El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. A key premise of the kalam cosmological argument is that the universe began to exist. However, while a number of philosophers have offered powerful criticisms of William Lane Craig’s defense of the premise, J.P. Moreland has also offered a number of unique arguments in support of it, and to date, little attention has been paid to these in the literature. In this paper, I attempt to go some way toward redressing this matter. The reward system of science is the priority rule. The first scientist making a new discovery is rewarded with prestige, while second runners get little or nothing. Michael Strevens, following Philip Kitcher, defends this reward system, arguing that it incentivizes an efficient division of cognitive labor. I argue that this assessment depends on strong implicit assumptions about the replicability of findings. I question these assumptions on the basis of metascientific evidence and argue that the priority rule systematically discourages replication. My (...) analysis leads us to qualify Kitcher and Strevens’s contention that a priority-based reward system is normatively desirable for science. (shrink)

The philosophy of perception has been mostly focused on vision, to the detriment of other modalities like audition or olfaction. In this paper I focus on olfaction and olfactory experience, and raise the following questions: is olfaction a perceptual-representational modality? If so, what does it represent? My goal in the paper is, firstly, to provide an affirmative answer to the first question, and secondly, to argue that olfaction represents odors in the form of olfactory objects, to which olfactory qualities are (...) attributed. In order to do this I develop an empirically adequate notion of olfactory object that is sensitive to the peculiarities of olfaction, and defend it against various objections. (shrink)

In recent years, the advent of Artificial Intelligence (AI) has profoundly reshaped the way we access and utilize humanity's vast reservoir of knowledge. Equipped with this powerful tool, I have undertaken a thorough exploration of the Human Mind, motivated by a growing concern: the evident decline in students' enthusiasm for learning. More specifically, as a professor and researcher, my need for understanding has driven me to explore in depth what defines us as Human beings and what sets us apart from (...) other species. This investigative journey prompted me to reevaluate the evolutionary process, revisit Darwin's theories, and contemplate fundamental questions regarding the nature of time and reality. These reflections ultimately culminated in the formulation of a concept we call the ``Total Universe", a realm in which all possible events and interactions coexist. Building on this concept, we formulated a Theory of Consciousness rooted in the exploration of this Universe through our minds. This culminated in the emergence of the ``World of the Mind", which represents Human reality within the Total Universe, the fusion of all existing Human realities. Importantly, this theory not only integrates various theories of consciousness but also provides a clear framework for understanding what it might mean for Artificial Intelligence to attain consciousness. Hence, I invite you to embark on this journey of reflection, guided by this collection of written codes that encapsulate the discoveries made within the Total Universe through my mind, my reality. My perspective may resonate with yours, or it may not, and both are entirely valid. After all, each individual inhabits their own unique reality. (shrink)

El Realismo Especulativo, Nuevo Realismo o Realismo Postcontinental es una corriente ecléctica que viene a superar las aporías e insuficiencias de la filosofía continental desde una perspectiva a la que se le podrían achacar los mismos problemas que la perspectiva idealista y constructivista de los filósofos continentales. Para el desarrollo de la filosofía es importante entablar conversación los autores de este movimiento. En el presente artículo se presenta una aproximación a los aciertos e insuficiencias de las ontologías de dos autores (...) de la corriente como son Markus Gabriel y Graham Harman. Se presentan los aciertos e insuficiencias del realismo neutro de Markus Gabriel y de la Ontología Orientada a los Objetos, en este orden. En el último epígrafe, a modo de conclusiones, se señalan los puntos en común de las ontologías y se aporta la idea de acontecimiento como línea de investigación que supere las aporías que emergen de la contraposición entre el idealismo y realismo. Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. This collection highlights the new trend away from rationalism and toward empiricism in the epistemology of modality. Accordingly, the book represents a wide range of positions on the empirical sources of modal knowledge. Readers will find an introduction that surveys the field and provides a brief overview of the work, which progresses from empirically-sensitive rationalist accounts to fully empiricist accounts of modal knowledge. Early chapters focus on challenges to rationalist theories, essence-based approaches to modal knowledge, and the prospects for naturalizing (...) modal epistemology. The middle chapters present positive accounts that reject rationalism, but which stop short of advocating exclusive appeal to empirical sources of modal knowledge. The final chapters mark a transition toward exclusive reliance on empirical sources of modal knowledge. They explore ways of making similarity-based, analogical, inductive, and abductive arguments for modal claims based on empirical information. Modal epistemology is coming into its own as a field, and this book has the potential to anchor a new research agenda. (shrink)

It’s constitutive of classical theism that there is a necessarily existent personal god who is also the creator of the universe, where the latter claim includes at least the following three theses: (i) God is wholly distinct from the natural world; (ii) God is the originating or sustaining cause of the natural world; and (iii) God created the natural world ex nihilo, i.e., without the use of pre-existing materials. Call this tripartite component of classical theism the classical view of creation. (...) In this paper, I offer a new argument against classical theism. In particular, I argue that creation ex nihilo is prima facie impossible, and that since the doctrine of creation ex nihilo is constitutive of classical theism, classical theism is false. (shrink)

Neste trabalho, investigo a possibilidade de compatibilidade entre o pessimismo filosófico e a compreensão da morte como um mal para quem morre. Por pessimismo filosófico, compreendo a doutrina filosófica que mantém como tese fundamental que a não-existência é preferível à existência, de modo que o pessimismo é tomado como a filosofia de que a vida não vale a pena ser vivida. Por mal da morte, me refiro à compreensão da morte como um dano para o indivíduo que morre, cujo pressuposto (...) em diferentes abordagens contemporâneas é o de que a morte só é um mal no caso de continuar existindo ser preferível a deixar de existir. Desse modo, o problema discutido é a aparente incompatibilidade entre a tese de que a não-existência é preferível à existência e a tese de que continuar existindo é preferível a deixar de existir. Busco demonstrar que essa (in)compatibilidade depende do modo como fundamentamos o pessimismo filosófico. Para tanto, examino dois argumentos para o pessimismo filosófico e suas implicações para o mal da morte: o argumento a priori de Arthur Schopenhauer e o argumento da assimetria de David Benatar. Concluo que o primeiro desses argumentos nos leva para a conclusão de que a morte não é um mal, mas que o segundo argumento compatibiliza o pessimismo filosófico e a compreensão da morte como um mal para quem morre. The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. While most people believe the best possible life they could lead would be an immortal one, so‐called “immortality curmudgeons” disagree. Following Bernard Williams, they argue that, at best, we have no prudential reason to live an immortal life, and at worst, an immortal life would necessarily be bad for creatures like us. In this article, we examine Bernard Williams' seminal argument against the desirability of immortality and the subsequent literature it spawned. We first reconstruct and motivate Williams' somewhat cryptic argument (...) in three parts. After that, we elucidate and motivate the three best (and most influential) counterarguments to Williams' seminal argument. Finally, we review, and critically examine, two further distinct arguments in favor of the anti‐immortality position. (shrink)

Are norms of inquiry in tension with epistemic norms? I provide a (largely) negative answer, turning to a picture of epistemic practices as rule-governed games. The idea is that, while epistemic norms are correctness standards for the attitudes involved in epistemic games, norms of inquiry derive from the aims of those games. Attitudes that, despite being epistemically correct, are inadvisable regarding the goals of some inquiry are just like bad (but legal) moves in basketball or chess. I further consider cases (...) in which the aims of inquiry recommend breaking epistemic norms. I compare them to strategic infractions, which are common in many coherent games. Finally, I explore the connections between rules and aims in games and in inquiry. I show that in both cases respecting the rules is constitutively required for satisfying the aims of the practice. Workplace democracy is often advocated on two intertwined views. The first is that the authority relation of employee to firm is akin to that of subject to state, such that reasons favoring democracy in the state may likewise apply to the firm. The second is that, when democratic controls are absent in the workplace, employees are liable to objectionable forms of subordination by their bosses, who may then issue arbitrary directives on matters ranging from pay to the allocation of overtime (...) and to relocation and promotion. Daniel Jacob and Christian Neuhäuser have recently submitted these views to careful criticism. They argue that the parallel between firms and states is unwarranted. For, unlike managerial authority, state authority is final. The state grants firms their legal status and subjects their authority to its regulations, which citizens in democracies already control. And they also argue that suitable workplace regulation alongside meaningful exit options may suffice to prevent, with no need for democratization, objectionable forms of workplace subjection. Neither view offers, they resolve, compelling reasons to believe that justice requires that firms be democratic. I here inspect these criticisms in turn, and offer reasons for skepticism. (shrink)

The logos question, one of the most important among the subjects that traverse the Plato's Sophist, has in fact some different aspects: the criticism of father Parmenides' logos, that is unable to speak about the not-being, but also about the being; the relations between logos and its cognates, phantasia, doxa and dianoia; the logos’ complex structure, that is a compound with onoma and rema; the difference between naming and saying, two distinct but inseparable actions; the logical and ontological conditions that (...) make possible to say the truth, or to lie or simply to joke; the necessity of a most flexible logos that allows us to speak about the not-being, and about the being, but at the same time is a logos dangerously similar to the sophist’ one; finally, the identity between the power to produce “spoken images” and the very power to speak. The aim of the present article is giving a systematical view of the matter that grasps all these faces. (shrink)

This is a challenge to one of the cen-tral interpretational theses that Cirne-Lima de-fends on Hegel: that we should read “contradic-tion” as “contrariety”. At first, I reconstruct Cirne-Lima’s interpretation and raise two cri-tiques: (I) Cirne-Lima ignores the origin of the concept “contradiction” as applied to statements of conceptual identity; (ii) Cirne-Lima only pays attention to one type of incompatibility involved in the “negation” that constitutes contradiction and forgets Hegel’s thesis on the “bound return to the ground”. In the final parts (...) of my paper, I dis-cuss the consequences of Cirne-Lima’s interpre-tation. The consequence of (i) is the development of an interpretation that doesn’t regard anything beyond what Hegel calls “external reflection” (“isof predication”) and ignores the role of “contra-diction” in “inner reflection” (“is of identity”). That of (ii) is the interpretation of “contradiction” as a mere “play of opposites”. I suggest that this last constraint is analogous to what Brandom calls “material incompatibility” and completely misses one of the main dimensions of Hegel’s “negative”: self-reference. To support my argu-ment (i) I rely on Pippin's remarks on the Logic of Essence and, in the case of (ii), Henrich’s the-sis, which Bordignon followed to criticize Bran-dom, that to be self-referential is a constitutive di-mension of “determinate negation”. It is common in psychiatry and other sciences to describe an individual or a type of individual in terms of its disposition to manifest specific effects in a particular range of circumstances. According to one understanding, dispositions are statistical regularities of an individual or type of individual in specific circumstances. According to another understanding, dispositions are properties of individuals in virtue of which such regularities hold. This entry considers a number of ways of making each of these senses of disposition (...) more precise while discussing a number of dangers lurking in careless use of the concept of a disposition. Besides the general agreement about the human capability of reflection, there is a large area of disagreement and debate about the nature and value of “reflective scrutiny” and the role of “second-order states” in everyday life. This problem has been discussed in a vast and heterogeneous literature about topics such as epistemic injustice, epistemic norms, agency, understanding, meta-cognition etc. However, there is not yet any extensive and interdisciplinary work, specifically focused on the topic of the epistemic value of reflection. This (...) volume is one of the first attempts aimed at providing an innovative contribution, an exchange between philosophy, epistemology and psychology about the place and value of reflection in everyday life. -/- Our goal in the next sections is not to offer an exhaustive overview of recent work on epistemic reflection, nor to mimic all of the contributions made by the chapters in this volume. We will try to highlight some topics that have motivated a new resumption of this field and, with that, drawing on chapters from this volume where relevant. -/- Two elements defined the scope and content of this volume, on the one hand, the crucial contribution of Ernest Sosa, whose works provide original and thought-provoking contributions to contemporary epistemology in setting a new direction for old dilemmas about the nature and value of knowledge, giving a central place to reflection. On the other hand, the recent developments of cultural psychology, in the version of the “Aalborg approach”, reconsider the object and scope of psychological sciences, stressing that “[h]uman conduct is purposeful”. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In his Religion within the Limits of Reason Alone, Kant speaks about a radical evil present in the human being, a tendency to place before the desire with regard to the rational duty, which is impossible to tear up by the roots from the human nature. In The revolt of the masses, Ortega also speaks about an evil that is anyway present in the so called mass-man, in each one of us, (...) and that is not to eradicate. The temporality of human action is very peculiar: different from the cosmic time and even paradoxical, inasmuch as it is really a circular time. The aim of this essay is to study this circularity in the sphere of human activity through the relations between the notions of potency and habit in the Aristotelian Ethics, among others structural conditions of the action. These structural conditions are explored by Aristotle as those which make possible to judge the actions.

This article analyzes the epistemological legitimation of mathematics in natural philosophy in the seventeenth century. In the Renaissance it was claimed that mathematics does not meet the Aristotelian criteria of scientificity, and that it did not explain the efficient and final causes. So, its critics, inspired by the Aristotelian tradition, rejected the first attempts to mathematize natural philosophy. The epistemological conditions involved in the debate are examined on the scientific nature of mathematics and its relevance to natural philosophy. A historiographical (...) tour of the mathematization of nature is made to provide new weighing elements with respect to a historically and philosophically more conceptual characterization of the emergence of modern science. Despite renewed interest in work, philosophers have largely ignored self-employment. This neglect is surprising, not just because self-employment was central to classic philosophizing about work, but also given that half of the global workforce today, including one in seven workers in OECD countries, are self-employed. We start off by offering a definition of self-employment, one that accounts for its various forms while avoiding misclassifying dependent self-employed workers as independent contractors, and by mapping the barriers to becoming and remaining self-employed (section (...) 2). We then examine five arguments why governments ought to promote self-employment, despite the forgone opportunities to promote employee work instead that this often entails (sections 3-7): the argument from job creation, the argument from job satisfaction, the argument from independence, the argument from occupational freedom, and the argument from subsistence under non-ideal circumstances. Some of these are unconvincing, we argue, but others are not. Although the strength of the latter arguments hangs on various context-dependent conditions, such that they need to be carefully weighed against considerations of efficiency and equality, they nonetheless offer compelling pro tanto reasons to promote, and not just to protect, self-employment. Em meio à chamada “virada biológica” dos estudos aristotélicos, seguiremos a hipótese levantada por alguns comentadores de que a Poética de Aristóteles partilha do modelo biológico estrutural de seu pensamento, o que implica que também a poesia possuiria uma “história natural”. Sendo assim, o propósito deste artigo é o de pensar a comédia a partir deste paradigma. O texto dividir-se-á em duas partes principais: primeiramente, apresentaremos evidências que corroboram a hipótese de que a Poética foi escrita tendo como modelo estrutural (...) a biologia de Aristóteles e, por conta disso, deve ser lida tendo isso como pano de fundo. Em segundo lugar, aplicaremos esse modelo de pensamento à comédia, de modo a conjecturar o que seria plenamente a arte cômica numa perspectiva aristotélica. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

In this paper, I defend a non-mechanistic interpretation of Kant's philosophy of nature. My interpretation contradicts the robust tradition of reading Kant as a mechanist about nature – or as someone who endorses the view that we can know the internally purposive causality characteristic of organisms has no place in nature. By attending closely to Kant's remarks about the possibility of internal purposiveness in nature and to key premises from Kant's arguments in the Antinomy of Teleological Judgment, we shall see (...) that it is not only plausible, but preferable, to believe that internally purposive things (i.e., organisms) exist in nature. Making room for such a belief leaves Kant with a philosophy of nature that simultaneously aligns with and surpasses the philosophies of nature offered up by his Early Modern predecessors. (shrink)

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

En este ensayo argumento que, en la ontología social de John Searle, existe un círculo virtuoso entre la cooperación, las instituciones y los poderes deónticos. Son categorías de la realidad social que se retroalimentan y fortalecen mutuamente. La primera sección es introductoria a los conceptos y problemas aquí tratados, mientras que la segunda versa sobre el abecé de la ontología social. En la tercera sección abordo cómo las instituciones están ligadas a prácticas sociales; es decir, las primeras de alguna manera (...) sintetizan la existencia de las segundas. Sin instituciones no podría haber ciertas prácticas, y estas necesariamente llevan a la creación de instituciones. Finalmente, en la última sección argumento acerca de la existencia de un círculo virtuoso entre la cooperación (y la confianza), las instituciones y los poderes deónticos en la realidad social. Es decir, sostengo que existe un fenómeno de retroalimentación y de fortalecimiento mutuo, en tanto la existencia de una categoría fortalece la existencia de las demás categorías. (shrink)

This article proposes a teleological ethical approach for the analysis of the conflict between the right to the city and the right to tourism. Unlike the understanding of this conflict through a deontological lens, which is based on universal and unconditioned moral duties, a teleological perspective allows us to observe much more underlying and intricate problems that can arise in any cultural and socio-historical context of each tourist city. By taking the teleological model of the philosopher Alasdair MacIntyre as a (...) starting point, the article suggests the basis of a framework for an ethical understanding of the complexity of teleological conflicts that can appear in the pursuit of situated internal goods —sought cooperatively— and external goods— sought competitively— within and between social practices related to both rights. In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. Si bien en la filosofía de las ciencias ya se han explorado algunos ejemplos provenientes de la bioquímica como casos de estudio, la filosofía de la bioquímica es una subdisciplina naciente. En este artículo estudiaremos dos problemas filosóficos de relevancia contemporánea en esta ciencia. Por un lado, examinaremos las bases epistemológicas del problema del plegamiento de proteínas. En particular lo relacionado con la predicción de la estructura tridimensional de las proteínas a partir de su secuencia, asunto que ha dado mucho (...) que hablar debido a los nuevos avances utilizando deep learning. Por otro lado, exploraremos el problema in-vitro/in-vivo y, más generalmente, el problema de la extrapolación en las ciencias biológicas. Finalmente, a partir de las consecuencias de ambos temas consideraremos algunas reflexiones filosóficas generales acerca del reduccionismo, el pluralismo y el lugar de la bioquímica en las ciencias biológicas. O presente trabalho tem por finalidade analisar, a partir do livro V da obra Ethica Nicomachea, se a justiça poderia ser tomada como um meio que irá auxiliar os cidadãos a desenvolver plenamente as suas virtudes. Buscar-se-á fundamentar que é através da justiça que os bons cidadãos seriam formados, bem como o bom caráter seria cultivado. Analisar-se-á, também, ainda que minimamente, o que Aristóteles entende de fato por justiça, de que o justo seria dar a cada um o que lhe (...) é devido, o que merece, haja vista que essa afirmação traz consigo um peso muito grande, pois nos faz indagar sobre o que seria o devido de cada indivíduo, bem como quais seriam as bases relevantes do mérito. Isto é, se o justo é dar a cada um o que lhe é devido, cabe a nós nos perguntarmos de que forma e critério seria usado na distribuição. De certa forma, ao raciocinarmos sobre justiça e direitos, consequentemente temos de raciocinar sobre a finalidade, o objetivo, o telos das atividades que circundam a vida social na Pólis. Buscar-se-á discutir sobre os temas apresentados, porém não se tem por finalidade propor medidas para pôr um fim na discussão. (shrink)

Neste artigo, analiso três casos que foram propostos na literatura filosófica como contraexemplos à abordagem dos interesses relativos ao tempo do dano da morte, buscando demonstrar como eles podem ser respondidos. Para tanto, o texto divide-se em quatro seções. Na primeira, introduzo as teses fundamentais da abordagem dos interesses relativos ao tempo sobre o que determina a magnitude do dano decorrente da morte para quem morre, tal como formulado por Jeff McMahan (2002). Na seção seguinte, explico dois pressupostos centrais dessa (...) abordagem, a saber, que a identidade pessoal não é o que fundamenta nossas razões de preocupação egoísta com o futuro e que a unidade psicológica consta entre as relações que fundamentam essa preocupação. Na terceira seção, apresento os (possíveis) contraexemplos, sendo eles o Caso da morte futura (Broome, 2004), o Caso da operação no cavalo Tommy (Harman, 2011) e o Caso do mal maior (Cunha, 2023). Na seção final, defendo que esses casos podem ser respondidos a partir da consideração moral e prudencial de determinados interesses relativos ao tempo futuro. (shrink)

El concepto de desarrollo humano del Programa de las Naciones Unidas para el Desarrollo (PNUD) surge en 1990 como una crítica a la consideración de la economía como el fin último de los esfuerzos del desarrollo. En la visión del PNUD, la economía es considerada un fin relativo, es decir, un fin y un medio para el desarrollo humano. Al considerar, por su parte, el fin del desarrollo humano, este es identificado con el ensanchamiento de las opciones y libertades de (...) que gozan los individuos. En este sentido, este concepto de desarrollo humano hace alusión a una práctica política más que a un entendimiento ético-ontológico del ser humano, evitando referirse a desarrollo humano entendido como un desarrollo del ser humano. Este artículo explora los antecedentes del concepto del desarrollo humano del PNUD y los fines que consideran estos enfoques previos. Se observa que la consideración subjetivista del PNUD proviene de la teoría de Amartya Sen, quien queda sujeto a la crítica objetivista de Martha Nussbaum al no considera un fin objetivo para los asuntos humanos, crítica que puede de igual manera aplicarse al concepto de desarrollo humano del PNUD. During the first half of the twentieth century, many philosophers of memory opposed the postulation of memory traces based on the claim that a satisfactory account of remembering need not include references to causal processes involved in recollection. However, in 1966, an influential paper by Martin and Deutscher showed that causal claims are indeed necessary for a proper account of remembering. This, however, did not settle the issue, as in 1977 Malcolm argued that even if one were to buy Martin (...) and Deutscher’s argument for causal claims, we still don’t need to postulate the existence of memory traces. This paper reconstructs the dialectic between realists and anti-realists about memory traces, suggesting that ultimately realists’ arguments amount to inferences to the best explanation. I then argue that Malcolm’s anti-realist strategy consists in the suggestion that causal explanations that do not invoke memory traces are at least as good as those that do. But then, Malcolm, I argue that there are a large number of memory phenomena for which explanations that do not postulate the existence of memory traces are definitively worse than explanations that do postulate them. Next, I offer a causal model based on an interventionist framework to illustrate when memory traces can help to explain memory phenomena and proceed to substantiate the model with details coming from extant findings in the neuroscience of memory. Aristotle's General Definition of the Syllogism may be taken as consisting of two parts: the Inferential Conditions and the Final Clause. Although this distinction is well known, traditional interpretations neglect the Final Clause and its influence on syllogistic. Instead, the aforementioned tradition focuses on the Inferential Conditions only. We intend to show that this neglect has severe consequences not just on syllogistic but on the whole exegesis of Aristotle's Prior Analytics I. Due to these consequences, our objective is to analyse (...) the General Definition's Final Clause and its consequences on syllogistic. We propose a reading of the Final Clause as an additional criterion for distinguishing some arguments as properly syllogistic ones and as a main theme which connects all parts of the Prior Analytics I into one coherent piece of work. Many philosophical discussions hinge on the concept of knowability. For example, there is a blooming literature on the so-called paradox of knowability. How to understand this notion, however? In this paper, we examine several approaches to the notion: the naive approach to take knowability as the possibility to know, the counterfactual approach endorsed by Edgington (1985) and Schlöder (2019) , approaches based on the notion of a capacity or ability to know (Fara 2010, Humphreys 2011), and finally, approaches that make (...) use of the resources of dynamic epistemic logic (van Benthem 2004, Holliday 2017). Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Según la versión estándar del juego de la imitación, la determinación del sexo de los participantes no desempeña ningún papel en el testeo de la inteligencia de máquina. Desafortunadamente, tal simplificación soslaya la teoría de la mente que fundamenta dicho juego. Teniendo en consideración este problema, en este ensayo argumento en contra de la simplificación del Test de Turing. En efecto, tal como sostengo, la determinación del sexo de los participantes no debe obviarse: la mente de una mujer y su (...) inteligencia son imitables y no dependen de realización física específica. Esto ocurre porque el funcionalismo de Turing supone un vínculo entre imitación, engaño y aprendizaje, tres claves para que el proyecto de la Inteligencia Artificial tenga éxito. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga.
