Le bâtir est un trait fondamental de la condition humaine. À notre époque, les réflexions en vue de mieux comprendre le sens phénoménologique et anthropologique de l’acte de bâtir se mul- tiplient. La constante qui semble rallier ces réflexions consiste à reconnaître l’enracinement du sens de l’acte de bâtir dans l’habiter : le bâtir puiserait ainsi sa signification première dans l’ha- biter. Ce ralliement et ce consensus semblent marquer ainsi ce que l’histoire pourrait un jour désigner comme le « tournant (...) » de l’habiter en architecture. Il est maintenant permis d’envisa- ger et de construire le portrait global de cette activité en usant de toutes les palettes de cou- leurs que comprend le spectre des facultés de l’esprit humain : la poétique, la logique, la phénoménologie, l’herméneutique, la rhétorique, la mystique et, bien sûr, l’éthique. This paper motivates the idea that social robots should be credited as moral patients, building on an argumentative approach that combines virtue ethics and social recognition theory. Our proposal answers the call for a nuanced ethical evaluation of human-robot interaction that does justice to both the robustness of the social responses solicited in humans by robots and the fact that robots are designed to be used as instruments. On the one hand, we acknowledge that the instrumental nature of robots and (...) their unsophisticated social capabilities prevent any attribution of rights to robots, which are devoid of intrinsic moral dignity and personal status. On the other hand, we argue that another form of moral consideration—not based on rights attribution—can and must be granted to robots. The reason is that relationships with robots offer to the human agents important opportunities to cultivate both vices and virtues, like social interaction with other human beings. Our argument appeals to social recognition to explain why social robots, unlike other technological artifacts, are capable of establishing with their human users quasi-social relationships as pseudo-persons. This recognition dynamic justifies seeing robots as worthy of moral consideration from a virtue ethical standpoint as it predicts the pre-reflective formation of persistent affective dispositions and behavioral habits that are capable of corrupting the human user’s character. We conclude by drawing attention to a potential paradox drawn forth by our analysis and by examining the main conceptual conundrums that our approach has to face. (shrink)

Jacobs, in Choosing Character, seems to assume that there are selves already capable of voluntary choice who then choose their character by developing habits. I argue that selves, choice, responsibility and character form a conceptual and practical hermeneutic circle, a whole without which selfhood makes no sense. There can be no selfhood prior to responsible character.

The central objective of Dewey’s Democracy and Education is to explain ‘what is needed to live a meaningful life and how can education contribute?’ While most acquainted with Dewey’s educational philosophy know that ‘experience’ plays a central role, the role of ‘situations’ may be less familiar or understood. This essay explains why ‘situation’ is inseparable from ‘experience’ and deeply important to Democracy and Education’s educational methods and rationales. First, a prefatory section explores how experience is invoked and involved in pedagogical (...) practice, especially experience insofar as it is (a) experimental, (b) direct, and (c) social-moral in character. The second and main section on situations follows. After a brief introduction to Dewey’s special philosophical use of ‘situation’, I examine how situations are implicated in (a) student interest and motivation; (b) ‘aims’ and ‘criteria’ in problem-solving; and (c) moral education (habits, values, and judgements). What should become abundantly clear from these examinations is that there could be no such thing as meaningful education, as Dewey understood it, without educators’ conscious, intentional, and imaginative deployment of experience and situations. Moral sentimentalism can be understood as a metaethical theory, a normative theory, or some combination of the two. Metaethical sentimentalism emphasizes the role of affect in the proper psychology of moral judgment, while normative sentimentalism emphasizes the centrality of warm emotions to the phenomena of which these judgments properly approve. Neither form of sentimentalism necessarily implies a commitment to virtue ethics, but both have an elective affinity with it. The classical metaethical sentimentalists of the Scottish Enlightenment—such as David Hume and (...) Adam Smith—were all, to a greater or lesser extent, also virtue theorists. The connection is even stronger in the case of Enlightenment philosophers who were also normative sentimentalists , as with Frances Hutcheson. For Hutcheson, virtue simply is a habit of acting from the warm motive of universal benevolence. Today, neo-sentimentalist metaethicists such as Allan Gibbard, Justin D’Arms and Daniel Jacobson generally remain agnostic on the question of whether virtue ethics is superior to its deontological and consequentialist competitors. Michael Slote, however, has developed a comprehensive theory of sentimentalist care ethics in an unambiguously virtue-centered form. (shrink)

What makes us persons? Is it our bodies, our minds, or our consciousness? For centuries, philosophers have sought to answer these questions. While some believe humans are physical or biological, others claim we have an immaterial soul. This book proposes a new alternative. Selves were formed in evolution through connections and commitments to others when early hominins lived in tribal groups and developed languages. As humans learned to fulfill these commitments, they not only cultivated relationships but also created their personal (...) identities. Their habits of responsibility established their characters and therefore their reputations within their communities. This naturalistic approach proposes that a self is defined by the history of its commitments to cultural and personal norms. While brain processes are required, the self is not some internal, private mind but primarily a role within its community. As technology advances, selfhood could in the future be enabled by electronic, quantum, or other non-biological means. So if a self is formed through norms, could artificial intelligence evolve to have self-identity? (shrink)

This study thoroughly investigates the financial behaviors of financially independent, young, single professionals aged 24 to 35 in Balayan, Batangas, amidst a period of global inflation. Focusing on five industries—education, finance, government, healthcare, and retail—the research employs a mixed-methods approach. Quantitative analysis, involving 75 respondents through a 4-point Likert scale survey, is complemented by qualitative insights from in-depth interviews with 5 participants from each industry. The findings from numerical values revealed that demographics did not impact working professionals' saving habits and (...) buying behaviors during the global inflation surge. This suggests that despite differences in age, gender, industry, employment status, and monthly income or salary, all professionals prioritized robust, strong savings and reduced spending to ensure financial stability. The research underscores the significance for professionals in various industries to prioritize specific aspects of personal financial management during the prevailing global inflation surge. There is increasing concern about “surveillance capitalism,” whereby for-profit companies generate value from data, while individuals are unable to resist (Zuboff 2019). Non-profits using data-enabled surveillance receive less attention. Higher education institutions (HEIs) have embraced data analytics, but the wide latitude that private, profit-oriented enterprises have to collect data is inappropriate. HEIs have a fiduciary relationship to students, not a narrowly transactional one (see Jones et al, forthcoming). They are responsible for facets of student life beyond education. In addition to (...) classrooms, learning management systems, and libraries, HEIs manage dormitories, gyms, dining halls, health facilities, career advising, police departments, and student employment. HEIs collect and use student data in all of these domains, ostensibly to understand learner behaviors and contexts, improve learning outcomes, and increase institutional efficiency through “learning analytics” (LA). ID card swipes and Wi-Fi log-ins can track student location, class attendance, use of campus facilities, eating habits, and friend groups. Course management systems capture how students interact with readings, video lectures, and discussion boards. Application materials provide demographic information. These data are used to identify students needing support, predict enrollment demands, and target recruiting efforts. These are laudable aims. However, current LA practices may be inconsistent with HEIs’ fiduciary responsibilities. HEIs often justify LA as advancing student interests, but some projects advance primarily organizational welfare and institutional interests. Moreover, LA advances a narrow conception of student interests while discounting privacy and autonomy. Students are generally unaware of the information collected, do not provide meaningful consent, and express discomfort and resigned acceptance about HEI data practices, especially for non-academic data (see Jones et al. forthcoming). The breadth and depth of student information available, combined with their fiduciary responsibility, create a duty that HEIs exercise substantial restraint and rigorous evaluation in data collection and use. Palawan is a land of promise, and of paradox. On maps, it appears on the edge of the Philippines, isolated. Indeed, it is a kind of last frontier. Its population remained tiny for centuries, the government offering homestead land in the 1950s practically for free to attract migrants from outside. The Palawan State University was established by law in 1965, but did not become operational until 1972. A commercial airport did not exist until the 1980s, and for many years, flights (...) were limited. Yet Palawan is one of the oldest sites of human habitation in the Philippines with the famous Tabon Cave human fossils. The oldest bone fragment here has been dated to be about 47,000 years. We know, too, that trade with China goes back several centuries. Today, Palawan seems to be making up for lost time with new commercial investments pouring in at breakneck speed. In particular, outsiders have rediscovered its potentials around logging, mining, fisheries, and tourism. This has caused concern among individuals and civil society organizations who want sustainable development, and see the commercial developments mainly as extractive, not just of natural resources but of the human. There’s very cheap labor available. And when potential investors marvel about cheap land, they’re actually talking about displacing earlier settlers, including indigenous people, from their lands. A subtle but still insidious aspect of the exploitation of human resources is a transformation of the very concept of human development. Using the rhetoric of modernity, residents in Palawan are reorienting the way they view themselves as well as their families and friends. The value of a human being now hinges on how they look, and the desired appearance is defined from the outside, as we see in this anthology of research reports coming from the Chemical Youth project of the University of Amsterdam and the University of the Philippines Diliman. We read about the importance of fair skin as a projection of cleanliness, of high social status (meaning someone not engaged in manual labor and therefore not exposed to the sun). We read of how “femininity” is defined around body contours, and cosmetics, and how hormones are used by male-to-female transgenders. We go beyond the visual, reading about the importance of controlling or enhancing body odors among tour guides, who interestingly are especially concerned about the bad odor management of their foreign customers, using car perfumes to keep their work manageable and we learn how difficult it is for security guards to stay alert during their long shifts. Energy drinks and cigarettes help them perform their duties. All these transformations through what the French philosopher and historian Michel Foucault has called “technologies of the self” are as paradoxical as Palawan. On the surface, the products—which are technologies—seem to be mainly in the realm of the self but are, in reality, pushed, through marketing, from the outside, in contexts of inequality and exploitative labour relations. Personal aspirations are not personal but are for predefined standards of modernity, related to work-related demands and expectations. The self must be made presentable to the tourist, to the customers in malls, and to those who may threaten the properties that young people protect. It is not surprising that these transformations become problematic for the “self.” The skin whiteners, the hormones, the body deodorants, and the energy drinks are expensive and can distort budgetary priorities. The money for tonic drinks, for example, could well go into more nutritious food. The tragedy, too, many of the products used are of doubtful safety and efficacy. Even the energy drinks have much too high levels of caffeine that can cause cardiac palpitations. Cosmetics and the skin whiteners imported from China and unregistered with the Food and Drug Administration may contain toxic chemicals like mercury. But even registered skin whiteners can be problematic, their so-called “skin-whitening effect” coming about because they take away the upper layers of the skin, leaving behind a red glow (seen as “whitening”) which is actually inflammation. The whitened skin fails to protect against the sun, leading to adverse effects such as black spots. Ultimately though, the problems come with the very definition of the self. As the reports show, young people use the chemicals with some ambivalence, knowing how expensive they are and experiencing some of the undesirable side effects. There is, too, doubt about whether what they’re doing is indeed “good,” captured by how IP women will put on cosmetics only when they’re away from home and about to go to work. The cosmetics have to be removed before they return home because they are not socially acceptable. The research reports are not for Palawan alone. It must make us more critical and discerning as we revisit concepts of development and exploitation, modernity and tradition, self and community. The chemicals, in many ways, are like the products used in precolonial barter trade. For the Chinese, the beeswax and the sea cucumbers, for the inhabitants of Palawan the ceramics, represented faraway lands. To have those products gave prestige. Today, the skin whiteners and tonic drinks and other chemicals described in this anthology represent modernity with promises of not just of a more attractive self, but of better jobs, a better life. We are proud to have worked with the Palawan State University, and the people of Palawan, to gather powerful narratives that will now challenge the outside, the purveyors of modernity, to be more critical and discerning, the chemicals now to be seen not just as stuff applied to the biological body, but as powerful shapers of social bodies. Les professionnels ont par définition un public bénéficiaire de leurs services : le patient pour le médecin, le psychologue ou l’infirmière ; le client pour l’avocat ; le consommateur pour le gestionnaire d’une entreprise commerciale ; etc. L’usager ou l’habitant du cadre bâti constitue un des destinataires des services professionnels du designer d’intérieur. De quelle manière peut-on apprendre aux étudiants/futurs professionnels du design d’intérieur à se mettre à la place de l’usager/habitant des espaces qu’ils conçoivent ? Le concept de l’empathie, (...) communément décrit comme la capacité de se mettre à la place de l’autre, de le comprendre et de ressentir ses sentiments et ses émotions, est bien adapté pour explorer cette attitude. Cet article est composé de deux parties. La première présente une expérience pédagogique en design d’intérieur où des étudiants apprennent à se représenter les usagers de leur projet d’aménagement en utilisant un outil méthodologique appelé « boussole éthique ». Cette boussole est constituée essentiellement de trois pôles qui renvoient aux trois rapports fondamentaux de l’être humain tels qu’étudiés dans la tradition stoïcienne : rapport à soi-même, à autrui et à la nature. Dans la seconde par- tie, l’article met en relief plusieurs éléments théoriques qui permettent de comprendre, de consolider et, éventuellement, de faire évoluer les bases conceptuelles qui sous-tendent cette démarche. Comme de nombreux penseurs antiques avant et après eux et contrairement à Socrate, Calliclès et Diogène ont déclaré avoir fondé leur éthique sur l’observation de la nature. Et pourtant, les deux discours normatifs qui sont tirés d’une nature que l’on pourrait a priori croire être la même sont on ne peut plus opposés. Calliclès croit que l’homme est appelé à dominer autrui ; Diogène pense plutôt qu’il doit se dominer lui-même ; le premier est un hédoniste débridé, le second croit (...) que le bonheur ne s’achète qu’au prix du sacrifice des désirs artificiels. Comment expliquer cette dichotomie ? Nous empruntons deux routes explicatives. D’abord, nous montrons que pour Calliclès et Diogène, la notion de nature non seulement diffère, mais est observée sous un angle différent. La première est celle des tyrans et de dieux anthropomorphes, la seconde, celle de petits animaux et de dieux autarciques. La première concerne la relation des hommes entre eux ; la seconde, celle de l’homme avec lui-même. Ensuite, nous exposons la différence des présupposés normatifs qui précèdent ou accompagnent l’observation de la nature ; nous contrastons, pour ce faire, les formes d’anticonventionnalisme et d’anti-intellectualisme défendues par Calliclès et Diogène. -/- SUMMARY. Like many ancient thinkers before and after them and contra Socrates, Callicles and Diogenes said they based their ethics on the observation of nature. And yet, the two normative discourses that are derived from nature that we might a priori believe to be the same could not be more opposed. Callicles believes that people are called to dominate others, Diogenes rather thinks people must dominate themselves. The first is an unbridled hedonist, the second believes that happiness can be bought only at the price of sacrificing artificial desires. How to explain this dichotomy? We take two explanatory routes. First, we show that for Callicles and Diogenes, the notion of nature not only differs but is observed from a different angle. The first one is the nature of tyrants and anthropomorphic gods, the second that of small animals and autarkic gods. The first focuses on the relationship between people, the second focuses on the relationship of a person with themselves. Secondly, we expose the difference in normative assumptions that precede or accompany the observation of nature; in order to do so, we contrast anticonventionalism and anti-intellectualism forms proper to both Callicles and Diogenes. L’importance de la légende de Saint François d’Assise pour le canon apocalyptique du xiii ème siècle nous permettra de relier cette vision éthique au mythe platonicien, nous amenant, au final, à suggérer une alternative aux visions apocalyptiques de l’Anthropocène, appuyée sur l’originalité de la conception de la nature dans la pensée simondonienne. ». In this paper Aristotle’s views concerning the place of reason and emotions in ethics are investigated. Aristotle ranks first among the philosophers who examined the problem of “the place of reason and emotions in ethics”in detail, which is basically the problem of the origin of ethical relationships or of ethical acts, and his solution was that reason is the origin or the fundament; because for him ethical relationships and ethical acts are appropriate to virtue. In his view, since virtue is (...) the habit which has a place in the mean , without reason it is impossible for the ethical relationship or act to come into being. Contrary to this, emotions, being affections, do not have the function of being motives; they can only be, like every affection, appropriate or inappropriate to virtue. (shrink)

Many theories about the teaching of logic and critical thinking take for granted that theoretical learning, the learning of formal rules for example, and its practical application are sufficient to master the tools taught and to take the habit of using them. However, this way of teaching is not efficient, a conclusion supported by much work in cognitive science. Approaching cognition evolutionarily with dual-process theories allows for an explanation of these insufficiencies and offers clues on how we could teach critical (...) thinking and logic more efficiently. In this article, we want to present this approach and explore these leads in order to make some pedagogical recommendations and lay the foundations of a framework. We will put forward an example of the application of this research program with philosophy for children. (shrink)

This study was to examine inter-cultural marriages in terms of the challenges and coping strategies in Ini local government area of Akwa Ibom state, Nigeria. The study adopted survey research design. The area of the study was Ini local government area, Akwa Ibom State. The population of one thousand, two hundred and fifty-four couples were into inter-cultural marriages in Ini L.G.A. Purposive random sampling technique was used in selecting the married couples that was used for the respondents. The instrument for (...) data collection was structured questionnaire which was validated by three expects. The sample size was 300. The major findings includes 10 prospects of inter-cultural marriage which were heightened cultural awareness and empathy, people are more tolerant in inter-cultural marriages than others, children of inter-cultural marriages feel affinity from the cultures of both parents among others with mean ranged from 3.06 to 3.50 and standard deviations ranged from 0.48 to 1.06. Ten challenges of inter-cultural marriages were identified with mean ranged from 3.07 to 3.53 while the standard deviations ranged from 0.50 to 0.94. 10 coping strategies of inter-cultural marriage were identified. This study recommends that couples who intend to go into intercultural marriages must understand clearly from the start what their companions will bring to the marriage, habits and attitudes learned from his/her family and friends and be carefully discussed before marriage and after marriage. ésumé : Les domaines de la philosophie et de la théorie politique ont connu un certain nombre de changements au cours des quarante dernières années. L'un attire notre attention tout particulièrement ; le basculement d'un point de vue national, cristallisé par le contrat social rawlsien, vers un point de vue non-national. En effet, plusieurs penseurs abordent un ensemble de phénomènes considérés comme nouveaux, tels que les traités de libre commerce et l'économie globale, les entreprises et les institutions supra et transnationales, (...) l'immigration et les contrôles frontaliers etc. Ces changements sont intéressants puisqu'ils obéissent, principalement, à une évolution majeure du terrain politique et social que l'on appelle mondialisation. Les théoriciens travaillant dans le domaine de la justice globale semblent s'adresser à deux questions différentes mais reliées. La première concerne la justice globale : dans quelle mesure et pourquoi l'ordre mondial est-il juste ou injuste ? Qu'est-ce qu'un ordre global juste ? La deuxième est dans un sens corollaire à la première, et concerne la responsabilité : qui devrait être blâmé ou digne d'éloge pour l'ordre mondial ? Est-ce que les citoyens sont responsables de l'ordre mondial ? Qui devrait redresser ses éventuelles conséquences injustes ? Face à l'économie mondialisée et aux institutions politiques et économiques internationales et trans-nationales, cette interrogation devient légitime et nécessaire : suis-je responsable à l'égard des travailleurs des sweat shop lorsque j'achète des habits à Auchan ou bien à l'égard des caféiculteurs très mal payés lorsque je prends un capuccino dans un café Starbucks ? Est-ce que les citoyens sont responsables des traités de libre commerce que leurs gouvernements signent ? Ces questions sur la responsabilité des individus dans le contexte de la mondialisation seront l'enjeu de ce travail de recherche. Nous interrogerons plus exactement la responsabilité d'un agent lorsqu'il fait partie d'un chaîne causale complexe, lorsqu'il participe d'une injustice structurelle. Ainsi, il ne s'agit pas seulement d'une chaîne causale, mais de connexions qui sont l'issue d'un changement des modes de productions, de consommation et de la concurrence dans un marché mondialisé. Plus important encore, il ne s'agit pas simplement de la responsabilité individuelle mais plutôt de la responsabilité individuelle en tant que citoyen, et donc d'une responsabilité politique. Elle peut certes être individuelle, mais nous devons tenir compte du fait qu'elle doit être pensée en tant que responsabilité politique, et pas uniquement morale, puisque l'individu et ses actions sont déterminés par des communautés politiques dans lesquelles il participe, ou dans lesquelles il est représenté. Ainsi, la mondialisation nous invite à repenser la responsabilité individuelle pour pouvoir rendre compte des intuitions morales et politiques qui guident une bonne partie du champ de la justice globale. Pour cela, nous verrons dans un premier temps la manière dont les théories de la justice globale essaient de répondre à ce défit. Grâce à cela nous dégagerons l'hypothèse qui nous guidera, l'idée que dans la mondialisation, un agent peut être responsable, avec d'autres, des raisons pour lesquelles il n'est pas considéré comme responsable. C'est-à-dire qu'il sera méta-responsable. Dans un second temps, nous essaierons de déterminer un model de responsabilité individuelle, et de comprendre comment la responsabilité est attribuée. Ensuite, nous essaierons de formuler une manière de concevoir la responsabilité politique. Grâce à ces deux éléments, la responsabilité individuelle et la responsabilité politique, nous pourrons parvenir à formuler une conception de la méta-responsabilité comme forme de penser l'agentivité traversée par la mondialisation. -/- . This study addresses the subject of Islamic ethics from definitional and disciplinary perspectives. It highlights the need for relevantization of Islamic ethics to contemporary issues in a systematic manner which, in turn, calls for development of Islamic ethics as a complete discipline with ability to meet all types of challenges: conceptual, practical, normative, applicative, etc. Regarding the definitional issue, different from and more expansive than the traditional understanding of alākhlāq, the researcher argues that a proper definition of ethics should include (...) ethically relevant habits, character, and behavior in its subject matter. As an academic discipline of paramount, practical significance, Islamic ethics should adequately address metaethical, normative, and applicative aspects of the subject. In terms of metaethics, Islamic ethics is derived from revealed knowledge; whereas, principles of Islamic jurisprudence (us
l al&fīqh) offers the best available methodology for the discipline in meeting demands of normativity and application. Regarding the nature of the subject of Islamic ethics, the researcher argues that understanding Islamic ethics as virtue ethics is unjustifiable reduction because a careful study of the subject from its sources would prove that Islamic ethics is rather an integrated field comprising of virtues ethics, divine command theory, duty&based ethics, etc. Therefore, Islamic ethics should be developed, taught, and learned as a whole composite of above&mentioned elements. This is the second book by Baz that aims to show that a big chunk of contemporary philosophy is fundamentally misguided. His first book, When Words Are Called For: A Defense of Ordinary Language Philosophy (2012) adopted a therapeutic approach (in the Wittgensteinian style) to problems in contemporary epistemology, arguing that when properly thought through, the way philosophers talk about ‘knowing’ that something is the case ultimately does not make sense. Baz’s goal in his second book is less therapeutic and (...) more constructive: he aims to start a methodological revolution (in the Kuhnian sense)—to shake contemporary philosophers out of the unconscious habits of normal science and provoke them into making a radical change in the methods they use to do philosophy and the basic assumptions that motivate those methods. This discussion revises and extends Jonny Anomaly's ‘public goods’ account of public health ethics in light of recent criticism from Richard Dees. Public goods are goods that are both non-rival and non-excludable. What is significant about such goods is that they are not always provided efficiently by the market. Indeed, the state can sometimes realize efficiency gains either by supplying such goods directly or by compelling private purchase. But public goods are not the only goods that the market may fail (...) to provide efficiently. This point to a way of broadening the public goods account of public health to accommodate Dees' counterexamples, without abandoning its distinctive appeal. On the market failures approach to public health ethics, the role of public health is to correct public health-related market failures of all kinds, so far as possible. The underlying moral commitment is to economic efficiency in the sense of Pareto: if we can re-allocate resources in the economy so as to raise the welfare of some without lowering the welfare of any other, we ought to do so. The concept of artificial intelligence is not new nor is the notion that it should be granted legal protections given its influence on human activity. What is new, on a relative scale, is the notion that artificial intelligence can possess citizenship—a concept reserved only for humans, as it presupposes the idea of possessing civil duties and protections. Where there are several decades’ worth of writing on the concept of the legal status of computational artificial artefacts in the USA and elsewhere, (...) it is surprising that law makers internationally have come to a standstill to protect our silicon brainchildren. In this essay, it will be assumed that future artificial entities, such as Sophia the Robot, will be granted citizenship on an international scale. With this assumption, an analysis of rights will be made with respect to the needs of a non-biological intelligence possessing legal and civic duties akin to those possessed by humanity today. This essay does not present a full set of rights for artificial intelligence—instead, it aims to provide international jurisprudence evidence aliunde ab extra de lege lata for any future measures made to protect non-biological intelligence. Congdon (2017), Giladi (2018), and McConkey (2004) challenge feminist epistemologists and recognition theorists to come together to analyze epistemic injustice. I take up this challenge by highlighting the failure of recognition in cases of testimonial and hermeneutical injustice experienced by victims of sexual harassment and sexual assault. I offer the #MeToo movement as a case study to demonstrate how the process of mutual recognition makes visible and helps overcome the epistemic injustice suffered by victims of sexual harassment and sexual assault. I argue that in declaring “me too,” the epistemic subject emerges in the context of a polyphonic symphony of victims claiming their status as agents who are able to make sense of their own social experiences and able to convey their knowledge to others. Philosophers of experiment have acknowledged that experiments are often more than mere hypothesis-tests, once thought to be an experiment's exclusive calling. Drawing on examples from contemporary biology, I make an additional amendment to our understanding of experiment by examining the way that `wide' instrumentation can, for reasons of efficiency, lead scientists away from traditional hypothesis-directed methods of experimentation and towards exploratory methods.

The genetic modification of pigs as a source of transplantable organs is one of several possible solutions to the chronic organ shortage. This paper describes existing ethical tensions in xenotransplantation (XTx) that argue against pursuing it. Recommendations for lifelong infectious disease surveillance and notification of close contacts of recipients are in tension with the rights of human research subjects. Parental/guardian consent for pediatric xenograft recipients is in tension with a child’s right to an open future. Individual consent to transplant is (...) in tension with public health threats that include zoonotic diseases. XTx amplifies concerns about justice in organ transplantation and could exacerbate existing inequities. The prevention of infectious disease in source animals is in tension with the best practices of animal care and animal welfare, requiring isolation, ethologically inappropriate housing, and invasive reproductive procedures that would severely impact the well-being of intelligent social creatures like pigs. Confucius gave counsel that is notoriously hard to follow: "What you do not wish for yourself, do not impose on others" (Huang 1997: 15.24). People tend to be concerned with themselves and to be indifferent to most others. We are distinct from others so our self-concern does not include them, or so it seems. Were we to realize this distinctness is merely apparent--that our true self includes others--Confucius's counsel would be easier to follow. Concern for our true self would extend (...) concern beyond the narrow selves we appear to be. The neo-Confucians held just such a view. They espoused an identity with the universe and everything in it, arguing that this identity explains a natural concern for everyone and everything, not just for our narrow selves. However, many things in the universe differ from each other, that is, some have qualities others lack. If they are all one and the same thing then that one thing differs from itself. I will suggest that the objection can be answered with some metaphysical innovation. I will address the objection by sketching a theory--call it the theory of aspects--that explains how numerically identical things can differ qualitatively. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. The tripartite account of propositional, fallibilist knowledge that p as justified true belief can become adequate only if it can solve the Gettier Problem. However, the latter can be solved only if the problem of a successful coordination of the resources (at least truth and justification) necessary and sufficient to deliver propositional, fallibilist knowledge that p can be solved. In this paper, the coordination problem is proved to be insolvable by showing that it is equivalent to the ''''coordinated attack'''' problem, (...) which is demonstrably insolvable in epistemic logic. It follows that the tripartite account is not merely inadequate as it stands, as proved by Gettier-type counterexamples, but demonstrably irreparable in principle, so that efforts to improve it can never succeed. Philosophical discussions of species have focused on multicellular, sexual animals and have often neglected to consider unicellular organisms like bacteria. This article begins to fill this gap by considering what species concepts, if any, apply neatly to the bacterial world. First, I argue that the biological species concept cannot be applied to bacteria because of the variable rates of genetic transfer between populations, depending in part on which gene type is prioritized. Second, I present a critique of phylogenetic bacterial species, (...) arguing that phylogenetic bacterial classification requires a questionable metaphysical commitment to the existence of essential genes. I conclude by considering how microbiologists have dealt with these biological complexities by using more pragmatic and not exclusively evolutionary accounts of species. I argue that this pragmatism is not borne of laziness but rather of the substantial conceptual problems in classifying bacteria based on any evolutionary standard. (shrink)

This Essay presents law’s evolution as a paradoxical union of the finite and the infinite. At any given point in time, law is a finite body of norms, which can be identified. At the same time, law’s evolution is infinite because rule-mutations that alter those norms are indeterminable. In modern legal systems, law’s evolution occurs under the constraining influence of master texts, which provide normative durability by enshrining the fundamental norms of a legal system and fortifying them against change. Despite (...) this stabilizing role, however, master texts are themselves open to mutations. Galileo’s Error is a superlative work of public philosophy, particularly as a way of introducing modern academic panpsychism to a broader audience. In this commentary, I reflect on an issue that is prominent, though often with different background concerns, in both academic and popular discourse: what it means to be ‘scientific’ or ‘unscientific’. Panpsychism is not itself a scientific hypothesis, but neither is it (as critics sometimes claim) in conflict with science. Indeed, Goff argues, and I agree, that panpsychism is (...) an eminently scientific worldview, in the sense of a way of viewing reality that accords with and embraces what science reveals. But what exactly it means to ‘accord with and embrace’ science is disputed; this paper tries to untangle some of the threads. (shrink)

In a recent issue of Philosophy East and West Douglas Berger defends a new reading of Mūlamadhyamakakārikā XXIV : 18, arguing that most contemporary translators mistranslate the important term prajñaptir upādāya, misreading it as a compound indicating "dependent designation" or something of the sort, instead of taking it simply to mean "this notion, once acquired." He attributes this alleged error, pervasive in modern scholarship, to Candrakīrti, who, Berger correctly notes, argues for the interpretation he rejects.Berger's analysis, and the reading of (...) the text he suggests is grounded on that analysis, is insightful and fascinating, and certainly generates an understanding of Nāgārjuna's enterprise that is welcome .. Beide Behauptungen sind falsch. ad (1): Der bedeutende Physiker und Chemiker Johann Ritter hat zwischen 1800 und 1801 eng mit Goethe kooperiert, dieselbe Forschungsmethode eingesetzt wie Goethe und aufgrund dieser Kooperation das UV-Licht entdeckt. It is generally acknowledged that a certain amount of state intervention in health and health care is needed to address the significant market failures in these sectors; however, it is also thought that the primary rationale for state involvement in health must lie elsewhere, for example in an egalitarian commitment to equalizing access to health care for all citizens. This paper argues that a complete theory of justice in (...) health can be derived from a commitment to correcting market failure, or in other words promoting Pareto-efficiency, in the domain of health. This approach can address familiar problems around access to care, as well as problems related to resource allocation and rationing, the control of health care costs, and the foundations of public health. Goethes Protest gegen Newtons Theorie des Lichts und der Farben ist besser, als man gemeinhin denkt. Man kann diesem Protest in den wichtigsten Elementen folgen, ohne Newton in der physikalischen Sache unrecht zu geben. Laut meiner Interpretation hat Goethe in Newtons wissenschaftsphilosophischer Selbsteinschätzung eine entscheidende Schwäche aufgedeckt: Newton glaubte, mithilfe prismatischer Experimente beweisen zu können, dass das Licht der Sonne aus Lichtstrahlen verschiedener Farben zusammengesetzt sei. Goethe zeigt, dass dieser Übergang vom Beobachtbaren zur Theorie problematischer ist, als Newton wahrhaben wollte. (...) Wenn Goethe darauf beharrt, dass uns der Übergang zur Theorie nicht von den Phänomenen aufgezwungen wird, dann kommt dadurch unser eigener, freier und kreativer Beitrag zur Theorie-Bildung ans Tageslicht. Und diese Einsicht Goethes gewinnt eine überraschende Schärfe, weil Goethe plausibel machen kann, dass sich alle entscheidenden prismatischen Experimente Newtons ebenso gut mit einer alternativen Theorie vereinbaren lassen. Wenn ich recht sehe, war Goethe der erste Wissenschaftsphilosoph, der mindestens eine empirisch äquivalente Alternative zu einer wohletablierten physikalischen Theorie gesehen hat: Damit war Goethe seiner Zeit um ein gutes Jahrhundert voraus.
