En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

There are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of these, however, identify idealization with misrepresentation. In this article, we instead approach idealization from the artifactual perspective, comparing it to the distortion-to-reality accounts of idealization, and exemplifying it through the case of the Hodgkin and Huxley model of nerve impulse. From the artifactual perspective, (...) the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to just some specific parts of the model. Instead, the idealizing process tightly embeds theoretical concepts and formal tools into the construction of a model. (shrink)

There is a large gap between the specialized knowledge of scientists and laypeople’s understanding of the sciences. The novice-expert problem arises when non-experts are confronted with (real or apparent) scientific disagreement, and when they don’t know whom to trust. Because they are not able to gauge the content of expert testimony, they rely on imperfect heuristics to evaluate the trustworthiness of scientists. This paper investigates why some bodies of scientific knowledge become polarized along political fault lines. Laypeople navigate conflicting epistemic (...) and social demands in their acceptance of scientific testimony; this might explain their deference to scientific fringe theories, which often goes together with denying established scientific theories. I evaluate three approaches to mitigate denialism: improving the message, improving the messenger, and improving the environment in which the message is conveyed. (shrink)

In this paper we aim to think systematically about, formulate, and begin addressing some of the challenges to applying theories of moral responsibility to behaviors shaped by a particular subset of unsettling psychological complexities: namely, implicit biases.

In Principia philosophiae antiquissimae et recentissimae (1690) Anne Conway (1631-1679) develops her monistic metaphysics regarding creation, whose distinctive characteristic is transmutations for the individuals that compose it. In chapter VI of this posthumous work, Conway exemplifies this process of transmutation with the case of a horse, which changes, after death, into a human being. In this article I intend to analyze this example to show that it is not casual that the horse in question rises in the hierarchy of beings. (...) To do this I will develop my interpretation of Conway’s philosophy, her understanding of created substance and its characteristics. In this way, I want to point out that her philosophy opens up the possibility of another understanding of non-human animals by human beings, even when the latter continue to occupy a prominent place in her proposal. This book explores a question central to philosophy--namely, what does it take for a belief to be justified or rational? According to a widespread view, whether one has justification for believing a proposition is determined by how probable that proposition is, given one's evidence. In this book this view is rejected and replaced with another: in order for one to have justification for believing a proposition, one's evidence must normically support it--roughly, one's evidence must make the falsity of that proposition (...) abnormal in the sense of calling for special, independent explanation. This conception of justification bears upon a range of topics in epistemology and beyond. Ultimately, this way of looking at justification guides us to a new, unfamiliar picture of how we should respond to our evidence and manage our own fallibility. This picture is developed here. This paper examines the role of prestige bias in shaping academic philosophy, with a focus on its demographics. I argue that prestige bias exacerbates the structural underrepresentation of minorities in philosophy. It works as a filter against (among others) philosophers of color, women philosophers, and philosophers of low socio-economic status. As a consequence of prestige bias our judgments of philosophical quality become distorted. I outline ways in which prestige bias in philosophy can be mitigated.

According to Mary Midgley, philosophy is like plumbing: like the invisible entrails of an elaborate plumbing system, philosophical ideas respond to basic needs that are fundamental to human life. Melioristic projects in philosophy attempt to fix or reroute this plumbing. An obstacle to melioristic projects is that the sheer familiarity of the underlying philosophical ideas renders the plumbing invisible. Philosophical genealogies aim to overcome this by looking at the origins of our current concepts. We discuss philosophical concepts developed in Indigenous (...) cultures as a source of inspiration for melioristic genealogy. Examining the philosophical concepts of these communities is useful because it gives us a better idea of the range of ethical, political, and metaphysical approaches that exist in the world. Members of western societies do not get a clear view of this range, in part because living in large groups presents its own constraints and challenges, which limit philosophical options. We argue that features of Indigenous philosophies, such as egalitarianism and care for one's natural environment, are not inevitable byproducts of Native material conditions and lifestyles, but that they are deliberate forms of conceptual engineering. Some transhumanists argue that we must engage with theories and facts about our evolutionary past in order to promote future enhancements of the human body. At the same time, they call our attention to the flawed character of evolution and argue that there is a mismatch between adaptation to ancestral environments and contemporary life. One important trait of our evolutionary past which should not be ignored, and yet may hinder the continued perfection of humankind, is the peculiarly human way of (...) bearing and raising children. The suffering associated with childbirth and a long childhood have demanded trade-offs that have enhanced our species, leading to cooperation, creativity, intelligence and resilience. Behaviors such as mother–infant engagement, empathy, storytelling, and ritual have also helped to create what we value most in human beings. Therefore, the moral, cognitive, and emotional enhancements proposed by these transhumanists may be impaired by their partial appropriation of evolution, insofar as the bittersweet experience of parenthood is left aside. Little is known about the aetiology of philosophical intuitions, in spite of their central role in analytic philosophy. This paper provides a psychological account of the intuitions that underlie philosophical practice, with a focus on intuitions that underlie the method of cases. I argue that many philosophical intuitions originate from spontaneous, early-developing, cognitive processes that also play a role in other cognitive domains. Additionally, they have a skilled, practiced, component. Philosophers are expert elicitors of intuitions in the dialectical context of (...) professional philosophy. If this analysis is correct, this should lead to a reassessment of experimental philosophical studies of expertise. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. We maintain that in many contexts promising to try is expressive of responsibility as a promiser. This morally significant application of promising to try speaks in favor of the view that responsible promisers favor evidentialism about promises. Contra Berislav Marušić, we contend that responsible promisers typically withdraw from promising to act and instead promise to try, in circumstances in which they recognize that there is a significant chance that they will not succeed.

Despite their divergent metaphysical assumptions, Reformed and evolutionary epistemologists have converged on the notion of proper basicality. Where Reformed epistemologists appeal to God, who has designed the mind in such a way that it successfully aims at the truth, evolutionary epistemologists appeal to natural selection as a mechanism that favors truth-preserving cognitive capacities. This paper investigates whether Reformed and evolutionary epistemological accounts of theistic belief are compatible. We will argue that their chief incompatibility lies in the noetic effects of sin (...) and what may be termed the noetic effects of evolution, systematic tendencies wherein human cognitive faculties go awry. We propose a reconceptualization of the noetic effects of sin to mitigate this tension. (shrink)

In this paper I propose a new solution to the problem of change: situationalism. According to this view, parts of reality fundamentally disagree about what is the case and reality as a whole is unsettled (i.e. metaphysically indeterminate). When something changes, parts of the world irreconcilably disagree about what properties it has. From this irreconcilable disagreement, indeterminacy arises. I develop this picture using situations, which are parts of possible worlds; this gives it the name situationalism. It allows a B-theory endurance (...) view on which there is genuine incompatibility when things change. There are costs to the view, which are explored, but it is a novel approach which offers a distinct explanation of what happens when things exist through change. (shrink)

Rationalization in the sense of biased self-justification is very familiar. It's not cheating because everyone else is doing it too. I didn't report the abuse because it wasn't my place. I understated my income this year because I paid too much in tax last year. I'm only a social smoker, so I won't get cancer. The mental mechanisms subserving rationalization have been studied closely by psychologists. However, when viewed against the backdrop of philosophical accounts of the regulative role of truth (...) in doxastic deliberation , rationalization can look very puzzling. Almost all contemporary philosophers endorse a version of the thesis of deliberative exclusivity—a thinker cannot in full consciousness decide whether to believe that p in a way that issues directly in forming a belief by adducing anything other than considerations that he or she regards as relevant to the truth of p. There is a common assumption that evolutionary explanations of religion undermine religious beliefs. Do etiological accounts similarly affect the rationality of religious practices? To answer this question, this paper looks at two influential evolutionary accounts of ritual, the hazard-precaution model and costly signaling theory. It examines whether Cuneo’s account of ritual knowledge as knowing to engage God can be maintained in the light of these evolutionary accounts. While the evolutionary accounts under consideration are not metaphysically incompatible with the idea that (...) religious rituals engage God, they cast doubt on whether many, if not all, rituals can do this successfully. This paper examines the cognitive foundations of natural theology: the intuitions that provide the raw materials for religious arguments, and the social context in which they are defended or challenged. We show that the premises on which natural theological arguments are based rely on intuitions that emerge early in development, and that underlie our expectations for everyday situations, e.g., about how causation works, or how design is recognized. In spite of the universality of these intuitions, the cogency of natural theological (...) arguments remains a matter of continued debate. This article examines the special features of the atmosphere in Habsburg’s Vienna, which led to the formation of such a direction in philosophical thought as a critique of language (Sprachkritik) and the influence its representatives such as Karl Kraus and Fritz Mauthner on the later Ludwig Wittgenstein’s views on language. I argue that Sprachkritik was inextricably connected with Sprachkrise (crisis of language), Sprachkrise was a strongly Austrian phenomenon due to special socio-cultural-political reasons and which led to the consideration of the (...) very phenomenon of language from a new point of view. Here I claim that Ludwig Wittgenstein, a ‘product’ of Habsburg’s Vienna, was strongly influenced by the intellectual atmosphere of the critique of language reigning in it. In Roberto Poli’s (1997: 16), scholar in sociology and philosophy, words, the “language-world relationship was a central element of the intellectual debate of those years: suffice it to mention Rainer Maria Rilke and Hugo von Hofmannsthal among writers, and Fritz Mauthner and Ludwig Wittgenstein among philosophers.” . In this article I consider Eugen Fink’s critique of Husserlean approach to language in phenomenology, first of all in the ‘middle’ and ‘late’ periods of Husserlean works since Ideas I. Fink was Husserl’s student and assistant and, also, he was influenced by Heidegger’s ideas. In his works he criticized insufficient attention and unworked position to language in Husserl’s works. He believed that language is very important to the whole theory of phenomenology, that we cannot carry out true phenomenological reduction without (...) clarifying what language is, how it is related to our thinking, is it possible to think without language and is it possible to carry out a complete phenomenological reduction. In her Nobel speech in 2019, Olga Tokarczuk presented the category of tenderness as a new way of narrating the contemporary world. This article is a proposal for the analysis and interpretation of tenderness in ethical and aesthetic terms. (1) From an ethical perspective, tenderness is interpreted as an extension and complement of feminist relational ethics, i.e., the ethics of care. In the proposed approach, tenderness is a broader and more universal quality than care in the feminist understanding. This article (...) opens with a brief discussion of feminist interventions in ethics, with particular emphasis on the ethics of care. Next, the differences between care and tenderness are enumerated and described, in order to show how tenderness can serve as an extension and complement of the feminist ethic of care. These considerations are guided by the question of why tenderness is a better—more appropriate and more responsive to contemporary challenges—moral guidepost than care. (2) From the aesthetic perspective, tenderness is the negation of a contemplative, distanced, impersonal, and rational view of reality. As an aesthetic imperative, tenderness implies engaged experience of the beauty of reality in all of its manifestations. Therefore, in the last part of the article, existential tender attunement is described in aesthetic terms, as a position serving to sensitize others to the beauty and complexity of the post-anthropocentric world. Religious disagreement is an emerging topic of interest in social epistemology. Little is known about how philosophers react to religious disagreements in a professional context, or how they think one should respond to disagreement. This paper presents results of an empirical study on religious disagreement among philosophers. Results indicate that personal religious beliefs, philosophical training, and recent changes in religious outlook have a significant impact on philosophers' assessments of religious disagreement. They regard peer disagreement about religion as common, and most (...) surveyed participants assume one should accord weight to the other's opinion. Theists and agnostics are less likely to assume they are in a better epistemic position than their interlocutors about religious questions compared with atheists, but this pattern only holds for participants who are not philosophers of religion. Continental philosophers think religious beliefs are more like preferences than analytic philosophers, who regard religious beliefs as fact-like. (shrink)

In this paper I distinguish the category of “rationalization” from various forms of epistemic irrationality. I maintain that only if we model rationalizers as pretenders can we make sense of the rationalizer's distinctive relationship to the evidence in her possession. I contrast the cognitive attitude of the rationalizer with that of believers whose relationship to the evidence I describe as “waffling” or “intransigent”. In the final section of the paper, I compare the rationalizer to the Frankfurtian bullshitter.

The cultural transmission of theological concepts remains an underexplored topic in the cognitive science of religion (CSR). In this paper, I examine whether approaches from CSR, especially the study of content biases in the transmission of beliefs, can help explain the cultural success of some theological concepts. This approach reveals that there is more continuity between theological beliefs and ordinary religious beliefs than CSR authors have hitherto recognized: the cultural transmission of theological concepts is influenced by content biases that also (...) underlie the reception of ordinary religious concepts. Nos Segundos Analíticos II.8-10, Aristóteles apresenta um modelo investigativo de descoberta da essência pela causa a partir de uma estrutura triádica: a demonstração silogística. Esse modelo explanatório-causal é colocado em prática em casos de processos naturais (e.g. eclipse, trovão) e, apesar de mencionadas, as substâncias sensíveis (e.g. homem) não são concretamente analisadas – algo que só se consolida nos livros centrais da Metafísica (mais especificamente, em Z.17) a partir da análise hilemórfica. Além disso, em Segundos Analíticos II.9, Aristóteles apresenta uma (...) restrição quanto ao domínio de aplicação do modelo: apenas os itens que possuem “causa diferente” (ἕτερον αἴτιον) são passíveis de análise nesses termos. Se, por um lado, o capítulo parece ser uma restrição ao caso específico das substâncias, não são explicitados quais itens possuem e quais não possuem “causa diferente”. Desse modo, é suscitada a questão: teria Aristóteles previsto a aplicação do modelo explanatório-causal às substâncias hilemórficas quando da elaboração dos Segundos Analíticos, ou sua utilização na Metafísica representaria uma reformulação posterior? Neste cenário, temos pelo menos duas hipóteses interpretativas: (i) uma leitura restritiva (ou desenvolvimentista), em que as substâncias não teriam sido previstas; (ii) uma leitura não-restritiva, que se opõe à primeira ao defender que as substâncias já estariam previstas na elaboração dos Segundos Analíticos, e sua omissão se daria por economia argumentativa. O objetivo do presente trabalho é apresentar a hipótese não-restritiva como uma solução para o problema do ἕτερον αἴτιον, defendendo uma aproximação entre a Metafísica e os Segundos Analíticos. This piece explores the origins of science fiction in philosophical speculation about the size of the universe, the existence of other solar systems and other galaxies, and the possibility of alien life. Science fiction helps us to grapple with the dizzying possibilities that a vast universe affords, by allowing our imagination to fill in the details.

Situationists such as John Doris, Gilbert Harman, and Maria Merritt suppose that appeal to reliable behavioral dispositions can be dispensed with without radical revision to morality as we know it. This paper challenges this supposition, arguing that abandoning hope in reliable dispositions rules out genuine trust and forces us to suspend core reactive attitudes of gratitude and resentment, esteem and indignation. By examining situationism through the lens of trust we learn something about situationism (in particular, the radically revisionary moral implications (...) of its adoption) as well as something about trust (in particular, that the conditions necessary for genuine trust include a belief in a capacity for robust dispositions). Natural theology is the branch of theology and philosophy that attempts to gain knowledge of God through non-revealed sources. In a narrower sense, natural theology is the discipline that presents rational arguments for the existence of God. Given that these arguments rarely directly persuade those who are not convinced by their conclusions, why do they enjoy an enduring appeal? This article examines two reasons for the continuing popularity of natural theological arguments: (i) they appeal to intuitions that humans robustly hold (...) and that emerge early in cognitive development; (ii) they serve an argumentative function by presenting particular religious views as live options. I conclude with observations on the role of natural theology in contemporary analytic philosophy of religion. (shrink)

Maria Gołaszewska (1926–2015), a Polish philosopher, was associated throughout her life with Poland’s oldest academic institution, the Jagiellonian University in Cracow. She was a student of the phenomenologist Roman Ingarden, himself a student of Edmund Husserl. During the postwar and communist years in Poland, Gołaszewska conducted research focusing on issues related to art and aesthetics. She created her own conception of empirically and anthropologically oriented aesthetics, which I believe is a prime example of a theory that accounts for the perspective (...) of gender, and in this sense should be acknowledged as an important contribution to contemporary gender-sensitive/feminist philosophy. In the article, I present Gołaszewska’s life, academic career, and philosophy as a cognitively valuable response to feminist philosophy’s search for a suitable description of women’s experiences related to art and aesthetic perception. According to Friedrich Schleiermacher, religiosity is rooted in feeling (Gefühl). As a result of our engagement with the world, on which we depend and which we can influence, we have both a sense of dependence and of freedom. Schleiermacher speculated that a sense of absolute dependence in reflective beings with self-consciousness (human beings) gave rise to religion. Using insights from contemporary philosophy of biology and cognitive science, I seek to naturalize Schleiermacher's ideas. I moreover show that this naturalization is in (...) line with Schleiermacher's outlook on biology, as he already had evolutionary considerations in mind when he wrote the Christian Faith (1830). While Schleiermacher rejects natural theology in a narrow sense (proofs for the existence of God), his project is natural theological in a broader sense, as it roots religion in experiences that we can examine using naturalistic theories. In the paper, I pose the question of how, on artistic, aesthetic, and philosophical levels, decoration and domestic handicrafts as subversive strategies enable the undermining and breakdown of class-based and patriarchal divisions into high and low, objective and subjective, public and private, masculine and feminine. I explore whether handicrafts, in accordance with feminist postulates, are transgressive, transformative, and inclusive. I link handicrafts with the feminist perspective, since, in the second half of the twentieth century, it was precisely the feminist movement (...) that initiated significant changes in the social and cultural perception of women, femininity, and gender relations. Thus I apply this perspective in the first place to the analysis of selected works of contemporary art in which handicrafts is used not only as a means of artistic expression but also as a subversive aesthetic strategy. I also demonstrate how the world of fashion transforms and aesthetizes handicrafts, whose presence in fashion makes it an area in which, in addition to imperatives and aesthetic values, social attitudes, ethical values, and world views are shaped. Finally, referring to the works of selected feminist authors (Mary Field Belenky, Mary Daly, Evelyn Fox-Keller, Donna Haraway), I show how these researchers have metaphorically interpreted handicrafts as specifically feminine ways of creating and developing knowledge. The article presents the evolution of the language of advertising from the 1960s to the present, presenting various images of women in advertising. Simultaneously a theoretical analysis has been carried out of the demands of second-wave feminism, which exerted significant influence on the creation of images of women in the mass media. The objective of our comparison of feminist theory with advertising practice is an attempt to answer the question of whether the present media image of women liberated from the (...) binary sexual order and weighted towards the genderqueer and/or transgender phenomena is the desired realization of the feminist demands for emancipation of and equality for women announced in the second half of the twentieth century. Is it right to convict a person of a crime on the basis of purely statistical evidence? Many who have considered this question agree that it is not, posing a direct challenge to legal probabilism – the claim that the criminal standard of proof should be understood in terms of a high probability threshold. Some defenders of legal probabilism have, however, held their ground: Schoeman (1987) argues that there are no clear epistemic or moral problems with convictions based on purely (...) statistical evidence, and speculates that our aversion to such convictions may be nothing more than an irrational bias. More recently, Hedden and Colyvan (2019, section VI) describe our reluctance to convict on the basis of purely statistical evidence as an ‘intuition’, but suggest that there may be no ‘in principle’ problem with such convictions (see also Papineau, forthcoming, section 6). In this paper, I argue that there is, in some cases, an in principle problem with a conviction based upon statistical evidence alone – namely, it commits us to a precedent which, if consistently followed through, could lead to the deliberate conviction of an innocent person. I conclude with some reflections on the idea that the criminal justice system should strive to maximise the accuracy of its verdicts – and the related idea that we should each strive to maximise the accuracy of our beliefs. Based on a qualitative research developed with former fighters from the paramilitarism and the extinct FARC guerrilla in Colombia, this article develops, from a feminist perspective, the analytical and political proposition of understanding armed groups as technologies of gender, understanding the production of militarized masculinities. The article conceptualizes the notion of militarized masculinities from a double component: militarization and militarism, while comparing paramilitary and guerrilla masculinities, emphasizing in how insurgent masculinity emerged inside the FARC as a type of militarized masculinity (...) characterized, among other things, by a communal subjectivity. Anne Finch Conway es una de las filósofas del siglo XVII que discutió con los filósofos destacados de su época. La única obra con la que contamos de esta autora es Principia Philosophiae Anticissimae et Recentissimae o The Principle of the Most Ancient and Modern Philosophy. En este artículo me propongo dar cuenta del rol que la naturaleza humana tiene en su metafísica, de modo de encontrar un lugar más específico para el dolor y el sufrimiento en un mundo que (...) parece ante todo gobernado por el amor recíproco y la simpatía. El concepto de hombre microcosmos y la relación de este con Cristo tiene una importancia poco destacada por la bibliografía sobre nuestra filósofa. Con esta meta, presentaré su metafísica prestando especial atención a la sustancia creada y su relación con la sustancia media, Cristo, y la sustancia primera, Dios. De este modo, además, daré cuenta de la responsabilidad que la naturaleza humana tiene con el mundo de la creación, por lo cual me permito mencionar también lo “ecológico” en el pensamiento de Conway, ya que el perfeccionamiento de la naturaleza humana es el perfeccionamiento de toda la naturaleza. The article deals with the philosophical problem of the objectivity of knowledge in relation to the ideas and postulates advanced by feminist critics from the 1960s on. To this end, I take the historical perspective into account and present successively selected threads of feminist criticism of the traditional theory of knowledge, followed by selected positive aspects of feminist epistemology. First of all, I discuss feminist criticism of the androcentric research model, which is based on the doctrine of the disembodied, detached (...) objectivity of the subject and object of research as well as of knowledge itself. Next, I present selected feminist approaches to knowledge which constitute cognitively valuable proposals for the transformation of the traditional theory of knowledge through the application in philosophical reflection and research of the feminist research perspective. Artykuł stanowi próbę artystycznej i estetycznej analizy dzieła Chrystus św. Jana od Krzyża Salvadora Dalego jako obrazu realizującego główne postulaty estetyki postmodernizmu. Zastosowana perspektywa badawcza ma na celu wyjście poza tradycyjną zależność polegającą na wskazywaniu tego, co postmodernizm przejął od wcześniejszych nurtów awangardowych, w szczególności od surrealizmu. Proponowana odwrócona perspektywa odsyła do innej, wzbogacającej relacji: wskazuje bezpośrednio na to, co surrealizm odkrył i w artystyczny sposób wykorzystał na długo przed nastaniem estetyki postmodernizmu.

Contextualist accounts of aesthetic predicates have difficulties explaining why we feel that speakers are disagreeing when they make true and compatible but superficially contradictory aesthetic judgments. One possible way to account for the disagreement is hybrid expressivism, which holds that the disagreement happens at the level of pragmatically conveyed, clashing contents about the speakers’ conative states. Marques defends such a strategy, combining dispositionalism about value, contextualism, and hybrid expressivism. This paper critically evaluates the plausibility of the suggested pragmatic mechanisms in (...) conveying the kind of contents Marques takes to explain disagreements. The positive part suggests an alternative account of how aesthetic judgments are sources of information about speakers’ conative aesthetic states. (shrink)

Philosophy of religion is often regarded as a philosophical discipline in which irrelevant influences, such as upbringing and education, play a pernicious role. This paper presents results of a qualitative survey among academic philosophers of religion to examine the role of such factors in their work. In light of these findings, I address two questions: an empirical one (whether philosophers of religion are influenced by irrelevant factors in forming their philosophical attitudes) and an epistemological one (whether the influence of irrelevant (...) factors on our philosophical views should worry us). My answer to the first question is a definite yes, my answer to the second, a tentative yes. (shrink)

Problem kobiecej tożsamości jest zagadnieniem żywym we współczesnym dyskursie feministycznym. Szczególne miejsce zajmuje on zwłaszcza we francuskiej myśli feministycznej, reprezentowanej między innymi przez liberalną feministkę Élisabeth Badinter. Najnowsza książka filozofki, zatytułowana Konflikt: kobieta i matka, stanowi szczegółowe opracowanie obowiązujących obecnie poglądów na naturę kobiety jako matki, która pragnie także realizować swoje własne, indywidualne potrzeby. Stąd tytułowy konflikt wartości, będący podłożem współczesnego kryzysu kobiecej tożsamości. Początki tożsamościowego myślenia kobiet przypisuje się matce europejskiego feminizmu, Simone de Beauvoir. Badinter, kontynuując tożsamościowe rozważanie de (...) Beauvoir, analizuje wpływ myślenia naturalistycznego i maternalistycznego na obowiązujący obecnie status kobiet. Filozofka zajmuje się także wyjątkowym przypadkiem Francuzek, które ze względu na historyczną specyfikę realiów życia we Francji jako jedyne realizują współcześnie model spełnionej kobiety i zaangażowanej matki. Nakładem wydawnictwa Uniwersytetu w Walencji ukazała się w 2008 roku książka brytyjskiego profesora Iana Ground’a, zatytułowana ¿Arte o chorrada? (tytuł oryginału: ang. Art or bunk?). Ian Ground jest wykładowcą Uniwersytetów w Edynburgu oraz Newcastle, przedmiotem jego zainteresowań filozoficznych jest estetyka oraz zagadnienia sztuki współczesnej. Długoletnie doświadczenie w pracy ze studentami stało się dla niego inspiracją do podjęcia próby przybliżenia odbiorcy idei sztuki współczesnej. Celem autora nie jest jednak podanie bezpośredniej odpowiedzi na pytanie: jak poradzić sobie w świecie sztuki współczesnej, ale (...) dostarczenie określonych narzędzi, pomocnych w zetknięciu z tego rodzaju sztuką. W zamyśle autora, narzędzia te pozwolą odbiorcy dokonać fundamentalnego osądu: czy ma do czynienia z dziełem sztuki, czy też ze zwykłym „śmieciem” i pospolitą „bzdurą” (ang. bunk, hiszp. chorrada). ¿Arte o chorrada? to próba stworzenia elementarnego podręcznika, prezentującego metodę analizy dzieła, które stało się dla nas wyzwaniem oraz zawierającego propozycję pewnych rozwiązań, nie zawsze będących gwarancją osiągnięcia sukcesu. Podobnie jak wiele innych prac związanych z tematem sztuki XX wieku, książka Iana Ground’a nie jest niezawodnym remedium na wszelkie bolączki odbiorcy sztuki współczesnej. Możemy ją raczej potraktować jako solidne zestawienie tez, na których autor opiera swoją propozycję rozumienia dzieł sztuki i w konsekwencji, konstruktywne podejście do omawianego problemu. (shrink)

In this paper I respond to Marcello Di Bello’s criticisms of the ‘normic account’ of the criminal standard of proof. In so doing, I further elaborate on what the normic account predicts about certain significant legal categories of evidence, including DNA and fingerprint evidence and eyewitness identifications.
