Amartya Sen has made a major contribution to the theory of social justice, and of gender justice, by arguing that capabilities are the relevant space of comparison when justice-related issues are considered. This article supports Sen's idea, arguing that capabilities supply guidance superior to that of utility and resources (the view's familiar opponents), but also to that of the social contract tradition, and at least some accounts of human rights. But I argue that capabilities can help us to construct a (...) normative conception of social justice, with critical potential for gender issues, only if we specify a definite set of capabilities as the most important ones to protect. Sen's "perspective of freedom" is too vague. Some freedoms limit others; some freedoms are important, some trivial, some good, and some positively bad. Before the approach can offer a valuable normative gender perspective, we must make commitments about substance. (shrink)

Martha Nussbaum’s new book Political Emotions is a contribution to political philosophy and, simultaneously, a moral-psychological study of the emotions. In it, she revisits some of the most prominent themes in her 2004 book Hiding from Humanity and her 2001 treatise, Upheavals of Thought. As Nussbaum points out in the opening pages of Political Emotions, one of her goals in this work is to answer a call issued by John Rawls for a “reasonable moral psychology” that would (...) be conceptually refined and empirically grounded, since a complete theoretical account of the just society must be informed by a suitably complex, accurate conception of human emotions. On the whole, Political Emotions is a remarkably successful book that combines several areas of philosophical research in which the author’s proficiency is well known. It shows how problems that lie on the more intimate side of ethics, pertaining for instance to friendship and family life, have relevance for social justice and publi .. (shrink)

Martha Nussbaum has argued in support of the view (supposedly that of Aristotle) that we can, through thought-experiments involving personal identity, find an objective foundation for moral thought without having to appeal to any authority independent of morality. I compare the thought-experiment from Plato’s Philebus that she presents as an example to other thought-experiments involving identity in the literature and argue that this reveals a tension between the sources of authority which Nussbaum invokes for her thought-experiment. I (...) also argue that each of her sources of authority presents further difficulties for her project. Finally, I argue that it is not clear that her thought-experiment is one that actually involves identity in any crucial way. As a result, the case she offers does not offer any satisfactory support for her view on the relation between identity, morality and thought-experiments, but we do gain some insights into what that relation really is along the way. The paper addresses some of the aspects of the neo-Aristotelian concept of good on the basis of Martha Nussbaum’s capabilities approach. The author’s general thesis is that the idea of good organizes its normativity along two vectors pointed towards nature and emancipation, which are interlinked, that is — the normativity of the good is always organized by both of them and it is inappropriate to refer to one of them only. This fault is made, the author believes, by (...) Nussbaum who does not offer enough resources to establish a sound naturalistic evaluative standard in her theory. To address this issue the author starts by discussing the capabilities approach as a form of the concept of good and proceeds by analysing Nussbaum’s view on family as an exemplar of the inadequacies of the approach. There appears to be a tension between two commitments in liberalism. The first is that citizens, as rational agents possessing dignity, are owed a justification for principles of justice. The second is that members of society who do not meet the requirements of rational agency are owed justice. These notions conflict because the first commitment is often expressed through the device of the social contract, which seems to confine the scope of justice to rational agents. So, contractarianism seems to ignore (...) the justice claims of the severely cognitively impaired. To solve this problem, Martha Nussbaum proposes the capabilities approach. The justifiability condition, on this approach, is met by the idea of overlapping consensus. This essay argues that overlapping consensus cannot meet liberalism’s justifiability condition, nor is it more inclusive of the cognitively impaired. Therefore, we have reason to retain the contract device and look for another way to ensure that liberalism respects the justice claims of all. (shrink)

A revelação de Aristóteles mostrou como o seu pensamento ético, por ultrapassar o racionalismo filosófico, inaugura uma corrente de pensamento moral cuja modéstia é mais adequada à fragilidade da condição humana.

The practical aspect of ancient philosophy has been recently made a focus of renewed metaphilosophical investigation. After a brief presentation of three accounts of this kind developed by Martha Nussbaum, Pierre Hadot, and Michel Foucault, the model of the therapeutic argument developed by Nussbaum is called into question from the perspectives offered by her French colleagues, who emphasize spiritual exercise (Hadot) or the care of the self (Foucault). The ways in which the account of Nussbaum can (...) be defended are then discussed, including both a ‘negative’ defense, i.e. the indication of the weaknesses of Hadot and Foucault’s proposals, and a ‘positive’ one focused on the points in which Nussbaum can convincingly address doubts about her metaphilosophical account. In response to these analyses, some further remarks made by Hadot and Foucault are discussed in order to demonstrate that their accounts are not as distant from Nussbaum after all. Finally, a recent metaphilosophical study by John Sellars together with a therapeutic (medical) model developed by the author of the present article are suggested as providing a framework for potential reconciliation between all three accounts discussed and a resource for further metaphilosophical studies. An assessment of Martha Nussbaum's capabilities approach with respect to religion. I contend that her contribution to John Rawls's project of political-liberalism would be less accommodating of religion, specifically illiberal religions, than it desires to be. This feature weakens the capabilities approach as a foundation for inclusive and stable political institutions in pluralistic societies.

Nussbaum’s theory of the emotions draws heavily on the Stoic account. In her theory, emotions are a kind of value judgment or thought. This is in stark contrast to the well-known proposal from William James, who took emotions to be bodily feelings. There are various motivations for taking emotions as judgments. One main reason is that emotions are intentional mental states. They are always about something, directed at particular objects or state of affairs. For example, fear seems to involve (...) the anticipation of danger. To grief for the passing of a loved one involves the thought that someone dear to us is now gone. In Upheavals of Thought and also in her Hochelaga Lecture, Nussbaum analyzed compassion as a set of judgments, including for example the judgment that someone is experiencing serious suffering, and that the person in question does not deserve the suffering. Contemporary moral theorists are increasingly attentive to the ways human beings actually make sense of their moral experience and compose meaningful lives. Martha Nussbaum's re-introduction of Aristotelian practical wisdom and Alasdair MacIntyre's emphasis on narrativity are good examples of a shift in focus away from tedious polemics about the single "right thing to do" in a situation. But recent theorists have tended to lack a highly articulated philosophical framework--especially a full-blooded theory of moral belief and deliberation--that would enable (...) us better to wend our way along the trails they have blazed. We are born, MacIntyre proclaims, with a social past, a tradition into which we grow. Yet MacIntyre advances a new moral vision independent of recent philosophical traditions that might accommodate and direct his own insights and inquiries. Classical American pragmatism, especially as developed by John Dewey, provides a framework that can clarify and extend the achievements of contemporary moral theory. I contend that a thoroughgoing reconstruction of our moral vision would profit immensely from looking back to Dewey's theory of moral understanding. I propose here to articulate the center of vision of this theory by developing a Deweyan conception of deliberation as imaginative dramatic rehearsal. (shrink)

Cet article constitue une analyse détaillée de la réponse de Nussbaum à ces enjeux, qui prétend unir un pluralisme axiologique à un universalisme moral fort. Nous avancerons que la démarche entreprise par la philosophe porte une tension entre le libéralisme politique rawlsien et le cadre conceptuel apporté par la liste (...) des capabilités. Cette liste pose une difficulté par le déficit démocratique de ses fondements, n’intégrant pas suffisamment des normes d’inclusion et de représentation. The concept of dignity plays a foundational role in the more recent versions of Martha Nussbaum’s capabilities theory. However, despite its centrality to her theory, Nussbaum’s conception of dignity remains under-theorised. In this paper we critically examine the role that dignity plays in Nussbaum’s theory by, first, developing an account of the concept of dignity and introducing a distinction between two types of dignity, status dignity and achievement dignity. Next, drawing on this account, we analyse (...) class='Hi'>Nussbaum’s conception of dignity and contrast it with Kant’s conception of dignity. On the basis of this comparison between Nussbaum and Kant, we highlight tensions between Nussbaum’s Aristotelianism, which is central to her conception of dignity, and her commitment to political liberalism. This leads us to conclude that Nussbaum’s claim that her conception of dignity is only a partial political conception is implausible and that her conception of dignity seems to commit her to a satisficing form of perfectionist liberalism. Despite the initial strangeness of grouping Iris Murdoch (a Platonist), Martha Nussbaum (an Aristotelian), and Richard Rorty (a pragmatist) together, this paper will argue that these thinkers share a strong commitment to the moral purport of literature. I will also show that their shared idea of moral engagement through literature interlocks the individual’s sense of self and the world of others. After considering their accounts, I will conclude by raising the question of literature’s moral limits.

In A Theory of Justice, John Rawls discusses “the problem of envy”, namely the worry that the well-ordered society could be destabilized by envy. Martha Nussbaum has proposed, in Political Emotions: Why Love Matters for Justice, that love, in particular what she calls civic friendship, is the solution to this problem. Nussbaum’s suggestion is in accordance with the long-standing notion that love and envy are incompatible opposites, and that the virtue of love is an antidote to the (...) vice of envy. I argue that this idea is misguided, and that love and envy are opposite sides of the same coin: what Kant called “unsociable sociability”. Love and envy arise from the same psychological mechanisms and thrive in the same social and personal conditions; thus, it’s not possible to have one without the other. This paper argues that the future of capabilities approach lies on the theoretical development of the democratic political structure. For this purpose, we take into account Martha Nussbaum’s late theoretical works. Firstly, we argue that the capability approach can be divided into two main models: the top down and the bottom up. Nussbaum, for example, endorses a top-down model, which it begins from an abstractive theory of partial justice and then draws the issue of institutional implementation. On (...) the other hand, Amartya Sem advocates the bottom-up model, which starts from the immanent demands of justice from public sphere and then up to normative and abstract questions (like his “idea of justice”). In the second part of this paper, we present Nussbaum’s partial theory of justice, arguing that it is mainly composed by four issues: (a) the elaboration of the list of capabilities, (b) the process of normative evaluation, (c) arguments for stability, (d) the implementation of the model. About this last topic, we argue in the third part that the current theoretical advance of the capabilities approach lies on the issue of the democratic political structure. In other words, the future of capabilities approach depends on the interaction between its own theory and a theory of democracy. Finally, in the last section we provide a re-elaboration of Nussbaum’s threshold level of capabilities (the list) in order to make it more adherent with the democratic political structure. (shrink)

Starting from Hellenistic philosophy, this paper highlights the importance of the emotions for treatment of social evils on a path that links John Dewey to Martha Nussbaum. The main issue is how to treat those evils without excluding the individual from the society. Following the medical analogy as central idea, it is made visible that effective therapy must include, both theoretically and practically, the Deweyan notion of integration between individual and environment. Starting with this idea, both Nussbaum (...) and Dewey claim that a sound emotional development is a fundamental factor to treat social evils, and at the same time to fulfil the “human flourishing” of individuals embedded in their society. In this chapter I discuss the relation between imaginative perception and moral creativity. I focus on three authors that have explained moral imagination as imaginative perception. Iris Murdoch, Martha Nussbaum, and Cora Diamond have all argued how we use imagination to transform our perspective of moral situations. However, their central examples demonstrate the importance of morally inventive action as well. I argue that this reveals another mode of moral imagination: moral creativity. While a creative process might build on (...) imaginative perception, moral creativity includes inventive responses to moral problems that are not necessarily given by seeing the world in another way. Discussions concerning whether there is a natural right to health care may occur in various forms, resulting in policy recommendations for how to implement any such right in a given society. But health care policies may be judged by international standards including the UN Universal Declaration of Human Rights. The rights enumerated in the UDHR are grounded in traditions of moral theory, a philosophical analysis of which is necessary in order to adjudicate the value of specific policies designed to enshrine (...) rights such as a right to health care. We begin with an overview of the drafting of the UDHR and highlight the primary influence of natural law theory in validating the rights contained therein. We then provide an explication of natural law theory by reference to the writings of Thomas Aquinas, as well as elucidate the complementary “capabilities approach” of Martha Nussbaum. We conclude that a right to health care ought to be guaranteed by the state. (shrink)

Since then, prominent contemporary philosophers including Charles Taylor and Martha Nussbaum have declared negative liberty insufficient or incoherent. This is a critique of those declarations, which have been unduly accepted to a large extent. The critique primarily focuses on Taylor, who made the most direct and complete argument against negative liberty. His argument is shown to be ineffective. What grounds human rights? How do we determine that something is a genuine human right? This chapter offers a new answer: human beings have human rights to the fundamental conditions for pursuing a good life. The fundamental conditions for pursuing a good life are certain goods, capacities, and options that human beings qua human beings need whatever else they qua individuals might need in order to pursue a characteristically good human life. This chapter explains how this Fundamental Conditions Approach is (...) better than James Griffin’s Agency Approach as well as Martha Nussbaum’s Central Capabilities Approach. It also shows how it can be compatible with the increasingly popular Political Conceptions of human rights defended by John Rawls, Charles Beitz, and Joseph Raz. (shrink)

In order to articulate an account of erotic love that does not attempt to transcend its personal features, Robert Solomon and Martha Nussbaum lean on the speeches by Aristophanes and Alcibiades in Plato’s Symposium. This leads them to downplay the sense in which love is not only for another person, but also for the good. Drawing on a distinction between relative and absolute senses of speaking about the good, I mediate between two features of love that at first (...) may seem irreconcilable. The first is the sense in which love is deeply personal in character. The second is the sense in which we in love come to articulate ethical demands. With the help of the Diotimian ascent of love that Socrates presents in his speech, I submit that these two can come together in the realization that our personally conditioned responses in love are transformed to accommodate demands that carry an unconditional meaning. I question whether the case for “literary cognitivism” has generally been successfully made. As it is usually construed, the thesis is easy to satisfy illegitimately because dependence on fictionality is not built in as a requirement. The thesis of literary cognitivism should say: “literary fiction can be a source of knowledge in a way that depends crucially on its being fictional” (Green’s phrasing). After questioning whether nonpropositional cognitivist views (e.g., Nussbaum’s) meet this neglected standard, I argue that if fictional (...) narratives can impart propositional knowledge in virtue of their fictionality, it would be largely via a suppositional framework. Yet in many cases, such as Huxley’s Brave New World, the key literary supposition could simply be an epistemic possibility (‘suppose X, which for all we know, occurs sometime’), not counterfactual supposition, that is, distinctively fictional supposition. The best general case for literary cognitivism may be the limited one that literary fiction can alert us to nonactual metaphysical possibilities that may be important for understanding actuality. Yet even here, seemingly possible fictions are often impossible. (shrink)

Las últimas cuatro décadas de pensamiento feminista y del género han estado profundamente marcadas por el debate multidisciplinar en torno a la que puede considerarse su categoría central, la de “mujer”. El presente trabajo vierte sobre el debate feminista en torno a dicha categoría algunos de los retos fundamentales que plantea una reflexión sobre la pluralidad y la diversidad culturales desde una perspectiva antropológica o culturalista, esto es, preocupada por cómo la cultura puede influir y modificar tanto a los individuos (...) que la componen como a sus productos culturales a nivel epistemológico, moral e incluso ontológico. Traeremos a colación los principales temas ligados al feminismo en el seno de la Antropología con vistas a hacernos una idea del proceder típico de una aproximación fijada en la cultura como factor crucial para una reflexión sobre el alcance de las categorías y conceptos humanos y de las principales tesis sostenidas respecto a la posibilidad de una “esencia femenina” objetiva y universal. Asimismo, con vistas a elaborar un estado de la cuestión en el ámbito de la Filosofía feminista, nos ocuparemos de un crucial debate entre dos de las autoras más relevantes en el ámbito del feminismo académico actual, Judith Butler y Martha C. Nussbaum, acerca del carácter ontológico y social de la mujer. Ambas autoras difieren tanto en su concepción de la mujer como en la correspondiente proyección del feminismo a nivel global, Butler desde una aproximación crítica y antiesencialista y Nussbaum desde una propuesta fundamentada en un esencialismo basado en el llamado “enfoque de las capacidades”. El debate entre ambas autoras será examinado críticamente desde nuestra propuesta culturalista. Advertiremos que el debate feminista en torno al esencialismo se ve sustancialmente enriquecido y transformado desde una aproximación de esta índole, pues la pluralidad y la diversidad culturales estudiadas en disciplinas como la Antropología social y cultural o la Sociología presentan dificultades a la intención de constituir un feminismo único de alcance universal. Por último, exploraremos la posibilidad de encuentro entre el relativismo cultural y el feminismo, lo que nos conducirá a afirmar la necesidad de reconsiderar los términos en los que ha sido tradicionalmente definido el relativismo cultural. In his article Banicki proposes a universal model for all forms of philosophical therapy. He is guided by works of Martha Nussbaum, who in turn makes recourse to Aristotle. As compared to Nussbaum’s approach, Banicki’s model is more medical and less based on ethical argument. He mentions Foucault’s vision to apply the same theoretical analysis for the ailments of the body and the soul and to use the same kind of approach in treating and curing them. In (...) his interpretation of philosophical therapy, there are, however, some controversial issues, to which we would like to call attention: -/- Is restoring health by a philosophical method of treatment – health understood as a person’s ability to reach his/her vital goals – a convincing explication of philosophical therapy in general? In order to answer this question, it may be useful to look at Plato. It is not only Platonism (and especially Neo-platonism since Plotinus) that questions the idea that therapy is necessarily connected with „vital goals“. Buddhist and Gnostic philosophies are questioning „the vital“ in general. The immense effort in the history of philosophy to liberate the mind from the body casts doubt on the project to explain philosophical therapy solely in analogy to medical therapy. -/- According to Banicki a therapeutic philosophy has to identify the diseases it attempts at curing. There are, however, reasons for associating the term therapy with suffering/risk rather than disease. If a therapy aims at reducing the fear of death, as for example many classical philosophical therapies do, then there is no disease to be cured. A model based on chances and risks also has the advantage that the Buddhist and Stoic reinterpretation of desires/emotions as “diseases” can be dropped in contemporary philosophical therapy. -/- Banicki mentions the comparison of therapies as one of the primary goals of modelling. Methods should be verified by a statistical correlation between method and therapeutic success and/or by a theory which justifies the method. Some forms of therapies, however, avoid theory-specific terms and concepts in favor of an unprejudiced interpretation of the patient’s statements. Others share the (Nietzschean) aspiration to explore and change measures of value. If the therapeutic process is seen as a unique phenomenon, then there can be no theory and no statistics with co-occurrences. -/- According to Banicki philosophical therapy has to describe techniques which qualify as genuinely philosophical. Techniques like maieutics and hermeneutics, however, are antique philosophical “inventions”, which were later adopted by psychotherapy. If meditation is accepted as a therapeutic tool – as it was in ancient times – then there is not only a methodical but also an emotional relation to religion. If finally, the Socratic search for a good life is seen as one of the characteristics of philosophical therapy, then delimitation even turns into a criterion for non-philosophical therapies. The search for a good life requires an interdisciplinary approach. -/- For the concretization of the formal structure, we suggest a typology of therapies, which is based on chances and risks. Such a typology has the advantage, that it can model conflicting (and even opposing) forms of therapies. The variety of therapeutic goals and methods is a consequence of the historical development towards conceptual freedom. (shrink)

This review brings to the fore the Indian philosopher Kalidas Bhattacharyya. It makes a case for Indian and Asian Studies' scholars to take up the study of Bhattacharya so that his corpus can be used to construct a clear hermeneutic for assessing and accessing Indian texts, say in English and also other English literary texts. Bhattacharyya has been neglected too long by the world.

Book Review of The Cosmopolitan Tradition: A Noble but Flawed Ideal. By Nussbaum Martha C..

This paper offers a critique of Martha Nussbaum’s description of the capability approach, and offers an alternative. I will argue that Nussbaum’s characterization of the capability approach is flawed, in two ways. First, she unduly limits the capability to two strands of work, thereby ignoring important other capabilitarian scholarship. Second, she argues that there are five essential elements that all capability theories meet; yet upon closer analysis three of them are not really essential to the capability approach. (...) I also offer an alternative description of the capability approach, which is called the cartwheel view of the capability approach. This view is at the same time radically multidisciplinary yet also contains a foundationally robust core among its various usages, and is therefore much better able to make the case that the capability approach can be developed in a very wide range of more specific normative theories. Finally, the cartwheel view is used to argue against Nussbaum's claim that all capabilitarian political theory needs to be politically liberal. (shrink)

In this paper, I will draw on the capabilities approach to social justice and human development as advanced, among others, by Martha Nussbaum, and seek to provide some theoretical resources for better understanding our obligations to future persons. My argumentative strategy is as follows: First, I’ll briefly reconstruct a capabilities approach to justice, examining this sort of view’s normative foundations and methodology. Using Nussbaum’s capabilities list as a basis, I will argue that various social and environmental functions (...) which are threatened by climate change are crucial with respect to enabling morally and politically central capabilities for both current and future people. Here, I will draw on recent work by Breena Holland to establish the notion of a sustainable climate system as a necessary precondition for the enablement and protection of these entitlements. Then, I’ll extend this strategy to argue that the capabilities approach provides a uniquely useful threshold conception of harm to inform our thinking about our relationship to our posterity. It is my hope that the capabilities approach so applied can give us a novel way of understanding our responsibilities toward future people in a time where such an understanding is both unfortunately lacking and increasingly dire. Finally, I will discuss some implications of a capability-based account in the intergenerational context and some justifications for applying the approach in this way. Ultimately, I submit that this sort of view seems more well-fitted to this context than other approaches (e.g., contractarianism and consequentialism), and that it offers a unique vehicle for understanding our relations and obligations to future people. Martha Nussbaum argues that animals are entitled to a flourishing life according to the norm for their species. Nussbaum furthermore suggests that in the case of dogs, breed norms as well as species norms are relevant. Her theses capture both common intuitions among laypeople according to which there is something wrong with the breeding of “unnatural” animals, or animals that are too different from their wild ancestors, and the dog enthusiast’s belief that dogs departing from the norms (...) for their breed are tragic. I argue that the high diversity of the dog species and the ultimate arbitrariness of breed norms support the thesis that a conception of welfare must be tied to what the individual requires in order to flourish. In the second part of the paper, I discuss the implications that an individualized welfare conception has for the breeding of dogs for conformation shows, for the pet market and for the performance of various tasks for which we need working dogs. This presentation explores the historical and ongoing relationship between Pierre Hadot's concept of philosophy as a way of life (PWL) and modern psychotherapy. Hadot noted that many ancient philosophical schools, such as the Epicureans, Skeptics, and Stoics, viewed philosophy as “the art of living,” focusing on practical exercises to transform one’s way of being. Scholars like Martha Nussbaum and Michel Foucault have also highlighted ancient philosophy’s therapeutic practices, known as "therapeia tēs psuchēs," or “cure of the soul.” For (...) the purpose of this presentation, I will primarily focus on Hadot’s (1995, 2002) view of ancient philosophy being a PWL and its therapeutic agenda, as well as Martha Nussbaum’s (1994) argument, presented in her book "The Therapy of Desire: Theory and Practice in Hellenistic Ethics," that ancient philosophy principally constitutes a form of therapy, as well as the position offered by Michel Foucault (1988), who suggested that we ought conceptualize Socrates along with Hellenistic and Roman thought in the context of self-care or ‘care of the self.’ This presentation is divided into three parts. After the introduction, the second part examines Hadot’s notion of ‘spiritual exercises.’ The third part surveys the view of philosophy as a distinct form of therapy or "therapeia," as a thread that runs through ancient, classical and modern philosophy (the aim is not to be comprehensive but merely to highlight the continuity). The conclusion, and final part, explores how the meta-philosophy of PWL, when applied as a meta-therapeutic and a meta-paradigmatic framework, can inform contemporary psychotherapy, as part of an interdisciplinary approach, which as I will suggest may be beneficial to both the emerging field of PWL and psychotherapy theory and practice—in addressing perennial issues of human suffering and how to live the good life. How did the Stoics conceive of a polis and statehood? What happens when these ideas meet different biographies and changing historical environments? To answer these questions, 'The Stoics and the State' combines close philological reading of original source texts and fine-grained conceptual analysis with wide-ranging contextualisation, which is both thematic and diachronic. A systematic account elucidates extant definitions, aspects of statehood (territory, institutions, population and state objectives) and the constitutive function of the common law. The book’s diachronic part investigates how (...) Stoics from Zeno to Marcus Aurelius used their theory of the state to assess particular states, explain the origin of political communities and shape their own political practice. A glimpse at modern adaptations from Justus Lipsius to Martha C. Nussbaum explains the peculiarities of Stoic notions and their basis in a conception of human nature as not only political but essentially sociable and beneficent. (shrink)

This essay argues that trans philosophy - and perhaps philosophy more broadly - should be understood according to the interplay of social, material, and emotional circulations. It opens by bridging insights from underemployed library work during the COVID-19 pandemic with Sara Ahmed’s analysis of the circulation of emotions in relation to texts and archives. The first major section diagnoses Martha Nussbaum’s confusing analysis of “the new trans scholarship” to establish that trans philosophy is differentially circulated across the discipline (...) of philosophy. The second major section argues that trans philosophy can be understood through the interplay of four different circulations: (1) trans philosophy as creating a space; (2) trans philosophy as the trans question; (3) trans philosophy as the gender wars; and (4) trans philosophy as the trans cult. I conclude that trans philosophy is a field that has yet to clearly form as it continues to twist and multiply according to affect, professional dynamics, political intrigue, who gets thrown away, and who is granted the space, time, energy, and money to write and publish. Na primeira, será apresentada a teoria das injustiças epistêmicas de Miranda Fricker, explicando a injustiça testemunhal e a injustiça hermenêutica. Em seguida, na segunda seção, será feita uma breve exposição da conceitualização que Martha Nussbaum oferece a respeito da objetificação. I argue that John Dewey’s analysis of imagination enables an account of learning from imaginary cases consistent with Jonathan Dancy’s moral particularism. Moreover, this account provides a more robust account of learning from cases than Dancy’s own. Particularism is the position that there are no, or at most few, true moral principles, and that competent reasoning and judgment do not require them. On a particularist framework, one cannot infer from an imaginary case that because a feature has a particular moral (...) importance there, that it must have that import in an actual case. Instead, for Dancy, cases can yield “reminders,” and a person with a lot of experience (real or imagined) brings a “checklist” of features that can matter to a situation. Using the Nathan-David exchange from 2 Samuel and Martha Nussbaum’s “Steerforth’s Arm” from Love’s Knowledge, I show that this account does not explain all instances of learning from cases. Drawing on recent work on cases, I argue that cases can be educative by serving an exploratory function, probing what one takes to be known and provoking change in the background one uses in evaluating a situation. I then argue that Dewey’s work on imagination in his comments on sympathy and in A Common Faith and Art as Experience enables such a role for cases on a particularist framework. Mark Johnson’s recent work on metaphor further illuminates how Dewey’s account of art can be exploratory. I contend that this account affords an exploratory role for cases consistent with Dancy’s particularism. (shrink)

This dissertation examines the idea of _ethical revaluation_ — taking things we normally see as good for our flourishing and seeing them as neutral or bad, and vice versa — in the Mahāyāna Buddhist thinker Śāntideva. It shows how Śāntideva’s thought on the matter is more coherent than it might otherwise appear, first by examining the consistency of Śāntideva’s own claims and then by applying them to contemporary ethical thought. In so doing, it makes four significant contributions. Śāntideva claims that (...) property and relationships are bad for us because they promote attachment, and that others’ wrongdoing is good for us because it allows us to generate patient endurance. Yet he also urges his readers to give property to others, and to prevent their wrongdoing. Is he caught in contradiction? The dissertation argues that he is not, because giving to others is not intended to benefit them materially, but rather to produce beneficial mental states in them, and preventing wrongdoing is intended to benefit the wrongdoer and not the victim. In both cases, Śāntideva emphasizes individual action in a way that makes social or political action more difficult to justify. The dissertation’s first contribution is to show how this interpretation of Śāntideva contrasts notably with standard presentations of Mahāyāna ethics. Its second contribution is to refute claims that Buddhists have no normative ethics. Śāntideva’s resolutions of these apparent contradictions also have relevance for contemporary ethical thought. Martha Nussbaum argues against an ethical revaluation similar to Śāntideva’s, on the grounds that such a revaluation makes it contradictory to argue for providing goods to others, preventing others’ wrongdoing or engaging in political action. Śāntideva’s views show that ethical revaluation is a more sustainable position than these criticisms of Nussbaum’s would imply; if it is to be rejected, it must be rejected on other grounds. To show this point is the dissertation’s third contribution. The fourth contribution is methodological; by finding similarities of concern and differences of opinion between Śāntideva and a contemporary thinker, it helps bridge the gap between normative and comparative religious ethics. There are striking parallels between current capability theories and the moral philosophy of Karl Christian Friedrich Krause. This article reconstructs central arguments of Krause’s ethics and correlates them with passages from the works of Martha Nussbaum, showing that such similarities extend not only to what, substantially, is being professed in either philosophy but also, procedurally, to the question of how the respective moral conclusions are reached. As Krause correlates responsibility with capability, the article begins with an examination of (...) Krause’s idea of human — as compared to animal — freedom and their respective normative implications. Next, the argument is extended to the social responsibilities of personal freedom, before widening the scope to the cosmopolitan plane. Martha Nussbaum has provided a sustained critique of Cicero’s De officiis (or On Duties), concerning what she claims is Cicero’s incoherent distinction between duties of justice, which are strict, cosmopolitan, and impartial, and duties of material aid, which are elastic, weighted towards those who are near and dear, and partial. No doubt, from Nussbaum’s cosmopolitan perspective, Cicero’s distinction between justice and beneficence seems problematic and lies at the root of modern moral failures to conceptualize adequately our obligations (...) in situations of famine and global inequality. And yet a careful reading of Cicero’s On Duties shows many duties that appear to be partial. It is hard to believe that Cicero’s discussion of these “partial duties” was a mere oversight or omission on his part. Rather, Cicero seemed to have no problem endorsing what I will call the “partial coherence” of duties in the work—namely, the claim that asserting that duties are exhaustively partial or impartial is a false dichotomy. With the help of conceptual analysis by Richard Kraut, my paper aims to establish and defend Cicero’s “partial coherence” against Nussbaum’s criticisms. (shrink)

Unlike his theory of justice as fairness, John Rawls’s political liberalism has generally been spared from critiques regarding what is due to the disabled. This paper demonstrates that, due to the account of the basic ideas of society and persons provided by Rawls, political liberalism requires that the interests of numerous individuals with disabilities should be put aside when the most fundamental issues of justice are settled. The aim is to accommodate within public reason the due concern for the disabled (...) while upholding political liberalism. To achieve this aim, a revision of the basic ideas of persons and society is proposed. The idea of persons should be regarded as more fundamental than that of social cooperation, and persons should be defined in terms of minimal moral powers. (shrink)

This chapter examines the relation of the Human Development or Capability Approach to liberal political theory. If development is enhancement of capabilities, then this chapter adds that development is human and social: development includes (1) the creation of value as a social process that is (2) a dialectical product of people in their relations. Specifically: (1) The place of the individual within political theory must be revised if the political subject is, as Carol Gould argues, an “individual-in-relations” rather than an (...) autonomous individual agent. (2) New possibilities for valuation are also relational: value is created dialectically along with those possibilities through processes that may be modeled on Denis Goulet’s account of dialectical recognition. These axiological claims hold importance for the place of democratic participation in just politics and development. Building upon David Crocker’s work, this chapter argues that just politics may require a participative approach that is undercut by Martha Nussbaum’s suggestion that a list of central capabilities should guide the drafting of national constitutions. The assimilation of the indigenous concept sumak kawsay to the ideal of buen vivir within Ecuador’s constitution is illustrative, suggesting that prior specification (a list) may limit and distort the dialectical generation of new capabilities. This paper defends a new, role-differentiated account of the virtues of compassion. My main thesis is that in order to understand compassion’s value and advance debate about its ethical importance we need to recognize that the virtue of compassion involves substantively different dispositions and attitudes in different spheres of life – for example in our personal, professional, and civic lives. In each sphere, compassion is an apt and distinctive form of good-willed responsiveness to the value of living beings and their (...) characteristic struggles to live good lives, but the relevant forms of good-willed responsiveness vary because in different contexts there are different types of living beings involved and different relations between the compassionate person and the being to whom she is compassionate. My specific focus is on compassion in human relations; I argue that, in different role and relationship contexts, the virtues of compassion involve different forms of good-willed responsiveness to human struggles to live well. In developing my account I critically engage with the emotion-focused accounts defended by Martha Nussbaum and Roger Crisp and explain how my more plausible account can shed light on the nature and value of compassion for oneself. Over the course of the Twilight series, Bella strives to and eventually succeeds in convincing Edward to turn her into a vampire. Her stated reason for this is that it will allow her to be with Edward forever. In this essay, I consider whether this type of immortality is something that would be good for Bella, or indeed for any of us. I begin by suggesting that Bella's own viewpoint is consonant with that of Leo Tolstoy, who contends that one (...) could not have meaningful life without immortality, because only immortality could allow one to make a permanent difference in the world. I argue that this characterization of a meaningful life is problematic, however, insofar as (1) immortality is neither sufficient nor necessary for having such an impact and (2) there is little reason to think that having such an impact is constitutive of a meaningful life. I go on to consider Edward's fear that vampires lack a soul as it relates to Martha Nussbaum's claim that immortal beings would be less capable of certain paradigmatic human values and virtues such as courage, love, or self-sacrifice. I suggest, contra Nussbaum, that Carlisle provides an example of an immortal who displays recognizably human virtues. However, the possibility of Carlisle's being virtuous in this way depends on the existence of other creatures who are mortal. -/- I close by considering the problem of boredom, as articulated by Bernard Williams. According to Williams, a meaningful human life is constituted by certain categorical desires such as the desire to raise children or to create art. The projects aimed at accomplishing these desires are necessarily finite in length, and cannot be repeated indefinitely without losing their value. I argue that many, though perhaps not all, of the immortals described in the series suffer from such boredom. For example, Edward and Rosalie struggle to find meaning in their lives and most werewolves choose to age and die normally after a certain time. Perhaps more significantly, many of the non-"vegetarian" vampires seem to have become entirely divorced from any recognizably human projects or values, and have become focused entirely on satisfying their immediate desires. These examples provide some reason to think that many of Bella's reasons for living, which are essentially tied to her mortality, are not likely to be met by becoming immortal. While this does not show that her choice to become a vampire will leave her ultimately unhappy, it does suggest that her doing so represents a considerable sacrifice. (shrink)

This is a Belarusian translation of an essay interpreting the much-neglected Second Part of Kant's book, Conflict of the Faculties, entitled “An old question raised again: Is the human race constantly progressing?”, by showing the close relationship between the themes it deals with and those Kant addresses in the Supplements and Appendices of Perpetual Peace. In both works, Kant portrays the philosopher as having the duty to promote a “secret article”, without which his vision of a lasting international peace through (...) the agency of a federation of states is bound to fail. Both works identify this article as involving the necessity of publicity as a transcendental condition for peace, and call for philosophers to engage politicians and lawyers in a creative attitude towards lawmaking. Kant’s visionary program has failed to reach its goal up to now, not because it is too idealistic, but because philosophers have failed to take up the challenge. (shrink)

The study investigated the management of students’ academic failure among secondary school students for high productivity in Obingwa Local Government Area of Abia State. The study was guided by two research questions and two hypotheses. Descriptive survey research design was used while the population of the study comprised thirty public secondary schools. A sample size of 10 secondary schools was selected from the 30 public secondary schools using stratified random sampling technique. Self-designed instrument entitled “Management Students’ Academic Failure Questionnaire” (MSAFQ) (...) was utilized. The validity of the instrument was ensured. Test retest method was used and reliability co-efficient of 0.80 and 0.83 was obtained through Cronbach Alpha Statistics. Mean was used to answer the research questions while Z-test statistics was used to test the hypotheses at 0.05 level of significant. The findings include but not limited to: lack of instructional material and inability of the teachers to stimulate students are causes of academic failures among students. It is therefore recommended that the government or appropriate agency should ensure adequate supply of functional instructional resources and teachers’ should do well to motivate students to learn thereby save students from incessant failures that could mar their future and life expectations.
