We discuss models that attempt to provide an explanation for the violation of Bell inequalities at a distance in terms of hidden influences. These models reproduce the quantum correlations in most situations, but are restricted to produce local correlations in some configurations. The argument presented in (Bancal et al. Nat Phys 8:867, 2012) applies to all of these models, which can thus be proved to allow for faster-than-light communication. In other words, the signalling character of these models cannot remain hidden.

The paper is focused on the criticisms that theorists of political constitutionalism raise against legal constitutionalism, especially with regard to the idea of representation and political sovereignty. At the same time, the intention is to reconstruct the debate between legal and political constitutionalism in contemporary liberalism, starting from the so-called counter-majoritarian difficulty. This debate concerns two different approaches: the political one rejects the idea of judicial review by the Supreme Court because it may establish a possible rule of the judges (...) (Michelman; Dworkin). It defends the role of Parliament in constitutional matters, in contrast with the role of the Supreme Court, inasmuch as – according to them – it is not open to political participation. Parliament is considered the only place in which we can exercise our constitutional power and in which our rights could be adequately protected (Bellamy; Waldron; Tushnet; Goldoni). On the other hand, legal constitutionalism upholds the idea of judicial review, defending the role of the Supreme Court as “exemplar of public reason” (Rawls 1993). This article tries to answer to three fundamental questions about constitutional democracy under the banner of political liberalism: 1. What do we mean by counter-majoritarian difficulty? 2. What is the answer that legal and political model of constitutionalism give to this question? 3. What is the role of constitutional courts in democratic regimes and what is their authority within the State? (shrink)

This contribution pays special attention to the Italian legal framework concerning the collaborative and sharing economy, with a focus on those economic initiatives which are platform mediated. This choice is due to the importance of the concept of “platform” in the definitions of the CSE provided at both the Italian and the European levels. As highlighted in some studies, most actors of the CSE can be considered not only economic disruptors but also policy disruptors. Thus, the chapter tries to shed (...) light on the difficulties Italian regulators had while dealing with the emergence of these actors, especially in sectors such as food, accommodation, delivery, and transport. Italian policymakers were not able to design new regulatory frameworks to cope with the challenges of CSE, privileging bans or almost total deregulation over the elaboration of innovative rules. Regarding the issue of digital labour, the Italian legislator adopted a partial solution, creating a framework that dualizes the labour market, maybe with the aim of satisfying both digital workers and platforms. Overall, it seems that the Italian ecosystem of the CSE is bound to evolve, especially after the appearance of the health crisis related to the COVID-19. (shrink)

q. 16 of John of Naples’ Quodlibet III – Utrum dolor vel passio damnatae animae separatae sit, sicut in subiecto immediato, in eius essentia vel potentia – evokes one of the most delicate debates, both from a theological and philosophical point of view, of scholastic eschatology between the end of the 13th century and the first decades of the 14th: that relating to the action of hellfire (considered, due to the auctoritas of Gregory the Great, corporeal and identical in essence (...) to sublunar fire) on an immaterial reality such as the soul in its state of separation (i.e. in the period between the individual death and the final judgement). The article retraces the way in which (in the well-known q. 2 of Quodlibet VI) John of Naples defends Thomas Aquinas from the suspicion of incurring, with his position, the condemnations of Tempier in 1270 and 1277, and how Aquinas himself tries to explain (especially in q. 26 of his Quaestiones disputatae de veritate) the passio or pain of the soul (both in the state of separation and in that of conjunction), through the double distinction between passio corporalis and passio animalis, and, within the former, between laesio and experimentalis perceptio laesionis. It then analyses q. 16 of Quodlibet III, in which John of Naples identifies the rational appetite – i.e. the will – as the immediate subject of the separate soul’s pain. In the appendix, an edition of John’s question is provided on the basis of the manuscripts Napoli, Biblioteca Nazionale, VII.B. 28 (= N) and Tortosa, Biblioteca de la Catedral, 244 (= T). (shrink)

Basilio Sabazio was the first in Italy to argue for the unity and corruptibility of either sublunar or celestial matter. In this paper new insight of his intellectual activity between Napoli and Milano is provided, and in particular his relationship with Scipione Capece, from whose letter to Giovan Francesco di Capua, Count of Palena we learn that Sabazio was an expert in philology and astronomy. The surviving part of an essay by Sabazio to the astronomer Francesco Cigalini from Como (...) is here edited with some informations about Cigalini’s reply. A newly recovered Sabazio’s astronomical work is here edited – from which his endorsement of Eraclides Ponticus’ astronomical system is evident –, as well as his Consilium to Pope Paolo III about the urgency of convening a general council. The Carafa of Santa Severina Chapel in the church of San Domenico (...) Maggiore, Naples, was one of the favourite places of Giordano Bruno’s youth. Its structure, similar to that of Giulio Camillo’s theatre, and the presence of thirty astrological symbols carved on the arches, make it the ideal ‘memory place’ for the application of the innovative ‘art of memory’ developed by the philosopher. In his Vermischte Bemerkungen 43, Wittgenstein notices that he was also influenced by Oswald Spengler. The paper deals with the question of in which way Spengler influenced Wittgenstein’s late works and if it really was influence or only a coincidence of ideas. It is put forward that Spengler’s rather unknown philosophy of language influenced Wittgenstein’s philosophy of language, especially the concepts of family resemblance, antiessentialism, and language-game (Sprachspiel). A picture of the famous Neapolitan gesture of “negation” which motivated Wittgenstein to (...) give up the picture theory of language is also shown with an example taken from Andrea de Jorio, La mimica degli antichi investigala nel gestire napoletano, Napoli 1832. FROM THE HISTORY OF PHYSICS TO THE DISCOVERY OF THE FOUNDATIONS OF PHYSICS By Antonino Drago, formerly at Naples University “Federico II”, Italy – drago@unina,.it (Size : 391.800 bytes 75,400 words) The book summarizes a half a century author’s work on the foundations of physics. For the forst time is established a level of discourse on theoretical physics which at the same time is philosophical in nature (kinds of infinity, kinds of organization) and formal (kinds of mathematics, kinds of logic). (...) This double side of the two dichotomies assures a deep comprehension of theoretical physics by avoiding both a purely philosophical analysis and a purely formal analysis, each manifestly insufficient for representing all the aspects of theoretical physics. Among the many formulations of a physical theory, e.g. Mechanics, also Mach(1) recognized technical differences only, Instead my suggestion is to consider their differences as revealing the characteristic features of their foundations. No more radical differences may exist than those concerning both their kinds of Mathematics and their kinds of Logic. As a fact, after the 20th Century within each of these sciences there exist two antagonist foundations, within Mathematics either the classical one or the constructive one(2); within Mathematical Logic either the classical logic or the intuitionist one(3). Let us take Mechanics as an instance. Being the choices of the Newton’s formulation respectively the actual infinity of the differential equations relying on the infinitesimals and the classical logic, a formulation based on the alternative choices is Lazare Carnot’s,(4) whose mathematics is no more than algebraic-trigonometric and the logic is the intuitionist one, because this formulation makes use of doubly negated propositions, whose corresponding affirmative propositions are idealistic or false; i.e. in these cases the law of double negation fails, as in intuitionist logic occurs. By considering these two dichotomies as the foundations of the physical theories, each couple of choices upon them fashions one out four models of scientific theory, which are baptized through the authors of their most representative theories: Newtonian, Carnotian, Lagrangian, Descartesian. In correspondence four versions of the principle of inertia are recognized, as suggested by respectively: Descartes. Lazare Carnot, Enriques and Cavalieri.(5) All that suggests that the four models of scientific theory may be graphically represented as a compass orientating our minds amid the so numerous physical theories. By taking these dichotomies as interpretative categories, a new interpretative history of Physics including both classical and modern physics results according to a quadrilinear development. The birth of modern physics is characterized by the two theories - Einstein’s paper on special relativity and Einstein’s first paper on quanta - whose choices are the alternative ones to those of the previously dominant physical theory, Newtonian mechanics: in the latter paper Einstein i) declares the dichotomy on the kinds of mathematics (“Introduction”) and then he chooses the discrete mathematics; ii) by using doubly negated propositions he organizes his theory in an alternative way to the deductive-axiomatic one.(6) Moreover, a new history of Philosophy of knowledge results. Kant’s first two a priori transcendental categories represent the physical interpretation of the two choices out of the four pairs of choices on the two dichotomies, i.e. the choices of the dominant theory of mechanics, Newton’s. Hegel’s dialectic was a misleading attempt of anticipating the subsequent intuitionist logic. The book starts by a comparison of different formulations of thermodynamics in order to recognize the first dichotomy on the kind of organization. In chapter 2 the dichotomy on the kind of infinity is recognized through a comparison of Newrton’s mechanics and Lazare Carnot’s. A quickly history of the other classical physical theories is illustrated in chapter 3; it results a foundational conflict between the last two theories, and hence a conflict between their opposite couples of choices. The two main theories of modern physics, special realtivity and quantum mechanics confirm the foundational role played by the two dichotomies which gives reason for the radical change in the history of theoretical physics. Indeed, the opposition of the two main pairs of choices gives reason of the crisis in theoretical physics in the early 1900s. As a global result, the book represents the first interpretation of the entire history of Physics, both classical and modern; This fact proves that the four models of scientific theories can works as a compass (that of the front cover) suggesting a direction among the many physical theories. This new history of physics leads to re-visit both Koyré’s and Kuhn’s historiographies. Their interpretative categories are interpreted and explained through the two dichotomies so that it is possible to suggest à la Koyré categories based on the alternative choices theories to Newton’s as the suitable categories for interpreting the alternative theories to Newton’s mechanics. All that suggests a new interpretation of the crucial step in the history of Western philosophy of knowledge, i.e. the passage from Leibniz to Kant: Leibniz’s suggestion of the two labyrinths of human minds may be seen as a close anticipation of the two above dichotomies. Kant applied them in order to construct the well-known four cosmological proofs, which however he misinterpreted as leading to contradictions, instead to tow different methods of investigation corresponding to the two different kinds of logic.(7) Bibliography 1. Il contributo consiste in una analisi e commento della prima sezione del De docta ignorantia di Nicola Cusano (capp. I-XVI), dedicata ai concetti di precisione matematica e di uguaglianza. Il saggio offre la possibilità di ripercorrere la teoria della conoscenza di Cusano, laddove l'impossibilità per la ragione di giungere ad una mens-ura precisa dell'oggetto da conoscere non si trasforma in una mera cultura del limite, bensì la filosofia negativa diviene base per la mistica. In altri termini l'obiettivo specifico del saggio (...) è rilevare come il metodo della dotta ignoranza apra alla conoscenza dell'infinito proprio nel momento in cui essa nega ogni conoscenza razionale precisa. La matematica diviene dunque il fondamento su cui far leva per innalzare la propria mente (transferre) verso la conoscenza simbolica di Dio, nel medesimo solco tracciato da Dionigi e dalla tradizione della mistica speculativa. Este trabajo se propone dos objetivos, uno descriptivo y otro propositivo. El descriptivo consiste en el análisis de la crítica que realiza E. Cioran, a lo largo de su obra, a la concepción humanista del ser humano Nuestro filósofo pone en cuestión la arrogancia del hombre que se coloca en el lugar fundamental y de supremacía en el ámbito de la vida, lugar que le sirve de justificación para conquistar, apropiarse y aniquilar a la naturaleza y al resto de los (...) vivientes. Por otro lado, en términos propositivos, me interesa plantear la cuestión de la animalidad(el animal que es el ser humano, y los animales no humanos) porque permite poner en cuestión esa concepción humanista, y pensar nuevos modos de ser-con lo viviente. En este sentido, sostengo a lo largo del trabajo que la filosofía de Cioran permite pensar una noción de lo humano atravesada por la animalidad, noción cioraneana que desarma("descompone") la arrogancia de los humanismos. Para ello me serviré de la problemática de la muerte como inmanente a la vida y de la crítica de Cioran a la noción de propiedad. (shrink)
