According to the thesis of the guise of the normative, all desires are associated with normative appearances or judgments. But guise of the normative theories differ sharply over the content of the normative representation, with the two main versions being the guise of reasons and the guise of the good. Chapter 6 defends the comparative thesis that the guise of reasons thesis is more promising than the guise of the good. The central idea is that observations from the theory of (...) content determination can be used in order to constrain possible theories of the representational contents associated with desire. The authors argue that the initially most promising versions of the guise of the good fail to meet these constraints, and then explain the steep challenge confronting any who wish to craft a new guise of the good theory which meets the constraints while also preserving the initial motivations for adopting any guise of the normative theory at all. But a simple version of the guise of reasons not only avoids the troubles besetting the guise of the good but proceeds immediately from a deep diagnosis of the source of its difficulties. (shrink)

This paper asks whether there is a moral virtue of hope, and if so, what it is. The enterprise is motivated by a historical asymmetry, namely that while Christian thinkers have long classed hope as a theological virtue, it has not traditionally been classed as a moral one. But this is puzzling, for hoping well is not confined to the sphere of religion; and consequently we might expect that if the theological virtue is structurally sound, there will be a secular, (...) moral analogue. This paper proposes that there is such an analogue, and that it is closely linked to the everyday notion of “having your priorities straight,” a phenomenon which is naturally understood in terms of the attitude of hope. It turns out that the priorities model provides an abstract way of characterizing a central but underexplored virtue, one which can be developed in secular or theological ways. (shrink)

The ‘Big 3’ theories of well-being—hedonism, desire-satisfactionism, and objective list theory—attempt to explain why certain things are good for people by appealing to prudentially good-making properties. But they don’t attempt to explain why the properties they advert to make something good for a person. Perfectionism, the view that well-being consists in nature-fulfilment, is often considered a competitor to these views (or else a version of the objective list theory). However, I argue that perfectionism is best understood as explaining why certain (...) properties are prudentially good-making. This version of perfectionism is compatible with each of the Big 3, and, I argue, quite attractive. (shrink)

An analogue of Arrow’s theorem has been thought to limit the possibilities for multi-criterial theory choice. Here, an example drawn from Toy Science, a model of theories and choice criteria, suggests that it does not. Arrow’s assumption that domains are unrestricted is inappropriate in connection with theory choice in Toy Science. There are, however, variants of Arrow’s theorem that do not require an unrestricted domain. They require instead that domains are, in a technical sense, ‘rich’. Since there are rich domains (...) in Toy Science, such theorems do constrain theory choice to some extent—certainly in the model and perhaps also in real science. (shrink)

The Growing Block Theory of time says that the metaphysical openness of the future should be understood in terms of there not being any future objects or events. But in a series of works, Ross Cameron, Elizabeth Barnes, and Robbie Williams have developed a competing view that understands metaphysical openness in terms of it being indeterminate whether there exist future objects or events. I argue that the three reasons they give for preferring their account are not compelling. And since the (...) notion of “indeterminate existence” suffers conceptual problems, the Growing Block is the preferable view. (shrink)

John D. Norton is responsible for a number of influential views in contemporary philosophy of science. This paper will discuss two of them. The material theory of induction claims that inductive arguments are ultimately justified by their material features, not their formal features. Thus, while a deductive argument can be valid irrespective of the content of the propositions that make up the argument, an inductive argument about, say, apples, will be justified (or not) depending on facts about apples. The argument (...) view of thought experiments claims that thought experiments are arguments, and that they function epistemically however arguments do. These two views have generated a great deal of discussion, although there hasn’t been much written about their combination. I argue that despite some interesting harmonies, there is a serious tension between them. I consider several options for easing this tension, before suggesting a set of changes to the argument view that I take to be consistent with Norton’s fundamental philosophical commitments, and which retain what seems intuitively correct about the argument view. These changes require that we move away from a unitary epistemology of thought experiments and towards a more pluralist position. (shrink)

Awareness and concern about climate change are widespread. But rates of pro-environmental behaviour are low. This is partly due to the way in which pro-environmental behaviour is framed—as a sacrifice or burden that individuals bear for the planet and future generations. This framing elicits well-known cognitive biases, discouraging what we should be encouraging. We should abandon the self-sacrifice framing, and instead frame pro-environmental behaviour as intrinsically desirable. There is a large body of evidence that, around the world, people who are (...) living more environmentally lifestyles are happier than those not doing so. This is the message we should be spreading. This chapter explores an unappreciated psychological dimension of intellectual humility. In particular, I argue there is a plausible connection between intellectual humility and epistemic egocentrism. Epistemic egocentrism is a well-known cognitive bias – often called ‘the curse of knowledge’ – whereby an agent attributes his or her own mental states to other people. I hypothesize that an individual who exhibits this bias is more likely to possess a variety of traits that are characteristic of intellectual humility. This is surprising because (...) intellectual humility is often regarded as an antidote to cognitive biases, whereas I claim that a particular cognitive bias (namely, the curse of knowledge) may help foster an intellectual virtue. I argue that in purely professional games of pure chance, such as slot machines, roulette, baccarat or pachinko, any instance of cheating that successfully deceives the judge can be ‘part of the game’. I examine, and reject, various proposals for the ‘ethos’ that determines how we ought to interpret the formal rules of games of pure chance, such as being a test of skill, a matter of entertainment, a display of aesthetic beauty, an opportunity for hedonistic pleasure, and a fraternal (...) activity. Ultimately, I argue that ‘winning the benefit’ is the only ethos that can apply in purely professional games of pure chance, and that if we interpret the formal rules according to this ethos, cheating that is undertaken with respect for the judge’s authority, but that attempts to cause the judge of the game to ‘voluntarily’ relinquish the benefit of the game by deceiving them into thinking that the formal rules of the game have been followed, is impermissible but acceptable cheating, and is therefore within, rather than outside, the game. Here, I define ‘games of pure chance’ as games in which chance is the only determinant of winning. (shrink)

This paper proposes a novel reading of Kant’s account of the dependence of possibility on God in the pre-Critical Beweisgrund. I argue that Kant has a theistic-potentialist conception of the way God grounds possibility, according to which God grounds possibility by his understanding and will. The reason is that Kant accepts what I call the Principle of Possible Existence: If something is possible, then it is possible that it exists. Furthermore, I explore the connection between causal powers and possibility, the (...) influence of Crusius on Kant, and the significance of the distinction between internal and external possibility. We argue that, insofar as one accepts either supersubstantivalism or strong composition as identity for the usual reasons, one has (defeasible) reasons to accept the other as well. Thus, all else being equal, one ought to find the package that combines both views—the Identity Package—more attractive than any rival package that includes one, but not the other, of either supersubstantivalism or composition as identity.

This paper investigates Kant’s account of “real essence” and of a thing’s “nature”. Notwithstanding their wide negligence in the literature, these concepts belong to the central ones of Kant’s metaphysics. I argue that, on the one hand, Kant is in continuity with the Aristotelian-Scholastic tradition of essence. But, on the other hand, he also follows Locke in distinguishing between “logical” and “real” essence. Contrary to recent attempts of aligning real essence with contemporary approaches to essence, I will defend the thesis (...) that Kant equates real essence and (formal) nature, and that real essence has a causal, but no constitutive role. I shall also respond to potential objections and discuss some developments of Kant’s views. (shrink)

This dissertation fits within the literature on subordinating speech and aims to demonstrate that how language subordinates is more complex than has been described by most philosophers. I argue that the harms that subordinating speech inflicts on its targets (chapter one), the type of authority that is exercised by subordinating speakers (chapters two and three), and the expansive variety of subordinating speech acts themselves (chapter three) are all under-developed subjects in need of further refinement—and, in some cases, large paradigm shifts. I also examine cases that have yet to be adequately addressed by philosophers working on this topic, like the explosion of abusive speech online (chapter four) or the distinctive speech acts of protest groups (chapter five). I argue that by considering these alongside the ‘paradigm’ cases of subordinating speech that inform most models, we are better able to capture the lived realities of this phenomena, as described by members of groups targeted by such speech. I develop a novel account of speaker authority to explain the variety of pragmatic effects subordinating speech generates. Instead of seeing this authority as reducible to either a formal position or a merely local, linguistic phenomenon, I argue for a conception of speaker authority that is a richly contextual social fact, distributed unevenly among members of different social groups. I also develop an account of collective authority that explains how a group of speakers can join together to subordinate in a way that no individual speaker is capable of doing. This account, I argue, is better able to explain the social reality of subordinating speech than individualist models. Overall, I show how a more fine-grained account of subordinating speaker authority gives us a more accurate picture of the different subordinating speech acts available to different speakers, along with how these may harm their targets. Kant’s doctrine of the “transcendental object” has always puzzled interpreters. On the one hand, he says that the transcendental object is the object to which we relate our representations. On the other hand, he declares the transcendental object to be unknowable and identifies it with the thing in itself. I argue that this poses a problem that Kant only in the B edition of the Critique solves in a satisfactory manner. According to this solution, we ascribe sensible predicates to things (...) in themselves, but only insofar as they appear. I conclude that this could motivate a phenomenalist account of Kant’s idealism, but one that gives due weight to the role of things in themselves. (shrink)

In diesem Aufsatz argumentiere ich, dass die Standardauffassung von Propositionen und propositionalen Einstellungen inadäquat ist, ein Artefakt der gegenwärtig herrschenden theorielastigen Auffassung von Intentionalität, Sprache und Rationalität, und skizziere eine alternative Auffassung. Im folgenden Abschnitt belege ich erst einmal die These der Theorielastigkeit anhand einiger Beispiele vor allem aus der gegenwärtigen analytischen Philosophie. Der dritte Abschnitt erklärt, wie diese Theorielastigkeit im Standardverständnis von Propositionen und propositionalen Einstellungen verkörpert ist. Im vierten Abschnitt argumentiere ich, dass dieses Standardverständnis der Proposition zwei unvereinbare (...) Rollen zuweist. Sie kann nicht sowohl einen Sachverhalt repräsentieren, der Gegenstand praktischer genauso wie theoretischer Stellungnahmen sein kann, als auch wie eine theoretische Stellungnahme Wahrheitswertträger sein. In den folgenden Abschnitten versuche ich eine partielle Diagnose, wie es zu dieser Auffassung kommen kann: gewisse Formen der Neutralisierung von Stellungnahmen durch das bloße „in den Raum stellen“ (fünfter Abschnitt), durch fiktionale Kontexte (sechster Abschnitt) und den Kontext logischer Verknüpfungen (der so genannte „Frege-Punkt“; siebter Abschnitt) werden verwechselt mit der Neutralität zwischen dem Praktischen und Theoretischen, zwischen Wollen und Wahrheit, die die Standardauffassung erfordern würde. Der achte Abschnitt skizziert in groben Umrissen ein alternatives Bild. Demnach wird eine Repräsentation eines Sachverhalts erst durch die dazu kommende theoretische oder praktische Position zu einer Stellungnahme und damit zum Träger eines Erfüllungswerts. Die Bereiche des Praktischen und des Theoretischen sind parallel strukturiert und unterschieden sich im Wesentlichen nur durch die Verschiedenheit der Passrichtungen. Grundlegende rationale Operationen wie Deduktion, Abduktion und Induktion können auf praktischen Stellungnahmen genauso ausgeführt werden wie auf theoretischen. Im neunten Abschnitt verorte ich die tieferen Wurzeln der Theorielastigkeit in dem Verlangen, das Praktische an die dem Theoretischen eigene Form der Objektivität zu assimilieren. Dieses Verlangen muss aber fruchtlos bleiben, und die dem Praktischen eigene Form der Objektivität wird so verfehlt. Kant’s postulate of possibility states that possible is whatever agrees with the formal conditions of experience. As has often been noted, this is a definition of real possibility. However, little attention has been paid to the relation of Kantian real possibility to the German philosophical tradition before him. I discuss three kinds of possibility present in this tradition – internal, external, and (Crusian) real possibility – and argue that Kant endorses internal and external possibility. Furthermore, I show, specifically with respect (...) to the concept of state (Zustand), that the three traditional conceptions are reminiscent of three conceptions of real possibility that Kant implicitly distinguishes. Lastly, I argue that, according to Kant, we need experience to prove real possibility (at least as regards the three conceptions of the real possibility of states) because otherwise we could not know whether the formal conditions of experience obtain. Discussions of the nature or possibility of moral expertise have largely proceeded in atheoretical terms, with little attention paid to whether moral expertise depends on theoretical knowledge of morality. Here I argue that moral expertise is more theory-dependent than is commonly recognized: Moral expertise consists, at least in part, in knowledge of the correct or best moral theory, and second, that knowledge of moral theory is essential to moral experts dispensing expert counsel to non-experts. Moral experts would not be moral (...) experts absent knowledge of moral theory, nor could they play the testimonial role we would expect them to play in moral inquiry and deliberation absent such knowledge. A few purported counterexamples to the Adams thesis have cropped up in the literature in the last few decades. I propose a theory that accounts for them, in a way that makes the connections between indicative conditionals and counterfactuals clearer.

How can the law be characterized in a theory of collective intentionality that treats collective intentionality as essentially layered and tries to understand these layers in terms of the structure and the format of the representations involved? And can such a theory of collective intentionality open up new perspectives on the law and shed new light on traditional questions of legal philosophy? As a philosopher of collective intentionality who is new to legal philosophy, I want to begin exploring these questions (...) in this paper. I will try to characterize the law in terms of the layered account of collective intentionality that I have introduced in some earlier writings (Schmitz 2013; 2018). In the light of this account I will then discuss a traditional question in the philosophy of law: the relation between law and morality. I begin by giving a brief sketch of the layered account in the next section. Collective intentionality should be understood in terms of experiencing and representing others as co-subjects, rather than as objects, of intentional states and acts on different layers or levels. I distinguish the nonconceptual layer of the joint sensory-motor-emotional intentionality of joint attention and joint bodily action, the conceptual level of shared we-mode beliefs, intentions, obligations, values, and so on, and the institutional level characterized through role differentiation, positions taken in role-mode, e.g. as a judge or attorney, and writing and other forms of documentation. In the third section I introduce a set of parameters for representations such as their degree of richness, of context-dependence, of density and differentiation of representational role and of durability and stability, which can be used to more precisely distinguish different layers. I also put forward the hypothesis that these properties are connected and tend to cluster, and that higher levels can only function and determine conditions of satisfaction against lower level ones. In the fourth and final section I critically discuss the sharp positivistic separation of morality and the law according to which whether something is a law is completely independent of its moral merits. I argue that this only seems plausible if we take an observational stance towards the law, but not towards morality. When we treat them the same way, it rather appears that the moral attitudes of the co-subjects of a society will determine whether and to what extent they will accept its legal order. I conclude by proposing to think of the law as being itself an institutionalized form of morality. (shrink)

Morality is traditionally understood as comprised of two components: justice and mercy. The first component, justice, the universal component of the form, is frequently seen as foundational for any moral system – which poses a challenge of explaining the second component, mercy, the particular component of content. Kantian ethics provides an example of this approach. After formulating his universalist theory of ethics in the Groundwork of the metaphysics of morals and further developing it in the Critique of practical reason, he (...) attempts to use it in order to establish the morality of mercy in the Metaphysics of morals. Yet can universal morality of justice necessitate particular ethics of mercy? Using the example of competitive games, the relations between the ethics of justice and that of mercy are demonstrated, and it is shown that the former does not lead to the latter. Moreover, the universality of the rules of moral behavior can serve as a form for blatant brutality. Analyzing the characteristics of particular morality, we can conclude that physical humanity of the moral object, perceived as such by the subject, is a required condition for mercy. Removal of object's humanity is a necessary step toward an ethical system that allows cruelty – a system that can still be based on universal moral rules. Bhagavad Gītā, on the other hand, can be seen as an example of combining nīṣkāmakarma, the formal, universal ethics of desireless action, with a variety of particular motivations originating in the nature and social context of the moral agent. How can consciousness, how can the mind be causally efficacious in a world which seems—in some sense—to be thoroughly governed by physical causality? Mental causation has been a nagging problem in philosophy since the beginning of the modern age, when, inspired by the rise of physics, a metaphysical picture became dominant according to which the manifest macrophysical world of rocks, trees, colors, sounds etc. could be eliminated in favor of, or identified with, the microconstituents of these entities and their basic (...) physical properties, plus their effects on human or animal minds. Against the background of this ontology, the argument from causal closure, or the causal completeness of physics, exerts strong pressure to also identify consciousness with microphysical entities—or even to eliminate it in favor of the latter—the only other options apparently being either the denial of the causal closure of the physical level, epiphenomenalism about the mind, or the view that its physical effects are generally overdetermined. In this paper, however, I want to introduce what I call the “microstructure view” (MV) of the brain-consciousness relation, and I want to try to make plausible that the problem of mental causation can also be solved, or perhaps rather dissolved, on the basis of this account. On the MV, the minimal neuronal correlates of consciousness—of the global state of consciousness, or specific states of consciousness such as pain—are not identical with these states, but rather constitute their microstructure, or, as I shall also say, equivalently, compose them. To what extent can Nietzsche's idea of the Overman be used in connection with transhumanist notions of highly advanced humans and even posthumans?

This publication defends a phenomenalist interpretation of Kant’s idealism, which, however, deviates from usual phenomenalist interpretations in several respects. According to my reading, appearances are the content of representations, but not the true object of cognition. The object to which our cognition refers is rather the thing itself as the transcendental object. Nonetheless, we only cognize them as they appear and not as they are in themselves. Thus the unknowability of things as they are in themselves is retained. In the (...) course of my presentation, I discuss a number of aspects of Kant’s philosophy, among which are the distinction between appearances and things in themselves, Kant’s relationship to Cartesian epistemology, the refutation of idealism, and not least his theory of synthesis. My aim is not only to show that Kant is a phenomenalist, but also to characterize the kind of his phenomenalism. (shrink)

Freedom can be seen as individual’s capacity to choose between alternatives. As such, it stands in a dialectical relationship to its environment that both imposes constraints on freedom and allows carrying it out. Yet if we see liberty as freedom’s social accommodation, how would freedom shape liberty, and how would liberty accommodate freedom? As a capacity for choice, freedom is formal. Negative liberty, or freedom from, protects this capacity yet does not give it content. To make freedom meaningful, its societal (...) accommodation has ensure that the choice can be carried out – in terms of accessing alternatives, understand them, and making informed choices. The paper, using the tools provided by the Hegelian philosophy and by information theory, explores the concept of liberty as an enabler of freedom and the role of knowledge in its enablement. This exploration leads us to specific positive rights that are necessary to make freedom meaningful. (shrink)

Um saco misto dominado pelo absurdo reducionista da H & D. Esta é uma continuação do famoso (ou infame como eu diria agora, considerando seu absurdo implacável) Godel, Escher, Bach (1980). Assim como seu antecessor, preocupa-se em grande parte com os fundamentos da inteligência artificial, mas é composto principalmente por histórias, ensaios e extratos de uma ampla gama de pessoas, com alguns ensaios de DH e DD e comentários para todas as contribuições de um ou outro deles. Este livro é uma tentativa única de correlacionar a filosofia clássica chinesa com a de Searle (S), a quem considero ser o melhor desde Wittgenstein (W) e seu herdeiro intelectual. A qualidade dos itens é extraordinariamente alta para tal coleção, que deve ser devido à cuidadosa seleção de papéis de Mou. Os leitores acharão instrutivo comparar isso com outro volume recente de artigos sobre a filosofia de S, "Thinking About the Real World", outro livro no qual escrevi a única revisão. Como observado em minhas outras críticas, tais erros são de interesse, pois são os padrões universais de nossa psicologia devido ao fato de que nossa linguagem carece de perspicaz, como W apontou pela primeira vez no BBB (Blue and Brown Books) 3/4 de um século atrás. Quando a conferência foi gravada, tentei obter o vídeo ou uma transcrição da resposta de Mou, S, Allinson e 3 pessoas no HKUST, mas ninguém ajudou. A questão da espiritualidade inevitavelmente se mistura com as questões da linguagem da filosofia em alguns dos artigos aqui. As muitas sutilezas ao longo do caminho para dissipar a ilusão de ego e a realização da iluminação são outra questão inteira, embora como em todas as outras arenas, as confusões filosóficas inevitavelmente surgem quando falam de religião, em vez de praticá-la. Η διεφθαρμένη ανθρώπινη φύση μετατρέπει αδυσώπητα το όνειρο της δημοκρατίας και της πολυμορφίας σε εφιάλτη του εγκλήματος και της φτώχειας.
