A long tradition of psychological research has explored the distinction between characteristics that are part of the self and those that lie outside of it. Recently, a surge of research has begun examining a further distinction. Even among characteristics that are internal to the self, people pick out a subset as belonging to the true self. These factors are judged as making people who they really are, deep down. In this paper, we introduce the concept of the true self and (...) identify features that distinguish people’s understanding of the true self from their understanding of the self more generally. In particular, we consider recent findings that the true self is perceived as positive and moral, and that this tendency is actor-observer invariant and cross-culturally stable. We then explore possible explanations for these findings and discuss their implications for a variety of issues in psychology. (shrink)

Metaphysical emergence has often been used to help understand the relationship between the entities of physics and the entities of the special sciences. What are the prospects of using metaphysical emergence within physics, to help understand the relationship between three-dimensional physical entities, and the non-three-dimensional entities that have been recently posited in certain interpretations of quantum mechanics and quantum gravity? This paper explores Jessica Wilson’s (2021) analysis of certain cases of metaphysical emergence in terms of degrees of freedom and raises (...) several questions that need to be answered in order to better understand whether this analysis can be used to handle cases of metaphysical emergence within physics. Children acquire complex concepts like DOG earlier than simple concepts like BROWN, even though our best neuroscientific theories suggest that learning the former is harder than learning the latter and, thus, should take more time (Werning 2010). This is the Complex- First Paradox. We present a novel solution to the Complex-First Paradox. Our solution builds on a generalization of Xu and Tenenbaum’s (2007) Bayesian model of word learning. By focusing on a rational theory of concept learning, we show that it (...) is easier to infer the meaning of complex concepts than that of simple concepts. (shrink)

This paper analyzes the determinants of women’s representation on boards of directors based on a panel of all privately owned or listed Danish firms with at least 50 employees observed during the period 1998–2010. We focus on the directors who are not elected by the employees and test three hypotheses on female board representation that we denote the female-led hypothesis, the tokenism hypothesis, and the pipeline hypothesis, respectively. We find evidence rejecting the female-led hypothesis. Firms with a female chairperson on (...) the board of directors tend to have significantly fewer other non-employee-elected female board members. We also find clear evidence of a tokenism behavior in Danish companies. The likelihood of enlarging the share of non-employee-elected female board members is significantly smaller if one, two, or more women have sat on the board of directors. Finally, the pipeline hypothesis is partly confirmed. The relation between the female pipeline of potentially qualified directors and female directors is weaker than the similar relation for males. Our findings offer insights to policy makers interested in promoting gender diversity within boardrooms. Our empirical evidence suggests that an important way to increase the female proportion of non-employee-elected board members is that more women reach top executive positions. (shrink)

In her paper, “The Non-Governing Conception of Laws,” Helen Beebee argues that it is not a conceptual truth that laws of nature govern, and thus that one need not insist on a metaphysical account of laws that makes sense of their governing role. I agree with the first point but not the second. Although it is not a conceptual truth, the fact that laws govern follows straightforwardly from an important (though under-appreciated) principle of scientific theory choice combined with a highly (...) plausible claim about the connection between scientific theory choice and theory choice in metaphysics. I present and defend this argument and then show how the resulting understanding of governance gives rise to an especially strong version of recent explanatory circularity arguments against Humeanism about laws of nature. Finally, I present three options for a further understanding of the governance relation that are compatible with my argument. (shrink)

Indigenous people (IP) have faced multiple difficulties in education. Indigenous students often do worse academically than non-indigenous student peers. These stated the low enrollment rates showed a dropout rate, absenteeism, repetition rates, literacy rate, and thus the educational outcomes, with retention and completion being two significant issues. Further, this study explores the lived experiences and challenges faced by indigenous high school students amidst the new normal education. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) The reason (...) why IP learners were not satisfied with their performance is that they cannot understand some of the lessons due to the language barrier. (2) IP learners are committed to finishing their studies, however, some of the students lack resources for studying, like gadgets for researching, and they do not have cell phones. And the other students may have gadgets or cellphones, but their internet connection is low or not accessible in some places at their location. (shrink)

In recent years, feminist scholarship on emotional labor has proliferated. I identify a related but distinct form of care labor, hermeneutic labor. Hermeneutic labor is the burdensome activity of: understanding and coherently expressing one’s own feelings, desires, intentions, and movitations; discerning those of others; and inventing solutions for relational issues arising from interpersonal tensions. I argue that hermeneutic labor disproportionately falls on women’s shoulders in heteropatriachal societies, especially in intimate relationships between women and men. I also suggest that some of (...) the gendered burdens of emotional labor that feminist scholars point out would better be described as hermeneutic labor. Drawing on feminist philosophy as well as findings from social psychology and sociology, I argue that the exploitation of women’s hermeneutic labor is a pervasive element of what Sandra Bartky calls the ‘micropolitics’ of intimate relationships. The widespread expectation that women are relationship maintenance experts, as well as the prevalence of a gendered demand-withdraw pattern of communication, leads an exploitative situation to appear natural or even desirable, even as it leads to women’s dissatisfaction. This situation may be considered misogynistic in Kate Manne’s sense, where misogyny is a property of social environments rather than a worldview. (shrink)

Historical explanations in evolutionary biology are commonly characterized as narrative explanations. Examples include explanations of the evolution of particular traits and explanations of macroevolutionary transitions. In this paper I present two case studies of explanations in accounts of pathogen evolution and host-pathogen coevolution, respectively, and argue that one of them is captured well by established accounts of time-sequenced narrative explanation. The other one differs from narrative explanations in important respects, even though it shares some characteristics with them as it is (...) also a population-level historical explanation. I thus argue that the second case represents a different kind of explanation that I call historical explanation of type phenomena. The main difference between the two kinds of explanation is the conceptualization of the explanandum phenomena as particulars or type phenomena, respectively. Narrative explanations explain particulars but also deal with generalization, regularities and type phenomena. Historical explanations of type phenomena, on the other hand, explain multiply realizable phenomena but also deal with particulars. The two kinds of explanation complement each other because they explain different aspects of evolution. (shrink)

Shepard’s (1987) universal law of generalisation (ULG) illustrates that an invariant gradient of generalisation across species and across stimuli conditions can be obtained by mapping the probability of a generalisation response onto the representations of similarity between individual stimuli. Tenenbaum and Griffiths (2001) Bayesian account of generalisation expands ULG towards generalisation from multiple examples. Though the Bayesian model starts from Shepard’s account it refrains from any commitment to the notion of psychological similarity to explain categorisation. This chapter presents the conceptual (...) spaces theory (Gärdenfors 2000, 2014) as a mediator between Shepard’s and Tenenbaum & Griffiths’ conflicting views on the role of psychological similarity for a successful model of categorisation. It suggests that the conceptual spaces theory can help to improve the Bayesian model while finding an explanatory role for psychological similarity. (shrink)

Tenenbaum and Griffiths (2001) have proposed that their Bayesian model of generalisation unifies Shepard’s (1987) and Tversky’s (1977) similarity-based explanations of two distinct patterns of generalisation behaviours by reconciling them under a single coherent task analysis. I argue that this proposal needs refinement: instead of unifying the heterogeneous notion of psychological similarity, the Bayesian approach unifies generalisation by rendering the distinct patterns of behaviours informationally relevant. I suggest that generalisation as a Bayesian inference should be seen as a complement to, (...) instead of a replacement of, similarity-based explanations. Furthermore, I show that the unificatory powers of the Bayesian model of generalisation can contribute to the selection of one of these models of psychological similarity. (shrink)

I argue that the way the world appears to be plays an important role in standard scientific practice, and that therefore the way the world appears to be ought to play a similar role in metaphysics as well. I then show how the argument bears on a specific first-order debate in metaphysics – the debate over whether there are composite objects. This debate is often thought to be a paradigm case of a metaphysical debate that is largely insulated from scientific (...) considerations, and is often disparaged or avoided by naturalistically inclined metaphysicians as a result. My argument below shows that this attitude is a mistake. The way in which metaphysical debates can be informed by our best science is more complex and far-reaching than is often acknowledged in the literature. (shrink)

In recent decades, interest in non-monogamous intimate relationships has grown rapidly. Polyamory, relationship anarchy, consensual or ethical non-monogamy, and more have become popular in academic and public discourse. These practices destabilize the privileging of heterosexual nuclear families and the assumption that romantic coupledom is the ultimate form of love. Non-monogamous approaches flout cultural norms of exclusivity by avowing that intimacy is compatible with multiple dyadic and/or multi-party relationships. The paper focuses on the problem of anthropodicy in the philosophical system of Hermann Cohen and its interpretation by Jacob Gordin (1896—1947). Gordin was one of the last followers of Cohen in Russia. He developes his interpretation in the lecture “Anthropodicy”, which was given in the Philosophical Circle at the Petrograd University in December 1921. For the study of the problem of anthropodicy he was apparently inspired by the discussions at the Free Philosophical Association in 1919—1921. Gordin places Cohen’s concept (...) of man in the wide intellectual context given by the ideas of the Russian religious philosophy, German classical philosophy, Neo-Kantianism, and the West European and Jewish mysticism (cabbala). Gordin compares Cohen’s anthropodicy with Vladimir Soloviev’s one and shows that there is a similarity in their approaches. Both philosophers point out that the justification of man is possible only in form of the justification of humanity and not as for Berdyaiev in form of the justification of personality. But Gordin uses Soloviev’s concept of all-unity and Berdyaiev’s concept of creativity in order to “improve” Cohen’s conception and to reveal the contribution of a person to the justification of humanity. Stronger as Cohen Gordin connects the programm of anthropodicy with individuality and underlines the participation of the individual in creating culture. (shrink)

Several philosophers and psychologists have characterized belief in conspiracy theories as a product of irrational reasoning. Proponents of conspiracy theories apparently resist revising their beliefs given disconfirming evidence and tend to believe in more than one conspiracy, even when the relevant beliefs are mutually inconsistent. In this paper, we bring leading views on conspiracy theoretic beliefs closer together by exploring their rationality under a probabilistic framework. We question the claim that the irrationality of conspiracy theoretic beliefs stems from an inadequate (...) response to disconfirming evidence and internal incoherence. Drawing analogies to Lakatosian research programs, we argue that maintaining a core conspiracy belief can be Bayes-rational when it is embedded in a network of auxiliary beliefs, which can be revised to protect the more central belief from disconfirmation. We propose that the irrationality associated with conspiracy belief lies not in a flawed updating method, but in a failure to converge toward wellconfirmed, stable belief networks in the long run. This approach not only reconciles previously disjointed views, but also points toward more specific descriptions of why agents may be prone to adopting beliefs in conspiracy theories. (shrink)

This chapter focuses on the relations between objective probabilities in physical theories at different levels. In general philosophy of probability, it is frequently assumed that a fundamental deterministic theory cannot support probabilistic phenomena at any higher level, or more generally that there cannot be non-trivial probabilities in higher-level theories that are not encoded in probabilities at the lower level. These assumptions face significant challenges from some well-understood physical theories – I focus on statistical mechanics and Bohmian mechanics – where a (...) deterministic description at some lower level gives rise to an effectively probabilistic theory at some higher level; in each case, constraints arising from an objective physical limitation on the acquisition of evidence concerning the lower level plays a crucial role in supporting the higher-level probabilities. The paper focuses on the problem of the “anthropological turn” in Russian Neo- Kantianism. There are three sources of this “anthropological turn”. The first one is the concept of man in German Neo-Kantianism which was developed on the basis of Kant’s ethics. The second one is the influence of Russian culture and history. The third is the state of Russian philosophy at the end of the 19th and the beginning of the 20th century. The Russian Neo-Kantians reflected closely on the (...) doctrine of Leo Tolstoi and on the existence of man in the contemporary historical changes and cataclysms. They conclude the freedom of man as his essence depends on the political state of society and its moral base. There is no genuine existence of man without social politics based on morality and the human ideal. (shrink)

Philosophical orthodoxy holds that pains are mental states, taking this to reflect the ordinary conception of pain. Despite this, evidence is mounting that English speakers do not tend to conceptualize pains in this way; rather, they tend to treat pains as being bodily states. We hypothesize that this is driven by two primary factors—the phenomenology of feeling pains and the surface grammar of pain reports. There is reason to expect that neither of these factors is culturally specific, however, and thus (...) reason to expect that the empirical findings for English speakers will generalize to other cultures and other languages. In this article we begin to test this hypothesis, reporting the results of two cross-cultural studies comparing judgments about the location of referred pains between two groups—Americans and South Koreans—that we might otherwise expect to differ in how they understand pains. In line with our predictions, we find that both groups tend to conceive of pains as bodily states. (shrink)

Traditional theists are, with few exceptions, global semantic realists about the interpretation of external world statement. Realism of this kind is treated by many as a shibboleth of traditional Christianity, a sine qua non of theological orthodoxy. Yet, this love affair between theists and semantic realism is a poor match. I suggest that everyone (theist or no) has compelling evidence drawn from everyday linguistic practice to reject a realist interpretation of most external world statements. But theists have further reason to (...) forswear this view, because those who insist on global semantic realism open themselves to the charge of hubris of a theologically inappropriate kind. If the arguments in this paper are sound, then neither God nor any of us have reason to apply a realist interpretation to all or even most statements about the external world. (shrink)

I distinguish between two different ways in which the wavefunction might play a role in explaining the behavior of quantum systems and argue that a satisfactory account of quantum ontology will make it possible for the wavefunction to explain the behavior of quantum systems in both of these way. I then show how this constraint has the potential to impact two quite different accounts of quantum ontology.

Imaginative resistance refers to a phenomenon in which people resist engaging in particular prompted imaginative activities. Philosophers have primarily theorized about this phenomenon from the armchair. In this paper, we demonstrate the utility of empirical methods for investigating imaginative resistance. We present two studies that help to establish the psychological reality of imaginative resistance, and to uncover one factor that is significant for explaining this phenomenon but low in psychological salience: genre. Furthermore, our studies have the methodological upshot of showing (...) how empirical tools can complement the predominant armchair approach to philosophical aesthetics. (shrink)

Richard Watson maintains that deep ecology suffers from an internal contradiction and should therefore be rejected. Watson contends that deep ecology claims to be non-anthropocentric while at the same time is committed to setting humans apart from nature, which is inherently anthropocentric. I argue that Watson’s objection arises out of a fundamental misunderstanding of how deep ecologist’s conceive of the ‘Self.’ Drawing on resources from Buddhism, I offer an understanding of the ‘Self’ that is fully consistent with deep ecology, and (...) does not lead to the anthropocentric contradiction that Watson identifies. The paper will proceed as follows: First, I articulate Watson’s objection, and briefly discuss the traditional deep ecology position. Next, I turn to a discussion of the ‘Self’ and show that there are conceptions of human nature that are not separate from ‘Nature.’ It will thus be shown that deep ecology is not inconsistent and need not be rejected. Against the standard view that the Republic’s division of goods distinguishes between intrinsic and instrumental value, a growing number of scholars have correctly argued that goods possess value δι᾽ αὑτό in virtue of some of their causal effects. However, these scholars have not yet given a convincing and principled account of what it means to be valuable διὰ τὰ γιγνόμενα ἀπ’ αὐτοῦ such that some effects can contribute to the value a good has δι᾽ αὑτό. Many people do not know or believe there is a God, and many experience a sense of divine absence. Are these (and other) “divine hiddenness” facts evidence against the existence of God? Using Bayesian tools, we investigate *evidential arguments from divine hiddenness*, and respond to two objections to such arguments. The first objection says that the problem of hiddenness is just a special case of the problem of evil, and so if one has responded to the problem of evil then (...) hiddenness has no additional bite. The second objection says that, while hiddenness may be evidence against generic theism, it is not evidence against more specific conceptions of God, and thus hiddenness poses no epistemic challenge to a theist who holds one of these more specific conceptions. Our investigation leaves open just how strong the evidence from hiddenness really is, but we aim to clear away some important reasons for thinking hiddenness is of no evidential significance at all. Busca-se apresentar a leitura de MacIntyre sobre o emotivismo moral presente no último capítulo de A Short History of Ethics, suas críticas a essa concepção ética nos capítulos dois e três de After Virtue, os argumentos de Bruce Waller e Nicholas Unwin em defesa de uma reformulação do emotivismo moral e as críticas (...) de John Lemos a essa sugestão. Espera-se que o texto contribua na apresentação dos principais argumentos do debate entre MacIntyre e o emotivismo moral, a fim de servir de orientação para outras discussões na área da metaética. Proponents of the predictive processing (PP) framework often claim that one of the framework’s significant virtues is its unificatory power. What is supposedly unified are predictive processes in the mind, and these are explained in virtue of a common prediction error-minimisation (PEM) schema. In this paper, I argue against the claim that PP currently converges towards a unified explanation of cognitive processes. Although the notion of PEM systematically relates a set of posits such as ‘efficiency’ and ‘hierarchical coding’ into a (...) unified conceptual schema, neither the frameworks’ algorithmic specifications nor its hypotheses about their implementations in the brain are clearly unified. I propose a novel way to understand the fruitfulness of the research program in light of a set of research heuristics that are partly shared with those common to Bayesian reverse engineering. An interesting consequence of this proposal is that pluralism is at least as important as unification to promote the positive development of the predictive mind. (shrink)

In this article, I argue that mass incarceration belongs to a category of social status interventions by which the modern state either withholds the ordinary protections and benefits of the law from outlawed groups or subjects them to private punishment based on their mere membership in those groups. In the US these groups include immigrants and resident Latinos, the homeless, the poor and poor blacks, sex workers, and ex-convicts. Outlawry is a fundamentally anti-democratic practice that cannot be justified in terms (...) of deterrence and is incompatible with public safety. (shrink)

In the literature on assertion, there is a common assumption that having the knowledge that p is a sufficient condition for having the epistemic right to assert that p—call this the Knowledge is Sufficient for Assertion Principle, or KSA. Jennifer Lackey has challenged KSA based on several counterexamples that all, roughly, involve isolated secondhand knowledge. In this article, I argue that Lackey’s counterexamples fail to be convincing because her intuition that the agent in her counterexamples both has knowledge and do (...) not have the epistemic right to assert is wrong. The article will progress as follows: In section 2, I present Lackey’s argument. In section 3, I suggest some more general reasons for doubting that the agent in her counterexamples actually has knowledge. I then show that from a virtue theoretic and Edward Craig’s practical explication of knowledge perspectives the agent in Lackey’ s counterexamples does not know. Since the agent in Lackey’s counterexamples does not have knowledge, she has failed to convincingly prove that KSA is false. In section 4, I conclude by suggesting that, at most, what Lackey’s counterexamples demonstrate is a problem with a simplistic evidentialist and/or process reliabilist epistemology. (shrink)

In this paper we offer a new argument for the existence of God. We contend that the laws of logic are metaphysically dependent on the existence of God, understood as a necessarily existent, personal, spiritual being; thus anyone who grants that there are laws of logic should also accept that there is a God. We argue that if our most natural intuitions about them are correct, and if they are to play the role in our intellectual activities that we take (...) them to play, then the laws of logic are best construed as necessarily existent thoughts -- more specifically, as divine thoughts about divine thoughts. We conclude by highlighting some implications for both theistic arguments and antitheistic arguments. (shrink)

This paper examines how professionals (N = 32) working on artificial intelligence (AI) view structural AI ethics challenges like injustices and inequalities beyond individual agents' direct intention and control. This paper answers the research question: What are professionals’ perceptions of the structural challenges of AI (in the agri-food sector)? This empirical paper shows that it is essential to broaden the scope of ethics of AI beyond micro- and meso-levels. While ethics guidelines and AI ethics often focus on the responsibility of (...) designers and the competencies and skills of designers to take this responsibility, our results show that many structural challenges are beyond their reach. This result means that while ethics guidelines and AI ethics frameworks are helpful, there is a risk that they overlook more complicated, nuanced, and intersected structural challenges. In addition, it highlights the need to include diverse stakeholders, such as quadruple helix (QH) participants, in discussions around AI ethics rather than solely focusing on the obligations of AI developers and companies. Overall, this paper demonstrates that addressing structural challenges in AI is challenging and requires an approach that considers four requirements: (1) multi-level, (2) multi-faceted, (3) interdisciplinary, and (4) polycentric governance. Esse livro, resultado de minhas pesquisas no Mestrado de Filosofia da Universidade Federal da Paraíba, apresenta e discute a perspectiva teórica dooyeweerdiana sobre a ordem de uma sociedade complexa. A filosofia de Herman Dooyeweerd pode contribuir para a reflexão e ação cristã em uma sociedade moderna e plural. Em Dooyeweerd, é possível encontrar uma teoria política e social abrangente para pensar e atuar no ambiente público, rejeitando orientações (...) ideológicas secularistas. Herman Dooyeweerd pode nos ajudar a refletir sobre política e sociedade na medida em que nos faz reconhecer princípios estruturais na realidade criada por Deus que estruturam cada esfera e relação social em seu âmbito de soberania. Em contraponto ao positivismo e ao historicismo, Dooyeweerd nos indica caminhos para compreender as normas divinas para cada centímetro quadrado da existência. Além de denunciar o comprometimento religioso do imanentismo das ideologias políticas, Dooyeweerd tem muito a dizer sobre como pensar política e sociedade na ordem da história. (shrink)

Recent accounts of coercion can be mapped onto two different axes: whether they focus on the situation of the coercee or the activities of the coercer; and whether or not they depend upon moral judgments in their analysis of coercion. Using this analysis, I suggest that almost no recent theories have seriously explored a non-moralized, coercer-focused approach to coercion. I offer some reasons to think that a theory in this underexplored quadrant offers some important advantages over theories confined to the (...) other quadrants. In particular I suggest that much of our interest in coercion depends on facts about the coercer, such as the sorts of powers coercers must possess to be able to coerce, and on the coercer's intention in using those powers to constrain or alter the coercee's activities. Although a number of responses to sophistic immoralism were made, one argument, in fact coming from a pair of sophists, has not received the attention it deserves. According to the argument I call Immortal Repute, self-interested individuals should reject immorality and cultivate virtue instead, for only a virtuous agent can (...) win the sort of everlasting reputation that makes a life truly admirable and successful. The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

In the Foundations of Mathematics, Ramsey attempted to amend Principia Mathematica’s logicism to meet serious objections raised against it. While Ramsey’s paper is well known, some questions concerning Ramsey’s motivations to write it and its reception still remain. This paper considers these questions afresh. First, an account is provided for why Ramsey decided to work on his paper instead of simply accepting Wittgenstein’s account of mathematics as presented in the Tractatus. We enjoy sounds. What about silence: the absence of sound? Certainly not all, but surely many of us seek out, attend to, and appreciate silence. But, if nothing is there, then there is nothing to possess aesthetic qualities that might engage aesthetic interest or reward aesthetic attention. This is at least puzzling, perhaps even paradoxical. In this paper, I attempt to dispel the sense of paradox and provide a way to understand aesthetic appreciation of silence. A história da filosofia é a história das ideias. Porém, para Herman Dooyeweerd, a história da filosofia imanentista é a história de antíteses teóricas radicadas em dialéticas religiosas insolúveis. O objetivo do presente artigo é apresentar o conceito de “motivos básicos religiosos” no pensamento de Herman Dooyeweerd. Em primeiro lugar, será apresentado a concepção de religião em Dooyeweerd e, em seguida, serão apresentados o conceito e o desenvolvimento dos “motivos básicos religiosos” no pensamento ocidental. As conclusões do texto são que (...) esse conceito contribui em demonstrar que há uma dimensão tácita e comunitária na reflexão filosófica e que a impossibilidade de síntese teórica entre polos de “motivos básicos religiosos” imanentistas diz respeito à “dialética religiosa”. Objetiva-se expor o pensamento de Herman Dooyeweerd (1894-1977), prolífico jusfilósofo holandês, no que diz respeito à maneira como destaca o aspecto jurídico da realidade e formula sua concepção de enciclopédia da ciência do Direito. Problematiza-se em que medida a teoria dooyeweerdiana permite o desenvolvimento de um conceito de Direito relevante para a teoria da decisão judicial. Neste afã, após exposição sintética das bases de seu pensamento, verticaliza-se o estudo do aspecto jurídico da realidade e da noção-base de sua Enciclopédia da (...) Ciência do Direito. Explora-se a original perspectiva filosófica dooyeweerdiana sobre a positivação do direito e a interpretação jurídica, ambas limitadas seja pelo inafastável núcleo distintivo do aspecto jurídico (a retribuição), seja pelo dever de considerar o todo dos aspectos da experiência humana e das esferas sociais envolvidas. Conclui-se que o conceito de enciclopédia jurídica em Dooyeweerd, à luz de uma densa e intrigante filosofia cosmonômica, enriquece sobremaneira a clássica discussão jusfilosófica que envolve o papel do direito positivo e os limites da interpretação jurídica, na medida em que oferece valioso prisma integrativo do aspecto jurídico frente aos demais aspectos da experiência humana, colaborando para uma visão jurídica não reducionista, preservadora da irredutibilidade do Direito e conferidora de limites mais claros à decisão judicial. A pesquisa é qualitativa, eminentemente bibliográfica, tendo sido utilizado o método hipotético dedutivo. (shrink)

Introdução: Hans Kelsen (1881-1973), juspositivista austríaco, e Herman Dooyeweerd (1894-1977), jusfilósofo neerlandês, foram pensadores contemporâneos que presenciaram o avanço do poder totalitário do Estado expresso por meio de normas jurídicas. Ambos se preocuparam em discutir sobre a relação entre Estado e direito, mas se afastaram na formulação de suas jusfilosofias: Kelsen defendeu uma concepção em que o Estado se tornou a personificação da ordem jurídica, Dooyeweerd distinguiu o direito da estrutura do Estado. Objetivo: analisar os comprometimentos teóricos e os problemas (...) político-jurídicos do pensamento de Hans Kelsen a partir da filosofia de Herman Dooyeweerd. Problemáticas: 1) A relação entre Estado e direito em Hans Kelsen é incapaz de proteger a sociedade civil e os indivíduos do poder do Estado, como afirmam os jusnaturalistas?; 2) Toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista, como defende Hans Kelsen?. Hipóteses: 1) Jusnaturalistas estão corretos ao afirmarem que a Teoria Pura do Direito de Kelsen possibilita um ilimitado poder ao ente estatal face à sociedade civil, sendo incapaz de oferecer-lhe subsídios teóricos para sua proteção; 2) Kelsen não está certo ao entender que toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista. Justificativas da pesquisa: 1) Analisa, a partir da crítica transcendental dooyeweerdiana, se os compromissos assumidos por Kelsen acerca da realidade o levaram a uma teoria reducionista capaz de tornar a sociedade desprotegida diante do poder do Estado; 2) Investiga se a teoria dooyeweerdiana tem capacidade de superar a tópica jusnaturalismo e juspositivismo. Resultados: 1) Como alegam os jusnaturalistas, a perspectiva política e jurídica de Kelsen, que reduz o direito ao aspecto lógico e delega as discussões de justiça ao âmbito político, não possibilita à sociedade uma proteção jurídica ao poder normativo do Estado; 2) A concepção político-jurídica dooyeweerdiana demonstra ser possível uma filosofia que encontra princípios limitadores à produção do direito na ordem da realidade e reconhece a pluralidadesocial devido à abertura da experiência histórica. Conclusão: sociedades democráticas profundamente polarizadas precisam descobrir normas objetivamente dispostas na realidade capazes de gerar consenso político e positivação legitimada, não por uma metafísica atemporal ou pela vontade impositiva de uma elite, mas pelo reconhecimento de que há uma ordem capaz de gerar mais benefícios para o bem comum. Dr Miranda Anderson is an Honorary Fellow in History, Classics and Archaeology at the University of Edinburgh and an Associate Lecturer at the Open University. She has held several prestigious fellowships and was principal investigator of an AHRC-funded project, titled ‘The Art of Distributed Cognition’, which involved collaboration with the Talbot Rice Gallery. Her work has investigated the relations between cognition and culture, particularly literary works, challenging the boundaries between disciplines and engaging with numerous contemporary science, technology and society (...) (STS) questions. In this perspective article, she evokes the ‘fission-fusion’ concept on which she has been working for some years now – a concept that contributes to debates surrounding the issue of identity by drawing on the arts, humanities, social sciences, and natural sciences. Discussions of sexual ethics often focus on the wrong of treating another as a mere object instead of as a person worthy of respect. On this view, the task of sexual ethics becomes putting the other’s subjectivity above their status as erotic object so as to avoid the harms of objectification. Ward and Anderson argue that such a view disregards the crucial, moral role that erotic objecthood plays in sexual encounters. Important moral features of intimacy are disclosed through the (...) experience of being an erotic object for another, as well as in perceiving another as an erotic object. Drawing on phenomenology, especially the insights of Simone de Beauvoir, Ward and Anderson argue that erotic encounters are shaped by the human condition of ambiguity, where being an object for others is intertwined with bodily agency. Because sexual agency is complex in this way, theories of sexual ethics and responsibility must widen their focus beyond transparent communication and authoritative expressions of will. (shrink)

In this chapter, I describe my “post-diagnosis” experiences as the parent of an autistic child, those years in which I tried, but failed, to make sense of the overwhelming and often nonsensical information I received about autism. I argue that immediately after being given an autism diagnosis, parents are pressured into making what amounts to a life-long commitment to a therapy program that (they are told) will not only dramatically change their child, but their family’s financial situation and even their (...) entire mode of existence. Moreover, despite information overload, many treatment programs for autism rely on empty jargon and make completely unrealistic promises, so parents are left feeling overwhelmed and panicked. Even well respected therapy programs encourage parents to spend liberally. Indeed, autistic therapists, who help construct what I refer to as the Culture of Autism, advise parents to commit to a minimum of 35 to 45 hours of intensive therapy every week. The implications are clear: for a parent who works full-time, their autistic child becomes a second full-time job. Autism is big business right now, and therapists are pushing parents to the brink of desperation. So it is not too surprising that there is a desperate cry for a more permanent solution—which is why researchers seek to cure autism. But there are two ways to conceptualize cure. A Therapeutic Cure model (TC) conceives of a cure as a beneficial treatment for the patient that eliminates or ameliorates the harms of the disease or condition. But the notion of a therapeutic cure for autism is highly implausible, given the complexities of autism. Indeed, at this point, the vast majority of researchers have come to the conclusion that the idea of a therapeutic cure for autism is simply a non-starter. Therefore the bulk of research seeking a cure for autism focuses instead on a second approach, which I refer to as the Negative Eugenics Cure model (NEC). With this model, the intention is to eliminate the disease or condition without regard for the health or well-being of the organism carrying the disease or condition. So, with regard to autism, researchers are focusing on identifying genetic markers for autism that can be detected in utero, or in embryos, so that autistic fetuses can be eliminated and autism eradicated by preventing the existence of autistic individuals. I review both models and argue that both fail to provide convincing arguments that the “solution” either offers is desirable. Both rest on the assumption that autism renders a life not worth living which, all things considered, is false. Instead of pushing to cure autism, an idea pervasive in this Culture of Autism, I contend that autistics are individuals with lives worth living. Moreover, rather than expend millions on research to search for the means to eliminate autism, we should instead expend our resources to ensure autistic individuals have access to support they may need. If the phenomenology of autism were better understood and appreciated, the panicked demand for a cure for autism might abate and perhaps autism could be seen as having value in and of its own right. O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A conclusão (...) é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. A concretização da liberdade exige participação nos assuntos públicos e vida ativa na esfera pública. (shrink)
