leads to an improvement of the (...) subject's epistemic condition. The aim of this paper is to formalize this intuition employing a model which extends Williamson (2013) on the arising of Gettier cases in epistemic logic. From a model where each world is univocally represented by the pair r, a defined by the real value and the apparent one, I will be considering a scenario wherein the subject has collected n appearances of the real parameter, so that each world is identified by a n + 1-tuple. On the assumptions that the n data are all independent and regarded by the subject as equally reliable, a plausible model should be able to describe three phenomena. First of all, the more coherent and closer to represent the real value the set of n appearances is, the more knowledge of the real value is gained. Secondly, the more the subject goes on acquiring "good" data, the more she knows. Thirdly, the world where the n apparent values and the real one match is the best world for the subject. Following Williamson, I shall put forth a system for multiple appearances in epistemic logic that aims at modeling these phenomena by describing the interval within which the real value is known to lie. At first sight, if A is all-things-considered better than B and B is all-things-considered better than C, the judgment that A is all-things-considered better than C seems to follow. This should be a straight-forward consequence of the transitivity of the \all-things-considered better than" relation. However, if we deny that transitivity is a logical axiom of those relations involving comparatives, then it might turn out that betterness is not transitive. Following Temkin's terminology, a relation R will be de ned as nontransitive (...) i either it is intransitive (i.e. aRb and bRc yet :(aRc)) or if transitivity cannot be applied, for there is no single relation R that holds between all the alternatives. More spefici cally, this could happen in a case where the obtaining of the better-than relation depends on different factors according to the nature of the relata. As a result, there are two main strategies available to question the axiom of transitivity: the rst is by providing an effective counterexample displaying cRa as well as (aRb ^ bRc), hence yielding a cycle. The second, more general way, is to show that all-things-considered betterness is a relation that conceptually involves comparison-dependent betterness relations, so that it is likely that transitivity fails to apply across different alternatives. The aim of this paper is to investigate part of the recent attack on the transitivity of better than, to conclude that there seems to be no cogent reason why this would not be a transitive relation. Tout au long de sa carriêre, Fernand Deligny expérimente de nouveaux modes de vie auprês d'individus en dehors des normes d'existence majoritaires. Subvertissant les hiérarchies et promouvant les pratiques libertaires, il affronte les structures correctrices dans sa logique d'adaptation.

Two common strategies have dominated attempts to account for the nature of taste. On the one side, we have an affectivist understanding of taste where aesthetic attribution has to do with the expression of a subjective response. On the other side, we find a non-affectivist approach according to which to judge something aesthetically is to epistemically track its main aesthetic properties. Our main argument will show that neither emotion nor perception can explain the nature of aesthetic taste single-handedly. In this (...) paper, our principal aim is to examine the relationship between perceptual discernment and emotional sensibility as we find it in the process of ascribing aesthetic qualities. Is it the nature of the specific aesthetic property in question which determines the way in which perception and emotion are balanced in aesthetic attribution, or is it, rather, something about how our sensory skills operate? One of the notions we would like to explore in greater detail in this context is the idea of attunement, or the way in which aesthetic agents can align themselves to the content of an artwork o in order to better grasp its content and significance. According to our proposed picture, the exercise of taste involves an adjustment of one’s emotional sensibility to the aesthetic character of o. Nosso objetivo é mostrar como Bachelard edifica a noção de vida em sua filosofia ao esboçar uma reflexão sobre o problema filosófico do tempo junto às noções de instante e duração. O livro A intuição do instante (1932), obra dedicada a esta reflexão metafísica sobre o tempo confluindo, quatro anos mais tarde, para A dialética da duração (1936), obra que, por sua vez, define o conceito de duração a partir das várias temporalidades superpostas constitutivas da própria existência, são as referências (...) privilegiadas deste estudo. Ressaltaremos a importância da filosofia de Henri Bergson nesta discussão ao estabelecermos um contraponto entre suas teses sobre a vida e a duração às mesmas teses conceituais bachelardianas, sobretudo a partir da oposição entre as seguintes noções: vida vivida (circunscrita ao tempo comum/tempo transitivo em Bergson) e vida pensada (circunscrita ao tempo do espírito/tempo imanente em Bachelard). Partimos da hipótese a ser debatida de que é porque o espírito pode chocar-se com a vida vulgar, escorregadia e homogênea que a vida superior, ou seja, do próprio espírito, deve ser entendida nesta filosofia bachelardiana como sendo uma construção racional ancorada em uma dialética pluralista de saberes sobre o tempo. Resumo A problemática sobre a “verdade” não tem obtido a devida atenção no meio jurídico. As considerações a respeito do que seja “verdade”, por certo, têm nítido viés filosófico, existindo distintas concepções acerca da “verdade”, embora muitas não são capazes de servir ao direito processual civil. Habermas concebe a “verdade” sobre um fato como um conceito dialético, construída a partir das argumentações desenvolvidas pelos sujeitos cognoscentes, ou seja, buscada na cooperação direcionada para o entendimento mútuo racional. Identificam-se pontos de contato (...) existentes entre a teoria habermasiana e os enunciados até agora elaborados no projeto do novo Código de Processo Civil brasileiro. A “verdade” no moderno processo civil deve ser buscada em um procedimento baseado na probabilidade das provas e das teses apresentadas, na intensa argumentação dialética e em colaboração entre os sujeitos processuais, e no respeito às normas e aos princípios válidos para o caso em julgamento. All the considerations about “truth” have a clearly philosophical points of view, and distinct conceptions concerning it, although many are not capable of serving in the civil procedure. Jürgen Habermas conceives the “truth” as a dialectical concept, constructed from the arguments developed by cognizant agents, i.e., those seeking cooperation aimed at rational mutual understanding. The article identifies points of contact between habermasian theory and legal rules developed up to now in the project of the new Brazilian Civil Code of Procedure. The “truth” in the modern civil process must be sought in a procedure based on the probability of the evidence and theses in intense dialectical argumentation and collaboration between all parties involved with the respect for the rules and principles considered valid for the case at hand. Healthcare systems across the globe are struggling with increasing costs and worsening outcomes. This presents those responsible for overseeing healthcare with a challenge. Increasingly, policymakers, politicians, clinical entrepreneurs and computer and data scientists argue that a key part of the solution will be ‘Artificial Intelligence’ (AI) – particularly Machine Learning (ML). This argument stems not from the belief that all healthcare needs will soon be taken care of by “robot doctors.” Instead, it is an argument that rests on the classic (...) counterfactual definition of AI as an umbrella term for a range of techniques that can be used to make machines complete tasks in a way that would be considered intelligent were they to be completed by a human. Automation of this nature could offer great opportunities for the improvement of healthcare services and ultimately patients’ health by significantly improving human clinical capabilities in diagnosis, drug discovery, epidemiology, personalised medicine, and operational efficiency. However, if these AI solutions are to be embedded in clinical practice, then at least three issues need to be considered: the technical possibilities and limitations; the ethical, regulatory and legal framework; and the governance framework. In this article, we report on the results of a systematic analysis designed to provide a clear overview of the second of these elements: the ethical, regulatory and legal framework. We find that ethical issues arise at six levels of abstraction (individual, interpersonal, group, institutional, sectoral, and societal) and can be categorised as epistemic, normative, or overarching. We conclude by stressing how important it is that the ethical challenges raised by implementing AI in healthcare settings are tackled proactively rather than reactively and map the key considerations for policymakers to each of the ethical concerns highlighted. Paper, $27.99.Iain Thomson’s Heidegger, Art, and Postmodernity is an exceptional piece of Heidegger scholarship, providing detailed, informative analysis while remaining highly readable.Thomson begins by reprising the argument from his earlier Heidegger on Ontotheology: Technology and the Politics of Education (Cambridge, 2005), namely, that (...) the concept of ontotheology is key to understanding Heidegger’s thought. Ontotheologies comprehend “the intelligible order in terms of both its innermost core [ontology] and its outermost form or ultimate expression [theology]” (10). Thomson examines Heidegger’s claim that these understandings of reality change over time, a history of being comprised of distinct metaphysical “epochs” of intelligibility. Thomson recounts Heidegger’s project as an attempt to overcome ontotheology, particularly its modern and late-modern forms, in which entities appear solely as objects for control or resources for optimization.Doing so requires cultivating a plural realism whereby entities are recognized as richer in intrinsic meaning than we can capture. Thomson shows that Heidegger’s analysis of [End Page 324] art—particularly Van Gogh’s “A Pair of Shoes”—is aimed at demonstrating how art over-flows conceptual boundaries and thereby reveals this plural givenness of meaning. With startling originality, Thomson both explains the use of the three artworks in “Origin of the Work of Art” in terms of Heidegger’s history of being and refutes Shapiro’s famous criticism, arguing that Heidegger is not suggesting that the painting simply represents a peasant woman’s shoes. Rather, it represents both the shoes and a plurality of other possible meaning gestalts suggested by the umbra of “nothingness” that surrounds the shoes—the unformed textures and colors of the background—one of which is the figure of a woman.The work prompts a gestalt shift from shoes to woman, encouraging us to recognize possibilities of meaning in the inchoate forms surrounding the shoes, and thus (Heidegger hopes) realize the inexhaustibility of meaning and the structure of intelligibility itself: namely, the ontological tension between earth and world, revealing and concealing. Any representation is only one of the many conceptual possibilities present, and art helps us accomplish a postmodern “active receptivity” that responds adequately to the inexhaustibility of being as such.The latter half of Thomson’s book engages in “applied Heidegger”: the examination of particular works to demonstrate the fruitfulness of understanding Heidegger in this way. By analyzing U2’s Achtung Baby, Moore’s Watchmen comic series, and (in a particularly informative chapter) Heidegger’s Contributions to Philosophy qua philosophical fugue, Thomson is able to pursue the implications of what “postmodernity” means for Heidegger and why it should be considered appealing.Thomson’s thought-provoking and informative book should prompt a great deal of discussion. In particular, one can ask whether such a “postmodern” condition represents what Thomson and Heidegger hope it does. Thomson suggests throughout that escaping late-modern optimization and control narratives will encourage us “to approach all things with care, humility, patience, gratitude, and perhaps... awe, reverence, and love” (212). But why should we suppose that recognizing meaning’s excessiveness and multiplicity should produce such positive responses? Is it not equally plausible that it would prompt a kind of desiccated ennui, an inability to care or commit that is rooted in the sense that there is no right answer, no right way to be? One wonders if living with such recognition is even possible, considering the view espoused throughout that intelligibility depends on tension between revealing and concealing. What is the proper place for the view that no framework of intelligibility is right or adequate, but merely captures one facet of possible meaning? Is this compatible with existentialism’s characterization of humanity in terms of the need to commit to projects that delimit a normative horizon through which the world can show up as intelligible?Further, though it seems clear that cultivating a poetic responsivity to the given plurality of meaning will help overcome Western nihilism—i.e. the view that there is no inherent meaning—it is not clear that it will move us beyond... O objetivo da presente dissertação é mostrar como Bachelard edifica a noção de vida em sua filosofia por meio de uma reflexão sobre o problema filosófico do tempo e das noções de instante e duração. Ao refletirmos sobre o instante descontínuo associando-o a outros conceitos que perpassam seus escritos, tanto epistemológicos, quanto poéticos, estabeleceremos de que maneira o pressuposto teórico de complementariedade entre as duas vertentes de seu pensamento é alcançado. Destacaremos também que em sua metafísica o ser do homem (...) busca sua referência autosincrônica por meio da experiência descontínua do instante verdadeiramente dinâmico, onde o tempo não corre, jorra. O livro A intuição do instante (1932), obra dedicada a esta reflexão metafísica sobre o tempo conflui, quatro anos mais tarde, para A dialética da duração (1936), obra que, por sua vez, define o conceito de duração a partir das várias temporalidades superpostas constitutivas da própria existência, ambas apresentam os fundamentos de uma filosofia do repouso e são as referências privilegiadas deste estudo. Não é necessário ressaltar a importância da filosofia de Henri Bergson nesta discussão: é a partir de um contraponto com suas teses, tanto sobre a vida como sobre a duração, que Bachelard irá forjar sua própria compreensão do conceito de vida por meio de uma oposição que é sublinhada ao longo de suas duas obras temporais, ou seja, entre vida vivida (circunscrita ao tempo comum/tempo transitivo) e vida pensada (circunscrita ao tempo do espírito/tempo imanente). Jenefer Robinson believes that feelings can play an important role in the critical evaluation of artworks. In this paper, I want to put some pressure on two important notions in her theory: emotional understanding and affective empathy. I will do this by focusing on the nature of self-conscious emotions. My strategy will be, firstly, to demonstrate the difficulty that Robinson’s two step theory of emotions has in accommodating higher cognitive emotional responses to art. Secondly, I will discuss how the tight (...) connection to the ‘self’ involved in self-conscious emotions makes it difficult to take the emotional perspective of another person as empathy requires. From here, I suggest that Peter Goldie’s feeling-towards and his critique of perspective-shifting may give a better understanding of the role of emotions in the appreciation of art, particularly in the case of reflective emotions. Os debates sobre a existência da consciência em animais não humanos vêm ganhando cada vez mais destaque nos círculos científicos e filosóficos ao redor do mundo. Um importante empecilho que a área atualmente enfrenta diz respeito à construção de um método confiável capaz de identificar se um determinado animal não humano possui estados mentais conscientes. A literatura nomeia essa questão de “o problema da mensuração da consciência animal”. A presente dissertação possui como objetivo analisar e responder esse problema através da (...) combinação entre o uso de evidências empíricas e de ferramentas filosóficas. Dito isso, existem inúmeras formas de respondê-lo. Ao longo do texto, analisarei algumas das que são consideradas mais relevantes na discussão atual. Uma delas é a concepção cética de que não há questão de fato sobre os animais não humanos serem ou não conscientes. Em contraste, as abordagens neutras e newtonianas buscam se esquivar de compromissos metafísicos e teóricos para atribuir consciência aos animais. Ao final da dissertação defenderei a chamada “abordagem teórica leve”, posição originalmente proposta pelo filósofo Jonathan Birch. Buscarei mostrar que ela é atualmente a hipótese empiricamente mais adequada e filosoficamente plausível dentre as disponíveis na literatura. (shrink)

Nas obras A intuição do instante (1932) e A dialética da duração (1936), o problema do tempo nos é apresentado em paralelo a um psicologismo temporal bachelardiano que objetivamos situar. Inicialmente, será através de um não-bergsonismo — ou seja, um bergsonismo generalizado — que convirá introduzirmos as nuances psicológicas das teses bachelardianas, elencando: 1) sua interpretação de memória, amparada pelas teses sobre a conduta do psicólogo Pierre Janet (contra a imediaticidade) e 2) a evidenciação do dinamismo e liberdade presentes na (...) psyché a partir da valorização da ideia de intervalos imanentes às estruturas temporais da consciência (descontinuidade). -/- Dans les ouvrages L’intuition de l’instant (1932) et La dialectique de la durée (1936), le problème du temps nous est présenté en parallèle d'un psychologisme bachelardien temporel que nous cherchons à situer. Dans un premier temps, ce sera à travers un non- bergsonisme — c’est-à-dire un bergsonisme généralisé — qu’il conviendra d’introduire les nuances psychologiques des thèses bachelardiennes, en listant : 1) leur interprétation de la mémoire, appuyée par les thèses sur la conduite de le psychologue Pierre Janet (contre l’immédiateté) et 2) la révélation du dynamisme et de la liberté présents dans la psyché à partir de la valorisation de l’idée d’intervalles immanents aux structures temporelles de la conscience (discontinuité). Although religious belief is often claimed to help with physical ailments including pain, it is unclear what psychological and neural mechanisms underlie the influence of religious belief on pain. By analogy to other top-down processes of pain modulation we hypothesized that religious belief helps believers reinterpret the emotional significance of pain, leading to emotional detachment from it. Recent findings on emotion regulation support a role for the right ventrolateral prefrontal cortex, a region also important for driving top-down pain inhibitory circuits. (...) Using functional magnetic resonance imaging in practicing Catholics and avowed atheists and agnostics during painful stimulation, here we show the existence of a context-dependent form of analgesia that was triggered by the presentation of an image with a religious content but not by the presentation of a non-religious image. As confirmed by behavioral data, contemplation of the religious image eneabled the religious group to detach themselves from the experience of pain. Critically, this context-dependent modulation of pain specifically engaged the right VLPFC, whereas group-specific preferential liking of one of the pictures was associated with activation in the ventral midbrain. We suggest that religious belief might provide a framework that allows individuals to engage known pain-regulatory brain processes. (shrink)
