En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. This article analyzes the epistemological legitimation of mathematics in natural philosophy in the seventeenth century. In the Renaissance it was claimed that mathematics does not meet the Aristotelian criteria of scientificity, and that it did not explain the efficient and final causes. So, its critics, inspired by the Aristotelian tradition, rejected the first attempts to mathematize natural philosophy. The epistemological conditions involved in the debate are examined on the scientific nature of mathematics and its relevance to natural philosophy. A historiographical (...) tour of the mathematization of nature is made to provide new weighing elements with respect to a historically and philosophically more conceptual characterization of the emergence of modern science. By elaborating on the results presented in Lógica cuántica, Nmatrices y adecuación I, here we discuss the notions of adequacy and truth functionality in quantum logic from the point of view of a non-deterministic semantics based on Nmatrices. We present a proof of the impossibility of providing a functional semantics for the quantum lattice. An advantage of our proof is that it is independent of the number of truth values involved, generalizing previous works. Due to the impossibility of defining adequate (...) interpreting sets for the conjunction and disjunction (as was shown in our previous work), it follows that a homomorphism between the lattice of quantum projections and a Boolean algebra of n-elements cannot exist. Since the last century, determining the content of the law has been one of the main discussions of Jurisprudence. The Hart-Dworkin debate has dominated the discussion: to Hart, only social facts determine the content of the law; to Dworkin, it is necessary also to consider moral facts. There has been substantial progress in the debate in the last decades; nonetheless, it is far from settled. Mark Greenberg's idea about the epistemology of nonbasic domains and the tracking of their metaphysics sheds (...) light on the debate. The thesis of the present essay is that the Hart-Dworkin debate is held at different levels of discussion. Hart aims to answer what are the metaphysical foundations of the law. Dworkin seems to engage in academic activism about what ought to be the metaphysical foundations of the law. I argue that the idea of tracking the epistemic foundations of the law is only consistent with social facts being the determinants of the content of the law. Moral facts could be relevant but only mediated by social facts. (shrink)

When a circular coin is rotated in depth, is there any sense in which it comes to resemble an ellipse? While this question is at the center of a rich and divided philosophical tradition (with some scholars answering affirmatively and some negatively), Morales et al. (2020, 2021) took an empirical approach, reporting 10 experiments whose results favor such perspectival similarity. Recently, Burge and Burge (2022) offered a vigorous critique of this work, objecting to its approach and conclusions on both philosophical (...) and empirical grounds. Here, we answer these objections on both fronts. We show that Burge and Burge’s critique rests on misunderstandings of Morales et al.’s claims; of the relation between the data and conclusions; and of the philosophical context in which the work appears. Specifically, Burge and Burge attribute to us a much stronger (and stranger) view than we hold, involving the introduction of “a new entity” located “in some intermediate position(s) between the distal shape and the retinal image.” We do not hold this view. Indeed, once properly understood, most of Burge and Burge’s objections favor Morales et al.’s claims rather than oppose them. Finally, we discuss several questions that remain unanswered, and reflect on a productive path forward on these issues of foundational scientific and philosophical interest. (shrink)

Ultimately this book provides a theory of intergenerational justice that is both intellectually robust and practical with wide applicability to law and policy.

Arguably the most foundational principle in perception research is that our experience of the world goes beyond the retinal image; we perceive the distal environment itself, not the proximal stimulation it causes. Shape may be the paradigm case of such “unconscious inference”: When a coin is rotated in depth, we infer the circular object it truly is, discarding the perspectival ellipse projected on our eyes. But is this really the fate of such perspectival shapes? Or does a tilted coin retain (...) an elliptical appearance even when we know it’s circular? This question has generated heated debate from Locke and Hume to the present; but whereas extant arguments rely primarily on introspection, this problem is also open to empirical test. If tilted coins bear a representational similarity to elliptical objects, then a circular coin should, when rotated, impair search for a distal ellipse. Here, nine experiments demonstrate that this is so, suggesting that perspectival shapes persist in the mind far longer than traditionally assumed. Subjects saw search arrays of three-dimensional “coins,” and simply had to locate a distally elliptical coin. Surprisingly, rotated circular coins slowed search for elliptical targets, even when subjects clearly knew the rotated coins were circular. This pattern arose with static and dynamic cues, couldn’t be explained by strategic responding or unfamiliarity, generalized across shape classes, and occurred even with sustained viewing. Finally, these effects extended beyond artificial displays to real-world objects viewed in naturalistic, full-cue conditions. We conclude that objects have a remarkably persistent dual character: their objective shape “out there,” and their perspectival shape “from here.”. (shrink)

Metacognition is the capacity to evaluate the success of one's own cognitive processes in various domains; for example, memory and perception. It remains controversial whether metacognition relies on a domain-general resource that is applied to different tasks or if self-evaluative processes are domain specific. Here, we investigated this issue directly by examining the neural substrates engaged when metacognitive judgments were made by human participants of both sexes during perceptual and memory tasks matched for stimulus and performance characteristics. By comparing patterns (...) of fMRI activity while subjects evaluated their performance, we revealed both domain-specific and domain-general metacognitive representations. Multivoxel activity patterns in anterior prefrontal cortex predicted levels of confidence in a domain-specific fashion, whereas domain-general signals predicting confidence and accuracy were found in a widespread network in the frontal and posterior midline. The demonstration of domain-specific metacognitive representations suggests the presence of a content-rich mechanism available to introspection and cognitive control. (shrink)

In this chapter, we discuss a selection of current views of the neural correlates of consciousness (NCC). We focus on the different predictions they make, in particular with respect to the role of prefrontal cortex (PFC) during visual experiences, which is an area of critical interest and some source of contention. Our discussion of these views focuses on the level of functional anatomy, rather than at the neuronal circuitry level. We take this approach because we currently understand more about experimental (...) evidence at this coarse level and because these results are appropriate for arbitrating between current theoretical frameworks. We discuss the Two-Visual-Systems Hypothesis (Milner & Goodale 1995; 2006), Local Recurrency (Lamme 2010; Lamme 2006), Higher Order (Lau 2008; Lau & Rosenthal 2011) and Global Workspace theories (Baars 1997; Baars 2005; Dehaene & Naccache 2001; Dehaene 2014). Despite the apparent stark differences between conscious and unconscious perceptual processing, available evidence suggests that their neural substrates must be largely shared. This indicates that the difference in neural activity between conscious and unconscious perceptual processing is likely to be subtle and highly specialized. We argue that current experimental evidence about the involvement of specific activity in prefrontal cortex supports the higher order neural theory of consciousness. In consequence, imaging techniques that focus only on marked differences between conscious and unconscious level of activity are likely to be insensitive to the relevant neural activity patterns that underlie conscious experiences. Finally, it follows from the evidence we discuss that the functional advantages of conscious over unconscious perceptual processing may be more limited than commonly thought. (shrink)

Introspection is a fundamental part of our mental lives. Nevertheless, its reliability and its underlying cognitive architecture have been widely disputed. Here, I propose a principled way to model introspection. By using time-tested principles from signal detection theory (SDT) and extrapolating them from perception to introspection, I offer a new framework for an introspective signal detection theory (iSDT). In SDT, the reliability of perceptual judgments is a function of the strength of an internal perceptual response (signal- to-noise ratio) which is, (...) to a large extent, driven by the intensity of the stimulus. In parallel to perception, iSDT models the reliability of introspective judgments as a function of the strength of an internal introspective response (signal-to-noise ratio) which is, to a large extent, driven by the intensity of conscious experiences. Thus, by modelling introspection after perception, iSDT can calibrate introspection’s reliability across a whole range of contexts. iSDT offers a novel, illuminating way of thinking about introspection and the cognitive processes that support it. This paper introduces the theory QST of quasets as a formal basis for the Nmatrices. The main aim is to construct a system of Nmatrices by substituting standard sets by quasets. Since QST is a conservative extension of ZFA (the Zermelo-Fraenkel set theory with Atoms), it is possible to obtain generalized Nmatrices (Q-Nmatrices). Since the original formulation of QST is not completely adequate for the developments we advance here, some possible amendments to the theory are also considered. One of the (...) most interesting traits of such an extension is the existence of complementary quasets which admit elements with undetermined membership. Such elements can be interpreted as quantum systems in superposed states. We also present a relationship of QST with the theory of Rough Sets RST, which grants the existence of models for SQT formed by rough sets. Some consequences of the given formalism for the relation of logical consequence are also analysed. (shrink)

Our pains can be more or less intense, our mental imagery can be more or less vivid, our perceptual experiences can be more or less striking. These degrees of intensity of conscious experiences are all manifestations of a phenomenal property I call mental strength. In this article, I argue that mental strength is a domain-general phenomenal magnitude; in other words, it is a phenomenal quantity shared by all conscious experiences that explains their degree of felt intensity. Mental strength has been (...) largely overlooked in favor of mental states’ type, representational contents, domain-specific phenomenology, or processes such as attention. Considering mental strength in our reflections about the mind illuminates debates about the relation of representational contents and phenomenal character, and it also helps address questions about the structure and functions of consciousness. Mental strength provides a unifying construct to model what is shared in the phenomenology of different types of conscious experiences. (shrink)

In this work, we discuss the failure of the principle of truth functionality in the quantum formalism. By exploiting this failure, we import the formalism of N-matrix theory and non-deterministic semantics to the foundations of quantum mechanics. This is done by describing quantum states as particular valuations associated with infinite non-deterministic truth tables. This allows us to introduce a natural interpretation of quantum states in terms of a non-deterministic semantics. We also provide a similar construction for arbitrary probabilistic theories based (...) in orthomodular lattices, allowing to study post-quantum models using logical techniques. (shrink)

The so-called ›resolute‹ reading of Wittgenstein, most notably represented by Cora Diamond and James Conant, claims that the text of the Tractatus does not convey a philosophical thesis. In engaging with the text and its literary form, the reader is supposed to cultivate an experience which will eventually allow her to confront (moral) reality without any obstructing philosophical abstractions. The article argues that this under- standing of the text implicitly rests on the traditional and highly problem- atic distinction between rhetoric (...) and ›serious‹ speech, between a use of language which describes facts and one which elicits experiences. By re- constructing the alleged effect of a ›resolute‹ reading of the Tractatus with the help of Iser’s theory of literary experience, it is shown that the ›real- ism‹ that the resolute readers argue for can have no substance at all. The energy codes of human beings transcend physical death as energy never ceases to exist, only to transform. Moreover, our ‘energy body network’ produces new energy through biophotons (...) which allow beings to be in total command of their existence and communicate with the cosmos through a cosmic language. Patient and consistent practice of cosmic meditation and mental physics will lead to an awakening and evolution to a Cosmic Quantum Consciousness that resembles the ultimate connection with the Alpha Energy. This article will explore the perennial approach of Quantum Cosmic Theology which suggests that all people can be united under one fundamental creed while concurrently respecting relatively minor differences in religious belief and practice. Questions Cavell's thesis that scepticism is a "natural" condition for mankind, by exploring certain historical developments (such as the scientific revolution) which does give scepticism a "natural" place in modern thinking. Emphasis is laid upon the question how scepticism can be an overwhelming ordinary experience, which is traced back to the establishment of devices such as the microscope.

Rescue workers have a stressful and risky occupation where being engaged is crucial to face physical and emotional risks in order to help other persons. This study aims to estimate work engagement levels of rescue workers (namely comparing nurses, firefighters, and police officers) and to assess the validity evidence related to the internal structure of the Portuguese versions of the UWES-17 and UWES-9, namely, dimensionality, measurement invariance between occupational groups, and reliability of the scores. To evaluate the dimensionality, we compared (...) the fit of the three-factor model with the fit of a second-order model. A Portuguese version of the instrument was applied to a convenience sample of 3,887 rescue workers (50% nurses, 39% firefighters, and 11% police officers). Work engagement levels were moderate to high, with firefighters being the highest and nurses being the lowest engaged. Psychometric properties were evaluated in the three-factor original structure revealing acceptable fit to the data in the UWES-17, although the UWES-9 had better psychometric properties. Given the observed statistically significant correlations between the three original factors, we proposed a 2nd hierarchal structure that we named work engagement. The UWES-9 first-order model obtained full uniqueness measurement invariance, and the second-order model obtained partial (metric) second-order invariance. (shrink)

During the last few years, burnout has gained more and more attention for its strong connection with job performance, absenteeism, and presenteeism. It is a psychological phenomenon that depends on occupation, also presenting differences between sexes. However, to properly compare the burnout levels of different groups, a psychometric instrument with adequate validity evidence should be selected (i.e., with measurement invariance). This paper aims to describe the psychometric properties of the Oldenburg Burnout Inventory (OLBI) version adapted for workers from Brazil and (...) Portugal, and to compare burnout across countries and sexes. OLBI's validity evidence based on the internal structure (dimensionality, reliability, and measurement invariance), and validity evidence based on relationships with other variables (work engagement) are described. Additionally, it aims presents a revision of different OLBI's versions—since this is the first version of the instrument developed simultaneously for both countries—it is an important instrument for understanding burnout between sexes in organizations. Data were used from 1,172 employees across two independent samples, one from Portugal and the other from Brazil, 65 percent being female. Regarding the OLBI internal structure, a reduced version (15 items) was obtained. The high correlation between disengagement and exhaustion, suggested the existence of a second-order latent factor, burnout, which presented measurement invariance for country and sex. Confirmatory factor analysis of the Portuguese OLBI version presented good goodness-of-fit indices and good internal consistency values. No statistically significant differences were found in burnout between sexes or countries. OLBI also showed psychometric properties that make it a promising and freely available instrument to measure and compare burnout levels of Portuguese and Brazilian employees. (shrink)

Studying the neural correlates of conscious awareness depends on a reliable comparison between activations associated with awareness and unawareness. One particularly difficult confound to remove is task performance capacity, i.e. the difference in performance between the conditions of interest. While ideally task performance capacity should be matched across different conditions, this is difficult to achieve experimentally. However, differences in performance could theoretically be corrected for mathematically. One such proposal is found in a recent paper by Lamy, Salti and Bar-Haim [Lamy (...) D, Salti M, Bar-Haim Y. Neural correlates of subjective awareness and unconscious processing: an ERP study. J Cognitive Neurosci 2009,21:1435-46], who put forward a corrective method for an electroencephalography experiment. We argue that their analysis is essentially grounded in a version of High Threshold Theory, which has been shown to be inferior in general to Signal Detection Theory. We show through a series of computer simulations that their correction method only partially removes the influence of perfor- mance capacity, which can yield misleading results. We present a mathematical correction method based on Signal Detection Theory that is theoretically capable of removing performance capacity confounds. We discuss the limitations of mathemati- cally correcting for performance capacity confounds in imaging studies and its impact for theories about consciousness. (shrink)

Consciousness and confidence seem intimately related. Accordingly, some researchers use confidence ratings as a measure of, or proxy for, consciousness. Rosenthal discusses the potential connections between the two, and rejects confidence as a valid measure of consciousness. He argues that there are better alternatives to get at conscious experiences such as direct subjective reports of awareness (i.e. subjects’ reports of perceiving something or of the degree of visibility of a stimulus). In this chapter, we offer a different perspective. Confidence ratings (...) in general, and metacognitive measures in particular, may offer important advantages over subjective ratings. The arguments we offer here are supported by empirical, practical and socio-strategic considerations. However, we do not suggest consciousness and confidence are interchangeable. We recognize the limitations of confidence ratings in some experimental designs and for some research questions. Nevertheless, we also address a potential conceptual link between consciousness and confidence that stems from Rosenthal’s very own work on mental quality space theory. (shrink)

The concept of shared mental models refers to the shared understanding among team members about how they should behave in different situations. This article aimed to develop a new shared mental model measure, specifically designed for the refereeing context. A cross-sectional study was conducted with three samples: national and regional football referees (n = 133), national football referees and assistant referees and national futsal referees (n = 277), and national futsal referees (n = 60). The proposed version of the Referee (...) Shared Mental Models Measure (RSMMM) has 13 items that are reflected on a single factor structure. The RSMMM presented good validity evidence both based on the internal structure and based on relations to other variables (presenting positive associations with team work engagement, team adaptive performance, and team effectiveness). Such promising psychometric properties point to an optimistic outlook regarding its use to measure shared mental models in futsal and football referee teams. -/- . (shrink)

To find the neural substrates of consciousness, researchers compare subjects’ neural activity when they are aware of stimuli against neural activity when they are not aware. Ideally, to guarantee that the neural substrates of consciousness—and nothing but the neural substrates of consciousness—are isolated, the only difference between these two contrast conditions should be conscious awareness. Nevertheless, in practice, it is quite challenging to eliminate confounds and irrelevant differences between conscious and unconscious conditions. In particular, there is an often-neglected confound that (...) is crucial to eliminate from neuroimaging studies: task performance. Unless subjects’ task performance is matched (and hence perceptual signal processing is matched), researchers risk finding the neural correlates of perception, rather than conscious perception. Here, we discuss the theoretical motivations for the performance matching framework and review empirical demonstrations of, and theoretical inferences derived from, obtaining differences in consciousness while controlling for task performance. We summarize signal detection theoretic modeling frameworks that explain how it is that we can derive performance-matched differences in consciousness without the effect being trivially driven by differences in criterion setting, and also provide principles for designing experimental paradigms that yield performance-matched differences in awareness. Finally, we address potential technical and theoretical issues that stem from matching performance across conditions of awareness, and we introduce the notion of “triangulation” for designing comprehensive experimental sets that can better reveal the neural substrates of consciousness. N.T. Wright has offered Christian philosophers a proposal where it is apparently possible to hold the belief in the intermediate state-resurrection of the body and an ontological holism in the same sense at the same time. I argue that this not only creates a basic contradiction in Wright’s ontological paradigm, but also it is not a coherent and tenable proposal despite the fact one might eventually find a potential solution to such a quandary.

The aim of this paper is to present a revision of international versions of the Utrecht Work Engagement Scale and to describe the psychometric properties of a Portuguese version of the UWES-9 developed simultaneously for Brazil and Portugal, the validity evidence related with the internal structure, namely, Dimensionality, measurement invariance between Brazil and Portugal, and Reliability of the scores. This is the first UWES version developed simultaneously for both countries, and it is an important instrument for understanding employees' work engagement (...) in the organizations, allowing human resources departments to better use workforces, especially when they are migrants. A total of 524 Brazilian workers and 522 Portuguese workers participated in the study. Confirmatory Factor Analysis, group comparisons, and Reliability estimates were used. The use of workers who were primarily professionals or administrative support, according to ISCO-08, reinforced the need to collect data on other professional occupations. Confirmatory factor analysis showed acceptable fit for the UWES-9 original three-factor solution, and a second-order factor structure has been proposed that presented an acceptable fit. Full-scale invariance was obtained between the Portuguese and Brazilian samples, both for the original three-factor first-order and second-order models. Data revealed that Portuguese and Brazilian workers didn't show statistically significant differences in the work engagement dimensions. This version allows for direct comparisons of means and, consequently, for performance of comparative and cross-cultural studies between these two countries. (shrink)

Dynamic Theodicy (DT) is a broad concept we bring up to designate some modern Philosophical Theology attempts to reconcile the necessary and perfect existence of God with the contingent characteristics of human life. In this paper we analyze such approaches and discuss how they have become incomprehensible because the metaphysical assumptions implicit in these explanations have lost their intrinsic relation to the natural human desire for salvation. In the first part we show Charles Hartshorne's DT-model, arising from the modal logic (...) of perfection, and the modern rational problems of this position in making infinite-necessary Being (God) and finite-contingent being (human) compatible. We note that at the heart of the contradictions in this DT account is a dialectical mode of thinking that makes it difficult to find a correct solution to this dichotomy, and to assume a human desire that could be considered related to lifelong goals. In the second part, supported by the proposal of Hans Urs von Balthasar's DT, we develop the concepts of bodily vulnerability, corporeal intentionality, and natural desire for salvation, which come from an Aristotelian-Thomistic thought. This theory is established in order to build an argument, following Alasdair MacIntyre’s ethical framework, on how to make possible the recovery of a metaphysical and anthropological desire that transcends natural aging and goes beyond death. We conclude that both human dependence and the virtues that arise naturally when human beings decide to seek the good of their transcendent condition, make it possible to recover the natural desire for salvation through divine and human love. In this paper we discuss the notions of adequacy and truth functionality in quantum logic from the point of view of a non-deterministic semantics. We give a characterization of the degree of non-functionality which is compatible with the propositional structure of quantum theory, showing that having truth-functional connectives, together with some assumptions regarding the relation of logical consequence, commits us to the adequacy of the interpretation sets of these connectives. An advantage of our proof is that it is independent of (...) the number of truth values involved, generalizing previous works. We also show the failure of the adequacy of every Nmatrix that is a model of the non-distributive lattice of quantum propositions. En este trabajo discutimos las nociones de adecuación y veritativo-funcionalidad en la lógica cuántica, desde el punto de vista de una semántica no determinista. Damos una caracterización del grado de no-funcionalidad compatible con la estructura proposicional de la teoría cuántica, mostrando que tener conectivos veritativo-funcionales, junto con algunos presupuestos relativos a la relación de consecuencia lógica, nos compromete con la adecuación de los conjuntos de interpretación de estos conectivos. Un punto ventajoso de nuestra prueba es que se independiza de la cantidad de valores de verdad involucrados, generalizando trabajos previos. Probamos también que falla la adecuación de cualquier Nmatriz que sirva como modelo para el retículo no distributivo de proposiciones cuánticas. (shrink)

Social entrepreneurship is usually understood as an economic activity which focuses at social values, goals, and investments that generates surpluses for social entrepreneurs as individuals, groups, and startups who are working for the benefit of communities, instead of strictly focusing mainly at the financial profit, economic values, and the benefit generated for shareholders or owners. Social entrepreneurship combines the production of goods, services, and knowledge in order to achieve both social and economic goals and allow for solidarity building. From a (...) broader perspective, entities that are focused on social entrepreneurship are identified as parts of the social and solidarity economy. These are, for example, social enterprises, cooperatives, mutual organizations, self-help groups, charities, unions, fair trade companies, community enterprises, and time banks. Social innovation is a key element of social entrepreneurship. Social innovation is usually understood as new strategies, concepts, products, services, and organizational forms that allow for the satisfaction of needs. Such innovations are created in particular in the contact areas of various sectors of the social system. For example, these are spaces between the public sector, the private sector, and civil society. These innovations not only allow the solving of problems but also extend possibilities for public action. (shrink)

Throughout its history, analytic philosophy has established a decidedly anti-rhetoric self-understanding. Yet the historical development of analytic philosophy, leading from Russell to Quine and Davidson, successively puts this anti-rhetorical ideals in question. Even though the rhetorics of clarity and objectivity remain, the discussions of post-analytic philosophy focus more and more an an understanding of language which is forced to acknowledge its irreducible practical and situational aspects. Analytical philosophy, then, should be seen as a decidedly anti-rhetoric tradition which tries to keep (...) up the spirit of scientific enlightenment in times of growing skepticism -- and which is driven, by the very force of clarity and a better understanding, to develop a picture of language which undermines this ideal at least in some aspects. Sostenemos la tesis de que el concepto de hegemonía que desarrolló Gramsci es deficiente en dos puntos claves: en dar cuenta de los modos de integración característicos de las sociedades complejas, y en su proyección respecto a la construcción de la sociedad futura. Los dos aspectos están relacionados en cuanto que uno y otro remiten a la concepción de una totalidad ética, vertebrada por una concepción del mundo. El concepto de hegemonía, según esto, debiera superar su honda dimensión eticista. Constitutions enshrine the fundamental values of a people and they build a framework for a state’s public policy. With regard to generational change, their endurance gives rise to two interlinked concerns: the sovereignty concern and the forgone welfare concern. If constitutions are intergenerational contracts, how (in)flexible should they be? This article discusses perpetual constitutions, sunset constitutions, constitutional reform commissions and constitutional conventions, both historically and analytically. It arrives at the conclusion that very rigid constitutions are incompatible with the principle of (...) intergenerational justice. Recurring constitutional reform commissions in fixed time intervals would give each generation of citizens a say without leaning too much to the side of flexibility. (shrink)

In this work we study dimensional theoretical properties of some a±ne dynamical systems. By dimensional theoretical properties we mean Hausdor® dimension and box- counting dimension of invariant sets and ergodic measures on theses sets. Especially we are interested in two problems. First we ask whether the Hausdor® and box- counting dimension of invariant sets coincide. Second we ask whether there exists an ergodic measure of full Hausdor® dimension on these invariant sets. If this is not the case we ask the (...) question, whether at least the variational principle for Haus- dor® dimension holds, which means that there is a sequence of ergodic measures such that their Hausdor® dimension approximates the Hausdor® dimension of the invariant set. It seems to be well accepted by experts that these questions are of great importance in developing a dimension theory of dynamical systems (see the book of Pesin about dimension theory of dynamical systems [PE2]). Dimensional theoretical properties of conformal dynamical systems are fairly well understood today. For example there are general theorems about conformal repellers and hyperbolic sets for conformal di®eomorphisms (see chapter 7 of [PE2]). On the other hand the existence of two di®erent rates of expansion or contraction forces problems that are not captured by a general theory this days. At this stage of de- velopment of the dimension theory of dynamical systems it seems natural to study non conformal examples. This is the ¯rst step to understand the mechanisms that determine dimensional theoretical properties of non conformal dynamical systems. A±ne dynamical systems represent simple examples of non conformal systems. They are easy to de¯ne, but studying their dimensional theoretical properties does never- theless provide challenging mathematical problems and exemplify interesting phe- nomena. We consider here a special class of self-a±ne repellers in dimension two, depending on four parameters (see 2.1.). Furthermore we study a class of attractors of piecewise a±ne maps in dimension three depending on four parameters as well. The last object of our work are projections of these maps that are known as gener- alized Baker's transformations (see 2.2.). The contents of our work is the following: In chapter two we give an overview about some main results in the area of di- mension theory of a±ne dynamical systems and de¯ne the systems we study in this work. We will explain, what is known about the dimensional theoretical properties of these systems and describe what our new results are. In chapter three we then apply symbolic dynamics to our systems. We will introduce explicit shift codings 4 and ¯nd representations of all ergodic measures for our systems using these codings. From chapter four to chapter eight we study dimensional theoretical properties, which our systems generally or generically have. In chapter four we will prove a formula for the box-counting dimension of the repellers and the attractors (see the- orem 4.1.). Then in chapter ¯ve we apply general dimensional theoretical results for ergodic measures found by Ledrappier and Young [LY] and Barreira, Schmeling and Pesin [BPS] to our systems. These results relate the dimension of ergodic measures to metric entropy and Lyapunov exponents. Using this approach we will be able to reduce questions about the dimension of ergodic measures in our context to ques- tions about certain overlapping and especially overlapping self-similar measures on the line. These overlapping self-similar measures are studied in chapter six. Our main theorem extends a result of Peres and Solomyak [PS2] concerning the absolute continuity resp. singularity of symmetric self-similar measures to asymmetric ones (see theorem 6.1.3.). In chapter seven we bring our results together. We prove that we generically (in the sense of Lebesgue measure on a part of the parameter space) have the iden- tity of box-counting and Hausdor® dimension for the repellers and the attractors. (see theorem 7.1.1. and corollary 7.1.2.). This result suggest that one can expect that the identity of box-counting dimension and Hausdor® dimension holds at least generically in some natural classes of non conformal dynamical systems. Furthermore we will see in chapter seven that there generically exists an ergodic measure of full Hausdor® dimension for the repellers. On the other hand the vari- ational principle for Hausdor® dimension is not generic for the attractors. It holds only if we assume a certain symmetry (see theorem 7.1.1.). For generalized Baker's transformations we will ¯nd a part of the parameter space where there generically is an ergodic measure of full dimension and a part where the variational principle for Hausdor® dimension does not hold (see theorem 7.1.3.). Roughly speaking the reason why the variational principle does not hold here is, that if there exists both a stable and an unstable direction one can not generically maximize the dimension in the stable and in the unstable direction at the same time. In an other setting this phenomenon was observed before by Manning and McCluskey [MM]. In chapter eight we extend some results of the last section to invariant sets that correspond to special Markov chains instead of full shifts (see theorem 8.1.1.). In the last two chapters of our work we are interested in number theoretical excep- tions to our generic results. The starting point of our considerations in section nine are results of ErdÄos [ER1] and Alexander and Yorke [AY] that establish singularity and a decrease of dimension for in¯nite convolved Bernoulli measures under special conditions. Using a generalized notion of the Garsia entropy ([GA1/2]) we are able 5 to understand the consequences of number theoretical peculiarities in broader class of overlapping measures (see theorem 9.1.1.). In chapter ten we then analyze number theoretical peculiarities in the context of our dynamical systems. We restrict our attention to a symmetric situation where we generically have the existence of a Bernoulli measure of full dimension and the identity of Hausdor® and box-counting dimension for all of our systems. In the ¯rst section of chapter ten we ¯nd parameter values such that the variational principle for Hausdor® dimension does not hold for the attractors and for the Fat Baker's transformations (see theorem 10.1.1.). These are the ¯rst known examples of dynamical systems for which the variational principle for Hausdor® dimension does not hold because of number theoretical peculiarities of parameter values. For the repellers we have been able to show that under certain number theoretical conditions there is at least no Bernoulli measure of full Hausdor® dimension; the question if the variational principle for Hausdor® dimension holds remains open in this situation. In the second section of chapter ten we will show that the identity for Hausdor® and box-counting dimension can drops because there are number theoretical pecu- liarities. In the context of Weierstrass-like functions this phenomenon was observed by Przytycki and Urbanski [PU]. Our theorem extends this result to a larger class of sets, invariant under dynamical systems (see theorem 10.2.1). At the end of this work the reader will ¯nd two appendices, a list of notations and the list of references. In appendix A we introduce the notions of dimension we use in this work and collect some general facts in dimension theory. In appendix B we state the facts about Pisot-Vijayarghavan number, we need in our analysis of number theoretical peculiarities. The list of notations contains general notations and a table with a summary of notations we use to describe the dynamical systems that we study. From the perspective of Latin American philosophy, the contribution done by Juan Carlos Scannone is undeniable. Theologian and philosopher, his purpose was to establish philosophical categories of thought that answer to Latin American problems from their ethical-historical-cultural nucleus. The objective of this article is to propose some contributions for inculturation in Philosophical Anthropology from the Latin American thought was developed by Scannone. Hoy en día se percibe una crisis en torno a las relaciones de la sociedad con el estado producto del descrédito por no sentirse identificados con el gobierno de turno, los actos de corrupción, la ineficacia de las acciones en torno a desastres naturales y humanos como la pandemia del Covid-19. Esta realidad planetaria nos invita a pensar en una nueva racionalidad política que sea incluyente reconociendo las diferencias y diversidades del ciudadano común. Para este cometido, el presente artículo realiza (...) una revisión de la literatura desde un recorrido histórico desde diferentes autores de la filosofía política sobre los sentidos y las tensiones en las relaciones entre la sociedad y el estado. Luego se plantea lo que es una nueva racionalidad política a partir de un sujeto político emergente que, ante las adversidades, las situaciones de marginalidad y pobreza, hace prevalecer el sentido de una conciencia colectiva. Desde un enfoque hermenéutico, se realiza una definición de lo político, como una forma alternativa de la praxis política que busca recuperar el sentido de organización, convivencia y toma de decisiones desde nuestra condición como seres políticos. De esta manera, las relaciones sociedad-estado serán resituadas para la búsqueda de un nuevo orden post-covid más justo, solidario, tolerante y resiliente. (shrink)

This article focuses on an Ethno philosophy through intercultural philosophy and dialogue. This philosophical reflection stands on an historical, cultural and ethical subject known as “us” in the Latin American experience. From an intercultural dialog and its philosophy, there will be an approach of Ethno philosophy as a new way of thinking and doing philosophy from interculturalism, the recovery of ancestral knowledge and the dialogue of different forms of knowledge from the diversity of worldviews of different cultures and ethnic groups.

A recent fMRI study by Webb et al. (Cortical networks involved in visual awareness independent of visual attention, Proc Natl Acad Sci U S A 2016;113:13923–28) proposes a new method for finding the neural correlates of awareness by matching atten- tion across awareness conditions. The experimental design, however, seems at odds with known features of attention. We highlight logical and methodological points that are critical when trying to disentangle attention and awareness.

This book brings together a number of researchers of different nationalities to reflect on religion and philosophy in ancient Greece. These scholars have been convened by the Brazilian research group Delphos and discuss, in particular, how religious and philosophical thought intertwined during this period. Among the papers collected here, several are devoted to epic and philosophical literature before Plato. The others deal, alongside this great classical philosopher, with Aristotle and Philo of Alexandria. These contributions allow us to recognise how the (...) vision of the cosmos, metaphysics and human life are intertwined in Greek thought. A journey is made from traditional Greek religion to its philosophical reinterpretations, reaching as far as the monotheistic God of Judaism made known in the Hellenic language. The nature of the cosmos, investigated scientifically, is no stranger to the Greeks' view of the divine, but neither is ethics, with all its demands. Thus, these studies provide a kaleidoscopic view of the various points of view from which nature, the human condition and divinity are approached through the eyes of ancient Greek literature. We develop a modern interactive libertarian dualism of physical and mental events using the concept of probability.

Perception is our primary means of accessing the external world. What is the nature of this core mental process? Although this question is at the center of scientific research on perception, it has also long been explored by philosophers, who ask fundamental questions about our capacity to perceive: Do our different senses represent the world in commensurable ways? How much of our environment can we be aware of at one time? Which aspects of perception are ‘objective’, and which ‘subjective’? What (...) properties count as perceptual in the first place? Although these parallel research programs typically proceed independently in contemporary scholarship, previous eras recognized more active collaboration and interaction across philosophical and scientific approaches to perception. Here, we review an emerging research focus that has begun to reunite these approaches, by putting several long-standing philosophical questions to empirical test. Unlike more general sources of philosophical inspiration, the work described here draws a direct line from a prominent philosophical conjecture or thought experiment about perception to a key test of that question in the laboratory—such that the relevant experimental work would not (and even could not) have proceeded as it did without the preceding philosophical discussion. Finally, we explore themes arising from these successful interactions, and point to further philosophical questions that might be amenable to empirical approaches. (shrink)

In dealing with arguments against the Christian faith in his book The Philosophy of Religion, Herman Bavinck uses a series of argumentative strategies. One of these strategies is the apologetic of despair. This study tries to fi gure out whether this strategy tends to be observed in most essays of the book or its use is only circumstantial.

In this paper, I reject that animal reasoning, negation in particular, necessarily involves the representation of absences, as suggested by Bermúdez (2003, 2006, 2007), since this would still work as a logical negation (unavailable for non-linguistic creatures). False belief, pretense, and communication experiments show that non-human animals (at least some primates) have difficulties representing absent entities or properties. I offer an alternative account resorting to the sub-symbolic similarity judgments proposed by Vigo & Allen (2009) and expectations: animal proto-negation takes place (...) through the incompatibility between an expected and the actual representation. Finally, I propose that the expectation paradigm be extrapolated to other experi-ments in cognitive psychology (both with pre-linguistic children and animals) in order to design fair experiments that test other minds considering their true abilities. In French post-structuralism, »decentering« signifies the criticism of any metaphysical »centre« which is supposed to reign the development and the logic of discourse, and hence of thinking. In particular, anthropology and the recourse to humanism were suspected to miss the plurality and the self-differing nature of discursive practices. This article presents Dewey’s philosophy as an alternative to this criticism. Dewey is comparably sceptical of any attempt to treat the human being as a metaphysical essence. Nevertheless, he develops an explicit humanism (...) which defends the central values of freedom, openness, and growth. This paradoxical humanism is rendered possible by developing a concept of nature, and the human being, which,decenters‘ the specific human capacities by consequently treating them as an integral part of nature. This paper invites the reader to reflect philosophically about the educational challenges from a new emerging rationality. Besides the logic and instrumental reason of Modernity, the emerging rationality appears in education as an inclusive, colloquial and integrative new way to think.
