Experimental work on free will typically relies on deterministic stimuli to elicit judgments of free will. We call this the Vignette-Judgment model. We outline a problem with research based on this model. It seems that people either fail to respond to the deterministic aspects of vignettes when making judgments or that their understanding of determinism differs from researcher expectations. We provide some empirical evidence for this claim. In the end, we argue that people seem to lack facility with the concept (...) of determinism, which calls into question the validity of experimental work operating under the Vignette-Judgment model. We also argue that alternative experimental paradigms are unlikely to elicit judgments that are philosophically relevant to questions about the metaphysics of free will. (shrink)

Theories of free will are often measured against how well they capture everyday intuitions about free will. But what are these everyday intuitions, and what theoretical commitments do they express? Empirical methods have delivered mixed messages. In response, some free will theorists have developed error theories to undermine the credentials of countervailing intuitions. These efforts are predicated on the idea that people might misunderstand determinism in any of several ways. This paper sheds light on the comprehension problem. We first discuss (...) recent efforts to explain systematic errors in how people interpret determinism. Then, we present the alarming results of two new preregistered studies exploring three types of comprehension failure: (a) epiphenomenal bypassing, (b) fatalistic bypassing, and (c) indeterministic intrusion. Our findings suggest that misunderstanding runs deeper than others have supposed. This casts doubt on existing models of commonsense thinking about free will. Unless and until researchers properly control for the kinds of misunderstandings we identify, research on free will intuitions cannot shed light on whether ordinary thinking reflects commitments to compatibilism or incompatibilism. One debate surrounding Derk Pereboom’s (2001, 2014) four-case argument against compatibilism focuses on whether, and why, we judge manipulated agents to be neither free nor morally responsible. In this paper, we propose a novel explanation. The four-case argument features cases where an agent is the only individual in her universe who has been manipulated. Let us call manipulation whose scope includes at least one but not all agents existential manipulation. Contrast this with universal manipulation, which affects all agents within a (...) universe. We propose that we find agents in Pereboom’s manipulation cases less free and morally responsible in part because they are the target of existential manipulation. We empirically tested this hypothesis and found that people’s free will and moral responsibility judgments were sensitive to the scope of manipulation: people judged existentially manipulated agents significantly less free and responsible than universally manipulated agents. Empirical work has lately confirmed what many philosophers have taken to be true: people are ‘biased toward the future’. All else being equal, we usually prefer to have positive experiences in the future, and negative experiences in the past. According to one hypothesis, the temporal metaphysics hypothesis, future-bias is explained either by our beliefs about temporal metaphysics—the temporal belief hypothesis—or alternatively by our temporal phenomenology—the temporal phenomenology hypothesis. We empirically investigate a particular version of the temporal belief hypothesis according to (...) which future-bias is explained by the belief that time robustly passes. Our results do not match the apparent predictions of this hypothesis, and so provide evidence against it. But we also find that people give more future-biased responses when asked to simulate a belief in robust passage. We take this to suggest that the phenomenology that attends simulation of that belief may be partially responsible for future-bias, and we examine the implications of these results for debates about the rationality of future-bias. Recent literature in experimental philosophy has postulated the existence of the abstract/concrete paradox : the tendency to activate inconsistent intuitions depending on whether a problem to be analyzed is framed in abstract terms or is described as a concrete case. One recent study supports the thesis that this effect influences judicial decision-making, including decision-making by professional judges, in areas such as interpretation of constitutional principles and application of clear-cut rules. Here, following the existing literature in legal theory, we argue that (...) the susceptibility to such an effect might depend on whether decision-makers operate in a legal system characterized by the formalist or particularist approach to legal interpretation, with formalist systems being less susceptible to the effect. To test this hypothesis, we compare the results of experimental studies on ACP run on samples from two countries differing in legal culture: Poland and Brazil. The lack of significant differences between those results suggests that ACP is a robust effect in the legal context. (shrink)

The claim that common sense regards free will and moral responsibility as compatible with determinism has played a central role in both analytic and experimental philosophy. In this paper, we show that evidence in favor of this “natural compatibilism” is undermined by the role that indeterministic metaphysical views play in how people construe deterministic scenarios. To demonstrate this, we re-examine two classic studies that have been used to support natural compatibilism. We find that although people give apparently compatibilist responses, this (...) is largely explained by the fact that people import an indeterministic metaphysics into deterministic scenarios when making judgments about freedom and responsibility. We conclude that judgments based on these scenarios are not reliable evidence for natural compatibilism. (shrink)

It is a common idea, and an element in many legal systems, that people can deserve punishment when they commit criminal (or immoral) actions. A standard philosophical objection to this retributivist idea about punishment is that if human choices and actions are determined by previous events and the laws of nature, then we are not free in the sense required to be morally responsible for our actions, and therefore cannot deserve blame or punishment. It has recently been suggested that this (...) argument can be backed up by neuroscience, since neuroscientific explanations of human behavior leave no room for non-determined free actions. In this thesis, an argument of this sort is discussed. According to this argument, that I call “the Revision Argument”, we should revise the legal system so that any retributivist justification of punishment is removed. I examine some objections to the Revision Argument according to which compatibilism about free will and responsibility is a morally acceptable basis of retributive punishment. I argue that these objections have difficulties in providing a plausible account of the relevant difference between people who deserve punishment for their actions and people who do not. Therefore, I argue that they fail to refute the conclusion of the Revision Argument. (shrink)

What it would take to vindicate folk temporal error theory? This question is significant against a backdrop of new views in quantum gravity—so-called timeless physical theories—that claim to eliminate time by eliminating a one-dimensional substructure of ordered temporal instants. Ought we to conclude that if these views are correct, nothing satisfies the folk concept of time and hence that folk temporal error theory is true? In light of evidence we gathered, we argue that physical theories that entirely eliminate an ordered (...) substructure vindicate folk temporal error theory. (shrink)

This paper argues for a view of free will that I will call the conceptual impossibility of the truth of free will error theory - the conceptual impossibility thesis. I will argue that given the concept of free will we in fact deploy, it is impossible for our free will judgements - judgements regarding whether some action is free or not - to be systematically false. Since we do judge many of our actions to be free, it follows from the (...) conceptual impossibility thesis that many of our actions are in fact free. Hence it follows that free will error theory - the view that no judgement of the form ‘action A was performed freely’ - is false. I will show taking seriously the conceptual impossibility thesis helps makes good sense of some seemingly inconsistent results in recent experimental philosophy work on determinism and our concept of free will. Further, I will present some reasons why we should expect to find similar results for every other factor we might have thought was important for free will. (shrink)

We linked between the social-psychology and experimental-philosophy paradigms for the study of folk intuitions and beliefs regarding the concept of free will to answer three questions: (1) what intuitions do people have about free-will and determinism? (2) do free will beliefs predict differences in free-will and determinism intuitions? and (3) is there more to free-will and determinism than experiencing certainty or uncertainty about the nature of the universe? Overall, laypersons viewed the universe as allowing for human indeterminism, and they did (...) so with certainty. Examining intuitions of prosociality, future-orientation, learning, meaningfulness, human uniqueness, and well-being, ratings were highest in the indeterministic universe condition and lowest in the deterministic universe condition, both significantly different from the uncertain universe condition. Participants’ free will beliefs had only weak impact on realism, happiness, and learning intuitions, but did not reverse the general intuition favoring indeterminism, and showed no impact on other intuitions. [Note: articles 1-5 are in English; Intro, Discussion, and Conclusion are in Portuguese.] Responsibility practices that are part of our daily lives involve, among other things, standards about how one should praise, blame, or punish people for their actions, as well as particular acts that follow those standards to a greater or lesser extent. A classical question in philosophy asks whether human beings can actually be morally responsible for what they do. This dissertation argues that addressing this classical question is (...) insufficient if one wants the investigation of moral responsibility to serve the goal of improving ordinary responsibility practices. As an alternative, I offer directions for an interdisciplinary investigation that I take to be in a better position to promote that goal. My argument is developed in five articles and a discussion section. The first four articles describe limitations of skeptical views, which deny the existence of moral responsibility. The first article assesses a skeptical argument based on results from neuroscience that intends to show that there is no free will. I argue that a premise in the argument—which says that choices are determined by events in the brain—is not supported by the available results. The second article argues that, despite the fact that existent results do not show that choices are determined by brain events, further studies in neuroscience could in principle do that. The third article begins the discussion of limitations that concern the implementability of some of the changes in responsibility practices recommended in skeptical approaches. Specifically, I describe challenges that attempts to reduce the severity of legal punishment are likely to face due to psychological facts about belief in free will and desire to punish. The forth article presents results from an original experiment that sought to test a hypothesis about the workings of belief in free will and the desire to punish, namely the hypothesis that the desire to punish causally affects beliefs about free will. Results failed to support the hypothesis. Finally, the fifth article presents what I call the enhancement model, i.e., a proposal about how to structure an interdisciplinary investigation that can promote the enhancement of ordinary responsibility practices. The final discussion section shows how the enhancement model overcomes some of the limitations of recent discussions about the existence of moral responsibility, which includes not just the skeptical views considered in earlier articles, but also views that affirm the existence of moral responsibility and free will. The central claim of this dissertation, therefore, is that the investigation of moral responsibility can be rearranged so as to further the goal of improving ordinary responsibility practices. In the last few decades, the literature on moral responsibility has been increasingly populated by scientific studies. Studies in neuroscience and psychology, in particular, have been claimed to be relevant for discussions about moral responsibility in a number of ways. And at the same time, there is not yet a systematic understanding of the sort of questions a science of moral responsibility is supposed to answer. This paper is an attempt to move toward such an understanding. I discuss three models (...) for framing scientific questions relevant to an investigation of moral responsibility. The favored model—the Enhancement model—proposes that a science of moral responsibility has two descriptive tasks. First, science can describe the causes and effects of the many sorts of responses that constitute the human practices of moral responsibility, such as praise, blame, and punishment. And, second, science can describe how modifications aiming at the improvement of such practices can be achieved. Relatively to the other models to be considered, the Enhancement model is broader in scope and less tied to the traditional philosophical agenda on moral responsibility. (shrink)

Compatibilism is the view that moral responsibility is compatible with determinism. Natural compatibilism is the view that in ordinary social cognition, people are compatibilists. Researchers have recently debated whether natural compatibilism is true. This paper presents six experiments (N = 909) that advance this debate. The results provide the best evidence to date for natural compatibilism, avoiding the main methodological problems faced by previous work supporting the view. In response to simple scenarios about familiar activities, people judged that agents had (...) moral responsibilities to perform actions that they were unable to perform (Experiment 1), were morally responsible for unavoidable outcomes (Experiment 2), were to blame for unavoidable outcomes (Experiments 3-4), deserved blame for unavoidable outcomes (Experiment 5), and should suffer consequences for unavoidable outcomes (Experiment 6). These findings advance our understanding of moral psychology and philosophical debates that depend partly on patterns in commonsense morality. (shrink)

In the past decade, a number of empirical researchers have suggested that laypeople have compatibilist intuitions. In a recent paper, Feltz and Millan have challenged this conclusion by claiming that most laypeople are only compatibilists in appearance and are in fact willing to attribute free will to people no matter what. As evidence for this claim, they have shown that an important proportion of laypeople still attribute free will to agents in fatalistic universes. In this paper, we first argue that (...) Feltz and Millan’s error-theory rests on a conceptual confusion: it is perfectly acceptable for a certain brand of compatibilist to judge free will and fatalism to be compatible, as long as fatalism does not prevent agents from being the source of their actions. We then present the results of two studies showing that laypeople’s intuitions are best understood as following a certain brand of source compatibilism rather than a “free-will-no-matter-what” strategy. Compatibilism is the view that determinism is compatible with acting freely and being morally responsible. Incompatibilism is the opposite view. It is often claimed that compatibilism or incompatibilism is a natural part of ordinary social cognition. That is, it is often claimed that patterns in our everyday social judgments reveal an implicit commitment to either compatibilism or incompatibilism. This paper reports five experiments designed to identify such patterns. The results support a nuanced hybrid account: The central tendencies in ordinary social (...) cognition are compatibilism about moral responsibility, compatibilism about positive moral accountability, neither compatibilism nor incompatibilism about negative moral accountability, compatibilism about choice for actions with positive outcomes, and incompatibilism about choice for actions with negative or neutral outcomes. Shaun Nichols has recently argued that while the folk notion of free will is associated with error, a question still remains whether the concept of free will should be eliminated or preserved. He maintains that like other eliminativist arguments in philosophy, arguments that free will is an illusion seem to depend on substantive assumptions about reference. According to free will eliminativists, people have deeply mistaken beliefs about free will and this entails that free will does not exist. However, an alternative (...) reaction is that free will does exist, we just have some deeply mistaken beliefs about it. According to Nichols, all such debates boil down to whether or not the erroneous folk term in question successfully refers or not. Since Nichols adopts the view that reference is systematically ambiguous, he maintains that in some contexts it’s appropriate to take a restrictivist view about whether a term embedded in a false theory refers, while in other contexts it’s appropriate to take a liberal view about whether a token of the very same term refers. This, according to Nichols, affords the possibility of saying that the sentence “free will exists” is false in some contexts and true in others. In this paper I argue that even if we grant Nichols his pluralistic approach to reference, there is still good reason to prefer eliminativism to preservationism with regard to free will. My argument focuses on one important difference between the concept of “free will” and other theoretical terms embedded in false theories—i.e., the role that the phenomenology of free agency plays in reference fixing. Philosophical tradition has long held that free will is necessary for moral responsibility. We report experimental results that show that the folk do not think free will is necessary for moral responsibility. Our results also suggest that experimental investigation of the relationship is ill served by a focus on incompatibilism versus compatibilism. We propose an alternative framework for empirical moral psychology in which judgments of free will and moral responsibility can vary independently in response to many factors. The debate over whether free will and determinism are compatible is controversial, and produces wide scholarly discussion. This paper argues that recent studies in experimental philosophy suggest that people are in fact “natural compatibilists”. To support this claim, it surveys the experimental literature bearing directly or indirectly upon this issue, before pointing to three possible limitations of this claim. However, notwithstanding these limitations, the investigation concludes that the existing empirical evidence seems to support the view that most people have compatibilist (...) intuitions. (shrink)

P.F. Strawson famously argued that reactive attitudes and ordinary moral practices justify moral assessments of blame, praise, and punishment. Here we consider whether Strawson's approach can illuminate the concept of desert. After reviewing standard attempts to analyze this concept and finding them lacking, we suggest that to deserve something is to justifiably receive a moral assessment in light of certain criteria – in particular, eligibility criteria (a subject's properties that make the subject principally eligible for moral assessments) and assignment criteria (...) (particulars about the subject, act, and circumstances that justify assessments such as blame in a particular case). Strawson's analysis of the ordinary attitudes and practices of moral assessment hints at these criteria but does not unequivocally ground a notion of desert. Following Strawson's general naturalistic approach, we show that recent psychological research on folk concepts and practices regarding freedom, moral responsibility, and blame illuminates how people actually arrive at moral assessments, thus revealing the very eligibility criteria and assignment criteria we suggest ground a concept of desert. By pushing the Strawsonian line even further than Strawson did, by empirically investigating actual moral practice and folk understandings, we can illuminate desert and lend credence to Strawson's general anti-metaphysical position. One debate in the experimental exploration of everyday judgments about free will is whether most people are compatibilists or incompatibilists. Some recent research suggests that many people who have incompatibilist intuitions are making a mistake; as such, they do not have genuine incompatibilist intuitions. Another worry is whether most people appropriately understand determinism or confuse it with similar, but different, notions such as fatalism. In five studies we demonstrate people distinguish determinism from fatalism. While people overall make this distinction, a (...) large percentage of people still judge that a person who is fated to perform an action is both free and morally responsible for that action. Those who thought that one freely performs and is morally responsible for a fated action had much stronger compatibilist judgments. These data suggest that a substantial percentage of people have “free will no matter what” intuitions. As a result, even though many people may appear to be compatibilist.. (shrink)

The idea that incompatibilism is intuitive is one of the key motivators for incompatibilism. Not surprisingly, then philosophers who defend incompatibilism often claim that incompatibilism is the natural, commonsense view about free will and moral responsibility (e.g., Pereboom 2001, Kane Journal of Philosophy 96:217–240 1999, Strawson 1986). And a number of recent studies find that people give apparently incompatibilist responses in vignette studies. When participants are presented with a description of a causal deterministic universe, they tend to deny that people (...) are morally responsible in that universe. Although this suggests that people are intuitive incompatibilists, Eddy Nahmias and Dylan Murray, in a recent series of important papers, have developed an important challenge to this interpretation. They argue that people confuse determinism with bypassing, the idea that one’s mental states lack causal efficacy. Murray and Nahmias present new experiments that seem to confirm the bypassing hypothesis. In this paper, we use structural equation modeling to re-examine the issue. We find support instead for an incompatibilist explanation of the bypassing results, i.e., incompatibilist judgments seem to cause bypassing judgments. We hypothesize that this phenomenon occurs because people think of decisions as essentially indeterministic; thus, when confronted with a description of determinism they tend to think that decisions do not even occur. We provide evidence for this in three subsequent studies which show that many participants deny that people make decisions in a deterministic universe; by contrast, most participants tend to allow that people add numbers in a deterministic universe. Together, these studies suggest that bypassing results don’t reflect a confusion, but rather the depth of the incompatibilist intuition. (shrink)

Many philosophers appeal to intuitions to support some philosophical views. However, there is reason to be concerned about this practice as scientific evidence has documented systematic bias in philosophically relevant intuitions as a function of seemingly irrelevant features (e.g., personality). One popular defense used to insulate philosophers from these concerns holds that philosophical expertise eliminates the influence of these extraneous factors. Here, we test this assumption. We present data suggesting that verifiable philosophical expertise in the free will debate-as measured by (...) a reliable and validated test of expert knowledge-does not eliminate the influence of one important extraneous feature (i.e., the heritable personality trait extraversion) on judgments concerning freedom and moral responsibility. These results suggest that, in at least some important cases, the expertise defense fails. Implications for the practice of philosophy, experimental philosophy, and applied ethics are discussed. For some reason, participants hold agents more responsible for their actions when a situation is described concretely than when the situation is described abstractly. We present examples of this phenomenon, and survey some attempts to explain it. We divide these attempts into two classes: affective theories and cognitive theories. After criticizing both types of theories we advance our novel hypothesis: that people believe that whenever a norm is violated, someone is responsible for it. This belief, along with the familiar workings (...) of cognitive dissonance theory, is enough to not only explain all of the abstract/concrete paradoxes, but also explains seemingly unrelated effects, like the anthropomorphization of malfunctioning inanimate objects. Skeptical worries about moral responsibility seem to be widely appreciated and deeply felt. To address these worries—if nothing else to show that they are mistaken—theories of moral responsibility need to relate to whatever concept of responsibility underlies the worries. Unfortunately, the nature of that concept has proved hard to pin down. Not only do philosophers have conflicting intuitions; numerous recent empirical studies have suggested that both prosaic responsibility judgments and incompatibilist intuitions among the folk are influenced by a number of (...) surprising factors, sometimes prompting apparently contradictory judgments. In this paper, we show how an independently motivated hypothesis about responsibility judgments provides a unified explanation of the more important results from these studies. According to this ‘Explanation Hypothesis’, to take an agent to be morally responsible for an event is to take a relevant motivational structure of the agent to be part of a significant explanation of the event. We argue that because of how explanatory interests and perspectives affect what we take as significant explanations, this analysis accounts for the puzzling variety of empirical results. If this is correct, the Explanation Hypothesis also provides a new way of understanding debates about moral responsibility. (shrink)

This paper considers three package deals combining views in philosophy of mind, meta-philosophy, and experimental philosophy. The most familiar of these packages gives center-stage to pumping intuitions about fanciful cases, but that package involves problematic commitments both to a controversial descriptivist theory of reference and to intuitions that “negative” experimental philosophers have shown to be suspiciously variable and context-sensitive. In light of these difficulties, it would be good for future-minded experimental philosophers to align themselves with a different package deal. This (...) paper suggests two alternatives. Experimentalists might help fans of “naturalized” approaches discover what natural kinds have been playing an appropriate role in causing us to use concepts as we do. Or, better still, experimentalists might instead help pragmatists and teleo-semanticists discover how our concept usage regularly yields beneficial outcomes, so that we can then craft philosophical analyses that will.. I edited his words for publication with his approval.

We discuss recent work in experimental philosophy on free will and moral responsibility and then present a new study. Our results suggest an error theory for incompatibilist intuitions. Most laypersons who take determinism to preclude free will and moral responsibility apparently do so because they mistakenly interpret determinism to involve fatalism or “bypassing” of agents’ relevant mental states. People who do not misunderstand determinism in this way tend to see it as compatible with free will and responsibility. We discuss why (...) these results pose a challenge to incompatibilists. If you start taking courses in contemporary cognitive science, you will soon encounter a particular picture of the human mind. This picture says that the mind is a lot like a computer. Specifically, the mind is made up of certain states and certain processes. These states and processes interact, in accordance with certain general rules, to generate specific behaviors. If you want to know how those states and processes got there in the first place, the only answer is that they (...) arose through the interaction of other states and processes, which arose from others... until, ultimately, the chain goes back to factors in our genes and our environment. Hence, one can explain human behavior just by positing a collection of mental states and psychological processes and discussing the ways in which these states and processes interact. This picture of the mind sometimes leaves people feeling deeply uncomfortable. They find themselves thinking something like: 'If the mind actually does work like that, it seems like we could never truly be morally responsible for anything we did. After all, we would never be free to choose any behavior other than the one we actually performed. Our behaviors would just follow inevitably from certain facts about the configuration of the states and processes within us.' Many philosophers think that this sort of discomfort is fundamentally confused or wrongheaded. They think that the confusion here can be cleared up just by saying something like: 'Wait! It doesn't make any sense to say that the interaction of these states and processes is preventing you from controlling your own life. The thing you are forgetting is that the interaction of these states and processes – this whole complex system described by cognitive science – is simply you. So when you learn that these states and processes control your behavior, all you are learning is that you are controlling your behavior. There is no reason at all to see these discoveries as a threat to your freedom or responsibility.'2 Philosophers may regard this argument as a powerful one, perhaps even irrefutable.. (shrink)

Recently, there has been an increased interest in folk intuitions about freedom and moral responsibility from both philosophers and psychologists. We aim to extend our understanding of folk intuitions about freedom and moral responsibility using an individual differences approach. Building off previous research suggesting that there are systematic differences in folks’ philosophically relevant intuitions, we present new data indicating that the personality trait extraversion predicts, to a significant extent, those who have compatibilist versus incompatibilist intuitions. We argue that identifying groups (...) of people who have specific and diverse intuitions about freedom and moral responsibility offers the possibility for theoretical advancement in philosophy and psychology, and may in part explain why some perennial philosophical debates have proven intractable. This paper develops a sympathetic critique of recent experimental work on free will and moral responsibility. Section 1 offers a brief defense of the relevance of experimental philosophy to the free will debate. Section 2 reviews a series of articles in the experimental literature that probe intuitions about the "compatibility question"—whether we can be free and morally responsible if determinism is true. Section 3 argues that these studies have produced valuable insights on the factors that influence our judgments on the (...) compatibility question, but that their general approach suffers from significant practical and philosophical difficulties. Section 4 reviews experimental work addressing other aspects of the free will/moral responsibility debate, and section 5 concludes with a discussion of avenues for further research. (shrink)

Recent experimental research has revealed surprising patterns in people's intuitions about free will and moral responsibility. One limitation of this research, however, is that it has been conducted exclusively on people from Western cultures. The present paper extends previous research by presenting a cross-cultural study examining intuitions about free will and moral responsibility in subjects from the United States, Hong Kong, India and Colombia. The results revealed a striking degree of cross-cultural convergence. In this paper we discuss studies that show that most people do not find determinism to be incompatible with free will and moral responsibility if determinism is described in a way that does not suggest mechanistic reductionism. However, if determinism is described in a way that suggests reductionism, that leads people to interpret it as threatening to free will and responsibility. We discuss the implications of these results for the philosophical debates about free will, moral responsibility, and determinism.

The epistemology of intuitions has become popular recently with philosophers’ increasing use of experimental methods to study intuitions. Philosophers have focused on the reliability of intuitions, as empirical studies seem to suggest that conflicting intuitions are common. One set of studies, concerning what Sinnott-Armstrong calls the abstract/concrete paradox, suggests that conflicting intuitions are common and, hence, that mistaken intuitions are common. As Goldman notes, if mistaken intuitions are sufficiently prevalent, then we might have reason to think intuitions are unreliable. I (...) argue that mistaken intuitions are not common, since studies concerning the abstract/concrete paradox have unknowingly studied several distinct phenomena instead of the abstract/concrete paradox and, hence, that they present merely apparently conflicting intuitions. I then discuss the import of empirical studies for debates about reliability, noting that those studies can inform us about the unreliability of intuitions but we are still unclear about the conditions for reliability. This paper assesses two accounts of what it means to have a moral responsibility. According to the desert account, moral responsibility amounts to deserving credit or blame for doing or failing to do things. According to an alternative theory, the demand account, moral responsibility amounts to being subject to a moral requirement, such as an obligation or duty. On this account, moral responsibility identifies the presence of a moral demand that may or may not be accompanied by desert. Experiments are (...) conducted to test these accounts in ordinary moral judgment. Results indicate that moral judgment has both a demand and a desert function, that responsibility can pattern with the demand function, and that responsibilities are attributed without blame, criticism, or punishment when several determinants of moral judgment, such as conscious awareness, intention, belief, and neurodeterminism are manipulated. Results also suggest that having a responsibility is distinguished from being responsible for something, that the latter can pattern with the desert function, and that paradoxically, one can have a responsibility that one is not responsible for. These findings advance our understanding of moral responsibility, the processes underlying moral judgment in moral psychology, and conceptual clarity in moral philosophy. (shrink)

Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. In this thesis, I will defend a new kind of compatibilist account of free action, indirect conscious control compatibilism (or indirect compatibilism for short), and argue that some of our actions are free according to it. My argument has three components, and involves the development of a brand new tool for experimental philosophy, and the use of cognitive neuroscience. The first component of the argument shows that compatibilism (of some kind) is a conceptual truth. Contrary to the current orthodoxy in (...) the free will literature, which is that our concept of free will is an incompatibilist concept - a concept according to which we have free will only if determinism is false - I will show that our concept of free will is in fact a compatibilist concept - a concept according to which we can have free will even if determinism is true - and I do so using a new experimental philosophy methodology inspired by two-dimensional semantics. -/- Of course, even if our concept of free will is a compatibilist concept, this does not mean that there are any free actions in the world: the current empirical evidence from the brain sciences appears to show that there might be no, or very few, free actions in the world, even on many compatibilist understandings of what it would take for there to be free will. The second component of the argument addresses this concern by extending our understanding of compatibilism. Agents act freely either when their actions are caused by compatibilistically acceptable psychological processes, or are indirectly caused by those same processes. Hence the name of my account: indirect compatibilism. -/- The final component of the argument defends my new account against some interesting objections and provides evidence from cognitive neuroscience that some of our actions count as free by the lights of indirect compatibilism. Experimental philosophy is a new interdisciplinary field that uses methods normally associated with psychology to investigate questions normally associated with philosophy. The present review focuses on research in experimental philosophy on four central questions. First, why is it that people's moral judgments appear to influence their intuitions about seemingly nonmoral questions? Second, do people think that moral questions have objective answers, or do they see morality as fundamentally relative? Third, do people believe in free will, and do they see free (...) will as compatible with determinism? Fourth, how do people determine whether an entity is conscious? (shrink)

Five experiments suggested that everyday free will and moral responsibility judgments about some hypothetical thought examples differed from free will and moral responsibility judgments about the actual world. Experiment 1 (N = 106) showed that free will intuitions about the actual world measured by the FAD-Plus poorly predicted free will intuitions about a hypothetical person performing a determined action (r = .13). Experiments 2–5 replicated this result and found the relations between actual free will judgments and free will judgments about (...) hypothetical determined or fated actions (rs = .22–.35) were much smaller than the differences between them (ηp2 = .2–.55). These results put some pressure on theoretical accounts of everyday intuitions about freedom and moral responsibility. (shrink)

Sommers (2010) argues that experimental philosophers of free will have largely been asking the wrong question – the question whether philosophically naïve individuals think that free will and moral responsibility are compatible with determinism. The present studies begin to alleviate this concern by testing the intuitive plausibility of Pereboom’s (2001) four case argument. The general pattern of responses from two experiments does not support Pereboom’s predictions. The time has come to consider whether experimental philosophy’s (“x-phi”) early arguments, debates, and conceptual frameworks, that may have worn well in its early days, fit with the diverse range of projects undertaken by experimental philosophers. Our aim is to propose a novel taxonomy for x-phi that identifies four paths from empirical findings to philosophical consequences, which we call the “fourfold route.” We show how this taxonomy can be fruitfully applied even at what one might have taken to be the (...) furthest edges of possible applications of x-phi in metaphysics and formal philosophy. Ultimately, the fourfold route helps us understand a different kind of empirical fact: the development of x-phi itself. (shrink)

Governments, physicians, media and academics have all called for individuals to bear responsibility for their own health. In this article, I argue that requiring those with adverse health outcomes to bear responsibility for these outcomes is a bad basis for policy. The available evidence strongly suggests that the capacities for responsible choice, and the circumstances in which these capacities are exercised, are distributed alongside the kinds of goods we usually talk about in discussing distributive justice, and this distribution significantly explains (...) why people make bad health choices. These facts suggest that we cannot justifiably hold them responsible for these choices. We do better to hold responsible those who determine the ways in which capacities and circumstances are distributed: they are indirectly responsible for these adverse health outcomes and possess the capacities and resources to take responsibility for these facts. Eddy Nahmias, with various collaborators, has used experimental data to argue for the claim that folk intuition is generally compatibilist. We try to undermine this claim in two ways. First, we argue that the various formulations of determinism he uses are not conceptually equivalent, jeopardizing the kinds of conclusions that can be drawn from the resulting data. Second, prompted by these conceptual worries we supplement the typical quantitative surveys that dominate the extant literature with short qualitative interviews. Neuroscience is increasingly used to infer the cognitive capacities of offenders from the activity and volume of different brain regions, with the resultant findings receiving great interest in the public eye. This field experiment tested the effects of public engagement in neuroscience on attitudes towards offenders. Brainstorm is a play about teenage brain development. Either before or after watching this play, 728 participants responded to four questions about the age of criminal responsibility, and the moral responsibility and dangerousness of a (...) hypothetical young or adult offender. After watching the play, participants perceived the young offender as less likely to reoffend than the adult offender and the young, but not adult, offender as less morally responsible for his actions, especially on the first offence. Therefore, public engagement in the newest arrival to the criminological scene – neuroscience – may shift support for different youth justice responses. (shrink)

As imaging technologies help us understand the structure and function of the brain, providing insight into human capabilities as basic as vision and as complex as memory, and human conditions as impairing as depression and as fraught as psychopathy, some have asked whether they can also help us understand human agency. Specifically, could neuroimaging lead us to reassess the socially significant practice of assigning and taking responsibility?While responsibility itself is not a psychological process open to investigation through neuroimaging, decision‐making is. Over the past decade, different researchers and scholars have sought to use neuroimaging (or the results of neuroimaging studies) to investigate what is going on in the brain when we make decisions. The results of this research raise the question whether neuroscience—especially now that it includes neuroimaging—can and should alter our understandings of responsibility and our related practice of holding people responsible.
