In this paper, we analyse how GPS-based navigation systems are transforming some of our intellectual virtues and then suggest two strategies to improve our practices regarding the use of such epistemic tools. We start by outlining the two main approaches in virtue epistemology, namely virtue reliabilism and virtue responsibilism. We then discuss how navigation systems can undermine five epistemic virtues, namely memory, perception, attention, intellectual autonomy, and intellectual carefulness. We end by considering two possible interlinked ways of trying to remedy (...) this situation: [i] redesigning the epistemic tool to improve the epistemic virtues of memory, perception, and attention; and [ii] the cultivation of cognitive diligence for wayfinding tasks scaffolding intellectual autonomy and carefulness. The Molyneux question asks: would a blind person, who knows spheres and cubes only from touch, be able to recognize these shapes visually immediately upon becoming sighted, without touching them? Molyneux himself answered no. Locke accepted Molyneux’s negative answer. But Locke’s answer appears inconsistent with the doctrine of common sensibles, according to which some ideas are given in more than one sense modality. Motivated by alleviating this tension, philosophers have put forth several interpretations of Locke’s views on shape perception. Here (...) I propose an approach to liar and Curry paradoxes inspired by the work of Roger Swyneshed in his treatise on insolubles (1330-1335). The keystone of the account is the idea that liar sentences and their ilk are false (and only false) and that the so-called ''capture'' direction of the T-schema should be restricted. The proposed account retains what I take to be the attractive features of Swyneshed's approach without leading to some worrying consequences Swyneshed accepts. The approach and the resulting (...) logic (called ''Swynish Logic'') are non-classical, but are consistent and compatible with many elements of the classical picture including modus ponens, modus tollens, and double-negation elimination and introduction. It is also compatible with bivalence and contravalence. My approach to these paradoxes is also immune to an important kind of revenge challenge that plagues some of its rivals. (shrink)

Mithilfe der Theorie zur hermeneutischen Ungerechtigkeit von Miranda Fricker und anhand von Beispielen aus dem Alltag wird die Frage gestellt, inwiefern wir unsere privaten Erfahrungen und damit unser Selbst nicht artikulieren können, weil es dafür keine öffentlich geteilten sprachlichen Deutungsmuster gibt, und was wir daran ändern können.

Can there be grounding without necessitation? Can a fact obtain wholly in virtue of metaphysically more fundamental facts, even though there are possible worlds at which the latter facts obtain but not the former? It is an orthodoxy in recent literature about the nature of grounding, and in first-order philosophical disputes about what grounds what, that the answer is no. I will argue that the correct answer is yes. I present two novel arguments against grounding necessitarianism, and show that grounding (...) contingentism is fully compatible with the various explanatory roles that grounding is widely thought to play. The willful ignorance doctrine says defendants should sometimes be treated as if they know what they don't. This book provides a careful defense of this method of imputing mental states. Though the doctrine is only partly justified and requires reform, it also demonstrates that the criminal law needs more legal fictions of this kind. The resulting theory of when and why the criminal law can pretend we know what we don't has far-reaching implications for legal practice and reveals a pressing (...) need for change. (shrink)

It is commonly held that retraction data, if they exist, show that assessment relativism is preferable to non-indexical contextualism. I argue that this is not the case. Whether retraction data have the suggested probative force depends on substantive questions about the proper treatment of tense and location. One’s preferred account in these domains should determine whether one accepts assessment relativism or non-indexical contextualism.

Dieser Beitrag setzt sich mit der unterrichtspraktischen Frage nach der Einführung und Vertiefung von Begriffsverständnissen im Philosophie- und Ethikunterricht aus- einander. Als Ausgangspunkt dient dazu Sistermanns Bonbonmodell. Es wird dafür argumentiert, dass dieses Modell sowie die Leitidee der Problemorientierung erweitert werden sollten, so man dem Anspruch einer Vermittlung tiefgehender Begriffsverständnisse gerecht werden will. Um eine solche Erweiterung vorzuschlagen, werden erstens ein lernproduktorientiertes Lehr-Lern-Modell aus der Physikdidaktik und zweitens lernpsychologische Grundlagen, die als Darstellungsebenenwechsel in der Mathematikdidaktik Anwendung finden, hinzugezogen.

Elselijn Kingma argues that, in cases of mammalian placental pregnancy, the foster (roughly, the post-implantation embryo/foetus) is part of the gravida (the pregnant organism). But she does not consider the possibility of proper overlap. I show that this generates a number of serious problems for her argument and trace the oversight to a quite general issue within the literature on biological individuality. Doing so provides an opportunity to pull apart and clarify the relations between some importantly distinct questions concerning organismality (...) and organismic parthood, and to identify the implications that this has for those who want to draw on this literature when making metaphysical or mereological arguments. Does natural science give us reason to believe that mathematical statements are true? And does natural science give us reason to believe in some particular metaphysics of mathematics? These two questions should be firmly distinguished. My argument in this chapter is that a negative answer to the second question is compatible with an affirmative answer to the first. Loosely put, even if science settles the truth of mathematics, it does not settle its metaphysics.

In the history of philosophy, the distinction between positive and negative predication has been collapsed. The collapse has caused us to search for a way through Parmenides’ gate: we have constructed scaffolding to see over its boundaries. Kant gave us the distinction between conceptual and non-conceptual knowledge; Hegel gave us determinate negation; Frege gave us the negation stroke; Husserl gave us bracketing and disappointment; G. Spencer-Brown gave us a calculus of distinction. Despite this, we find ourselves—alongside Wittgenstein— wondering how it (...) can be the case that we are able to think what is not the case. We are puzzled by the fact that we can think nothing without the thought lacking content. I suggest that this confusion is unnecessary. Throughout this work, I exercise the thought that the distinction between positive and negative predication is mistaken. I rather suggest that to think what is or is not the case necessarily depends upon an exemplar distinction that is experientially recognized and learned in the world. All the same, our capacity to understand natural distinction likewise depends upon our practical and pervasively conceptual capacities to express it in language. I conclude by suggesting that what makes positive and negative predication distinct is a fundamental unity in conceptual form through its capacity to play distinct functional roles in linguistic practice. Can an AGI create a more intelligent AGI? Under idealized assumptions, for a certain theoretical type of intelligence, our answer is: “Not without outside help”. This is a paper on the mathematical structure of AGI populations when parent AGIs create child AGIs. We argue that such populations satisfy a certain biological law. Motivated by observations of sexual reproduction in seemingly-asexual species, the Knight-Darwin Law states that it is impossible for one organism to asexually produce another, which asexually produces another, and (...) so on forever: that any sequence of organisms (each one a child of the previous) must contain occasional multi-parent organisms, or must terminate. By proving that a certain measure (arguably an intelligence measure) decreases when an idealized parent AGI single-handedly creates a child AGI, we argue that a similar Law holds for AGIs. (shrink)

A common objection to the very idea of conceptual engineering is the topic continuity problem: whenever one tries to “reengineer” a concept, one only shifts attention away from one concept to another. Put differently, there is no such thing as conceptual revision: there’s only conceptual replacement. Here, I show that topic continuity is compatible with conceptual replacement. Whether the topic is preserved in an act of conceptual replacement simply depends on what is being replaced (a conceptual tool or a conceptual (...) role) and what the topic under discussion is. Thus, the topic continuity problem only arises from a failure to specify these two things. (shrink)

Contrary to the popular assumption that linguistically mediated social practices constitute the normativity of action (Kiverstein and Rietveld, 2015; Rietveld, 2008a,b; Rietveld and Kiverstein, 2014), I argue that it is affective care for oneself and others that primarily constitutes this kind of normativity. I argue for my claim in two steps. First, using the method of cases I demonstrate that care accounts for the normativity of action, whereas social practices do not. Second, I show that a social practice account of (...) the normativity of action has unwillingly authoritarian consequences in the sense that humans act only normatively if they follow social rules. I suggest that these authoritarian consequences are the result of an uncritical phenomenology of action and the fuzzy use of “normative”. Accounting for the normativity of action with care entails a realistic picture of the struggle between what one cares for and often repressive social rules. (shrink)

In 1937 Joan Robinson proposed that “when capitalism is rightly understood, the rate of interest will be set at zero and the major evils of capitalism will disappear”. A permanent zero rate would abolish capitalist profit except in limited cases, leaving nearly all output to be claimed by labour as wages. It would allow capital to be allocated on the basis of prospective social benefit rather than short-term profitability and a collateral basis that favours the wealthy. It would remove some (...) of the economic pressure to use resources unsustainably. So why not do this? I argue that the few available philosophical arguments for positive interest rates are unsatisfactory. Those who want a just and sustainable form of capitalism should target net zero for the interest rate. (shrink)

This paper argues that higher-order doubt generates an epistemic dilemma. One has a higher-order doubt with regards to P insofar as one justifiably withholds belief as to what attitude towards P is justified. That is, one justifiably withholds belief as to whether one is justified in believing, disbelieving, or withholding belief in P. Using the resources provided by Richard Feldman’s recent discussion of how to respect one’s evidence, I argue that if one has a higher-order doubt with regards to P, (...) then one is not justified in having any attitude towards P. Otherwise put: No attitude towards the doubted proposition respects one’s higher-order doubt. I argue that the most promising response to this problem is to hold that when one has a higher-order doubt about P, the best one can do to respect such a doubt is to simply have no attitude towards P. Higher-order doubt is thus much more rationally corrosive than non-higher-order doubt, as it undermines the possibility of justifiably having any attitude towards the doubted proposition. (shrink)

The late tenth century siddha and scholar Ratnākaraśānti, also known as the Mahāsiddha Śāntipa, was renowned as the author of both philosophical śāstras and commentaries on tantra. Typically, these are considered separate spheres of activity. However, Ratnākaraśānti’s approach, building on the tradition of scholarship associated with the Mahāvairocanābhisaṃbodhitantra and the Guhyasamājatantra, as well as on Yogācāra analysis and Buddhist pramāṇa theory, is highly syncretic. This paper is a study of Ratnākaraśānti’s commentaries that highlights his synthesis of the exoteric and esoteric (...) streams of Buddhist discourse, with particular emphasis on the nondual nature of reflexive awareness (svasaṃvitti, rang rig), or 'luminosity' (prakāśa, gsal ba), which serves as the conceptual bridge between sūtra and tantra. Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. Discussion of the relevance of grounding to substantiveness, theory-choice, and “location problems” in metaphysics.

Why has modern American conservatism committed itself to gender binaries? Examining why this new categorizing unsettles conservatives (and how they have reacted against teacher unions and transgender influencers), this paper turns to Nietzschean analysis. It finds that the unsettling of heteronormative gender norms resulted in a pivot by conservatism to perpetuate a new gender identity politics in which nonbinary and especially transgender people are scapegoated. Imagining a nihilistic interpretation of gender, conservatives have made “transgender” a signifier of amorality and barbarism, (...) envisioning themselves as warriors of normalcy. Conservative activists have named their frontier “radical gender ideology” while contesting the legitimacy of diagnosed gender dysphoria, revising its pathology, and alleging clinical gender transitioning is a financial ploy. As a result, bodies have become sites of contestation between doctors, trans activists, and groups that advocate against gender-affirming care. This paper traces the conservative movement from resentment to opposition on three fronts – pathology, pronouns, and restrooms. (shrink)

In this paper, we consider two different attempts to make an end run around the experimentalist challenge to the armchair use of intuitions: one due to Max Deutsch and Herman Cappelen, contending that philosophers do not appeal to intuitions, but rather to arguments, in canonical philosophical texts; the other due to Joshua Knobe, arguing that intuitions are so stable that there is in fact no empirical basis for the experimentalist challenge in the first place. We show that a closer attention (...) to philosophical practices reveal, in turn, that we cannot make sense of these philosophical texts as arguments all the way down; and that our methods are so sensitive to error that even a modest amount of instability is enough to raise deep methodological concerns. We have begun work on two separate but related ontologies for the study of neurological diseases. The first, the Neurological Disease Ontology (ND), is intended to provide a set of controlled, logically connected classes to describe the range of neurological diseases and their associated signs and symptoms, assessments, diagnoses, and interventions that are encountered in the course of clinical practice. ND is built as an extension of the Ontology for General Medical Sciences — a high-level candidate OBO Foundry ontology that (...) provides a set of general classes that can be used to describe general aspects of medical science. ND is being built with classes utilizing both textual and axiomatized definitions that describe and formalize the relations between instances of other classes within the ontology itself as well as to external ontologies such as the Gene Ontology, Cell Ontology, Protein Ontology, and Chemical Entities of Biological Interest. In addition, references to similar or associated terms in external ontologies, vocabularies and terminologies are included when possible. Initial work on ND is focused on the areas of Alzheimer’s and other diseases associated with dementia, multiple sclerosis, and stroke and cerebrovascular disease. Extensions to additional groups of neurological diseases are planned. The second ontology, the Neuro-Psychological Testing Ontology (NPT), is intended to provide a set of classes for the annotation of neuropsychological testing data. The intention of this ontology is to allow for the integration of results from a variety of neuropsychological tests that assay similar measures of cognitive functioning. Neuro-psychological testing is an important component in developing the clinical picture used in the diagnosis of patients with a range of neurological diseases, such as Alzheimer’s disease and multiple sclerosis, and following stroke or traumatic brain injury. NPT is being developed as an extension to the Ontology for Biomedical Investigations. (shrink)

Verteilungsgerechtigkeit befasst sich mit der Verteilung von Gütern innerhalb einer Gruppe, wobei verschiedene Verteilungsprinzipien und -ergebnisse als mögliche Ideale einer solchen Verteilung verhandelt werden. Diese normativen Ansätze sind oft rein verbal formuliert, wodurch ihre Anwendung auf unterschiedliche konkrete Verteilungssituationen, die hinsichtlich ihrer Gerechtigkeit beurteilt werden sollen, häufig schwer fällt. Eine Möglichkeit, fein abgestufte Gerechtigkeitsbeurteilungen verschiedener Verteilungen präzise erfassen zu können, besteht in der formalen Modellierung solcher Ideale durch Maße oder Indizes. Die Auswahl eines geeigneten Maßes, das ein gewisses Ideal abbilden (...) soll, muss ihrerseits eine Fundierung erfahren, was durch die Forderung von begründeten Axiomen erreicht werden kann, denen ein Maß genügen soll. In der vorliegenden Arbeit werden solche Axiome für Maße der Verteilungsgerechtigkeit am Beispiel von Bedarfsgerechtigkeit eingeführt. Ferner werden exemplarische Maße der Bedarfsgerechtigkeit vorgestellt. Damit wird für die Beurteilung und Modellierung von Maßen der Verteilungsgerechtigkeit eine erste diskutable Grundlage gelegt. Our paper examines Gloria Anzaldúa’s critical appropriation of Mexican philosophical sources, especially in the writing of Borderlands/La Frontera. We demonstrate how Anzaldúa developed a transnational Philosophy of Mexicanness, effectively contributing to what has been recently characterized as the “multi-generational project to pursue philosophy from and about Mexican circumstances” (Vargas). More specifically, we recover “La Mexicana en la Chicana” by paying careful attention to Anzaldúa’s Mexican sources, both those she explicitly cites and those we have discovered while conducting archival research using (...) the Gloria Evangelina Anzaldúa Papers from the Benson Latin American Collection at the University of Texas at Austin. The three sections of our paper: 1) define the terms Mexican and philosophy in conversation with Anzaldúa’s work, 2) examine the Mexican philosophical sources that Anzaldúa cites in Borderlands/La Frontera, and 3) present the other major Mexican philosophical influences on Anzaldúa that we have found in her archive. The eight Mexican philosophical sources we discuss here include: José Vasconcelos (1882-1959), Miguel León-Portilla (1926-2019), Juana Armanda Alegría (1938- ), Octavio Paz (1914-1998), Samuel Ramos (1897-1959), Rosario Castellanos (1925-1974), Sor Juana Inés de La Cruz (1648-1695), and Jorge Carrión (1913-2005). Dieses Buch bietet eine grundlegende Einführung in die wichtigsten Aspekte der Vermittlung und des Erwerbs von mathematischer Modellierungskompetenz im Schulkontext. In den letzten Jahren hat sich unter anderem anhand der Covid-19 Pandemie mehr denn je gezeigt, wie Mathematik im Allgemeinen und das mathematische Modellieren im Speziellen zum Verständnis globaler Herausforderungen und Möglichkeiten zu ihrer Bewältigung beiträgt. Deshalb sollte die mathematische Modellierungskompetenz eine zentrale Rolle im Schulunterricht spielen. Dies kann auch zur Vermittlung eines ganzheitlichen Bildes der Mathematik beitragen. Doch der Prozess (...) von Vermittlung und Erwerb einer solchen Kompetenz ist komplex und mit vielfältigen Schwierigkeiten verbunden. Angesichts dieser Ausgangslage fasst das Buch Geschichte und Definition der Modellierungskompetenz im Mathematikunterricht zusammen, stellt die damit verbundenen Ziele und Perspektiven dar, veranschaulicht theoretische Hintergrundüberlegungen, stellt Modellierungsaufgaben und passende Lernumgebungen vor und weist auf notwendige Teilkompetenzen und mögliche Hindernisse beim Erwerb von Modellierungskompetenz hin. Letztendlich wird damit auch der Anspruch der Vermittlung eines ganzheitlichen Bildes der Mathematik im Schulunterricht angesprochen. Fine is widely thought to have refuted the simple modal account of essence, which takes the essential properties of a thing to be those it cannot exist without exemplifying. Yet, a number of philosophers have suggested resuscitating the simple modal account by appealing to distinctions akin to the distinction Lewis draws between sparse and abundant properties, treating only those in the former class as candidates for essentiality. I argue that ‘sparse modalism’ succumbs to counterexamples similar to those originally posed by (...) Fine, and fails to capture paradigmatic instances of essence involving abundant properties and relations. (shrink)

We provide an intuitive motivation for the hyperreal numbers via electoral axioms. We do so in the form of a Socratic dialogue, in which Protagoras suggests replacing big-oh complexity classes by real numbers, and Socrates asks some troubling questions about what would happen if one tried to do that. The dialogue is followed by an appendix containing additional commentary and a more formal proof.

The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

This dissertation examines the theory of perceptual cognition laid out by the 7th century Buddhist scholar, Dharmakīrti, in his magnum opus, the Pramāṇavārttika. Like most theories of perception, both ancient and modern, the sensory cognition of ordinary objects is a topic of primary concern. Unlike other theorists, however, Dharmakīrti advances a technical definition of “perception” as a cognition which is both nonconceptual and non-erroneous. Dharmakīrti’s definition of perception is thereby deliberately inclusive of three additional types of “perceptual” cognition, in addition (...) to veridical sensory awareness: the nonconceptual mental apprehension of an immediately-preceding cognition (“mental perception”), the vivid appearance of soteriologically efficacious objects of contemplative practice (“yogic perception”), and the sheer unmediated presence of the contents of cognition—whatever these might be—to the cognizing mind (“reflexive awareness”). Through the logical examination of what it means to be aware of an object, Dharmakīrti demonstrates that the awareness of an object is just the awareness of a phenomenal form or cognitive image produced by that object. Pursuing this analysis further, however, Dharmakīrti argues that the very notion of an object of cognition that exists “externally” or outside the mind is incoherent. Additionally, Dharmakīrti maintains that the phenomenological structure of subject and object—that is, the “first-personal” sense of one’s own cognitions as pertaining to oneself (“for-me-ness”), together with the inseparably concomitant sense that the objects of cognition exist “out there” in an extramental world—is strictly a form of cognitive error. Therefore, because ordinary sensory cognition is inherently structured by this subject-object duality, ordinary sensory cognition must in the final analysis be understood as erroneous. According to Dharmakīrti, in other words, ultimately only the nondual “luminosity” of reflexive awareness is genuinely perceptual, because only reflexive awareness is undistorted by nature. In this way, Dharmakīrti’s epistemology provides a theoretical foundation for the advanced nondual contemplative practices of Indian and Tibetan Buddhism, particularly Mahāmudrā and rDzogs chen. Anscombe claims that whenever a subject is doing something intentionally, this subject knows that they are doing it. This essay defends Anscombe's claim from an influential set of counterexamples, due to Davidson. It argues that Davidson's counterexamples are tacit appeals to an argument, on which knowledge can't be essential to doing something intentionally, because some things that can be done intentionally require knowledge of future successes, and because such knowledge can't ever be guaranteed when someone is doing something intentionally. This essay suggests that the U.S.-American Pragmatist tradition could be fruitfully reconstructed by way of a dialogue with Latin American Liberation Philosophy. More specifically, I work to establish a common ground for future comparative work by: 1) gathering and interpreting Enrique Dussel’s scattered comments on Pragmatism, 2) showing how the concept of liberation already functions in John Dewey’s Pragmatism, and 3) suggesting reasons for further developing this inter-American philosophical dialogue and debate.

ABSTRACT It has become standard to conceive of metalinguistic disagreement as motivated by a form of negotiation, aimed at reaching consensus because of the practical consequences of using a word with one content rather than another. This paper presents an alternative motive for expressing and pursuing metalinguistic disagreement. In using words with given criteria, we betray our location amongst social categories or groups. Because of this, metalinguistic disagreement can be used as a stage upon which to perform a social identity. (...) The ways in which metalinguistic disagreements motivated in this way diverge in character from metalinguistic negotiations are described, as are several consequences of the existence of metalinguistic disagreements motivated in this way. Otto Neurath’s empiricist methodology of economics and his contributions to politi- cal economy have gained increasing attention in recent years. We connect this research with contemporary debates regarding the epistemological status of thought experiments by reconstructing Neurath’s utopias as linchpins of thought experiments. In our three reconstructed examples of different uses of utopias/dystopias in thought experiments we employ a reformulation of Häggqvist’s model for thought experiments and we argue that: (1) Our reformulation of Häggqvist’s model more adequately complies with many (...) uses of thought experiments, especially with the open-ended discussions of utopias and dys- topias in thought experiments. (2) As a strict logical empiricist, Neurath is committed to a strictly empiricist account of thought experiments. John Norton’s empiricist argument view can indeed account for the justifications of empirical beliefs and genuine discoveries targeted by scientific utopianism in three distinct (yet connected) ways, all of which Neur- ath already contemplated: (2.I) Dealing with utopias and thought experiments on a regular basis increases creativity and inventiveness. (2.II) Particular ways of presenting knowl- edge facilitate scientific discovery and social progress. We con- clude by highlighting that, even though thought experiments support a positive attitude for exploring new social possibilities, Neurath points out that active decisions are unavoidable. Dabei sind historisch verschiedenste Positionen verhandelt worden. Es soll nicht versucht werden, eine Antwort auf die Frage nach der Möglichkeit zu liefern; vielmehr sollen methodische Überlegungen zur Klärung der Frage in den Fokus gerückt werden. Es wird gezeigt, dass die eigentliche Frage präzisierungsbedürftig ist. Exemplarisch wird ein ausgewählter Präzisierungsversuch aus dem zeitgenössischen Diskurs kritisch beleuchtet und ihm wird ein (...) Verständnis der Frage entgegengesetzt, das die Diskussion um die Möglichkeit eines doxastischen Voluntarismus in einen neuen Rahmen einbetten kann. (shrink)

Friedrich Stadler und sein Team schließen über 40 Jahre nach Präsentation der ersten beiden Bände das von Rudolf Haller initiierte Projekt einer umfassenden Werkschau Otto Neuraths (1882–1945) ab. In acht Bänden wird auf fast 5.000 Seiten das Schaffen eines Polyhistors dokumentiert und zugänglich gemacht, dessen intellektueller Spannweite man nicht einmal gerecht wird, wenn man ihn als Philosophen, Nationalökonomen, Gesellschaftstechniker und Aufklärer bezeichnet.

Plausibly, one important part of a good life is doing work that makes a contribution, or a positive difference to the world. In this paper, however, I explore contribution pessimism, the view that people will not always have adequate opportunities for making contributions. I distinguish between three interestingly different and at least initially plausible reasons why this view might be true: in slogan form, things might become too easy, they might become too good, or we might be too late. Now, (...) one response to these problems might be to deliberately attempt to undo them. However, I claim that this solution is intuitively misguided, and argue that explaining this supports a holistic approach to the value of contributions. Finally, I argue that if contribution pessimism is correct, it could provide an explanation of some widely held intuitions about issues in population ethics, with implications about the practical issue of how much priority we should give to addressing risks of human extinction. The legal reasons that bind a judge and the moral reasons that bind all persons can sometimes pull in different directions. There is perhaps no starker example of such judicial dilemmas than in criminal sentencing. Particularly where mandatory minimum sentences are triggered, a judge can be forced to impose sentences that even the judge regards as “immensely cruel, if not barbaric.” Beyond those directly harmed by overly harsh laws, some courts have recognized that “judges who, forced to participate in such (...) inhumane acts, suffer a loss of dignity and humanity as well.” When faced with such a judicial dilemma—a powerful tension between the judge’s legal and moral reasons—the primary question is what a judge can do to resolve it. We argue that the two standard responses—sacrificing morality to respect the law (“legalism”), or sacrificing the law to respect morality (“moralism”)—are unsatisfying. Instead, this Article defends an underexplored third response: rather than abandoning one ideal to maximally promote the other, we argue that judges should seek to at least minimally satisfy the demands of both. Judges should, in other words, look for and employ what we dub Satisficing Options. These are actions that enjoy sufficient support from both the legal reasons and the moral reasons, and thus are both legally and morally permissible—even if the acts in question would not strictly count as optimal by the lights of the law or morality. This common sensical response to the problem is not only underappreciated in the literature, but also has great practical import. Focusing on the sentencing context, this Article demonstrates that judicial dilemmas can be systematically resolved, mitigated or avoided through a range of concrete strategies that on their own or in conjunction can constitute Satisficing Options: these strategies include seeking out legally permitted but morally preferable interpretations of the law, expressing condemnation of unjust laws in dicta, and seeking assistance or cooperation from other actors to help defendants facing substantively unjust mandatory sentences. While these strategies can at times also go too far, we argue that in certain contexts they can be sufficiently defensible on both legal and moral grounds to be a justifiable response to judicial dilemmas. This Article thus provides both a novel theoretical framework for understanding the justification of judicial responses to unjust laws, as well as a practical a menu of options which judges can use to guide their responses to the judicial dilemmas that they are increasingly likely to encounter within our criminal justice system. Kant’s claim that we must postulate the immortality of the soul is polarizing. While much attention has been paid to two standard arguments in its defense (one moral-psychological, the other rational), I contend that a favorite argument of Kant’s from the apogee of his critical period, namely, the teleological argument, deserves renewed attention. This paper reconstructs it and exhibits what makes it unique (though not necessarily superior) in relation to the other arguments. In particular, its form (as third-personal or descriptive, (...) beginning from observations) and related force of assent (as a subjectively universal reflective judgment) set it apart from the other arguments. My goal is to establish that any engagement with Kant’s immortality postulate must include equal consideration of the teleological argument in order to be complete. (shrink)

The aim of this article is to give students a small sense of what metamathematics is—that is, how one might use mathematics to study mathematics itself. School or college teachers could base a classroom exercise on the letter games I shall describe and use them as a springboard for further exploration. Since I shall presuppose no knowledge of formal logic, the games are less an introduction to Gödel's theorems than an introduction to an introduction to them. Nevertheless, they show, in (...) an accessible way, how metamathematics can be mathematically interesting. (shrink)

A number of bioethicists have been critical of the power of the family to “veto” a patient’s decision to posthumously donate her organs within opt-in systems of organ procurement. One major objection directed at the family veto is that when families veto the decision of their deceased family member, they do something wrong by violating or failing to respect the autonomy of that deceased family member. The goal of this paper is to make progress on answering this objection. I do (...) this in two stages. First, I argue that the most plausible interpretation of what happens when a person registers as an organ donor in an opt-in system is that she gives her consent to the state to posthumously remove her organs for transplantation purposes. Call this the Authorization Account. Second, given the Authorization Account, I argue by analogy that when families veto an individual’s decision to donate and the individual’s organs are not in the end removed, neither the doctors nor the family violate the individual’s autonomy in any morally objectionable sense. Call this the Nonremoval Thesis. I argue that since the Nonremoval Thesis is true, we do not violate or fail to respect the autonomy of registered donors when we fail to remove their organs because their family has objected. Inductive logic would be the logic of arguments that are not valid, but nevertheless justify belief in something like the way in which valid arguments would. Maybe we could describe it as the logic of “almost valid” arguments. There is a sort of transitivity to valid arguments. Valid arguments can be chained together to form arguments and such arguments are themselves valid. One wants to distinguish the “almost valid” arguments by noting that chains of “almost valid” arguments are weaker than (...) the links that form them. But it is not clear that this is so. I have an apparent counterexample the claim. Though: as is typical in these sorts of situations, it is hard to tell where the problem lies. (shrink)
