ABSTRACT In Consciousness and Fundamental Reality, Philip Goff argues that the case against physicalist views of consciousness turns on ‘Phenomenal Transparency’, roughly the thesis that phenomenal concepts reveal the essential nature of phenomenal properties. This paper considers the argument that Goff offers for Phenomenal Transparency. The key premise is that our introspective judgments about current conscious experience are ‘Super Justified’, in that these judgments enjoy an epistemic status comparable to that of simple mathematical judgments, and a better epistemic status than (...) run of the mill perceptual judgments. After presenting the key ideas in the ‘Super Justification Argument’, I distinguish two Super Justification theses, which vary according to the kind of introspective judgments that they take to be Super Justified. I argue that Goff’s case requires ‘Strong Super Justification’, according to which a wide range of introspective judgments about conscious experience are Super Justified. Unfortunately, it turns out that Strong Super Justification is implausible and not well-supported by examples. In contrast, a weaker Super Justification thesis does not require anything like Phenomenal Transparency and, indeed, can be explained by physicalistic accounts of phenomenal concepts. (shrink)

Erik Wielenberg recently invoked the parent-child analogy in an argument against Christian theism. The argument relies on the claim that a loving parent would never allow her child to feel abandoned in the midst of what feels like gratuitous suffering. In this paper, I offer three clear counterexamples to Wielenberg’s central premise. At the same time, a successful counterexample does not a robust theology of suffering make. To that end, and with a careful eye towards anti-theodical concerns, I defend the (...) need for a more proactive Christian philosophical examination of the role of suffering in a meaningful life. According to phenomenal transparency, phenomenal concepts are transparent where a transparent concept is one that reveals the nature of that to which it refers. What is the connection between phenomenal transparency and our concept of a subject of experience? This paper focuses on a recent argument, due to Philip Goff, for thinking that phenomenal transparency entails transparency about subjecthood. The argument is premissed on the idea that subjecthood is related to specific phenomenal properties as a determinable of more specific determinates. (...) I argue that the argument fails, which opens the door for one to endorse phenomenal transparency while denying transparency about the concept of a subject of experience. I draw out the consequences of this for certain versions of the combination problem for panpsychist metaphysics and moreover argue that rejecting the transparency of subjecthood does not undermine anti-physicalist arguments premissed on considerations relating to phenomenal transparency. In his recent The Parmenidean Ascent, Michael Della Rocca develops a regress-theoretic case, reminiscent of F.H. Bradley’s famous argument in Appearance and Reality, against the intelligibility of relations and in favor of a monistic conception of reality. I argue that Della Rocca illicitly supposes that “internal” relations – in one sense of that word – lead to a “chain” regress, a regress of relations relating relations and relata. In contrast, I contend that if “internal” or grounded relations lead to a (...) regress at all, it is a kind of “fission” regress within the relata themselves, and that a chain regress for relations only arises, if at all, for so-called “external” relations, relations not grounded in their relata. In this way, I contend that Della Rocca pursues a regress for so-called “internal” or grounded relations that only arises, if at all, for so-called “external” relations, relations not grounded in their relata. I compare Della Rocca’s case against relations with Bradley’s reasoning in Appearance and Reality, and suggest in this context that Bradley may, perhaps, have the upper hand. (shrink)

Jaegwon Kim argued that nonreductive physicalism faces the “exclusion problem” for higher-level causation, mental causation in particular. Roughly, the charge is that given the presumptive ubiquity of physical causation, there cannot be irreducible mental causes for physical effects. Since there are mental causes, Kim concluded that nonreductive physicalism should be rejected in favor of a more reductionist alternative according to which mental causes are just physical causes differently described. But why should mental causes be “excluded” in this way? Unfortunately, Kim (...) had less to say about this than one might expect. After reviewing some of Kim’s proposals, I suggest that the exclusion problem should be premised on nothing more or less than Occamist, simplicity-based considerations. I apply this conception of the exclusion problem to some prominent responses to Kim’s critique of nonreductive physicalism and argue that this conception mandates reconsidering the success of these responses. Philosophers working in the nascent field of ‘experimental philosophy’ have begun using methods borrowed from psychology to collect data about folk intuitions concerning debates ranging from action theory to ethics to epistemology. In this paper we present the results of our attempts to apply this approach to the free will debate, in which philosophers on opposing sides claim that their view best accounts for and accords with folk intuitions. After discussing the motivation for such research, we describe our methodology of (...) surveying people’s prephilosophical judgments about the freedom and responsibility of agents in deterministic scenarios. In two studies, we found that a majority of participants judged that such agents act of their own free will and are morally responsible for their actions. We then discuss the philosophical implications of our results as well as various difficulties inherent in such research. (shrink)

The concept of truthmaking, the idea that when a statement is true, there is typically something about the world in virtue of which it is true, has garnered much interest in recent metaphysics. Often, the motivation has been the thought that truthmaking can provide a new perspective on an important issue. This paper evaluates the claim that truthmaking can play a substantive role in defining an unproblematic notion of emergence. For despite playing an important role in philosophical discourse over the (...) past 100 years, it has often been thought that there is something mysterious about the notion of emergence. It has recently been argued, however, that once emergent properties are characterized as those that, while “ontologically dependent” are yet needed as truthmakers emergence and emergent properties prove unproblematic. In response, I argue that there is reason to doubt that truthmaking can play an important role in formulating an unproblematic yet recognizable notion of emergence. I argue that it is consistent with truthmaking being unable to play a substantive role in emergentism that truthmaking can play a more significant role in characterizing an attractive middle ground between reductive and nonreductive physicalism. In 2022, at an interdisciplinary conference on Creation and the Imago Dei, Biola psychologist Liz Hall posed a powerful challenge to the philosophers and theologians in the room. In the face of the “already and not yet” nature of Christian theology, she put forth the need for a “theology of tension.” Over and over again, while reading Biblical Philosophy, I was reminded of this challenge. The features Johnson puts forth as emblematic of Hebraic Philosophy can help in this respect, in (...) two clear ways: First, retrospectively, Johnson’s categories are useful for diagnosing both the philosophical missteps targeted by critiques of theodicy and the features held in common by some of the more successful accounts. Second, going forward, the convictions and modes of argument central to Hebraic philosophy may help guide future philosophical responses to suffering. In general, I believe that the philosophical problems related to suffering are especially well-suited to responses that are pixelated, networked, mysterianist, creationist, transdemographic, and ritualist. Perhaps Hebraic philosophy can succeed where Hellenist philosophy has struggled: in addressing the tension that arises from the experience of suffering in a world governed by a loving, providential, sovereign God. While I am largely in favor of Johnson’s Hebraic philosophy, I will conclude by breaking from his view in one important respect. Johnson presents the Biblical view as substantially contrasting with the correspondence theory affirmed by many contemporary philosophers. I will end by pushing back on this claim. On Johnson’s own account, the Hebraic notion of truth is determined with reference to the divinely designed order. I propose that we understand the Hebraic notion of truth as degrees of correspondence to this divinely ordered, absolute reality. (shrink)

In this dissertation I examine the ontological and systematic basis of Hegel’s social and political philosophy. I argue that the structures of the will, discussed in paragraphs five through seven of the Philosophy of Right, present the key for understanding the goal and the argumentative structure of that work. Hegel characterizes the will in terms of the oppositions between the universal and the particular, the infinite and the finite, and the indeterminate and the determinate. Ultimately, he argues that we must (...) grasp the will as the unity of these oppositional moments. The Philosophy of Right presents an extended attempt to grasp this unity. -/- In order to central problem presented by the structure of the will, I argue that we must first recognize the will as the highest instantiation of the more general structures that constitute the notion. On my interpretation, the term ‘notion’ designates Hegel’s doctrine of substance. More specifically, this term presents his conception of substance in terms of categories normally associated with human subjectivity, in terms of representation and purposive action. -/- The will presents the highest or truest instantiation of the notion. Various notions can be ranked along a spectrum in accordance with their degree of success at resolving the basic problem facing all objects – namely the problem of integrating or essentially relating identity and difference through self-constituting activity. The unification of identity and difference presents the central problem or paradox of Hegel’s philosophy. It is a paradox that takes many forms. In this dissertation, I show how change, the structure of judgment, and the nature of the object all exhibit this paradox. I also show how Hegel’s doctrine of the notion develops as a direct response to this paradox. Additionally, I argue that Hegel’s account of the structure of the will – as the unity of the universal and the particular, the unity of the infinite and the finite, and the unity of the indeterminate and the determinate – presents the highest manifestation of the paradox that arises when we seek to explain the unity of identity and difference. Philosophers often suggest that their theories of free will are supported by our phenomenology. Just as their theories conflict, their descriptions of the phenomenology of free will often conflict as well. We suggest that this should motivate an effort to study the phenomenology of free will in a more systematic way that goes beyond merely the introspective reports of the philosophers themselves. After presenting three disputes about the phenomenology of free will, we survey the (limited) psychological research on the experiences (...) relevant to the philosophical debates and then describe some pilot studies of our own with the aim of encouraging further research. The data seem to support compatibilist descriptions of the phenomenology more than libertarian descriptions. We conclude that the burden is on libertarians to find empirical support for their more demanding metaphysical theories with their more controversial phenomenological claims. (shrink)

Incompatibilists believe free will is impossible if determinism is true, and they often claim that this view is supported by ordinary intuitions. We challenge the claim that incompatibilism is intuitive to most laypersons and discuss the significance of this challenge to the free will debate. After explaining why incompatibilists should want their view to accord with pretheoretical intuitions, we suggest that determining whether incompatibilism is in fact intuitive calls for empirical testing. We then present the results of our studies, which (...) put significant pressure on the claim that incompatibilism is intuitive. Interested in art, we tend to be interested in works of art. We seem to encounter works of art all the time, and—setting aside certain relatively abstruse problems in ontology—we seem to have little difficulty in recognizing them for what they are. That there are works of art seems obvious and unproblematic. Quite so, I think. But reflection on what has to be the case if there are to be works of art shows that some quite demanding conditions have to (...) be met. Some will find those conditions too demanding: if I am right, that means that they should not admit that there are any works of art, and they will have to give some other account of what might be involved when we think we are dealing with a work of art. For myself, I think the conditions are not too demanding: their interest comes in what they show us about the nature of artistic ‘media’, and about what is involved in being a great artist. (shrink)

In the pedagogy of Pancasila-based State, the Church recognizes the existence and function of State as the instrument of God to prevent/punish evil and strive for justice of all people. Church and state relationships inherently contain potential conflicts. This is because both the Church and State have a thorough claim on human life, in the sense that all the facets of human life have a spiritual and political dimension. The tension of the relationship between Church and State should not be (...) extinguished by subordinating one to the other, both in the form of „Church-State‟ and „State-Church‟. Therefore, in addition to rejecting totalitarianism and authoritarianism, Church and State must also reject theocracy, ecclesiocracy and a secular State. Responsibilities of the State‟s responsibility to the Church are mutual responsibilities and reciprocal cooperation and compatible with the pedagogy of Pancasila-based State in Indonesia, while the responsibility of the Church to the State is not mutual responsibilities and reciprocal cooperation, but asymmetric (being-for not being-with). In this dissertation, I examine the implications of the problem of mental causation and what David Chalmers has dubbed the “ hard problem of consciousness” for competing accounts of the mind. I begin, in Chapter One, with a critical analysis of Jaegwon Kim’s Physicalism, or Something Near Enough. (2005) There, I maintain that Kim’s ontology cannot adequately address both the problem of mental causation and the “ hard problem of consciousness.” In Chapter Two, I examine the causal pairing problem for (...) substance dualism. I demonstrate both that the substance dualist can respond to the argument at no great cost, and that the pairing problem applies, with equal force, to the irreducible qualia posited on Kim’s account. Chapters Three and Four are devoted to what I take to be the central argument against any kind of dualism: the causal exclusion argument. In Chapter Three, I examine dualistic responses to the exclusion argument that grant the causal closure of the physical world. I note that these responses, though technically adequate, are nevertheless theoretically unpalatable. In addition to requiring the dualist to adopt unconventional attitudes towards causation, responses of this variety also have the unfortunate result of rendering libertarian freedom impossible. Finally, in Chapter Four, I turn my attention to the question of causal closure. I maintain that the causal closure of the physical world, though widely affirmed, is nevertheless extraordinarily difficult to support. In light of Hempel’s Dilemma, causal closure is either false, compatible with dualistic interaction, or unacceptably stipulative. There is, I maintain, no causal closure principle up to the tasks required by the causal exclusion argument. For that reason, I conclude that the dualist ought not to worry about causal closure. This paper discusses and evaluates a recent argument for the conclusion that an attractive variety of Russellian monism ought to be regarded as a form of physicalism. According to this line of thought, if the Russellian’s “inscrutable” properties are held to ground not only experience, but also the physical structure of the world—and in this sense are not “experience-specific”—they thereby have an unproblematic place in physicalist metaphysics. I argue, in contrast, that there can be a sense in which the Russellian’s (...) inscrutables are experience-specific in a way that a physicalist probably ought to find objectionable, even if they play some role other than grounding experience. This will be the case, I argue, if certain worlds are taken to be possible, as they sometimes have: worlds of “bare structure” and worlds with what might be called “swapped inscrutables”. In this way, I claim that accepting certain possibilities has consequences for how one should understand the nature of the Russellian’s inscrutables and the place they have in physicalist metaphysics. In Morris I presented in outline a new interpretation of the famous ‘substance argument’ in Wittgenstein’s Tractatus. The account I presented there gave a distinctive view of Wittgenstein’s main concerns in the argument, but did not explain in detail how the argument works: how its steps are to be found in the text, and how it concludes. I remain convinced that the interpretation I proposed correctly identifies the main concerns which lie behind the argument. The development of possible worlds semantics for modal claims has led to a more general application of that theory as a complete semantics for various formal and natural languages, and this view is widely held to be an adequate (philosophical) interpretation of the model theory for such languages. We argue here that this view generates a self-referential inconsistency that indicates either the falsity or the incompleteness of PWS.

Entre estos trabajos se encontraba Los Elementos de Euclides. Los Elementos fueron cuidadosamente traducidos durante el califato de Al-Ma’mūn por el matemático Mohammed (...) ibn-Musa Al-Khwārizmī, autor de Al-jabr wa’l muqābalah, quien sentó los fundamentos de la disciplina que más tarde sería conocida como álgebra y quien, en la primera parte de su obra, nos proporciona tres métodos para resolver tres tipos de ecuaciones que llama “ecuaciones combinadas”. A lo largo de este artículo se ofrecen argumentos para sostener que los métodos para resolver estas ecuaciones constituyen una reinterpretación, en el terreno algebraico, de los teoremas 6, 7 y 8 del segundo libro de Los Elementos de Euclides. Mi objetivo es dar respuesta a la siguiente pregunta: ¿Qué lectura de Los elementos Euclides posibilitó la emergencia del álgebra en el mundo árabe? Para responderla necesario explorar el acercamiento que los árabes tuvieron con el Libro II de Los Elementos, con el fin de proponer una interpretación de los posibles factores que los llevaron a formular el álgebra. The mind-brain identity theory, the thesis that sensations are identical with properties or processes of the brain, was introduced into contemporary discussion by U.T. Place, Herbert Feigl, and J.J.C Smart in the 1950s. Despite its widespread rejection in the following decades, the identity theory has received several carefully articulated defenses in recent years. Aside from developing novel responses to well-known arguments against the identity theory, contemporary identity theorists have argued that the epistemological resources available to support the adoption of identities (...) are more plentiful than has often been supposed; further, they have argued that mind-brain identities allow for the resolution of otherwise intractable explanatory puzzles about the phenomenal properties of experience. From an epistemological perspective, identity theorists have thus argued that a central reason for believing theoretical identities—both mind-brain identities as well as more mundane identities such as water = H2O—stems from the explanatory power that they confer. Yet from an explanatory perspective, identity theorists have maintained that identities cannot themselves be explained; indeed, they have maintained that it is hardly intelligible to request an explanation for an identity. This paper considers these ideas draws out an important tension between them. The central claim is that insofar as identity theorists insist on the explanatorily efficacy of identities, they should concede that there is a good sense in which theoretical identities can be explained. However, it is moreover argued that this concession is not especially problematic and, indeed, ought to be welcomed by identity theorists. (shrink)

The way that nonhuman animals and other nonhuman sentient beings are portrayed in the Christian-based Harry Potter series, C. S. Lewis's Narnia series, and Tolkien's Middle Earth stories is discussed from a Christian animal liberationist perspective.Middle Earth comes closest to a liberationist ideal, in that vegetarianism is connected with themes of power, healing, and spirituality. Narnia could be described as a more enlightened welfarist society where extremes of animal cruelty are frowned upon, but use of animals for food is acceptable. (...) In contrast, the more recent Harry Potter series portrays a less enlightened attitude toward human and nonhuman animals. Animals are treated merely as ends, vegetarianism is unheard of, and the view that even iconic species have intrinsic worth is ridiculed. (shrink)

We develop a reading of Moore’s “Proof of an External World” that emphasizes the connections between this paper and Moore’s earlier concerns and strategies. Our reading has the benefit of explaining why the claims that Moore advances in “Proof of an External World” would have been of interest to him, and avoids attributing to him arguments that are either trivial or wildly unsuccessful. Part of the evidence for our view comes from unpublished drafts which, we believe, contain important clues concerning (...) Moore’s aims and intent. While our approach to PEW may be classified alongside other broadly "metaphysical" readings, we believe that a proper recognition of the continuity in Moore’s philosophical concerns and strategies across his philosophical career shows that the customary distinction between "epistemological" and "metaphysical" interpretative approaches to PEW is at best superficial. In this paper it is argued that the conjunction of linguistic ersatzism, the ontologically deflationary view that possible worlds are maximal and consistent sets of sentences, and possible world semantics, the view that the meaning of a sentence is the set of possible worlds at which it is true, implies that no actual speaker can effectively use virtually any language to successfully communicate information. This result is based on complexity issues that relate to our finite computational ability to deal with (...) large bodies of information and a strong, but well motivated, assumption about the cognitive accessibility of meanings of sentences ersatzers seem to be implicitly committed to. It follows that linguistic ersatzism, possible world semantics, or both must be rejected. (shrink)

En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. In both cases, practice of criticism that subjectifies desubjugating, poses the question of liberty. (shrink)

Plato’s Socrates holds that we always have reason to be just, since being just is essential for living a happy and successful life. In Book II of Plato’s Republic, Socrates’ main interlocutor, Glaucon, raises a vivid and powerful challenge to this claim. He presents the case of Gyges, a Lydian shepherd who possesses a ring that gives him the power of invisibility. Glaucon’s contention is that Gyges does not have reason to be just in this circumstance, since being just will (...) not promote his happiness. Thus, the argument poses the following challenge: what reason do we have to be just, particularly in circumstances where we can get away with injustice? In this essay, we describe Glaucon’s challenge, highlight its similarity to challenges offered by other skeptical figures in the history of philosophy, namely, Hobbes’ Foole and Hume’s sensible knave, and present three broad lines of response. Much of the recent philosophical discussion about free will has been focused on whether compatibilists can adequately defend how a determined agent could exercise the type of free will that would enable the agent to be morally responsible in what has been called the basic desert sense :5–24, 1994; Fischer in Four views on free will, Wiley, Hoboken, 2007; Vargas in Four views on free will, Wiley, Hoboken, 2007; Vargas in Philos Stud, 144:45–62, 2009). While we agree with Derk Pereboom (...) and others that the compatibilist’s burden should be properly understood as providing a compelling account of how a determined agent could be morally responsible in the basic desert sense, the exact nature of this burden has been rendered somewhat unclear by the fact that there has been no definitive account given as to what the basic desert sense of moral responsibility amounts to. In Sect. 1 we set out to clarify the compatibilist’s burden by presenting our account of basic desert moral responsibility—which we call retributivist desert moral responsibility for purposes of clarity—and explain why it is of central philosophical and practical importance to the free will debate. In Sect. 2 we employ a thought experiment to illustrate the kind of difficulty that compatibilists of any stripe are likely to encounter in attempting to explain how determined agents can exercise the kind of free will needed for retributivist desert moral responsibility. When comparing alternative courses of action, modern military decision makers often must consider both the military effectiveness and the ethical consequences of the available alternatives. The basis, design, calibration, and performance of a principles-based computational model of ethical considerations in military decision making are reported in this article. The relative ethical violation (REV) model comparatively evaluates alternative military actions based upon the degree to which they violate contextually relevant ethical principles. It is based on a set of specific ethical principles (...) deemed by philosophers and ethicists to be relevant to military courses of action. A survey of expert and non-expert human decision makers regarding the relative ethical violation of alternative actions for a set of specially designed calibration scenarios was conducted to collect data that was used to calibrate the REV model. Perhaps unsurprisingly, the survey showed that people, even experts, disagreed greatly amongst themselves regarding the scenarios’ ethical considerations. Despite this disagreement, two significant results emerged. First, after calibration the REV model performed very well in terms of replicating the ethical assessments of human experts for the calibration scenarios. The REV model outperformed an earlier model that was based on tangible consequences rather than ethical principles, that earlier model performed comparably to human experts, the experts outperformed human non-experts, and the non-experts outperformed random selection of actions. All of these performance comparisons were measured quantitatively and confirmed with suitable statistical tests. Second, although humans tended to value some principles over others, none of the ethical principles involved—even the principle of not harming civilians—completely overshadowed all of the other principles. Street-level bureaucrats are a fundamental part of the implementation process of any policy. This study provides an examination of the factors that shape the behavior of street-level bureaucrats at the frontlines of policy implementation. This study investigates how rebelliousness generates an impact on the discretion of street-level bureaucrats and to what extent client meaningfulness plays a moderating factor. It utilizes a survey questionnaire distributed among inspectors of the Department of Labor in the Ministry of Human Resources of Malaysia (n=241). The (...) result of this study demonstrates that rebelliousness has a negative relationship with discretion, and client meaningfulness has a direct positive correlation with discretion. However, the relationship between rebelliousness and discretion is stronger with a high level of client meaningfulness. The objective of this study is to examine street-level bureaucrat behavior through the lens of Lipsky's theory which will provide an answer to the broad question of the factors that contribute to the existence of an imperfect implementation process. This study sheds light on the importance of client meaningfulness in moderating the behavior of street-level bureaucrats while interacting with inspectees. The novelty of this study is by highlighting two main constructs that are likely contributing to the implementation process by directly and indirectly impacting bureaucrats’ discretion: rebelliousness, and client meaningfulness. A brief biographical entry on Charles Morris in the Lexicon Grammaticorum: A Bio-Bibliographical Companion to the History of Linguistics.

Abstract: One of the institutional highlights of the encounter between Austrian “wissen¬schaftliche Philosophie” and French “philosophie scientifique” in the first half of the 20th century was the “First International Congress for Unity of Science” that took place 1935 in Paris. In my contribution I deal with an episode of the philosophical mega-event whose protagonist was the American philosopher and semiotician Charles William Morris. At the Paris congress he presented his programme of a comprehensive, practice-oriented scientific philosophy and, in a (...) more elaborated version he published it two years later in Logical Positivism, Pragmatism and Scientific Empiricism (Morris 1937). Morris aimed at a synthesis of formalism, pragmatism, and traditional empiricism that combined the virtues of these accounts while avoided their shortocmings. The core of approach was a comprehensive theory of the concept of meaning. Through an analysis of the concept of meaning he sought to sort out the existing differences and the options for a possible future rapprochment between logical empiricism and pragmatism. Against the overly narrow logical empiricist understanding of philosophy as the syntax of the language of science Morris argued for a “scientific pragmatism” that comprised four levels: (1) Philosophy as Logic of Science, (2) Philosophy as Clarification of Meaning (Peirce), (3) Philosophy as Empirical Axiology (Dewey), and (4) Philosophy as Empirical Cosmology (Whitehead). En la Constitución de la República de Polonia del 2 de abril de 19971 se reconocía el carácter objetivo de ciertos valores y un cognoscitivismo axiológico. Si tomamos las disposiciones constitucionales en serio tenemos que aceptar que algunas valoraciones morales o que algunas proferencias [utterances] valorativas pueden ser verdaderas o falsas y que nos informan acerca de una realidad objetiva. Por otro lado, en la teoría del derecho polaca y en los cursos universitarios de lógica para abogados se encuentran definiciones (...) de la justificación axiológica de las normas y de normas axiológicas (normas que poseen una justificación axiológica) que presuponen que ningún valor es objetivo y que no pueden ser conocidos — se presupone un no-cognoscitivismo axiológico. O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

This is a book review of Errol Morris's book on Kuhn, The Ashtray (Or the Man Who Denied Reality).

El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. Información Financiera (CINIIF) 13 – Programas de Fidelización de Clientes-, CINIIF 15 – Acuerdos para la Construcción de Inmuebles-, CINIIF 18 – Transferencias de Activos procedentes de Clientes-, e Interpretación desarrollada por el Comité de Interpretaciones de Normas Internacionales de Contabilidad (SIC) 31 – Ingresos-Permutas de Servicios de Publicidad-. A tales efectos, analizaremos los principales lineamientos contables establecidos por la NIIF 15, a través del modelo de las cinco etapas y de otros aspectos que a nuestro entender son importantes presentando algunos casos prácticos para un mejor entendimiento. En su discusión “Obras de ficción, formas de conciencia y literatura”, Josep Corbí formula una serie de críticas certeras a mis ideas sobre la distinción que he hecho entre ficción y no ficción en Relatar lo ocurrido como invención. En esta nota de respuesta expongo primero de forma sucinta el núcleo de esas ideas y después proporciono las que considero las razones más decisivas para adoptarlas, a pesar de las dificultades que señala Corbí.

In his paper “Obras de ficción, formas de conciencia y literatura”, Josep Corbí raises a few sharp objections to my distinction between fiction and non-fiction, as I formulate it in my recently published Relatar lo ocurrido como invención. In this response, I present first in a compact form such ideas, and then I try to answer to Corbí’s criticisms.

Desde un punto de vista postmetafísico y a partir de los argumentos que nos proporciona un autor como Ludwig Wittgenstein, trataremos de defender la tesis de que las normas en general cobran su carácter normativo de la responsabilidad que se atribuye a cada agente cuando, al actuar en sociedad, se liga a los compromisos que sostienen la posibilidad de que esa acción sea común. Esos compromisos, ya que no pueden responder ante una instancia ajena a los agentes sociales , habrán (...) de tener el cariz práctico de todo lo que atañe en exclusiva a los afanes de los humanos entre sí. Una regla no nos pide que respondamos de su cumplimiento o no, pero nosotros sí que podemos pedirnos cuentas unos a otros de ese cumplimiento o vulneración a partir de la responsabilidad compartida en la vida social en que pululan tales reglas; de hecho, a aquellos que las incumplen gravemente, siempre podemos apartarlos definitivamente de nuestra vida en sociedad adjudicándoles «maldad» o «locura» persistente. Al caer así en la cuenta de que las reglas tienen sólo este género de responsabilidad mutua, una nueva regla se nos puede hacer plausible junto a las demás: la de tolerar la posibilidad de otros compromisos con diferentes reglas en otros contextos que hayan generado otras responsabilidades diferentes a las nuestras. The subject of this paper is Charles Morris’ semiotic theory that has as one of its major projects the unification of all sciences of signs. However, since the above project has proven to be unsuccessful, we will try to examine here the reasons that led to this. Accordingly, we will argue that to transcend the particularities of individual disciplines that he wanted to unify, Morris had to make certain ontological assumptions, instead of theoretical and methodological ones, that they (...) could share. However, because the 'sign' as an ontological category could in our view only be established if we follow the principles of the pragmatic philosophical tradition, we will try to show that the reasons for this failure should be primarily sought in different effects that consistent application of the pragmatic principles has in each of them (primarily in linguistics and the philosophy of language). On the other hand, this should enable us to draw several important conclusions regarding Morris’ project: namely, that his failure does not have to mean giving up semiotics as a potentially key discipline in approaching some fundamental philosophical problems, but also that it would demand return to the original semiotics developed in Peirce’s works. Por consiguiente, se resolverá la siguiente cuestión: ¿cuál es la función ética del derecho, en el marco del ejercicio de una conciencia y consciencia construidas por agentes morales? Se concluye que la coacción legítima debe fundarse en la protección universal de toda persona y en el sometimiento a objeciones por parte de los ciudadanos, con el propósito (...) de revisar la legitimidad y legalidad de las normas jurídicas. The Morris water maze has been put forward in the philosophy of neuroscience as an example of an experimental arrangement that may be used to delineate the cognitive faculty of spatial memory (e.g., Craver and Darden, Theory and method in the neurosciences, University of Pittsburgh Press, Pittsburgh, 2001; Craver, Explaining the brain: Mechanisms and the mosaic unity of neuroscience, Oxford University Press, Oxford, 2007). However, in the experimental and review literature on the water maze throughout the history of its (...) use, we encounter numerous responses to the question of “what” phenomenon it circumscribes ranging from cognitive functions (e.g., “spatial learning”, “spatial navigation”), to representational changes (e.g., “cognitive map formation”) to terms that appear to refer exclusively to observable changes in behavior (e.g., “water maze performance”). To date philosophical analyses of the water maze have not been directed at sorting out what phenomenon the device delineates nor the sources of the different answers to the question of what. I undertake both of these tasks in this paper. I begin with an analysis of Morris’s first published research study using the water maze and demonstrate that he emerged from it with an experimental learning paradigm that at best circumscribed a discrete set of observable changes in behavior. However, it delineated neither a discrete set of representational changes nor a discrete cognitive function. I cite this in combination with a reductionist-oriented research agenda in cellular and molecular neurobiology dating back to the 1980s as two sources of the lack of consistency across the history of the experimental and review literature as to what is under study in the water maze. O propósito deste trabalho é analisar a estrutura e discutir a aplicação da(s) lógica(s) deôntica(s) na representação de normas jurídicas. Após uma apresentação desta(s) lógic(s) e, em particular, do sistema de von Wright e da SDL (Standard Deontic Logic), veremos as dificuldades de se aplicar uma lógica à análise do direito positivo: as regras da lógica devem permitir realizar sobre as normas formalizadas somente os tipos de inferência e operaçôes lógicas intuitivamente feitas pelos juristas, ou seja, a reconstrução lógica do (...) direito positivo não se trata de uma tarefa de criação do direito, mas uma tarefa de representação daquilo que o conceito de direito usual reconhece como tal. Para ilustrar estas dificuldades, abordaremos as propostas de Carlos Alchourrón em artigo de 1975, “Condicionalidad y la representación de las normas jurídicas”. (shrink)

Una de las tesis que tradicionalmente han sido defendidas por la tradición del positivismo jurídico es la tesis coactiva, según la cual el derecho consiste en un conjunto de normas coactivas, en el sentido de impuestas por medio de la fuerza. Pero, sin abandonar esta corriente, ha habido históricamente diversas maneras de entender las relaciones entre derecho y fuerza. Si, pues, hasta comienzos del s. XX era opinión común la idea de que el derecho constituía un conjunto de mandatos o (...) normas de conducta cuya eficacia se garantizaba a través de la amenaza del uso de la fuerza coactiva a los transgresores de aquéllas; a lo largo del siglo pasado, empero, algunos autores muy destacados dieron en sostener la opinión de que la fuerza disponible por jueces y funcionarios venía a constituir sustancialmente el objeto mismo de toda regulación jurídica. Según esta última concepción, el derecho tendría primordialmente la función de articular las condiciones de legitimidad para el uso de la fuerza, designando a los sujetos a los que se encomienda tal uso y determinado los casos y modalidades en los que pueda utilizarse. Entre quienes sustentan la primera tesis, que afirma que la fuerza constituye la garantía del derecho, es lugar común citar a Austin y, a menudo, se cita también a Jhering. Entre los defensores de la segunda tesis común es habitual mencionar a Kelsen, Olivecrona y Ross, habiéndose sustanciado una polémica entre Bobbio y Olivecrona en punto a determinar si fuera menciona Olivecrona o fue Kelsen el primero en adoptarla. Sin embargo, es problemático incluir a Jhering dentro del primer grupo y no dentro del segundo, en cuyo caso habría que atribuirle la primera formulación histórica de la tesis. Este trabajo, de carácter histórico, parte de la citada polémica y trata de verificar la constancia de la segunda tesis en las obras no sólo de Kelsen y Olivecrona, sino sobre todo de Jhering. In this paper, I present two ways of conceiving a genealogical explanation of the concept of knowledge. The first one is through the epistemic state of nature hypothesis developed by Edward Craig, according to which knowledge is understood as a concept evolved from the concept of a good informant. After considering Craig’s project, I draw a parallel between this approach and Miranda Fricker’s value-laden account of the same concept. Then, I present and discuss Fricker’s social take on Craig’s genealogy, in (...) which she suggests that the notions of a good informant and of knowledge are necessarily dependent on the establishment of a credibility norm, and that this norm should be viewed as inherently political. Lastly, I defend an illustration, through Kristie Dotson’s work, of how both genealogical approaches could explain and offer solutions to failings in the normativity of our epistemic systems.
