Sobre el libro de John Saxe-Fernández, La compra-venta de México, Plaza & Janés, México 2002, 600 págs.

En México y en otros países, eufemísticamente llama-dos "en desarrollo", los sistemas públicos de atención a la salud enfrentan continuos recortes presupuestales, lo que impacta negativamente a los recursos materiales y a la disminución de plazas para los egresados de las carreras de medicina, esto es, menos contratos de médicos de base en hospitales, clínicas y centros de salud. Bajo este panorama adverso, algunos administradores, desarrolladores de software y no pocos políticos preclaros, suponen que la salida a los problemas económicos (...) estará en el uso intensivo de la inteligencia artificial (en adelante IA) y la robótica. Una vez que los algoritmos sean adecuadamente entrenados, un ejército de robots doctores serán capaces de hacer valoraciones más precisas, diagnósticos 100% acertados, y prescripciones farmacológicas exactas; mucho mejor que los médicos humanos. Además, la IA no se cansa, no protesta, no se sindicaliza… ¿Realidad o ficción? En países como China y el Reino Unido ya se utilizan técnicas computacionales para la interpretación de imágenes de rayos X, detección de tumores, prótesis inteligentes e incluso IA para predecir los resultados de un ataque cerebrovascular isquémico. En México se incorporó a RoomieBot, un robot que sirve para el diagnóstico de pacientes con posible coronavirus. La cirugía robótica Da Vinci es buen ejemplo de cómo la IA puede trabajar colaborativamente con la o el cirujano en el quirófano. Sin embargo, aún quedan por resolver grandes desafíos antes de preocuparse por el llamado desempleo tecnológico de los egresados. Si bien la IA es una valiosa herramienta, en estricto sentido, en esta y en otras muchas áreas su autonomía total es todavía una quimera, por ejemplo: los vehículos autónomos pueden ser engañados y hackeados, y no existe aún un robot que pueda hacer un simple nudo a las correas de sus zapatos sin asistencia 2. Por otra parte, se requiere un marco normativo-todavía inexistente-para la aplicación universal de IA en los cuidados de la salud. Los principios de la bioética están claramente establecidos: la beneficencia, la no maleficencia, la autonomía y la justicia, así como el Juramento Hipocrático. No es así para IA, donde los países interesados no llegan al consenso de los principios morales básicos de la medicina que debería extrapolar 3. Hasta que no se solucionen los problemas técnicos, tecnológicos y, sobre todo, los dilemas éticos, la IA deberá continuar como la útil herramienta que es para la medicina; sin embargo, sustituir el valor intrínseco kantiano de la persona es algo que, seguramente, tendremos mucho tiempo para reflexionar y, acaso, algún día resolver de manera satisfactoria. John Searle’s theory of social ontology posits that there are indispensable normative components in the linguistic apparatuses termed status functions, collective intentionality, and collective recognition, all of which, he argues, make the social world. In this paper, I argue that these building blocks of Searle’s theory are caught in a petitio of constitutive circularity. Moreover, I note how Searle fails to observe language in reciprocal relation to the institutions which not only are shaped by it but also shape language’s practical (...) applications. According to Searle, social theorists that tried to show a connection between society, culture, and language all failed to see the constitutive role of language in the making of social reality. Consequently, I believe that Searle is himself guilty of a certain kind of blind presumption, and argue that Hegel’s philosophy of culture, which Searle dismisses as implausible, offers a more cohesive account of the normative transactions between human beings and their social world. ¿Podemos habituarnos a un mundo más sostenible? Más vale que digamos que sí. En septiembre de 2015, Naciones Unidas adoptó los 17 Objetivos de Desarrollo Sostenible (ODS). Esta Agenda 2030 es la respuesta del concierto mundial frente a desafíos como la pobreza, la desigualdad social, el hambre, la corrupción y el cambio climático. Los gobiernos de los 193 miembros de la ONU se comprometieron con esta hoja de ruta por un mundo más vivible. Pero ¿cuál es el papel de las (...) personas corrientes y molientes? Esta obra apunta a integrar los ODS en el ejercicio cotidiano de la ciudadanía. El futuro es sostenible no solo por el compromiso gubernamental, sino también individual de cada ciudadano. En estos 15 capítulos, profesores e investigadores de universidades de España, de México, de Colombia y de Venezuela exploran la tríada ambiental, social y económica que define el desarrollo sostenible. De allí que la educación ética y filosófica ha de transitar, a nuestro juicio, por el diálogo, la ecoética, la ecosofía indígena, la igualdad de género, el pensamiento crítico, la educación en y para la paz, la educación emocional, la compasión, la agencia epistémica, la inclusión, el cuidado de la salud mental, la fraternidad en las redes sociales, la moda sostenible, el consumo sostenible en consonancia con la educación ambiental y la verdad frente a la desinformación. La sostenibilidad no es un logro instantáneo, sino un proceso continuo que se entrelaza con hábitos y prácticas sostenibles. El êthos, o hábito (héxis) sostenido que se convierte en praxis, es el hilo conductor de estas reflexiones éticas y filosóficas sobre 15 hábitos, vinculados directa o transversalmente con los 17 ODS, que se han identificado como un nuevo mapa -este más ciudadano- para conseguir no un futuro, sino un presente más sostenible. The American philosopher John Dewey is probably best known for his contributions to educational philosophy, though his writings on logic, metaphysics, epistemology and value theory are for the most part equally impressive. Before and after his death in 1952, he was lauded as “America’s philosopher” and a “public intellectual for the twentieth century.” During the early 1920s, to call Dewey an internationalist would be to state the obvious. He had travelled to Japan, Russia, Mexico, Turkey and China. Of all these (...) places, he stayed in China the longest—two years and two months (May 1919 to July 1921)—and wrote the most about his experiences there. Unfortunately, too much of the extent literature speaks to how Dewey influenced China. In this brief paper the author focuses on the question of how China changed Dewey. Before attempting this project it helps to explicate how Dewey conceived experience—to paint a picture of his so-called “metaphysics of experience”—in order to then appreciate how he conceived his own China experience. English Abstract In Art as Experience, John Dewey decried the estrangement of art from lived human experience, both by artificial conceptual walls and the physical walls that secluded art within museums. Instead he argued that making and enjoying art are crucial organic functions that sustain communities and integrate individuals within their environments. In the 1920’s Diego Rivera became one of the luminaries of the Mexican muralist movement by creating frescoes that were rooted in Mexican life, both in their subject matter (...) and public location. Rivera and the other artists working within the government cultural program guided by José Vasconcelos created murals that boldly expressed the new values of democracy, peaceful revolution, racial equality and cultural pride. This essay explores the deep resonance between Rivera’s most prominent murals from this period and Dewey’s argument that art is a refined and integral feature of human experience. In particular, this essay will examine the great extent to which these men independently came to the common understanding that for people to thrive and grow they need to create and experience art that grows out of and remains rooted in their culture. Without claiming that either thinker influenced the other, this essay argues that their works mutually inform and enrich each other. Both men sought to free art from the museum, but where Dewey urged us tear down the walls that separated art from lived experience, Rivera transformed walls themselves into murals that unified and educated the people of Mexico and restored their culture. Se realiza una investigación documentada sobre el contenido semántico del concepto "América Latina" en sus orígenes y en su evolución posterior. Se muestra que en sus inicios el concepto tuvo un significado emancipador y descolonizador en el uso que de él hicieron Francisco Bilbao y José María Torres Caicedo. Luego fue utilizado con propósitos recolonizadores en los marcos de la invasión napoleónica a México, a partir de lo cual mantuvo esa polisemia colonizadora-descolonizadora. A propósito de lo anterior el libro realiza (...) una comparación en el significado que le atribuyen al concepto dos autores contemporáneos: Roberto Fernández Retamar y Walter Mignolo. How did the Franciscan friars translate Scotism to the New Spain? And Which controversies did it created? In this work we pretend to build the Scotistic Tradition in the New Spain by searching the bibliographical works used to teach and spread the ideas of John Duns Scotus since 1531 to 1780.

The history of philosophy is replete with attempts at invoking rationality as a means of directing and even subduing human desire and emotion. Understood as that which moves human beings to action, desire and emotion come to be associated with human freedom and rationality as a means of curbing that freedom. Plato, for instance, takes for granted a separation between thought and action that drives a wedge between our rational ability to exercise self-discipline and the free expression of desire and (...) emotion. Hobbes, on the other hand, replaces our internal ability for rational self-control with the external authority of the political State. So long as freedom and control are pitted against one another, human beings are incapable of attaining a symbiosis of these two elements of human action so essential to realizing true democracy. Unlike Plato, John Dewey sees in democracy the greatest potential for individual and social life. The purpose of this dissertation is to demonstrate how the educational philosophy of Dewey, which culminates in an educational aesthetic, appeals to and makes the most of the symbiosis of freedom and self-control, emotion and reason. Dewey’s educational aesthetic not only offers an alternative to traditional methods of education, but also demonstrates how the goal of a democratic way of life is made feasible by means of intelligently guided self-discipline—a form of self-control guided by intelligence that is not a constraint upon freedom, but instead embodies greater opportunity for freedom. I trace the basis for this synthesis, in the social-political and pedagogical principles of John Locke and Jean-Jacques Rousseau. Both Locke and Rousseau offer educational theories that begin turning our attention toward the essential partnership required of rationality and emotion. Dewey's educational aesthetic is then considered as a response to alienating forms of education that continue to pit control and freedom against one another, and which thwart the intellectual and emotional development necessary for autonomy and democratic forms of social organization. As he moves closer to half of his term as president of the Philippines, Rodrigo Roa Duterte has continually been in friction with the Catholic Church, specifically with certain members of its hierarchy. Mainly identifiable as the dividing line between Duterte’s administration and the Church is the issue on human rights particularly the extrajudicial killings (EJK) of suspected users and pushers of illegal drugs. This paper argues that Duterte’s attitude and positioning towards the Catholic Church neither strengthen nor advance the (...) Philippine state towards a greater degree of secularization. On the contrary, the Church has become more politically and publicly involved. Consequently, it has remained a key actor or interest group providing an alternative moral discourse to that of the government. (shrink)

A review of John Woods, Truth in Fiction: Rethinking its Logic. Cham: Springer, 2018.

Abstract: This research employs a Random Forest classification model to predict and assess obesity and cardiovascular disease (CVD) risk based on a comprehensive dataset collected from individuals in Mexico, Peru, and Colombia. The dataset comprises 17 attributes, including information on eating habits, physical condition, gender, age, height, and weight. The study focuses on classifying individuals into different health risk categories using machine learning algorithms. Our Random Forest model achieved remarkable performance with an accuracy, F1-score, recall, and precision all reaching 97.23%. (...) The model's success is attributed to its ability to effectively leverage attributes related to eating habits, physical condition, and demographic factors. Feature importance analysis reveals key factors contributing to accurate predictions. This paper contributes to the field of health analytics by demonstrating the effectiveness of Random Forest in predicting and categorizing health risks. The insights gained from this research have the potential to inform personalized health interventions and contribute to the advancement of precision health strategies. In a recent very interesting and important challenge to tracking theories of knowledge, Williams & Sinhababu claim to have devised a counter-example to tracking theories of knowledge of a sort that escapes the defense of those theories by Adams & Clarke. In this paper we will explain why this is not true. Tracking theories are not undermined by the example of the backward clock, as interesting as the case is.

In this essay, we draw on John Haugeland’s work in order to argue that Burge is wrong to think that exercises of perceptual constancy mechanisms suffice for perceptual representation. Although Haugeland did not live to read or respond to Burge’s Origins of Objectivity, we think that his work contains resources that can be developed into a critique of the very foundation of Burge’s approach. Specifically, we identify two related problems for Burge. First, if (what Burge calls) mere sensory responses are (...) not representational, then neither are exercises of constancy mechanisms, since the differences between them do not suffice to imply that one is representational and the other is not. Second, taken by themselves, exercises of constancy mechanisms are only derivatively representational, so merely understanding how they work is not sufficient for understanding what is required for something, in itself, to be representational (and thereby provide a full solution to the problem of perceptual representation). In this article, I draw attention to the value of community in John Mbiti’s philosophy using his famous axiom by reconciling the tension between the individual and community his philosophy envisages. To do this, I offer a reconstruction of Mbiti’s communitarian axiom: “I am because we are; and since we are, therefore I am.” Mbiti is considered one of the forerunners of the communitarian debate in African philosophy. His axiom, which describes his idea of Afro-communitarianism, accounts for the importance of (...) individual and community in thinking about social existence in African thought. However, Mbiti’s argument for the direct influence of the community in the formation of the individual is taken to mean the supremacy of the community over the individual. Mbiti’s concept of community has implications for the idea of personhood in that it raises the question of individual agency. This has affected the reception of Mbiti’s contribution to the idea of community in African political thought. While Mbiti’s contributions to Afro-communitarianism transcend the discourse of personhood, I argue that maximising the potential of his idea requires reconstruction and a critical analysis of his axiom. In doing that, I demonstrate that a possible relationship exists between the “I” and “we” in his axiom that represents a harmony between the community and individual and does not suggest a primacy of either but the significance of community. This analysis will enable fair engagement with Mbiti’s conception of community. (shrink)

I shall in this paper, assume three basic moments. My principal objective is to show that belief in reincarnation from the Igbo narrative is logically coherent with simultaneous subsistence in the ancestral realm. In the first, I engage the question of metaphysics from a socio-hermeneutic perspective to decipher its position as characteristically Igbo; in the second, I propose a scale of eschatology and juxtapose it with the Christian schema such that, I exploit my provision of an Igbo anthroposophy to show (...) how a unique individual exists that is still, the reincarnation of an ancestor. In the final analysis, I demonstrate the uniqueness of the eschatological schemes of the Igbos and Christians, in an effort to interpretatively spell out their fundamental differences and apparent similarities. With this in mind, I am pledged by intellectual troth to portraying the consistence of individual haecceity and reincarnation, making use of Igbo anthroposophy as my operative argumentatory legerdemain. The interest of this submission is to decipher philosophical meaning from the cultural practice of Afia Olu of the Awka-Etiti people. This interrogation which extracts philosophical significance is principally geared towards apprehending why such a practice still maintains in the tradition of the Awka-Etiti as well as what residue philosophy can consult with respect to current thinking. The insights of reflection revolve around the factual significance maintained in relation to the Awka-Etiti people. In this paper, I set out to critically review the impact of Popperian falsificationism and Lakatosian methodology of scientific research programmes [MSRP] on economic methodology and philosophy of economics. The central thesis I maintain is that neither Popper's falsificationism nor Lakatos' MSRP offers [philosophy of] economics a proper condition for the reception or rejection of economic theories.

In this paper, I transcend the abstract engagement of J. L. Austin's Speech Acts theory and explore their sociopolitical advantages, using the Nigerian social space as my primary experimental field. Nigerian social space is quite hierarchical and progresses along apparently asymmetrical lines of social relationship (in most cases). This in turn, accentuates some sort of power dynamics. In every communication, there is an implicit reinforcement of the social fabric as well as the power dynamic, either through one person's percep6of the (...) social status of the other or, of one's emphasis of power dynamic over the other. Austin's theory comes to the fore as a very laudable framework to map this interesting sociological facts. This work then, offers a philosophical contribution to an otherwise, sociological/anthropological fact. My job in this paper, is to explore a sociopolitical negotiation of Austin's theory in a multiethnic nation-state as Nigeria where hierarchy and power dynamics are heavily emphasized. This paper thus highlights the importance of the perlocutionary acts and the felicity conditions, and also accentuates their implications for social interactions and power dynamics in the Nigerian social space. This paper is written on the occasion of the celebration of the gift of femininity. In this paper, I argue philosophically, as to what may be taken as a framework for what it means to be a female. While I am aware of the various attendant positions and orientations that are wont to accompany such a discussion, I maintain that a female is essentially, a human being with certain biological configurations, and other cultural descriptions. While this definition may be reductionist (...) at first approximation, the fact that the female is a human being means that the female is, in the words of Battista Mondin, a bundle of possibilities that can neither be understood in entirety, or reduced to a definite range. -/- Ce papier est écrit à l'occasion de la célébration du don de la féminité. Dans cet article, je discute philosophiquement de ce qui peut être considéré comme un cadre pour ce que signifie être une femme. Bien que je sois conscient des différentes positions et orientations qui accompagnent habituellement une telle discussion, je maintiens qu'une femme est essentiellement un être humain avec certaines configurations biologiques et d'autres descriptions culturelles. Bien que cette définition puisse être réductionniste en première approximation, le fait que la femme soit un être humain signifie que la femme est, selon les mots de Battista Mondin, un faisceau de possibilités qui ne peuvent ni être comprises dans leur intégralité, ni réduites à une gamme définie. The purpose of this essay is threefold. First, I seek to trace a brief history of the concept of catholicity within the Reformed tradition and offer this historical context as an explanation for its resistance to traditional conceptions of the Church. Second, I will show how Georges Florovsky’s work “The Boundaries of the Church,” offers a better point of reference for Orthodox dialogue with Churches of the Reformed Tradition than other Orthodox ecclesiologies, such as those based solely on St. Cyprian’s (...) model, and the ecclesiology of N. Afanassieff. Last, I will use John Calvin’s ideas on the church in Institutes of the Christian Religion to show that certain contemporary Reformed ecclesiologies do not take into consideration the early Calvinist emphasis on catholicity. Using the early Christological controversies of Monophysitism and Nestorianism and applying them to ecclesiology, I will illustrate how both the traditionalist Orthodox and evangelical Reformed views of the Church are weak, make extreme claims on the nature of the Church, and must come closer to the center for dialogue. There is hope if doctrinal agreement could be made in two areas— the existence of the Church, at least to some degree, outside the formal walls of any given denominational, canonical structure in a “charismatic” sense, and the intrinsic unity of the Church as a catholic reality. Both these statements must be affirmed for the sides to agree, though agreement must not come at the expense of doctrinal suicide for either tradition. (shrink)

Octavio Paz representa las fiestas mexicanas en El laberinto de la soledad (1950) con un rasgo adverso y relativista, que se opone a la unificación de la cultura como un instintivo. Inmediatamente, este carácter es reconocible desde la lógica posmoderna, la misma que trabaja Beatriz Sarlo. Al ser así, la configuración que se le atribuye a estas celebraciones cuenta con el propósito de hallar notoriamente la interrelación pluricultural y su respectiva difusión. Esa es la orientación que se le brinda al (...) tópico de la relatividad, que se respalda también de las concepciones de la semiótica tensiva de Jacques Fontanille (la inclusión del cuadrado semiótico) y la configuración teórica del tiempo, tal como la fundamenta Paul Ricoeur. De estas, se aprecia el funcionamiento de la dinámica de opuestos, inmersa en el desarrollo de las festividades. Asumiendo que este estudio abarca a un autor distinguible, he reconsiderado previamente un panorama hermenéutico a esta investigación (análisis bibliográficos en torno a la obra). (shrink)

En este artículo se debaten tres aspectos del concepto de la moral: el primero se refiere a la puesta en duda de la existencia misma, no sólo del concepto sino de la posible o imposible fundamentación de lo moral per se. En segundo lugar, la positivización del término llevado a lo normativo como una búsqueda de objetividad de lo moral y, el tercer aspecto, la crítica a la moral imperativa desde posturas dogmáticas. Se defiende que no es suficiente la perfectibilidad (...) de las leyes desde un punto de vista de la moralidad, sino que existe lo que podríamos llamar un fundamento personal, y al mismo tiempo, colectivo de comprensión del Derecho; entendido como el bienestar individual y colectivo para la realización de una vida plena en la polis. La moralidad, por tanto, si bien no es posible definirla en modo explicativo, racional, necesita de una base en valores compartidos con aspiraciones objetivistas y, al mismo tiempo, universalistas. This paper studies the context-dependence of the first-person indexical 'I,' while attempting to make the identifiability criteria for specificity and definiteness clearer for this important indexical. Having been influenced by John Perry's work on indexicals, we'll show that this (seemingly) clearest case of an indexical poses a difficulty.

Having followed the literature on genocide since the beginning of 1990s I have been often struck that academic writing on genocide is very much like non-professional pursuits in youth sports: anything is considered 'a good try'. The French have a good phrase for what I mean here: n'importe quoi. Works exhibiting no sound methodology, replete with irrational claims without factual basis and beliefs about foreigners adopted on faith limited only by a 'the worse the better' criterion of plausibility dominate the (...) literature on genocide. My only consolation in confronting this literature has been that philosophers, for the most part, had not been the ones taking part in this orgy of nonsense. The book Genocide and Human Rights takes even that solace away as it purports to be 'a philosophical guide' to genocide. (shrink)

An extensive commentary on moral philosophy that is a renunciation of my previous two essays. This essay promotes the idea that the answer to an objective morality lies in examining moral problems through an epistemic lens.

This papers aims at clarifying some misunderstandings that seem to block an adequate account of de re thoughts within the Fregean framework. It is usually assumed that Fregean senses cannot be de re, or dependent upon objects. Contrary to this assumption, Gareth Evans and John McDowell have claimed that Fregean de re senses are not just possible, but in fact the most promising alternative for accounting for de re thoughts. The reasons blocking this alternative can be traced back to Russellian (...) considerations that contaminated the interpretation of Frege. This contaminated understanding is first detected in Tyler Burge’s distinction between de dicto and de re, then connected to the motivations behind David Kaplan’s notion of character, and finally found in John Searle’s descriptivist account. The difficulty in understanding de re thoughts is, roughly speaking, a side effect of the misunderstanding of the boundaries separating internal and external elements of thoughts, as well as the distinction between mental content and means of representation. I offer two potential diagnoses of the behavioral norms governing post‐truth politics by comparing the view of language, communication, and truth‐telling put forward by David Lewis (extended by game theorists), and John Searle. My first goal is to specify the different ways in which Lewis, and game theorists more generally, in contrast to Searle (in the company of Paul Grice and Jurgen Habermas), go about explaining the normativity of truthfulness within a linguistic community. The main difference is that for Lewis (...) and game theorists, “truthful” signaling follows from an align- ment of interests, and deception follows from mixed motives leading to the calculation that sending false information is better for oneself. Following in the Enlightenment tradition, Searle argues that practical reasoning, which involves mastery of at least one language, requires that actors intend to communicate. This intention includes constraining the content of statements to uphold veracity conditions. After distinguishing between these two accounts, I will artic- ulate the implications for explaining, and even informing actions, constitutive of post‐truth politics. I argue that the strategic view of communication is suffi- cient neither to model everyday conversation nor to reflect a public sphere useful for democratic govern- ment. Both the pedagogy of strategic communication as cheap talk, and its concordance with new digital information technologies, challenge norms of truthful- ness that underlie modern institutions essential to an effective public sphere. The moral justification of intellectual property is often called into question when placed in the context of pharmaceutical patents and global health concerns. The theoretical accounts of both John Rawls and Robert Nozick provide an excellent ethical framework from which such questions can be clarified. While Nozick upholds an individuals right to intellectual property, based upon its conformation with Lockean notions of property and Nozicks ideas of just acquisition and transfer, Rawls emphasizes the importance of basic liberties, such as an (...) individuals right to health, superceding such secondary rights as intellectual property rights. From a policy perspective, patent protection for pharmaceutical products necessarily entails the balancing of corporate intellectual property interests and public interests in healthcare. The moral dilemma that occurs when these two interests clash is not easily resolved. Aside from corporate and public interests, the state maintains an interest in creating and preserving policies that regulate the moral dilemma itself. This paper analyzes the economic and ethical factors surrounding the production and distribution of the anti-HIV medication, AZT. Potential policy implications and recommendations are also discussed. This article compares James M. Buchanan's and John Rawls's theories of democratic governance. In particular it compares their positions on the characteristics of a legitimate social contract. Where Buchanan argues that additional police force can be used to quell political demonstrations, Rawls argues for a social contract that meets the difference principle.

Universal Basic Income has become a popular idea in the last few decades even though one can find its roots in the earlier centuries. In this thesis, I have examined the position of UBI in the works of the most influential contemporary philosophers. By connecting the idea of UBI with some certain concepts from different philosophers, I aimed to improve the overall understanding of UBI. I have mentioned the concepts such as "labor", "leisure", "idleness", "boredom", "poverty", "inequality", "distribution", "happiness", "power", (...) "needs", "truth", "alienation", etc. I have used a literature methodology for my research. I have tried to read and relate the concept of UBI with the works of 10 philosophers: Arthur Schopenhauer, Karl Marx, William James, Bertrand Russell, Michel Foucault, John Rawls, Robert Nozick, Noam Chomsky, Slavoj Zizek, Peter Singer. At the time of his death in May of 2012, Ralph Pred was working on a critical social theory inspired by process philosophy. In the book manuscript he left unfinished, Syntax and Solidarity, he develops a “radically empirical” sociology that enables him to identify and critically evaluate the different forms that social solidarity has taken in the history of civilization. The purpose of this paper is to draw attention to the importance of his unfinished project. We define a formal semantics of conditionals based on _normatively ideal worlds_. Such worlds are described informally by Armgardt (Gabbay D, Magnani L, Park W, Pietarinen A-V (eds) Natural arguments: a tribute to john woods, College Publications, London, pp 699–708, 2018) to address well-known problems of the counterfactual approach to causation. Drawing on Armgardt’s proposal, we use iterated conditionals in order to analyse causal relations in scenarios of multi-agent interaction. This results in a refined counterfactual approach to causal responsibility in (...) legal contexts, which solves overdetermination problems in an intuitively accessible manner. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

This paper considers the view that the basis of equality is the range property of being a moral person. This view, suggested by John Rawls in his A Theory of Justice (1971), is commonly dismissed in the literature. By defending the view against the criticism levelled against it, I aim to show that this dismissal has been too quick. The critics have generally failed to fully appreciate the fact that Rawls's account is restricted to the domain of distributive justice. On (...) Rawls's view distributive justice is a matter of the fair terms of cooperation among the participants of a system of social cooperation. I argue that this understanding of distributive justice can provide a compelling rationale for considering moral personality as the basis of equality for this domain of morality. That moral persons are indeed equal is further supported by an intuitive argument concerning the irrelevance of morally arbitrary factors, giving us reasons to believe that varying capacities among moral persons does not result in an unequal moral status. The dismissal of Rawls's account of equality has thus been premature, and it remains an important view to consider. (shrink)

In Tulving’s initial characterization, episodic memory was one of multiple memory systems. It was postulated, in pursuit of explanatory depth, as displaying proprietary operations, representations, and substrates such as to explain a range of cognitive, behavioural, and experiential phenomena. Yet the subsequent development of this research program has, paradoxically, introduced surprising doubts about the nature, and indeed existence, of episodic memory. On dominant versions of the ‘common system’ view, on which a single simulation system underlies both remembering and imagining, there (...) are no processes unique to memory to support robust generalizations with inductive potential. Eliminativism about episodic memory seems to follow from the claim that it has no dedicated neurocognitive system of its own. After identifying this under-noticed threat, we push back against modern eliminativists by surveying recent evidence that still indicates specialized mechanisms, computations, and representations that are distinctly mnemic in character. We argue that contemporary realists about episodic memory can retain lessons of the common system approach while resisting the further move to eliminativism. (shrink)

I argue that silence is replete with aesthetic character and that it can be a rewarding object of aesthetic appreciation, assessment, and appraisal. The appreciation of silence might initially seem impossible, for, it might seem, there is nothing there to behold. Taking up this challenge, I attempt to dispel the sense of paradox. I contend that, despite our never actually experiencing absolute silence, there is much to enjoy in the silences that we do experience. I go on to argue that (...) proper appreciation of silence is a two-way street, involving quiet on the outside and stillness on the inside. I conclude by offering some suggestions for how to make the aesthetic appreciation of silence part of a flourishing life. (shrink)

The Formalist tradition in late-scholastic philosophy has gone unnoticed in standard historiography. This article’s overall objective is to add the Formalist tradition to what we know about Renaissance philosophy. I first show how the Formalist tradition was born out of some innovative considerations of hierarchies of distinctions in the wake of the Franciscan John Duns Scotus’s teaching on the formal distinction in the beginning of the fourteenth century (especially Francis of Meyronnes’s model of four distinctions and Petrus Thomae’s more elaborate (...) doctrine of seven kinds of distinctions). I then trace how Formalist literature developed from being an exclusively Franciscan affair to becoming a much more widespread phenomenon. Thus, from the decades up to 1500 and onwards, authors from various late-scholastic schools (Thomism, Lullism, Averroism, and others) produced Formalist literature, i.e., treatises on multiple kinds of distinctions. I highlight particularly how one Franciscan philosopher of the sixteenth century, Jean Du Douet, proposed to view the Formalist preoccupation with distinctions as a discipline in its own right, a proper scientia formalitatum. I finally argue that while this proposal met with dismissive reactions, Du Douet’s idea does in fact reflect the role Formalism played in the scholastic curriculum in the late sixteenth century, at least in Franciscan milieus. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Super-Humeans argue that the most parsimonious ontology of the natural world compatible with our best physical theories consists exclusively of particles and the distance relations between them. This paper argues by contrast that Super-Humean reduction goes insufficiently far, by showing there to be a more parsimonious ontology compatible with physics: Ultimate-Humeanism. This novel view posits an ontology consisting solely of the particles and distance relations required for the existence of a single brain. Super-Humeans impose conditions on what counts as an (...) ontology of the natural world to avoid their view slipping into this kind of ontology, but these conditions are arbitrarily imposed and once this is exposed, Super-Humeans face a dilemma. Either they can embrace Ultimate-Humeanism as the minimal ontology of the natural world compatible with physics, or (more likely) they can rethink the methodology that got them there. Overall, this paper argues that Super-Humeanism currently lacks principled motivation, outlines a framework for naturalistic ontological reductions, and exposes the consequences of unchecked adherence to a simplicity-driven methodology. This essay explores the implications of historicising John Rawls’s theory of justice. While historical research on Rawls and his social context has provided valuable insights, some scholars argue that historicising carries significant philosophical consequences. This paper critically examines one such argument that contends that historicising Rawls’s theory demonstrates its contextual nature, undermines its diagnostic powers, and leads to its complete dissolution. We offer a reconstruction of this argument and show that it fails. Further, while we argue that this argument fails, (...) we go on to suggest that historical evidence may contribute to a defensive argument against appeals to expert opinion. By examining the appropriate relationship between historical research and philosophy, this essay contributes to the evaluation of the historicist critique and offers insights into the broader role of historical research in philosophical discourse.
