El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. Resumo A transferência de embriões em bovinos tem o objetivo principal de aprimorar o melhoramento genético e otimizar a reprodução bovina A importância dessa prática é destacada pela sua contribuição para a maximização de características desejadas nos rebanhos, como qualidade de carne, eficiência reprodutiva e resistência a condições ambientais adversas. Este trabalho descreve e analisa as técnicas avançadas utilizadas nesse processo, incluindo seleção genômica, sexagem de embriões, produção in vitro, protocolos não cirúrgicos, sincronização reprodutiva, criopreservação de embriões e uso de (...) marcadores de fertilidade. A compreensão aprofundada dessas técnicas é fundamental para o sucesso da transferência de embriões, bem como para a capacidade de personalizar e aprimorar as características específicas dos rebanhos. Enfatizando a importância da expertise de profissionais especializados em reprodução bovina, este trabalho busca oferecer uma visão abrangente das práticas atuais e avanços tecnológicos nesse campo. Ao unir ciência e prática, torna-se importante a comparação de técnicas, bem como relacionar resultados eficientes para promover qualidade genética, trazer a sustentabilidade e envolver a técnica em um cenário atualizado da indústria. Palavras-chave: Embriões; Hormônio; Reprodutor. -/- Abstract Embryo transfer into cattle has the main objective of improving genetic improvement and optimizing bovine reproduction. The importance of this practice is highlighted by its contribution to maximizing desired characteristics in herds, such as meat quality, reproductive efficiency and resistance to environmental conditions adverse. This work describes and analyzes the advanced techniques used in this process, including genomic selection, embryo sexing, in vitro production, non-surgical protocols, reproductive synchronization, embryo cryopreservation and the use of fertility markers. An in-depth understanding of these techniques is critical to the success of embryo transfer, as well as the ability to customize and enhance specific herd characteristics. Emphasizing the importance of the expertise of professionals specialized in bovine reproduction, this work seeks to offer a comprehensive view of current practices and technological advances in this field. When combining science and practice, it becomes important to compare techniques, as well as relate efficient results to promote genetic quality, bring sustainability and involve the technique in an updated industry scenario. There can be no doubt that discrimination based on sex, race, ethnicity, religion or beliefs should not be tolerated in academia. Surprisingly, however, in recent years, policies of Diversity, Inclusion and Equity(DIE), officially introduced to counteract discrimination, have increasingly led to quite the opposite result: the exclusion of individuals who do not share a radical 'woke' ideology on identity politics (feminism, other gender activisms, critical race theory, etc.), and to the suppression of the academic freedom to discuss such dogmas. This (...) subversion of academia ― disguised Trojan-horse style as universal human rights advocacy ― is unacceptable because academia must be politically neutral and protect freedom of speech, a cornerstone of professional scholarly activity without which universities as we know them will slowly but surely suffocate. -/- Our purpose here is to put together some particularly illustrative cases of such repression in a single book, testifying to a ubiquitous trend within western culture, irreducible to a few isolated complaints. Defensores do princípio da precaução propõem com frequência mudanças nas práticas científicas, para que elas facilitem o mesmo objetivo do princípio: evitar ameaças incertas ao ambiente ou à saúde humana. A ciência deveria ser uma ciência precautória. Apesar da importância prática da ciência precautória e da sua proximidade com os debates sobre ciência e valores, ela ainda não foi sistematicamente examinada. Neste artigo, pretende-se contribuir para a literatura sobre a ciência precautória de dois modos: sistematizando sua literatura prévia e propondo (...) uma definição de um de seus elementos principais, a precaução epistêmica, como uma orientação específica para a gestão de riscos indutivos. Conclui-se com algumas objeções que tal definição levanta, bem como caminhos de pesquisas futuras para abordá-las. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. Abstract. Following the tracks of Ryle and based upon the theory of complex systems, we shall develop a characterization of action-based consciousness as an embodied, embedded, selforganized process in which action and dispositions occupy a special place. From this perspective, consciousness is not a unique prerogative of humans, but it is spread all around, throughout the evolution of life. We argue that artificial systems such as robots currently lack the genuine embodied embeddedness that allows the type of self-organization that is (...) relevant to consciousness. -/- Sommario. Seguendo la linea tracciata da Ryle e basata sulla teorie dei sistemi complessi, svilupperemo una caratterizzazione della coscienza basata sull’azione come un processo incarnato, situato e auto organizzante nel quale le azioni e le disposizioni occupano un ruolo decisivo. Da questo punto di vista, la coscienza non è una prerogativa esclusiva degli esseri umani, ma è diffusa nel mondo naturale grazie ai processi evolutivi. Noi sosteniamo che i sistemi artificiali come i robot attualmente sono carenti del tipo di relazione con la corporeità e con l’ambiente che consente quel tipo di auto-organizzazione indispensabile per l’emergenza della coscienza. Rigidity does interesting philosophical work, with important consequences felt throughout metaphysics, epistemology, philosophy of mind, and so on. The authors’ aim in this article is to show that rigidity has yet another role to play, with surprising consequences for the problem of free will and determinism, for the phenomenon of rigidity has the upshot that some metaphysically necessary truths are up to us. The significance of this claim is shown in the context of influential arguments against free will. The authors (...) show that some virtually indisputable inference rules employed in formulations of the Consequence Argument, as well as in fatalistic arguments, fail with a variety of counter-examples. Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. El presente trabajo confronta el abordaje de la cuestión del sujeto en Louis Althusser y Ludwig Wittgenstein. La comparación se produce porque el tratamiento del lenguaje de la filosofía del segundo Wittgenstein es particularmente apropiado para abordar la intervención del discurso en el proceso por el cual la ideología interpela a los individuos como sujetos, según Althusser. El descentramiento del sujeto obliga a repensar la dimensión de la agencia, y con ella, la de la política. Tanto Wittgenstein como Althusser desembocan (...) en una encrucijada: negación teórica de la noción de sujeto y reconocimiento de la existencia paradójica de la misma en la práctica. Ello implica deconstruir el par "determinismo-libertad" sobre el que se asienta la pregunta por la agencia. Sobre el final retomamos el trabajo de Michel Pêcheux sobre los efectos retroactivos del discurso, lo que implica un replanteo del vocabulario de la determinación, prominente en los escritos althusserianos. -:-:-:-:--:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-ABSTRACT:- The present paper compares Ludwig Wittgenstein’s and Louis Althusser’s approach to the problem of subject. This comparison is motivated by the fact that second Wittgenstein’s approach to language is particularly appropriate to think of the intervention of discourse in the process of ideological interpellation which, according to Althusser,constitutes individuals as subjects. The decentering of the involved subject requires rethinking the dimension of agency and, consequently, of politics. Both, Wittgenstein and Althusser, end in a crossroads: they refuse theoretical prominence to the notion of the subject, but at the same time they recognise the practical priority of this notion, which gives it a sort of paradoxical existence. This implies deconstructing the pair “determinism–liberty” where the priority of agency is located. We end with the work of Michel Pêcheux on the retroactive effects of discourse, that entail (in agreement with Wittgenstein) rethinking the vocabulary of determination, prominent in Althusserian writings. One important objection to the Condition Of ReasonNable Epistemic Access (CORNEA) is that it is incompatible with inductive evidence. This objection, however, relies on a counterfactual interpretation of CORNEA, and Wykstra and Perrine have shown that CORNEA need not be interpreted in that way, but rather in terms of conditional probability. Here, we show that there is an important gap in this recent response to the counterfactual-based criticism of CORNEA. We argue that the main response to this criticism ultimately depends (...) on a specific semantics for counterfactual conditionals. More specifically, it ultimately depends on the denial of the conditional excluded middle principle. We then investigate and suggest a hitherto unknown defense of CORNEA’s counterfactual interpretation. (shrink)

In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. In debates concerning the consequence argument, it has long been claimed that [McKay, T. J., and D. Johnson. 1996. “A Reconsideration of an Argument Against Compatibilism.” Philosophical Topics 24 (2): 113–122] demonstrated the invalidity of rule (β). Here, I argue that their result is not as robust as we might like to think. First, I argue that McKay and Johnson's counterexample is successful if one adopts a certain interpretation of ‘no choice about’ and if one is willing to deny the (...) conditional excluded middle principle. In order to make this point I demonstrate that (β) is valid on Stalnaker's theory of counterfactuals. This result is important and should not be neglected, I argue, because there is a particular line of objection to the revised formulations of the consequence argument that does not succeed against the original version. Special issue: "Henri Bergson. Creative Evolution and Philosophy of Life." -/- I read the genealogy of the concept of energy through Bergson's Creative Evolution to argue that, historically, energy and its proto-concepts are grounded in spatialized notions of time. Bergson's work not only demands that we rethink energy and its relation to time, it also allows us to see that the concept of energy as we know it depicts time and materiality as a numerical multiplicity, which effaces the differences in (...) kind which are characteristic of energy transformations and real duration. To make this case, I first provide an analysis of Bergson’s concept of the cinematographical mechanism of thought, which splits duration into a composition of distinct states strung together by the idea of an impersonal becoming. Bergson claimed that this is the epistemological model for both ancient philosophy and modern science, meaning that it is also the epistemological ground within which energy concepts in western philosophy and science have been theorized. I then show how Bergson offers a way to overcome this model of theorizing through his method of intuition, and how these conclusions might be extended to future energy concepts. Thus, I argue that 1) Bergson’s work on duration allow us to interpret the genealogy of energy as the history of attempts to provide an account of change in terms of spatialized notions of time; 2) that his work offers a way of incorporating historicity into our understanding of energy; and 3) that thinking energy in the context of duration offers the possibility of conceptualizing energy as change. La tesis de la privacidad linguitica nace con el gesto fundador de la filosofía moderna que apoya toda legitimidad en la subjetividad y la conciencia. Ello da origen a dos problemas filos�ficos fundamentales, concernientes al mundo y al solipsismo. El siglo XX creyó encontrar en el lenguaje una salida a estos problemas. Wittgenstein es allí una pieza clave. Sin embargo las interpretaciones más influyentes de Wittgenstein enfocaron la crítica del lenguaje privado de tal modo que la salida debía permanecer en (...) el terreno epistemológico de las garantías o criterio de corrección (Malcolm, Fogelin, Kenny, Canfield, Tugendhat). Sostenemos que la interpretación propuesta por Kripke se apoya un un agudo diagnóstico de la fuente de estas dificultades, dándose cuenta que la refutación del lenguaje privado requería abandonar toda una concepción, la del realismo, que afectaban por igual al lenguaje privado y al público. Su argumentación, centrada en la semántica, irradia consecuencias más allá de la misma. Su "solución escéptica" al establecer que los juicios de corrección, entendidos como básicos y primitivos, sólo poseen sentido en el marco de una comunidad uniforme en sus juicios, coloca al discurso filosófico en un nuevo terreno. Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

Las heroínas trágicas deberán enfrentarse, de manos atadas, a la caída de Troya, a ser sorteadas entre los jefes del ejército griego como botines de guerra y a los asesinatos de los jóvenes Astianacte y Políxena. Partiendo de esos hechos, se pretende analizar, atendiendo a diferentes motivos y prestando cuidadosa atención a la argumentación dramática, la caracterización trágica de cada (...) una de ellas y las similitudes o diferencias que comparten en su sufrimiento. We usually don’t acknowledge social mediation when speaking about subjective experiences in day-to-day life, which relies instead on a unitary and essentialist notion of identity. I initially explore this statement by examining how Kant changes his view on singular-universal relation from the first to the third Critique. A closer look at the reflexive judgment and how it states singularity as a non-conceptualised event follows from that. I then argue in favour of an affinity between an aesthetic notion of singularity, such (...) as found in the third Critique, and the political mobilisation of subjective experiences. (shrink)

We explore Peirce’s pragmatic conception of sign action, as a distributed and emergent view of cognition and exemplify with the emergence of classical ballet. In our approach, semiosis is a temporally distributed process in which a regular tendency towards certain future outcomes emerges out of a history of sign actions. Semiosis self-organizes in time, in a process that continuously entails the production of more signs. Emergence is a ubiquitous condition in this process: the translation of signs into signs cannot be (...) inferred from the properties of the components of a semiotic triad alone, but has to take into account a complex interaction between a micro-semiotic and macro-semiotic level of description. This interaction can be understood as an interplay of potentialities and tendencies, or upward constitutive determinative relations and downward selective determinative relations. According to this view, emergence is a central defining condition of processes of meaning. Ballet is a sign in action. The emergence of classical ballet is a self-regulatory process, in which a system of different kinds of cognitive artifacts (musical, bodily/motor, spatial/architectonic) and agents obtained a stable semiotic relation throughout many phases of development between the 16th and the 19th Century. One case is the development of the verticality of dance in classical ballet as a semiotic relation connecting proscenium arch stages, dancing bodies, and audiences. This development is micro-semiotically determined by the spatial constraints of the proscenium arch stage, and macro-semiotically determined by a historical construction of the dancing body as a sign within a network of semiotic chains, such as the intersemiotic regulation of body of the dancer by principles coming from painting. This is not only the emergence of actual meaning, but also the emergence of an open-ended field of potential and general meanings, an autonomous tendency of development. To say that ballet, as sign action, emerges, is to say that cognitive artifacts such as dancer’s bodies, stages and audience’s point of view, musical compositions, costumes, all sorts of supporting institutions, etc, constitute a niche for sign action, interacting according to tendencies of development that didn’t exist before. The paper makes a twofold contribution. Firstly, it advances a preliminary account of the conditions that need to obtain for constitutional rights to be democratic. Secondly, in so doing, it defends precommitment-based theories from a criticism raised by Jeremy Waldron—namely, that constitutional rights do not become any more democratic when they are democratically adopted, for the people could adopt undemocratic policies without such policies becoming democratic as a result. The paper shows that the reductio applies to political rights, yet not (...) to non-political rights, such as reproductive, environmental, or privacy rights. The democratic status of the former is process-independent. The latter, by contrast, are democratic precisely when they are adopted by democratic means. (shrink)

The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. This paper aims to map the different theoretical options related to the Precautionary Principle (PP). Great part of the literature on it can be systematized by answering to three different questions: is there a basic structure in the PP? If so, in which interpretation of the PP does this structure express itself? Finally, are its damage or knowledge conditions fixed or adjustable? The first question separates realist from non-realist approaches. The second question allows us to discriminate monist, dualist, or pluralist (...) positions in relation to the three interpretations of the PP: decision rule, procedural requirement, or epistemic rule. Finally, the third question distinguishes rigid from non-rigid formulations of the principle. Based on this mapping, one can not only navigate through the different formulations of the PP present both in official documents and in specialized literature, but also deflect some of its common objections, and understand Hans Jonas’ eventual connection with PP. Notwithstanding, this mapping does not capture other important themes attached to PP, which motivates a final distinction between narrow and broader forms of PP. (shrink)

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. La obra es un estudio de una de las nociones fundamentales en la filosofía de Gadamer, el concepto de aplicación. Se intenta dar cuenta de la manera en que dicho concepto viene a solucionar, o tal vez sería mejor decir, a disolver, en la reflexión del siglo XX, el problema que enfrentaban las ciencias históricas en el siglo XIX para convertirse en conocimiento objetivo. Dicho problema consistía en dos importantes dificultades vinculadas entre sí: la imposibilidad de disponer de un objeto (...) independiente, el pasado “tal cual ocurrió” para confrontar la adecuación de las visiones del mismo constituidas desde el presente, por un lado, y la imposibilidad de erradicar la perspectiva del presente (intereses, ideologías, etc.)en los relatos históricos. Para abordar este problema, Gadamer acomete nada menos que una revisión de las categorías fundamentales en las cuales se inserta esta dificultad, esto es, las nociones de conocimiento, realidad y verdad modeladas, a través de Kant, de acuerdo a la perspectiva de la moderna ciencia de la naturaleza. Un paso fundamental será entonces examinar el problema del valor cognitivo del arte, esto es, elucidar las nociones de realidad y experiencia a partir de la experiencia artística, para extender luego estas conclusiones a la historia y el lenguaje. En el marco de esta revisión se perfila el concepto de aplicación, el cual destaca que nuestra condición de agentes históricos, insertos en una tradición y en una comunidad lingüística, no es un obstáculo, sino justamente la condición que hace posible que podamos comprender lo diferente a lo propio, ya sea en la forma de la alteridad histórica, lingüística o meramente personal. La tesis de la obra que presentamos es que la estructura de la aplicación, con la consecuente historicidad que acarrea, se presenta de manera semejante tanto en las macro-estructuras de la comprensión (comprensión de textos, de la tradición, del arte) como en las estructuras de un nivel inferior o más básico, como la realización de juicios y la comprensión de conceptos, punto que se elabora, en esta obra, a través de una comparación con las ideas del segundo Wittgenstein. This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. Aproximaciones a la escuela francesa de epistemología Los problemas que dominan a la epistemología pueden contextualizarse históricamente como una forma de racionalidad filosófica. La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. Los trabajos de este libro esperan problematizar este y otros ejes, explorando las perspectivas de los ?clásicos? de la escuela francesa en epistemología (Bachelard, Canguilhem, Althusser, Foucault, etc.), las relaciones entre los mismos y los diálogos que cabe establecer entre estos y otras corrientes de pensamiento. Despite renewed interest in work, philosophers have largely ignored self-employment. This neglect is surprising, not just because self-employment was central to classic philosophizing about work, but also given that half of the global workforce today, including one in seven workers in OECD countries, are self-employed. We start off by offering a definition of self-employment, one that accounts for its various forms while avoiding misclassifying dependent self-employed workers as independent contractors, and by mapping the barriers to becoming and remaining self-employed (section (...) 2). We then examine five arguments why governments ought to promote self-employment, despite the forgone opportunities to promote employee work instead that this often entails (sections 3-7): the argument from job creation, the argument from job satisfaction, the argument from independence, the argument from occupational freedom, and the argument from subsistence under non-ideal circumstances. Some of these are unconvincing, we argue, but others are not. Although the strength of the latter arguments hangs on various context-dependent conditions, such that they need to be carefully weighed against considerations of efficiency and equality, they nonetheless offer compelling pro tanto reasons to promote, and not just to protect, self-employment. In a recent paper in this Journal San Pedro I formulated a conjecture relating Measurement Independence and Parameter Independence, in the context of common cause explanations of EPR correlations. My conjecture suggested that a violation of Measurement Independence would entail a violation of Parameter Independence as well. Leszek Wroński has shown that conjecture to be false. In this note, I review Wroński’s arguments and agree with him on the fate of the conjecture. I argue that what is interesting about (...) the conjecture, however, is not whether it is true or false in itself, but the reasons for the actual verdict, and their implications regarding locality. In this paper, I defend a non-mechanistic interpretation of Kant's philosophy of nature. My interpretation contradicts the robust tradition of reading Kant as a mechanist about nature – or as someone who endorses the view that we can know the internally purposive causality characteristic of organisms has no place in nature. By attending closely to Kant's remarks about the possibility of internal purposiveness in nature and to key premises from Kant's arguments in the Antinomy of Teleological Judgment, we shall see (...) that it is not only plausible, but preferable, to believe that internally purposive things (i.e., organisms) exist in nature. Making room for such a belief leaves Kant with a philosophy of nature that simultaneously aligns with and surpasses the philosophies of nature offered up by his Early Modern predecessors. (shrink)

Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. Habit in semiosis can be modeled both as a macro-level in a hierarchical multi-level system where it functions as boundary conditions for emergence of semiosis, and as a cognitive niche produced by an ecologically-inherited environment of cognitive artifacts. According to the first perspective, semiosis is modeled in terms of a multilayered system, with micro functional entities at the lower-level and with higher-level processes being mereologically composed of these lower-level entities. According to the second perspective, habits are embedded in ecologically-inherited environments (...) of signs that co-evolve with cognition. Both descriptions offer a novel approximation of Peirce’s semiotics and theoretical findings in other areas (hierarchy theory, evolutionary biology), suggesting new frameworks to approach the concept of habit integrated with its role in semiosis. This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, coercively enforced, (...) hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Se intenta extraer de esta aproximación una distinción entre la filosofía como práctica teórica ideológica y como práctica teórica crítica. The discussion regarding the political consequences of Wittgenstein's thought has focused on the possibility of building critical approaches to the legitimacy, amplitude, strength, etc. of the social sphere. However, bringing Wittgenstein close to a materialist position as understood by L. Althusser leads to a different understanding of critique, linked to the deconstruction of the philosophical discourse that attempts to unify and hierarchically organize the certainties that are constitutive of the different language games in which the social is deployed. On the basis of this approach, the article attempts to draw a distinction between philosophy as ideological theoretical practice and as critical theoretical practice. (shrink)

The following paper puts the history of race and colonialism in conversation with the history of the concept of energy. The objective is to understand what a critical decolonial perspective can teach us about the central role that energy plays in western culture, materially and epistemologically. I am interested in how this approach to political, epistemological, and ontological questions demands that we reconceptualize energy to account for the historical particularity of the concept and the phenomena of history and intersubjectivity, which (...) are eschewed in a purely materialistic and quantitative conception of energy. We will see how energy has been complicit in the racialization of black and indigenous bodies, and how the privileged place that the concept of energy has occupied in the canon of western physics has served to obscure the theological, metaphysical, and cultural assumptions that constitute it. Institutions to address short-termism in public policymaking and to more suitably discharge our duties toward future generations have elicited much recent normative research, which this chapter surveys. It focuses on two prominent institutions: insulating devices, which seek to mitigate short-termist electoral pressures by transferring authority away to independent bodies, and constraining devices, which seek to bind elected officials to intergenerationally fair rules from which deviation is costly. The chapter first discusses sufficientarian, egalitarian, and prioritarian theories of our duties toward future (...) generations, and how an excessive focus on the short term in policymaking may hinder that such duties be fulfilled. It then surveys constraining and insulating devices, and inspects their effectiveness to address the epistemic, motivational, and institutional drivers of political short-termism as well as their intra- and intergenerational legitimacy. I reconstruct 20th-century Mexican philosopher José Vasconcelos’s answers to two important aesthetic-political questions: (1) Can aesthetic judgments bind community? and (2) Can aesthetic judgments drive political, social, and cultural change? My objectives are twofold: one, to show that Vasconcelos’s responses make original contributions to an important aesthetic-political tradition that begins with Kant, and two, to offer key ideas from Vasconcelos’s aesthetics to a wider audience, as an invitation to engage with his work in their research and teaching. In section I, (...) I argue that Kant’s remarks suggest that aesthetic judgments bind the community. In section II, I explain that Kant sometimes appears to suggest that aesthetic judgments promote political, social, and cultural change. Section III discusses two bridge figures—Schiller and Arendt—that help us better understand how Kantian aesthetics binds community and serves political purposes. In section IV, I argue that Vasconcelos aligns with the Kantian tradition exemplified by Schiller and Arendt when developing a plan for aesthetically-guided social and political progress. I also show that, during his time in various positions of power in the Mexican government, Vasconcelos brought ideas from the Kantian tradition to life. I conclude by reflecting on how Vasconcelos reveals new possibilities for the Kantian tradition. (shrink)

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Representing unborn generations to more suitably include future interests in today's climate policymaking has sparked much interest in recent years. In this review we survey the main proposed instruments to achieve this effect, some of which have been attempted in polities such as Israel, Philippines, Wales, Finland, and Chile. We first review recent normative work on the idea of representing future people in climate governance: The grounds on which it has been advocated, and the main difficulties that traditional forms of (...) representation have encountered when applied to this particular case. We then survey existing institutional means to represent generations to come. We separate out representation in courts, in parliament, and by independent bodies, and review specific instruments including climate litigation, parliamentary commissions, future representatives, youth quotas, and independent offices for future generations. We examine the particular forms whereby each of these may suitably represent future people, including audience representation, surrogate representation, and indicative representation, and discuss the main challenges they encounter in so doing. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. Are norms of inquiry in tension with epistemic norms? I provide a (largely) negative answer, turning to a picture of epistemic practices as rule-governed games. The idea is that, while epistemic norms are correctness standards for the attitudes involved in epistemic games, norms of inquiry derive from the aims of those games. Attitudes that, despite being epistemically correct, are inadvisable regarding the goals of some inquiry are just like bad (but legal) moves in basketball or chess. I further consider cases (...) in which the aims of inquiry recommend breaking epistemic norms. I compare them to strategic infractions, which are common in many coherent games. Finally, I explore the connections between rules and aims in games and in inquiry. I show that in both cases respecting the rules is constitutively required for satisfying the aims of the practice.
