Technology and Artificial Intelligence, both today and in the near future, are dominated by automated algorithms that combine optimization with models based on the human brain to learn, predict, and even influence the large-scale behavior of human users. Such applications can be understood to be outgrowths of historical trends in industry and academia, yet have far-reaching and even unintended consequences for social and political life around the world. From the very beginning, phenomenology met with sound inquiry. Not only the relationship between Husserl and Stumpf, whose investigations influenced numerous philosophers and twenty-century trends, but a whole musicological thread (Mersmann, Eimert, Güldenstein, Bekker) referred to phenomenology during the twenties and following decades (Besseler, Leibowitz, Schaeffer, Rognoni). From another side, explicit aesthetic reflections are traceable in the Göttingen Circle but also in W. Conrad, Schütz, Plessner, and Anders-Stern. Even Heidegger, Merleau-Ponty, up to Smith, Ihde, Dufrenne, Clifton, Ferrara, and Piana, which (...) more or less systematically dealt with sound. The aim of this work is to show the fundamental cores of a phenomenology of sound; then, the continuing need for research. Through themes like the constitution of the sound-object, the phenomenological distinction between sounds and noises, and the spatial features of sound, the phenomenological scenario of sound inquiry will be pointed out and analyzed. Is it possible to conceptualize the sound image? How can we talk about the intertwined between visual image and sound? When precisely is there a sound image? In this article, I specify what is not a sound image, and I analyze three forms of what should be considered a sound image. Understood as a form of experience, the sound image is linked to a subject, but at the same time is independent from him: it is a world manifestation.

Ever since the early days of quantum mechanics it has been suggested that consciousness could be linked to the collapse of the wave function. However, no detailed account of such an interplay is usually provided. In this paper we present an objective collapse model where the collapse operator depends on integrated information, which has been argued to measure consciousness. By doing so, we construct an empirically adequate scheme in which superpositions of conscious states are dynamically suppressed. Unlike other proposals in (...) which “consciousness causes the collapse of the wave function,” our model is fully consistent with a materialistic view of the world and does not require the postulation of entities suspicious of laying outside of the quantum realm. Metamorphosis seems problematic for our occidental point of view. Becoming in general is viewed as an error or exception by our classic standpoint. In fact, it is strongly against identity and law of non-contradiction: A is fundamentally something different from B and for A it is impossible to be at the same time B. We need to think A as what-becomes-B in order to make metamorphosis possible. Anyway, how can A become B? As a matter of fact, this very claim (...) has been historically the most common critic opposed to becoming. Deleuze and Guattari in their monumental work had tried to offer an enormous contribution to a few related problems. Redefining the subject as an event described by movement and affect can exceed the metamorphosis’ aporia. This new principle of individuation provides a new look upon arisen questions primarily because affects and movements are constant coordinates that define how metamorphosis is experienced. The paper tries to show how the betweenness in action in the encounter with people, human beings, things, animals, plants and minerals defines the logic field of metamorphosis. This is shown in dialogue with the ontological turn in anthropology that is particularly focused on this affective and lively dimension of encounter especially among Amazonian populations. Actually this is also what happens in our – occidental and classical but live – relation with things and objects, as long as we try to think a real conceptualisation of experience. (shrink)

How can sound and space be connected not only in a metaphorical sense? Over the last decades, philosophy of sound, aesthetics, and musicology have shown increasing interest in space inquiry. However, the way we interact with each other, communicate in space, and gather information about/in space is rooted in sound in a completely different way from those of musical metaphors. In this paper, I present an analysis of the role sound plays in the constitution of both space and relations of (...) intimacy within it. Starting from the wealthy tips that E. T. Hall gives to us in order to delineate a new understanding of proxemics that includes sound experience, I argue that sound, silence, and noise are essential to determine the intimate space and the way we interact with it. Moving from a classical proxemics perspective, the analysis will focus on the intimate relation between sound, space, and body, dialoguing with phenomenology, anthropology, semiotics, and philosophy of space. Husserl and the phenomenology of religion have a delicate relationship that combines direct references to religious themes with broader analyses subsumable under the more general phenomenology of consciousness. This paper shows the themes and problems of a Husserlian phenomenological analysis of religious consciousness through an encounter with its elements. Word, Prayer, relationship with the Sacred and Faith are some of the indelible traces of a phenomenology of religious consciousness. The belief, however, is that phenomenology can be spoken of if and (...) only if the themes are addressed through the analysis of consciousness as the method teaches. Thus, an analysis of religious lived-experiences and transcendence (subjective and absolute) is joined by such phenomenologically diriment questions as a possible dichotomy between transcendence of immanence or immanence of transcendence. I suoni e le immagini sembrano appartenere a due forme dell’esperienza profondamente distinte. Due registri sensoriali antitetici cui corrispondono due fenomeni accostabili, ma mai completamente unibili. Eppure si ricorre spesso all’espressione immagine sonora, che cosa si intende precisamente? Esiste un punto in cui i suoni e le immagini si appartengono reciprocamente? Può un’immagine risuonare e un suono essere anche un’immagine? Il testo cerca di rispondere a questi quesiti scavando e intarsiando una concettualizzazione dell’immagine sonora attraverso un dialogo con la semiotica, (...) la fenomenologia e la filosofia dell’arte. Arricchendosi di una riflessione sul rapporto con il pensiero, l’indagine sull’immagine sonora si declina in tre momenti distinti: il suono con un fondamento d’immagine in cui l’elemento fondante è dato dalla presenza dell’immagine nel suono; il suono e l’immagine che si equivalgono orizzontalmente fondendosi l’uno con l’altra; l’immagine con un fondamento sonoro, in cui si rintracciano presenze sonore nell’immagine visiva. Starting from Jaspers’ analysis of attitudes in Psychologie der Weltanschauungen and analyzing their causes, we find an essential description of the human being. The human condition of being in the world (Heidegger, Jaspers) can be troubled (Freud, Jung). However, this is characteristic for human life (Jaspers, Schellenbaum). Among all attitudes, the enthusiastic one is the more consistent with human being’s dynamic nature (Bergson, Jaspers, Schellenbaum). The human being feels himself deeply touched (Scheler, Jaspers) and becomes stunned. The aim of the (...) paper is to show that the enthusiastic view is well exposed by the act of singing. Traditionally analysed in connection with art (Cassirer, Solger, Wackenroder), the enthusiastic view gives us a “sound image” of the human being since his childhood (Gehlen, Leydi). In everyday life and by all its difficulties (Freud, Jung, Schellenbaum, Jaspers), the human being discloses his nature in acoustic manifestations (Keil, Kafka, Wackenroder) by expressing the enthusiastic mode. Listening is not an incorporeal experience; we do not listen with our non-extended minds. We listen with all our body, and music can change completely our personal structure. It is through sound experience that we change and asset ourselves. Studies in the doctrine of affects often use sonorous metaphors and concepts such as Stimmung, resonance, consonance, that refer to sound experience. In this paper, I try first of all to show how listening is rooted in body experience. Then, I argue (...) for a new consideration of the notion of person that takes into account the fundamental sonorous basis – psycho-acoustic – of its constitution. Thanks to sounds we can reach a new conceptualization of emotional relations between persons which we attain through the person’s ordo amoris. Additionally, with the analysis of sounds we grasp some aspects of emotional experience related to the singular person (intra-personal). So, if sounds are profoundly related to corporeal experience, so strongly involving affects as to modify our personal structure and form a person’s constitution, and affects can really do that, their relationship need to be inquired where both sound experience and affection are rooted: corporeity. The paper tries to conceptualize the metamorphosis through a distinction between two forms: (1) metamorphosis or transformation that allows us to know from (...) where what is transformed comes (start) and where it arrives (arrival); (2) becoming that shows a tension between two different conditions or that not allows us to grasp something because of his intangibility. In the last few years, the idea of human being has been enlarged from the individual closeness to morphogenetic openness. Concurrently with discovers and researches into invisible worlds that live with human beings – microbes, fungi, bacteria, etc. – a debate has opened up that agrees with recent positions in the field of ontology. The human being is capable of poietic openness and is defined by relations. Anyway, an absence of a rigorous conceptualisation of the individualising process remains latent to (...) the discourse. A classic principle of individualisation is probably incomplete. This paper brings into dialogue individualisation with singularisation through the manifestation process of expression in accordance with recent theoretical enactments of hybridisation processes. Recent studies have identified that the problem is not one of finding a location for a given task, but of identifying how and what one wants to do with a given stimulus. This radicalises the problem of attention in perception. New principle of individuation and analysis of expression provide new looks to arisen problems with classical logic and metamorphosis representations, which will be acceptable and comprehensible as art shows. L'articolo analizza i fondamenti delle indagini percettive nell'impostazione fenomenologica. In particolare l'ambito uditivo si struttura in modalità, ricezioni ed analisi che, attraverso la critica di vari autori (Husserl, Heidegger, Dufrenne, Ihde, Schaeffer), si mostrano articolate in due direzioni (soggetto-oggetto e oggetto-soggetto). L' analisi delle componenti costitutive porta a riconoscere come ricorrente tra autori differenti quell'impostazione del problema la quale asserisce che, se da un lato non può prescindere dall'attività percettiva, come attività propria del soggetto, dall'altro questa stessa cerca una legittimità (...) emergente dalle cose stesse. La costituzione, una volta riconosciuto il darsi dell'oggetto sonoro, risiede, tuttavia, nelle attività percettive che delineano così il differenziarsi degli ascolti. (shrink)

The relationship between knowledge and vision seems really consolidated. It started in ancient Greece and we can found its basis in Plato. The history of logos as reason and as western foundation of culture gives us enormous examples in terms of metaphors and approaches in the knowledge-vision relationship. «I see it» is like «I know it». However if we look at the basis of logos we find the deep meaning of gathering, composition, bond and bind (lèghein), so as to we (...) could choose «to gather» as the best translation of logos (Hoffmann). My aim is to show how this key feature is represented by sounds. To think is to link information, memories and so on and the principal property of sound is union and merger. We can argue for a «sonorous thought» but in reality this property is simply the founding element of thought and reason. In fact if we analyse the limits of our knowledge (Kant, Plessner) we discover the incorrectness of knowledge-vision relationship – like the knowledge-discourse relationship. We should investigate this guideline as the recent research for Covid-19 vaccine has shown. (shrink)

Man avoids solitude through _divertissement_ because he is afraid of what staying alone entails: thinking about himself (Pascal). Furthermore, man seeks isolation in order to gain ambition and reputation (Montaigne). However, solitude is really different from isolation and it is a fundamental emotional condition. Heidegger’s analysis of the forms of boredom adapts to and relates to the specific dynamic of solitude, showing that it is a part of human being’s structure despite his experience appearing controversial. Even if man lives in (...) modern apartments and one-room apartments, he is in a condition of co-isolation (Sloterdijk) that differs from solitude. There is a space solitude (Foucault) that involves – or can involve – human isolation, but we only experience essential solitude in sleep (Merleau-Ponty, Blanchot, Perec) where man detached himself from himself and he is really alone, from himself and the others. The forms of solitude lead the analysis towards impersonal activity. (shrink)

Heidegger’s ontologische Differenz imposes methodological limits which strictly mark his philosophy for rigor and determinacy. If it is not possible to think Being from the categories of the entity, it is also true that the difference is a tank of possibilities and developments to which Heidegger himself hints at. From the accuracy of the early works to the overturning of the problem in the later works, the ontological difference is a constant of Heideggerian thought. This paper seeks to push Existenz (...) from a mode of being of Dasein to a mode of giving of Seiende. In accordance with his late writings, bringing the question of the Being­-existence bond towards the perspective of the entity – and not only the entity among entities that poses the question –, the development of the problem in Heidegger’s meditation is analysed through the questions of ontological difference – the mode of negation, the between of distinction, the specific situatedness that defines experience, the Being, as a member of ontological difference, in its connection to the Nichts, the Event as a relaxation of the connection between Sein and Seiende. The entity that is exist­ent is the convergence point of the Event where Being and existent, Being and existence, are not in contrast, but protrude (ragen) towards each other revealing the traits of a Seyende des Seyns, of the entity of Being. We cooperate with other people despite the risk of being exploited or hurt. If future artificial intelligence (AI) systems are benevolent and cooperative toward us, what will we do in return? Here we show that our cooperative dispositions are weaker when we interact with AI. In nine experiments, humans interacted with either another human or an AI agent in four classic social dilemma economic games and a newly designed game of Reciprocity that we introduce here. Contrary to the hypothesis that (...) people mistrust algorithms, participants trusted their AI partners to be as cooperative as humans. However, they did not return AI's benevolence as much and exploited the AI more than humans. These findings warn that future self-driving cars or co-working robots, whose success depends on humans' returning their cooperativeness, run the risk of being exploited. This vulnerability calls not just for smarter machines but also better human-centered policies. (shrink)

Whilst arguing for sounds as repeatable objects does not seem suitable to our auditory experience, considering them as events can then help us understand some of their main features. In this sense, sounds are events happening to material objects; they have a beginning and an end; they are ephemeral entities that we cannot grasp as ordinary objects. Nevertheless, supporters of event theory usually focus on the autonomous status that sounds manifest from the things in the world. Conversely, when we hear (...) sounds, we hear what and where they are sounding even in those theories that I will call detached-sound theories; in hearing them we hear how different materials create different sounds. Within the different positions of the event theory to pure-event or acousmatic proposal, the importance and role that the material has in the creation of diverse sounds does not always seem to be recognized. In this paper, I therefore aim to show how the materiality of resonating bodies and objects is given in all forms of auditory experience, not until analyzed the differences between object and event accounts in the philosophy of sound. The notion of hyle seems problematic for a phenomenological foundation of experience. For this very reason, its completed invalidity was generally postulated. At the same time, there are many reflections in Husserlian writings that help us understand it better. This paper attempts to show how hyletic experience, by existing in the lived body, triggers in parallel rhythmic, vibrating, and sonorous experiences as bodily experiences. Sounds are experienced by the body before any reflections or conscious experiences of them. In this way, (...) the aporetical instance of hyletic data founds a proposal of resolution in the fundamental corporeal experience of sound. (shrink)

This paper analyses Spalding’s Betrachtung über die Bestimmung des Menschen (1748) through a translation proposal that tries to point out the human disposal to act ethically. In accord with modern German use, I argue for a translation of Bestimmung as disposition. In the first part of the article, I deal with the relevant issues for a philosophy of human experience that are present in Spalding’s text. In the second one, I bring the translation proposal into the philosophical domain showing how (...) the Bestimmung as disposition suits the human nature, in particular for what concerns the ethics, namely the way humans are arranged to act with others, and things in a non-egoistic mode. The analysis rests on two philosophical concepts: Sorge (Heidegger) and Liebe (Jaspers), that give a description of the essential relational component of human beings in which to take care, to love, and to discover our surrounding world are the key points. The existence of singularities alerts that one of the highest priorities of a centennial perspective on general relativity should be a careful re-thinking of the validity domain of Einstein’s field equations. We address the problem of constructing distinguishable extensions of the smooth spacetime manifold model, which can incorporate singularities, while retaining the form of the field equations. The sheaf-theoretic formulation of this problem is tantamount to extending the algebra sheaf of smooth functions to a distribution-like algebra sheaf in which the (...) former may be embedded, satisfying the pertinent cohomological conditions required for the coordinatization of all of the tensorial physical quantities, such that the form of the field equations is preserved. We present in detail the construction of these distribution-like algebra sheaves in terms of residue classes of sequences of smooth functions modulo the information of singular loci encoded in suitable ideals. Finally, we consider the application of these distribution-like solution sheaves in geometrodynamics by modeling topologically-circular boundaries of singular loci in three-dimensional space in terms of topological links. It turns out that the Borromean link represents higher order wormhole solutions. (shrink)

The notion of “empire” in Hardt and Negri’s political theory indicates a new postmodern sovereignty, able to lead the capital accumulation in the global market era. With the concept of “empire”, Hardt and Negri want to overtake the imperialism doctrines, considered by the two authors unable to understand correctly the global world. The aim of this essay is to clarify the conceptual contraposition between “empire” and “imperialism” offering a brief description of the international debate raised by the publication of “Empire” (...) by Hardt and Negri, in order to present the different positions and describe strengths, contradictions and aporias. Marlene van Niekerk's 1994 Triomf is a plaasroman, or farm novel, without the farm; it formally resembles a nostalgic pastoral genre initiated by the collapse of Southern African agricultural economy around the time of the Great Depression, but removes even the symbol of the farm as aesthetic compensation for material loss. In the process, van Niekerk composes a post-apartheid tragicomedy of a lumpenproletariat white supremacist family coming into long-belated class consciousness, an epiphany which, surprisingly, survives the novel's translations from Afrikaans (...) to South African English to 'international' English. Crucially, this understanding is mediated by a critical tendency to appraise Triomf in the context of Faulkner and the Southern Gothic, a generic comparison which gets a lot wrong but is ultimately very revealing, less about Triomf than about the imperial world-system through which it circulates and is consecrated. Consequently, the novel stages globally what seems at first to be a parochial question: how is one supposed to imagine democratic reconciliation and integration after apartheid, when one of the classes to be reconciled lacks historical self-consciousness and has no obvious place in either the apartheid regime or the post-apartheid dispensation? By analyzing van Niekerk's novel and the institutions which consecrate it, the paper fleshes out critiques of world-literary hermeneutics, specifically for its naive handling of genre and context, and of post-apartheid 'reconciliation' under capital. This essay identifies and intervenes in the limitations of both the social and the medical models of disability in the postcolonial context, suggesting that those limitations may apply to theorizations of disability more broadly. It suggests that Bessie Head's novel A Question of Power, which represents mental illness and disability without positing a stable etiology for them, illustrates the inapplicability of these ways of thinking about disability under instances of extreme precarity. As such, Head offers a test case for how (...) mental illness and disability writ large might be theorized without the suppositions implicit to the liberal subject. (shrink)

This chapter sketches a literary history of writing the colonial interregnum through the comparison of a canonical Dublin text and its filmic adaptation with a canonical Johannesburg text and its filmic adaptation. Njabulo Ndebele’s short story ‘Fools’ (1983) repurposes formal elements from Joyce’s ‘The Dead’ (1914), transposing strategies for representing late colonial Dublin to a Johannesburg township during the height of apartheid in a context of extreme racial domination; beginning with close comparative readings of both stories, my chapter argues that (...) the context in which ‘Fools’ emerges determines the significance of its reappropriation of Joycean formal devices and simultaneously forces a re-reading of Joyce’s flirtation with bourgeois naturalism in ‘The Dead.’ Further, the respective publishing contexts of ‘Fools’ and ‘The Dead’ go on to determine their reception and recirculation, as demonstrated by the diverse histories of the American John Huston’s adaptation of ‘The Dead’ (1984), and Ramadan Suleman’s South African adaptation of ‘Fools’ (1997). In following this circumatlantic history of influence and adaptation from Joyce to Ndebele to Huston to Suleman, across hemispheres and media, I mean to articulate a relationship between modernist form and forms of modernity, particularly as those forms that appear and reappear in the global south over the course of the long twentieth century. Particular attention is paid here to the history of underdevelopment in the global south and how it impinges upon the production and circulation of literary adaptations. (shrink)

An examination of the specifically graphic-novelistic strategies employed in Art Spiegelman's graphic memoir, Maus, in leading the reader into a punctuated experience of time and memory, and in forcing complicity with the novel's problematic animal-as-ethnicity metaphor, in a wider attempt at putting together the critical vocabulary for discussing comic books as simultaneously textual and pictorial ‘texts’.

The paper presents a brief review of the different stages in the Italian operaismo (workerism) with the aim to demonstrate that Empire (2000), written by Hardt and Negri, has been able to lead many of the ideas elaborated within the Italian workerist experience in the contemporaneity of global studies. Finally, after a review of the critiques addressed to Empire in order to challenge the workerist ideas, the book is connected with the so-called “Italian Theory”.

We give a brief overview of the evolution of mathematics, starting from antiquity, through Renaissance, to the 19th century, and the culmination of the train of thought of history’s greatest thinkers that lead to the grand unification of geometry and algebra. The goal of this paper is not a complete formal description of any particular theoretical framework, but to show how extremisation of mathematical rigor in requiring everything be drivable directly from first principles without any arbitrary assumptions actually leads to (...) relaxing the computational difficulty along with maximal conceptual clarity. With this, we consider a revision of the foundations of elementary geometry and algebra based on the work of Grassmann and Clifford and apply it to conceptual and practical problems of past and present modern mathematics and mathematical physics. Il dilemma «autonomia del politico-autonomia del sociale» ha le sue radici in quello tra trascendenza e immanenza, e si riproduce nel corso di tutta l’elaborazione teorica di Laclau e Negri, dagli scritti degli anni ’70 fino agli interventi più recenti. Queste due impostazioni teoriche si intersecano in un dialogo a distanza, la cui analisi permette di cogliere gli aspetti salienti di differenziazione e i motivi profondi di incompatibilità, ma anche di dimostrare che, considerato in questi termini, tale dilemma non ha (...) soluzione. Questo intervento si propone di indagare la dicotomia tra «sociale» e «politico» in Negri e Laclau tramite un’attenzione particolare alle categorie di immanenza e trascendenza, con l’obiettivo di mostrare come le due posizioni si escludano a vicenda poiché entrambe formulate nei termini di un aut aut tra «politico» e «sociale» dove i due lemmi vengono esclusivamente giocati uno contro l’altro. Così facendo, i due non affrontano realmente la questione del rapporto tra «sociale» e «politico», ma scelgono semplicemente una delle due parti escludendo – o contrastando – l’altra. Per prima cosa, verrà fatta emergere l’autonomia del politico all’opera nei lavori di Laclau: in un percorso a ritroso dagli scritti più recenti (a partire dalle critiche che egli muove a Negri e Hardt) fino ai primi testi pubblicati, verrà mostrata la priorità che Laclau attribuisce al «politico» a discapito del «sociale», e come in questa impostazione sia fondamentale il rifiuto della categoria di immanenza. In secondo luogo, l’attenzione verrà dedicata agli interventi di Negri dagli anni ’70 ad oggi, compresi alcuni «scambi diretti» con Laclau. Verrà evidenziato il modo in cui Negri, per sfuggire all’autonomia del politico, elabora una autonomia del sociale in cui il rapporto tra «sociale» e «politico» viene concepito unicamente come conflittuale, ovvero come tentativo continuo del «politico» e della sua trascendenza di annichilare il «sociale» e le sue potenzialità costituenti. This paper considers Achebe's No Longer at Ease in terms of its modest canonical fortunes and its peculiar formal construction. The paper argues that the novel's urban setting is produced through an emergent and local noir style, that this setting indexes the increasing centrality of the city in late colonial African life, and that it formally responds to the success of Achebe's rural Things Fall Apart and its problematic status as a paradigmatic African text. The paper suggests that No Longer (...) at Ease 's foreign and local horizons of interpretation, as symptoms of an ongoing imperial world-system, are internalized and symbolically resolved by the novel's instantiation of Lagos as chronotope. The paper's methodological intervention offers a hermeneutics of literary setting through which to elaborate the relationships between form, literary institutions, and material conditions in the postcolony. In this article we examine the role of Entscheider (decision-makers) in the German asylum procedure, both legally and ethical. As the responsibility for deciding on asylum applications lies exclusively with them, their significance for the German asylum procedure can hardly be underestimated. However, over the last few decades the situation of Entscheider changed significantly: While the number and complexity of the cases they have to decide on has increased due to the growing immigration, the requirements for their education have been (...) lowered, owed to critical amendments to the relevant law. We analyze how the law currently defines the role of Entscheider, whether the legal framework is constitutional, and what modifications morality requires. Although the law defining their role seems to be constitutional, Entscheider’s education must be improved and they must be entrusted with the hearing of the applicants to meet what morality requires, we conclude. Graham Priest has influentially claimed that the Sorites paradox is an Inclosure paradox, concluding that his favored dialetheic solution to the Inclosure paradoxes should be extended to the Sorites paradox. We argue that, given Priest’s dialetheic solution to the Sorites paradox, the argument purporting to show that that paradox is an Inclosure is unsound, and discuss some issues surrounding this fact.

This essay aims at clarifying the concept of «multitude» through a comparison between Negri’s work and some of the critiques addressed to his thought. In the first part of the paper, I will consider the relationship between multitude and the individual, in order to confute those who think that the category of «multitude» is a liberal one. Then, I will analyze the connection between the multitude and class-working class, so as to highlight that in Negri’s theory there is not an (...) opposition between those categories. Finally, the last paragraph will examine the forms of the «multitudinarian class struggle» and the hiatus existing between will and potentiality of the multitude related to the issue, still not resolved, of its organization. Relies on two historical events: the framing of the universal declaration of human rights and recent emphasis on global justice. Suggests that power and moral authority of human rights does not depend on a previous thorough consideration of this notion, and also that this authority is not compatible with any theory. Because of its enduring stability in experimental application, physics has today reached heights that not only inspire wonder, but arguably exceed the limits of intuitive (...) vision, if not intuitive comprehension. For many physicists and philosophers, however, the currently fashionable tendency toward exotic interpretation of the theoretical formalism is recognized not as a mark of ascent for the tower of physics, but rather an indicator of sway—one that must be dampened rather than encouraged if practical progress is to continue. -/- In this unique two-part volume, designed to be comprehensible to both specialists and non-specialists, the authors chart out a pathway forward by identifying the central deficiency in most interpretations of quantum mechanics: That in its conventional, metrical depiction of extension, inherited from the Enlightenment, objects are characterized as fundamental to relations—i.e., such that relations presuppose objects but objects do not presuppose relations. The authors, by contrast, argue that quantum mechanics exemplifies the fact that physical extensiveness is fundamentally topological rather than metrical, with its proper logico-mathematical framework being category theoretic rather than set theoretic. -/- By this thesis, extensiveness fundamentally entails not only relations of objects, but also relations of relations. Thus, the fundamental quanta of quantum physics are properly defined as units of logico-physical relation rather than merely units of physical relata as is the current convention. Objects are always understood as relata, and likewise relations are always understood objectively. In this way, objects and relations are coherently defined as mutually implicative. The conventional notion of a history as “a story about fundamental objects” is thereby reversed, such that the classical “objects” become the story by which we understand physical systems that are fundamentally histories of quantum events. -/- These are just a few of the novel critical claims explored in this volume—claims whose exemplification in quantum mechanics will, the authors argue, serve more broadly as foundational principles for the philosophy of nature as it evolves through the twenty-first century and beyond. La naturaleza del ordenamiento jurídico ecuatoriano contempla derechos fundamentales y busca implementar nuevos derechos que han ido surgiendo en los últimos años. Sin embargo, estas acciones deben respetar los derechos fundamentales ya establecidos, un área de particular tensión es el conflicto entre el derecho al acceso a la información, específicamente los procesos judiciales y el derecho al olvido. La investigación buscó, por tanto, analizar cómo Ecuador, a través de leyes como la Ley Orgánica de Protección de Datos Personales o el (...) Código Orgánico de la Función Judicial busca equilibrar el alcance e intereses de estos derechos; para ello se requirió al uso de leyes, normas y doctrinas para su análisis que, junto al método sintético-analítico, inductivo y deductivo sirvieron para comprender y delimitar de mejor manera los temas objeto de estudio y la información en general. La presente investigación tiene como objetivo desarrollar un método para la evaluación del derecho de publicidad de procesos contra el reconocimiento del derecho al olvido en un ecuador constitucional. Se examinó la implementación del derecho al olvido, definición de información pública y el principio de publicidad, concluyendo que, Ecuador enfrenta el reto de desarrollar un marco legal sólido que proteja tanto la transparencia y rendición de cuentas como la privacidad y la dignidad de las personas en la era digital. Los jueces y legisladores deben considerar cuidadosamente los casos concretos y buscar soluciones que equilibren estos derechos fundamentales. (shrink)

El presente estudio analiza el avance del populismo penal en Ecuador, tomando en cuenta los últimos índices de violencia, las reformas constitucionales más recientes y los lineamientos para un correcto desarrollo de la política criminal. Se busca contribuir a un debate informado en la academia sobre este tema crucial para la seguridad pública y la justicia en el país, en este momento de coyuntura social en el que el populismo penal ha tomado auge en Ecuador. La presente investigación tiene como (...) objetivo desarrollar un método neutrosófico para la evaluación del avance del populismo penal en Ecuador. Se caracteriza por reformas legislativas que endurecen las penas, amplían el catálogo de delitos y restringen los beneficios penitenciarios. Si bien estas medidas pueden generar una sensación de falsa seguridad en la población, no abordan las causas estructurales de la criminalidad y, en muchos casos, tienen consecuencias negativas en los derechos humanos y la reincidencia delictiva.
