Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. En este ensayo intentaremos realizar una pequeña aproximación al pensamiento de Gilbert Simondon, filósofo francés cuya obra podría resumirse en sus dos tesis doctorales defendidas en 1958, una de las cuales no fue publicada de forma completa sino póstumamente. No obstante, lo dicho, tras el creciente interés en su pensamiento comenzaron a publicarse ya nacido este milenio, en particular en Argentina, sus cursos sobre percepción, imaginación, invención, información, comunicación y tecnología. A pesar de su escueta obra, Simondon es un filósofo (...) de sistema, que a partir de su teoría de la individuación intentó fundar un monismo ontogenético en el cual puedan entrar en comunicación todas las disciplinas humanas; y para ello buscó explotar todos los recursos conceptuales que brindaron las revoluciones científicas de su época. En este ensayo, sin embargo, abordaremos tan sólo el tipo de realidad o estatus ontológico que Simondon atribuía a los objetos técnicos. Para ello desarrollaremos 4 apartados y un bis. En el primero, haremos un esbozo de lo que es el método filosófico propuesto por Simondon, el cual describimos como un paradigmatismo analógico. En el segundo, desarrollaremos algunas críticas a cierto paradigmatismo particular que, según Simondon, subyace en gran parte del pensamiento occidental y que nos impide, entre otras cosas, comprender la realidad propia de los OT, a saber: el hilemorfismo. En tercer lugar, analizaremos en qué medida podemos salvar la realidad de los OT de ser reducida a mero constructo social. En cuarto lugar; analizaremos algunas analogías y disparidades entre los OT y los seres vivientes. Por último, a modo de apéndice, expondremos sucintamente un artículo de Esperanza García y Villegas Jaraleño, presentado en el último volumen de Scientia in verba, en el cual se plantea la pregunta sobre el estatus ontológico de los artefactos biotecnológicos desde una perspectiva bungeana; así como pequeñas críticas y aportes que pudiésemos hacerle desde el pensamiento simondoniano. A fundamental tension exists between Rawls's ideal Kantian conception of justice as fairness (JAF), which requires respecting people as ends, and his realistic non-Kantian consequentialist conception of a supreme emergency in a just war. By justifying the targeting of objectively innocent noncombatants during a supreme emergency exception, Rawls allows for treating them as means only. Hence, his appeal to a supreme emergency is insufficient to avoid this tension. First, since for him JAF is ideal but also practical, one might argue (...) that his fictional people in the original position must reflect on the justification for using force on behalf of JAF. And second, since Rawls justifies targeting objectively innocent people during a supreme emergency exemption, he justifies what one might conceive of as emergency terrorism. Emergency terrorism, however, treats people as means only. Therefore, Rawls's Kantian conception of JAF is in tension with his consequentialist justification of a supreme emergency in a just war and hence with emergency terrorism. (shrink)

Why do we have social norms—of fairness, cooperation, trust, property, or gender? Modern-day Humeans, as I call them, believe these norms are best accounted for in cultural evolutionary terms, as adaptive solutions to recurrent problems of social interaction. In this paper, I discuss a challenge to this “Humean Program.” Social norms involve widespread behaviors, but also distinctive psychological attitudes and dispositions. According to the challenge, Humean accounts of norms leave their psychological side unexplained. They explain, say, why we share equally, (...) but not why we disapprove of those who don’t. I defend the Humean Program against this challenge. In particular, I suggest an idea for how to extend the Program to account for the psychological side of norms. Socially adaptive behaviors aren’t just likely to emerge in a group; They are also likely to be widely taught within it. The transmission of these behaviors through instruction explains why they are associated with distinctive normative attitudes and dispositions. These attitudes play a pedagogical role in helping transmit these behaviors to children and newcomers. (shrink)

This is a critical review of Susana Nuccetelli’s book: An Introduction to Latin America Philosophy. While I am sympathetic to Professor Nuccetelli’s conception of Latin American philosophy as applied philosophy, I tried to underscore a tension that exists between those of us who do philosophy from an analytic perspective broadly construed, and those who engage in postmodernist, decoloniality, and liberationist perspectivism. I also bring to the attention of the audience the neglected but important role that Victor Cousin’s eclecticism played in (...) promoting philosophy in the Americas. (shrink)

O objetivo principal deste trabalho é apresentar a distinção entre ciência e cientificismo e, com base no trabalho de van Fraassen, intitulado A imagem científica (2006), discutir sobre as circunstâncias em que o cientificismo poderia ser repudiado. O cientificismo é uma corrente de pensamento que somente considera válido um conhecimento se ele for científico. Segundo essa corrente, os procedimentos da ciência natural seriam mais especiais, uma vez que, dentre outros motivos, eles são capazes de descrever regularidades e possibilitar predições. Dessa (...) forma, o cientificismo defende que os procedimentos não científicos não possuem valor algum, pois não seriam capazes de descrever regularidades e realizar predições como fazem os procedimentos da ciência natural. Trataremos de maneira crítica essa concepção, apresentando o argumento de van Fraassen de que a descrição de uma regularidade também pode ser construída por explicações não científicas. Em sua opinião, o poder explicativo de uma teoria vai além de sua importância empírica, ele é radicalmente dependente do contexto. Isso significa que as regularidades descritas por uma crença científica são também dependentes de explicações não científicas, como as explicações da psicologia, da história, da filosofia, da sociologia, etc. Assim, a forte predição que encontramos na ciência natural não é realizada somente com base na adequação empírica e científica, mas com base em um sistema de explicações não científicas. Isso torna incorreta a classificação do conhecimento científico como o mais verdadeiro ou especial por ser capaz de descrever regularidades e realizar a predições. Pretende-se, com isso, refletir se o conhecimento pode ser construído por outras áreas não científicas, sem que o conhecimento seja com isso prejudicado. Uma reflexão necessária que servirá para apresentar um dos problemas que tornam o cientificismo indesejável. (shrink)

Several studies have shown that people are more likely to attribute intentionality and blame to agents who perform actions that have harmful consequences. This kind of bias has problematic implications for jury decisions because it predicts that judgment in juries will malfunction if an action has a blameworthy effect. Most of these studies include in their design a vignette in which it is clear that agents have foreknowledge of the effects of their actions. This kind of design fails to replicate (...) trial situations where, in most cases, it is impossible to know with certainty whether agents have foreknowledge of the effects of their actions. In the present study, we adopt an alternative design that includes vignettes in which there is no direct evidence of foreknowledge to investigate the relationship between intentionality and blame in actions that have harmful and helpful effects. We find that people are still more likely to attribute intentionality to actions that produce harmful effects than actions that produce good effects. However, we find that people tend to attribute more blame when they have direct evidence of foreknowledge than when presented with an alternative design that does not include foreknowledge. Results indicate the relevant role that evidence of foreknowledge plays in experimental designs that study blame attribution. (shrink)

Vitoria and Suárez defend the categorical immunity of the innocent not to be intentionally killed. But they allow for inflicting collective punishment on the innocent and the noninnocent alike during and after a just war. So they allow for deliberately harming them. Inflicting harm on the innocent can often result in their death. Hence, holding both claims seems incoherent. First, the objections against using the term “innocent” are explained. Second, their views on just war are explored. And third, by appealing (...) to Aquinas' double-effect reasoning, it is shown how they try to avoid the above-mentioned incoherence. Still, their appeal might be insufficient to palliate the tension between the above-mentioned claims. If just wars are possible, the deliberate harming of the innocent is reasonably unavoidable for defeating and punishing those who wage them. Hence, defenders of just wars, whether from a religious or a secular perspective, must live with such a tension. (shrink)

O objetivo deste artigo é apontar cinco aspectos do pensamento nietzschiano que podem ser relevantes para os debates da filosofia da ciência em torno da natureza e representação do conhecimento científico. Para tanto, é realizada uma revisão de literatura com o objetivo de selecionar trechos de obras nietzschianas como O nascimento da tragédia, Genealogia da moral, A gaia ciência e outras que permitam interpretar Nietzsche como um filósofo da ciência preocupado com a construção do conhecimento cientifico sobre a realidade física. Como resultado é possível identificar uma proposta epistemológica na perspectiva nietzschiana, cuja representação objetiva do mundo deve apontar para uma estética da vida. -/- The purpose of this article is to point out five aspects of Nietzschean thought that may be relevant to debates in the philosophy of science around the nature and representation of scientific knowledge. To this end, a literature review is carried out with the aim of selecting excerpts from Nietzschean works such as The Birth of Tragedy, Genealogy of Morals, The Gay Science and others that allow us to interpret Nietzsche as a philosopher of science concerned with the construction of scientific knowledge about the physical reality. As a result, it is possible to identify an epistemological proposal in the Nietzschean perspective, whose objective representation of the world should point to an aesthetics of life. (shrink)

In this article, it is argued that a significant internal tension exists in John Rawls' political liberalism. He holds the following positions that might plausibly be considered incongruous: (1) a commitment to tolerating a broad right of freedom of political speech, including a right of subversive advocacy; (2) a commitment to restricting this broad right if it is intended to incite and likely to bring about imminent violence; and (3) a commitment to curbing this broad right only if there is (...) a constitutional crisis. By supporting a broad right of freedom of political speech in Political Liberalism, he allows militant intolerant people such as Jihadists, White Supremacists and Neo-Nazis to advocate publicly their dangerously intolerant beliefs. Public advocacy of dangerously intolerant beliefs can be construed as subversive advocacy. As demonstrated by the historical examples of the Weimar Republic and the Second Spanish Republic, militant intolerant groups could use a right of subversive advocacy to threaten the stability of liberal democracies. Hence, by allowing them to exercise a broad right of freedom of political speech, Rawls could jeopardize that which he intends to defend, namely the actual political stability of a liberal democratic order. Lastly, Rawls' conception of ideal constitutional interpretation, which privileges a broad right of freedom of political speech, might be insufficient to deal effectively with the threat posed by militant intolerant groups. Yet a tradition of American constitutional interpretation that balances freedom of speech with other important constitutional and/or political values has overcome a civil war, two world wars, the Cold War and the 9/11 terrorist attacks without abandoning democracy or permanently renouncing those values. Still, Rawls' ideal approach to constitutional interpretation might, in hindsight, help us to understand some of the excesses and deficiencies of American jurisprudence in times of emergency.<br><br><br><br>. It is still common to find the traditionalist and rationalist conception that scientific knowledge is the most accurate way of describing natural data, as if, therefore, the notion of knowledge were identical to the notion of natural science. In this article, this conception is problematized, based on some concrete cases of the history of science that seem to show that the beliefs of natural science can also be explained on the basis of non-scientific beliefs, such as the beliefs of sociology, (...) psychology, history and philosophy. That is, the main purpose of this paper is to argue that the assessment one can have of scientific clarity can not be constructed only through explanations provided by the procedures of natural science, but also through explanations provided by the procedures of other distinct areas. This argument runs counter to traditionalist rationalism and will be used in this article to criticize the conception that knowledge, in order to be valid, will necessarily have to be scientific and rational. The controversy over the possibility of an indigenous Latin American Philosophy might be understood as dealing with an older question about the nature of philosophy itself: Is the nature of philosophy purely speculative, practical, or both? For the sake of argument, I am using the term “Latin American Philosophy” in a normative sense as referring to social and political philosophy written by Latin Americans to change oppressive conditions and policies affecting their societies. I am assuming that liberation philosophers fall under (...) the above description. Unlike liberationists, I argue that universalist philosophers can present illuminating and hence persuasive arguments for their position. Of course, liberationists might argue that I am begging the question. But if they could successfully demonstrate that I am doing so, they would be compelled to appeal to at least some nonarbitrary principle of adjudication. If they were to do so, they would be supporting rather than undermining my argument in favor of a universalist conception of philosophy. (shrink)

Carl Schmitt contends that liberal constitutionalism or the rule of law fails because it neglects the state of exception and the political, namely politics viewed as a distinction between friend and enemy groups. Yet, as a representative of liberal constitutionalism, Locke grapples with the state of exception by highlighting a magistrate prerogative and/or the right of the majority to act during a serious political crisis. Rather than neglecting the political, Locke’s state of war presupposes it. My thesis is that Schmitt’s (...) assault against Locke’s liberal constitutionalism is one-sided, and hence Locke’s militant liberalism can disarm it. In support of my thesis I shall argue (1) that Schmitt overlooks Locke’s distinction between liberty and license; (2) that, ironically, Schmitt’s conception of politics resembles Locke’s state of war; and (3) that Locke’s liberalism is militant rather than neutral because it excludes extremists from enjoying equal civil and political rights, as reasonable citizens do, to compete for political power. This paper explores whether terrorist violence could be morally justified or excused. It defends the absolute immunity of innocent people against those who might want to sacrifice them for other goals. The defense is based on recognizing people’s stringent natural duty of nonmaleficence, which entails an obligation on moral agents to refrain from intentionally bringing about harm or significant risk of it to the innocent. The paper is divided into two parts. The first part distinguishes between unconditional and conditional critics’ (...) arguments regarding the use of terrorist violence, and between a narrow and a broad definition of terrorism. While unconditional critics accept the narrow definition or one akin to it because they equate terrorism with murder, conditional critics accept the broad definition or one akin to it because they attempt to justify or excuse the use of terrorism based, e.g., on an analogy with a just war approach, consequentialism, moral relativism, supreme emergency or last resort. Exception is taken with the latter arguments since they attempt to justify or excuse morally unjustifiable and inexcusable actions such as the deliberate use of violence against the innocent. The second part explores plausible conditional critics’ reasons for justifying or excusing the 9/11/01 attacks and find them wanting. If the argument works, then, with minor modifications, it could also apply to the 3/11/04 attacks in Madrid, the 7/7/05 attacks in London, and similar attacks elsewhere. (shrink)

El artículo consta de cuatro partes. En la primera parte, la introducción, señalo algunos aspectos de la importancia del proyecto. Segundo, describo y evalúo como Varela interpreta la filosofía. Tercero, exploro su eclecticismo dentro de su filosofía. Por último, explico el concepto de utilidad en el quehacer filosófico de Varela. Estos tres conceptos: filosofía, eclecticismo y utilidad están correlacionados en su obra. La filosofía con la recta razón. El eclecticismo, o lo que Varela llama la “verdadera filosofía,” con la sabia (...) selección de argumentos, incluyendo diversos métodos para explorar nuestras experiencias cotidianas, y la utilidad con la mesurada evaluación de nuestra conducta, incluyendo el bien común. Dado que estos tres conceptos son polisémicos, ellos pueden ser manipulados, y de hecho han sido tergiversados, por pensadores que han tratado de explicar el pensamiento filosófico vareliano con fines partidistas, ya sea con buenas intenciones o con fines ideológicos tendenciosos. Hamas’s deliberate attack on October 7th against innocent civilians is absolutely wrong. Therefore, it should be universally condemned. And yet, I wonder how a universal recognition of an absolute duty of respect for human dignity can help solving the existential conflict confronting Israelis and Palestinians. Ideally, a two-state solution proposed by the international community can be seen as a reasonable and fair compromise. Nevertheless, the reality on the ground is different. Thus far the existence of one state has precluded the (...) existence of another with no end in sight to their mutually destructive violence. Their conflict demands that people who are reasonable and fair-minded try to understand it holistically and to offer an impartial assessment of this intractable conflict without relativizing the undeserved human suffering of all those involved and affected by it. El ataque deliberado de Hamás el 7 de octubre contra civiles inocentes es absolutamente inicuo. Por lo tanto, debe ser condenado universalmente. Y, sin embargo, me pregunto cómo un reconocimiento universal de un deber absoluto de respeto por la dignidad humana puede ayudar a resolver el conflicto existencial al que se enfrentan israelíes y palestinos. Idealmente, una solución de dos Estados propuesta por la comunidad internacional puede ser vista como un compromiso razonable y justo. Sin embargo, la realidad sobre el (...) terreno es diferente. Hasta ahora, la existencia de un Estado ha impedido la existencia de otro, sin que se vislumbre el final de su violencia mutuamente destructiva. Su conflicto exige que las personas razonables e imparciales traten de entenderlo de manera holística y de ofrecer una evaluación justa de este conflicto insoluble sin relativizar el sufrimiento humano inmerecido de todos los involucrados y afectados por él. First, I argue that the contestability of the term “terrorism” is insufficient to justify the targeting of those who are innocent noncombatants beyond reasonable doubt; second, that states could be as vicious, if not even more so, than nonstate actors could be in perpetrating acts that might be described as terrorism, and, third, that an adequate definition of international terrorism must focus on the actual victims of such despicable acts.

In this paper, it is argued that terrorism undermines the justification of perspective relativism. The cliché, “one person’s terrorist is another person’s freedom fighter,” is offered as an example of perspective relativism. Perspective relativists argue that moral principles and judgments have no universal moral import. Those who defend the cliché expression presuppose that the evaluation of terrorism is necessarily perspectival. For them, there are no morally objective differences, e.g., between deliberately killing combatants and deliberately killing innocent noncombatants. Yet there are (...) morally objective differences between these two acts. While the first act might be justified, the second act is considered murder. Hence, the evaluation of terrorism is not necessarily perspectival. Therefore, in the face of the evil that terrorists bring about, it is argued that perspective relativists have a substantive burden of proof to show that there are no transcultural moral values. Frente a quienes sostienen una incompatibilidad entre historia de la filosofía y filosofía, en cuanto plantean una disyuntiva entre una práctica descriptiva y una argumentativa, en este trabajo nos proponemos mostrar, examinando la labor histórico-filosófica de Aris- tóteles, que esa disyuntiva no es excluyente. Para ello, en primer lugar, examinaremos algunos pasajes de su obra en los que ofrece indicaciones metodológicas que permiten comprender la doble función que cumplen las exposiciones críticas de los filósofos precedentes en la constitución misma de (...) su filosofía. En segundo lugar, ilustraremos el tipo de argumentación aristotélica a través del análisis de las críticas que dirige a las Ideas platónicas como causas. Contra Platón, Aristóteles establece que, para dar cuenta de la ingenerabilidad e incorruptibilidad de las formas, no es necesario caracterizarlas como entidades separadas de la materia y del movimiento. Basta asegurar la eternidad de la forma a través de su reproducción en otros individuos de la misma especie. Tal análisis nos permite concluir, finalmente, que filosofía o historia de la filosofía constitu- yen una falsa disyuntiva en Aristóteles, por lo que el examen dialéctico de las doctrinas precedentes es un método adecuado de indagación filosófica. The adage, “one person’s terrorist is another person’s freedom fighter,” is offered as a plausible example of evoking moral relativism. Moral relativists recognize no transcultural moral facts. So, for them, even the concept of harm would be subjective or context-sensitive. Yet one can appeal to cogent transcultural moral reasons to distinguish between deliberately and unjustifiably harming impeccably innocent people and those who might engage in justifiably harming those guilty of grave crimes. In the face of the preventable evil acts that (...) terrorists frequently perpetrate against impeccably innocent people, it is argued that moral relativists have a substantive burden of proof to demonstrate that no cogent transcultural moral reasons exist against the practice of terrorism. In the absence of such a demonstration, it is reasonable to believe that the practice of terrorism, while not totally defeating moral relativism, seems to undermine its credibility. (shrink)

In my replies to some of my critics I argue that while the practice of terrorism is never justified, I concede that it is rarely but sometimes excused. As result, those who engage in excusable terrorism has a substantial burden of proof. They need to offer a compelling argument to show that the harm caused by their terrorist violence is actually excused by the extenuating circumstances and the goal that they are trying to achieve, so they will not be morally (...) or legally blameworthy for bringing about such harm. I am assuming that they will need to demonstrate that the alleged harm is excusable because it is necessary to accomplish a worthy goal and there is no other reasonable way to obtain such a worthy goal without deliberately harming those who can be reasonably conceived of as impeccably or objectively innocent. That is, those who are innocent beyond reasonable doubt. (shrink)

La polémica fue un importante evento cultural durante el siglo XIX en Cuba. De 1838 a 1840 se debatieron en los principales periódicos de la isla temas en torno a la metafísica, la epistemología, la ética, la pedagogía y la influencia del eclecticismo de Víctor Cousin. Exploro en esta investigación brevemente algunos de los hechos históricos que antecedieron a esta polémica. Arguyo que es inexacta la interpretación predominante que esta polémica fue motivada por el deseo de independizar a Cuba de (...) España. Tal interpretación promueve un mito de emancipación. Según mi análisis, cuando en su intervención en la polémica José de la Luz y Caballero apela al patriotismo, establece sin saberlo un precedente peligroso que usarán los autodenominados protectores del patriotismo para restringir los debates públicos. -/- La polémica filosófica en la Habana se refiere a una serie de debates públicos que acaecieron en el siglo XIX en Cuba principalmente entre jóvenes intelectuales de la época. Con frecuencia estos debates resultaron en argumentos apasionados y algunas veces en ataques ad hominem entre los participantes de dicha polémica. -/- . (shrink)

O objetivo deste trabalho é apresentar as ponderações de Nietzsche sobre a filosofia nascente de Tales de Mileto com base em trechos selecionados dos ensaios nietzschianos do período da juventude intitulados A filosofia na época trágica dos gregos e Sobre verdade e mentira no sentido extramoral, da obra do período de transição A gaia ciência, assim como da obra do período mais tardio de sua vida intitulada Genealogia da moral, uma polêmica. Os trechos são suficientes para enfatizar o “erro” presente (...) na hipótese da água e as implicações da “intuição filosófica” de Tales para a representação da phýsis. Nietzsche pondera que a contemplação de Tales foi movida por uma crença ilógica, fantasiosa e indemonstrável, que encontramos em todos os filósofos, de que é possível acessar a realidade objetiva pelo “conhecimento”. Pondera ainda que o “filosofar indemonstrável” de Tales tem ainda o seu valor em pretender ser em todo caso não místico e não alegórico. Essas ponderações de Nietzsche sobre o filosofar de Tales servem neste trabalho para consolidar a perspectiva nietzschiana de que o conhecimento em suas formas de representar a “vida”, desde Tales, é movido pela crença ilógica na “verdade”, não na “aparência”. According to many philosophers, rationality is, at least in part, a matter of one’s attitudes cohering with one another. Theorists who endorse this idea have devoted much attention to formulating various coherence requirements. Surprisingly, they have said very little about what it takes for a set of attitudes to be coherent in general. We articulate and defend a general account on which a set of attitudes is coherent just in case and because it is logically possible for the attitudes to (...) be jointly satisfied in the sense of jointly fitting the world. In addition, we show how the account can help adjudicate debates about how to formulate various rational requirements. (shrink)

From 1838 to 1840, issues of metaphysics, epistemology, ethics, pedagogy, and the influence of Victor Cousin’s eclecticism were discussed in the island’s leading newspapers. A brief historical account preceding the polemic is offered. It is argued that the predominant view of the polemic as motivated by a widespread desire for Cuba’s independence from Spain is misleading — promoting an emancipatory myth. Lastly, it is argued that José de la Luz y (...) Caballero’s appeal to patriotism during the polemic unwittingly established a dangerous precedent for self-appointed guardians of patriotism to condition public debates. (shrink)

Teniendo esto en mente, Bernard Williams ha desarrollado una crítica en contra de la propuesta ética de Aristóteles, acusándola de una cierta ambición científica en el campo del razonamiento práctico que resulta insostenible actualmente. Este ensayo busca discutir si, en efecto, estos señalamientos tienen (...) un sustento plausible o si, por el contrario, se basan en una interpretación debatible de los fundamentos de la ética aristotélica. A decir verdad, ella nunca lo atrajo tanto como Antígona. Con todo, lo cierto es que él rebajó a Antígona: vulneró la singularidad de la grandeza del carácter de Antígona en la Fenomenología, mezcló su imagen de Antígona con rasgos modernos burgueses, y transfirió con ello algunas características de su singularidad a la imagen de la mujer (...) en el marco de la pequeña familia de la incipiente sociedad burguesa. Esta imagen fusionada de la grandeza de Antígona la acaba dañando, y tampoco ayuda a una interpretación y auto-interpretación apropiada de la mujer, o bien a la elucidación de sus roles sociales y de género en la modernidad naciente. Apartándose estrictamente de esta imagen mezclada, en la Filosofía del derecho Hegel ha ofrecido una imagen comprensible hasta el día de hoy, y en muchos sentidos aún relevante, acerca de los diferenciados roles sociales y de género, adecuados a las expectativas de la incipiente sociedad moderna, o bien acerca de una correspondiente auto-interpretación y autodeterminación para la mujer de la modernidad naciente. La mujer comparte del mismo modo con el hombre la orientación subjetiva-normativa en la actitud práctica: ella debe apropiar y ejercitar correctamente sus roles sociales y de género. Pero todas estas expectativas se encuentran muy alejadas de la grandeza de Antígona. Con ello Hegel abrió una perspectiva a través de su comprensión de la fragilidad de la existencia humana en la modernidad, en medio de la cual mujeres y hombres cuestionamos cada vez el sentido de nuestra propia existencia. Este capítulo presenta una mirada hacia la historia del renacimiento afroperuano en paralelo con la historia del contrapunto de zapateo criollo, una de las prácticas que más destacó el renacimiento. Enfatizando en las nociones de ruptura y acontecimiento del filósofo francés Alain Badiou, se examinan ambos como rupturas que constituyen una nueva historia. En el caso específico del contrapunto esta ruptura está dada por la transición de ser un concurso a ser una práctica escénica. Este documento es el primero en (...) enumerar, hasta donde tengo conocimiento, los cambios fundamentales que esta transición implica: ya no hay un juez, el público cobra un rol fundamental, intervienen más de dos zapateadores, se cierra con una coreografía común. El hecho de que no haya un juez que determine un ganador sella el carácter dialéctico del contrapunto de zapateo escénico. Estas páginas buscan rescatar ese interacción dialéctica de zapateador con zapateador como algo que podemos aplicar a nuestra vida, en la relación que guardamos con los demás. Una relación simultáneamente de admiración, afecto y desafío para crecer. -/- ENGLISH: This chapter presents a parallel of this history of the Afro-Peruvian revival or "renacimiento", as I would rather call it, and the history of the "contrapunto de zapateo", a step dance that unfolds as a "battle" or relationship of challenge. Emphasizing the concepts of Rupture and Event propposed by French philosopher Alain Badiou, I examine both as ruptures that constitute new histories. In the specific case of the Contrapunto, this rupture is given by the transition from being a contest to being a scenic practice. This document, to the best of my knowledge, is the first one to enumerate the fundamental changes that characterize this transition: there is no longer a judge, the audience thus plays a fundamental role, more than two dancers can partake, and the contrapunto closes with a common choreography. The fact that there is no longer a judge that rules for a winner, seals the dialectic nature of the stated contrapunto. The aim of this article is to present the assumptions of Nietzsche's critique of the notion of “truth” that allow to consider his “perspectivism” an excellent critical and epistemological alternative to philosophy of science. It takes place, therefore, an interpretation of the Nietzschean expressions “tragedy”, “tragic knowledge”, “life”, “perspectivism” and “truth”. Nietzsche seems to be convinced that the belief in the notion of “truth” cannot be consistent with “life”, since “life” is also “tragedy” and therefore cannot be reduced to a (...) concept. On the other hand, the notion of “truth” found in natural science seeks to consolidate a concept about reality, which nullifies the plurality of perspectives on life. Thus, an analogy between this aspect behind Nietzsche's perspectivism and the construction of scientific knowledge allows us to consider that the construction of scientific knowledge needs to disregard the notion of truth and to consider all the individual perspectives of scientists – science must not seek truths but metaphors or perspectives on “life” – which allows to show an excellent contribution of Nietzsche to the debates about the notion of truth in the philosophy of science. Há ainda a analogia do conceito de Deus com o espaço e o tempo, na medida em que ambos comunicam infinitude e onipresença. Por fim, nas considerações finais apontarei a importância de Newton para a metafísica moderna e como os seus estudos contribuíram para uma visão posterior do universo e suas leis e do homem enquanto ser pensante. The objective of this article is to approach the way in which Kant considers the “analogies of experience” necessary connections for the scientific representation of the physical world to occur. The method consists of carrying out a conceptual analysis of selected excerpts from theCritique of pure reasonthat may serve to support the interpretation that the analogies of experience are, for Kant, rules that determine the necessary links between perceptions and the ability to understand phenomena. from them. In this way, we (...) seek to explain the divergence between pure knowledge and empirical knowledge, as well as the way in which physics manages to maintain its a priori concepts. -/- O objetivo deste artigo é abordar a maneira como Kant considera as “analogias da experiência” ligações necessárias para ocorrer a representação científica do mundo físico. O método consiste em analisar trechos selecionados da Crítica da razão pura, sobretudo do texto “Analítica dos princípios”, que apresentem as analogias da experiência como regras que determinam as ligações necessárias entre as percepções e a capacidade de compreensão dos fenômenos. Kant argumenta que embora os objetos sejam em si mesmos inacessíveis a nós isto não implica a impossibilidade de pensarmos neles. The purpose of this article is to present the influence of Plotinus' thought on the political philosophy of the Roman Emperor Julian, between the years 361 to 363. The methodology consists of selecting excerpts from the works of Juliano Misopogon and Cartas y Fragmentos that may indicate the influence of the ideas of Plotinus' Ennead in the speech given by the Emperor to legitimize his political power. Juliano argues that the laws of the empire were created by the gods for (...) the organization of human life, so that obedience to the gods necessarily requires an obedience to those laws. According to Juliano, knowledge or episteme about the laws of empire is conditioned to the escape from sensible reality in the name of spiritual reality, in which the wise ruler also needs to transcend the body to know and obey divine laws. Thus, after analyzing Juliano's arguments, we seek to reflect on the viability of the political system adopted by him, especially if the reception of his ideas by rulers from the 20th century onwards is considered. This quantitative study explores the acceptability of Online Learning Action Cell (LAC) practice as a school-based professional development strategy for Tagumpay National High School (TNHS) teachers. The research was motivated by the Department of Education (DepEd) Order No. 35 s. 2016 which prompts public schools to comply with the implementation of LAC sessions because it has a positive impact on teachers’ beliefs and practices resulting in education reforms for learners’ benefit. However, in compliance with DepEd’s policy on maximizing Time-On-Task (DepEd (...) Order No. 9 s. 2005) and the teacher’s conflict of schedule and other ancillary and coordination functions, absences or non-participation in classroom LAC was noted. The viability of offering Online LAC sessions using appropriate media and technologies to provide more options and flexibility for the study is suggested and tested utilizing a conceptual framework drawn from DepEd Order No. 35 s. 2016, Simonson’s Equivalency Theory and Anderson’s Community of Inquiry (COI). A descriptive survey method was used in this study with purposive sampling identifying ten Technology and Livelihood Education (TLE) teachers to pilot the Online LAC based on the memorandum issued by the school head. The subjects went through a week of experience in a LAC session using Facebook (FB) as Learning Management System (LMS) while a researcher-designed survey tool in the form of a Likert-type scale questionnaire was administered via Google forms before and after the online session to measure teacher’s acceptability of Online LAC Session practice. In the analysis, a descriptive statistic shows that pre-post survey results on Online LAC session planning is from ‘moderately acceptable’ to ‘very highly acceptable’; implementation is from ‘acceptable’ to ‘very highly acceptable’, and evaluation is from ‘moderately acceptable’ to ‘very highly acceptable’. TNHS teachers' acceptability of Online LAC session practice increases after their participation in a fully-online learning environment. Limitations, recommendations, future research directions, and conclusions are also included in the study. -/- . (shrink)

Physicians, so it will be argued have by virtue of their profession a weightier obligation than patients to disclose their HIV infection, and also have a duty to refrain from performing exposure-prone invasive procedures. This argument supports both the AMA and CDC guidelines on HIV infected health care workers (HCWS), while undermining the recommendations against disclosure suggested by the National Commission on AIDS (NCA). The argument is divided into three parts. First, a distinction is made between entrenched and fuzzy roles. (...) Second, the physician-patient relationship is described as essentially fiduciary rather than businesslike or merely contractual. Third, the conflict between patients' and physicians' right to know is portrayed as one between patients' and physicians' right to life. Last, given the the probability of infection from seropositive patients to seronegative physicians, and, conversely, is roughly the same, it is recommended as a fair social policy that whenever an invasive procedure occurs, both physicians and patients have a duty to disclose any serious infection that may jeopardize their lives. Consideraba que se estaba viviendo un tiempo de transición, en el que se daba una tendencia hacia un mejor y más feliz estado de cosas, aunque también percibía que la época era de riegos y amenazas. No se pensaba ni como filósofo ni como académico ni como político, se veía a sí mismo como un reformador social, cuya función (...) era educar a la opinión ilustrada y progresista. El propósito de sus textos es persuadir y, con ello, ayudar a transformar. Sus tesis defienden la necesidad de organizar la sociedad moderna bajo ciertos principios para que pueda alcanzar un estado superior de progreso social y moral. -/- Contra la acusación de que John Stuart Mill es un pensador ecléctico, contradictorio y que no añade nada a los clásicos, el libro que el lector tiene en sus manos muestra que su originalidad no consistió en haber creado nuevos conceptos, sino en haber transformado conceptos fundamentales de la filosofía social, moral y política, matizándolos, otorgándoles nuevos sentidos y abriéndoles nuevas posibilidades. Fue un utilitarista, pero la doctrina utilitarista salió renovada de sus escritos. Fue un liberal, pero en un sentido nuevo de liberal, ni clásico ni contractualista. Fue demócrata, aunque en un sentido distinto del de la voluntad general de Rousseau. Sus libros tuvieron una gran acogida y su nombre gozó de prestigio, admiración y respeto en Inglaterra. The objective of this work is to present Ludwig Wittgenstein's perspective on the impossibility of the existence of philosophical problems, to then reflect on the implications of such a perspective based on Popper's thought. For that, Wittgenstein's perspective, as exposed in his work Tractatus logico-philosophicus, is contrasted with Karl Popper's perspective presented in “The nature of philosophical problems and their scientific roots” (in Conjectures and refutations). The example of the problem faced by Kant in his work Critique of pure reason (...) will also be considered for the analysis of Wittgenstein's argument. According to Wittgenstein, philosophical problems are pseudo-problems because they have no solution. However, despite admitting the existence of pseudo-problems, Popper argues that factual, logical, or hybrid problems, under certain circumstances, can be philosophical. Thus, the aim is to contrast these two perspectives in order to emphasize how not all philosophical problems are pseudo-problems. (shrink)

This work presents to dance and music scholarship the concept of competence, developed and deployed by Greimas, together with the semiotic concepts of counterpoint and harmony. I emphasize competence as a temporal process that requires sanction by an external entity and which corresponds to the level of surface narrative syntax within Greimas’s method of ‘generative trajectory’. To exemplify the application of the generative trajectory to dance, I present the case of the contrapunto de zapateo from Peru. In this step dance, (...) two or more dancers take turns and perform for an audience who claps and cheers for them and upon whom depends the appreciation of their competence. To better account for the complex relations between all actors of the contrapunto, I resort to the concept of semiotic counterpoint, which is first explained by means of input–output boxes, inspired by black box modeling in engineering. Counterpoint is also represented using equations, especially to address memory/retention and prediction/protention, with a subsequent discussion of its relevance and articulation to Greimas’s semiotics. Finally, I complement counterpoint with Leibniz’s definition of harmony and Spinoza’s principle of maximization of action, in order to account for different kinds of fluent interactions between dancers, arguing for its application not only to the contrapunto de zapateo, but also to dances such as Capoeira, breakdancing, and contact improvisation. The concept of modes of existence of semiotic entities underlies (post)Greimasian semiotics, yet it seems to have received little attention. Modes of existence can be used in different senses. For Greimas, from the perspective of narrative semiotics, when Michelangelo first receives a block of marble and decides to sculpt the David, his intention is in a virtual mode; as Michelangelo progresses he ends up bringing the David into existence, and his intention comes to the realized mode. In Fontanille’s tensive semiotics, (...) however, modes of existence can have to do with how one can narrow or broaden the scope of our apprehension of the David as our eyes look at it in order to produce a meaningful experience. In this work, the perspectives of narrative and tensive semiotics are contrasted both theoretically and practically applying both to a number of examples. In order to identify all possible modes of existence and all the possibilities of transitioning from one to the other in the examples presented, we resort to the method of finite-state automata from computer science. In the end, we propose a robust narrative account of modes of existence that relies on narrative semiotics for its definition, but into which intent and apprehension from tensive semiotics can be integrated. This work calls for the need of establishing a syntax of modes of existence, since both Greimas and Fontanille construe them as being necessary to account for the production of signification. The purpose of this work is to present the analogy between the thoughts of Epicurus de Samos and Friedrich Nietzsche regarding the notion of “freedom”. In Epicurus, the idea of “freedom” (eleuthería) is linked to the idea of “self-assertion” (autárkeia), since “freedom” for Epicurus means the “exercise of wisdom” through the autonomy of the “sage” (sophós, prhóneo) when it is free to act according to thought. In a similar way, in Nietzsche the idea of freedom (Freiheit) is linked to the (...) idea of “affirming life” (Lebensbejahung) – and “of oneself” – in acting, when the “superman” (Übermensch) is above of good and evil and being able to create and determine their own values. The discussion about freedom, according to the thought of Epicurus and Nietzsche, makes it possible to identify the analogy between them regarding the understanding of the importance of freedom in philosophical action, in addition to promoting a reflection on thinking and acting in the world.
