Biobanks act as the custodians for the access to and responsible use of human biological samples and related data that have been generously donated by individuals to serve the public interest and scientific advances in the health research realm. Risk assessment has become a daily practice for biobanks and has been discussed from different perspectives. This paper aims to provide a literature review on risk assessment in order to put together a comprehensive typology of diverse risks biobanks could potentially face. (...) Methodologically set as a typology, the conceptual approach used in this paper is based on the interdisciplinary analysis of scientific literature, the relevant ethical and legal instruments and practices in biobanking to identify how risks are assessed, considered and mitigated. Through an interdisciplinary mapping exercise, we have produced a typology of potential risks in biobanking, taking into consideration the perspectives of different stakeholders, such as institutional actors and publics, including participants and representative organizations. With this approach, we have identified the following risk types: economic, infrastructural, institutional, research community risks and participant’s risks. The paper concludes by highlighting the necessity of an adaptive risk governance as an integral part of good governance in biobanking. In this regard, it contributes to sustainability in biobanking by assisting in the design of relevant risk management practices, where they are not already in place or require an update. The typology is intended to be useful from the early stages of establishing such a complex and multileveled biomedical infrastructure as well as to provide a catalogue of risks for improving the risk management practices already in place. An increasing number of European research projects return, or plan to return, individual genomic research results (IRR) to participants. While data access is a data subject’s right under the General Data Protection Regulation (GDPR), and many legal and ethical guidelines allow or require participants to receive personal data generated in research, the practice of returning results is not straightforward and raises several practical and ethical issues. Existing guidelines focusing on return of IRR are mostly project-specific, only discuss which results to (...) return, or were developed outside Europe. To address this gap, we analysed existing normative documents identified online using inductive content analysis. We used this analysis to develop a checklist of steps to assist European researchers considering whether to return IRR to participants. We then sought feedback on the checklist from an interdisciplinary panel of European experts (clinicians, clinical researchers, population-based researchers, biobank managers, ethicists, lawyers and policy makers) to refine the checklist. The checklist outlines seven major components researchers should consider when determining whether, and how, to return results to adult research participants: 1) Decide which results to return; 2) Develop a plan for return of results; 3) Obtain participant informed consent; 4) Collect and analyse data; 5) Confirm results; 6) Disclose research results; 7) Follow-up and monitor. Our checklist provides a clear outline of the steps European researchers can follow to develop ethical and sustainable result return pathways within their own research projects. Further legal analysis is required to ensure this checklist complies with relevant domestic laws. (shrink)

Th ere is much controversy surrounding the nature of the relation between fictional individuals and possible individuals. Some have argued that no fictional individual is a possible individual; others have argued that (some) fictional individuals just are (merely) possible individuals. In this paper, I off er further grounds for believing the theory of fictional individuals defended by Amie Thomasson,viz., Artifactualism, by arguing that her view best allows one to make sense of this puzzling relation. More specifically, when we realize that (...) the view allows for an identification of merely possible individuals with fictional individuals, we seethat the utility, and hence the level of credence lent to Artifactualism, is increased. In several respects one can saythat the right to freedom of thought is virtually “co-original” with the endof the Wars of Religion. 1900 was a remarkable year for science. Several ground-breaking events took place, in physics, biology and psychology. Planck introduced the quantum concept, the work of Mendel was rediscovered, and Sigmund Freud published The Interpretation of Dreams . These events heralded the emergence of completely new areas of inquiry, all of which greatly affected the intellectual landscape of the 20 th century, namely quantum physics, genetics and psychoanalysis. What do these developments have in common? Can we discern a family likeness, a (...) basic affinity between them, so that we can use the one to deepen our understanding of the other? One common denominator is that they open up realms of inquiry that are significantly different from the world of everyday experience, namely the realm of elementary particles, of genes and genomes, and of the unconscious. But to what extent can we meaningfully argue, for instance, that the genome is the biological unconscious, and the unconscious the psychic genome? To address these questions, I will build on the work of two key intellectual figures who have explored the affinities of these developments in depth, namely Erwin Schrödinger (a quantum physicist and avid reader of Schopenhauer who initiated molecular biology) and Jacques Lacan (who reframed the specificity of psychoanalysis with the help of 20 th century science: the era of structural linguistics, but also of quantum physics, molecular biology, bioinformatics and DNA). Th e recent revival of Berkeley studies in the last three decades or so make it interesting to look back at George Santayana’s discussion of Berkeley. Th ough Santayana understood the latter’s arguments for immaterialism, he claimed no one could both seriously accept immaterialism, and live, as Berkeley certainly did, an embodied life. As he writes of Berkeley, “Th is idealist was no hermit” (205). Santayana claimed that without matter there was nothing (“no machinery”) for the soul to work on. (...) For a soul (mind) the machinery consists of material objects including one’s body. In this, paper, aft er some introductory comments, particularly on some aspects of early modern philosophy, e.g. the theory of ideas, which Berkeley largely accepts, and the metaphysics of indirect realism which he rejects, I look at the issue of human embodiment, and conclude, although Santayana perhaps misread important aspects of Berkeley’s discussion, he is largely correct in noting that Berkeley’s idealism/immaterialism can’t capture the special relation we have to our bodies. His works themselves ring true and eminently philosophically; simultaneously, they (...) are not philosophical prose. Нis ideas contain exceptional depth and originality. The mythical and folklore elements which impart characteristic Bulgarian sounding to them are emphasized. Нis typically Bulgarian view of life charms the readers. Summarizing, Radichkov's work "Attempt of fying" is represenrarive of the Bulgarian literature and possesses philosophical depth. (shrink)

It comes to a reference of views representative of the metaphysical approach of early neo-Kantian Johannes Volkelt to representative of Baden School of late New-Kantian, Heinrich Rickert. In the lecture I would like to make the reconstruction and the analysis of philosophies of Volkelt and Rickert in the context of the problem of metaphysics. Th e object is the content, premises and consequences of (...) their philosophy in comparison to New-Kantian and other philosophy. Th e basis for the reconstruction is their expressions in their various writings. Th e purpose is the analysis of the transformation of western metaphysics and their infl uence on the contemporary thinking about the world. (shrink)

Th is work is a companion piece to "The American Worker," Karl Kautsky's reply to Werner Sombart’s Why Is There No Socialism in the United States? (1906), first published in English in the November 2003 edition of the journal Historial Materialism. In August 1909 Kautsky wrote an article on Samuel Gompers, the president of the American Federation of Labor, on the occasion of the latter's first European tour. Th e article was not only a criticism of Gompers’s anti-socialist "pure-and-simple" unionism (...) but also part of an ongoing battle between the revolutionary wing of German Social Democracy and the German trade-union officials. In this critical English edition we provide the historical background to the document as well as an overview of the issues raised by Gompers' visit to Germany, such as the bureaucratisation and increasing conservatism of the union leadership in both Germany and the United States, the role of the General Commission of Free Trade Unions in the abandonment of Marxism by the German Social-Democratic Party and the socialists’ attitude toward institutions promoting class collaboration like the National Civic Federation. Th is paper's purpose was to identify the key sources when formulating competitive advantages of hotel chains. Th e research assessed the fi nancial activities performance included in annual hospitality industry reports and on their offi cial websites; questioning of loyal and potential customers; the fi ve-point Likert scale and the Pearson correlation coeffi cient were applied to understand the possible consumer reaction to a certain competitive advantage or its absence. Th e paper confi rms the eff ectiveness of key (...) sources used by management to win and retain competitive advantages: despite strong dependence on the economic cycle phase etc., after the devastating crisis of 2007, 2008, but also to achieve sustainable growth. All the networks examined over the last decade have expanded their presence in international markets, diversifi ed the portfolio of brands, increased the number of jobs and profi ts. It was also proved that the opinion of the fi nal consumer is still not suffi ciently taken into account in the assessment of the Pearson correlation coeffi cient (the latter allowed the authors to propose their own defi nition of the competitive advantage in the industry). Th e paper attempts for the fi rst time to consider the competitive advantages of hotel chains from the point of view not only of theorists and business practitioners, but also with the view of the opinion of the services consumer; there were identifi ed the discrepancies, which consideration would allow to increase the level of guest satisfaction and, accordingly, the effi ciency of the hotel business. In future papers, the authors plan to verify the existence of a correlation between the degree of guest loyalty to a particular hotel network and the main fi nancial results of its activities. In Th e Order of Public Reason, Gerald Gaus defends an innovative and sophisticated convergence version of public reason liberalism. Th e crucial concept of his argumentative framework is that of “social morality”, intended as the set of rules apt to organize how individuals can make moral demands over each other. I claim that Gaus’s characterization of social morality and its rules is unstable because it rests on a rejection of the distinction between the normative and the descriptive. I argue (...) that such rejection is motivated by certain practical aims Gaus wishes his theory to achieve. His method and his idea that morality needs to be understood both as the dictate of impartial reasoning and as a social and historical fact come from the need for his theory to perform the task of settling the problem of order. I discuss Gaus’s philosophical attitude and, finally, distinguishing between “therapeutic” and “evaluative” approaches, I present some points of discussion for understanding the role and scope of political philosophy in general. A meaningful life, we shall argue, is a life upon which a certain sort of valuable pattern has been imposed by the person in question - a pattern which involves in serious ways the person having an effect upon the world. Meaningfulness is thus a special kind of value which a human life can bear. Two interrelated difficulties face ths proposal. One concerns responsiblity: how are we to account for the fact that a life that satisfies the above criteria can (...) have more meaning than a life with the same positive outcomes but which lacks responsiblity on the part of the agent? The other turns on these outcomes themselves: how can the meaningfulness engendered by actions you perform now be affected by what those actions go on to produce in the future, perhaps even after your death? Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. Neutrosophic set approaches are suitable to modeling problems with uncertainty, indeterminacy and inconsistent information in which human knowledge is necessary, and human evaluation is needed. Neutrosophic set theory firstly proposed in 1998 by Florentin Smarandache, who also developed the concept of single valued neutrosophic set, oriented towards real world scientific and engineering applications. Since then, the single valued neutrosophic set theory has been extensively studied in books and monographs introducing neutrosophic sets and its applications, by many authors around the world. Also, an international journal - Neutrosophic Sets and Systems started its journey in 2013. This first volume collects original research and applications from different perspectives covering different areas of neutrosophic studies, such as decision-making, neutroalgebra, neutro metric, and some theoretical papers. Timothy Williamson has shown that the B axiom for 'definitely' (α → Δ¬Δ¬α) guarantees that if a sentence is second-order vague in a Kripke model, it is nth order vague for every n. More recently, Anna Mahtani has argued that Williamson's epistemicist theory of vagueness does not support the B axiom, and conjectured that if we consider models in which the “radius of accessibility” varies between different points, we will be able to find sentences that are nth-order vague but (n+1)th-order (...) precise, for any n. This paper bolsters Mahtani's argument, shows her conjecture to be true, and shows that imposing certain further natural constraints on "variable radius" models does not change the situation. The recent debate on cognitive phenomenology has largely focused on phenomenal aspects connected to the content of thoughts. By contrasts, aspects pertaining to their attitude have often been neglected, despite the fact that they are distinctive of the mental kind of thought concerned and, moreover, also present in experiences and thus less contentious than purely cognitive aspects. My main goal is to identify two central and closely related aspects of attitude that are phenomenologically salient and shared by thoughts with experiences, (...) namely the rational role that they play in our mental lives and their determination by factors external to them, such as external objects or reasons. The modern Everett interpretation of quantum mechanics describes an emergent multiverse. The goal of this paper is to provide a perspicuous characterisation of how the multiverse emerges making use of a recent account of (weak) ontological emergence. This will be cashed out with a case study that identifies decoherence as the mechanism for emergence. The greater metaphysical clarity enables the rebuttal of critiques due to Baker (2007) and Dawid and Th\'ebault (2015) that cast the emergent multiverse ontology as incoherent; responses (...) are also offered to challenges to the Everettian approach from Maudlin (2010) and Monton (2013). This paper presents a challenge for exemplar theories of moral concepts. Some have proposed that we acquire moral concepts by way of exemplars of actions that are prohibited as well as of actions that are required, and we classify newly encountered actions based on their similarity to these exemplars. Judgments of permissibility then follow from these exemplar-based classifications. However, if this were true, then we would expect that individuals who lacked, or were deficient in, the capacity to form or access (...) exemplars of this kind would be similarly deficient in the ability to classify new actions according to them, and this relative inability would be manifested in the moral judgments made by such individuals. This essay responds to the thoughtful essays on the Order of Public Reason (OPR) by Elvio Baccarini, Giulia Bistagnino and Nenad Miscevic. All three essays interrogate OPR’s understanding of moral theory - “meta” matters about the nature of morality, reasons and modeling within moral theories. I first turn to the general understanding of the moral enterprise underlying OPR, explaining why it takes a view at odds with the contemporary mainstream in moral philosophy. I then explain the idea of moral truth (...) in OPR: when it comes to social morality, moral truth is necessarily a function of what can be endorsed by some collectivity. Th is leads to a fundamental worry about theories of public reason: why is the endorsement of the public so important? And if some sort of public endorsement is really so terribly important, how can a theory of public reason withstand the fact that it advances its own controversial claims that cannot be publicly endorsed? After considering when public endorsement is necessary, and when public reason theories can make controversial claims, I close by considering in what way OPR does, and in what way it does not, employ a thought experiment, and the complexities of that. Neo-Fregean logicists claim that Hume’s Principle (HP) may be taken as an implicit definition of cardinal number, true simply by fiat. A long-standing problem for neo-Fregean logicism is that HP is not deductively conservative over pure axiomatic second-order logic. This seems to preclude HP from being true by fiat. In this paper, we study Richard Kimberly Heck’s Two-Sorted Frege Arithmetic (2FA), a variation on HP which has been thought to be deductively conservative over second-order logic. We show that it isn’t. (...) In fact, 2FA is not conservative over n-th order logic, for all $n \geq 2$. It follows that in the usual one-sorted setting, HP is not deductively Field-conservative over second- or higher-order logic. (shrink)

How, if at all, are we to distinguish between the works that we call ‘art’ and those that we call ‘pornography’? This question gets a grip because from classical Greek vases and the frescoes of Pompeii to Renaissance mythological painting and sculpture to Modernist prints, the European artistic tradition is chock-full of art that looks a lot like pornography. In this paper I propose a way of thinking about the distinction that is grounded in art historical considerations regarding the function (...) of erotic images in 16 th -century Italy. This exploration suggests that the root of the erotic art/pornography distinction was—at least in this context—class: in particular, the need for a special category of unsanctioned illicit images arose at the very time when print culture was beginning to threaten elite privilege. What made an erotic representation exceed the boundaries of acceptability, I suggest, was not its extreme libidinosity but, rather, its widespread availability and, thereby, its threat to one of the mechanisms of sustaining class privilege. Joy of a certain kind has an important affective role in demonstrating the overcoming of nihilism for Nietzsche. In this chapter I explore how one might arrive at a point where they too can give voice to Zarathustra’s proclamation that “all joy wills eternity.” There are consistent references to eternity and infinitude in passages of Nietzsche’s discussing nihilism. This is most obviously borne out in Nietzsche scholarship with reference to discussions of eternal recurrence. But eternal recurrence does not have a (...) monopoly for denoting Nietzsche’s employment of the motifs of eternity and infinitude. Eternal recurrence and its affirmation, I argue, is only a kind of end point for a process of overcoming nihilism. -/- My concern here is the manner in which Nietzsche employs these motifs to track three different stages related to nihilism. The first stage demonstrates an affective response of initial disorientation, which aims to engender a realization by the “marketplace atheists” that humanity must undergo the phenomenon of nihilism. Th e second stage documents an active confrontation with this phenomenon, which in turn offers deeper, more terrifying yet also more positive consequences of this realization, ones proffering new forms of freedom. The third stage is the constructive use to which Nietzsche sets these motifs in the service of life-affirmation, of which eternal recurrence plays an integral part. I examine several important passages using these motifs in Nietzsche’s mature writings, particularly from The Gay Science and Thus Spoke Zarathustra, to claim that they inform a developmental process concerning the realization of nihilism and its overcoming. -/- I conclude by claiming that the motifs of eternity and infinitude’s employment at each of these three stages mirrors the substance of the “Three Metamorphoses of the Spirit” section in Thus Spoke Zarathustra. A god is a cosmic designer-creator. Atheism says the number of gods is 0. But it is hard to defeat the minimal thesis that some possible universe is actualized by some possible god. Monotheists say the number of gods is 1. Yet no degree of perfection can be coherently assigned to any unique god. Lewis says the number of gods is at least the second beth number. Yet polytheists cannot defend an arbitrary plural number of gods. An alternative is that, (...) for every ordinal, there is a god whose perfection is proportional to it. The n -th god actualizes the best universe(s) in the n -th level of an axiological hierarchy of possible universes. Despite its unorthodoxy, ordinal polytheism has many metaphysically attractive features and merits more serious study. (shrink)
