According to an attractive conception of love as attention, discussed by Iris Murdoch, one strives to see one’s beloved accurately and justly. A puzzle for understanding how to love another in this way emerges in cases where more accurate and just perception of the beloved only reveals his flaws and vices, and where the beloved, in awareness of this, strives to escape the gaze of others - including, or perhaps especially, of his loved ones. Though less attentive forms of love (...) may be able to render one’s continued love coherent and justifiable in these cases, they risk further alienating the beloved precisely because they are less attentive and because of the operations of the beloved’s shame. I argue that attentive love is well-suited to alleviate this problem of alienation, but that in order to do so, it must be supplemented with grace. I propose a conception of gracious love as an affectionate love for the qualities of human nature, distinguishing this from a love of humanity, and show how this complex emotion, in being responsive to the complexities of shame, is able to alleviate the problem of alienation. The philosophy of historical sciences investigates their distinct objects of study, epistemic challenges, and methodological solutions. Rethinking astronomy in this light offers a contribution. First, the methodology of historical sciences adds to a more adequate description of how astronomers study and utilize token events. Second, astronomy faces a typical difficulty in identifying traces of some past events and has developed a delicate solution. This enriches the idea of trace and suggests a methodology that relies on iterations between data-driven approaches and (...) theory-driven approaches, together with the cross-validation between multiple relevant historical events or datasets. The guise of the good thesis can be understood as an attempt to distinguish between human motivations that are intelligible as desires and those that are not. I propose, first, that we understand the intelligibility at stake here as the kind necessary for the experience of reactive attitudes, both negative and positive, to the behavior and motivations of an agent. Given this, I argue that the thesis must be understood as proposing substantive content restrictions on how human agents perceive objects (...) of their desires; it cannot be a purely formal constraint. Moreover, while proponents of the guise of the good thesis who posit substantive content restrictions on human desire are right to do so, they are mistaken to claim that we always desire the apparently good. Instead, I propose a different limit: the naturally attractive. This alternative to the guise of the good thesis nonetheless captures the compelling idea that human desires are intelligent, quasi-perceptual responses to the world. (shrink)

On one predominant conception of virtue, the virtuous agent is, among other things, wholehearted in doing what she believes best. I challenge this condition of wholeheartedness by making explicit the connections between the emotion of boredom and the states of continence and akrasia. An easily bored person is more susceptible to these forms of disharmony because of two familiar characteristics of boredom. First, that we can be – and often are – bored by what it is that we know would (...) be best to do, and second, that occurrent states of boredom tend to give rise to positive interest in performing actions that we know are bad to perform. Moreover, while a person’s susceptibility to boredom can indicate a lack of attentiveness or acuity, or be evidence of a vice such as ingratitude or shallowness, it can in others indicate positive qualities of character, such as perspicacity, liveliness, and certain forms of intelligence. Upon imagining certain bored akratics without the psychological qualities that give rise to their boredom, we will either imagine them without these positive qualities, or with others that – though perhaps psychologically possible – are not clearly better. This yields the result that a person who is continent or even akratic because of her susceptibility to boredom may have a character no less excellent than that of the wholehearted agent. (shrink)

Parmenides expelled nonbeing from the realm of knowledge and forbade us to think or talk about it. But still there has been a long tradition of nay-sayings throughout the history of Western and Eastern philosophy. Are those philosophers talking about the same nonbeing or nothing? If not, how do their concepts of nothing differ from each other? Could there be different types of nothing? Surveying the traditional classifications of nothing or nonbeing in the East and West have led me to (...) develop a typology of nothing that consists of three main types: 1) privative nothing, commonly known as absence; 2) negative nothing, the altogether not or absolute nothing; and finally 3) original nothing, the nothing that is equivalent to being. I will test my threefold typology of nothing by comparing the similarities and differences between the conceptions of nothing in Heidegger, Daoism and Buddhism. With this study, I hope that I will clarify some confusion in the understanding of nothing in Heidegger, Daoism and Buddhism, and shed light on the central philosophical issue of “what there is not”. The present paper explores some pre-Vibhāṣika sources including the Kathāvatthu, *Śāriputrābhidharma, and Vijñānakāya. These sources suggest an early origin of the concept of the cognition of nonexistent objects (asad-ālambana-jñāna) among the Mahāsāṃghikas and some of its sub-schools. These scattered sources also indicate some different aspects of this theory from that held by the Dārṣṭāntikas and the Sautrāntikas. In particular, some Mahāsāṃghika arguments for the cognition of nonexistent objects reveal how a soteriologically-oriented issue gradually develops into a sophisticated philosophical concept.

As with certain other self-reflexive emotions, such as guilt and shame, our understanding of self-hatred may be aided by views of the mind which posit an internalized other whose perspective on oneself embodies and focuses a set of concerns and values, and whose perspective one is in some sense vulnerable to. To feel guilt for some transgression is not solely to feel the anger that one would feel toward another’s trespasses, now directed back onto oneself as an object of that (...) anger; it is at the same time to react to that anger – perhaps, for example, to accept it as deserved, or to welcome the lashing of one’s bad conscience. To feel shame before oneself is not just to see oneself in some compromising way, it is to feel compromised by one’s own gaze. Likewise, the person who hates herself does not feel the hatred that she might have for another, simply taking herself as object of that attitude. She is not merely the seat of an internalized hostile voice and perspective that she may, for example, react to with indifference. She does not only tell herself that she is “worthless” but, will typically feel herself so in response. And her suffering may not just result from pain she is inclined to inflict, but suffering that, in some sense, she is inclined to suffer. But how is this so? How, in self-hatred, does one become not only subject to, but vulnerable and even receptive to one’s own hostility? (shrink)

The dominant way to define physical entities is by appeal to ideal physics (as opposed to current physics). However, it has been worried that physicalism understood in terms of ideal physics would be too liberal to rule out “psychism”, the view that mentality exists at the fundamental metaphysical level. In this article, I argue that whereas physicalism is incompatible with some psychist cases, such as the case of “phenomenalism” in which ideal physics adopts mental concepts to denote fundamental entities, physicalism (...) should accommodate a certain type of psychist case in which fundamental mental entities are denoted by non-mental concepts in ideal physics. In so doing, I propose a distinctive account of physical entities, which asserts that physical entities are entities denoted by non-mental natural concepts in ideal physics. Physicalism thus understood is expected to be neither too liberal nor too demanding. (shrink)

In “Confucianism and Same-Sex Marriage,” published recently in Politics and Religion, Professor Tongdong Bai argues for a “moderate Confucian position on same-sex marriage,” one that supports its legalization and yet endeavors “to use public opinion and social and political policies to encourage heterosexual marriages, and to prevent same-sex marriages from becoming the majority form of marriages” (Bai 2021:146). Against the backdrop of downright homophobia prevalent among vocal Confucians in mainland China today, Bai claims that his pro-legalization rendition “show[s] a different (...) version of Confucianism that challenges the received perception of Confucianism that it is deeply conservative, a perception that often lies at the core of the rejection of its contemporary relevance, especially by the so-called ‘liberals’ in China and elsewhere” (Bai 2021:133). Furthermore, Bai claims that his moderate Confucianism is normatively preferrable to “the typical liberal or individualist position” of a marriage equality supporter, because the specter of polygamy – the conservative trope of invoking polygamy as a reductio ad absurdum against same-sex marriage – imposes “a serious challenge” to liberals but not to moderate Confucians (Bai 2021:146, 153). -/- Both of Bai’s claims falter upon scrutiny, however. Granted, it is applaudable that Bai tries to dissuade his more conservative Confucian colleagues from opposing the legalization of same-sex marriage. But as Section 1 of this Response will show, the alternative rendition of Confucianism he presents, along with the way he presents it, is premised on a highly contested conception of what shared Confucian values are; does injustice to Confucians who embrace marriage equality more unreservedly (i.e., without caveats à la Bai); fails to produce new arguments that “enrich the theoretical basis for same-sex marriage” (Bai 2021:133); and, ironically, reinforces – rather than “challenges” – the “received perception” of Confucianism as deeply conservative. Meanwhile, Section 2 will show that Bai’s comparison between liberalism and moderate Confucianism relies both upon an apparent unfamiliarity with the extensive and nuanced liberal discussions on polygamy, and upon fallacious methods of assessing comparative normative valence. -/- Finally, Section 3 will offer some concluding thoughts from the perspective of decolonial theory, examining the dynamic of spectacularized postcoloniality that propels the production and consumption of dubious theoretical projects like Bai’s. As it turns out, this case serves not only as a cautionary tale of how not to conduct comparative normative theorizing, but also as a cautionary tale of how not to let the spectacle of postcoloniality derail the pursuit of academic decolonization. To act akratically is to act, knowingly, against what you judge is best for you to do, and it is traditionally assumed that to do this is to be weak-willed. Some have rejected this identification of akrasia and weakness of will, arguing that the latter is instead best understood as a matter of abandoning one's reasonable resolutions. This paper also rejects the identification of akrasia and weakness of will, but argues that this alternative conception is too broad, and that weakness (...) of will is best understood in relation to certain kinds of pain and pleasure. Moreover, the phenomenon of strong-willed akrasia, cases in which a person must exhibit strength of will to do precisely what she judges she should not do, suggests that strength of will is an executive virtue, and that being weak-willed is just one way (among others) in which a person can fail to manifest this virtue. ABSTRACT What is the ethical significance of the suffering of nonhuman animals? For many, the answer is simple. Such suffering has clear moral significance: nonhuman animal suffering is suffering, suffering is something bad, and the fact that it is bad gives us reason to alleviate or prevent it. The practical problem that remains is how to do this most efficiently or effectively. I argue that this does not exhaust the ethical significance of certain evils, once we consider how the existence (...) of those evils may detract from the meaning of human life, even on fully “naturalistic” conceptions of meaning in life. I will draw a distinction between what I will call “spiritual” problems and “moral” problems and consider why moral philosophers may be well suited to addressing both problems, as long as the domain of the ethical is not taken to be exhausted by the domain of the moral. Finally, I will elaborate on why marking a distinction between these problems—the moral and the spiritual—may help illuminate some disagreements between Utilitarians and their opponents about the ethical significance of the suffering of nonhuman animals. Philosophers are now wary of conflating the “fittingness” or accuracy of an emotion with any form of moral assessment of that emotion. Justin D’Arms and Daniel Jacobson, who originally cautioned against this “conflation”, also warned philosophers not to infer that an emotion is inaccurate from the fact that feeling it would be morally inappropriate, or that it is accurate from the fact that feeling it would be morally appropriate. Such inferences, they argue, risk committing “the moralistic fallacy”, a mistake they (...) claim is widespread throughout the work of contemporary and historical moral philosophers. I argue that many basic and familiar forms of moral assessment of the emotions are not subject to these arguments. I illustrate this by reconsidering the idea that to assess an emotion as “fitting” is to assess it as what a virtuous person would feel. After showing how assessments akin to this “virtue-theoretical” notion of fit may be prevalent even outside of the Aristotelian tradition, I suggest some more charitable and philosophically productive interpretations of the philosophical views of the emotions that D’Arms and Jacobson criticize, and argue that we cannot coherently theorize about the fittingness conditions of the emotions in a morally neutral way. L.A. Paul argues that “transformative experiences” challenge our hopes to live up to an ideal that she believes is upheld within western, wealthy cultures. If these experiences reveal information to us about the world and ourselves that is in principle unavailable to us before we undergo them, it seems that there is no hope for us to be rational, authentic and autonomous masters of our own lives. Supposing that Paul is right about this, how concerned should we be? Here, I (...) challenge the ideal of "rational mastery" that guides Paul’s project, and which must be granted in order to motivate the philosophical challenge purportedly generated by experiences that drastically change who we are and what we know. This paper calls for a paradigm shift in studying academic dependency, towards the paradigm of brokered dependency. Using Chinese academia as an example, I demonstrate how the neocolonial condition of academic dependency is always mediated through blockage-brokerage mechanisms. The two most salient blockage-brokerage mechanisms of dependency in the Chinese context are linguistic barrier and authoritarian malepistemization, and the effects of the latter consist of three layers: institutional, informational and incorporational. On top of their domestic impacts, those mechanisms jointly exacerbate spectacularized (...) postcoloniality in anglophone-hegemonic global academic publishing. The paradigm of brokered dependency not only represents a more nuanced approach to the study of academic dependency, but also underscores the fact that the dismantling of the neocolonial condition cannot be conceived and pursued in isolation from comprehending and confronting the authoritarian condition, especially when the latter pertains under the disguise of anticolonialism. This study deals with the tensions between old and new Yogācāra, as seen in the Huayan sources, which, in turn, reflect discontinuity between Indian Yogācāra and its reception in China. Its particular focus is on the concept of karmic appearance , as developed in the Awakening of Faith and further elaborated on by many Huayanmasters. This concept illustrates the sudden arising of deluded thoughts and provides us with a paradigm for the approach to the problem of delusion, a problem that (...) is deeply rooted in Tathāgatagarbha Thought and addresses the origin of deluded thoughts against the backdrop of the pure mind. This Huayan solution resembles the concept of free will, as developed in mainstream Christian theology after Augustine attempted to solve the problem of evil, and the concept of playfulness found in Indian Vedānta theology to explain the creation of the illusory world. The present paper discusses some concepts and materials that may be linked to Īśvarasena’s theory of non-cognition. These include the concept of feiliang 非量 as found in the writings of Dharmapāla, Asvabhāva, Jinaputra and their Chinese counterparts, and apramāṇatā (or apramāṇatva), as found in the works of Dharmakīrti and his commentators. I shall demonstrate that the two concepts in many ways mirror the theory of three pramāṇas, proposed by Īśvarasena. As most of these materials are from the sixth to eighth (...) century, they are extremely helpful for clarifying the early development of the theory of non-cognition and filling gaps in our understanding of the early development of this theory. Among various opinions in the controversy over the the cognition of non-existent objects (asad-ālambana-vijñāna) among various Buddhist and Indian philosophical schools or in the debate on the objectless presentations (gegenstandslose Vorstellungen) happened in the early development of phenomenology and analytic philosophy, I find that Dharmakīrti and Husserl hold similar views. Both of them have less interest in redefining the ontological status of nonexistent objects than Russell and Meinong. Rather they engage themselves in analyzing the experiential structure of negative cognition and (...) come up with a similar conclusion that negative judgments presuppose affirmative perceptions. In the world of Avatar: The Last Airbender (ATLA) and The Legend of Korra (LOK) —let’s call it the Bending World—some people (“benders”) are endowed with telekinetic superpowers to maneuver surrounding objects without physical interaction, by mentally steering (“bending”) one of the four classical “elements of nature” composing the objects: air, fire, water, and earth. Perhaps, in a world where the fundamental laws of nature are radically different from those of our world, the fundamental conditions and manifestations of politics should (...) be radically different too. That, of course, is not to deny that political bodies familiar to us are depicted in ATLA and LOK: tribes, monarchies, autonomous townships, city-states, loose federations, colonial empires, and democracies. Despite those familiar depictions, however, it’s worth contemplating how the existence of supernatural power might fundamentally alter the norms and rationales of politics—and how it might in turn help us better understand our own political reality. Aim: Low professional help-seeking intention (PHSI) hinders effective treatment of mental illness. PHSI among Chinese students is still understudied and under-recognized. This study aimed to evaluate the status of PHSI and its associated risk factors among Chinese medical students. -/- Methods: A cross-sectional survey was conducted in Hainan province, South China, between January 1, 2021, and May 31, 2021. A total of 2182 medical students were recruited and surveyed via an anonymous structured questionnaire. Logistic regression analyses were performed to identify (...) the factors associated with PHSI. -/- Results: Among the 2182 medical students (mean age 21.0 years (SD = 3.70), 61.5% females), those with and without PHSI were 72.0% and 28.0%, and 16.4% with moderate to severe depression. Male students, those with a high level of depression stigma, serious family dysfunction, and heavy dependence on mobile phones were significantly less likely to seek professional mental health help, with odds ratios (ORs) of 1.5, 2.0, 2.1, and 1.7, respectively. -/- Conclusion: A significant proportion of Chinese medical students demonstrate low PHSI, influenced by factors such as gender, depression stigma, family dysfunction, and mobile phone dependence. Future interventions aimed at increasing medical students’ PHSI should prioritize reducing depression stigma, mitigating reliance on mobile phone use, and enhancing family function to address these key barriers to seeking professional mental health support. Nutrient losses from sloping farmland in karst areas lead to the decline in land productivity and nonpoint source pollution. A specially tailored steel channel with an adjustable slope and underground hole fissures was used to simulate the microenvironment of the "dual structure" of the surface and underground of sloping farmland in a karst area. The artificial rainfall simulation method was used to explore the surface and underground runoff characteristics and nutrient losses from sloping farmland under different rainfall intensities. The effect (...) of rainfall intensity on the nutrient loss of farmland on karst sloping land was clarified. The results showed that the surface was the main route of runoff and nutrient loss during the rainy season on sloping farmland in karst areas. The influence of rainfall intensity on the nutrients in surface runoff was more substantial than that on underground runoff nutrients. Nutrient loss was more likely to occur underground than on the surface. The losses of total nitrogen, total phosphorus, and total potassium in surface and underground runoff initially increased and then gradually stabilized with the extension of rainfall duration and increased with increasing rainfall intensity and the amount of nutrient runoff. The output of nutrients through surface runoff accounted for a high proportion of the total, and underground runoff was responsible for a low proportion. Although the amount of nutrients output by underground runoff was small, it could directly cause groundwater pollution. The research results provide a theoretical reference for controlling land source pollution from sloping farming in karst areas. (shrink)

Recent years have seen a surge of interest in implicit bias. Driving this concern is the thesis, apparently established by tests such as the IAT, that people who hold egalitarian explicit attitudes and beliefs, are often influenced by implicit mental processes that operate independently from, and are largely insensitive to, their explicit attitudes. We argue that implicit bias testing in social and empirical psychology does not, and without a fundamental shift in focus could not, establish this startling thesis. We suggest (...) that implicit bias research has been conducted in light of inadequate theories of racism and sexism. As a result, such testing has not sufficiently controlled for subjects’ prejudiced explicit beliefs and emotions, and has not ruled out the possibility that explicit prejudice best explains test subjects’ discriminatory associations and behavior. A scarcity mindset is considered to impact consumer behaviors. Our research aimed to examine the moderating effect of the scarcity mindset on the relationship between mental accounting and hedonic (vs. utilitarian) consumption. We conducted an online experimental design (mental accounting: windfall gains vs. hard-earning gains; consumption: hedonic products vs. utilitarian products) and verified our hypotheses in two distinct samples: a student sample and an adult sample. Our results showed that consumers who received windfall gains tended to use it for hedonic (...) consumption rather than utilitarian consumption. Intriguingly, such an effect was insignificant under a high level of a scarcity mindset but significant under a low level of the scarcity mindset. Moreover, consumers who received hard-earning gains tended to spend the money on utilitarian (vs. hedonic) consumption. However, we did not detect the impact of the scarcity mindset on such effects. Our research suggested an asymmetric effect of the scarcity mindset on hedonic (vs. utilitarian) consumption under two different mental accounts. It highlights the important role of the scarcity mindset in consumer behaviors, which leaves avenues for future research to understand marketing promotion strategies for distinct products. (shrink)

This book examines some possible ethical principles to resolve moral dilemmas involving water. Existing problems in current water management practices are discussed in light of these principles. Transformation of human water ethics has the potential to be far more effective, cheaper and acceptable than some existing means of “regulation”, but transformation of personal and societal ethics need time because the changes to ethical values are slow.

Mobile Edge Computing (MEC) is an emerging technology that enables computing directly at the edge of the cloud computing network. Therefore, it is important that MEC is applied with reliable transmission. The problem of reaching consensus in the distributed system is one of the most important issues in designing a reliable transmission network. However, all previous protocols for the consensus problem are not suitable for an MEC paradigm. It is the first time an optimal protocol of reaching consensus is pro- (...) posed for MEC paradigm. The protocol makes all fault-free nodes communicate with each other and collect the exchanged messages to decide a common value. Based on the common value, the protocol ensures all fault-free nodes reach consensus without the influence of unreliable transmission. Finally, we proved theoretically that the proposed protocol can tolerate the maximum number of faulty components and using only two rounds of message exchanges. (shrink)

Currently, little is known about the mechanism of how university students’ attitudes toward entrepreneurship education (ATEE) affect entrepreneurial self-efficacy (ESE) in the post-pandemic entrepreneurial environment. Based on the existing research, this study explores the relationship between ATEE, the post-pandemic entrepreneurship environment, and ESE through a questionnaire survey. A total of 910 university students from three universities in Zhejiang Province, China participated, with an effective rate of 92.9%. The data collection focused on the period from August to December 2020. In this (...) study, Stepwise Multiple regression analysis was used to analyze university students' ATEE and its impact on ESE, as well as the moderating effect of the post-pandemic entrepreneurial environment. Este artigo tem quatro objetivos. O primeiro deles é mostrar que dois debates contemporâneos de grande importância para a filosofia política aristotélica – a saber, o debate acerca do laço que liga ou deve ligar os cidadãos de uma comunidade política e o debate acerca da importância da participação política no que diz respeito ao alcance da felicidade – devem ser compreendidos em conjunto com o mo- vimento hermenêutico que chamamos hoje de biological turn. Como veremos, a maneira como respondemos (...) a essas duas questões influencia ainda uma terceira, a saber, a questão acerca da importância e da função da lei para a comunidade política tal como pensada por Aristóteles. O segundo objetivo é resumir os principais argumentos apresentados nos ditos debates apontando sua pertinência e as suas falhas. O terceiro objetivo é ressaltar um ponto de considerável importância para ambos os debates que não recebeu a devida atenção por parte dos comentadores. Sendo impossível alcançar uma resposta definitiva a respeito das duas questões no espaço que temos aqui, o último objetivo do presente artigo é indicar um possível caminho para futuras investigações. RESUMO:O objetivo deste artigo é discutir sobre os conceitos de obrigação e lei natural, tendo como referência o polêmico debate moderno envolvendo intelectualismo e voluntarismo. Em um primeiro momento, destacaremos a rejeição de Wolff ao voluntarismo de Pufendorf e sua orientação em direção ao intelectualismo de Leibniz. Conforme essa nova orientação, uma teoria da lei natural não deve basear seu conceito de obrigação na autoridade das leis e em seu poder coercitivo, mas, por outro lado, unicamente na ideia de necessidade (...) moral, interpretada como expressão da ligação natural universal dos seres racionais com o dever. Em um segundo momento, apresentaremos os efeitos dessa discussão no pensamento inicial de Kant, que, se posicionando diante mesmo de Wolff e Baumgarten, vai empreender a superação de seus predecessores, através de uma revisão conceitual do problema, a qual culminará nos pressupostos de sua doutrina ética madura. -/- ABSTRACT:This paper highlights the debate around the concepts of obligationand natural law, with reference to the controversial modern discussion involving intellectualism and voluntarism. Firstly, we highlight Wolff’s rejection of the voluntarism of Pufendorf and Wolff’s orientation toward the intellectualism of Leibniz. For intellectualism, a theory of natural law should not ground the concept of obligation in the authority of laws and in their coercive power, but in the idea of moral necessity, understood as an expression of the universal natural connection of rational beings with duty. We then present the effects of this discussion on Kant’s early thought. For intellectualism, a theory of natural law should not ground the concept of obligation in the authority of laws (established as an arbitrary decree of God) and in their coercive power (interpreted as fear of punishment), but in the idea of moral necessity, understood as an expression of the universal natural connection of rational beings with duty. We then present the effects of this discussion on Kant’s early thought. Kant undertook to go beyond Wolff and Baumgarten through a conceptual review of the problem, which culminated in the assumptions of his mature ethics. (shrink)

The following article aims to reconstruct the philosophical-political content of Primo Levi's 1976 essays "About Obscure Writing", focusing especially on the anthropological question of inequality.

Neste ensaio filosófico, propomos analisar a lógica e as implicações subjacentes à Lei da Atração.

A partir de uma definição específica de sistema filosófico, este texto apresenta princípios condutores gerais para guiar o filósofo que deseja criar e propor sistemas. Além disso, este artigo mostra como tais complexos conceituais podem ser definidos com o uso de leis interativas, ligando noções de diferentes naturezas e esclarecendo a estrutura lógica dos sistemas filosóficos. Este artigo contém ainda comparações entre a presente abordagem e a recente desenvolvida por Puntel.

Os problemas da lei e da autoridade marcaram fortemente o pensamento políticomedieval ocidental, e em especial o desenvolvimento da noção de soberania, ponto deconvergência dos grandes conflitos de jurisdição no período. O debate acerca dadistribuição das jurisdições constituiu um dos momentos importantes para a construção damoderna idéia de soberania. Na medida em que se tomava a lei como dada, o sentido daautoridade tinha necessariamente de ser vinculado à idéia de comissão: a autoridade eraum atributo daquele que podia fazer cumprir a (...) lei em nome do legislador divino. Outromomento relevante foi o da emergência do problema do poder legislativo, tal como entendidomodernamente. Jurisdição, a partir daí, passaria a incluir também o direito de criar ede impor as normas válidas para toda a comunidade por um legislador agora humano. Aospoucos, a vontade do príncipe, que não se limita mais pelo rigor da razão e da moralidade,passa a ser entendida como fonte criadora, transformadora e revogadora da lei. O presente trabalho tem por objetivo mostrar o contexto filosófico e literário no qual evolui o seguinte problema: quais são as consequências da morte de Deus para a moral? Para responder a esta questão, focarei minha atenção sobre um período específico do pensamento ocidental, a saber, o que vai de Feuerbach (ou, da publicação da Crítica da razão pura de Kant em 1781) a Sartre e Camus, passando particularmente por Dostoievski e Nietzsche. Nele, digo que farei uma introdução à metafísica das leis da natureza. Uma introdução, em filosofia, consiste da apresentação de um problema filosófico, indicando as razões pelas quais tal problema é um problema, e das principais posições que tentam resolvê-lo, com suas respectivas dificuldades mais aparentes. Uma introdução não deve dar respostas definitivas sobre qual posição devemos aceitar, (...) nem argumentar decisivamente contra ou a favor de uma posição qualquer frente a outras; mas deve fornecer um quadro geral, para que os filósofos que não conhecem o tema possam começar a sua própria investigação. In this paper, we intend to explore the possible influences of legislative prose in the Anaximander’s cosmological prose construction, who would have been, according to Themistius, “the first Greek who dared to expose a written discourse about nature” (ἐθάρρησε πρῶτος ὧν ἴσμεν Ἑλλήνων λόγον ἐξενεγκεῖν περὶ φύσεως συγγεγραμμένον, Or. 26 p. 383 = DK12A7). Our aim is to clarify which notions of nature and justice are assumed in its emergent cosmology, considering that, at least from the lexical point of view, (...) it seems strongly suggestive to be undefined the barriers between the legal and cosmic order, between the Human and the Natural. Indeed, this is what the peripatetic tradition seems to suggest by judging Anaximander’s language extremely poetic (ποιητικωτέροις οὕτως ὀνόμασιν αὐτὰ λέγων), since he would use legal terms (διδόναι αὐτὰ δίκην καὶ τίσιν ἀλλήλοις τῆς ἀδικίας) to explain the natural processes of generation and corruption (ἡ γένεσίς ἐστι τοῖς οὖσι, καὶ τὴν φθορὰν εἰς ταῦτα γίνεσθαι, Simpl. in Phys. 24. 13–25 = DK12B1). ——— Objetivamos neste artigo explorar as possíveis influências da prosa legislativa na constituição da prosa cosmológica de Anaximandro de Mileto, que teria sido, segundo Temístio, “o primeiro grego que ousou expor um discurso escrito sobre a natureza” (ἐθάρρησε πρῶτος ὧν ἴσμεν Ἑλλήνων λόγον ἐξενεγκεῖν περὶ φύσεως συγγεγραμμένον, Or. 26 p.383 = DK12A7). Visamos aclarar que noções de natureza e de justiça estão sendo pressupostas nessa cosmologia então emergente, considerando que, ao menos do ponto de vista lexical, parece fortemente sugestivo serem indefinidas as barreiras entre a ordem jurídica e a cósmica, entre o âmbito humano e o natural. Com efeito, é o que parece já sugerir a tradição peripatética ao julgar o linguajar de Anaximandro extremamente poético (ποιητικωτέροις οὕτως ὀνόμασιν αὐτὰ λέγων) por o milésio empregar termos considerados do âmbito jurídico (διδόναι αὐτὰ δίκην καὶ τίσιν ἀλλήλοις τῆς ἀδικίας) para explicar os processos ditos naturais de geração e corrupção (ἡ γένεσίς ἐστι τοῖς οὖσι, καὶ τὴν φθορὰν εἰς ταῦτα γίνεσθαι, Simpl. in Phys. 24.13–25 = DK12B1). This book deals with an internal theme of metaphysics, which is the metaphysics of the laws of nature. The author presents traditional contemporary theories, as well as his own original theory, and evaluates each one at a time. He also addresses the problem of the modality of the laws of nature and makes some criticism of the standard view of necessity as truth in all possible worlds, and shows an application of his discussion to the metaphysics of physics. / Este (...) livro trata de um tema interno à metafísica, que é a metafísica das leis da natureza. O autor apresenta as teorias tradicionais contemporâneas, tal como também a sua própria teoria original, e avalia cada uma delas por vez. RESUMO Versa o presente artigo sobre a regulação do linchamento no Direito Romano do período antigo, em especial sobre o artigo 9º da Tábua III das Leis das XII Tábuas. A partir de uma metodologia de análise qualitativa, revisão bibliográfica e interpretação textual, os autores objetivam ampliar a visão tradicional sobre o linchamento, compreendendo a institucionalização de sua prática no Direito Romano e sua função no contexto de formação da cultura jurídica do período antigo. A hipótese de trabalho é a (...) de que o artigo 9º da Tábua III das Leis das XII Tábuas apresenta, historicamente, uma forma de punição intermediária entre a linchamento popular extralegal e a pena criminal prevista em lei. Do ponto de vista jurídico-antropológico, a comprovação da hipótese permitiria concluir a ideia de que a pena praticada na antiguidade é uma evolução do controle social informal da violência. ABSTRACT The following paper is about the lynching regulation in Roman law in Ancient Era, especially in what comes about the article 9 of Table Three from Twelve Tables. Making use of a methodology based in qualitative analisys, literature review and interpretation, the auctor aim to expande the traditional view about lynching, understanding the institutionalization of their practice in Roman Law and it’s function in the legal culture in Ancient Era. The working hipothesis is that the article 9 of Table Three of Twelve Tables presents, in a historical context, a intermediate form of punishment between extralegal collective lynching and criminal penalty provided by law. From a legal-anthropological point of view, the proof of the hypothesis would allow us to conclude the idea that the penalty practiced in antiquity is an evolution of informal social control of violence. Entendendo a identidade como construção ideológica, esta pesquisa busca refletir sobre a identidade dos professores de língua portuguesa construída nos Parâmetros Curriculares Nacionais e nas Orientações Curriculares Nacionais para o ensino de língua portuguesa, os quais impõem uma nova postura teórica e prática a estes profissionais. Dito de outra forma, pretende-se apresentar e discutir os resultados de uma análise discursiva das representações da (s) identidade (s) e competências atribuídas aos professores, enfatizando as representações sociais da profissão do professor na sociedade (...) contemporânea brasileira, abrindo a possibilidade para questionarmos a identidade unificada e transparente que os documentos oficiais desenham para os professores. Este trabalho apresenta algumas considerações a respeito da Base Nacional Comum Curricular (BNCC), no referente às questões ligadas ao ensino da língua portuguesa no Brasil, à territorialidade e ao pertencimento racial, processos históricos, que envolvem, no campo da educação, a formação docente e a construção da cidadania dos educandos e das educandas nestes tempos de reafirmação do Estado democrático de direito e da vaga decolonial. Portanto, trata-se de uma abordagem política em termos do pensamento de Paulo Freire, patrono da educação (...) brasileira, que considerava político o ato de educar (FREIRE, 1980; 1983; 1989; 1996). É com base nesta perspectiva que a BNCC será abordada, mas sob o aporte teórico da análise pragmática do discurso, tributária da análise discursivo-desconstrutiva (cf. ARAÚJO, 2020). (shrink)

These purposes are important since the concept of "natural law" is used in many (if not all) realms of natural science and in many branches of philosophy; if Tooley's cases are possible, they represent situations that must (...) be adequately described. The goal of this thesis to defend the philosophical view of the new ante rem substantivism against its supposed alternatives. To achieve such goal, we will present four views about the nature of laws, two kinds of realism and two kinds of anti-realism, and evaluate them critically. The disadvantages from those theories are going to be presented for us to show that they are insufficient to provide a metaphysics that is able to explain the world's counterfactuality, universality, and regularity, and (...) that just one form of realism, the new ante rem substantivism, can. This goal is important because the concept of laws of nature is widely used in many areas of science and philosophy, and because according to the view we accept, the laws may fulfill some theoretical roles, and not others. We intent to show that the new ante rem substantivism's laws are able to fulfill the roles that scientists would hope the natural laws to fulfill. (shrink)

Philosophy undergraduate course completion work published in 2015. This work examines Frege's concept of logical law and its relationship to other normative and descriptive approaches in the history of philosophy, as well as epistemological conceptions of the a priori aspects of mathematical knowledge.

We intend at this article to show some reasons to think the laws of nature as metaphysically necessary: to distinguish the metaphysical modality from the epistemical modality, and to have an absolute modality to face the relative physical and logical modalities. Lately, we indicate what does it mean to talk about metaphysically necessary laws, distinguishing two kinds of metaphysical modalities, and we account for the question about if the laws of nature are metaphysically necessary.
