Current debates in Clinical Legal Education (CLE) exclude essay writing as a legitimate form of ‘clinical’ pedagogy. This article argues that essay writing should be classified as a form of CLE due to its potential to mirror legal practice and enhance students' reflective capacities. By incorporating Hegelian dialectical reasoning, the paper proposes a structured approach to legal essay writing that includes thesis, antithesis, and synthesis. This method encourages students to engage deeply with legal arguments, reflecting on their (...) merits and counterarguments. The dialectical approach aligns with constructivist teaching methodologies, promoting critical thinking and practical skills relevant to legal practice and beyond. The article outlines the theoretical basis of this model and provides a practical framework for its implementation in legal education. It further connects this pedagogical strategy to the development of transferable skills that prepare students for professional legal environments. Through this dialectical method, the paper advocates for a more holistic and nuanced understanding of legal concepts, bridging the gap between academic theory and practical application, and, thus, making the case for the incorporation of Hegel-inspired essay writing into the definition of CLE. Perhaps no one has done more in the last 30 years to advance thinking in the metaphysics of modality than has Alvin Plantinga. Collected here are some of his most important essays on this influential subject. Dating back from the late 1960's to the present, they chronicle the development of Plantinga's thoughts about some of the most fundamental issues in metaphysics: what is the nature of abstract objects like possible worlds, properties, propositions, and such phenomena? The rapid pace of technological advancements offers an essential field of research for a deeper understanding of man’s relationship with artifacts of her design. These artifacts designed by humans can have various mental and physical effects on their users. The human interaction with the artifact is not passive; on the contrary, it exhibits a potential that reveals the inner dispositions of human beings and makes them open to new creations. In this article, we will examine the impact of technology on (...) human life through the dispositional compatibilism perspective of the contemporary philosopher Kadri Vihvelin, arguing for a system of metaphysics in which ontology of properties depend on dispositions. In this context, the emerging phenomenon of dispositional compatibilism opens the door to developing new philosophical ideas for evaluating the concepts of compatibilism and freedom in the context of technology. Thus, it is emphasized that although technological devices shape human life, new and unforeseen powers may emerge due to human-artifact interaction. This article will examine the idea of dispositional compatibilism by specifically considering human interaction with text-based AI applications. The ability of AI to collaborate with human thought patterns is a meaningful example of the observation of dispositional compatibilism. In conclusion, the article aims to address the effects of technology on human freedom by approaching the human-artifact relationship from a dispositional perspective. It also aims to defend the claim that technological artifacts can positively contribute to human freedom from the perspective of dispositional compatibilism. (shrink)

The subject of this essay-based dissertation is Hume’s natural philosophy. The dissertation consists of four separate essays and an introduction. These essays do not only treat Hume’s views on the topic of natural philosophy, but his views are placed into a broader context of history of philosophy and science, physics in particular. The introductory section outlines the historical context, shows how the individual essays are connected, expounds what kind of research methodology has been used, and encapsulates the research contributions (...) of the essays. The first essay treats Newton’s experimentalist methodology in gravity research and its relation to Hume’s causal philosophy. It is argued that Hume does not see the relation of cause and effect as being founded on a priori reasoning, similar to the way in which Newton criticized non-empirical hypotheses about the causal properties of gravity. Contrary to Hume’s rules of causation, the universal law does not include a reference either to contiguity or succession, but Hume accepts it in interpreting the force and the law of gravity instrumentally. The second article considers Newtonian and non-Newtonian elements in Hume more broadly. He is sympathetic to many prominently Newtonian themes in natural philosophy, such as experimentalism, critique of hypotheses, inductive proof, and the critique of Leibnizian principles of sufficient reason and intelligibility. However, Hume is not a Newtonian philosopher in many respects: his conceptions regarding space and time, the vacuum, the specifics of causation, the status of mechanism, and the reality of forces differ markedly from Newton’s related conceptions. The third article focuses on Hume’s Fork and the proper epistemic status of propositions of mixed mathematics. It is shown that the epistemic status of propositions of mixed mathematics, such as those concerning laws of nature, is that of matters of fact. The reason for this is that the propositions of mixed mathematics are dependent on the Uniformity Principle. The fourth article analyzes Einstein’s acknowledgement of Hume regarding special relativity. The views of the scientist and the philosopher are juxtaposed, and it is argued that there are two common points to be found in their writings, namely an empiricist theory of ideas and concepts and a relationist ontology regarding space and time. These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). This essay is my critical review of Al Gini and Alexei Marcoux’s fine text, The Ethics of Business. Unlike most business ethics texts, Gini/Marcoux recognize that most businesses are small, and that business is not inherently immoral and always in need of reform. And they put their focus on using ethical theory to find action-guiding principles to help guide business behavior. Moreover, they adopt the Schumpeterian view that business is an entrepreneurial activity—one that not merely executes transactions, but seeks (...) them out. I critically probe a number of issues with their book such as their reliance upon virtue ethics as their main ethical theory, and their view that trust plays an overwhelming role in business. The belief that an eternal-atemporal God is present to temporal beings is at the heart of Christian doctrine. The problem with such belief is that there seems to be a metaphysical barrier between them. Therefore, the doctrine of divine timelessness is incompatible with divine presence. This essay will show that such a contention is false, given that His awareness of the temporal beings will be sufficient to account for His presence. This approach is not directly interested in matters of time (for example, in evolution), but rather in the formal shape of biological objects. So it is different from, but not opposed to, natural science. In his later years, Wittgenstein made similar investigations in psychology and mathematics. While swing music was outlawed in Nazi Germany as “degenerate,” the Nazi regime created a radio program called “Charlie and his Orchestra” for foreign consumption. The propaganda lay in the changes to the original lyrics of the songs played, making them convey the anti-Semitic and other themes of the Nazi ideology. ‘Reasoning’ can be considered a general concept that, upon speaking, is the ‘enraonar’, a Catalan word that should not be mistaken with ‘explain’ nor with ‘discuss’ which imply more detail, and cover different situations. This article is presented as an essay on the ancient ideal of ‘enraonar’. To that end, it is explained in what sense ‘enraonar’ and reason are one of the most complex phenomena thought has to deal with. In this essay, we discuss Simona Ginsburg and Eva Jablonka’s The Evolution of the Sensitive Soul from an interdisciplinary perspective. Constituting perhaps the longest treatise on the evolution of consciousness, Ginsburg and Jablonka unite their expertise in neuroscience and biology to develop a beautifully Darwinian account of the dawning of subjective experience. Though it would be impossible to cover all its content in a short book review, here we provide a critical evaluation of their two key ideas—the role of (...) Unlimited Associative Learning in the evolution of, and detection of, consciousness and a metaphysical claim about consciousness as a mode of being—in a manner that will hopefully overcome some of the initial resistance of potential readers to tackle a book of this length. This dissertation explores the prospects of postdeflationary substantive theorizing about truth. Postdeflationary theories define the concept of truth or the property of being a true truthbearer in a way that respects the deflationary desiderata of clarity, purity, and permissiveness with truth-aptness, without a necessary commitment to the core negative thesis of the deflationary approach. Postdeflationary substantive theories further acknowledge the complexity and explanatory utility of truth in understanding and defining other concepts and phenomena. The motivation for pursuing this study arises (...) from the so-called contemporary crisis of truth, where a substantive understanding of truth is subjected to widespread skepticism, critique, and even cynicism both inside and outside of philosophy in formal and mundane discourse. To better understand this crisis, particular attention is directed towards the deflationary critique of substantive theories of truth, which is a prevalent point of discussion in contemporary literature on western analytic philosophy. By exploring the limits and philosophical sustainability of deflationary critique of substantive accounts of truth, valuable insight is gained about the contemporary crisis of truth and the potential for substantive theorizing about truth in general. This dissertation composes of an introduction and four original research publications that address two connected themes: exploration of the philosophical sustainability of deflationary critique of substantive theories of truth, and exploration of the prospects for development of the now popular substantive pluralist theories of truth. These themes constitute both negative and positive aspects in relation to analyzing the prospects of postdeflationary substantive theorizing about truth. The first part of this dissertation focuses on arguing against the widespread deflationary readings of W.V.O. Quine’s truth, who is widely interpreted as a prominent and influential deflationist in both the secondary literature on his philosophy and contemporary truth-theoretic debates more broadly conceived. The first essay demonstrates that Quine’s immanent conception of truth involves commitments that are incompatible with general and theory-specific framings of the deflationary thesis. The second essay demonstrates conflicts between Quine’s views and what has in recent literature been argued as strong and moderate variants of the deflationary thesis. In conclusion, these essays demonstrate that the widespread deflationary readings of Quine’s truth are mistaken, thus removing a prominent thinker from the deflationists ranks while simultaneously casting suspicion towards the philosophical sustainability of the deflationary approach in general. The second part of this dissertation explores the prospects of postdeflationary substantive theorizing about truth by analyzing the limits and prospects for development of the increasingly popular substantive pluralist theories. The third essay explores different ways in which semantic ambiguity poses trouble for current pluralist models. The fourth essay argues that to achieve the theoretical desiderata that pluralists ask from discourse domains, the latter ought to be individuated on ontological rather than topical grounds. In conclusion, these essays demonstrate that while current pluralist models involve shortcomings, they encompass potential for development and provide a viable prospect for sustainable postdeflationary substantive theorizing about truth. As conceived by analytic philosophers ontology consists in the application of the methods of mathematical logic to the analysis of ontological discourse. As conceived by realist philosophers such as Meinong and the early Husserl, Reinach and Ingarden, it consists in the investigation of the forms of entities of various types. The suggestion is that formal methods be employed by phenomenological ontologists, and that phenomenological insights may contribute to the construction of adequate formal-ontological languages. This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

In Essays on Beauty & the Arts (2023) (‘Essays’), Dominic McIver Lopes has unearthed something of a champion for his ongoing mission to rejuvenate analytic aesthetics. ‘The history of analytic aesthetics’, Lopes declares, ‘is dominated by writing on Kant and, to a lesser extent, David Hume. … We badly need to excavate alternatives to the tradition of Hume and Kant’ (p. xvi). As tall of an order this already is, the height of Lopes’s hopes for Bolzano appears to reach further (...) still—‘Perhaps Bolzano can do for aesthetics what Mill and Kant do for ethics’ (p. xxv). While the jury is still out on whether Bolzano can fill those shoes, what is clear is that Lopes succeeds at making a tantalizing case on Bolzano’s behalf. (shrink)

This dissertation provides a careful reading of the later Wittgenstein’s philosophy of mathematics centered around three major themes: reality, determination, and infinity. The reading offered gives pride of place to Wittgenstein’s therapeutic conception of philosophy. This conception views questions often taken as fundamental in the philosophy of mathematics with suspicion and attempts to diagnose the confusions which lead to them. In the first essay, I explain Wittgenstein’s approach to perennial issues regarding the alleged reality to which mathematical truths or (...) propositions correspond. Wittgenstein diagnoses exotic pictures of mathematical reality as stemming from misleading analogies formed across empirical and mathematical propositions. The second essay explains Wittgenstein’s treatment of perplexity regarding the ability of a mathematical rule to determine its applications in advance. This too is found to depend on a misleading analogy, in this case across behavioral and mathematical senses of ‘determine’. The third and final essay discusses Wittgenstein’s general critical approach to “the infinite”. Philosophical perplexity about infinity is shown to depend on the verbal imagery regularly associated with proofs and their power to take hold of one’s imagination. Wittgenstein dampens the imaginative excesses often associated with “the infinite” by offering a sober redescription of Cantor’s famous method of diagonalization. (shrink)

The Austrian philosopher Christian von Ehrenfels published his essay "On 'Gestalt Qualities'" in 1890. The essay initiated a current of thought which enjoyed a powerful position in the philosophy and psychology of the first half of this century and has more recently enjoyed a minor resurgence of interest in the area of cognitive science, above all in criticisms of the so-called 'strong programme' in artificial intelligence. The theory of Gestalt is of course associated most specifically with psychologists of (...) the Berlin school such as Max Wertheimer, Wolfgang Kohler and Kurt Koffka. We shall see in what follows, however, that an adequate philosophical understanding of the Gestalt idea and of Ehrenfels' achievement will require a close examination not merely of the work of the Berlin school but also of a much wider tradition in Austrian and German philosophy in general. According to the traditional Bayesian view of credence, its structure is that of precise probability, its objects are descriptive propositions about the empirical world, and its dynamics are given by conditionalization. Each of the three essays that make up this thesis deals with a different variation on this traditional picture. The first variation replaces precise probability with sets of probabilities. The resulting imprecise Bayesianism is sometimes motivated on the grounds that our beliefs should not be more precise than the evidence (...) calls for. One known problem for this evidentially motivated imprecise view is that in certain cases, our imprecise credence in a particular proposition will remain the same no matter how much evidence we receive. In the first essay I argue that the problem is much more general than has been appreciated so far, and that it’s difficult to avoid without compromising the initial evidentialist motivation. The second variation replaces descriptive claims with moral claims as the objects of credence. I consider three standard arguments for probabilism with respect to descriptive uncertainty—representation theorem arguments, Dutch book arguments, and accuracy arguments—in order to examine whether such arguments can also be used to establish probabilism with respect to moral uncertainty. In the second essay, I argue that by and large they can, with some caveats. First, I don’t examine whether these arguments can be given sound non-cognitivist readings, and any conclusions therefore only hold conditional on cognitivism. Second, decision-theoretic representation theorems are found to be less convincing in the moral case, because there they implausibly commit us to thinking that intertheoretic comparisons of value are always possible. Third and finally, certain considerations may lead one to think that imprecise probabilism provides a more plausible model of moral epistemology. The third variation considers whether, in addition to conditionalization, agents may also change their minds by becoming aware of propositions they had not previously entertained, and therefore not previously assigned any probability. More specifically, I argue that if we wish to make room for reflective equilibrium in a probabilistic moral epistemology, we must allow for awareness growth. In the third essay, I sketch the outline of such a Bayesian account of reflective equilibrium. Given that this account gives a central place to awareness growth, and that the rationality constraints on belief change by awareness growth are much weaker than those on belief change by conditionalization, it follows that the rationality constraints on the credences of agents who are seeking reflective equilibrium are correspondingly weaker. One of Leibniz’s more unusual philosophical projects is his presentation (in a series of unpublished drafts) of an argument for the conclusion that a time will necessarily come when “nothing would happen that had not happened before." Leibniz’s presentations of the argument for such a cyclical cosmology are all too brief, and his discussion of its implications is obscure. Moreover, the conclusion itself seems to be at odds with the main thrust of Leibniz’s own metaphysics. Despite this, we can discern (...) a serious and important point to Leibniz’s consideration of the doctrine, namely in what it suggests about the proper boundary between metaphysics and theology, on the one hand, and ordinary history (whether human or natural), on the other. And we can get a better sense of Leibniz purpose in the essays by considering them in the context of Leibniz's response to Thomas Burnet's "Telluris theoria sacra" (1681-89). Leibniz praises Burnet's history of earth for presenting a harmony between the principles of nature and grace, a harmony absent in the cosmogonies of Descartes and the Newtonians. But Leibniz also complains that Burnet misconceives the boundary between natural explanation and reflections on divine wisdom. And Leibniz's essays on cyclical cosmology suggest the alternative to Burnet's account: a natural history of the earth and its inhabitants should be radically autonomous from, even if ultimately harmonious with, theological principles. Among recent developments in the anthropological sciences, hardly any have found so much attention and led to so much controversy as have the views advanced by the late Benjamin Whorf.The hypothesis offered by Whorf is,“that the commonly held belief that the cognitive processes of all human beings possess a common logical structure which operates prior to and independently of communication through language, is erroneous. It is Whorf's view that the linguistic patterns themselves determine what the individual perceives in this world (...) and how he thinks about it. Since these patterns vary widely, the modes of thinking and perceiving in groups utilizing different linguistic systems will result in basically different world views”.“We are thus introduced to a new principle of relativity which holds that all observers are not led by the same physical evidence to the same picture of the universe, unless their linguistic backgrounds are similar. … We cut up and organize the spread and flow of events as we do largely because, through our mother tongue, we are parties to an agreement to do so, not because nature itself is segmented in exactly that way for all to see”. With this book we want to illustrate the way we philosophers think that public argument and debate should be. Our goal is not to present a collection of academic texts. Although most of us are part of the academy, we want to present to the lay public shorter, more essay-like texts, originally published on an Internet page called Refutations. The page is not, of course, an academic journal; it is a digital magazine with opinion texts that share simplicity, rigor (...) and total accessibility to anyone not initiated to the philosophers' way of thinking. And although the magazine's columnists are friends, they actively disagree on the most diverse topics, such as politics, economics, ethics and art. The reader, therefore, has before him a book with the most varied opinions on some of the main contemporary themes. Naturally, we do not expect to have the last word on any matter. Our intention is much more modest, but also very important: to show that it is possible, even without putting an end to the debates, to think in a creative, clear and civilized way. / Com este livro queremos ilustrar a maneira como nós, filósofos, pensamos que a argumentação e o debate públicos devem ser. Nosso objetivo não é apresentar uma coletânea de textos acadêmicos. Embora a maioria de nós seja parte da academia, queremos apresentar ao público leigo textos mais curtos e ensaísticos, originalmente publicados em uma página na Internet chamada Refutações. A página não é, naturalmente, um periódico acadêmico; trata-se de uma revista digital com textos de opinião que compartilham a simplicidade, o rigor e a total acessibilidade a qualquer não iniciado ao modo de pensar dos filósofos. E, embora os colunistas da revista sejam amigos, eles discordam ativamente a respeito dos mais diversos temas, como política, economia, ética e arte. O leitor, portanto, tem diante de si um livro com as mais variadas opiniões a respeito de alguns dos principais temas contemporâneos. The object of realist metaphysics is generally thought to be to describe the structure of the world as it is in itself, or, alternatively, to determine precisely what is real. The purpose of this essay is to suggest that, although there have been many attempts to achieve this goal, they all fall down, not simply because they have misconstrued the nature of the in-itself or precisely what is real, but because, more fundamentally, they are not clear about what it (...) is to talk about the in-itself or the real. In short, contemporary realism, both continental and analytic, does not have an adequate concept of reality. (shrink)

I argue that appreciation of the phenomenon of forgetting requires serious attention to its origins and place in nature. This, in turn, necessitates metaphysical inquiry as well as empirical backing – a combination likely to be eschewed by psychological orthodoxy. But, if we hope to avoid the conceptual vacuity that characterizes too much of contemporary psychological inquiry (e.g., Klein, 2012, 2014a, 2015a, 2016a), a “big picture” approach to phenomena of interest is essential. Adopting this investigative posture turns the “received view” (...) of the relation between remembering and forgetting on its head: Rather than treated as the result of breakdowns and limitations of biologically engineered systems of remembering, forgetting is accorded elevated status as the driving force behind the evolution of organic systems of information retention. We introduce the topic of panpsychism, before briefly outlining the 19 essays on panpsychism containing in this special issue.

Where Humeans rule out the possibility of material or non-logical necessity, and thus of any associated knowledge a priori, the German legal philosopher Adolf Reinach defends the existence of a wide class of material necessities falling within the domain of what can be known a priori, for example in fields such as color and shape, rational psychology, law and economics. Categories such as promise or claim or obligation are, in Reinach’s view, exist as nodes in a system of necessary relations, (...) so that anyone who has experience of relevant instances of these categories is implicitly aware also of a corresponding family of relations to certain other categories – as for example that every promise implies a mutually correlated claim and obligation. Midway between the two extremes of Hume and Reinach stands Searle, who accepts necessary relations of the mentioned sorts, but sees them as human creations, following from ‘constitutive rules’ analogous to the rules of chess. We seek to demonstrate that Searle does not occupy a stable and acceptable half-way house between Hume and Reinach; that he, too, if he is to do justice to the very constitutive rules which form the center of his approach, must on pain of circularity embrace something like the Reinachian position. A series of essays on film and philosophy whose authors - philosophers or film studies experts - write on a wide variety of films: classic Hollywood comedies, war films, Eastern European art films, science fiction, showing how film and watching it can not only illuminate philosophy but, in an important sense, be doing philosophy. The book is crowned with an interview with Wittgensteinian philosopher Stanley Cavell, discussing his interests in philosophy and in film and how they can come together.

In this short chapter I propose some possible research directions ad- dressing the problem of how cognitive, formal and computational models of trust (i.e. one of the main areas of Rino Falcone’s contribu- tions) can play a major role in the development of cognitive modeling and AI research community in the context of what Allen Newell called the rational and social bands.

This dissertation is composed of three essays which examine the impact of financial integration and trade liberalization. Chapter I investigates the effect of financial openness on labor share of income by using four measures of the labor share of income: one unadjusted and three adjusted measures of income share which account for earnings from the self-employed workers. The author also uses both measures of capital account openness: de jure and de facto indicators. The empirical work is applied for a panel (...) dataset of 30 countries during the period of 1970 – 2013. Despite using different measurement methods of the labor share of income and financial openness, the results from all specifications support the hypothesis that financial integration leads to a decline in the labor share of income for the all countries sample. This 183-page introductory part of my dissertation is an overview of some key debates in philosophical moral psychology and its methodology.

New philosophical essays on love by a diverse group of international scholars. Topics include contributions to the ongoing debate on whether love is arational or if there are reasons for love, and if so what kind; the kinds of love there may be ; whether love can explain the difference between nationalism and patriotism; whether love is an necessary component of truly seeing others and the world; whether love, like free will, is “fragile,” and may not survive in a deterministic (...) world; and whether or not love is actually a good thing or may instead be a force opposed to morality. Key philosophers discussed include Immanuel Kant, Iris Murdoch, Bernard Williams, Harry Frankfurt, J. David Velleman, Niko Kolodny, Thomas Hurka, Bennett Helm, Alfred Mele and Derk Pereboom. Essays also touch on the treatment of love in literature and popular culture, from Graham Greene’s The End of the Affair to Spike Jonze’s movie her. (shrink)
