This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. In the biomedical context, policy makers face a large amount of potentially discordant evidence from different sources. This prompts the question of how this evidence should be aggregated in the interests of best-informed policy recommendations. The starting point of our discussion is Hunter and Williams’ recent work on an automated aggregation method for medical evidence. Our negative claim is that it is far from clear what the relevant criteria for evaluating an evidence aggregator of this sort are. What is the (...) appropriate balance between explicitly coded algorithms and implicit reasoning involved, for instance, in the packaging of input evidence? In short: What is the optimal degree of ‘automation’? On the positive side: We propose the ability to perform an adequate robustness analysis as the focal criterion, primarily because it directs efforts to what is most important, namely, the structure of the algorithm and the appropriate extent of automation. Moreover, where there are resource constraints on the aggregation process, one must also consider what balance between volume of evidence and accuracy in the treatment of individual evidence best facilitates inference. There is no prerogative to aggregate the total evidence available if this would in fact reduce overall accuracy. (shrink)

Do scientific theories limit human knowledge? In other words, are there physical variables hidden by essence forever? We argue for negative answers and illustrate our point on chaotic classical dynamical systems. We emphasize parallels with quantum theory and conclude that the common real numbers are, de facto, the hidden variables of classical physics. Consequently, real numbers should not be considered as ``physically real" and classical mechanics, like quantum physics, is indeterministic.

In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. This article defends a relational account of personhood. I argue that the structure of personhood consists of dyadic relations between persons who can wrong or be wronged by one another, even if some of them lack moral competence. I draw on recent work on directed duties to outline the structure of moral communities of persons. The upshot is that we can construct an inclusive theory of personhood that can accommodate nonhuman persons based on shared community membership. Most physics theories are deterministic, with the notable exception of quantum mechanics which, however, comes plagued by the so-called measurement problem. This state of affairs might well be due to the inability of standard mathematics to “speak” of indeterminism, its inability to present us a worldview in which new information is created as time passes. In such a case, scientific determinism would only be an illusion due to the timeless mathematical language scientists use. To investigate this possibility it is necessary (...) to develop an alternative mathematical language that is both powerful enough to allow scientists to compute predictions and compatible with indeterminism and the passage of time. We suggest that intuitionistic mathematics provides such a language and we illustrate it in simple terms. (shrink)

We aim to do two things in this article. On the positive end, our goal is to explain how some seemingly incompatible aspects of belief live together, by presenting distinct mechanistic explanations of each of them: in particular we want to show how belief can be discerning, credulous, rational, and irrational. After clarifying our positive view, we take aim at some competitor views in the second half of the paper, particularly offering critiques of epistemic vigilance and social marketplace accounts of (...) belief. The claim that the observation of a violation of a Bell inequality leads to an alleged alternative between nonlocality and non-realism is annoying because of the vagueness of the second term.

In a number of papers, Kit Fine introduced a theory of embodiment which distinguishes between rigid and variable embodiments, and has been successfully applied to clarify the ontological nature of entities whose parts may or may not vary in time. In particular, he has applied this theory to describe a process such as the erosion of a cliff, which would be a variable embodiment whose manifestations are the different states of erosion of the cliff. We find this theory very powerful, (...) and especially appropriate to capture the intuition that the same process may go on at different times. However, its formal principles have been subject to some criticisms, mainly concerning the mereological structure of a variable embodiment. Moreover, since the notion of variable embodiment is very general, simply saying that processes are variable embodiments is not enough to understand their ontological nature. To address these concerns, in this paper we proceed in two phases: first, we propose a revised version of Fine’s original theory adapted to the case of processes, which adopts a classical mereology instead of Fine’s hylomorphic mereology, and a temporalized constitution relation in place of Fine’s function of variable embodiment; second, we go deeper into the ontological nature of processes by revisiting the notions of homogeneity, intentionality, and telicity discussed in the literature, and propose an account based on ontological principles and not on semantic properties of predicates. This allows us to organize processes into a novel taxonomy based exclusively on their unity and individuation principles. (shrink)

We present a systematic and qualitative review of academic literature on early conceptual development (0–24 months of age), with an emphasis on methodological aspects. The final sample of our review included 281 studies reported in 115 articles. The main aims of the article were four: first, to organise studies into sets according to methodological similarities and differences; second, to elaborate on the methodological procedures that characterise each set; third, to circumscribe the empirical indicators that different sets of studies consider as (...) proof of the existence of concepts in early childhood; last, to identify methodological limitations and to propose possible ways to overcome them. We grouped the studies into five sets: preference and habituation experiments, category extension tasks, object sorting tasks, sequential touching tasks and object examination tasks. In the “Results” section, we review the core features of each set of studies. In the “Discussion” and “Conclusions” sections, we describe, for one thing, the most relevant methodological shortcomings. We end by arguing that a situated, semiotic and pragmatic perspective that emphasises the importance of ecological validity could open up new avenues of research to better understand the development of concepts in early childhood. World food production is facing exorbitant challenges like climate change, use of resources, population growth, and dietary changes. These, in turn, raise major ethical and political questions, such as how to uphold the right to adequate nutrition, or the right to enact a gastronomic culture and to preserve the conditions to do so. Proposals for utopic solutions vary from vertical farming and lab meat to diets filled with the most fanciful insects and seaweeds. Common to all proposals is a polarized (...) understanding of food and diets, famously captured by Warren Belasco in the contraposition between technological fixes and anthropological fixes. According to the first, technology will deliver clean, just, pleasurable, affordable food; future generations will not need to adjust much of their dietary cultures. According to the second, future generations should dramatically change their dietary habits (what they eat and how they eat it) to achieve a sustainable diet. The two fixes found remarkably distinct perspectives over dietary politics and the ethics of food production and consumption. In this paper we argue that such polarized thinking rests on a misrepresentation of the ontological status of food, which in turn affects the underlying ethical and political issues. Food is a socially constructed object that draws in specific ways on habits, norms, traditions, geographical, and climatic conditions. Although this thesis seems somewhat obvious, its consequences on the ethical and political perspectives on the future of food have not been derived properly. After introducing the issue at stake (¤1), we point out the polarities that characterize food utopias (¤2) and their ontological faults (¤3). We hence suggest that a socio-ontological analysis of food can better deliver the principles for a foundation of food utopias (¤4). (shrink)

We present in this paper a novel ontological theory of events whose central tenet is the Aristotelian distinction between the object that changes and the actual subject of change, which is what we call an individual quality. While in the Kimian tradition events are individuated by a triple ⟨ o, P, t ⟩, where o is an object, P a property, and t an interval of time, for us the simplest events are qualitative changes, individuated by a triple ⟨ o, (...) q, t ⟩, where q is an individual quality inhering in o or in one of its parts. Detaching the individuation of events from the property they exemplify results in a fine-grained theory that keeps metaphysics and semantics clearly separate, and lies between the multiplicative and the unitarian approaches. We discuss then the way language refers to events, observing that, in most cases, event descriptions refer to complex, cognitively relevant clusters of co-occurring qualitative changes, which exhibit a synchronic structure depending on the way they are described. Contra Bennett, who famously argued that the semantics of event names ultimately depends on “local context and unprincipled intuitions”, we show how the lexicon provides systematic principles for individuating such clusters and classifying them into kinds. Finally, we address some open challenges in the semantics of locative and manner modifiers. (shrink)

The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. In particular, I focus on single-event virtues, first-time virtuous acts, and morally dangerous situations. (shrink)

Most people agree that inflicting unnecessary suffering upon animals is wrong. Many fewer people, including among ethicists, agree that painlessly killing animals is necessarily wrong. The most commonly cited reason is that death (without pain, fear, distress) is not bad for them in a way that matters morally, or not as significantly as it does for persons, who are self-conscious, make long-term plans and have preferences about their own future. Animals, at least those that are not persons, lack a morally (...) significant interest in continuing to live. At the same time, some argue that existence itself can be good, insofar as one’s life is worth living. For animals, a good life can offset a quick, if early, death. So, it seems to follow that breeding happy animals that will be (prematurely) killed can be a good thing overall. Insofar as slaughter and sale makes it economically sustainable to raise new ones, who would otherwise not exist, raising and killing animals for food who will have lives worth living is good overall. It benefits them as well as consumers, and makes the world better by adding to the sum of happiness. The process of raising and killing animals with positive welfare produces a sequence of replacement that maintains or increases overall welfare, all else being equal (assuming in particular no overall negative impact on the welfare of other parties). Call this the Replaceability Argument (RA) and the ensuing controversy the Replaceability Problem (RP). This is a problem at the crossroads of the ethics of killing, agricultural ethics, procreation ethics, and population ethics. (shrink)

The διακριτικὴ τέχνη (the art of separating or discriminating), from which the sixth definition of theSophiststarts (226b1–231b9), is puzzling.Prima faciethe art of separating does not fit the initial division of art between ποιητικὴ τέχνη (production) and κτητικὴ τέχνη (acquisition) at 219a8–c9. Therefore, scholars generally agree that, although mutually exclusive, ποιητική and κτητική are not exhaustive and leave room for a third species of art, διακριτικὴ τέχνη, on a par with ποιητική and κτητική. However, I argue that textual evidence suggests otherwise.

Imagine that your body has become attached, without your permission, to that of a sick violinist. The violinist is a human being. He will die if you detach him. Such detachment seems, nonetheless, to be morally permissible. Thomson argues that an unwantedly pregnant woman is in an analogous situation. Her argument is considered by many to have established the moral permissibility of abortion even under the assumption that the foetus is a human being. Another popular argument is that presented by (...) Singer and Unger to the effect that even those who are moderately prosperous are morally obliged to help the poor if they can do so at relatively small cost to themselves. The empirical study of belief is emerging at a rapid clip, uniting work from all corners of cognitive science. Reliance on belief in understanding and predicting behavior is widespread. Examples can be found, inter alia, in the placebo, attribution theory, theory of mind, and comparative psychological literatures. Research on belief also provides evidence for robust generalizations, including about how we fix, store, and change our beliefs. Evidence supports the existence of a Spinozan system of belief fixation: one that is automatic (...) and independent of belief rejection. Independent research supports the existence of a system of fragmented belief storage: one that relies on large numbers of causally isolated, context-sensitive stores of belief in memory. Finally, empirical and observational data support at least two systems of belief change. One system adheres, mostly, to epistemological norms of updating; the other, the psychological immune system, functions to guard our most centrally held beliefs from potential inconsistency with newly formed beliefs. Refining our under- standing of these systems can shed light on pressing real-world issues, such as how fake news, propaganda, and brainwashing exploit our psychology of belief, and how best to construct our modern informational world. Ontology as a branch of philosophy is the science of what is, of the kinds and structures of objects, properties, events, processes and relations in every area of reality. ‘Ontology’ is often used by philosophers as a synonym for ‘metaphysics’ (literally: ‘what comes after the Physics’), a term which was used by early students of Aristotle to refer to what Aristotle himself called ‘first philosophy’. The term ‘ontology’ (or ontologia) was itself coined in 1613, independently, by two philosophers, Rudolf Göckel (...) (Goclenius), in his Lexicon philosophicum and Jacob Lorhard (Lorhardus), in his Theatrum philosophicum. The first occurrence in English recorded by the OED appears in Bailey’s dictionary of 1721, which defines ontology as ‘an Account of being in the Abstract’. (shrink)

The idea that appearances provide justifications for beliefs—the principle of phenomenal conservatism—is self-evidently true. In the case of cognitive penetration, however, it seems that certain irrational etiologies of a belief may influence the epistemic quality of that belief. Susanna Siegel argues that these etiologies lead to ‘epistemic downgrade.’ Instead of providing us with a decisive objection, cognitive penetration calls for us to clarify our epistemic framework by understanding the formative parts of appearances. In doing so, the two different but inseparable (...) ideas of sensation and intellection provide us with a basis of our appearances. These appearances, in turn, provide us with the objective evidence needed to test our judgements. După o scurtă Introducere, care include o istorie a evoluţiei conceptului de serviciu de informaţii după (...) al doilea război mondial, în Activitatea de informaţii definesc obiectivele şi organizarea serviciilor de informaţii, modelul de bază al acestor organizaţii (ciclul informaţional), şi aspectele relevante ale culegerii de informaţii şi analizei de informaţii. This text proposes an analysis of the phenomenon of faith in the tradition and spirituality of the Eastern Church. Starting from the relationship between phenomenology and theology, the article uses a theo-phenomenological method to depict the phenomenon of faith both theologically and phenomenologically. This article also argues that non-religious faith—either natural or philosophical—is the foundation of religious faith. According to Orthodox spirituality, faith is not reduced to a set of theoretical teachings and dogmas; they constitute only the first type of (...) faith, “simple faith”. At the same time, faith is also a form of experience, which has ascetical, ethical, and mystical dimensions; they characterize the second type of faith, faith as contemplative sight and knowledge. It’s natural to think of acts of solidarity as being public acts that aim at good outcomes, particularly at social change. I argue that not all acts of solidarity fit this mold - acts of what I call ‘private solidarity’ are not public and do not aim at producing social change. After describing paradigmatic cases of private solidarity, I defend an account of why such acts are themselves morally virtuous and what role they can have in moral development.

A constitutive theory of representation must address two challenges. The content determination challenge requires specifying why a particular state has a given content. The job description challenge requires spelling out the explanatory role that representational notions play in that theory. Recently, Nicholas Shea has advanced *varitel semantics* as a hybrid approach to representation to answer those challenges, supplementing teleosemantics with non-historical features –namely, exploitable relations and robustness. In this paper, I critically assess the hybrid theory’s answers to both challenges, arguing (...) that their hybrid nature undermines their merits. In each case, I will show that it is hard to establish how the alleged complementariness of the hybrid account components works. Singularitățile gravitaționale în relativitatea generală sunt locații în spațiu-timp unde câmpul gravitațional devine infinit. Curburile invariabile scalare ale spațiu-timpului includ o măsură a densității materiei. Unii fizicieni și filosofi consideră că, deoarece densitatea materiei tinde spre infinit în singularitate, legile spațiu-timpului nu mai sunt valabile acolo. O singularitățile gravitațională aproape unanim acceptată în astrofizică și cosmologie, ca cea mai timpurie stare a universului, este Big Bang. Certains scientifiques et philosophes sont d’avis que toute théorie permettant un voyage dans le temps introduirait des problèmes de causalité. In this article, I show that the semantics one adopts for mass terms constrains the metaphysical claims one can make about mixtures. I first expose why mixtures challenge a singularist approach based on mereological sums. After discussing an alternative, non-singularist approach, I take chemistry into account and explain how it changes our perspective on these issues.

Despre necesitatea şi utilitatea dezvoltării unei filosofii specifice tehnologiei blockchain, accentuând pe aspectele ontologice. După o Introducere în care evidenţiez principalele direcţii filosofice pentru această tehnologie emergentă, în Tehnologia blockchain explicitez modul de funcţionare al blockchain, punând în discuţie direcţiile ontologice de dezvoltare în Proiectarea şi Modelarea acestei tehnologii. Următoarea secţiune este dedicată principalei aplicaţii a tehnologiei blockchain, Bitcoin, cu implicaţiile sociale ale acestei criptovalute. Urmează o secţiune de Filosofie în care identific tehnologia blockchain cu conceptul de heterotopie dezvoltat de (...) Michel Foucault şi o interpretez în lumina tehnologiei notaţionale dezvoltată de Nelson Goodman ca sistem notaţional. În secţiunea Ontologii dezvolt două direcţii de dezvoltare considerate de mine ca importante: Ontologia narativă, bazată pe ideea de ordine şi structură a istoriei transmise prin naraţia istoriei a lui Paul Ricoeur, şi un sistem ontologic bazat pe Ontologiile de intreprindere, bazat pe conceptele şi modelele de intreprindere specifice webului semantic, şi pe care eu îl consider cel mai bine dezvoltat şi cel care va deveni, probabil, sistemul ontologic formal, cel puţin în ceea ce priveşte aspectele economice şi juridice ale tehnologiei blockchain. Il s’agit ici de présenter une version raffinée du libéralisme de la peur de Judith Shklar : le libéralisme de la prudence. Après en avoir brièvement présenté les grandes lignes et les principales faiblesses, j’esquisse les contours du libéralisme de la prudence et montre comment il réalise, mieux que libéralisme de la peur, le programme minimaliste poursuivi par Shklar. Je montre ensuite comment le libéralisme de la prudence nous permet de sortir du dilemme libéral posé par la tradition postrawlsienne : (...) justifier le libéralisme sur des bases morales, au risque de le priver de neutralité, ou le justifier sur des bases réalistes hobbesiennes, au risque d’en faire l’otage des rapports de force changeants. Enfin, j’examine comme le principal défaut apparent du libéralisme de la prudence – à savoir son ascétisme programmatique – est en fait son principal mérite. (shrink)

Alors que le débat sur le caractère scientifique ou pseudo-scientifique de l’agriculture biodynamique occupe régulièrement le débat public, l’histoire et la philosophie des sciences ne semblent que très peu s’être emparées de ce sujet. La thèse défendue ici est double : tout d’abord, si l’agriculture biodynamique rencontre un relatif succès aujourd’hui, cela tient sans doute au fait que son théoricien, R. Steiner, a été un des premiers à critiquer le paradigme qui domine l’agronomie, ou en tout cas l’agriculture, depuis plus (...) d’un siècle. Cette critique semble d’ailleurs se maintenir dans ses motifs tout au long du XXe siècle, jusqu’à une certaine critique contemporaine de l’agro-industrie et de ses conséquences désastreuses sur l’environnement. Or, et c’est la seconde thèse défendue ici, cette critique semble méconnaître voire occulter la réalité des débats internes qui ont traversé l’agronomie au cours du XXe siècle et qui continuent de l’agiter aujourd’hui : l’agronomie système a ainsi par exemple intégré dans ses objets des éléments de l’agriculture biodynamique. Selon nous, le problème principal est que l’agronomie est souvent abordée selon une approche externaliste, qui doit impérativement être complétée par une approche internaliste afin tout d’abord de distinguer ce qui relève de la science et ce qui relève du mysticisme, et ensuite de saisir toute la richesse historique et épistémologique de l’agronomie. The method of the transcendental reduction, which takes place as a return revealing the subjectivity to itself, makes possible to grasp the link connecting the worldly reality and the egological dimension, i.e. the world’s becoming in the ways of the originally subjective constitution. The legitimate aim of the psychological experience to understand the basic structures of the life-consciousness can find in the conceptual figure of the phenomenological reduction both a valid methodological approach and a useful terms of comparison.

Cet article est consacré au problème du rapport entre l’entrelacement des genres (συμπλοκὴ τῶν εἰδῶν) et le logos dans le Sophiste. Après avoir brièvement présenté le problème, je discute, dans la première partie, différentes solutions proposées par les commentateurs. Je cherche à montrer qu’aucune de ces solutions n’est pleinement satisfaisante. Dans la deuxième partie, je propose une nouvelle solution au problème de la συμπλοκὴ τῶν εἰδῶν fondée sur une distinction entre deux types de logos, le logos dialectique et le logos (...) doxique. Dans la troisième partie, je cherche à justifier textuellement cette solution en recourant à la fois au texte du Sophiste lui-même et à la dernière partie du Théétète. Dans ma conclusion, je suggère que la distinction entre logos dialectique et logos doxique correspond à une différence qui traverse toute l’œuvre de Platon, à savoir la différence entre connaissance et opinion. / This paper deals with the problem of the συμπλοκὴ τῶν εἰδῶν in the Sophist. In the first part, after a brief presentation of this problem, I discuss different solutions which have been proposed in the recent literature. I try to show that none of them is entirely satisfying. In the second part, I propose and explain a new solution based on a distinction between two types of logos : dialectical logos and doxastic logos. In the third part, I try to justify this solution on the basis of some passages of the Sophist and of the final part of the Theaetetus. To conclude, I suggest that the distinction between dialectical logos and doxasticlogos matches the difference between knowledge and belief made by Plato in his dialogues. (shrink)

De acuerdo con una caracterización filosófica estándar, el comportamiento humano se hace inteligible a partir de estados mentales, atendiendo especialmente a dos relaciones explicativas: la racionalidad y la causalidad. En el presente artículo evaluaremos cuán adecuada es dicha caracterización respecto a las explicaciones que se dan en las psicoterapias contextuales. Nuestro análisis establece varias respuestas por la negativa. Por un lado, el objetivo de estas terapias no es la comprensión ni la evaluación normativa, por lo que la racionalidad no juega (...) allí un rol explicativo. A su vez, el rol de la causalidad es secundario en la evaluación diagnóstica, dado que en esa etapa del proceso terapéutico es la función de los comportamientos la que busca elucidarse. Finalmente, sostenemos que la intervención terapéutica de estas psicoterapias se centra en explicaciones causales, aunque no desde el modelo de sentido común que la caracterización filosófica supone. Sugerimos, por la positiva, que las explicaciones del comportamiento en psicoterapias contextuales son híbridas: al evaluar apelan a explicaciones funcionales y al intervenir a explicaciones causales. Bimal Krishna Matilal (1935-1991) was a Harvard-educated Indian philosopher best known for his contributions to logic, but who also wrote on wide variety of topics, including metaethics. Unfortunately, the latter contributions have been overlooked. Engaging with Anglo-American figures such as Gilbert Harman and Bernard Williams, Matilal defends a view he dubs ‘pluralism.’ In defending this view he draws on a wide range of classical Indian sources: the Bhagavad-Gītā, Buddhist thinkers like Nāgārjuna, and classical Jaina concepts. This pluralist position is somewhere (...) between relativism and absolutist realism. Unlike the relativist, he argues that there is a genuinely universal morality; unlike the absolutist, he argues that there are multiple, but often conflicting and incommensurable, moral frameworks and ideals. This paper will explain his objections to relativism, as well as flesh out his suggestive remarks about his own pluralistic account. (shrink)

În lucrările sale timpurii, Lakatos pare să accepte că după un punct de saturație: respingem teoria, pentru ca ulterior să afirme că, dimpotrivă, nu există un astfel de lucru ca punctul de saturație natural pentru un program de cercetare. In a world that is overflowing with journals and other outlets for scientific publication, the appearance of any new periodical requires some justification. There are already more journals than we can read and more conferences than we can attend. In the case of applied Ontology, we believe that the creation of anew journal not only is completely justifiable, it is downright exciting. For too long, workers in computer science have assumed that content comes for free. “Theory” in computer science has (...) always meant the theory of processes and of computation. We measure the complexity of computer programs in terms of how long it takes machines to execute them, not in terms of how long it takes people to understand and to represent the data on which those programs might operate. We typically describe computer code in terms of algorithms that operate on formal parameters, often without pausing to discuss where the data that might satisfy those parameters come from. This journal was founded on the premise that workers in computer science, informatics, and information science are overdue in paying as much attention to contents as they do to algorithms. (shrink)

This article analyses the peculiarities of Dominicus Gundissalinus’s reading and use of Avicenna’s writings in his original works. Gundissalinus (1120ca – post 1190) is the Latin translator of Avicenna’s De anima and Liber de philosophia prima, but also an original philosopher whose writings are precious witnesses of the very first reception of Avicennian philosophy in the Latin West. The article points out the structural bond with the Persian philosopher upon which Gundissalinus grounds his own speculation. This contribution stresses, in particular, (...) the important role played by Avicenna’s psychology, epistemology, and metaphysics in order to provide Gundissalinus with a different set of answers to at least two main questions. On the one hand, the problem of creatural existence and cosmological causation, concerning which Gundissalinus tends to doctrinally merge Avicenna with Ibn Gabirol. On the other hand, Avicenna’s influence is crucial for Gundissalinus’s attempt at elaborating a new system of knowledge, which was supposed to be able to include the new sciences made available by the translation movement, but that also needed to be internally organised through firm epistemological principles. Beside his crucial contribution as translator, Gundissalinus’s first philosophical encounter with the Avicenna paved the road for the subsequent reception of the Persian philosopher’s works, opening a hermeneutical perspective which would be pivotal for the thirteenth-century discussions on soul, knowledge, and being. This Article draws attention to a conceptual point that has been overlooked in recent discussions about the theoretical foundations of contract law. I argue that, rather than enforcing the obligations of promises, contract law concerns complaints against promissory wrongs. This conceptual distinction is easy to miss. If one assumes that complaints arise whenever an obligation has been violated, then the distinction does not seem meaningful. I show, however, that an obligation can be breached without giving rise to a valid complaint. (...) This Article illustrates the importance of this conceptual distinction by focusing first on the doctrine of substantive unconscionability. I claim that the doctrine can be best explained by the way in which a party who engages in exploitative behavior may lose her moral standing to complain. It is because such a party has lost her moral standing to complain that the law, through unconscionability doctrine, bars her from bringing a legal complaint. This explanation avoids the oft-issued charge of paternalism and it also offers benefits over an alternative state-oriented account developed recently by Seana Shiffrin. Using the conceptual distinction behind this account of unconscionability, this Article further argues that recent theoretical debates about the relationship between contract law and morality have been largely misconceived. Those debates have focused on whether contract law and morality impose parallel obligations. Once one appreciates the difference between imposing obligations and recognizing complaints, the comparison looks quite different. Contract law recognizes valid complaints against broken promises, much as morality recognizes moral complaints. (shrink)
