Hawley introduced the idea of the client's perspective on knowledge, which she used to illuminate knowing-how and cases of epistemic injustice involving knowing-how. In this paper, I explore how Hawley's idea might be used to illuminate not only knowing-how, but other forms of knowledge that, like knowing-how, are often claimed to be distinct from mere knowing-that, focusing on the case studies of moral understanding and ‘what it is like’-knowledge.

The subject’s perspective objection (SPO) is an objection against externalist theories of justification, warrant, and knowledge. In this article, I show that externalists can accommodate the SPO while remaining externalist. So, even if the SPO is successful, it does not motivate internalism, and the primary motivation for internalism has been lost. After this, I provide an explanation for why so many people find cases that motivate the SPO convincing.

While the image of the slave as the antithesis of the freeman is central to republican freedom, it is striking to note that slaves themselves have not contributed to how this condition is understood. The result is a one-sided conception of both freedom and slavery, which leaves republicanism unable to provide an equal and robust protection for historically outcast people. I draw on the work of Frederick Douglass – long overlooked as a significant contributor to republican theory – to show (...) one way why this is so. Focusing the American Revolution, the subsequent republican government established new political institutions to maintain the collective interests of the whole population. The political revolution was held in place by processes of public reason that reflected the values and ideas of the people that had rebelled. The black population, however, had not been part of this revolution. After emancipation, black Americans were required to accept terms of citizenship that had already been defined, leaving them socially dominated, subject to the prejudices and biases within the prevailing ideas of public discourse. Douglass argued that republican freedom under law is always dependent on a more fundamental revolution, that he calls a ‘radical revolution in thought’, in which the entire system of social norms and practices are reworked together by members of all constituent social groups – women and men, black and white, rich and poor – so that it reflects a genuinely collaborative achievement. Only then can we begin the republican project of contestatory freedom as independence or non-domination that today’s republicans take for granted. (shrink)

Causal Decision Theory reckons the choice-worthiness of an option to be completely independent of its evidential bearing on its non-effects. But after one has made a choice this bearing is relevant to future decisions. Therefore it is possible to construct problems of sequential choice in which Causal Decision Theory makes a guaranteed loss. So Causal Decision Theory is wrong. For some years now, Michael Bergmann has urged a dilemma against internalist theories of epistemic justification. For reasons I explain below, some epistemologists have thought that Michael Huemer’s principle of Phenomenal Conservatism can split the horns of Bergmann’s dilemma. Bergmann has recently argued, however, that PC must inevitably, like all other internalist views, fall prey to his dilemma. Anti-cognitivism is best understood as a challenge to explain how works of fictional narrative can add to our worldly knowledge. One way to respond to this challenge is to argue that works of fictional narrative add to our knowledge by inviting us to explore, in the imagination, the perspectives or points of view of others. In the present paper, I distinguish two readings of this thesis that reflect two very different conceptions of “perspective”: a first understanding focuses on what (...) the world looks like from a subjective point of view. Within this framework, we can distinguish approaches that focus on the subjective character of experience from others that explore the nature of subjectivity. I will argue that both strands can be successful only if they acknowledge the de se character of imagining. The second conception understands perspective as a method of representing. To illustrate it, I will look back to the invention of linear perspective in Renaissance painting. I will argue that the definition of perspective as a rule-guided method or technique can shed new light on the thesis that works of narrative fiction are particularly suited to display other perspectives. Summary Giancarlo Trombini presents the continuation of his research on the question of which criteria can be used to assess the progress of therapy in an objectively verifiable way and to make the decision on the completion of therapy. In the first phase of his research, the phenomenological criterion of a qualitative change in the patient’s relations toward the positive and higher complexity was proposed for this purpose. In terms of the working method in analytic therapy, this meant concretely: attention (...) should be paid to what development is shown in the comparison of the relationships that occur in the dream narrative and in the subsequent associations. This criterion was therefore given the name manifest dream/association comparison (MDAC)—comparison between the manifest dream and the subsequent associations. The idea can easily be transferred to those therapy methods, which do not primarily work with reports of dream memories and subsequent associations—also, in other ways of working, it is possible to pay attention, in the way suggested by Trombini, to the qualitative development of the relationships which are thematized by the clients in the course of an hour. To this first criterion, another phenomenological criterion is now added in the present article: that of the “concluding therapeutic turn” (CTT). If the patient’s development reaches this turn in the course of the therapy in one session, this indicates, according to Trombini, that the therapy can soon be concluded. The fulfillment of this criterion can be recognized by the fact that in the sequence of dream narration and subsequent associations in a session, a relational dynamic toward the positive and higher complexity becomes recognizable and that is, at the same time, connected with a reconciliation of the three temporal reference systems (past, present, and future). The achievement of this CTT indicates that the patient is aware of the changes made in therapy and makes it evident to the therapist that the therapy is nearing completion. (shrink)

Although current educational priorities tend to avoid strong moral positions, one of the world's most venerable yet persistently influential moral traditions not only lays out a number of major moral principles but also incorporates them into its pedagogy. Confucius teaches us about the importance of seeking knowledge, learning how to learn, applying ancient wisdom to contemporary situations, valuing virtue over material gain, following the Golden Rule, and living by our principles. He also has ways of assessing his own students' progress (...) in these matters. Confucius' pedagogy is an interesting model to consider and contrast with contemporary models. This chapter introduces these principles and assessments from the Analects and draws out some comparisons to and contrasts with two alternative theories in western moral thought, Augustine and John Dewey. -/- The accepted version of the paper is included here. Lawyers and judges cannot adequately address the nature of text, meaning, or interpretation without reference to the insights provided by linguists and philosophers of language. Exploring some of those insights, this article focuses upon what linguists and philosophers of language call “pragmatics.” Pragmatics examines the relations between words and users rather than the relations of words to words (syntax) or the relations of words to the world (semantics). In other words, pragmatics studies how language users actually use and interpret words (...) and other signs in communication. -/- Pragmatics recognizes that speaker meaning can differ from (and even contradict) linguistic meaning, including the literal meaning of text. In its proper context, for example, “Bob is indeed a good lawyer” can ironically mean just the opposite. Pragmatics also recognizes that relevant text is not a thing-in-itself that is simply given. Good lawyers look at such things as purpose and cohesion when determining relevant text. They do not simply take their opponent’s (or even their client’s) assertions of relevance. -/- Pragmatics also provides lawyers with a number of specific concepts and tools which are helpful in determining speaker meaning. For user convenience, this article attempts to set out in one place a number of such concepts and tools. We naturally attribute obligations to groups, and take such obligations to have consequences for the obligations of group members. The threat posed by anthropogenic climate change provides an urgent case. It seems that we, together, have an obligation to prevent climate catastrophe, and that we, as individuals, have an obligation to contribute. However, understood strictly, attributions of obligations to groups might seem illegitimate. On the one hand, the groups in question—the people alive today, say—are rarely fully-fledged moral agents, making it (...) unclear how they can be subjects of obligations. On the other, the attributions can rarely be understood distributively, as concerned with members’ obligations, because obligations to do something require a capacity to do it, and individual members often lack the relevant capacities. Moreover, even if groups can have obligations, it is unclear why that would be relevant for members, exactly because members often lack control over whether group obligations are fulfilled. In previous work, I have argued that a general understanding of individual obligations extends non-mysteriously to irreducibly shared obligations, rendering attributions of obligations to groups legitimate. In this paper, I spell out how the proposed account also helps us understand the relation between individual and shared obligations. Even though few individual human agents have any significant control over whether we will be successful in preventing climate catastrophe, our collective capacity to prevent catastrophe and shared preventative obligation to do so can give rise to significant individual obligations to contribute to its fulfillment. Stephen L. Pepper argues that lawyers and clients often act together in ways that their moral convictions would prevent them from acting individually. In an attempt to address this problem, I explore the nature of the attorney's responsibility to help her client reach autonomous decisions. To do this, I review the work of some prominent medical ethicists on a parallel to Pepper's problem in doctor-patient relationships.

Natural scientific views on the human being have the tendency to reduce selfhood toa static object. This tendency arguably derives from the need to objectify the present in which the human being is found. Phenomenology avoids such a reduction by engaging with the present instead of distancing from it for the sake of analysis. This beneficence that derives froma phenomenological view of reality is argued to be a warranted view a counseling therapist should adopt. Not only can a therapist who (...) involves phenomenological perspectives in their practice succeed in viewing their clients non-instrumentally, but such a therapist can also “Be” genuine. The paper conceives of the therapist capable of performing these phenomenological tasks in therapy as adopting a mode of Being which we highlight as akin to the ancient concept: hypostasis. This conception in turn is shown to have epistemological ramifications for the meaning of “understanding”, which is shown quite suitably in the example of therapeutic presence. Heidegger’s Dasein serves as conceptual example of self in the paper to elucidate the connection between hypostasis and understanding throughout. (shrink)

Kyle Stanford’s reformulation of the problem of underdetermination has the potential to highlight the epistemic obligations of scientists. Stanford, however, presents the phenomenon of unconceived alternatives as a problem for realists, despite critics’ insistence that we have contextual explanations for scientists’ failure to conceive of their successors’ theories. I propose that responsibilist epistemology and the concept of “role oughts,” as discussed by Lorraine Code and Richard Feldman, can pacify Stanford’s critics and reveal broader relevance of the “new induction.” The possibility (...) of unconceived alternatives pushes us to question our contemporary expectation for scientists to reason outside of their historical moment. _La Peste_, originally published in 1947 by the Nobel Prize-winning writer Albert Camus, chronicles the progression of deadly bubonic plague as it spreads through the quarantined Algerian city of Oran. While most discussions of fictional examples within aesthetics are either historical or hypothetical, Camus offers an example of "pestilence fiction." Camus chose fiction to convey facts--about plagues in the past, his own bout with tuberculosis at age seventeen, living under quarantine away from home for several years, and forced separation from (...) his wife who remained in Algiers while he was abroad in Nazi-occupied France. His own lived experiences undergird an imaginative account of shared human realities with which we can identify: vulnerability to the disease, isolation, fear, and finally humanitarianism. _The Plague_ teaches us to neither covet nor expect what we so casually took for granted. This collection of original essays on philosophical themes in _The Plague_ is of special relevance during and in the aftermath of Covid-19 but also provides reflections that will be of lasting value to those interested in this classic work of literature. The novel explores questions of enduring importance. Do we collectively meet the threshold of ethical behavior posed by Camus who wrote, "What's true of all the evils in the world is true of plague as well. It helps men to rise above themselves"? Or does the absurd undermine the compassionate? By deploying the methodology of Judith Butler's notion of performativity, this article intends to understand the possibility of the concept of queerness beyond the possibilities of gender studies and queer theory and to develop a concept transcending the limits of identity. It is undeniable that Foucault's concept of disciplinarity is one of the major precursors of the notion of performativity, which is a more focused tool for what Foucault broadly devised. Both thinkers explain how the subject is a construction by (...) power. They explain how bodies are marked, assigned, and manipulated and expose the banality with which these operations take one for granted. It is through unearthing the disciplinary aspects of performativity in Butler and foreseeing the performative aspects of disciplinarity in Foucault that this article finds its methodological perspective. It is notable that disciplinarity and, as its extension, performativity ultimately exposes the underlying ontology of identity as a 'truth effect' rather than as an apriori truth. The paper critically analyses the artist's identity and the artistic discourse to unravel the queerness or an underlying plurality of aesthetic experience using performativity as a formative tool. The experience of joint attention that is described in this text is enigmatic, dynamic, integrative, and transformative. In the literature on transitional justice, there is disagreement about whether countries like the United States can be characterized as transitional societies. Though it is widely recognized that transitional justice mechanisms such as truth commissions and reparations can be used by Global North nations to address racial injustice, some consider societies to be transitional only when they are undergoing a formal democratic regime change. We conceptualize the political situation of low-income Black communities under the U.S. imprisonment and policing regime in (...) terms of three criteria for identifying transitional contexts: normalized collective and political wrongdoing, pervasive structural inequality, and the failure of the rule of law. That these criteria are met, however, does not necessarily mean that a transition is taking place. Drawing on the American political development and abolition democracy literatures, we discuss what it would mean for the United States to transition out of its present imprisonment and policing regime. A transitional justice perspective shows the importance of not only pushing for truth and reparation, but for an actual transition. (shrink)

Due to the rising pressure from population growth and environmental crises induced by anthropogenic food production activities, the production and consumption of insects have been promoted internationally. The current paper discusses the nutritional and environmental benefits of insect consumption and the socio-cultural and psychological factors that constrain such a habit on an international scale. Then, some historical and cultural information regarding insect consumption in Vietnam is provided to highlight the potential of insect consumption standardization. Unlike those in Western societies, where (...) people exhibit significant psychological resistance to the idea of consuming insects as food, Vietnam has a longstanding tradition of entomophagy, resulting in far less resistance to this practice. Insects have not only been consumed widely in recent times, but they also have a historical root thanks to the early contribution of Nguyen Cong Tieu, a leading Vietnamese agriculture scientist since the French domination period (1884-1945). Nevertheless, insects are commonly viewed as street food or regional specialties but not dietary food, and the perception that insects are “poor man’s diet” persists, which can hinder the standardization of insect consumption within Vietnamese society. To capitalize on the nutritional sources from insects, we suggest that insect-eating should be embraced as an expression of progressive culture for environmental sustainability, and more interdisciplinary research in emerging countries, like Vietnam, could be conducted for the sake of good. Background: Mental health professionals working in correctional contexts engage a double role to care and control. This dual loyalty conflict has repeatedly been criticized to impede the development of a high-quality alliance. As therapeutic alliance is a robust predictor of outcome measures of psychotherapy, it is essential to investigate the effects of this ethical dilemma. Methods: This qualitative interview study investigates patients’ perceptions of their therapists’ dual role conflict in court-mandated treatment settings. We interviewed 41 older incarcerated persons using a (...) semi-structured interview guide, the interviews were subsequently analyzed following thematic analysis. Results: We first present the patients’ perceptions of their treating psychotherapist’s dual loyalty conflict, which was linked to their overall treatment experience. In a second step, we outline the study participants’ reasons for this judgment, which were most commonly linked to feelings of trust or betrayal. More specifically, they named certain therapist characteristics and activities that enabled them to develop a trustful therapeutic alliance, which we grouped into four topics: respecting the patient’s pace and perceived coercion; patient health needs to be first priority; clarity in roles and responsibilities; and the art of communication – between transparency and unchecked information sharing. Discussion: Developing a high quality alliance in mandatory offender treatment is central due to its relationship with recovery and desistance. Our findings show that some therapists’ characteristics and activities attenuate the negative impact of their double role on the development and maintenance of the alliance. To increase the effectiveness of court-mandated treatments, we need to support clinicians in dealing with their dual role to allow the formation of a high quality therapeutic alliance. Our qualitative interview study contributed to this much-needed empirical research on therapist’ characteristics promoting a trustful relationship in correctional settings. (shrink)

Arthur C. Danto did not live to witness the proliferation of AI in artistic creation. However, his philosophy of art offers key ideas about art that can provide an interesting perspective on artwork generated by artificial intelligence (AI). In this article, I analyze how his ideas about contemporary art, intention, interpretation, and authorship could be applied to the ongoing debate about AI and artistic creation. At the same time, it is also interesting to consider whether the incorporation of AI (...) into artistic creation marks a new chapter in the narrative, which seems to have reached its end, or if it represents a significant rupture with past artistic traditions. In this paper, I argue for a version of panpsychist idealism on first-person experiential grounds. As things always appear in my field of consciousness, there is prima facie empirical support for idealism. Furthermore, by assuming that all things correspond to a conscious perspective or perspectives (i.e., panpsychism), realism about the world is arguably safeguarded without the need to appeal to God (as per Berkeley’s idealism). Panpsychist idealism also has a phenomenological advantage over traditional panpsychist views as it does not (...) commit perceptual experience to massive error by denying that perceived colours are properties of things. Finally, I argue that the subject combination problem for panpsychism has been motivated by the problematic assumption that consciousness is in things. Thinking about subject combination from the first-person perspective is fruitful for reframing the subject combination problem and for seeing how subjects could potentially combine for the idealist. When one considers one's own persistence over time from the first-person perspective, it seems as if facts about one's persistence are "further facts," over and above facts about physical and psychological continuity. But the idea that facts about one's persistence are further facts is objectionable on independent theoretical grounds: it conflicts with physicalism and requires us to posit hidden facts about our persistence. This essay shows how to resolve this conflict using the idea that imagining from the first-person point (...) of view is a guide to centered possibility, a type of possibility analyzed in terms of centered worlds. This study aims to identify the digital reputation at the University of Palestine: an analytical perspective of the employees ’point of view, where the researchers used the descriptive and analytical approach, through a questionnaire distributed to a sample of employees at the University of Palestine, where the size of the study population is (234) employees, and the size of The sample is (117) employees, of whom (90) employees responded. The study provided a theoretical framework for what the writers and (...) researchers presented about the study variables, as well as a practical analytical framework for the opinions of employees at the University of Palestine. The digital reputation was expressed as an independent variable through its four indicators (feeling about the organization (satisfaction), admiration and respect, and trust, and social responsibility). The study found a set of results, the most important of which are: the existence of a high degree of digital reputation at the University of Palestine from the viewpoint of employees, and the absence of differences in the opinions of the study sample about digital reputation according to demographic variables. The study presented a set of recommendations, the most important of which are: The need for universities to enhance their digital reputation and raise its level. (shrink)

The problem of time involves an overlap between physics, philosophy, psychology and neuroscience. My talk will discuss the role of time in physics but also emphasize that physics may need to expand to address issues usually regarded as being in the other domains. I will first review the mainstream physics view of time, as it arises in Newtonian theory, relativity theory and quantum theory. I will then discuss the various arrows of time, the most fundamental of which is the passage (...) of time associated with consciousness. I will argue that this goes beyond both relativity theory and quantum theory, so that one needs some new physical paradigm to accommodate it. A new paradigm is required anyway to describe quantum gravity and this may elucidate the nature of both time and consciousness. (shrink)

In the summer of 2016, the University of Dallas and the Instituto Tecnológico Autónomo de México organized a conference to discuss the topic of the middle class and its continued decline—recognizing that, despite some historical, political and cultural differences, healthy democracies throughout the hemisphere depend upon a strong and prosperous middle class. This volume brings together contributions by nine scholars from both institutions. The chapters reflect diverse disciplinary perspectives that are historical, political, economic, anthropological, and philosophical. Despite this diversity, the (...) volume possesses a conceptual unity that stems from its foundation in Aristotle’s approach to the middle class. On this basis, the topic is given a rigorous study that is both theoretical and data-driven. The chapters include treatments of Aristotle, Montesquieu, Adam Smith and Sir James Steuart, Catholic social teaching, the problem of inequality in the US, the definition and measurement of the middle class in Mexico, as well as its values and political attitudes, the rise of middle-class politics in early-twentieth-century Latin America, and a comparative analysis of healthcare for the middle class in North America. In an attempt to contribute to the discussion of the philosophy of agriculture, this paper introduces a preliminary philosophical discourse on the views of the farmers of the Municipality of San Francisco, Southern Leyte. It seeks to philosophize from the vantage point of the farmers. It uses thematic analysis from the face-to-face interview with the selected farmers. Then, it purposefully integrates a method, which I call, "Philosophizing from"-a process of philosophical discourse that proceeds from the views of the participants. The paper examines the loss of African identity within the modern/ contemporary era. African identity has been a recurrent theme in all domains of African studies, serving as a major intellectual concern of many African scholars. Debates on the reality of African Philosophy are anchored on the questions surrounding African identity giving rise to thoughts and contents of that philosophy. Despite the volumes already generated on the theme, the controversial circumstances that engendered the subject of African identity makes its intellectual (...) concern sustainable and almost inexhaustible. The question of African identity is basically an ontological question of the reality of Africa cum the being of an African. The series of infiltration and appraisals of Africa by foreign elements tend to plunge the continent into crises of identity. In addition to the various approaches to the subject, the nature-culture perspective presents the argument that if culture is ideally the product of a people’s nature, African culture represents the objective manifestation of the Africanity of the continent and its organic/holistic content. Such frame of thought embellished with philosophic tools provides further locus for a more feasible and stable definition of African identity as the holistic nature and character of being African. Empathy is essential in story comprehension as it requires understanding of the emotions and intentions of the characters. We evaluated the sensitivity of an emotional perspective-taking task using Aesop’s Fables in relation to empathy. Participants (N = 301) were presented with 15 short fables and were asked to rate the intensity of the emotions they would feel (anger, sadness, disgust, fear, surprise, joy, trust, and anticipation) by adopting the perspective of one of the characters (offender, victim) or the (...) observer’s perspective. A data-driven approach revealed that participants’ responses were aligned with the characters’ intentions, suggesting successful emotional perspective-taking. Participants sympathized with the victim rather than the offender, demonstrating affective sharing processes. Further, participants with higher empathy scores exhibited stronger negative emotions from the victim’s perspective, independently of their level of distress. Our task was not influenced by gender effects. We suggest that the Aesop’s Fables task could provide an indirect instrument to study empathy. (shrink)

This paper aims to study the organizational excellence and the extent of its clarity in the Palestinian universities from the perspective of students. Researchers have used the descriptive and analytical approach and used the questionnaire for data collection and distributed to students in universities. The researchers used a sample stratified random method by the university. The total number of students was (381) and (235) were distributed to identify the study population. (166) questionnaires were recovered with rate of (96.3%). We (...) used statistical analysis (SPSS) program for data entry, processing and analysis. The study reached the following conclusions: that (62.8%) of the study population believe that the availability of "faculty staff" somewhat weak, showed that the number of Academic staff is appropriate to the number of students. The results confirmed that (66.4%) of the study population believe that the suitability "admission policies" is average, showed that the admission policies declared for the students, it is also transparent, the university administration provides orientation programs for newley admitted students. The results showed that (55.4%) of the study population believe that the "Student support" is low in the universities, and (52.8%) of the study population believe that "student activities" in the universities is low. The study found a set of recommendations, including: the establishment of university centers for gifted and talented students, follow their growth and their creations after graduating from college and while working in the sectors of production, and provide college library modern references in all disciplines. Whether it is about Québec independence, French language or immigration, nationalism is a crucial feature of Québec politics. The Québec 2018 election is not an exception. Scholars have developed theories about individual identity, the nation and nationhood, but we lack a citizens’ perspective. We provide the first thorough description of Quebeckers’ nationalism, which reveals a roughly normal (i.e. non-polarized) distribution of ethnic nationalism attitudes. Most importantly, we measure ethnic nationalism with a never tested measure in Québec and we show (...) that it substantially explains vote choice in the Québec 2018 election—especially the support for the Coalition Avenir Québec. There was a massive increase in migration for various reasons, which also gave rise to many other political problems. Multiculturalism and migration got adequate space in Modood's political literature. He presented its socio-political analysis. In discussing the interrelationships between Multiculturalism and liberalism, the question of adjustment of many cultures in relatively less liberal systems provides an alternative perspective to understanding Multiculturalism through migration. -/- . The 1970s Wages Against Housework (WAH) movement has much to offer as we form a “new normal” for life and work within the Covid-19 pandemic. WAH feminist philosophers Mariarosa Dalla Costa, Selma James, and Silvia Federici, as well as WAH critic Angela Davis outline the ways in which the housewife functions as a laborer within capitalist accumulation, as her duties to care for the home and rear the children generate the possibility of the husband to labor outside the home. This (...) role of the housewife in Dalla Costa and James’ “social factory” parallels the work of teachers and the chorus of demands to “return to the classroom” that were placed on teachers in the early stages of the Covid-19 pandemic. Highlighting these parallels, the argument of this essay is simple: Covid-19 has visibilized the underpaid and unpaid labor of teachers. We ought to engage this moment of visibilization to demand transformative change to the teaching profession. Due to the parallels between WAH's “housewife” and teachers, we have much to learn from WAH theorizing as we demand those transformative changes, especially now as we solidify our “new normal” more than two years since the Covid-19 pandemic began. Mainstream views of medical research tell us it should be a fact-based, value-free endeavor: what a scientist (or her funding source) wants or cares about should not influence her findings. At the same time, we also sometimes criticize medical research for failing to embody certain values, e.g. when we criticize pharmaceutical companies for largely ignoring the diseases that affect the global poor. This chapter seeks to reconcile these perspectives by distinguishing appropriate from inappropriate influences of values on medical research. It (...) divides this broad question into two narrower ones, the Role Question (at what points in the research process is value influence potentially acceptable?) and the Content Question (when value influence is potentially acceptable, what specific values should researchers use?), and then draws on the philosophical literature on values in science to explore answers to each of them. Until recently there has been no general theory concerning the impact of legal processes upon participant wellbeing and its implications for attaining justice system objectives. This gap has been filled by therapeutic jurisprudence. Its essential premise is that the law does have therapeutic or anti-therapeutic consequences. This paper uses existing research to explore how the tools of the behavioral sciences, e.g. psychology, can be used to study the therapeutic and anti-therapeutic impact of the law, and that we can think creatively (...) about improving the law’s healing potential without violating other important values. By claiming that justice is therapy, the therapeutic jurisprudence perspective reaches beyond how to design and operate a court into a larger question of how law clients should be treated by the justice system. Using a triangulation of three methods, we devise a framework for the acquisition of the resources vital for the start-up of a business in South Africa. Against the backdrop of the fact that numerous challenges prohibit African immigrants from starting a business, let alone growing the business, we set out to investigate how those who succeed acquired the necessary resources. Within the quantitative paradigm, the survey questionnaire was used to collect and analyze the data. To complement the quantitative approach, personal (...) interviews and focus groups were utilised as the methods within the qualitative approach paradigm. The research revealed that an African immigrant entrepreneur is most likely to be a male between the ages of 19 and 41 who has been forced to immigrate by political circumstances. Once in South Africa, limited job opportunities forced these immigrants into starting up a business. In order of importance, financial, informational, human and physical, resources were identified as being critical for the start-up a business. With respect to the acquisition of resources, African immigrant entrepreneurs unwillingly made use of personal savings to finance their businesses during the start-up phase of the business. Financial resource played a double role in that it determined the main sources of physical resources used. From a human resource perspective, African immigrant entrepreneurs preferred employing South Africans during the start-up phase of the business, and the reverse was true during the growth phase. To a limited extent family labour was involved at both the start-up as well as the operation phases of the business; with formal education and prior experience playing an indirect role as far as the human resources mixed were concerned. In terms of information, African immigrant entrepreneurs made use of two primary sources of information namely; their ethnic networks and friends from somewhere else. -/- . (shrink)

Techno-ethics is the area in the philosophy of technology which deals with emerging robotic and digital AI technologies. In the last decade, a new techno-ethical challenge has emerged: Autonomous Weapon Systems (AWS), defensive and offensive (the article deals only with the latter). Such AI-operated lethal machines of various forms (aerial, marine, continental) raise substantial ethical concerns. Interestingly, the topic of AWS was almost not treated in Jewish law and its research. This article thus proposes an introductory ethical-halakhic perspective on (...) AWS, in the Israeli context. The article has seven sections. Section 1 defines AWS and the main ethical concerns it evokes, while providing elementary definitions and distinctions. §2 locates AWS within the realm of Jewish laws of war (hilkhot-ẓava), which recognize the right for self-defense, as well as the status of universally accepted moral norms. §3 unfolds pragmatic ethical premises of a humane techno-ethics, which are required for the identifying AWS as a moral question: I. Relationality; II. Technology is not (completely) neutral; III. The fallaciousness of transhumanism. It is argued that these premises are compatible with halakhic tradition. §4 investigates the question of the morality of AWS, within the field of military AI ethics. It is clarified why the standard categories of war-ethics (ad bello, in bellum) do not capture the singular ethical problem of AWS, which pertains to the operation of military means, rather than their human targets. It is argued that reductive perception of the human mind is misleading about the feasibility of ‘ethical robots’, capable of independent moral discretion. To provide a thick examination of human agency from the perspective of Jewish tradition, §5 explores two stories from the biblical book of Samuel (the murder of Nob’s priests and of Uriah). The lessons about the significance of moral agency within the pubic-political military sphere are made explicit, as well as the possible costs resulting from the loss of human agency in the case of AWS. Given that realpolitik considerations are basic in halakhah, §6 considers some possible contemporary socio-political implications of the AWS, that may risk the sustainability of the democratic project. §7 concludes by pointing out humane contributions of Jewish law to contemporary techno-ethics. This article assesses how autonomy and machine learning impact the existential risk of nuclear war. It situates the problem of cyber security, which proceeds by stealth, within the larger context of nuclear deterrence, which is effective when it functions with transparency and credibility. Cyber vulnerabilities poses new weaknesses to the strategic stability provided by nuclear deterrence. This article offers best practices for the use of computer and information technologies integrated into nuclear weapons systems. Nietzsche is absent from today’s growing debate on slavery past and present. In this article I argue that his views on the subject add a pertinent, if challenging, dimension to this wide-ranging discussion. Nietzsche’s analysis is capable of contributing to our understanding of this multifaceted phenomenon in a number of respects. I look at Nietzsche’s use of the controversial notions of slavery, understood both historically and in the context of modern society, to explore such central concerns of political anthropology as (...) the nature and role of leadership, and the questions of development and inequality. The key focus of Nietzsche’s examination concerns slavery as an enduring facet of human existence. He sees it becoming an important hallmark of the industrial culture as a barometer of modern society’s physiological well-being, as well as acting as the repository for its externalities. Nietzsche’s genealogical inquiry leads him to explore the psychological content of slavery and to conceptualise it in terms of human vulnerability, which increases susceptibility to exploitation. In these respects, Nietzsche’s views resonate with pertinence today and deserve closer critical attention and scrutiny – something Nietzsche would undoubtedly welcome. (shrink)

In my paper ‘Three Forms of Internalism and the New Evil Demon Problem,’ I argued that the new evil demon problem, long considered to be one of the biggest obstacles for externalism, is also a problem for virtually all internalists. In (McCain 2014a) and in his recent book (McCain 2014b), Kevin McCain provides a challenging and thought provoking reasons for thinking that many internalists do not have any such problem. In this paper, I’ll provide some replies to McCain. Of note, (...) At the age of 70 years, Professor Chris Nwamuo is still breaking new grounds in the Theatre, Media and Communication disciplines, not only in the University of Calabar, but also in Cross River University of Technology (CRUTECH) in Cross River State Nigeria, Abia State University in Abia State, Nigeria and many other state, national and international higher institutions of learning. He is tireless in research, clinical in project supervision, stern in the resolution of academic knots and committed to teaching students (...) both at the graduate and undergraduate levels. One would imagine that despite the ever busy schedule of this prolific scholar, including his attendance to family affairs, he still has the time to write out his findings, thoughts and perspectives in the very field that he has worked for more than three decades. One of his most recent works is his book “The Dynamics of International Communication” published in 2016. Communication is the human nutrient that grows a healthy relationship among people and nations of the world. When absent or not properly handled, communication effects result to rumor, grapevines, conflict or in internationally severe cases, war. ‘Communication’ as a term is surrounded by mysteries of comprehension but Nwamuo has attempted an unraveling throughout his years of academic surgeon in the field. Ike (2005:40) define communication as the process by which people share information, ideas and feelings using spoken and written words, body language, personal mannerism and style, the physical environment or anything that adds meaning to a message. Iyorza (2015:11) views communication as the transmission of information, idea or beliefs from the encoder to the decoder with the aim of achieving a common ground of understanding, promoting a course or reacting to given stimuli in the communication encounter. Both definitions share a common characteristic: information or ideas sharing or transmission. (shrink)

ABSTRACT The aim of this paper is to provide a sketch on the way Nāgārjuna deals with the idea of 'relation'. The concept of 'relation' as expressed in the Pāli sources is here theoretically systematized according to three patterns: 1. logical, 2. strictly subordinative existential, 3. non-strictly subordinative existential. After having discussed Nāgārjuna's acceptance and treatment of these three patterns, particular attention is paid to the non-strictly subordinative existential relation. This kind of relation is meant to describe the way the (...) factors of the conditioned co-origination are linked to each other and is exemplified by Nāgārjuna by means of the father-son bond. A possible way to explain the conditioned co-origination doctrine in the light of the father-son example is here suggested by having resource to the 'Cambridge change' theory. Even if in the Pāli Canon the non-strictly subordinative existential pattern is said to apply to all the other factors of the conditioned co-origination, there is no direct evidence that it concerns also the avidyā-saṃskāras link. It will be shown how Nāgārjuna, by applying it to the avidyā-saṃskāras link, seems to introduce a new perspective in the conditioned co-origination theory. RESUMO O objetivo deste artigo é proporcionar um esboço da maneira na qual Nāgārjuna aborda a ideia de 'relação'. O conceito de 'relação' que encontramos nas fontes pāli é aqui sistematizado teoricamente conforme três padrões: 1. lógico, 2. existencial estritamente subordinativo, 3. existencial não estritamente subordinativo. Após ter discutido a recepção e o tratamento nagarjunianos desses três padrões, este estudo dedica atenção especial à relação existencial não estritamente subordinativa. Esse tipo de relação visa descrever a maneira na qual os fatores da cooriginação condicionada estão ligados entre eles, e é tipificada por Nāgārjuna pelo exemplo da ligação pai-filho. Para explicar a doutrina da cooriginação condicionada à luz do exemplo pai-filho, um modo possível aqui sugerido é por meio do recurso à teoria do 'Cambridge change'. Embora no cânone pāli se diga que o modelo de relação existencial não estritamente subordinativa se aplique a todos os outros fatores da cooriginação condicionada, não há nenhuma evidência direta de que ele concerna também à ligação avidyā-saṃskāras. Será mostrado como Nāgārjuna, ao aplicar esse modelo à ligação avidyā-saṃskāras, pareça introduzir uma nova perspectiva na teoria da cooriginação condicionada. (shrink)

The educators of the 21st century have a great task ahead. In today’s world, the educators are expected to have a great deal of professional and personal qualities, and extraordinary skills. This descriptive-correlational study aimed to determine perceptions of college students on a well-qualified educator. The study included 123 selected college students from different colleges in Central Luzon, Philippines using a convenience sampling technique. As data collection tool, a questionnaire prepared by the researcher team was used. Some of the findings (...) of the study include: (1) the respondents answered agree on the context of professional and personal qualities that a teacher should have; (2) while in terms of the skills exhibited by an educator, it got an answer to Very Satisfactory. We also found significant differences in professional qualities, learning and innovation skills and life and career skills when grouped according to the respondent’s profile. There was low-to-moderate evidence of the relationship that existed between the qualities and skills of an educator. The results further confirmed the relationship through regression analysis and found that communication skills affect the qualities of an educator. Based on the results, we discussed and recommended practical suggestions on professional, personal and skills improvements of an educator. (shrink)

The Gamer’s Dilemma consists of three intuitively plausible but conflicting assertions: (i) Virtual murder is morally permissible. (ii) Virtual child molestation is morally forbidden. (iii) There is no relevant moral difference between virtual murder and virtual child molestation in computer games. Numerous attempts to resolve (or dissolve) the Gamer’s Dilemma line the field of computer game ethics. Mostly, the phenomenon is approached using expressivist argumentation: Reprehensible virtual actions express something immoral in their performance but are not immoral by themselves. Consequentialists, (...) on the other hand, claim that the immorality of virtual actions arises from their harmful consequences. I argue that both approaches have serious difficulties meeting the moral challenge posed by the Gamer’s Dilemma. They tend to confuse the morality of in-game actions either with the morality of their real-world counterparts or with the morality of games as objects. Following this critical analysis, I will develop a Kantian argument and defend it against two objections. So far, deontological responses to the Gamer’s Dilemma have been sought in vain. Yet, with Kant, its moral challenge can be met by looking at the gamer’s reasons. From this perspective, the Gamer’s Dilemma is based on a false assumption: the moral status of gaming acts does not derive from a normative equation with their real-world counterparts but only from their justifications. This essay aims to provide conceptual tools for the understanding of Wittgenstein’s theory of color as a grammar problem instead of a phenomenological or purely scientific one. From an introduction of his understanding of meaning in his early and late life, his notion of grammar will be analyzed to understand his rebuttal of scientific and phenomenological discourse as a proper means for dealing with the problem of color through his critique of Goethe. Then Wittgenstein’s take on color will become clear (...) as his sympathy for Runge, the painter that Goethe criticizes, is analyzed to understand color as a language-game regarding kinds of colors as numbers and geometrical figures, in that grammar rather than experience is used to acknowledge them. The regularity in social relations is deduced on the base of natural human reactions. The regularity is similar to the Newton’s Third Law. The new approach to phenomenon and definition of violence is offered as a consequence of the discovered regularity. Violence is considered as an action with an object without consent of the owner. It is shown that a person herself is responsible for significant part of violence against her, namely for the violence which is just reaction for her (...) own violence. The regularity of deliberate rejection of violence in society in historical perspective is proved. (shrink)

In Chapter 1 I discuss the basic problem which made me undertake the issue of human death. That problem was the dualism in the depiction of human nature which has not been fully overcome yet, the dualism which leads to the emergence of new difficulties in contemporary attempts at adequately solving the problem of human death. They include the separation of soul from the body in the moment of death, and the borderline between the moment of death and the moment (...) of resurrection. Chapter 2 is devoted to the presentation of a new anthropological perspective, of an anthropology build “from the bottom up”, that is “from foundations”, and taking into account man’s rooting in the biological environment, and thus also in the genetic heritage taken over from our pre-human ancestors. That anthropology brings new aspects into traditional anthropology by extending it to include new ways of explaining the genesis of the human body and spirit, and new depictions of man’s death. In Chapter 2 I will also present the concept of evolution proposed by P.T. de Chardin, which I appreciate for its comprehensive evolutionary perception of the world. This concept has provoked various responses, but it certainly provides a creative inspiration for further attempts at applying the idea of evolution to various issues. The general framework of the evolutionary model proposed by the French researcher turns out to be useful also when applied to the evolutionary understanding of human death. Chapter 3 contains a discussion of the principal premises of the evolutionary concept of human death taken from analyses carried out by T. Wojciechowski concerning the issue of time, space, and the structure of variable material beings. A being is variable because it has a temporal structure, and the changes that occur are the derivatives of that structure. The temporal structure may be seen as endless, in which a being, even though its existence had a beginning, will exist for ever. Material substance should not be seen statically, but in dynamic and evolutionary terms. In evolution, time becomes a driver of development, an element shaping and directing the evolution of the entire cosmos. Man’s substance has been made capable of two levels of being and acting: the spatial and temporal level, and the endless and immanent level. Together, they form the one essence of man. Thus, the human person is partially immersed in the material cosmos, and partially elevated above it. Chapter 4 presents the evolutionary approach to the moment of man’s death. The views of T. Wojciechowski will be presented in which the moment of death is seen as a moment of transformation and perfection of the structure of the essence of human existence. Furthermore, the issue of the relationship existing, according to T. Wojciechowski, between man’s death and resurrection will be discussed. Understood in evolutionary terms, the moment of death is the time when the structure of human existence is transformed. Death transfers man fully into eternity and enables his life on a higher level of existential being. The element of flesh is retained, but changes its nature. Such view of death allows it to be understood as the moment of resurrection and the culmination of the evolutionary process of life. Death is therefore an “invention” of the evolution and should be seen as a natural and positive phenomenon. At this point, I also propose a solution to the question about reconciliation between temporal and endless existence. In Chapter 5 I take up the issue of consequences flowing from the postulated understanding of human death. They have been pointed to by T. Wojciechowski, but need to be further developed and clarified. He believed two lines in man’s development need to be recognized: that of natural and that of supernatural evolution. Both have the same direction, while occurring on different planes. In each of these lines, death is a natural element of life, pre-planned and, so to say, “encoded” in the cosmic matter. Therefore, the treatment of biological death as the consequence of sin is not only contrary to the evolutionary understanding of life, but in addition artificially combines that which is natural with that which is supernatural. Man’s authentic experience of his own present is a condition of his achieving full existential perfection in the moment of this death. Full engagement in the present is, in a way, a harbinger of the future; thus, the life “here” and “there” may not be inherently inconsistent. In the light of the evolutionary concept, death is not a punishment, but the most positive experience of man’s life in that it enables him to achieve full existential perfection. Chapter 6 is devoted to a substantiation of the possibility of evolutionary transformation of the structure of human existence in the moment of death. An adequate cause needs to be identified which could substantiate that transformation and achievement of perfection. I believe an appropriate substantiation can be found in God’s creative act, interpreted in evolutionary terms. The process of evolution, with its subsequent stages, is only a necessary condition for that “transformation” and “elevation”. The sufficient condition is fulfilled by the continuous creative intervention of God. The concept of God’s creative activity in the moment of man’s death finds its continuation in Chapter 7, where I present a detailed analysis of God’s activity at the time of man’s death. The concept of God’s creative activity extended over the entire process of evolution makes it possible to consider the moment of death as the moment of man’s resurrection. The moment of death is thus a moment of creation in evolutionary terms. Thus, as long as man is related to temporal and spatial elements, his development, or creation, continues. Death is only the completion of the final stage of creation, which may be painful and evoke fear, but in fact should give hope, for it involves resurrection. I also propose that the creative act in the moment of man’s death-resurrection be considered a basic action of God, which explains the manner in which God’s activity is contained within the framework of the creative act, encompassing also the moment of death-resurrection. The final Chapter 8 describes a didactic model illustrating the concept proposed here. I use the analogy of white light dispersion effect in the prism, and compare the incident ray to the creative act, and the dispersed rays going through the prism to the line of man’s natural and supernatural evolution. This model also shows the difference in the perspectives from which the phenomenon of death is seen by God and by man. (shrink)
