The conventional wisdom regarding the aims and shortcomings of Kantian constructivism is mistaken. The aim of metaethical constructivism is not to provide a naturalistic account of the objectivity of normative facts by deriving substantive morality from a conception of agency so thin as to be uncontroversial (a task at which it is generally regarded to have failed). Its aim is to explain the “grip” that normative facts have on us—to avoid what I call the problem of normative alienation. So understood, (...) Kantian constructivism faces two problems: that determinate normative facts cannot be derived from agency and that its individualistic conception of agency cannot account for the sociality of morality. I propose and elaborate a social conception of agency that is better able to address the latter problem while still avoiding normative alienation, and evaluate two different strategies for responding to the former problem. I argue that No-Ought-From-Is (in the sense that I believe it) is a relatively trivial affair. Of course, when people try to derive substantive or non-vacuous moral conclusions from non-moral premises, they are making a mistake. But No-Non-Vacuous-Ought-From-Is is meta-ethically inert. It tells us nothing about the nature of the moral concepts. It neither refutes naturalism nor supports non-cognitivism. And this is not very surprising since it is merely an instance of an updated version of the conservativeness of logic (in (...) a logically valid inference you don’t get out what you haven’t put in): so long as the expressions F are non-logical, you cannot get non-vacuous F-conclusions from non-F premises. However, the triviality of No-Non-Vacuous-Ought-From-Is is important and its non-profundity profound. No-Ought-From-Is is widely supposed to tell us something significant about the nature of the moral concepts. If, in fact, it tells us nothing, this is a point well worth shouting from the housetops. This brings me to my dispute with Gerhard Schurz who has proved a related version of No-Ought-From-Is, No-Ought-Relevant-Ought-From-Is, a proof which relaxes my assumption that ‘ought’ should not be treated as a logical constant. But if ought is not a logical expression then it does not really matter much that No-Ought-From-Is would be salvageable even if it were. Furthermore, Schurz’s proof depends on special features of the moral concepts and this might afford the basis for an abductive argument to something like non-cognitivism. As an error theorist, and therefore a cognitivist, I object. Finally I take a dim view of deontic logic. Many of its leading principles are false, bordering on the nonsensical, and even the reasonably plausible ones are subject to devastating counter-examples. (shrink)

This is a response to Stephen Maitzen’s paper. ‘Moral Conclusions from Nonmoral Premises’. Maitzen thinks that No-Ought-From-Is is false. He does not dispute the formal proofs of Schurz and myself, but he thinks they are beside the point. For what the proponents of No-Ought-From-Is need to show is not that you cannot get SUBSTANTIVELY moral conclusions from FORMALLY non-moral premises but that you cannot get SUBSTANTIVELY moral conclusions from SUBSTANTIVELY non-moral premises. And he believes that he can derive substantively moral (...) conclusions from FORMALLY moral but SUBSTANTIVELY nonmoral premises. However his argument relies on what I call ‘taxonomic essentialism’, the thesis that sentences do not change their semantic characters from context to context or from world to world. In particular, they do not change their META-ETHICAL status from context to context or world to world. If a sentence is non-moral at one world it is non-moral at all the rest. This thesis leads to contradictions (with some propositions as both moral and non-moral) and even if (as is perhaps possible) these contradictions can be avoided, it leads to further consequences that are palpably absurd. Thus It may be possible to derive substantively moral conclusions from premises that are not substantively moral, but if it is, Maitzen has failed to prove the point. (shrink)

The project of “public reason” claims to offer an epistemological resolution to the civic dilemma created by the clash of incompatible options for the rational exercise of freedom adopted by citizens in a diverse community. The present Article proposes, via consideration of a contrast between two classical accounts of dialectical reasoning, that the employment of “public reason,” in substantive due process analysis, is unworkable in theory and contrary to more reflective Supreme Court precedent. Although logical commonalities might be available to (...) pick out from the multitude of particularized accounts of what constitutes “civic order,” no “public reason” so derived could adequately capture - and thus be able to secure in a practical sense - any single determinate civic order, much less one that would be consistent with all citizens' conceptions of public order. Part I of this Article raises a number of issues for consideration relating to the epistemology of law and focuses especially on the concept of public reason and its critique. Part II addresses alternative approaches to legal reasoning suggested by classical accounts of practical reasoning and virtue theory and considers the operation of such legal analysis outside the area of substantive due process; Part III analyzes post-Lawrence case law confirming the dilemma created by the Supreme Court's ambiguous approaches to substantive due process and concludes that only one interpretation - that articulated fully in Washington v. The paper argues that the assumption that there are property designators, together with two theoretically innocent claims, leads to a puzzle, whose solution requires us to reject the position that all (canonical) property designators are rigid. But if we deny that all (canonical) property designators are rigid, then the natural next step is to reject an abundant conception of properties and with it the suggestion that properties are the semantic values of predicates.

Hume seems to contend that you can’t get an ought from an is. Searle professed to prove otherwise, deriving a conclusion about obligations from a premise about promises. Since (as Schurz and I have shown) you can’t derive a substantive ought from an is by logic alone, Searle is best construed as claiming that there are analytic bridge principles linking premises about promises to conclusions about obligations. But we can no more derive a moral obligation to pay up from the (...) fact that a promise has been made than we can derive a duty to fight a duel from the fact that a challenge has been issued – just conclusions about what we ought to do according to the rules of the relevant games. Hume suggests bridge principles that would take us from the rules of the games to conclusions about duties, but these principles are false. This article derives from data collected over a six-month period between February and August 2022. Its sampling pertains to members of two general Twitter Lists of philosophy professionals: “Philosophers on Twitter”, limited to a maximum of 4500 active accounts, and “Philosophers”, restricted to accounts surpassing 1000 followers and currently including over 1,100 individuals. The totality of members of these two Lists is referenced in this article as “Philosophy Twitter”. -/- Data was collected in five principal ways from members of these (...) two Lists: 1) Monitoring the List streams, 2) addressing members, including following, retweeting, liking, endorsing, asking, commenting, and replying, 3) probing members’ Twitter activities in their Profiles (“Tweets & replies”), 4) reviewing members’ Twitter Bios, CVs, professional profiles, and websites, and 5) network analysis of members’ quantitative and qualitative association and interaction profiles. -/- The study of this material aimed at revealing interpersonal social structures and processes of philosophy professionals by their Twitter conduct. Its personal purview focused on creators, teachers, researchers, and students and thus excepted schools, colleges, universities, formal associations, and publishers. This paper examines an argument by Schaffer (2017) that aims to prove how, contrary to what many philosophers hold, there is no special explanatory gap occurring in the connection between the physical and the phenomenal. This is because a gap of the same kind can be found in every connection between a more fundamental and a less fundamental level of reality. These gaps lurk everywhere in nature. For Schaffer, they can be bridged by means of substantive metaphysical principles such as (...) grounding principles. He thus puts forward a version of grounding-based physicalism, which is supposed to provide this kind of substantive bridge principle. My main contention is as follows: even if Schaffer’s argument indeed proves the existence of a gap in every connection between fundamental and derivative entities, and such gaps can be bridged by means of grounding principles, a different gap remains open in the psycho-physical connection. True Darwinian Ethics -/- Darwin’s model for the evolution of morality as presented in Descent of Man (1871) is shown to comprise three major stages that are here referred to as empathic premorality, tribal morality, and universalizing morality. Empathy, the key component of Darwin’s “social instincts” that started moral evolution, is here recognized as the principal cognitive device that conveys epistemic credibility to moral agency. The two constitutive elements of the tribal morality are conscience that Darwin conceived of as a (...) conflict between a lasting social motive and an immediate selfish impulse, and true altruism that evolved as a result of group (community) selection. Darwin’s genius recognized the uniqueness of group selection in human evolution as being dependent on mental faculties and speech that facilitated habit formation through praise and blame form other group members, with empathy as a gauge of others’ emotional reactions. Contrary to repeated claims, Darwin did not derive morality from reciprocity that he (and his contemporaries) considered to be “a low motive”, and adduced it only as a mechanism of habit formation. The universalizing morality was brought about by the increasing powers of intellect that led to respecting individual lives (rather than group interests only) and extending humane concerns beyond one’s group, ultimately to all sentient beings, which places Darwin among the spiritual fathers of modern humanitarianism. In terms of substantive ethics, Darwin’s views support moral individualism that requires to treat each subject according to his/her individual characteristics rather than any group membership. Darwin’s moral individualism and universalism have been elaborated by Peter Singer as the principle of equal consideration of interests and the expanding circle of ethics, respectively. Darwin’s model of moral evolution, which starts with intuitive but epistemically reliable moral agency and then allows for its rational improvement, provides a way out of the moral subjectivism of evolutionary ethics that reduces morality to an adaptation to social life. The primary or core morality that relies on empathy and implements reciprocity supports welfare (wellbeing) of a group and its members. Welfare (which has been defined by Darwin) is a basic “terminal” (ultimate) value that constitutes an objective, measurable fact. Since the primary morality supports welfare, it is objectively good, which justifies an ethical reasoning that such morality ought to be extended (with appropriate adjustments) to all sentient beings. Confusion over the status of morality is largely due to the lack of appreciation of its complexity: not only had its motivational apparatus (known as the moral agency) evolved by superposition of many emotional and pure cognitive mechanisms, but it has subsequently been co-opted to implement prudential, religious and possibly other norms that are accidental and sometimes contrary to its original social function. Those secondary morality norms are now enforced by the moral agency but lack moral objectivity and thus may support the perception of moral subjectivism and relativism. In short, true Darwinian ethics is based on the scientific axiology that recognizes evolutionary origins of all values, requires respecting all values that are experienced by each and every subject according to its individual characteristics, and calls for a critical assessment of each and every received morality. Many have claimed that legitimate constitutional democracy is either conceptually or practically impossible, given infinite regress paradoxes deriving from the requirement of simultaneously democratic and constitutional origins for legitimate government. This paper first critically investigates prominent conceptual and practical bootstrapping objections advanced by Barnett and Michelman. It then argues that the real conceptual root of such bootstrapping objections is not any specific substantive account of legitimacy makers, such as consent or democratic endorsement, but a particular conception of the logic of (...) normative standards—the determinate threshold conception—that the critic attributes to the putatively undermined account of legitimacy. The paper further claims that when we abandon threshold conceptions of the logic of legitimacy in favor of regulative-ideal conceptions, then the objections, from bootstrapping paradoxes to the very idea of constitutional democracy, disappear. It concludes with considerations in favor of adopting a more demanding conception of the regulative ideal of constitutional democracy, advanced by Habermas, focusing on potentials for developmental learning. I focus on D A Masolo’s discussion of morality as characteristically understood by African philosophers. My goals are both historical and substantive, meaning that I use reflection on Masolo’s book as an occasion to shed light not only on the nature of recent debates about African ethics, but also on African ethics itself. With regard to history, I argue that Masolo’s discussion of sub-Saharan morality suggests at least two major ways that the field has construed it, depending on which value (...) is taken to be basic and which ones are deemed derivative. According to one perspective, the ultimate aim of a moral agent should be to improve people’s quality of life, which she can reliably do by supporting community in certain ways, while the other view is that community should instead be valued for its own sake, with the enhancement of welfare being morally relevant only insofar as it is part of that. I claim that Masolo does not indicate a clear awareness of how these two perspectives differ and is not explicit about how they relate to one another. After pointing out that Masolo is not alone in these respects, I draw what is meant to be a definitive, clear distinction between the two major ethical philosophies. Then, I provide what I deem to be conclusive reason to prefer the community- based conception of sub-Saharan ethics to the welfare-based one. (shrink)

The traditional proof of prescriptive moral relativism: the argument from variability: Judgments, rules, and shared values are de facto variable in time and space. The traditional counter-proof: examples of variability do not prove what skeptics contend. -/- 3. Agriculture does not follow stock-raising); b) racial characters have no relevance in development of civilization; c) we are not yet in a position to compare externally identical kinds of behaviour till we have not yet understood beliefs and intentions laying at their roots (for ex.: “From an ethnological point of view murder cannot be considered as a single phenomenon”; d) we should distinguish among different practices which are only superficially similar (fro ex. practices traditionally classified under the label “tabù”); e) there is as a fact just one normative ethic, constant in its contents but varying in its extension; f) the implication is not that we cannot judge behavior by members of other groups; it is only a recommendation of caution. -/- Bronislaw Malinowski (1884-1942): a) against Tylor’s and Frazer’s “magpie” methodology, field-work is required, a culture as a whole should be observed from inside; individual elements are incomprehensible; b) a culture is an organic whole; c) its elements are accounted for by their function (economy), avoiding non-observables (empio-criticism). -/- Ruth Benedict and Melville Herskovitz identify Boas’s approach with “cultural relativism”. Benedict: what is normal and abnormal is to be judged on a culture’s own standards, not on our own (“Anthropology and the Abnormal”). Herskovits: “Boas adumbrates what we have come to call cultural relativism” (The Mind, p. 10); “Judgements are based on experience, and experience is interpreted by each individual in terms of his own enculturation” (Man and his Works). -/- 4. How analytic philosophy understood and misunderstood the discussion 4.1. At the beginning of the 20th c., the new view in ethics was non-cognitivism (emotivist and subjectivist). Eric Westermark combines this view with an old-style ethnographic approach in support of relativity of moralities. Moralities are codes, or systems of emotive ‘disinterested’ reactions selected by evolution on their usefulness in terms of survival value for the society that is the carrier of such systems or codes. The moral relativity thesis: there are cases of disagreement that cannot be settled even after agreement about facts. 4.2 Anti-realists Brandt, Mackie, Gilbert, Harman adopt Westermark’s approach in a more sophisticated version: a) moralities are codes with an overall function and may be appraised only as wholes; b) variability is an argument for moral subjectivism; c) apparent legitimacy of deriving shift from ought is legitimized only within one institution d) morality should not be described but instead made, and existing moralities may be improved. Is it ‘real’ relativism? It is clearly subjectivism (a metaethical thesis). The normative thesis is that there better and worse codes, and survival values is the normative standard. -/- 4.3 Particularists MacIntyre, Sandel, Taylor, Wiggins, McDowell ‘Wittgensteinian’ prospectivist arguments bent to support weak-relativist claims MacIntyre: there is ‘incommensurability’ between different theoretical systems in both science and ethics. No argument is possible through different systems Different traditions may coexist for a long time without being able to bring their conflicts to a rational solution. -/- 4.4 Kantian universalists Baier, Gewirth, Rawls, Apel, Habermas Shared claim: justice concerns the right and is universal in so far as it may be based on minimal assumptions Other virtues are relative to context in so far as they are related to comprehensive views of the good - O’Neill criticism: a) it is an assumption shared by both alignments; b) after an alleged crisis brought about by alleged loss of metaphysical certainties, theories of justice have dropped demanding assumptions and kept universalism, virtue theories have kept demanding assumptions and dropped universalism; c) the opposition of virtue and justice has arisen in an unjustified way. O’Neill’s positive proposal: ‘constructive’ procedures may be adopted both (i) concerning all the range of virtues and (ii) across cultures once we abandon idealization and confine ourselves to abstraction from real-world cases. -/- 4.5 A metaethical relativist and anti-relativist normative ethicists: Bernard Williams Williams: vulgar relativism may be assumed to claim that: a) 'just' means 'just in a given society'; b) 'just in a given society' is to be understood in functionalist sense; c) it is wrong for one society’s members to condemn another society’s values. It is inconsistent since in (c) uses ‘just’ in a non-relative way that has been excluded in (a). William’s positive proposal: i) keep a number of substantive or thick ethical concepts that will be different in space and time; ii) admit that public choices are to be legitimized through recourse to more abstract procedures and relying on more thin ethical concepts. -/- 5. Critical remarks 5.1 The only real relativism available is ‘vulgar’ relativism (Westermark?) 5.2. Descriptive universalism (or absolutism) has a long pedigree, from Cicero on, reaching Boas himself but it is useless as an answer to normative questions 5.3. Twentieth-century philosophical discussion seems to discuss an ad hoc doctrine reconstructed by assembling obsolete philosophical ideas but ignoring the real theory of cultural relativism as formulated by anthropologists. -/- 6. A distinction between ethoi and ethical theories as a way out of confusions a)There are systems of conventions de facto existing. These may be studies from outside as phenomena or facts. b)There is moral argument and this, when studies from outside, is a fact, but this does not influence in any degree the possible validity of claims advanced. c) the difference between the above claims and Mackie’s criticism to Searle’s argument of the promising game is that promises, arguments etc. are also phenomena, but they are also communicative phenomena with a logical and pragmatic structure. -/- 7.Conclusions: a) cultural relativism, as a name for Boas’s methodology is a valuable discovery, and in this sense we are all relativists; b) ethical relativism, as an alleged implication of cultural relativism, has been argued in a philosophically quite unsophisticated way by Benedict and Herskovits; philosophers apparently discussed ethical relativism in the basis of a rather faint impression of what cultural relativism had been. c) a full-fledged ethical relativism has hardly been defended by anybody among philosophers; virtually no modern philosopher really argued a prescriptive version of the thesis; d) we may accept the grain of truth in ethical relativism by including relativist critique to ethical absolutism into a universalist normative doctrine that be careful in separating open-textured formulations of universal claims from culturally conditioned particular prescriptions. -/- . Public reason liberalism is the political theory which holds that coercive laws and policies are justified when and only when they are grounded in reasons of the public. The standard interpretation of public reason liberalism, consensus accounts, claim that the reasons persons share or that persons can derive from shared values determine which policies can be justified. In this paper, I argue that consensus approaches cannot justify fair educational policies and preserving cultural goods. Consensus approaches can resolve some controversies about (...) teaching values in the educational system, such as curriculum choice. But they cannot determine which culture goods, e.g., architecture, artwork, or language ought to be preserved in the education system. Consensus approaches cannot fairly resolve competing claims about these kinds of disputes. -/- I propose that convergence accounts of public reason, which allow individuals to draw on their own comprehensive doctrines in limited ways, can remedy these weaknesses in the mainline public reason tradition. The convergence approach can justify a pluralist state that can advance valuable community goods. John Henry Newman’s advocacy of liberal arts education finds resonance in other cultures, notably among Confucians, illustrating that there can be a shared moral vision and inquiry into the good life across deep substantive disagreements about educational values and policies, once we expand our notion of justification to be more inclusive. Since the time of Aristotle's students, interpreters have considered Prior Analytics to be a treatise about deductive reasoning, more generally, about methods of determining the validity and invalidity of premise-conclusion arguments. People studied Prior Analytics in order to learn more about deductive reasoning and to improve their own reasoning skills. These interpreters understood Aristotle to be focusing on two epistemic processes: first, the process of establishing knowledge that a conclusion follows necessarily from a set of premises (that is, on the (...) epistemic process of extracting information implicit in explicitly given information) and, second, the process of establishing knowledge that a conclusion does not follow. Despite the overwhelming tendency to interpret the syllogistic as formal epistemology, it was not until the early 1970s that it occurred to anyone to think that Aristotle may have developed a theory of deductive reasoning with a well worked-out system of deductions comparable in rigor and precision with systems such as propositional logic or equational logic familiar from mathematical logic. When modern logicians in the 1920s and 1930s first turned their attention to the problem of understanding Aristotle's contribution to logic in modern terms, they were guided both by the Frege-Russell conception of logic as formal ontology and at the same time by a desire to protect Aristotle from possible charges of psychologism. They thought they saw Aristotle applying the informal axiomatic method to formal ontology, not as making the first steps into formal epistemology. They did not notice Aristotle's description of deductive reasoning. Ironically, the formal axiomatic method (in which one explicitly presents not merely the substantive axioms but also the deductive processes used to derive theorems from the axioms) is incipient in Aristotle's presentation. Partly in opposition to the axiomatic, ontically-oriented approach to Aristotle's logic and partly as a result of attempting to increase the degree of fit between interpretation and text, logicians in the 1970s working independently came to remarkably similar conclusions to the effect that Aristotle indeed had produced the first system of formal deductions. They concluded that Aristotle had analyzed the process of deduction and that his achievement included a semantically complete system of natural deductions including both direct and indirect deductions. Where the interpretations of the 1920s and 1930s attribute to Aristotle a system of propositions organized deductively, the interpretations of the 1970s attribute to Aristotle a system of deductions, or extended deductive discourses, organized epistemically. The logicians of the 1920s and 1930s take Aristotle to be deducing laws of logic from axiomatic origins; the logicians of the 1970s take Aristotle to be describing the process of deduction and in particular to be describing deductions themselves, both those deductions that are proofs based on axiomatic premises and those deductions that, though deductively cogent, do not establish the truth of the conclusion but only that the conclusion is implied by the premise-set. Thus, two very different and opposed interpretations had emerged, interestingly both products of modern logicians equipped with the theoretical apparatus of mathematical logic. The issue at stake between these two interpretations is the historical question of Aristotle's place in the history of logic and of his orientation in philosophy of logic. This paper affirms Aristotle's place as the founder of logic taken as formal epistemology, including the study of deductive reasoning. A by-product of this study of Aristotle's accomplishments in logic is a clarification of a distinction implicit in discourses among logicians--that between logic as formal ontology and logic as formal epistemology. In this paper, I will argue that Locke is a substance dualist in the general sense, in that he holds that there are, independent of our classificatory schema, two distinct kinds of substances: wholly material ones and wholly immaterial ones. On Locke’s view, the difference between the two lies in whether they are solid or not, thereby differentiating him from Descartes. My way of establishing Locke as a general substance dualist is to be as minimally committal as possible at the (...) outset, especially with respect to the classic debates on Locke’s positions in this domain, including those concerning substrata, real essences, and the like. Nonetheless, I show that minimal commitments about Locke’s primary/secondary quality distinction are sufficient to derive some substantive conclusions about his positions on these issues, as well as that he is a general substance dualist. Moral constitutivism purports to explain moral normativity by appeal to the nature of either agency or rational powers. Ambitious constitutivism aspires to ground the categorical authority of morality and to derive the content of the basic moral norms while avoiding the problems of moral realism. As a general strategy, moral constitutivism faces three serious challenges. First, the shmagency challenge. The worry is that the authority of the norms derived from the nature of agency is only conditional on having a (...) reason to be an agent rather than some other kind of subject, a shmagent or an alienated agent. Constitutivists usually reply by appealing to the inescapability of agency. Second, there is a worry that agency is too thin a basis for the derivation of the substantive content of moral norms. Finally, there is the worry that constitutivism might be unable to make room for bad actions. The entry considers possible responses by moral constitutivism to these concerns and whether, if these responses are unsatisfactory, moral constitutivism might still have some explanatory power but of a less ambitious sort. Cohen’s hostility to Rawls’ justification of the Difference Principle by social facts spawned Cohen’s general thesis that ultimate principles of justice and morality are fact-insensitive, but explain how any fact-sensitive principle is grounded in facts. The problem with this thesis, however, is that when facts F ground principle P, reformulating this relation as the "fact-insensitive" conditional “If F, then P” is trivial and thus explanatorily impotent. Explanatory, hence justificatory, force derives either from subsumption under more general principles, or precisely exhibiting (...) value in light of relevant (actual or hypothetical) facts. In examples where no subsumption occurs, actual facts trivially become hypothetical facts in "fact-insensitive" conditionals, an empty formalism. Indeed, Rawls’ grounding of principles of justice in “conditions of life” can easily be reformulated as a conditional principle “sensitive” only to hypothetical such conditions, and thus formally fact-insensitive in Cohen's sense, for all Cohen’s ire against Rawls’s grounding.Moreover, any plausible “ultimate fact-insensitive principle” must be intricately qualified, which tacit ceteris paribus clauses mask. Each qualification implies prioritisation of one principle over another in conceivable circumstances, and wherever the now qualified principle is given scope, that too implies prioritisation over competing principles in typical circumstances. Any principle is thus sensitive to conceivable circumstances of application, as recognised by more sophisticated intuitionisms. Non-trivial ultimate principles – luck egalitarianism, act utilitarianism, etc. - require defense, which inevitably involves showing how they best interpret and respond to facts about human needs, goals, and capacities in predictable circumstances. Finally, the substantive debate between Rawls and Cohen about which facts are relevant to the DP is only obscured by the doctrine of fact-insensitivity. (shrink)

Christy Mag Uidhir’s Art and Art-Attempts begins from two deceptively simple observations: artworks are the product of intentions, and intentions are the kinds of things that can fail to be realized successfully. Drawing on these observations, he argues that most contemporary theories of art must be rejected because they are not substantively intention-dependent: that is, they do not account for the fact that an attempt to make an artwork can fail. From his view that artworks must be the product of (...) art-attempts that are subject to failure, Mag Uidhir derives implications for many domains in the philosophy of art. He argues that artworks cannot be abstract objects, since abstract objects cannot participate in causal relations and thus can’t be the product of art attempts: one can’t coherently intend or attempt to create something that exists eternally. Things that we think of as repeatable artworks, then, can’t be abstract types: instead, Mag Uidhir proposes, every artwork is concrete, but some are tied together by a relation of relevant similarity. In this symposium, Mag Uidhir replies to three critics, David Davies, Sherri Irvin and Keith Lehrer. All three critics examine the relevant similarity relation that Mag Uidhir proposes to account for artworks that we treat as repeatable, while also considering a variety of other issues. (shrink)

I argue that the evolutionary history of anger has substantive implications for normative ethics. In the process, I develop an evolutionary account of anger and its influence on action. First, I consider a prominent argument by Peter Singer and Joshua Greene. They conclude that evolutionary explanations of human cooperation debunk – or undercut the evidential value of – the moral intuitions supporting duty ethics (as opposed to utilitarian or consequentialist ethics). With this argument they aim to defend consequentialist theories. However, (...) their argument also threatens to debunk intuitions that support consequentialist theories. I give a novel argument that overcomes this difficulty. Specifically, I offer an evolutionary story about anger that can explain retributive, duty-oriented intuitions concerning punishment. This explanation debunks these intuitions (and not others) by showing that they were selected for their biological consequences rather than their accuracy (concerning duties to punish). I develop this explanation by raising and resolving three additional problems. First, prominent evolutionary explanations of retributive motives fail because they appeal to models that apply only to organisms with strategic insight. To mitigate this problem, I explain the existence of a retributive-like motive in rodents by appealing to an economic model of resource competition, which applies to organisms without strategic insight. Second, I show that human anger was shaped by resource competition of this kind. To do so, I develop evidential criteria to determine when psychological systems in different species share common evolutionary origins. I deploy these criteria to argue that human anger and the retributive motive in rodents derive from the same ancestral trait. Finally, the continuity of anger across human and nonhuman animals stands in tension with the idea that anger causes purposive behavior like retribution or retaliation. I argue that differences between the angry behaviors of human and nonhuman animals are differences in degree and not in kind. In the end, this evolutionary story both explains and undermines retributive intuitions, but not in the straightforward way that Singer and Greene suppose. (shrink)

This essay attempts to assess recent communitarian charges that liberalism cannot provide for genuine bonds of community or fraternity. Along with providing an analysis of fraternity, I argue that there is more common ground here than supposed by communitarians and l iberals alike. Communitarians often fail to see that liberal concerns for liberty and equality function as substantive constraints on the moral worth of fraternal bonds. On the other hand, insofar as liberals ignore fraternity, or see it as a purely (...) derivative ideal, they too make an important error. (shrink)

This essay considers the nature of duties incumbent on legislators in virtue of the office itself. I argue that there is no duty for a legislator to enact a criminal law based on morality; there is no duty to incorporate substantive moral conditions into the criminal law; and there is therefore no duty derivable from the nature of the legislative office itself to make conditions of culpability depend on those of moral responsibility. Finally, I argue that the relation between morality (...) and the criminal law is therefore much less direct than assumed in most theories of the criminal law. (shrink)

Heidegger’s reimagining of the artwork was instrumental in forcing a re-evaluation of modern aesthetic assumptions in the first half of the twentieth century. Heidegger’s theory of the origin of the work of art derives from a hermeneutic analysis of a single van Gogh masterpiece. On Heidegger’s view, the artwork provides a substantive and practical way of accessing the nature of art even if questions remain about all manifestations of the nature of art in general. This paper turns his analysis to (...) an alternative influential artwork - Duchamp's ‘Fountain’. I argue ‘Fountain’ presents difficulties for Heidegger’s method, some of which can be accommodated. However, the requirement to confine phenomenal engagement to the art object alone leads to problems when the object is appropriated from outside the artworld, not exhibited, and only one photograph bears witness to its existence. The prospect of broadening the focus of our attention from the art object alone to the ‘drama’ of ‘Fountain’ provides for a much richer phenomenal engagement. However, this move runs counter to a second stipulation of Heidegger's approach - that the artist’s intentions and her performative acts in creating the object should be excluded from our engagement with the work. Duchamp's radical move with ready-mades, and ‘Fountain’, in particular, disarms more than Heidegger’s early post-modern conception of an artwork. It also places pressure on aesthetic theories that lack the capacity to reset ontological boundaries when deeper transformative experiences lie beyond the remit of the object alone, or when art-relevant concepts are appropriated into and out of the realm of art. Duchamp points to a richer means of engaging with artworks than the one construed by Heidegger, one that includes consideration of the relevant artmaking acts. (shrink)

Theorists of liberal neutrality, including in this context David Miller, claim that it is unjust for environmental policy to privilege a particular conception of the good by appealing to normative principles derived from any substantive conception of human flourishing. However, analysis of Miller's arguments reveals the inability of procedural justice thus understood to adequately engage with the complex and contested issue of the relationship between human beings and the rest of the world. Miller's attempt to distinguish categories of public (...) goods generally, and environmental goods in particular, according to the possibility of reasonable disagreement, is seriously flawed. It results in an inability to distinguish between want-regarding and ideal-regarding justifications for the public provision of environmental goods, and more generally, an inability to recognise ecological sustainability as an important aspect of the common good. Effective environmental policy is not rendered illegitimate or unjust by incompatibility with liberal neutrality. (shrink)

Social metaphysics is a source of important philosophical and moral insight. Furthermore, much social metaphysics appears to be substantive. However, some have recently argued that standard views of metaphysics cannot accommodate substantive social metaphysics. In this paper I offer a new diagnosis of this problem and defend a new solution, showing that this problem is an illuminating lens through which to examine the nature and boundaries of metaphysics. This case instantiates a broad, common pattern generated by attempts to align distinctions (...) between realism and anti-realism, mind-independence and mind-dependence, and legitimate and non-legitimate inquiry. I show that the best response is to abandon the association between substantive metaphysics and mind-independence, and I sketch a new definition of substantivity, given in terms of explanatory power, that makes room for substantive social metaphysics while also offering an attractive basis for general metaphysics. According to the objection from positive duties, Kant's Formula of Universal Law is flawed because it cannot be used to derive any affirmative moral requirements. This paper offers a response to that objection and proposes a novel way to derive positive duties from Kant's formula. The Formula of Universal Law yields positive duties to adopt our own perfection and others’ happiness as ends because we could not rationally fail to will those ends as universal ends.

All morally wrong actions deserve some form of moral condemnation. But the degree of that condemnation is not the same in all cases. Some wrongs are so morally extreme that they seem to belong to a different category because they deserve our very strongest form of moral condemnation. For example, telling a white lie to make a friend feel better might be morally wrong, but intuitively such an act is in a different moral category to the sadistic, brutal, and violent (...) rape and torture of a child. The former act is merely wrong and not evil. In contrast, the latter act seems so morally extreme that we need to call it “evil” and not merely “wrong” if we are to do justice both to the moral seriousness of that act and the strength of our condemnation of it. The task of a theory or substantive conception of evil is to spell out what is an evil action and how it differs from a merely wrongful action. But what does a plausible substantive theory of evil look like? To explore this question, I spell out the concept of evil and illustrate four different types of substantive conceptions of evil actions: victim, perpetrator, spectator, and mixed theories. Of these four options, I argue that mixed theories are the most plausible type of theory, before investigating in detail the promising mixed theory recently defended by Matthew Kramer (2014b). Finally, in light of my analysis of Kramer’s view, I present a reformulated version of my combination theory of evil (Formosa 2008; Formosa 2013). (shrink)

The traditional view of evidence in mathematics is that evidence is just proof and proof is just derivation. There are good reasons for thinking that this view should be rejected: it misrepresents both historical and current mathematical practice. Nonetheless, evidence, proof, and derivation are closely intertwined. This paper seeks to tease these concepts apart. It emphasizes the role of argumentation as a context shared by evidence, proofs, and derivations. The utility of argumentation theory, in general, and argumentation schemes, in particular, (...) as a methodology for the study of mathematical practice is thereby demonstrated. Argumentation schemes represent an almost untapped resource for mathematics education. Notably, they provide a consistent treatment of rigorous and non-rigorous argumentation, thereby working to exhibit the continuity of reasoning in mathematics with reasoning in other areas. Moreover, since argumentation schemes are a comparatively mature methodology, there is a substantial body of existing work to draw upon, including some increasingly sophisticated software tools. Such tools have significant potential for the analysis and evaluation of mathematical argumentation. The first four sections of the paper address the relationships of evidence to proof, proof to derivation, argument to proof, and argument to evidence, respectively. The final section directly addresses some of the educational implications of an argumentation scheme account of mathematical reasoning. (shrink)

Many philosophers of physics think that physical rates of change, like velocity or acceleration in classical physics, are extrinsic. Many philosophers of mind think that phenomenal properties, which characterize what it’s like to be an agent at a time, are intrinsic. I will argue that these two views can’t both be true. Given that these two views are in tension, we face an explanatory challenge. Why should there be any interesting connection between these physical quantities and consciousness in the first (...) place? In a speculative spirit, I close by developing a panpsychist view which promises to explain this connection in a particularly satisfying way. (shrink)

This dissertation explores the prospects of postdeflationary substantive theorizing about truth. Postdeflationary theories define the concept of truth or the property of being a true truthbearer in a way that respects the deflationary desiderata of clarity, purity, and permissiveness with truth-aptness, without a necessary commitment to the core negative thesis of the deflationary approach. Postdeflationary substantive theories further acknowledge the complexity and explanatory utility of truth in understanding and defining other concepts and phenomena. The motivation for pursuing this study arises (...) from the so-called contemporary crisis of truth, where a substantive understanding of truth is subjected to widespread skepticism, critique, and even cynicism both inside and outside of philosophy in formal and mundane discourse. To better understand this crisis, particular attention is directed towards the deflationary critique of substantive theories of truth, which is a prevalent point of discussion in contemporary literature on western analytic philosophy. By exploring the limits and philosophical sustainability of deflationary critique of substantive accounts of truth, valuable insight is gained about the contemporary crisis of truth and the potential for substantive theorizing about truth in general. This dissertation composes of an introduction and four original research publications that address two connected themes: exploration of the philosophical sustainability of deflationary critique of substantive theories of truth, and exploration of the prospects for development of the now popular substantive pluralist theories of truth. These themes constitute both negative and positive aspects in relation to analyzing the prospects of postdeflationary substantive theorizing about truth. The first part of this dissertation focuses on arguing against the widespread deflationary readings of W.V.O. Quine’s truth, who is widely interpreted as a prominent and influential deflationist in both the secondary literature on his philosophy and contemporary truth-theoretic debates more broadly conceived. The first essay demonstrates that Quine’s immanent conception of truth involves commitments that are incompatible with general and theory-specific framings of the deflationary thesis. The second essay demonstrates conflicts between Quine’s views and what has in recent literature been argued as strong and moderate variants of the deflationary thesis. In conclusion, these essays demonstrate that the widespread deflationary readings of Quine’s truth are mistaken, thus removing a prominent thinker from the deflationists ranks while simultaneously casting suspicion towards the philosophical sustainability of the deflationary approach in general. The second part of this dissertation explores the prospects of postdeflationary substantive theorizing about truth by analyzing the limits and prospects for development of the increasingly popular substantive pluralist theories. The third essay explores different ways in which semantic ambiguity poses trouble for current pluralist models. The fourth essay argues that to achieve the theoretical desiderata that pluralists ask from discourse domains, the latter ought to be individuated on ontological rather than topical grounds. In conclusion, these essays demonstrate that while current pluralist models involve shortcomings, they encompass potential for development and provide a viable prospect for sustainable postdeflationary substantive theorizing about truth. When philosophers, social scientists, and politicians seek to determine the justice of institutional arrangements, their discussions have often taken the form of questioning whether and under what circumstances the redistribution of wealth or other valuable goods is justified. This essay examines the different ways in which redistribution can be understood, the diverse political contexts in which it has been employed, and whether or not it is a useful concept for exploring questions of distributive justice.

This chapter derives and refines a novel normative moral theory and descriptive theory of moral psychology--Rightness as Fairness--from the theory of prudence defended in Chapter 2. It briefly summarizes Chapter 2’s finding that prudent agents typically internalize ‘moral risk-aversion’. It then outlines how this prudential psychology leads prudent agents to want to know how to act in ways they will not regret in morally salient cases, as well as to regard moral actions as the only types of actions that satisfy (...) this prudential interest. It then uses these findings to defend a new derivation of my (2016) theory of morality, Rightness as Fairness, showing how the derivation successfully defends Rightness as Fairness against a variety of objections. The chapter also details how this book’s theory helps to substantiate the claim that Rightness as Fairness unifies a variety of competing moral frameworks: deontology, consequentialism, contractualism, and virtue ethics. Finally, the chapter shows how Chapter 2’s theory of prudence entails some revisions to Rightness as Fairness, including the adoption of a series of Rawlsian original positions to settle moral and social-political issues under ideal and nonideal circumstances—thus entailing a unified normative and descriptive psychological framework for prudence, morality, and justice. In a rather old paper, Mario Liu described a hydrodynamic Maxwell equations. While he also discussed potential implications of these new approaches to superconductors, such a discussion of electrodynamics of superconductors is made only after Tajmar’s paper. Therefore, in this paper we present for the first time a derivation of fluidic Maxwell-Proca equations. The name of fluidic Maxwell-Proca is proposed because the equations were based on modifying Maxwell-Proca and Hirsch’s theory of electrodynamics of superconductor. It is hoped that this paper (...) may stimulate further investigations and experiments in superconductor. It may be expected to have some impact to cosmology modeling too, for instance we consider a hypothetical argument that photon mass can be origin of gravitation. Then, after combining with the so-called chiral modification of Maxwell equations (after Spröessig), then we consider chiral Maxwell-Proca equations as possible alternative of gravitation theory. Such a hypothesis has never considered in literature to the best of our knowledge. (shrink)

We show that the physical meaning of the wave function can be derived based on the established parts of quantum mechanics. It turns out that the wave function represents the state of random discontinuous motion of particles, and its modulus square determines the probability density of the particles appearing in certain positions in space.

Unlike other organs that operate continuously, such as the heart and kidneys, many of the operations of the nervous system shut down during sleep. The evolutionarily conserved unconscious state of sleep that puts animals at risk from predators indicates that it is an indispensable integral part of systems operation. A reasonable expectation is that any hypothesis for the mechanism of the nervous system functions should be able to provide an explanation for sleep. In this regard, the semblance hypothesis is examined. (...) Postsynaptic membranes are continuously being depolarized by the quantally released neurotransmitter molecules arriving from their presynaptic terminals. In this context, an incidental lateral activation of the postsynaptic membrane is expected to induce a semblance (cellular hallucination of arrival of activity from its presynaptic terminal, which forms a unit for internal sensation) of the arrival of activity from its presynaptic terminal as a systems property. This restricts induction of semblance to a context of a very high ratio of the duration of the default state of neurotransmitter-induced postsynaptic depolarization to the total duration of incidental lateral activations of the postsynaptic membrane. This requirement spans within a time-bin of a few sleep-wake cycles. Since the duration of quantal release remains maximized, the above requirement can be achieved only by ceiling the total duration of incidental lateral activations of the postsynaptic membrane, which necessitates a state of sleep. At the heart of Rik Peels’s Responsible Belief: A Theory in Ethics and Epistemology is the idea that responsibility for belief ought to be understood on the model of responsibility for states of affairs that are subject to our influence but not under our intentional control, or what he calls derivative responsibility. In this article, I argue that reflection on the nature and scope of derivative responsibility reveals important lacunae in Peels’s account of responsible belief and his account of responsibility (...) for belief. The possibility of merely derivative quantum indeterminacy undermines both a recent argument against quantum indeterminacy due to David Glick, and an argument against the possibility of merely derivative indeterminacy due to Elizabeth Barnes.

This paper shows how to derive nested calculi from labelled calculi for propositional intuitionistic logic and first-order intuitionistic logic with constant domains, thus connecting the general results for labelled calculi with the more refined formalism of nested sequents. The extraction of nested calculi from labelled calculi obtains via considerations pertaining to the elimination of structural rules in labelled derivations. Each aspect of the extraction process is motivated and detailed, showing that each nested calculus inherits favorable proof-theoretic properties from its associated (...) labelled calculus. (shrink)

The notions of conservation and relativity lie at the heart of classical mechanics, and were critical to its early development. However, in Newton’s theory of mechanics, these symmetry principles were eclipsed by domain-specific laws. In view of the importance of symmetry principles in elucidating the structure of physical theories, it is natural to ask to what extent conservation and relativity determine the structure of mechanics. In this paper, we address this question by deriving classical mechanics—both nonrelativistic and relativistic—using relativity and (...) conservation as the primary guiding principles. The derivation proceeds in three distinct steps. First, conservation and relativity are used to derive the asymptotically conserved quantities of motion. Second, in order that energy and momentum be continuously conserved, the mechanical system is embedded in a larger energetic framework containing a massless component that is capable of bearing energy. Imposition of conservation and relativity then results, in the nonrelativistic case, in the conservation of mass and in the frame-invariance of massless energy; and, in the relativistic case, in the rules for transforming massless energy and momentum between frames. Third, a force framework for handling continuously interacting particles is established, wherein Newton’s second law is derived on the basis of relativity and a staccato model of motion-change. Finally, in light of the derivation, we elucidate the structure of mechanics by classifying the principles and assumptions that have been employed according to their explanatory role, distinguishing between symmetry principles and other types of principles that are needed to build up the theoretical edifice. The aim of this article is to study the notion of derivability and its semantic counterpart in the context of non-transitive and non-reflexive substructural logics. For this purpose we focus on the study cases of the logics _S__T_ and _T__S_. In this respect, we show that this notion doesn’t coincide, in general, with a nowadays broadly used semantic approach towards metainferential validity: the notion of local validity. Following this, and building on some previous work by Humberstone, we prove that in (...) these systems derivability can be characterized in terms of a notion we call absolute global validity. However, arriving at these results doesn’t lead us to disregard local validity. First, because we discuss the conditions under which local, and also global validity, can be expected to coincide with derivability. Secondly, because we show how taking into account certain families of valuations can be useful to describe derivability for different calculi used to present _S__T_ and _T__S_. (shrink)

Indeterminacy is metaphysical (or worldly) if it has its source in the way the world is (rather than how it is represented or known). There are two questions we could ask about indeterminacy. First: does it exist? Second: is indeterminacy derivative? I focus on the second question. Specifically, I argue that (at least some) metaphysical indeterminacy can be derivative, where this roughly means that facts about indeterminacy are metaphysically grounded in facts about what is determinate.

I reply to criticisms from Duetz and Dentith, Basham, and Hewitt. I argue that the central disputes on this topic concern how ordinary people understand conspiracy theories and how to evaluate concrete conspiracy theories and conspiracy theorists.

It is shown that the heuristic "derivation" of the Schrödinger equation in quantum mechanics textbooks can be turned into a real derivation by resorting to spacetime translation invariance and relativistic invariance.

The one-side defaultable financial derivatives valuation problems have been studied extensively, but the valuation of bilateral derivatives with asymmetric credit qualities is still lacking convincing mechanism. This paper presents an analytical model for valuing derivatives subject to default by both counterparties. The default-free interest rates are modeled by the Market Models, while the default time is modeled by the reduced-form model as the first jump of a time-inhomogeneous Poisson process. All quantities modeled are market-observable. The closed-form solution gives us a (...) better understanding of the impact of the credit asymmetry on swap value, credit value adjustment, swap rate and swap spread. (shrink)

I give a pedagogical derivation of the Cramer-Rao Bound, which gives a lower bound on the variance of estimators used in statistical point estimation, commonly used to give numerical estimates of the systematic uncertainties in a measurement.

I pedagogically show that the momentum operator in quantum mechanics, in the position representation, commonly known to be a derivative with respect to a spatial x-coordinate, can be derived by identifying momentum as the generator of space translations.

Verbal disputes are often seen as closely related to a lack of substantivity. However, a systematic and comprehensive investigation of how verbalness relates to substantivity is still missing. The present paper attempts to close this gap. In addition to offering different conceptions of verbalness, the paper further develops Sider’s (Writing the Book of the World, OUP, Oxford, 2011) notion of substantivity. Ultimately, I argue for a more careful choice of terminology when it comes to assessing a dispute as “(merely) verbal” (...) or “nonsubstantive”. While the paper shows that there is no strict logical relation between mere verbalness and nonsubstantivity construed along the lines set out by Sider, it also demonstrates that further notable notions of (mere) verbalness and substantivity are in fact closely intertwined.
