Bealer’s argument against Kripke is presented. We then show how Kripke could counteract it. Our idea that the identity materialist may have the possibility of explaining why type psychophysical identities only appear to be contingent (but are necessary), because we confuse the exemplified properties (one property) with the concepts that subsume them (two distinct concepts), is supported by McGinn’s and Nagel’s materialistic intuitions. It remains to be seen whether a critique of Kripke like that of Bealer runs counter to the (...) exemplified properties and the concepts that subsume them. We argue that Bealer’s criticism of Kripke does not contradict it. McGinn’s and Nagel’s intuitions support our idea. What we want to show is that, even if, from the anti-materialist side of the debate about the mind–body identity thesis, Bealer and Kripke agree on the general anti-materialist strategy but not on the strategies of phenomenological explanation (which for Bealer, Kripke neglects) and descriptivist explanation (which for Bealer is wrong), the disagreement between Bealer and Kripke still leaves open the materialist explanation of one property and two concepts. If there is an explanation for the illusion of contingency, it is quite possible that these type psychophysical identities are indeed necessary. (shrink)

I'll show that the kind of analogy between life and information [argued for by authors such as Davies (2000), Walker and Davies (2013), Dyson (1979), Gleick (2011), Kurzweil (2012), Ward (2009)] – that seems to be central to the effect that artificial mind may represent an expected advance in the life evolution in the Universe – is like the design argument, and that if the design argument is unfounded and invalid, the argument to the effect that artificial mind may represent (...) an expected advance in the life evolution in the Universe is also unfounded and invalid. However, if we are prepared to admit (though we should not do so) this method of reasoning as valid, I'll show that the analogy between life and information to the effect that artificial mind may represent an expected advance in the evolution of life in the Universe seems to suggest some type of reductionism of life to information, but biology respectively chemistry, or physics are not reductionist, contrary to what seems to be suggested by the analogy between life and information. Given the hard problem of consciousness, there are no brain electrophysiological correlates of the subjective experience (the felt quality of redness or the redness of red, the experience of dark and light, the quality of depth in a visual field, the sound of a clarinet, the smell of mothball, bodily sensations from pains to orgasms, mental images that are conjured up internally, the felt quality of emotion, the experience of a stream of conscious thought, or the phenomenology of thought). However, (...) there are occipital and left temporal brain electrophysiological correlates of the subjective experience. Notwithstanding, as an evoked signal, the change in event-related brain potential phase (frequency is the change in phase over time) is instantaneous, that is, the frequency will transiently be infinite: a transient peak in frequency (positive or negative), if any, is instantaneous in electroencephalogram averaging or filtering that the event-related brain potentials required and the underlying structure of the event-related brain potentials in the frequency domain cannot be accounted for, for example, by the Wavelet Transform or the Fast Fourier Transform analysis, because they require that frequency be derived by convolution rather than by differentiation. However, as I show, one suitable method for analysing the instantaneous change in event-related brain potential phase and accounting for a transient peak in frequency (positive or negative), if any, in the underlying structure of the event-related brain potentials is the Empirical Mode Decomposition with post-processing Ensemble Empirical Mode Decomposition. Realizar uma discussão teórica decorrente da perspectiva ninfomanía em um cenário da pandemia do covid-19, possibilitando o resumo de informações como facilitador do tratamento de pacientes. Trata-se de uma revisão narrativa de aspecto critico discursivo, onde a construção da pesquisa e a formulação foram baseadas em publicações relevantes sobre o tema proposto, conceituando a doença e os fatores que influenciam seu diagnóstico e tratamento. Questionável nos aspectos sociais, religiosos e na perda do controle sexual ao deparar mos em situação de (...) isolamento social, necessitando de tratamento adequado. O aumento da exposição na mídia de pessoas que sofrem de distúrbios ninfomaníacos pode ser negativo, seja refletido no sentimento de preconceitos e incertezas perante a expansão de uma pandemia, onde consultas medicas e informações fornecidas por profissionais habilitados são todas por video chamadas, seguindo o protocolo do distanciamento, resultando na exposição de informações. In this paper I draw together the notion of the absent referent as proposed by Carol J. Adams, and the notions of literal and symbolical sacrifice by eating the other — or ingestion — advanced by Jacques Derrida, to characterize how animals are commonly perceived, which ultimately forbids productive arguments for vegetarianism. I discuss animals as being literally and definitionally absent referents, and I argue, informed by Derrida’s philosophy, that it is impossible to aim at turning them into present referents (...) without reinforcing symbolic ingestion by linking symbolic ingestion to epistemic appropriation or conceptualization. With this, I highlight the ethical importance of discussing symbolic ingestion in animal philosophy. (shrink)

Defender-se-á que a arte narrativa é capaz de instruir moralmente pois 1) proporciona um tipo de conhecimento não-proposicional que permite o acesso a novas perspetivas, e 2) é capaz de cultivar e refinar os valores e as práticas morais dos leitores, através do engajamento emocional. Tentar-se-á mostrar que o poder inverso — o poder de corromper moralmente — não se verifica (ou não se verifica tão facilmente): apelar-se-á à resistência imaginativa humana (...) que parece impedir que o Homem exporte perspetivas morais que violentam o seu próprio posicionamento axiológico. In this paper I defend an intermediate position between the ‘bare mathematical results’ view and the ‘transmission’ view of mathematical explanations of physical phenomena (MEPPs). I argue that, in MEPPs, it is not enough to deduce the explanandum from the generalizations cited in the explanans. Rather, we must add information regarding why those generalizations obtain. However, I also argue that it is not necessary to provide explanatory proofs of the mathematical theorems that represent those generalizations. The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

While most people believe the best possible life they could lead would be an immortal one, so‐called “immortality curmudgeons” disagree. Following Bernard Williams, they argue that, at best, we have no prudential reason to live an immortal life, and at worst, an immortal life would necessarily be bad for creatures like us. In this article, we examine Bernard Williams' seminal argument against the desirability of immortality and the subsequent literature it spawned. We first reconstruct and motivate Williams' somewhat cryptic argument (...) in three parts. After that, we elucidate and motivate the three best (and most influential) counterarguments to Williams' seminal argument. Finally, we review, and critically examine, two further distinct arguments in favor of the anti‐immortality position. (shrink)

This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

O presente trabalho busca refletir, no sentido derridiano, sobre o ensino do Português Língua Estrangeira (PLE) à luz do Quadro Europeu Comum de Referência para a aprendizagem, ensino e avaliação de línguas (QECR). Tal documento, juntamente com o Portfólio Europeu das Línguas, se apresenta como um instrumento essencialmente linguístico para a harmonização do ensino de línguas vivas europeias e com uma perspectiva intercultural. Dessa forma, o QECR advoga que o ensino de língua deve promover o desenvolvimento do aprendiz, da sua (...) identidade em resposta à experiência enriquecedora da diferença na língua e na cultura. Exige-se do aluno muito mais do que simplesmente imitar ou memorizar. O QECR busca descrever exaustivamente aquilo que o aprendiz de uma língua, no nosso caso o PLE, tem que aprender para ser capaz de comunicar, interagir e quais os conhecimentos e habilidades ele tem de desenvolver para serem eficazes na sua atuação. A descrição abrange também o contexto cultural dessa língua. Sendo assim, o QECR é mais uma alternativa para aqueles que trabalham com o português na modalidade de língua 2 (PLE) no sentido da compreensão das alteridades, da cidadania e da democracia num mundo sem fronteiras em que “Navegar é preciso”, i.e., interagir, dialogar. This study takes up the discussion held by Philippe Sabot in Foucault, Sade and the Enlightenment when it came the Marquis de Sade's work uses in studies conducted by Michel Foucault from Madness and Civilization to The Will to Knowledge. What interests us know of this relationship? This is the main question that guided our study.

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Este artigo busca adentrar pelas questões relacionadas à biopolítica do corpo, sobretudo, daquelas ligadas à estatização do biológico e do racismo do Estado, que aparecem nos trabalhos de Michel Foucault e que aqui evocamos para analisar o corpo enquanto objeto discursivo analisável dessa biopolítica em duas produções francesas de horror, - Frontière(s) e em À l’interieur – que exibem imagens dos tumultos de Outubro de 2005, acontecimento marcado pelos protestos contra a política de perseguição aos sans-papiers que vitimou três jovens (...) de origem africana. É a partir daí que retomaremos a discussão do “quem somos nós”, em Foucault, para refletir sobre o sujeito, a menoridade e a liberdade na estatização do corpo, um lugar da memória nacional. (shrink)

Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

Este estudio se ocupa del control social del cuerpo y de la reconfiguración de la memoria popular en películas de horror a través de la perspectiva genealógica de Foucault, presentada en su libro Vigilar y Castigar, publicado hace 40 años. Por lo tanto, tomaremos, À l’interieur e Frontière (s), dos producciones de horror cinematográfico hechas por directores franceses, ambos publicados en 2007. La hipótesis principal es que las películas de terror se muestran como una nueva forma de vigilancia y control (...) social del cuerpo. Por otro lado, también puede recodificar la memoria popular apropiándose de acontecimientos polítcos y/o revolucionarios como en las películas comentadas por Foucault en la revista Cahiers de Cinéma en 1974 políticas, aunque no sean las películas de terror. Parece um fato bastante trivial que quando uma teoria científica se torna obsoleta, por ter sido substituída por outra, isto não tem nenhuma consequência para os objetos técnicos compatíveis com a teoria antiga. Pretendo, neste ensaio, responder à questão bem menos óbvia de por que isto se dá. Como subproduto, apresento uma defesa da teoria da ciência de Thomas Kuhn. Para tanto, inicio mostrando como a teoria de Kuhn foi motivada por considerações sobre a história da ciência. We argue that there is no tension between Reid's description of science and his claim that science is based on the principles of common sense. For Reid, science is rooted in common sense since it is based on the idea that fixed laws govern nature. This, however, does not contradict his view that the scientific notions of causation and explanation are fundamentally different from their common sense counterparts. After discussing these points, we dispute with Cobb's and Benbaji's interpretations of Reid's (...) views on causation and explanation. Finally, we present Reid's views from the perspective of the contemporary debate on scientific explanation. (shrink)

É bem conhecida a divergência entre as posições de Gottlob Frege e Bertrand Russell com relação ao tratamento semântico dado a sentenças contendo termos singulares indefinidos, ou seja, termos singulares sem referência ou com referência ambígua, tais como ‘Papai Noel’ ou ‘o atual rei da França’ ou ‘1/0 ’ ou ‘√4’ ou ‘o autor de Principia Mathematica’. Para Frege, as sentenças da linguagem natural que contêm termos indefinidos não formam declarações e portanto não são nem verdadeiras nem falsas. Já para (...) as sentenças da matemática, Frege defende que elas precisam ser corrigidas através da convenção forçada de uma referência não ambígua. Russell, por outro lado, aceita os termos indefinidos e propõe, através de sua teoria das descrições definidas, uma maneira de avaliar as sentenças em que eles ocorrem; e Quine amplia a teoria de Russell para abranger também os nomes com problemas de referência. Na prática da matemática são comuns os termos singulares indefinidos, sem referência, tais como ‘1/0 ’, ou com referência ambígua, tais como ‘√4’. Apesar de não haver uma sistematização rigorosa desta situação entre os matemáticos, há, no entanto, um conjunto de regras convencionais que tradicionalmente costumam ser aplicadas no tratamento matemático dos termos indefinidos. Nossa proposta é tomar a convenção matemática como inspiração e modelo para apresentar uma interpretação semântica formal para as descrições definidas e os nomes e utilizá-la como um argumento que favorece a abordagem de Russell relativamente à de Frege. Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. The upshot is that one should (...) not ameliorate for the sake of truth or knowledge, in the case of ideologies—at least, not primarily. (shrink)

The fields of quantum biology and physics are now starting to unite to solve the mysteries associated with the field of evolutionary biology. One such question is the origination and propagation of consciousness which has always been ambiguous and in order to understand this concept, many theories have been proposed by several philosophers and scientists. This review paper agrees with the idea, that evolution is not a random process but hypothesizes, that its succession was managed by the expanding level of (...) consciousness due to cell division and cell differentiation. Several theories propose that the cytoskeleton and its proteins are promoters for consciousness in the brain, which propagates by means of super-conductance. A better correlation of cytoskeletal evolution and consciousness could help solve the enigma of the origination, propagation and existence of consciousness. This review is a compilation of theories, evidences and scientific studies which intends to bring an association between propagation of consciousness and the evolution of the cytoskeleton and its proteins. Conceptual engineering is the method for assessing and improving our representational devices. On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. In the Principles of Philosophy, Descartes explains several observable phenomena showing that they are caused by special arrangements of unobservable microparticles. Despite these microparticles being unobservable, many passages suggest that he was very confident that these explanations were correct. In other passages, however, Descartes points out that these explanations merely hold the status of “suppositions” or “conjectures” that could be wrong. My main goal in this chapter is to clarify this apparent conflict. I argue first that for Descartes it was (...) indeed possible to have knowledge of unobservable particles and structures, and that the possibility of natural explanations being wrong should be understood as these explanations not being absolutely certain, but only morally certain. I use the debate in contemporary philosophy of science between scientific realism and antirealism as a framework to understand how Cartesian explanations work. Especifically, I argue that Cartesian explanations rely on what Ernan McMullin calls retroduction, which is a mode of inference that justifies beliefs in concrete unobservable entities and processes, based on considerations such as simplicity, coherence, etc. This kind of justification is of common use among scientific realists. Thus, another goal of this chapter is to highlight the relevance of Descartes’ ideas about explanation in the contemporary debate on scientific realism. (shrink)

Energy from the cosmos interacted with inorganic matter to support matter with retention of this riveted energy, as energy to be circulated within the primitive channelized structures to conserve energy by the materialization of the proton homeostasis (...) mechanisms developed from the obtainable inorganic matter. The driver for these processes as we now confirm, exists in the quantum world and through quantum phenomenal processes could have combined these constants to create the magic of life. Primitive earth was a chemical reactive system that triggered a macromolecular evolution by means of open thermodynamic systems, driven by cyclic gradients of temperature, electromagnetic radiation and chemical potentials which sustained life and proto-consciousness in the first life forms driven by the quantum processes. The origin of life is always an intriguing topic but the purpose for finding the cause should never be inclined towards obliterating it; for if that is the case, the further we seek, the farther it will go. Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. Near-death experiences are a big challenge to the fields of science and philosophy; termed as hallucinatory by neurologists and “stuff of which fantasies are made off” by sceptics, there are some unique near-death experiences which defy these claims. Memories generated during these experiences are of specific interest as they are created without a body and can be recalled post the experience. Call it the mind, soul, psyche or consciousness, if deliberated as a form of quantum generated energy, a strong correlation (...) under a reductionist based perspective can be obtained. Life at a macroscopic level may not be similar to life at a quantum level, and has been proved in quantum physics through its spooky properties like quantum entanglement. Self-sustaining quantum generated energy through entanglement is the answer to all mystical realties and the answer lies in believing in its existence in and around us. It is this energy that brings in the awareness of one’s existence and which performs tasks beyond the imagination of the current self; an energy created at the creation of all that exists; a true supernatural force. This paper reviews a unique void near-death experience and hypothesizes quantum entanglement to be involved in the conception and storage of these energy-based memories in a quantum subatomic cloud which can be restated if returned back to the body or lost to the environment upon death. In this paper I argue for a novel interpretation of Shepherd’s notion of selfhood. In distinction to Deborah Boyle’s interpretation, I contend that Shepherd differentiates between the mind and the self. The latter, for Shepherd, is an effect arising from causal interactions between mind and body – specifically those interactions that give rise to our present stream of consciousness, our memories, and that can unite these two. Thus, the body plays a constitutive role in the formation of the self. The (...) upshot of this interpretation is that it can dissolve the problem of individuating mind that Boyle identifies. Briefly, the problem consists in Shepherd seemingly individuating minds in terms of their associated bodies and bodies in terms of the minds they are united with. My interpretation, however, allows to see that Shepherd neither wants nor needs to individuate the mind in isolation of the body and to read the passages, in which the problem seems to arise, as being about what makes living beings individual – with mind and body both playing a crucial role in this context. The soul is believed to be an immortal essence of living things in scores of philosophical and religious traditions but sparsely understood by science. The word ‘soul’ does not have a scientific definition but through this paper is hypothesized to be an indefinite, non-structured, massless energy made up of electromagnetic radiations that is confined in the cytoskeletal network of the biological cell. Electromagnetic radiations continually interact with the biological cell and propagate within the cell; by a pathway known as ‘Cell-Soul (...) Pathway’. This pathway is a coherent, imperceptible, uncontainable and recyclable support pathway, which uses this energy to promulgate consciousness in a biological cell. The cell-soul pathway augments with stress and ceases with death and results in, liberation of the energy as ultra-weak electromagnetic radiations that coalesce with the universe. Neste artigo analisamos o conceito de eu quantificado a partir na Perspectiva de Segunda Pessoa, segundo a qual a eu-dade, ou pessoalidade, é atualizada em relações contexto-dependentes de total ou parcial transparência cognitiva não redutíveis aos aspectos considerados nas perspectivas de primeira ou de terceira pessoa. O eu quantificado designa o indivíduo que realiza medições sobre si mesmo por meio de tecnologias ubíquas em rede para obter um suposto maior autoconhecimento, instanciando, segundo alguns autores, um ponto de vista de Quarta (...) Pessoa constituído por relações de alteridade (pessoa-máquina-pessoa) emergentes, em especial, em um cenário sociocultural permeado por tecnologias ubíquas e análises de big data. Procuraremos problematizar a tese de que o automonitoramento digital promoveria um aprofundamento do autoconhecimento, defendida pelos postuladores da quantificação do eu. Procuraremos mostrar que a coleta de dados sobre si mesmo por meio de tecnologias ubíquas não favorece necessariamente a constituição/atualização da pessoalidade porque o automonitoramento digital mediado pode interferir significativamente nos modos de interação social da Segunda Pessoa e no autoconhecimento que tal interação pode promover. In this paper, I present a new interpretation of Kant’s notion of consciousness of oneself as a Subject on behalf of a polemic with a recent reading suggested by Longuenesse. My central aim is to provide a systematic interpretation of Kant’s metaphysics of consciousness in general. I present and defend new interpretations for four capital Kant’s notions. First, I present a reading of Kant’s sensible intuition as a de re form of mental representation without conceptual content and any structure. It (...) makes the subject aware only in the limited sense of demonstratively representing what appears to him. In the sequence, I present a reading of empirical consciousness as the result of a first-order representation. The important introduction of §16 of the first Critique is construed here as expressing what is known today as the access consciousness. This book is conceived as an introductory text into the theory of syntactic and semantic information, and information flow.

In this paper, we present a case of a boy – Noah Wall, who till today surprises the world of neuroscience with his will to grow his brain and survive. The case presented in this study sets a stepping stone in understanding the advent of the will to make a choice, from a neuro-quantum mechanics interpretation. We propose that besides our internal states of choices (neurogenesis, neuroplasticity, cell differentiation, etc.) we also relate with external states of choices (love, compassion, empathy, (...) emotions, etc.) that contributes to its emergence. Quantum uncertainty seems to support the existence of a fundamental property based on which the universe functions; which means that even the nothing of free space has a small chance of containing something. Outcomes are not determined by prior or random events but by consciousness that gives rise to these outcomes. This provides us a lead into understanding the existence of the will and the origin of choice when we look deeper into the realms of the implausible interpretations of quantum mechanics. Free will is the ability for the mind to choose between possible outcomes. Willful power is therefore not only a psychological intervention but also a biological and quantum intervention, where we have the capacity to make choices about what direction we will take, making a change to the systematic functioning of our body. Este ensaio celebra as cinco décadas da publicação do livro A ordem do discurso de Michel Foucault, realizando uma reflexão acerca de sua repercussão entre as ciências sociais e sobre seus usos, principalmente, no campo da linguagem na parte relacionada à análise do discurso de linha francesa. Portanto, trata-se de uma retrospectiva crítica cuja análise começa com a entrevista que Foucault concedeu algumas semanas antes de proferir esta aula aos brasileiros Sergio Paulo Rouanet e José Guilherme Merquior. Em seguida, o (...) presente trabalho faz uma breve história da entrada de Foucault ao Collège de France e, por fim, lida com a microfísica do discurso que se encontra nesta aula, sobretudo, da rarefação do sujeito, além dos seus usos nas ciências humanas e sociais mais o campo da linguagem em torno da pragmática e das análises de discurso. Justice Across Ages offers an attractive account of justice between the young and the old that brings together three notable principles of age-group justice: complete-lives equality, relational equality, and prudence. Yet, the book says little about the fact that many of us live longer than others, and the little it does say casts doubt on whether lifespan inequality threatens justice as construed by the three principles. This essay argues, instead, that theories of justice between the young and the old should (...) not dispense with a conception of justice between different longevity groups. It concludes that we must be sensitive to lifespan variations when designing policies to promote justice across age groups. (shrink)

Este trabalho trata do conceito Exu Diaspórico, o qual foi forjado para lidar com as pesquisas empíricas situadas dentro do quadro teórico da vaga decolonial. Sua concepção está ligada às tradições iorubanas diaspóricas nessa parte do Atlântico Sul onde emergiram outros sistemas resultantes, quer seja de fragmentos e vestígios de narrativas em gestos de memória e resistência, quer seja da tradução realizada pelo outro, muitas vezes, por meio de um processo de carnavalização cultural, que, por sua vez, se deu pela (...) convivência com os bantu, com os povos autóctones e com o colonizador europeu. Este conceito se articula com o conceito de língua-linguagem como encruzilhada apresentado por Araújo (2021a), mas pode ser tomado, ainda, de forma independente. Portanto, trata-se de uma discussão conceitual que visa contribuir com as reflexões e pesquisas decoloniais. O conceito também está a cargo de noções como negritude e Baianidade. Contudo, ele aparece para reunir todas as representações de Exu que resultaram da diáspora negra em meio a um processo de carnavalização das tradições iorubanas em contato com outras culturas e cosmologias. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

It is my view that my soul is my consciousness and my consciousness is my soul. It appears that energy renders my consciousness to surge within me and my soul is a sphere of energy that encases me. Further, it appears that my soul dwell within me until my bodily death and my soul makes me conscious of my existence and all that exist around me. I feel my consciousness for it is my soul. Addressing the ‘how’ of my soul (...) may someday be possible but knowing the ‘why’ of my soul may stay a mystery for it is as mystifying as the supernatural. We may be able to introduce a soul within non-living beings by evoking consciousness artificially, but I am rather sure that these beings may never experience the soul or consciousness that I experience. On bodily death, my soul shall depart as an end to my conscious cycle for somewhere someone shall reap the energy and devise its consciousness, thus, its soul. (shrink)

Of all the risks we face in life, ranging from unemployment to old age, early death is among the most tragic and yet most neglected by modern states. Liberal egalitarians might find it easy to dismiss social insurance against early death, but I argue they should not. Early in this paper, I explain why social insurance should include the risk of premature death by replying to four common criticisms. What follows is a case for a novel form of insurance that (...) is more liberal and egalitarian across ages than the status quo. More specifically, I show that granting storable pensions in all life stages - youth, middle and old age - promotes liberty and reduces lifetime inequality. Writers on age group and longevity justice often overlook the extent to which liberal lifetime equality can supply insightful arguments against inequality across ages. These call for a policy that gives each age group the freedom to draw a storable pension. I call that policy "freetirement". (shrink)

Este trabalho reflete sobre o modo como nossos ancestrais negros resistiram à necropolítica colonial mobilizando saberes para recriar no Brasil outros espaços religiosos sob o nome de terreiros de candomblé. Mas o objetivo principal da discussão é tratar sobre as noções de sincretismo religioso, desconstruindo-a teoricamente conforme a decolonialidade aplica tal conceito derridiano. O termo necropolítica é usado aqui conforme Achille Mbembe o emprega. Como uma forma de contribuir com o debate em voga e, ao mesmo tempo, fazer o diagnóstico (...) do presente, a discussão se justifica também porque a questão do sincretismo religioso tem sido alvo de muitos questionamentos por parte dos movimentos negros e por parte dos teóricos da decolonialidade. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)
