The methodology title on BMF analytics is now in its third year of service to our research community, enabling many researchers to implement their research pursuits.

In this field questions arise which are certainly difficult; but as I listened last time to members of the group, I felt that the main difficulty perhaps lay in determining precisely what questions we are trying to answer. I have the conviction that if we could only say clearly what the questions are, the answers to them might not appear so elusive. So I have begun with a simple list of questions about discretion which in one form or another were, (...) as it seemed to me, expressed by the group last time. I may indeed have omitted something and inserted something useless: if so, no doubt I shall be informed of this later. The central questions then seem to me to be the following: 1. What is discretion, or what is the exercise of discretion? 2. Under what conditions and why do we in fact accept or tolerate discretion in a legal system? 3. Must we accept discretion or tolerate discretion, and if so, why? 4. What values does the use of discretion menace, and what values does it maintain or promote? 5. Wilson è sempre stato uno dei miei eroi -- non solo un biologo eccezionale, ma uno della piccola e svanire minoranza di intellettuali che almeno osa accennare alla verità sulla nostra natura che gli altri non riescono a cogliere, o nella misura in cuisi trovano, evitano scrupolosamente per l'opportunità politica. In this brief introduction, I shall rather reflect, from a biographer’s viewpoint, on the significance of Discretion for our understanding of the trajectory of Hart’s ideas and on the significance of his year at Harvard. I shall then move on to consider the intriguing question of why Hart did not subsequently publish or build on some of the key insights in the paper itself. Here I highlight the fact that, almost uniquely in Hart’s work, Discretion features a notable emphasis (...) on the significance of institutional factors in our understanding of the nature of legal decisionmaking; and I argue that Hart’s failure fully to develop this insight in the essay, or to build on it in his subsequent work, derives from the fact that such a development would have necessitated a diversion from the philosophical issues that were his core intellectual concern, and moreover would have presented certain dangers to his conception of legal positivism. I shall conclude by considering what contribution the essay makes to our overall interpretation and evaluation of Hart’s legal philosophy. (shrink)

This Essay analyzes an essay by H. L. A. Hart about discretion that has never before been published, and has often been considered lost. Hart, one of the most significant legal philosophers of the twentieth century, wrote the essay at Harvard Law School in November 1956, shortly after he arrived as a visiting professor. In the essay, Hart argued that discretion is a special mode of reasoned, constrained decisionmaking that occupies a middle ground between arbitrary choice and determinate rule (...) application. Hart believed that discretion, soundly exercised, provides a principled way of coping with legal indeterminacy that is fully consistent with the rule of law. This Essay situates Hart’s paper – Discretion – in historical and intellectual context, interprets its main arguments, and assesses its significance in jurisprudential history. In the context of Hart’s work, Discretion is notable because it sketches a theory of legal reasoning in depth, with vivid examples. In the context of jurisprudential history, Discretion is significant because it sheds new light on long-overlooked historical and theoretical connections between Hart’s work and the Legal Process School, the American jurisprudential movement dominant at Harvard during Hart’s year as a visiting professor. Alison L. LaCroix is Assistant Professor of Law at the University of Chicago Law School, where she specializes in legal history, federalism, constitutional law and questions of jurisdiction. She has written a fine, scholarly volume on the intellectual origins of American federalism. LaCroix holds the JD degree (Yale, 1999) and a Ph.D. in history (Harvard, 2007). According to the author, to fully understand the origins of American federalism, we must look beyond the Constitutional Convention of 1787 and range over (...) the colonial, revolutionary, and founding periods including developments in the early republic. LaCroix questions both the idea that American federalism originated, all at once, at the Constitutional Convention of 1787 and the idea that republican ideology (with its strong emphasis on legislative power) was the single dominant framework of eighteenth-century American political thought. The content of this paper is an elaboration of Hubert L. Dreyfus’s philosophical critique of Artificial Intelligence (AI), computers and the internet. Hubert L. Dreyfus (1929-2017) is Ua SA philosopher and alumni of Harvard University who teach at the Massachusetts Institute of Technology (MIT) and University of California, Berkeley. He is a phenomenological philosopher who criticize computer researchers and the artificial intelligence community. In 1965, Dreyfus wrote an article for Rand Corporation titled “Alchemy and Artificial Intelligence” which criticizes the (...) masterminds of Artificial Intelligence. Dreyfus also criticized the order of computers via two books: (1) What Computers Can’t Do (1972) and (2) What Computers Stills Can’t Do (1992). He favored human intuition rather than the computer logic in his book Mind over Machine: The Power of Human Intuition and Expertise in the Era of the Computer (1986). In 2001, Dreyfus wrote a book On the Internet, which considers the prominent phenomenon in the recent Industry 4.0. By elaborating on Dreyfus’s philosophy on the computer, artificial intelligence, and the internet, we will know the philosophical debate on the result of industry 3.0 (computer and artificial intelligence) and 4.0 (artificial intelligence and internet). Depuis Gintis est un économiste senior et j’ai lu certains de ses livres précédents avec intérêt, je m’attendais à un peu plus de perspicacité dans le comportement. Malheureusement, il fait les mains mortes de la sélection de groupe et la phénoménologie dans les pièces maîtresses de ses théories du comportement, et cela invalide en grande partie le travail. Pire encore, puisqu’il montre un si mauvais jugement ici, il remet en question tout son travail précédent. La tentative de ressusciter la sélection (...) de groupe par ses amis à Harvard, Nowak et Wilson, il y a quelques années, c’était l’un des principaux scandales en biologie au cours de la dernière décennie, et j’ai raconté la triste histoire dans mon article 'Altruism, Jesus and the End of the World-how the Templeton Foundation bought a Harvard Professorship and attacked Evolution, Rationality and Civilization -- A review of E.O. Wilson 'The Social Conquest of Earth' (2012) et Nowak and Highfield 'SuperCooperators' (2012).' Contrairement à Nowak, Gintis ne semble pas être motivé par le fanatisme religieux, mais par le fort désir de générer une alternative aux sombres réalités de la nature humaine, facilitée par le manque (quasi universel) de compréhension de la biologie humaine fondamentale et le slateisme vierge des scientifiques comportementaux, d’autres universitaires et du grand public. Gintis attaque à juste titre (comme il l’a fait à maintes reprises) les économistes, les sociologues et d’autres scientifiques du comportement pour ne pas avoir un cadre cohérent pour décrire le comportement. Bien sûr, le cadre nécessaire pour comprendre le comportement est évolutif. Malheureusement, il ne parvient pas à en fournir un lui-même (selon ses nombreux critiques et je suis d’accord), et la tentative de greffer le cadavre pourri de la sélection de groupe sur toutes les théories économiques et psychologiques qu’il a généré dans ses décennies de travail, n’a fait qu’invalider tout son projet. Bien que Gintis fasse un vaillant effort pour comprendre et expliquer la génétique, comme Wilson et Nowak, il est loin d’être un expert, et comme eux, le calcul l’aveugle juste aux impossibilités biologiques et bien sûr c’est la norme en science. Comme Wittgenstein l’a noté sur la première page de la culture et de la valeur « Il n’y a pas de dénomination religieuse dans laquelle l’utilisation abusive des expressions métaphysiques a été responsable de tant de péchés qu’il l’a en mathématiques. » Il a toujours été clair que un gène qui provoque un comportement qui diminue sa propre fréquence ne peut pas persister, mais c’est le cœur de la notion de sélection de groupe. En outre, il a été bien connu et souvent démontré que la sélection de groupe réduit juste à la condition physique inclusive (sélection de parents), qui, comme Dawkins l’a noté, est juste un autre nom pour l’évolution par sélection naturelle. Comme Wilson, Gintis a travaillé dans cette arène pendant environ 50 ans et n’a toujours pas compris, mais après le scandale a éclaté, il ne m’a fallu que 3 jours pour trouver, lire et comprendre le travail professionnel le plus pertinent, comme détaillé dans mon article. Il est ahurissant de se rendre compte que Gintis et Wilson n’ont pas été en mesure d’y parvenir en près d’un demi-siècle. Je discute des erreurs de sélection de groupe et de phénoménologie qui sont la norme dans le milieu universitaire comme des cas spéciaux de l’échec quasi universel de comprendre la nature humaine qui détruisent l’Amérique et le monde. The archaeological record is very limited and its analysis has been contentious. Hence, molecular biologists have shifted their attention to molecular dating techniques. Recently on April 2013, the prestigious Cell Press Journal Current Biology published an article (Fu et al. 2013) entitled “A Revised Timescale for Human Evolution Based on Ancient Mitochondrial Genomes”. This paper has twenty authors and they are researchers from the world’s top institutes like Max Planck Institute, Harvard, etc. Respected authors of this paper have emphatically (...) accepted that the fossil record is inadequate and unreliable. These statements clearly substantiate that now biologists are agreeing that fossil records do not provide any significant evidence at all for conventional evolution theory. Despite the well-recorded fact of the continual grand propaganda of Darwinism based on fossil evidence for more than 150 years, in recent times biologists are surprisingly coming up with such statements, based on their confidence that evolution can be explained purely by the genealogical/genomic record provided by modern molecular biology. Still many respected journals (for example the article in Nature, Retallack, 2013) continue to publish articles on fossil evidence to support Darwinian evolution. These incoherently diverse claims prove that Darwinists are struggling with unscientific ideological approaches to explain biodiversity. Darwinian evolutionary theory is not only the basis of modern biology, but also acts as the guiding principle of science and intellectual reasoning for modern civilization. Hence, a scientific understanding of the breakdown of the Darwinian theory of objective evolution is very important for overcoming the traditional scientific temper of mechanistic intellectualism that characterizes this ideology. In my article “21st Century Biology Refutes Darwinian Abiology” (published in two parts in November and December 2012 issues of The Harmonizer: www.mahaprabhu.net/satsanga/harmonizer) it was noted that several recent findings challenge the credibility that random mutations and natural selection can provide a valid basis for justifying the naturalistic evolution of species. The present article summarizes the problems associated with the fossil record and dating techniques, and its implication on the neo-Darwinian mechanistic misconception of biological life as mere molecular chemistry or abiology. An alternative approach based on the Vedāntic view for explaining biodiversity in the light of 21st century biology is also discussed in the end of the article. (shrink)

Guerra Civil Americana), que ocorreu entre 1861 e 1865 e gerou ressentimentos e atritos entre a população do sul e a do norte dos Estados Unidos. -/- Em contrapartida, houve a urbanização das terras do oeste e das áreas centrais do país, o que contribuiu para o crescimento da economia e a expansão industrial. No norte, graças ao esforço de guerra, houve um grande crescimento, principalmente na metalurgia, no transporte ferroviário, na indústria de armamentos e na indústria naval. O comércio também se expandiu de maneira exponencial em todo o território estadunidense. -/- O padrão de cultura dos Estados Unidos passou a ser o ideal nortista de “trabalho duro, educação e liberdade econômica a todos”. Houve ainda um grande desenvolvimento de escolas e instituições de ensino superior. -/- O segundo grande evento que marcou a história estadunidense foi a chegada em massa de estrangeiros. Entre 1860 e 1900, os Estados Unidos passaram de país agrícola, com população em torno de 4 milhões, para país industrial, com uma das maiores economias do mundo e com 75 milhões de habitantes. -/- O incremento populacional e a industrialização redundaram em um processo de urbanização sem precedentes que continuou até a década de 1930. Para se ter uma ideia, em 1860 viviam em Chicago 102 260 pessoas; em 1900, a população da cidade passou a 1 698 575 e, em 1930, a 3 375 329. Em virtude desses fatores, consolidaram-se nos Estados Unidos uma burguesia industrial, comercial e financeira significativa, uma classe trabalhadora majoritariamente formada por imigrantes e uma classe média em ascensão. -/- As principais cidades passaram a ser um espaço de conflito e alvo de preocupações. Temas como imigração, aculturação, conflitos étnicos, comportamentos desviantes e políticas públicas foram importantes na Sociologia desenvolvida inicialmente no país. -/- Entre os principais fundadores da Sociologia nos Estados Unidos estão William Graham Sumner (1840 -1910), Lester Frank Ward (1841-1913), Albion Woodbury Small (1854-1926), Franklin Henry Giddings (1855-1931), Thorstein Bunde Veblen (1857-1929), William Isaac Thomas (1863-1947), Robert Ezra Park (1864-1944), Charles Horton Cooley (1864-1929) e George Herbert Mead (1863-1931). -/- A herança cultural desses fundadores é muito diversa: foram influenciados principalmente pela tradição religiosa protestante disseminada em quase todo o território, pelo liberalismo econômico clássico conservador, do tipo laissez-faire, pelo evolucionismo do inglês Charles Darwin (1809-1882) e pelo darwinismo social de Herbert Spencer (1820-1903). Acrescente-se a esse cadinho de concepções de mundo e ciência o pragmatismo do filósofo e psicólogo William James (1842-1910) e do filósofo Charles Pierce (1839-1914). -/- Essa herança permite compreender as duas grandes características da Sociologia nos Estados Unidos: -/- • multiplicidade de temas, problemas e propostas e diversidade teórica e metodológica; -/- • desenvolvimento desse campo do conhecimento em universidades, nas quais as atividades eram financiadas pelo Estado e pelo setor privado (Fundação Rockefeller, comitês e associações normalmente religiosas). -/- Por causa dessa segunda característica, optei por analisar o desenvolvimento da Sociologia nos Estados Unidos em três importantes universidades estadunidenses: a de Chicago, Harvard e Columbia. -/- 1. A Universidade de Chicago -/- A Universidade de Chicago foi fundada em 1890 pelo magnata do petróleo John D. Rockefeller e recebeu os primeiros alunos em 1892. Nela foi criado o primeiro departamento de Sociologia dos Estados Unidos, sob a direção de Albion Woodbury Small. -/- No início de seus trabalhos sociológicos, a Universidade de Chicago deu primazia à pesquisa empírica, procurando conhecer, por meio da observação direta, a dinâmica das relações sociais. Desenvolveu uma forte tendência pragmática e microssociológica, que viria a ser conhecida como a Escola de Chicago. A maior preocupação dos integrantes dessa Escola foi com os problemas das grandes cidades dos Estados Unidos, como a marginalidade social, o alcoolismo, as drogas, a segregação racial e a delinquência, estabelecendo uma relação entre a pesquisa sociológica e a intervenção dos organismos públicos na sociedade. -/- Os sociólogos de Chicago também se dedicaram ao que chamaram de ecologia humana, em oposição à ecologia animal e vegetal. -/- Em 1895, Albion Woodbury Small fundou o American Journal of Sociology e, em 1907, participou ativamente da fundação da Sociedade Americana de Sociologia. Ele publicou, com Georges Vincent, em 1894, talvez o primeiro manual de Sociologia para estudantes, intitulado Introdução ao estudo da sociedade. Tendo estudado na Alemanha, Small foi o principal divulgador do pensamento de Georg Simmel nos Estados Unidos. -/- Entre os integrantes da Escola de Chicago mais conhecidos no Brasil, podemos citar William I. Thomas (1863-1947) e Florian Znaniecki (1882-1958), cuja principal obra foi O camponês polonês na Europa e na América, editada em 1918. -/- Destacam-se ainda Robert E. Park (1864-1944) e Ernest W. Burgess (1886-1966), que escreveram, entre outras obras, Introdução à ciência da Sociologia, em 1921. -/- Os dois, com Roderick Mackenzie, escreveram o clássico A cidade, em 1925. Outro membro de destaque foi Louis Wirth (1897-1952), autor de O gueto, escrito em 1928, e de um artigo que se tornou famoso, “Urbanismo como modo de vida”, publicado em 1938, no American Journal of Sociology. -/- A Escola de Chicago congregou, ainda, sociólogos e antropólogos com ligação com a Psicologia Social, que desenvolveram uma abordagem sociológica das relações sociais conhecida como interacionismo simbólico. A principal figura dessa vertente foi George Herbert Mead (1863-1932), que trabalhou em diversas áreas, sobretudo como psicólogo social e como professor de várias gerações de antropólogos e sociólogos. Seus escritos foram sistematizados por seus alunos e publicados com o nome Mind, self and society (A mente, o eu e a sociedade), em 1934. -/- Além da tradição intelectual dos Estados Unidos, os integrantes da Escola de Chicago receberam a influência de Jean-Gabriel de Tarde, Émile Durkheim e Georg Simmel. Seus continuadores foram Herbert Blumer (1900-1987) e Everett C. Hughes (1897-1983). -/- 1.1 Erving Goffman (1922-1982) -/- O representante da Sociologia desenvolvida na Universidade de Chicago mais influente no Brasil é Erving Goffman, que nasceu em Manville, Alberta, no Canadá, em 1922, e faleceu nos Estados Unidos em 1982. Obteve o grau de bacharel pela Universidade de Toronto, em 1945, e concluiu mestrado (1949) e doutorado (1953) na Universidade de Chicago, onde estudou Sociologia e Antropologia Social. Em 1958, tornou-se professor da Universidade da Califórnia e, em 1968, ingressou na Universidade da Pensilvânia, onde foi professor de Antropologia e Sociologia. -/- Entre 1981 e 1982, Goffman foi presidente da Sociedade Americana de Sociologia e realizou pesquisas na linha da Sociologia interpretativa e cultural, iniciada por Max Weber, desenvolvendo a ideia de que o mundo é um teatro e cada um, individualmente ou em grupo, interpreta papéis de acordo com as circunstâncias em que se encontra. Essas circunstâncias são marcadas por rituais e posições distintivas em relação a outros indivíduos ou grupos. Para ele, é possível distinguir indivíduos, grupos e classes com base, por exemplo, em aspectos como as formas de vestir ou de se apresentar publicamente. -/- O sociólogo considera a interação social como um processo fundamental de identificação e de diferenciação dos indivíduos e grupos, analisando-a no cotidiano, especialmente em lugares públicos. Goffman estudou com especial atenção o que chamou de “instituições totais”, lugares onde o indivíduo é isolado da sociedade, como prisões e manicômios. -/- De acordo com o sociólogo brasileiro Édison Gastaldo: -/- O trabalho de Goffman trouxe à luz aspectos da vida cotidiana que não se julgavam “sociologicamente relevantes”. Seus insights sobre as interações ordinárias, sobre o deslocamento dos pedestres, sobre a ocupação social dos espaços públicos, sobre a atuação dos vigaristas, mendigos, loucos, espiões, jogadores e de todos aqueles que passam cotidianamente debaixo de nossos narizes sem que prestemos atenção modificaram o pensar sociológico no mundo. Sua descrição etnográfica de um hospital para doentes mentais colaborou decisivamente para deflagrar a luta antimanicomial no mundo inteiro. Vinte e dois anos depois de sua morte, os temas e os conceitos desenvolvidos por Goffman ainda estão em pleno uso e vitalidade (GASTALDO, 2004, p. 9/10). -/- Suas três obras mais conhecidas são: A representação do eu na vida cotidiana (1959), Manicômios, prisões e conventos (1961) e Estigma: notas sobre a manipulação da identidade (1963). -/- 2. A Universidade Harvard -/- A história de Harvard começa em 1636, quando foi fundada, na cidade de Cambridge, no estado de Massachusetts, uma instituição de ensino denominada New College. Em 1639, essa instituição recebeu o nome de Harvard College, em homenagem a John Harvard, seu principal mecenas. -/- A Sociologia desenvolvida na Universidade Harvard é marcada por uma preocupação teórica e tem dois sociólogos como expoentes: Pitirim Alexandrovich Sorokin (1889-1968) e Talcott Edgar Frederick Parsons (1902-1979). Este último influenciou muito o desenvolvimento da Sociologia no mundo e no Brasil. -/- 2.1 Talcott Parsons (1902-1979) -/- Talcott Parsons nasceu no Colorado, nos Estados Unidos. Em 1924, graduou-se em Biologia e Filosofia na Faculdade Amherst. Em 1925, pós-graduou-se em Ciências Sociais na Escola de Economia de Londres, na Inglaterra, e, em seguida, doutorou-se na Universidade de Heidelberg, na Alemanha. -/- Nos Estados Unidos, lecionou Economia e Sociologia na Universidade Harvard durante 45 anos (1927-1973). Em 1944, tornou-se presidente do Departamento de Sociologia, transformando-o, dois anos depois, no Departamento de Relações Sociais, a fim de unir a Sociologia a outras ciências sociais. -/- Assim como Sorokin, Parsons voltou-se para a Sociologia europeia, tendo por base as ideias de Max Weber, Vilfredo Pareto (1848-1923) e Émile Durkheim, além das do economista inglês Alfred Marshall (1842-1924). Fundamentado nesses autores, desenvolveu uma grande obra teórica, que dominaria a Sociologia estadunidense desde então. -/- Parsons é o sociólogo estadunidense mais conhecido no mundo. Em geral, seus críticos entenderam-no como um pensador conservador, preocupado basicamente com o bom ordenamento da sociedade. Seu interesse era determinar a função que os indivíduos desempenhavam na estrutura social. Entendia o indivíduo como expressão dessa estrutura, a qual devia ser mantida e preservada. Caso isso não ocorresse, deviam entrar em ação os mecanismos de controle social (moral, ética, sistema jurídico e penal etc.), como instrumentos preventivos ou corretivos. -/- Seu trabalho exerceu influência em diversos países e ambientes acadêmicos (particularmente nas décadas de 1950 a 1970), até mesmo na então União Soviética, onde, em 1964, ministrou aulas sobre a Sociologia estadunidense a convite da Academia de Ciências da União Soviética (URSS). -/- Suas principais obras foram: A estrutura da ação social (1937), O sistema social (1951), Economia e sociedade (1956, com N. Smelser), Estrutura e processo nas sociedades modernas (1960), Sociedades: perspectivas evolucionárias e comparativas (1966), Teoria sociológica e sociedade moderna (1968), Política e estrutura social (1969), Sistemas sociais e a evolução da teoria da ação (1977) e Teoria da ação e a condição humana (1978). -/- 3. A Universidade Columbia -/- A King’s College foi fundada em 1754, em Nova York, nos Estados Unidos. Quando as colônias inglesas se declararam independentes da Grã-Bretanha, a instituição passou a se chamar Universidade Columbia. A partir da última década do século XIX, essa universidade se destacaria por uma importante produção no campo da Sociologia, tendo como pioneiro Franklin Giddings (1855-1931), fundador da cadeira de Sociologia. Fortemente marcado pelo evolucionismo e pelo pragmatismo, foi um dos primeiros a usar métodos quantitativos e experi-mentais no estudo dos fenômenos sociais. -/- Dois sociólogos de Columbia merecem destaque, por serem muito conhecidos no Brasil: Robert K. Merton e Charles Wright Mills. -/- 3.1 Robert King Merton (1910-2003) -/- Merton nasceu na Filadélfia e faleceu em Nova York. Graduou-se em Sociologia na Universidade Temple e pós-graduou-se na Universidade Harvard, onde trabalhou com Pitirim Sorokin e Talcott Parsons até a defesa de seu doutorado, em 1936. -/- Em 1941 Merton transferiu-se para a Universidade Columbia, onde permaneceu durante 38 anos, até aposentar-se. Nessa universidade procurou integrar teoria à prática sociológica. Estudou o comportamento desviante e os processos de adaptação social, tendo por base pesquisas qualitativas e quantitativas do exercício profissional em ambiente de solidariedade e de conflito. Com Paul Lazarsfeld (1901-1976), desenvolveu o Departamento de Pesquisa Social Aplicada. -/- O nome de Merton está vinculado à proposta de criação de teorias de alcance médio, segundo a qual os sociólogos seriam mais úteis à sociedade se deixassem de lado as grandes teorias (criticando Parsons) e criassem outras de médio alcance. Essas teorias estariam situadas entre as hipóteses de trabalho rotineiras na pesquisa e as amplas especulações. Mediariam, dessa forma, as abstrações, generalizações e fundamentos empíricos da pesquisa. -/- Merton tinha uma visão humanista da função social da ciência, demonstrando influência clara de Max Weber. Concebia a ciência como um conjunto de conhecimentos compartilhados por todos os membros da sociedade, que deveriam julgar a credibilidade das postulações científicas de acordo com suas expectativas e valores morais. Mas as decisões acerca do fazer científico não caberiam à sociedade, e sim ao próprio cientista, sempre adequando seus valores aos da sociedade. -/- 3.2 Charles Wright Mills (1916-1962) -/- Charles Wright Mills (1916-1962) nasceu em Waco, no Texas, Estados Unidos. Mestre em Artes, Filosofia e Sociologia pela Universidade do Texas, concluiu, em 1942, seu doutorado em Sociologia e Antropologia pela Universidade de Wisconsin. Foi professor de Sociologia nas universidades de Maryland e Columbia, onde passou a lecionar em 1947 e permaneceu até a morte, em 1962. -/- Charles Mills representa uma tendência quase marginal na Sociologia dos Estados Unidos, por apresentar uma visão crítica e militante da sociedade estadunidense e da própria Sociologia. -/- Influenciado por Karl Marx e Max Weber, Mills procurou conciliar o conceito de classe social com o de status, visando esclarecer processos e mecanismos dos conflitos e das mudanças sociais. Por meio de pesquisas, tentou elucidar a complexidade de estruturas de poder, particularmente das elites (em lugar de classes dominantes), e de seu papel na mudança social, fugindo da ideia de revolução como única via para a transformação social. -/- Charles Wright Mills é conhecido principalmente por seu livro A imaginação sociológica, publicado originalmente nos Estados Unidos em 1959. Nele, o autor propõe que os sociólogos, ao exercer a profissão, não deixem a imaginação e a criatividade de lado em favor de uma pretensa objetividade e neutralidade do trabalho científico. Para Mills, os grandes intelectuais da história nunca abriram mão da reflexão e da criatividade e mantiveram uma postura crítica diante da realidade. -/- Atribuindo aos sociólogos a responsabilidade de agentes ativos na sociedade, cabendo-lhes tomar parte nos debates públicos de sua época, Mills defendia a ideia de que a Sociologia deveria ser compreensível para o grande público. Para ele, a ciência social era inseparável da vida pessoal do cientista: a intuição, a imaginação e o comprometimento com o tempo em que se vivia eram fundamentais para compreender cientificamente a sociedade. Suas obras foram publicadas em vários idiomas. Dal momento che Gintis è un economista senior e ho letto alcuni dei suoi precedenti libri con interesse, mi aspettavo qualche più intuizione sul comportamento. Purtroppo, fa le mani morte della selezione di gruppo e della fenomenologia nei pezzi centrali delle sue teorie del comportamento, e questo invalida in gran parte l'opera. Peggio ancora, dal momento che mostra un tale cattivo giudizio qui, mette in discussione tutto il suo lavoro precedente. Il tentativo di resuscitare la selezione di gruppo da parte (...) dei suoi amici ad Harvard, Nowak e Wilson, alcuni anni fa è stato uno dei maggiori scandali della biologia nell'ultimo decennio, e ho raccontato la triste storia nel mio articolo 'Altruismo, Gesù e la fine del mondo: come la Templeton Foundation ha acquistato una cattedra di Harvard e ha attaccato Evolution, Rationality and Civilization - Una recensione di E.O. Wilson 'The Social Conquest of Earth' (2012) e Nowak and Highfield 'SuperCooperators'). A differenza di Nowak, Gintis non sembra essere motivato dal fanatismo religioso, ma dal forte desiderio di generare un'alternativa alle cupe realtà della natura umana, reso facile dalla mancanza (quasi universale) della comprensione della biologia umana di base e dello slateismo in bianco degli scienziati comportamentali, di altri accademici e del pubblico in generale. Gintis attacca giustamente (come ha fatto molte volte prima) economisti, sociologi e altri scienziati comportamentali per non avere un quadro coerente per descrivere il comportamento. Naturalmente, il quadro necessario per comprendere il comportamento è evolutivo. Purtroppo, non riesce a fornire uno se stesso (secondo i suoi molti critici e io concordo), e il tentativo di innestare il cadavere marcio di selezione di gruppo su qualsiasi teoria economica e psicologica che ha generato nei suoi decenni di lavoro, invalida semplicemente il suo intero progetto. Anche se Gintis fa uno sforzo coraggioso per capire e spiegare la genetica, come Wilson e Nowak, è lontano da un esperto, e come loro, la matematica lo acceca alle impossibilità biologiche e, naturalmente, questa è la norma nella scienza. Come Wittgenstein notoriamente ha notato sulla prima pagina di Cultura e Valore "Non esiste una denominazione religiosa in cui l'uso improprio delle espressioni metafisiche è stato responsabile di tanto peccato come ha fatto in matematica." È sempre stato chiaro che un gene che provoca un comportamento che diminuisce la propria frequenza non può persistere, ma questo è il nucleo della nozione di selezione del gruppo. Inoltre, è stato ben noto e spesso dimostrato che la selezione di gruppo riduce solo alla forma fisica inclusiva (selezione dei parenti), che, come ha notato Dawkins, è solo un altro nome per l'evoluzione per selezione naturale. Come Wilson, Gintis ha lavorato in questa arena per circa 50 anni e ancora non l'ha afferrato, ma dopo lo scandalo è rotto, mi ci sono voluti solo 3 giorni per trovare, leggere e capire il lavoro professionale più rilevante, come descritto nel mio articolo. È da capo giro rendersi conto che Gintis e Wilson non sono stati in grado di raggiungere questo obiettivo in quasi mezzo secolo. Discuto gli errori di selezione di gruppo e fenomenologia che sono la norma nel mondo accademico come casi speciali della quasi universale incapacità di comprendere la natura umana che stanno distruggendo l'America e il mondo. ABSTRACT The individual-community relationship has always been one of the most fundamental topics of social sciences. In sociology, this is known as the micro-macro relationship while in economics it refers to the processes, through which, individual actions lead to macroeconomic phenomena. Based on philosophical discourse and systems theory, many sociologists even use the term "emergence" in their understanding of micro-macro relationship, which refers to collective phenomena that are created by the cooperation of individuals, but cannot be reduced to individual actions. (...) "Emergence" theories attempt to explain the nature of society as a complex system by examining how individuals and their relationships lead to the creation of integrated and macro-social phenomena such as markets, educational systems, cultural beliefs, and shared social practices. As a prelude to activity, every researcher has to answer the question from the methodological point of view, how is it possible to study the behavior of social groups and how can we gain knowledge about the laws related to social groups? Anyone who deals with humanities and social sciences or any reality and phenomenon that affects human beings, inevitably deals with the reality that is emerging. In fact, emergence occurs when one level of reality emerges radically from another level. Examples of emergent levels of reality include how the mind emerges from the body; or the way society emerges from human beings. Therefore, when there is an emerging factor, different scientific disciplines should be used, because it is inevitable to talk about social affairs, psychology and neurobiology, as well as physical and even chemical. -/- INTRODUCTION Since its beginning in the 19th century, sociology has faced the fundamental question of what a social phenomena stands for? At a glance, sociologists deal with the study of social groups, collective behavior, institutions, social structures, social networks, and social dynamics, and ultimately all such phenomena are composed of individuals. Therefore, social phenomena seem to have no independent ontological status, and in this case, sociology is ultimately about reducible individuals. Different approaches about the micro-macro relationship, using the concept of "emergence", argue that although collective phenomena are created by individuals, they cannot be reduced to individual action. The term "emergence" is used to distinguish "emergent results" from " Procedural results". Results are called Procedural that can only be calculated by adding or subtracting the causes that act together. On the contrary, they are emergent outcomes that are qualitatively novel compared to the causes from which they originate. An example of such emergent results is mental characteristics that emerge from neural processes, but are not considered among the characteristics of neural processes of components - which are their origin. Philosophical debates about emergentism and reductionism focus on the mind-brain relationship, but as many philosophers have noted, they can be generalized to apply to any hierarchical set of features. The cognitive revolution reactivated a 19th century controversy between theorists of Identity and dualism. The theorists of Identity believe in reductionist materialism and elimination of metaphysics, according to which the mind is nothing more than the biological, while the dualists believe that the mind and the brain are distinct from each other. Emergence has been considered as a third way between the theories of Identity and dualism. -/- METHODOLOGY Interdisciplinarity Is fundamentally indicated by the dominance of open systems as well as social and emerging systems at different levels. Therefore, as long as we are facing a new emergentism, there will necessarily be different fields and an interdisciplinary method. The commonality of social sciences and cognitive sciences on the issue of emergence provides the possibility of interaction and exchange of concepts between these two for deeper research. Therefore, in this research, apart from the concepts of Subvenience and downward causation, we have used multiple realization and wildly disjunctive, which are used to explain the emerging concept in cognitive sciences, including neurobiology, psychology, and philosophy. For analytical and interdisciplinary approaches, after examining the concepts of subvenience, and wildly disjunctive, Individualistic and collectivist emergentism have been reviewed. And then their adequacy is criticized and evaluated in meeting strong emergence conditions. -/- FINDINGS Philosophers of the mind have been able to define the conditions of irreducibility and downward causation, which are essential for strong emergence, by using the principle of subvenience with the help of multiple realization and wildly disjunctive principles. Therefore, by definition, emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and emergentist collectivism faces the challenge of reification. The analysis of the challenges facing the two methodological approaches of individualism and collectivism leads us to three unresolved issues about the emerging phenomenon, which are realism, downward causality, and mechanism. Despite the differences in the stances of these two approaches regarding the aforementioned triple problems, individualists and collectivists both agree that some social characteristics are reducible; and some others are irreducible due to their complexity, the determination of which, depends on the case study of the mechanism of emergence of each social characteristic. -/- CONCLUSION An emergence that is consistent with reductionism is called a weak emergence. And strong emergence includes the principle of irreducibility and downward causality. According to strong emergence, the characteristics of social phenomena have downward causal power, which cannot be reduced to the causal forces. The principle of subvenience, together with multiple realization and wildly disjunctive, can provide the conditions of irreducibility and downward causality, which are essential conditions of strong emergence. Based on the philosophical analysis of two methodological approaches, individualist and collectivist, it can be concluded that emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and reification collectivism faces the challenge of reification. The analysis of the problems faced by these two approaches leads us to three unresolved issues, which are realism, downward causality, and mechanism. individualist emergentists acknowledge the existence of emergent social characteristics, but despite this, they believe that these characteristics are not real but merely analytical constructs that require explanation based on individuals and their mutual actions. But collectivists argue that emergentism yields a categorical ontology and supports social realism. They accept the dependence of social characteristics on individuals, but claim that social entities and structures are ontologically independent. Individualists and collectivists both agree that some social characteristics are reducible; and others are irreducible due to their complexity; and the only way to recognize this is to engage in empirical studies of the mechanisms and temporal processes of "emergence" that create social characteristics. -/- NOVELTY The newness of this compact article is as follows: a) Presenting an interdisciplinary approach using the analysis of philosophy of cognitive sciences, including the philosophy of mind, neurobiology and psychology to formulate the issue of social emergence; b) Criticizing individualist and collectivist methodological approaches to the issue of social emergence and explaining the sufficiency and shortcomings of both in providing weak and strong emerging conditions; c) Explaining and categorizing the challenges facing methodological approaches in explaining the phenomenon of social emergence, in three categories: realism, downward causality, and mechanism. The following is a mock debate on schizophrenia set in the 1960s at the Sorbonne in Paris, France, between two fictional characters, Dr. Brian L. Zacou, a qualitative sociologist and Institute Professor Emeritus at the University of Prague; Dr. Wytt Thomas, a professor of psychology at Harvard University; two notable historical figures: Dr. Michel Foucault [20th-century philosopher, historian, academic and theorist] and Dr. R. D. Laing [20th-century psychiatrist and experimental researcher and author] and the writer of this compendium [artist (...) and writer Alexej Savreux; himself a diagnosed schizophrenic]. We model it as a transcription of a debate held at that juncture. It explores the historical framework of schizophrenia, the deep-seated aspects and reality of psychosis, a critique of psychiatry, and a sociological perspective on psychosis. We devote the first chapter to the historical framework and an explanation of the reality of schizophrenia. The second chapter is a critique of mainstream psychiatry, and the third chapter is a resolution between the mock debaters on the social framework and how best to come out unscathed in post-modernity. The remarks from Foucault and Laing are paraphrased from the works “Madness and Civilization: A History of Insanity in the Age of Reason” (Foucault) and “The Divided Self: An Existential Study in Sanity and Madness” (Laing) and are annotated with footnotes along with a few other sources. The writer has taken great liberties in constructing this mock debate, including the usage of anachronisms, and also determines his findings based on what we refer to as the anti-symmetry underpinning the biopsychosocial reality of schizophrenia and the social framework that ensues, generated by popular responses to abstract disease concepts associated with insanity. The question I want to explore is whether experience supports an antireductionist ontology of time, that is, whether we should take it to support an ontology that includes a primitive, monadic property of nowness responsible for the special feel of events in the present, and a relation of passage that events instantiate in virtue of literally passing from the future, to the present, and then into the past.

Philosophers of experiment have acknowledged that experiments are often more than mere hypothesis-tests, once thought to be an experiment's exclusive calling. Drawing on examples from contemporary biology, I make an additional amendment to our understanding of experiment by examining the way that `wide' instrumentation can, for reasons of efficiency, lead scientists away from traditional hypothesis-directed methods of experimentation and towards exploratory methods.

The tripartite account of propositional, fallibilist knowledge that p as justified true belief can become adequate only if it can solve the Gettier Problem. However, the latter can be solved only if the problem of a successful coordination of the resources (at least truth and justification) necessary and sufficient to deliver propositional, fallibilist knowledge that p can be solved. In this paper, the coordination problem is proved to be insolvable by showing that it is equivalent to the ''''coordinated attack'''' problem, (...) which is demonstrably insolvable in epistemic logic. It follows that the tripartite account is not merely inadequate as it stands, as proved by Gettier-type counterexamples, but demonstrably irreparable in principle, so that efforts to improve it can never succeed. Philosophical discussions of species have focused on multicellular, sexual animals and have often neglected to consider unicellular organisms like bacteria. This article begins to fill this gap by considering what species concepts, if any, apply neatly to the bacterial world. First, I argue that the biological species concept cannot be applied to bacteria because of the variable rates of genetic transfer between populations, depending in part on which gene type is prioritized. Second, I present a critique of phylogenetic bacterial species, (...) arguing that phylogenetic bacterial classification requires a questionable metaphysical commitment to the existence of essential genes. I conclude by considering how microbiologists have dealt with these biological complexities by using more pragmatic and not exclusively evolutionary accounts of species. I argue that this pragmatism is not borne of laziness but rather of the substantial conceptual problems in classifying bacteria based on any evolutionary standard. (shrink)

It seems natural to choose whether to have a child by reflecting on what it would be like to actually have a child. I argue that this natural approach fails. If you choose to become a parent, and your choice is based on projections about what you think it would be like for you to have a child, your choice is not rational. If you choose to remain childless, and your choice is based upon projections about what you think it (...) would be like for you to have a child, your choice is not rational. This suggests we should reject our ordinary conception of how to make this life-changing decision, and raises general questions about how to rationally approach important life choices. (shrink)

The genetic modification of pigs as a source of transplantable organs is one of several possible solutions to the chronic organ shortage. This paper describes existing ethical tensions in xenotransplantation (XTx) that argue against pursuing it. Recommendations for lifelong infectious disease surveillance and notification of close contacts of recipients are in tension with the rights of human research subjects. Parental/guardian consent for pediatric xenograft recipients is in tension with a child’s right to an open future. Individual consent to transplant is (...) in tension with public health threats that include zoonotic diseases. XTx amplifies concerns about justice in organ transplantation and could exacerbate existing inequities. The prevention of infectious disease in source animals is in tension with the best practices of animal care and animal welfare, requiring isolation, ethologically inappropriate housing, and invasive reproductive procedures that would severely impact the well-being of intelligent social creatures like pigs. This discussion revises and extends Jonny Anomaly's ‘public goods’ account of public health ethics in light of recent criticism from Richard Dees. Public goods are goods that are both non-rival and non-excludable. What is significant about such goods is that they are not always provided efficiently by the market. Indeed, the state can sometimes realize efficiency gains either by supplying such goods directly or by compelling private purchase. But public goods are not the only goods that the market may fail (...) to provide efficiently. This point to a way of broadening the public goods account of public health to accommodate Dees' counterexamples, without abandoning its distinctive appeal. On the market failures approach to public health ethics, the role of public health is to correct public health-related market failures of all kinds, so far as possible. The underlying moral commitment is to economic efficiency in the sense of Pareto: if we can re-allocate resources in the economy so as to raise the welfare of some without lowering the welfare of any other, we ought to do so. I defend a one category ontology: an ontology that denies that we need more than one fundamental category to support the ontological structure of the world. Categorical fundamentality is understood in terms of the metaphysically prior, as that in which everything else in the world consists. One category ontologies are deeply appealing, because their ontological simplicity gives them an unmatched elegance and spareness. I’m a fan of a one category ontology that collapses the distinction between particular and property, replacing it (...) with a single fundamental category of intrinsic characters or qualities. We may describe the qualities as qualitative charactersor as modes, perhaps on the model of Aristotelian qualitative (nonsubstantial) kinds, and I will use the term “properties” interchangeably with “qualities”. The qualities are repeatable and reasonably sparse, although, as I discuss in section 2.6, there are empirical reasons that may suggest, depending on one’s preferred fundamental physical theory, that they include irreducibly intensive qualities. There are no uninstantiated qualities. I also assume that the fundamental qualitative natures are intrinsic, although physics may ultimately suggest that some of them are extrinsic. On my view, matter, concrete objects, abstract objects, and perhaps even spacetime are constructed from mereological fusions of qualities, so the world is simply a vast mixture of qualities, including polyadic properties (i.e., relations). This means that everything there is, including concrete objects like persons or stars, is a quality, a qualitative fusion, or a portion of the extended qualitative fusion that is the worldwhole. It is generally acknowledged that a certain amount of state intervention in health and health care is needed to address the significant market failures in these sectors; however, it is also thought that the primary rationale for state involvement in health must lie elsewhere, for example in an egalitarian commitment to equalizing access to health care for all citizens. This paper argues that a complete theory of justice in (...) health can be derived from a commitment to correcting market failure, or in other words promoting Pareto-efficiency, in the domain of health. This approach can address familiar problems around access to care, as well as problems related to resource allocation and rationing, the control of health care costs, and the foundations of public health. Egalitarian theories of justice in health cannot make sense of the depth and pervasiveness of state involvement in health and health care; only a theory rooted in the need to correct market failure can. Several prominent voices have called for a democratization of science through deliberative processes that include a diverse range of perspectives and values. We bring these scholars into conversation with extant research on democratic deliberation in political theory and the social sciences. In doing so, we identify systematic barriers to the effectiveness of inclusive deliberation in both scientific and political settings. We are particularly interested in what we call misidentified dissent, where deliberations are starkly framed at the outset in terms of (...) dissenting positions without properly distinguishing the kinds of difference and disagreement motivating dissent. I argue that we can understand the de se by employing the subjective mode of presentation or, if one’s ontology permits it, by defending an abundant ontology of perspectival personal properties or facts. I do this in the context of a discussion of Cappelen and Dever’s recent criticisms of the de se. Then, I discuss the distinctive role of the first personal perspective in discussions about empathy, rational deference, and self-understanding, and develop a way to frame the problem of lacking (...) prospective access to your future self as a problem with your capacity to imaginatively empathize with your future selves. Many hold that distributing healthcare according to medical need is a requirement of equality. Most egalitarians believe, however, that people ought to be equal on the whole, by some overall measure of well-being or life-prospects; it would be a massive coincidence if distributing healthcare according to medical need turned out to be an effective way of promoting equality overall. I argue that distributing healthcare according to medical need is important for reducing individuals' uncertainty surrounding their future medical needs. Citizens in wealthy liberal democracies are typically expected to see to basic needs like food, clothing, and shelter out of their own income, and those without the means to do so usually receive assistance in the form of cash transfers. Things are different with health care. Most liberal societies provide their citizens with health care or health care insurance in kind, either directly from the state or through private insurance companies that are regulated like public utilities. Except perhaps for small (...) co-pays or deductibles, citizens are not expected to see to their health needs out-of-pocket, at least for some basic level of care. In a recent issue of Philosophy East and West Douglas Berger defends a new reading of Mūlamadhyamakakārikā XXIV : 18, arguing that most contemporary translators mistranslate the important term prajñaptir upādāya, misreading it as a compound indicating "dependent designation" or something of the sort, instead of taking it simply to mean "this notion, once acquired." He attributes this alleged error, pervasive in modern scholarship, to Candrakīrti, who, Berger correctly notes, argues for the interpretation he rejects.Berger's analysis, and the reading of (...) the text he suggests is grounded on that analysis, is insightful and fascinating, and certainly generates an understanding of Nāgārjuna's enterprise that is welcome .. Moral reasoning traditionally distinguishes two types of evil: moral and natural. The standard view is that ME is the product of human agency and so includes phenomena such as war, torture and psychological cruelty; that NE is the product of nonhuman agency, and so includes natural disasters such as earthquakes, floods, disease and famine; and finally, that more complex cases are appropriately analysed as a combination of ME and NE. Recently, as a result of developments in autonomous agents in cyberspace, (...) a new class of interesting and important examples of hybrid evil has come to light. In this paper, it is called artificial evil and a case is made for considering it to complement ME and NE to produce a more adequate taxonomy. By isolating the features that have led to the appearance of AE, cyberspace is characterised as a self-contained environment that forms the essential component in any foundation of the emerging field of Computer Ethics. It is argued that this goes some way towards providing a methodological explanation of why cyberspace is central to so many of CE’s concerns; and it is shown how notions of good and evil can be formulated in cyberspace. Of considerable interest is how the propensity for an agent’s action to be morally good or evil can be determined even in the absence of biologically sentient participants and thus allows artificial agents not only to perpetrate evil but conversely to ‘receive’ or ‘suffer from’ it. The thesis defended is that the notion of entropy structure, which encapsulates human value judgement concerning cyberspace in a formal mathematical definition, is sufficient to achieve this purpose and, moreover, that the concept of AE can be determined formally, by mathematical methods. A consequence of this approach is that the debate on whether CE should be considered unique, and hence developed as a Macroethics, may be viewed, constructively, in an alternative manner. The case is made that whilst CE issues are not uncontroversially unique, they are sufficiently novel to render inadequate the approach of standard Macroethics such as Utilitarianism and Deontologism and hence to prompt the search for a robust ethical theory that can deal with them successfully. The name Information Ethics is proposed for that theory. It is argued that the uniqueness of IE is justified by its being non-biologically biased and patient-oriented: IE is an Environmental Macroethics based on the concept of data entity rather than life. It follows that the novelty of CE issues such as AE can be appreciated properly because IE provides a new perspective. In light of the discussion provided in this paper, it is concluded that Computer Ethics is worthy of independent study because it requires its own application-specific knowledge and is capable of supporting a methodological foundation, Information Ethics. The self can be understood in objective metaphysical terms as a bundle of properties, as a substance, or as some other kind of entity on our metaphysical list of what there is. Such an approach explores the metaphysical nature of the self when regarded from a suitably impersonal, ontological perspective. It explores the nature and structure of the self in objective reality, that is, the nature and structure of the self from without. This is the objective self. I am taking (...) a different approach. In addition to objective reality, which is usually understood and explored from an impersonal, quasi-observational and metaphysically realist perspective, we can also explore the nature and structure of subjective reality. The nature and structure of subjective reality is defined by the nature and structure of first-personal, conscious experience. Subjective reality is as real as objective reality, and a metaphysical realist such as myself can endorse the existence of both kinds of ontology. The mental states that, as experienced from the first-personal or subjective perspective, capture the nature and structure of subjective reality, are included in objective reality. The questions to explore in a subjective ontology of the self concern the nature and structure of the self from the first-personal or subjective perspective, that is, the nature and structure of the self from within. In this paper, I distinguish two conceptions of solidarity, which I call solidarity as beneficence and solidarity as mutual advantage. I argue that only the latter is capable of providing a complete foundation for national universal health care programs. On the mutual advantage account, the rationale for universal insurance is parallel to the rationale for a labor union’s “closed shop” policy. In both cases, mandatory participation is necessary in order to stop individuals free-riding on an ongoing system of mutually advantageous (...) cooperation. (shrink)

Despite the recent backlash against epistemic consequentialism, an explicit systematic alternative has yet to emerge. This paper articulates and defends a novel alternative, Epistemic Kantianism, which rests on a requirement of respect for the truth. §1 tackles some preliminaries concerning the proper formulation of the epistemic consequentialism / non-consequentialism divide, explains where Epistemic Kantianism falls in the dialectical landscape, and shows how it can capture what seems attractive about epistemic consequentialism while yielding predictions that are harder for the latter to (...) secure in a principled way. §2 presents Epistemic Kantianism. §3 argues that it is uniquely poised to satisfy the desiderata set out in §1 on an ideal theory of epistemic justification. §4 gives three further arguments, suggesting that it (i) best explains the objective normative significance of the subject's perspective in epistemology, (ii) follows from the kind of axiology needed to solve the swamping problem together with modest assumptions about the relation between the evaluative and the deontic, and (iii) illuminates certain asymmetries in epistemic value and obligation. §5 takes stock and reassesses the score in the debate. Galileo’s Error is a superlative work of public philosophy, particularly as a way of introducing modern academic panpsychism to a broader audience. In this commentary, I reflect on an issue that is prominent, though often with different background concerns, in both academic and popular discourse: what it means to be ‘scientific’ or ‘unscientific’. Panpsychism is not itself a scientific hypothesis, but neither is it (as critics sometimes claim) in conflict with science. Indeed, Goff argues, and I agree, that panpsychism is (...) an eminently scientific worldview, in the sense of a way of viewing reality that accords with and embraces what science reveals. But what exactly it means to ‘accord with and embrace’ science is disputed; this paper tries to untangle some of the threads. (shrink)

This classic collection of essays, first published in 1968, represents H.L.A. Hart's landmark contribution to the philosophy of criminal responsibility and punishment. Unavailable for ten years, this new edition reproduces the original text, adding a new critical introduction by John Gardner, a leading contemporary criminal law theorist.

Two problems are considered here. One relates to who has moral status, and the other relates to who has moral responsibility. The criteria for mattering morally have long been disputed, and many humans and nonhuman animals have been considered “marginal cases,” on the contested edges of moral considerability and concern. The marginalization of humans and other species is frequently the pretext for denying their rights, including the rights to health care, to reproductive freedom, and to bodily autonomy. There is broad (...) agreement across cultural and philosophical traditions about the capacities and responsibilities of moral agents. I propose an inclusive and expansive way of thinking about moral status, situating it not in the characteristics or capacities of individuals, but in the responsibilities and obligations of moral agents. Moral agents, under this view, are not privileged or entitled to special treatment but rather have responsibilities. I approach this by considering some African communitarian conceptions of moral status and moral agency. I propose that moral agency can also be more expansive and include not just individual moral agents but collective entities that have some of the traits of moral agents: power, freedom, and the capacity to recognize and act on the demands of morality and acknowledge and respect the rights of others. Expanding who and what is a moral agent correspondingly extends moral responsibility for respecting rights and fostering the conditions for the health and well-being of humans and animals onto the collective entities who uniquely have the capacity to attend to global-scale health threats such as pandemics and human-caused climate change. This Essay presents law’s evolution as a paradoxical union of the finite and the infinite. At any given point in time, law is a finite body of norms, which can be identified. At the same time, law’s evolution is infinite because rule-mutations that alter those norms are indeterminable. In modern legal systems, law’s evolution occurs under the constraining influence of master texts, which provide normative durability by enshrining the fundamental norms of a legal system and fortifying them against change. Despite (...) this stabilizing role, however, master texts are themselves open to mutations. Therefore, law’s evolution under the constraints of a master text mediates the paradoxical union of law’s finite and infinite nature. (shrink)

When medical assistance in dying (MAiD) was legalized in Canada in June 2016, the question of allowing decisionally capable persons to make advance requests in anticipation of later incapacity was reserved for further consideration during the mandatory parliamentary review originally scheduled to begin in June 2020 (but since delayed by COVID-19). In its current form the legislation does not permit such requests, since it stipulates that at the time at which the procedure is to be administered the patient must give (...) “express consent” to receiving it. Since express consent presupposes decisional capacity, this requirement rules out administering MAiD to a patient who has lost capacity. Amendments to the legislation passed by Parliament in March 2021 open the door slightly by allowing advance requests by patients after they have been approved for MAiD, if they fear losing capacity before the procedure can be administered. But this provision would apply only to patients whose natural death was deemed to be “reasonably foreseeable”, and would continue to exclude (a) requests made after diagnosis of a “grievous and irremediable medical condition” but in advance of approval for MAiD, and (b) requests made before such a diagnosis. My aim in this paper is twofold: to explore the ethical and legal issues concerning advance requests for MAiD, and to argue for expanding provision for such requests to include both of these further scenarios. The purpose of this article is to explore the concept and scope of public health and to argue that particularly in low-income contexts, where social injustice and poverty often impact significantly on the overall health of the population, the link between public health and social justice should be a very firm one. Furthermore, social justice in these contexts must be understood as not simply a matter for local communities and nation-states, but in so far as public health is concerned, as (...) a matter of global concern and responsibility. The interpretation of the scope of public health by any particular nation is I believe contingent on the current socio-political context and the conception of social or distributive justice that underpins this context. Furthermore I will argue here that the link between public health and social justice ought to be founded on a conception of social justice that adequately addresses issues of social injustice, and patterns of systematic disadvantage, that contribute to ill health and that so commonly prevail in many low- and middle-income social contexts. Darwinism, especially in the form of the Modern Synthesis, has become one of the most influential theories in the worldwide scientific community. However, due to its often dogmatic interpretation, it is more and more orthodoxical. An increasing number of scientists have come to criticise Darwinism and go beyond it with a systemic approach and an expanded vision of the evolutionary process. As a matter of fact, the discovery of natural genetic engineering mechanisms shows that living cells are able to rewrite (...) their own genetic material at the genomic level, thus leading to evolutionary innovations.
