This book investigates the relationship between liberal democracies and ontology, that is, philosophical claims about the constitution of agents and the social world. Many philosophers argue that ontology needs to be avoided in political and legal philosophy. In fact, political liberalism, a highly influential paradigm founded by the philosopher John Rawls, makes the avoidance of ontology a core ambition of its 'political, non-metaphysical' programme. In contrast to political liberalism, this book argues that attending to ontological disputes is essential to political (...) and legal philosophy. Illuminating, criticising and developing ontological arguments does not only enhance our understanding of justice, but also highlights key features of democratic citizenship. The argument is built up by bringing together three traditions of thought that have so far not been confronted with one another: political liberalism, the work of Michel Foucault, and the psychoanalytic theories of Sigmund Freud and Donald Winnicott. The book also investigates more concrete implications of ontological disputes by drawing on several case studies: a Dutch political-legal debate about greeting rituals; an American conflict about the legalisation of religious freedom; and the struggles for resilience of two American social movement groups. Right-wing intellectuals often invoke Nietzsche's concept of slave morality to underpin their criticism of 'political correctness' ('PC'). This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

In der sozialphilosophischen Debatte um Freiheit bei Foucault wird das ‚Freiheitsproblem‘ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Die Arbeit unterscheidet systematisch vier verschiedene Interpretationsstrategien von Foucaults Werk, die es als kohärente sozialphilosophische Theorie konstruieren und dabei das Freiheitsproblem lösen sollen; sie rekonstruiert die Arbeiten von exemplarischen Vertreter_innen dieser Strategien: 1. Dafür werden einige neue systematische Unterscheidungen entwickelt: u.a. das Freiheitsproblem der Machtdetermination im Gegensatz zum Freiheitproblem der Subjektivierung, Freiheit als Anders-handeln-Können im Gegensatz zu Freiheit als Kritik, verschiedene Modalitäten dieser Freiheitsbegriffe und eine Foucault-Lesart der Regierungstranszendenz im Gegensatz zu einer Lesart der radikalen Immanenz. This lecture insisted upon negative liberty as the political complement to the human capacity for free choice, and made matching metaphysical claims: the nature of being, and especially the conflicts amongst values, were inconsistent with totalitarian claims. Berlin, arguing along this line, provided an account of the perversion of positive liberty into a warrant for such claims, discussed nationalism, and emphasized the value‐pluralism, now linked so frequently with his name.

In 1784, the German newspaper Berlinische Monatsschrift asked its audience to reply to the question "What is Enlightenment?" Immanuel Kant took the opportunity to investigate the purported truths and assumptions of his age. Two hundred years later, Michel Foucault wrote a response to Kant's initial essay, positioning Kant as the initiator of the discourse and critique of modernity. The Politics of Truth takes this initial encounter between Foucault and Kant, as a framework for its selection of unpublished essays and transcripts (...) of lectures Foucault gave in America and France between 1978 and 1984, the year of his death. Ranging from reflections on the Enlightenment and revolution to a consideration of the Frankfurt School, this collection offers insight into the topics preoccupying Foucault as he worked on what would be his last body of published work, the three-volume History of Sexuality. It also offers what is in a sense the most "American" moment of Foucault's thinking, for it was in America that he realized the necessity of tying his own thought to that of the Frankfurt School. In this clear and comprehensive analysis of his thought, Johanna Oksala identifies the different interpretations of freedom in his philosophy and examines three major divisions of it: the archaeological, the genealogical, and the ethical. Much recent philosophical work on social freedom focuses on whether freedom should be understood as non-interference, in the liberal tradition associated with Isaiah Berlin, or as non-domination, in the republican tradition revived by Philip Pettit and Quentin Skinner. We defend a conception of freedom that lies between these two alternatives: freedom as independence. Like republican freedom, it demands the robust absence of relevant constraints on action. Unlike republican, and like liberal freedom, it is not moralized. We show that freedom as (...) independence retains the virtues of its liberal and republican counterparts while shedding their vices. Our aim is to put this conception of freedom more firmly on the map and to offer a novel perspective on the logical space in which different conceptions of freedom are located. (shrink)

The long republican tradition is characterized by a conception of freedom as non‐domination, which offers an alternative, both to the negative view of freedom as non‐interference and to the positive view of freedom as self‐mastery. The first part of the book traces the rise and decline of the conception, displays its many attractions and makes a case for why it should still be regarded as a central political ideal. The second part of the book looks at the sorts of political (...) and civil institutions that would be required in a society in which freedom as non‐domination is systematically fostered. It outlines the causes and policies, the constitutional and democratic forms, and the regulatory controls that a republican state ought to endorse. Governmentality draws on Foucault's work along with wider analytical frameworks to reclaim centre stage for this sociological concept. The author argues for a new understanding of how the individual is related to the state and vice versa.

The social-philosophical discourse of the last 20 years pictured recognition mainly as medium of human autonomy. In recent years however, concerns have been raised over whether recognition might not occasionally work in the opposite direction, as means of subjection. This article contends that these concerns rely on a misconstruction of the relationship between recognition and subjection as merely contingent. Developing themes from Foucault’s work, it argues that recognition rather always necessarily involves a moment of subjection. In the first part, I (...) show that Foucault, especially in his power-analytic writings, can plausibly be read as theorist of recognition insofar as every relation of power presupposes the recognition of the other as free. In the second part, I elaborate that every concrete relation of power depends on conditions - knowledge and norms - that precede it and that are formed and transformed in complex historical processes, in which the authority of individual subjects is always only a limited one. Against this background, it will become visible that recognition indeed allows us to conduct ourselves autonomously as certain kinds of subjects according to certain norms but as such also always subjects us as it ties our freedom to conditions that we remain largely exposed to. The question of how to define the concept of social power has been a focus of controversy among social theorists. In this paper, I put forward a definition of social power that avoids many of the pitfalls of previous attempts at such a definition. Roughly, I define the power which one agent has over another as the ability that the dominant agent has to control the situation within which the subservient agent acts. Using this basic definition of power, I go (...) on to define many of the central forms in which power actually exists, forms that are conceptualized by such concepts as force, coercion, and influence. I show that these different forms of power can all be understood as specifications of the generic definition of power that I offered and go on to develop an account of how they function in relation to one another in actual relationship of social power. The revival of recognition theory has brought new energy to critical theory. In general terms, recognition theory aims to critically evaluate social structures against a standard of social freedom identified with norms of interaction which are freely recognized by all parties. Until now, attention has primarily focused on the categories and forms of recognition theory. However, the influence of contemporary French theory upon the development of theories of recognition has not yet received the consideration it merits. The book takes up (...) this task. Unruly Practices brings together a series of widely discussed essays in feminism and social theory. Read together, they constitute a sustained critical encounter with leading European and American approaches to social theory. In addition, Nancy Fraser develops a new and original socialist-feminist critical theory that overcomes many of the limitations of current alternatives. Liberty is an expanded edition of Isaiah Berlin's classic of liberalism, Four Essays on Liberty. Berlin's editor Henry Hardy has incorporated a fifth essay, as Berlin wished, and added further pieces on the same topic, so that Berlin's principal statements on liberty are available together for the first time. He also describes the gestation of the book and throws further biographical light on Berlin's preoccupation with liberty in appendices drawn from his unpublished writings.

The author considers the way in which psychic life is generated by the social operation of power, and how that social operation of power is concealed and fortified by the psyche that it produces. Power is no longer understood to be 'internalized' by an existing subject, but the subject is spawned as an ambivalent effect of power, one that is staged through the operation of conscience. To claim that power fabricates the psyche is also to claim that there is a (...) fictional and fabricated quality to the psyche. The figure of a psyche that 'turns against itself' is crucial to this study, and offers an alternative to describing power as 'internalized'. Although most readers of Foucault eschew psychoanalytic theory, and most thinkers of the psyche eschew Foucault, the author seeks to theorize this ambivalent relation between the social and the psychic as one of the most dynamic and difficult effects of power. At the core of republican thought, on Philip Pettit’s account, lies the conception of freedom as non-domination, as opposed to freedom as noninterference in the liberal sense. I revisit the distinction between liberal and republican freedom and argue that republican freedom incorporates a particular rule-of-law requirement, whereas liberal freedom does not. Liberals may also endorse such a requirement, but not as part of their conception of freedom itself. I offer a formal analysis of this rule-of-law requirement and compare liberal and (...) republican freedom on its basis. While I agree with Pettit that republican freedom has broader implications than liberal freedom, I conclude that we face a trade-off between two dimensions of freedom (scope and robustness) and that it is harder for republicans to solve that trade-off than it is for liberals. Contemporary accounts of individual self-formation struggle to articulate a mode of subjectivity not determined by relations of power. In response to this dilemma, Foucault's late lectures on the ancient ethical practices of "fearless speech" (parrhesia) offer a model of ethical self-governance that educates individuals to ethical and political engagement. Rooted in the psychological capacities of curiosity and resolve, such self-governance equips individuals with a "disposition to steadiness" that orients individuals in the face of uncertainty. The practices of parrhesia accomplish this (...) task without fabricating a distinction between internal soul and external body; by creating not a "body of knowledge" but a "body of practices"; and without reference to an external order such as nature, custom, tradition, or religion. The result is an "expressive subject" defined through expressive practices sustained by a simultaneous relationship to herself and to others. In Hobbes, freedom of choice requires nonfrustration: the option you prefer must be accessible. In Berlin, it requires noninterference: every option, preferred or unpreferred, must be accessible—every door must be open. But Berlin’s argument against Hobbes suggests a parallel argument that freedom requires something stronger still: that each option be accessible and that no one have the power to block access; the doors should be open, and there should be no powerful doorkeepers. This article deals with the relationship between the thought of Michel Foucault and that of Axel Honneth, arguing in favour of the former against the latter. I begin by considering Honneth’s early engagement in The Critique of Power with Foucault’s thought. I rebut Honneth’s criticisms of Foucault here as a misreading, one which prevents Honneth from coming to grips with Foucault’s position and hence the challenge that it poses to Honneth’s project.
