From year to year some of us, people of planet Earth, Earthlings, attacks intensify on the veto right in the UN Security Council. They consciously or unconsciously ignore its metaphisical, ontological and existential statuses established in 1945 by the founders of the United Nations as a result of the multimillion sacrificial struggle of all Humanity against nazism. Perhaps this is due to a misunderstanding of the metaphysics of international relations, the enduring existential significance of the veto for the (...) viability of the entire UN system in the nuclear-ecological information era, or because of the veiled, formal-procedural veto status enshrined in the UN Charter. The authors of the attacks substantiate their conclusions by the "non-democracy", "ineffectiveness" of the UN Security Council, "unfair privileges" of the five permanent members of the Security Council ("P1945"), a significant increase in the number of UN member states after 1945, the fate of the League of Nations, "geopolitical realities". According to the attackers, the veto in the UN Security Council makes the decision-making process "unequal and abortive", which does not contribute to maintaining peace and preventing civil wars, genocide, violation of human rights and aggression in international relations. Some politicians and experts propose not only to limit the veto right of the five permanent members of the UN Security Council, but to completely deprive them of this right, which, as we know, are nuclear powers and bear the main responsibility for international security, the preservation of peace and life itself on planet Earth. Taking into account 75-years experience in the use of the veto right in the UN Security Council, with the aim of strengthening the historical, metaphysical, existential and procedural-legal significance of the veto right, its fundamental role in resolving the most complex international problems in the context of the constantly increasing threats and risks of our times during the reform of the UN Security Council with the increased number of members of the Security Council, the UN Charter must establish two essential levels of the veto right: 1. The conceptual model of United Nations reform - "UN 3.0" includes the General Program of Action on UN Reform, consisting of two stages. The first stage for 2020-2025 envisages the transformation of the main organs of the UN - the General Assembly and the Security Council with measures to improve the effectiveness of the management system, address the "veto problem", problem of financing, improve staff work and administrative and financial control, strengthen UN media, improvement of work with (...) the global civil society. The General Assembly is converted into the General All-Parliamentary Assembly of the UN. In the structure of the Assembly, the Council for Law is being established, which coordinates the activities of UN structures in the field of law. To coordinate the activities of the UN in the field of human rights and civil society, ethical issues, the General all-parliamentary Assembly creates the Council on ethics, human rights and civil society and transforms the Committee on information into the Council on public information and communication with civil society. The structure of the Council includes all UN media. The reform of the UN Security Council is carried out in three sub-stages. At the 1st sub-stage (2020-2021) the Security Council is transformed into the Council of Existential Security (CES). The membership of the CES is increased to 25 member countries, of which five countries have the right of the unconditional (absolute, eternal) veto: Great Britain, France, China, Russian Federation, USA. The General All-Parliamentary Assembly elects 15 new permanent members of the Council of Existential Security with the right of the conditional (limited) veto: Argentina, Australia, Brazil, Canada, Egypt, Germany, India, Indonesia, Italy, Mexico, South Africa, Nigeria, Pakistan , Turkey, Japan (if they fulfill the mandatory restrictive conditions). At this sub-stage, the CES elects also five non-permanent members with the right of a conditional (limited) veto when they meet the mandatory restrictive conditions, with a rotation period of 2 years from geographical regions (or regional unions): Africa, Latin America and the Caribbean, Asia and the Pacific Ocean (2 places), Eastern Europe. On the second sub-stage (2022-2023), subject to the effective activity of the CES of the enlarged composition and compliance with mandatory restrictive conditions, new permanent members of the "Existential Security Council" are elected with the right of a conditional (limited) veto: Iran, Spain, Poland, Saudi Arabia. Members of the CES may be regional unions, whose member countries are not represented in the CES, but still have one vote with the right of a conditional (limited) veto. -/- Two essential levels of the veto: 1. Unconditional (absolute, eternal) veto is the historical right of veto of the five permanent members of the Council of Existential Security - Great Britain, China, Russia, USA, France; 2. Сonditional (limited) veto is the veto of other permanent and non-permanent members of the Council of Existential Security. The right of veto is a unique international school for the achievement of consensus, a school of high democracy for Humanity, a reliable guarantee of the viability of the UN structure. The Council for Existential Security centralises the management of the UN subsidiary bodies with the expansion of their security functions: the Military Staff Committee, the Counter-Terrorism Committee, the Committee for the Prevention of the Spread of Nuclear, Chemical and Biological Weapons, the Sanctions Committees and other committees. On the basis of the decision of the Council of Existential Security, the General All-Parliamentary Assembly creates permanent contingents of UN peacekeeping and counter-terrorism forces. In addition, two Centers are being created in the structure of the Council for Existential Security: the World Center for the Elimination of the Effects of Technogenic and Natural Disasters with branches on all continents and the World Center for the Analysis of Existential Risks and the Overall Security Strategy. The Center is developing the Programs of research and monitoring of global existential threats and risks. In order to increase the level of legitimacy and authority of the Secretary General of the United Nations, the Rules of procedure for elections to this post are changing. Each member country of the Council for Existential Security represents one of the most authoritative candidates for election to the post of Secretary General at the session of the General All-Parliamentary Assembly, with the possibility of nominating candidates from other countries, including those not members of the Council for Existential Security. Elections are held in two rounds during one day of the session of the Assembly. The Legal Committee of the UN General Assembly is developing a Program for the Reform of the Judicial System of the United Nations, which takes into account the proposals of the previous international discussion and determines the scope and terms of the reform of the courts. In accordance with the Program of Action on UN Reform for 2020-2025, reforms are under way in the structure of the Economic and Social Council. The central task of the reform is to strengthen the coordinating role of ECOSOC in the entire system of UN-related specialized agencies, funds and programs related to the Council. The key task of the UN reform is the solution of the financing problem. A unified "UN Open Budget "Solidarity XXI" is being created, including the financing of peacekeeping operations and other expenses. Each country, a member of the United Nations, lists in an established period, once a year, an Existential contribution - the Earth Tax. The Earth Tax for each UN member state is established on the basis of four scales of calculation: Scale I - for 5 permanent members of the Council of Existential Security, who have the right of absolute (absolute) veto; Scale II - for the permanent members of the SEB, who have the right to a conditional (limited) veto; Scale III - for non-permanent members of the SEB, who have the right to a conditional (limited) veto; Scale IV - for all other UN member countries. The program of action on UN reform includes a set of measures to ensure transparent work of the International Civil Service Commission with the involvement of the UN media. To strengthen control functions in the sphere of personnel policy, administrative and financial management, the General All-Parliamentary Assembly of the United Nations establishes the Permanent Commission on Ethics and Administrative and Financial Control. All members of the Commission, members of the Committees and auditors are independent in their activities from the leadership of the United Nations, its funds and programs. The General All-Parliamentary Assembly completes the first stage of the Program of Action on UN Reform in 2025 and, following an open discussion, introduces a single language of international communication - Esperanto and approves it as the official language of the United Nations. With a view to more effective work of the central UN governing bodies in the face of increasing existential threats and risks, reducing the current expenses for the maintenance of the central bodies of the UN, the Council for Existential Security and the General All-Parliamentary Assembly decide on the relocation of the UN headquarters to Iceland. The UN building complex in New York is transferred to preferential use of non-governmental organizations, which contribute to the implementation of the goals of the United Nations. At the second stage of the UN reform in the period 2026-2028, additional necessary transformations are being made in the UN system. At the end of the first stage of the reform, taking into account the reforms carried out by the main organs of the United Nations and the internal improvement of the work of all its structures, the United Nations Program of Action for the years 2026-2028 is being developed. As the basis for such a project of reforming common opinion about astrol¬ogy, we find a quiet yielding attitude toward sceptical antidogmatism, and a (...) non-deterministic way of conceiving man 's naturai relationship with heavenly bodies. It is commonplace among Nietzsche scholars to think that Nietzsche maintains a sceptical attitude towards the possibility of self-knowledge. This attitude, which is patent in the late works, could be traced back at least to the period of Human, All Too Human, if not to the unpublished essay On Truth and Lying in a Non-Moral Sense (1973). As much as this picture may be correct, it is incomplete. To see why this is so, one needs to distinguish between different notions (...) of the self and different methodologies. These distinctions will prove to be helpful to examine Nietzsche’s stance towards self-knowledge in Human, All Too Human as well as the pivotal role that genealogy plays in achieving it. (shrink)

The topic I address in this paper is whether the independence of Church and State brought about by the Lutheran Reformation tantamounted to the secularisation of the latter. Taking into account two recent essays by Harold Berman and John Witte on the Lutheran contribution to the Western legal tradition, I argue that Luther’s criticism of the catholic doctrine of Papal power came hand in hand with a theologization of the foundations of the authority of the State, which is difficult to (...) deem «secular». The Committee on Economic, Social and Cultural Rights (CESCR) has a new mechanism to receive individual complaints and issue views, which makes the question of how the Committee should interpret the broad articles of the International Covenant on Economic, Social and Cultural Rights more pressing than ever. Most commentators on the legitimacy of the CESCR’s interpretation have argued that interpreters should make better use of Articles 31–33 of the Vienna Convention on the Law of Treaties (VCLT) in order to improve (...) the legitimacy of their findings. In this article, we argue conversely that the individual communication mechanism should be evaluated and reformed in terms of legitimate authority. In the context of the Committee’s process of interpretation, we contend that proportionality is better suited than the various interpretive options of the VCLT to offer a consistent procedure that is able to generate legitimacy by attenuating the tension between personal and collective autonomy. I clarify that Sidgwick was not a moral relativist; on the contrary he was heavily conditioned by ethnocentric prejudice: I add that Sidgwick did not believe a reform of common-sense morality to be viable; on the contrary he concluded that it was impossible and, besides, that there were important utilitarian reasons against the viability of any reform strategy.

We explore how one might respond emotionally to the eternal recurrence. Zarathustra himself serves as our central case study. First we clarify the idea of eternal recurrence and its role in Nietzsche’s philosophy, explaining why the eternal recurrence has the emotional consequences Nietzsche describes when he first introduces the idea in The Gay Science. Then we describe Zarathustra’s emotional journey from horror at the eternal recurrence to loving it, in the sections from “On Great Events” to “The Seven Seals, or: (...) The Yes and Amen Song.”. In spite of his post-World War II works on international law, which seems more purely juridical, Hans Kelsen continues to put forward in his vast body of work an implicit – and sometimes even explicit – juridical objectivism and pacifism. Especially before and during the second World War he makes – by means of many moral-political writings – an effort for a more effective assurance of international peace. The fact that Kelsen regards the law as the pre-eminent means to achieve (...) the end of peace, is – in view of the tradition running from Hobbes to Kant – still not very innovating. But the primary and central role he assigns to the judiciary in order to guarantee international peace is on the other hand really original. To bring out Kelsen’s juridical objectivism and pacifism, I restrict myself in this article to his plea before and during the second World War for the judicial primacy in the international legal order. In that plea, which is spread over many writings and founded by several arguments, I distinguish however three main convincing arguments – namely an evolutionary, a technical and a moral-political argument – for the establishment of an international court with compulsory jurisdiction as the ‘guardian of international peace’. The fact that Kelsen’s original plea is still relevant to our times, is already evident from the post-World War II UN-system of peace-enforcement, which still functions little satisfactorily and of which the existing plans of reform go no further than strengthening the position of the Security Council, the current hardly effective ‘maintainer of world peace’. Instituţiile publice sunt reformate şi reorganizate după modelul managerial al firmelor, filosofia serviciului public este reformulată în termenii loialităţii faţă de interesele antreprenoriale (pentru profit) sau faţă de pasiunile cetăţenilor virtuoşi ce creează în jurul preocupărilor personale asociaţii civice, gestionând o parte din serviciile de interes public abandonate de statul capitalist. Pentru ca aceste lucruri să se întâmple, inflexibilitatea politicilor orientate către impunerea fără alternativă a aşa-numitului „consens de la Washington” trebuie să fie însoţită de o cât mai mare flexibilizare (...) a voinţei, aspiraţiilor şi vieţii umane. Cetăţenii statului neoliberal trebuie să se obişnuiască să trăiască departe de familie pentru a câştiga mai mult, pentru a obţine un loc de muncă sau pentru a nu îşi pierde poziţia profesională pe care au obţinut-o, trebuie să jongleze cu mai multe calificări, să fie deschişi către perspectiva înstrăinării unei bune părţi din timpul legal de odihnă în beneficiul companiei sau instituţiei publice pentru care lucrează, să construiască permanent strategii de salvare pentru eventualitatea în care angajatorul se va dispensa de serviciile lor etc. Tensiunile şi contradicţiile ce însoţesc transformările neoliberale sunt vizibile în numeroase domenii, dar sunt poate mai frapante în cele care au o îndelungată tradiţie a autonomiei organizaţionale şi care au obţinut privilegiul de a-şi construi practicile în conformitate cu reguli sau aprecieri endogene, în câmpul creaţiei culturale. Comunităţile universitare resimt din plin influenţele forţelor disruptive şi distructive ale re-structurării neoliberale. Observaţiile pe care le voi expune în cele ce urmează vor evidenţia câteva dintre acestea, fie că este vorba de manifestări generale, sesizabile la scară globală, fie că este vorba de forma pe care o iau ele în România. La théorie de l’organisme social était une approche foncièrement et largement répandue au début du 20ème siècle, qui était acceptée par de nombreuses orientations théoriques dans la sociologie et l’économie. L’approche de Rudolf Steiner s’y rapportant est bien connue. La théorie de Gerhard Stolzmann ne l’est pas autant. Ce dernier était un représentant de ce qu’on appelle le « mouvement des droits sociaux de l’économie politique » et au plan philosophique, il défendait le néo-kantisme (école de Marburg, de l’Allemagne du (...) sud-ouest). Stolzmann a connu et cité les écrits de Steiner sur l’organisme social, comme on peut le prouver. Dans cet essai, on va mettre au jour les communautés et tendances dans le concept de l’organisme social chez Stolzmann et Steiner. Tous deux ont mis en exergue l’importance du spirituel et en conséquence de la sphère du droit, pour la société et l’économie dans leur théorie. Mais Steiner eut essentiellement une amorce plus pratique. Son concept d’organisme social est plus une proposition de réforme pour l’économie et la société, alors que Stolzmann fait ressortir la signification théorique générale toujours valable de sa théorie. The right to food is recognized as a basic right under international human rights law. The lack of implementation of the right is a challenge for societies around the world. The failures in implementation are leading stakeholder's to strongly advance more appropriate standards vis-a-vis the right to food. The concept of food sovereignty for instance has gained importance in this regard. The concept of food sovereignty is interpreted to be larger in scope than the right to food. Food sovereignty is (...) not limited to the making "provision" of food to the beneficiaries by the state. In addition, it also mandates the empowerment of communities by the adoption of policies to secure land, food production and consumption, etc. -/- In 2010, the UN Special Rapporteur on the Right to Food recognized the wider import of the right to food based on the concept of food sovereignty. The Rapporteur emphasised on the provision of land for instance as essential to right to food. The acceptance of food sovereignty as a benchmark for state performance is one of the most notable developments in the field of economic, social and cultural rights. This chapter discusses the role of the concept of food sovereignty, and how it is shaping international and domestic policy frameworks. (shrink)

À partir de certaines remarques de Wittgenstein, il est possible de contester la pertinence de l’étude de contenus propositionnels associés aux croyances religieuses. L’article vise à critiquer ce refus de l’analyse théorique de ces contenus propositionnels. Il est montré que, loin de décrire les croyances et les pratiques religieuses, Wittgenstein impose une réforme (...) de ces croyances et pratiques à partir d’un fidéisme moral, lui-même dépendant d’un athéisme de principe qui accompagne son intérêt profond pour les questions religieuses. Élie HALÉVY (1870-1937), philosophe et historien des idées, fut professeur à l'École libre des sciences politiques, l'ancêtre de l'actuel Sciences Po. Comme son autre grand ouvrage, l'Histoire du peuple anglais au XIXe siècle, paru en six tomes de 1913 à 1932, les trois tomes de La formation du radicalisme philosophique, parus en 1901 pour les deux premiers et en 1904 pour le troisième, reflètent pour partie ses enseignements de l'Ecole libre consacrés à l'histoire britannique. Le premier tome, La jeunesse de (...) Bentham 1776-1789, étudie la doctrine utilitariste non seulement chez celui qu'on regarde comme son fondateur principal, Jeremy Bentham, mais aussi chez les nombreux auteurs qui, en Grande-Bretagne et sur le continent, en dessinèrent avant lui les contours. Le deuxième tome, L’évolution de la doctrine utilitaire de 1789 à 1815, montre comment l'utilitarisme revêtit la forme non seulement d'une école de pensée, mais aussi d'un mouvement pour la réforme économique, sociale et politique. Le rôle coordonnateur nouveau de James Mill, ainsi qu'une convergence de vues avec les économistes, qui poussaient dans le sens des réformes, marquèrent notamment cette évolution. Le troisième tome, Le radicalisme philosophique, continue d'étudier la transformation de l'école en mouvement après la fin des guerres napoléoniennes, lorsque celle-ci commence à engranger ses premiers grands succès réformistes. Bentham, James Mill et les autres penseurs utilitaires sont alors réunis sous l'appellation de philosophic radicals. Le terme temporel de l'ouvrage est le Reform Act de 1832, première étape vers la modernisation du système électoral, que la propagande de ce groupe ne contribua pas peu à faire aboutir. Quoique l'ouvrage d'Halévy vaille en premier lieu par l'immense savoir qu'il déploie, et le nombre et l'excellence des citations qu'il propose, il comporte aussi des thèses historiques et philosophiques originales. On peut citer parmi les premières la thèse, qui relie les trois tomes, voulant que l'utilitarisme britannique trouve sa forme achevée dans l'intervention sur la société, lorsqu'il se mue en radicalisme philosophique, et parmi les secondes, la thèse, énoncée au début du premier tome, voulant qu'il existe trois modèles dominants de jonction des intérêts individuels (la fusion sympathique, l'identification naturelle et l'identification artificielle). Une autre grande thèse, à la fois historique et philosophique, affirme en substance que l'économie politique classique serait un département spécialisé de la pensée utilitaire. La question de savoir jusqu'à quel point Smith, Ricardo et Malthus ont pu adhérer au "principe d'utilité" de Bentham est toujours débattue. En même temps que les élucidations apportées à ce principe, elle contribue à expliquer l'intérêt que les historiens de la pensée économique continuent de porter à l'ouvrage. L'auteur a participé à la réédition de La formation du radicalisme philosophique en 1995 par les Presses Universitaires de France (P.U.F.), suivant un projet collectif lancé par Monique Canto-Sperber. Dans le présent article, antérieur à cette réédition, l'auteur tentait de résumer brièvement un livre qui demeure irremplaçable en dépit d'une conception et d'un style quelque peu datés. (shrink)

Horwich donne une belle analyse de Wittgenstein (W) et est un érudit W de premier plan, mais à mon avis, ils sont tous en deçà d’une pleine appréciation, comme je l’explique longuement dans cet examen et beaucoup d’autres. Si l’on ne comprend pas W (et de préférence Searle aussi) alors je ne vois pas comment on pourrait avoir plus qu’une compréhension superficielle de la philosophie et de la pensée de l’ordre supérieur et donc de tout comportement complexe (psychologie, sociologie, anthropologie, (...) histoire, littérature, société). En un mot, W a démontré que lorsque vous avez montré comment une phrase est utilisée dans le contexte d’intérêt, il n’y a rien de plus à dire. Je vais commencer par quelques citations notables, puis donner ce que je pense sont les considérations minimales nécessaires pour comprendre Wittgenstein, la philosophie et le comportement humain. Tout d’abord, on pourrait noter que mettre "meta" en face de n’importe quel mot devrait être suspect. W a fait remarquer par exemple, que la métamathématique est mathématiques comme les autres. L’idée que nous pouvons sortir de la philosophie (c’est-à-dire la psychologie descriptive de la pensée de haut ordre) est elle-même une profonde confusion. Une autre irritation ici (et tout au long de l’écriture académique pour les 4 dernières décennies) est le sexisme linguistique inverse constant de «elle» et «la sienne» et «elle» ou «il / elle», etc, où «ils» et «leur» et «eux» ferait bien. De même, l’utilisation du mot Français «répertoire» où le «répertoire» anglais se portera plutôt bien. La lacune majeure est l’échec complet (bien que très commun) d’employer ce que je considère comme la vue extrêmement puissante et intuitive de deux systèmes de HOT et Searle cadre que j’ai décrit ci-dessus. C’est particulièrement poignant dans le chapitre sur le sens p111 et seq. (en particulier dans les notes de bas de page 2-7), où nous nageons dans l’eau très boueuse sans le cadre de l’automatisé vrai seul S1, propositionnelle dispositionnelle S2, COS etc. On peut également avoir une meilleure vue de l’intérieur et de l’extérieur en lisant par exemple, Johnston ou Budd (voir mes commentaires). Horwich fait cependant beaucoup de commentaires incisifs. J’ai particulièrement aimé son résumé de l’importation de la position anti-théorique de W sur p65. Il doit mettre davantage l’accent sur 'On Certainty', récemment l’objet de beaucoup d’efforts de Daniele Moyal- Sharrock, Coliva et d’autres et résumé dans mes récents articles. Horwich est de premier ordre et son travail vaut bien l’effort. On espère qu’il (et tout le monde) étudiera Searle et une certaine psychologie moderne ainsi que Hutto, Read, Hutchinson, Stern, Moyal-Sharrock, Stroll, Hacker et Baker, etc. pour atteindre une large vision moderne du comportement. Il donne l’un des plus beaux résumés de l’endroit où une compréhension de Wittgenstein nous laisse que j’ai jamais vu. « Il ne doit y avoir aucune tentative d’expliquer notre activité linguistique/conceptuelle (PI 126) comme dans la réduction de l’arithmétique à la logique de Frege ; aucune tentative de lui donner des fondations épistémologiques (PI 124) comme dans les comptes basés sur le sens d’une connaissance a priori; aucune tentative de caractériser des formes idéalisées de celui-ci (PI 130) comme dans le sens logique; aucune tentative de réforme (PI 124, 132) comme dans la théorie de l’erreur de Mackie ou l’intuitionnisme de Dummett; aucune tentative de rationaliser (PI 133) comme dans le récit de Quine de l’existence; aucune tentative pour le rendre plus cohérent (PI 132) comme dans la réponse de Tarski aux paradoxes menteurs; et aucune tentative pour le rendre plus complet (PI 133) comme dans le règlement des questions d’identité personnelle pour des scénarios hypothétiques bizarres de « téléportation ». Enfin, permettez-moi de suggérer qu’avec la perspective que j’ai encouragée ici, W est au centre de la philosophie et de la psychologie contemporaines et n’est pas obscure, difficile ou non pertinente, mais scintillante, profonde et limpide et que de lui manquer est de manquer l’une des plus grandes aventures intellectuelles possibles. Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. The wishes of registered organ donors are regularly set aside when family members object to donation. This genuine overruling of the wishes of the deceased raises difficult ethical questions. A successful argument for providing the family with a veto must (a) provide reason to disregard the wishes of the dead, and (b) establish why the family should be allowed to decide. One branch of justification seeks to reconcile the family veto with important ideas about respecting property rights, preserving (...) autonomy, and preventing harm. These arguments are ultimately unsuccessful. Another branch of arguments is consequentialist, pointing out the negative consequences of removing the veto. Whether construed as concerning family distress or as a potential drop in the organs available, these arguments are unsuccessful; the first fails to recognize the tremendous distress associated with waiting for an organ, while the second has little supporting evidence. A final section considers and rejects whether combining some of the arguments just examined could justify the family veto. We should thus remove the family veto in organ donation. (shrink)

Alvin Plantinga theorizes the existence of a sensus divinitatis – a special cognitive faulty or mechanism dedicated to the production and non-inferential justification of theistic belief. Following Chris Tucker, we offer an evidentialist-friendly model of the sensus divinitatis whereon it produces theistic seemings that non-inferentially justify theistic belief. We suggest that the sensus divinitatis produces these seemings by tacitly grasping support relations between the content of ordinary experiences (in conjunction with our background evidence) and propositions about God. Our model offers (...) advantages such as eliminating the need for a sui generis religious faculty, harmonizing the sensus divinitatis with prominent theories in the cognitive science of religion, and providing a superior account of natural revelation. Despite their divergent metaphysical assumptions, Reformed and evolutionary epistemologists have converged on the notion of proper basicality. Where Reformed epistemologists appeal to God, who has designed the mind in such a way that it successfully aims at the truth, evolutionary epistemologists appeal to natural selection as a mechanism that favors truth-preserving cognitive capacities. This paper investigates whether Reformed and evolutionary epistemological accounts of theistic belief are compatible. We will argue that their chief incompatibility lies in the noetic effects of sin (...) and what may be termed the noetic effects of evolution, systematic tendencies wherein human cognitive faculties go awry. We propose a reconceptualization of the noetic effects of sin to mitigate this tension. (shrink)

A number of bioethicists have been critical of the power of the family to “veto” a patient’s decision to posthumously donate her organs within opt-in systems of organ procurement. One major objection directed at the family veto is that when families veto the decision of their deceased family member, they do something wrong by violating or failing to respect the autonomy of that deceased family member. The goal of this paper is to make progress on answering this (...) objection. I do this in two stages. First, I argue that the most plausible interpretation of what happens when a person registers as an organ donor in an opt-in system is that she gives her consent to the state to posthumously remove her organs for transplantation purposes. Call this the Authorization Account. Second, given the Authorization Account, I argue by analogy that when families veto an individual’s decision to donate and the individual’s organs are not in the end removed, neither the doctors nor the family violate the individual’s autonomy in any morally objectionable sense. Call this the Nonremoval Thesis. I argue that since the Nonremoval Thesis is true, we do not violate or fail to respect the autonomy of registered donors when we fail to remove their organs because their family has objected. This paper aims to counter the recent opinion that there is a peculiar epistemology in the reformed Church which made it negative to natural theology. First, it is shown that there was an early and unanimous adoption of natural theology as the culmination of physics and the beginning of metaphysics by the sixteenth and seventeenth century philosophers of good standing in the reformed Church. Second, it is argued that natural theology cannot be based on revelation, should not assume a peculiar (...) analysis of knowledge and must not pass over demonstration. (shrink)

In questo contributo descriviamo un sistema di creatività computazionale in grado di generare automaticamente nuovi concetti utilizzando una logica descrittiva non monotòna che integra tre ingredienti principali: una logica descrittiva della tipicalità, una estensione probabilistica basata sulla semantica distribuita nota come DISPONTE, e una euristica di ispirazione cognitiva per la combinazione di più concetti. Una delle applicazioni principali del sistema riguarda il campo della creatività computazionale e, più specificatamente, il suo utilizzo come sistema di supporto alla creatività in ambito mediale. In particolare, tale sistema è in grado di: generare nuove storie (a partire da una rappresentazione narrativa di storie pre-esistenti), generare nuovi personaggi (ad es. il nuovo “cattivo” di una serie tv o di un cartone animato) e, in generale, può essere utilizzato per proporre nuove soluzioni e format narrativi da esplorare nell’ambito dell’industria creativa. Reformed epistemology, roughly, is the thesis that religious belief can be rational without argument. After providing some background, I present Plantinga’s defense of reformed epistemology and its influence on religious debunking arguments. I then discuss three objections to Plantinga’s arguments that arise from the following topics: skeptical theism, cognitive science of religion, and basicality. I then show how reformed epistemology has recently been undergirded by a number of epistemological theories, including phenomenal conservatism and virtue epistemology. I end by noting that (...) a good objection to reformed epistemology must criticize either a substantive epistemological theory or the application of that theory to religious belief; I also show that the famous Great Pumpkin Objection is an example of the former. In the opinion of many Slovenian and Croatian scholars, the constitutional and legislative design of citizen-initiated referendums in their respective countries was in many ways flawed. Referendums initiated by citizens have caused, at least from the point of view of governments in these two countries, many unexpected constitutional, political and/or economic problems. Over the years, several unsuccessful constitutional reforms of the institute of referendum have been attempted both in Slovenia and Croatia. In 2013, Slovenia finally attained its ‘constitutional moment’ in (...) which it was possible to reach an almost universal consensus in the National Assembly on constitutionally redesigning the legislative referendum. On the other hand, several attempts by the Croatian Parliament to amend the constitutional provision relating to citizens’ initiatives have come to nothing due to the interests of the major parties in the constitutional amendment process being different. The elections and political parties are necessary ingredients of democratic governance. Elections are a necessary condition of representative democracy. In representative democracy citizens participate in politics primarily by choosing political authorities in competitive elections. Elections, hence, are a necessary and crucial instrument to make democracy work. In India, free and fair elections are held at regular intervals as per guidelines of the constitution and the Election Commission. To make them free of flaws it is essential to reform them from (...) time to time. Electoral reform means introducing fair electoral systems for conducting fair elections. It also rejuvenates the existing systems to enhance and increase the efficiency of the same. Following the demands of electoral reforms several committees were being set up. Some of the measures like reduction of voting age and anti defection law are appreciable but there are other vital areas in election field completely neglected. This paper will evaluate about different attempts made for electoral reforms in India. Different challenges before the Election Commission are also been discussed, also how it can be made effective as suggested by Commission in India will be presented. A comparative analysis with other democratic countries like U.S.A and U.K. is added to it. (shrink)

Researchers face perennial difficulties in studying live jury deliberation. As a result, the academic community struggles to reach a consensus on key matters of legal reform concerning jury trials. The hurdles faced by empirical jury researchers are often legal or institutional. This note argues that the legal and institutional barriers preventing live deliberation research should be removed and discusses two forms that live deliberation research could take.

In the 1980s, physiologist Benjamin Libet conducted a series of ex-periments to test whether the will is free. Whilst he originally assumed that the will functions like an immaterial initiator of cerebral processes culminating in actions, he later began to think that it rather works like an immaterial veto inhib-iting unwanted actions by preventing unconsciously initiated cerebral processes from unfolding. Libet’s veto was widely criticized for its Cartesian dualist and interactionist implications. However, in 2016, Schultze-Kraft et al. adopted (...) Libet’s idea of an action-inhibiting veto and conducted a new experiment. Its goal was to test until which moment agents can inhibit an action that they already intended to do. Despite insisting on the material nature of the veto, the researchers also described the function of the veto in interactionist terms, namely as an act of the agent performed against her own cerebral processes. The purpose of this pa-per is to explain in which sense the veto in Libet’s and in Schultze-Kraft’s study is interactionist, and to provide a non-interactionist reinterpretation of the test subjects’ action inhibition in Schultze-Kraft’s experiment. There is some intuitive plausibility to the idea that composers create musical works by indicating sonic types in a historical context. But the idea is technically indefensible as it stands, requiring a thorough representational reform that also eliminates the type-theoretic commitments of current versions. On the reformed account, musical 'indication' is an operation of high level representational interpretation of concrete sounds, that can both explain the creativity of composers, and the often successful interpretations of their listeners. In reference to the philosophical theology of medieval Islamic theologian Ibn Taymiyya, this paper outlines a parallel between Taymiyyan thought and Alvin Plantinga’s thesis of ‘Reformed Epistemology’. In critiquing a previous attempt to build an account of ‘Islamic externalism’, the Taymiyyan model offers an account that can be seen as wholly ‘Plantingan’.

When viewing a circular coin rotated in depth, it fills an elliptical region of the distal scene. For some, this appears to generate a two-fold experience, in which one sees the coin as simultaneously circular (in light of its 3D shape) and elliptical (in light of its 2D ‘perspectival shape’ or ‘p-shape’). An energetic philosophical debate asks whether the latter p-shapes are genuinely presented in perceptual experience (as ‘perspectivalists’ argue) or if, instead, this appearance is somehow derived or inferred from (...) experience (as ‘anti-perspectivalists’ argue). This debate, however, has largely turned on introspection. In a recent study, Morales, Bax, and Firestone (2020) aim to provide the first empirical test of this question. They asked subjects to find an elliptical coin seen face-on from a search array that also included a circular coin seen either face-on or at an angle. They found that subjects reacted more slowly when the distracting circle was seen at an angle, such that it’s p-shape matched that of the target ellipse. From this, they concluded that the similar p-shape between the ellipse and circle constituted a phenomenal similarity between the two, and thus that perspectivalism is true. We show that these results can also be explained by pre-attentive guidance by unconscious representations (in what follows, just “unconscious pre-attentive guidance”) and that this explanation is at least as plausible as one from phenomenal similarity. Thus, we conclude that the experiment does not support perspectivalism over anti-perspectivalism. (shrink)

Informed consent is a central concept for empirical and theoretical research concerning pregnancy management decisions and is often taken to be one of the more fundamental goals of the profession of genetic counseling. Tellingly, this concept has been seen by disability communities as salutary, despite longstanding critiques made by disability activists, advocates, and scholars concerning practices involved in genetic counseling more generally. In this chapter, we show that the widespread faith in informed consent is misleading and can be detrimental to (...) the practice of genetic counseling as guided by concerns of justice and equity. We proceed in two steps. First, we explain how informed consent is flawed as a practical concept. Second, we show how the inadequacy of informed consent illuminates the animating core of disability critiques of genetic counseling: the issue of ableism. We argue that the problem of ableism cannot be solved with informed consent because it is not merely a problem of information, but also of epistemic schemas. We suggest that what we call critically informed consent is better suited to move genetic counseling from being aware of the problem of ableism to becoming actively anti-ableist. (shrink)

James a maintes fois célébré les rencontres philosophiques et l’on sait les efforts de James et de Bergson pour se voir, lors des passages de James en Europe. Proximité physique ne signifie évidemment pas convergence ni capillarité philosophiques, comme l’apprend à ses dépens Agathon dans le Banquet de Platon. Or, le rapprochement, mais aussi les confusions, entre la philosophie de Bergson et celle de James, voire entre « bergsonisme » et « pragmatisme », restent un passage obligé de l’étude des (...) deux hommes. Si cette confusion — peut-être ces familles de confusions — sont caractéristiques du début du XXe siècle , il serait sans doute illusoire de croire que nous en sommes sortis aujourd’hui. C’est en France une expérience encore très répandue chez le jamesien que devoir se justifier par rapport au « bergsonisme », et c’en est une autre pour le « bergsonien » que de devoir dire qu’il n’est pas forcément « pragmatiste ». Ces glissements ont déjà été maintes fois analysés et je tiendrai ici pour acquis que Horace Kallen , Floris Delattre , Ralph Barton Perry et Millic Capek , qui ont procédé à la revue de détail, nous ont donné suffisamment d’éléments pour qu’il ne soit pas nécessaire de reprendre le dossier dans son ensemble. Le propos sera plutôt de décomposer un travers de lecture que l’on inflige généralement aux deux auteurs à partir d’un terrain plus limité : le thème du « courant », ou flux (stream), de conscience, thème prétendument commun aux deux hommes. Je vais pour cela tenter d’identifier, dans la première section, deux grandes manières d’aborder le rapport entre les deux hommes qui ont conduit à méconnaître leur apport propre. L’une interdit tout simplement de les lire comme philosophes, même si elle est couramment pratiquée, ce que j’illustrerai à la lumière de deux exemples. L’autre type de lecture engage, lui, un contresens sur la thèse même de James, et c’est ici que la face critique de ce chapitre se retourne en argument positif. Le cœur de ce contresens est de croire que James aurait introduit le thème du courant de pensée ou de conscience, et que ce serait là son originalité. Or, comme il est normal chez un auteur pragmatiste après tout, l’originalité réside dans l’usage qui est fait de ce thème. En examinant dans la deuxième section les rouages de ce contresens, dont il n’est pas certain que tous les lecteurs de Bergson l’aient totalement évité alors même qu’ils pensaient le déposer, on tentera donc de préciser tout d’abord en quoi le thème lui-même n’est pas spécifiquement jamesien, ensuite en quoi le propos de James n’est pas tant de décrire ce flux pour lui-même que de nous expliquer ce qui nous guette si nous le négligeons systématiquement, enfin quelles sont les fonctions remplies par les passages sur le courant de conscience dans l’argument de James. The experience of Costa Rica highlights the potential for conflicts between the right to health and fair priority setting. For example, one study found that most favorable rulings by the Costa Rican constitutional court concerning claims for medications under the right to health were either for experimental treatments or for medicines that should have low priority based on health gain per unit of expenditure and severity of disease. In order to better align rulings with priority setting criteria, in 2014, the (...) court initiated a reform in its assessment of claims for medicine. This paper assesses this reform’s impact on the fairness of resource allocation. It finds three effects. First, a reduction in successful claims for experimental medication, which is beneficial. Second, an increase in the success rate of medication lawsuits, which is detrimental because most claims are for extremely cost-ineffective medications. Third, a decline in the number of claims for medicine, which is beneficial because it forestalls such low-priority spending. This paper estimates that, taking all three effects into account, the reform has had a modest net positive impact on overall resource allocation. However, it also argues that there is a need for further reforms to lower the number of claims to low-priority medicines that are granted. (shrink)

Secularism is a condition of the times when we live in today. It gives awareness to the global community that in reality there is only the immanent—there is no God. So, theism is seen as just one of the many available options: atheism becomes even more attractive to embrace. Generally, a theist will respond by demonstrating the theism plausibility through positive arguments about the existence of God. The author rejects this and offers an approach from Reformed epistemology on the problem, (...) as it is a thesis on how one knows God. Through Reformed epistemology, the author views secularism as what he considers as a cognitive environment. A cognitive environment prevents the “knowing subject” from knowing God, as the authors point out that the appropriate response to secularism is involving the “knowing subject” into the liturgy. According to Warriner (1969) a simple way of defining land reforms is to name it “the redistribution of property or rights in land for the benefit of the landless, tenants and farm labourers”. Land reforms are mainly characterised by the government’s change of laws, regulations or customs regarding land ownership. Land reforms deal with the government in power distributing property which is in most times agricultural land. In some instances it also involves the distribution of land from the more powerful (...) or wealthy group of people such as nobles and bourgeoisie and giving potions of the land to the less powerful in society especially during the start of the post-colonial error in most countries in Southern Africa. During the pre-colonial period, land or pieces of land belonged to different ethnic groups, clans and lineages but now in the post-colonial land reform programs were to introduce individual ownership of land. There are many reasons why the government (both colonial and post-colonial) embark on land reforms and some of the factors influencing them include political reasons such promoting communism or socialism, social reasons such as separating the blacks from the whites and creating social stratification and economic reasons such as facilitating private investments and raising the country’s economic growth of the agricultural sector just but to mention a few reasons. Though some of the government’s reasons to embark on land reforms appear to be noble, local communities refuse these land reforms since they create social stratifications, at times increase poverty, destroy the matrilineal societies and are more political in nature rather than a means to better the people’s lives especially during the colonial error. The essay below will vividly portray why the government embarks on land reform programs and why local people resist these reforms using examples from both colonial and post-colonial Southern African countries. The paper was intended to make a tentative point about the organizational reform and types of organization, i.e., international, national and private. The author explores in the basics of public administration and contextualizes the variables often employed critically for the discipline of public policy and administration. They would include, for instance, the democratic principles,importance of communication and negotiation, the concept of policy network, diversity, technology and ethics, which are applied and argued over the transition from 1947 GATT to a (...) WTO nauguration in 1995. The present study of organizations or their reform would assively be consulted for the national or private reform, which tends to shed a focus on the legal perspective, organizational efficiency and reform. The studies in variance with the types of organization or institutional agenda, as well as in the viewpoint of public policy and administration are generally lacking or insufficient, at least, less systemic or fragmented. While the WTO has made much accomplishment since its inception, it would equally be true that the criticism and new vision had been raised and will be likely ahead. As it is one of the most dynamic and active international organizations, the author likes to exemplify it to test a scope of policy variables as interactive with the last and extended renovation in 1987-1994, which continue to be relevant with the new agendas and vision for a better paradigm of WTO and as an international organization. The author also expects that the future research can develop a set of distinct elements in response with the types of organization and from the viewpoint of public administration. (shrink)

Synthetic biology has a strong modal dimension that is part and parcel of its engineering agenda. In turning hypothetical biological designs into actual synthetic constructs, synthetic biologists reach towards potential biology instead of concentrating on naturally evolved organisms. We analyze synthetic biology’s goal of making biology easier to engineer through the combinatorial theory of possibility, which reduces possibility to combinations of individuals and their attributes in the actual world. In recent work Mary Kate McGowan presents an account of oppressive speech inspired by David Lewis's analysis of conversational kinematics. Speech can effect identity-based oppression, she argues, by altering 'the conversational score', which is to say, roughly, that it can introduce presuppositions and expectations into a conversation, and thus determine what sort of subsequent conversational 'moves' are apt, correct, felicitous, etc., in a manner that oppresses members of a certain group (e.g. because the suppositions and expectations derogate or demean members (...) of that group). In keeping with the Lewisian picture, McGowan stresses the asymmetric pliability of conversational scores. She argues that it is easier to introduce (for example) sexist presuppositions and expectations into a conversation than it is to remove them. Responding to a sexist remark, she thus suggests, is like trying to "unring a bell". I begin by situating McGowan's work in the wider literature on speech and social hierarchy, and explaining how her account of oppressive speech improves upon the work of others in its explication of the relationship between individuals' verbal conduct and structurally oppressive social arrangements. I then propose an explanation and supportive elaboration of McGowan's claims about the asymmetric pliability of conversations involving identity-oppressive speech. Rather than regarding such asymmetry as a sui generis phenomenon, I show how we can understand it as a consequence of a more general asymmetry between making things salient and un-salient in speech, and I show how this asymmetry also operates in various cases that interested Lewis. We provide an overview of Searle's contributions to speech act theory and the ontology of social reality, focusing on his theory of constitutive rules. In early versions of this theory, Searle proposed that all such rules have the form 'X counts as Y in context C' formula – as for example when Barack Obama (X) counts as President of the United States (Y) in the context of US political affairs. Crucially, the X and the Y terms are here identical. A (...) problem arises for this theory for cases involving 'free-standing Y terms', as for example in the case of money in a computerized bank account. Here there is no physical X to which a status function might be attached. We conclude by arguing that Searle's response to this problem creates difficulties for his naturalistic framework. (shrink)

In all probability, future generations will outnumber us by thousands or millions to one. In the aggregate, their interests therefore matter enormously, and anything we can do to steer the future of civilization onto a better trajectory is of tremendous moral importance. This is the guiding thought that defines the philosophy of longtermism. Political science tells us that the practices of most governments are at stark odds with longtermism. But the problems of political short-termism are neither necessary nor inevitable. In (...) principle, the state could serve as a powerful tool for positively shaping the long-term future. In this chapter, we make some suggestions about how to align government incentives with the interests of future generations. First, in Section II, we explain the root causes of political short-termism. Then, in Section III, we propose and defend four institutional reforms that we think would be promising ways to increase the time horizons of governments: 1) government research institutions and archivists; 2) posterity impact assessments; 3) futures assemblies; and 4) legislative houses for future generations. Section IV concludes with five additional reforms that are promising but require further research: to fully resolve the problem of political short-termism we must develop a comprehensive research program on effective longtermist political institutions.
