The essay deals with the question whether Fichte’s socio-economic model which based both on the experiences and ideas of his time. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? (...) What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Ingenieur- und Naturwissenschaften sind Knoten eines engen Beziehungsgeflechts, in dem Mensch und Gesellschaft, Natur und Kultur weitere Knoten sind. Entwicklungen in diesen beiden Bereichen haben somit stets Auswirkungen sowohl auf die anderen Knoten als auf das Beziehungsgeflecht als Ganzes. Ingenieur- und Naturwissenschaften sind als ars humana zudem stets eine Form menschlicher Handlung. Damit werden sie zu einem Schlüsselproblem der theoretischen und praktischen Philosophie. Denn der Mensch, seine Handlungen und seine Eingliederung in die Gesellschaft stehen ebenso wie die Natur und die (...) Kultur seit jeher im Zentrum philosophischer Untersuchungen. Die Philosophie vermag diese beiden Wissenschaftsbereiche zu fundieren und kritisch zu begleiten. Philosophie, Ingenieur- und Naturwissenschaften haben das Vermögen, sich gegenseitig zu befruchten. In Anbetracht der humanen, sozialen und ökologischen Probleme des 21. Jhds. ist die fachbereichsübergreifende und partnerschaftliche Zusammenarbeit dieser drei Schlüsselbereiche unabdingbar. Sie ist eine nicht hintergehbare Grundbedingung aller Entwicklungen, die den Anspruch erheben, nachhaltig zu sein und damit dem normativen Leitziel folgen, heutigen und zukünftigen Generationen bedingungslos ein menschenwürdiges Leben zu ermöglichen. Ingenieure und Naturwissenschaftler können dabei einen wesentlichen Beitrag leisten. Der Konstruktionsbegriff erfuhr er unter dem Eindruck technischer Fortschritte wie soziokultureller Veränderungen vor allem im 19. Jahrhundert wesentliche Wandlungen. Mit dessen selbstverständlich erscheinender Nutzung ergibt sich die Frage nach seinem Bedeutungsfeld: Ist Konstruieren ein Prozess, der sich auf das Entwerfen, die Präsentation der äußerlichen Gestalt des zu erzeugenden Gegenstandes konzentriert oder sind in ihm wesentlich mehr Aspekte impliziert? Im 17./18. Jahrhundert war Konstruktion verbunden mit dem Maschinenbegriff und vom Anspruch getragen, das geschlossene Ganze der Maschine als Objekt zu erfassen. Im (...) Unterschied dazu wurde namentlich in der klassischen deutschen Philosophie der Konstruktionsgedanke in ganz anderer Weise ausgebildet. Insbesondere Fichte vollzog einen Paradigmawechsel, indem er die Konstruktion zur universellen Fähigkeit der Begriffsbildung erhob. Wissen galt ihm als ideale "Nachkonstruktion" des Seins unter der Form des Wissens. Es verbindet sich damit der Wechsel vom ordnenden zu einem entwerfenden Weltverhältnis. Das Wissen erscheint nun als ein Werdendes. Im Herausarbeiten der theoretischen-begrifflichen Fassung des Wesens eines Gegenstandes manifestiert sich der entwerfende, tätige Charakter des Subjektes. The concept of construction underwent significant changes under the influence of technical advances and socio-cultural changes, especially in the 19th century. With its seemingly obvious use, the question of its field of meaning arises: Is construction a process that focuses on design, the presentation of the external shape of the object to be produced, or are significantly more aspects implied in it? In the development of his analytical-synthetic method Fichte sought recourse to diaeresis, which reflects back methodically to Plato. While Plato indisputably provides the historical origin of diaeresis, very little is given as a direct reference for Fichte’s decision of terms. Therefore, the essay examines which contemporary scientific and philosophical problems led to the reference point for the resumption and reformation of diaeresis. It also shows how Fichte developed the diaeresis into a special transcendental philosophical method as well as tracking how it marks a turning point in philosophy. The multifaceted methodological and epistemological considerations for formulating the unity and diversity of appearances in nature and history form the contemporary background for Fichte’s development of a new type of analytical-synthetic method. By laying down a basic form which in itself contains the possibility of a differentiated formation, the philosophical development of the concept becomes traceable in its genesis. This marks the point where Fichte's conception transcends the contemporary taxonomic approaches and their spatially-static stratification of concepts. The same applies to the approaches that shape hybridization with their latent temporalization of the conceptual chain. It forms a rupture in thinking related to the linking of species, in that the idea of the mediation of the species (of concepts) among themselves becomes the idea guiding the knowledge. Genetic reconstruction follows the path of the transformation of the absolute I and thus the subject involved in these changes in the process of cognition as a kind of ›unwrapping‹ into other modes of appearance up to ›reality‹ as a representational existence. It is known that in connection with proposed educational reforms in the German states around 1800, Johann Gottliebe Fichte, following the Enlightenment concepts, developed a program, which considered education as an indispensable human right. In this program, the idea of providing all the citizens with the opportunity to get an education has been formulated as a social task and a condition of social and political modernization. In accordance with Fichte’s thought, over the cultivation of individuals, a new morality, and then, (...) on that basis, a new civic subject had to shape itself. The science thenceforth should have obtained a function of organizing a new society, in Fichte’s vision of it, instead of theology having previously played that role, while the public education system should have mediated the application of the scientific principles of organizing the society and thus to become a driving force in this development process. The generally accessible education and science were conceived by Fichte as autonomous moments of social organization, being the area intact by any immediate influence of authorities and based on the principles of individuals’ free communication. Fichte’s theorem of intersubjectivity has introduced an understanding of teaching as a social and communicative process into the ethical and political, as well as into the educational thought. It was not limited to reproduction of predetermined skills by the subject, but took into account the subject’s formation in the course of actively perception of educational contents and the change of the subject himself taking place by that. Имея в виду произошедшие около 1800 г. в немецких государствах реформы образовательных учреждений, И. Г. Фихте в направлении развития соответствующих просветительских концептов предложил программу, в которой образование обосновывалось в качестве неотъемлемого права человека. В этой программе идея предоставить всем гражданам возможность получения образования была сформулирована как общественная задача и условие социально-политической модернизации. По мысли Фихте, посредством культурного развития индивидов должна была сформироваться новая нравственность и на этой основе — новый гражданский субъект. Функцию обоснования организации нового общества, как оно виделось Фихте, вместо прежде игравшей эту роль теологии отныне должна была получить наука, а общественное образование должно было стать посредником в применении научных принципов формирования общества и тем самым одновременно движущей силой процесса общественного развития. Общедоступное образование и наука мыслились Фихте в качестве автономных моментов организации общества, областей, неподверженных непосредственному влиянию власть предержащих и основанных на принципах свободной коммуникации индивидов. Фихтевская теорема интерсубъективности ввела в этико-политическую и педагогическую мысль понимание обучения как социально-коммуникативного процесса, не ограничивающегося воспроизведением субъектом предзаданных навыков, но имеющего в виду его образование в ходе активного восприятия учебного материала и осуществляющееся при этом изменение самого субъекта. Der Artikel behandelt die Problemstellung inwieweit der Klassik-Begriff als Periodenbegriff sinnvoll ist. Dabei wird herausgearbeitet, dass ein historisch-kritischer Zugang den Begriff als einen Wertungsbegriff aus einer jeweils gegebenen historischen Perspektive zu dechiffrieren vermag.

Der Autor analysiert die methodologische Grundlegung der Transzendentalphilosophie durch Fichte. Als entscheidenden Punkt arbeitet er den durch Fichte vollzogenen Paradigmenwechsel heraus Danach kommt der Systembegründung nicht mehr ein vorwissenschaftlicher Status zu, sondern diese wird Moment der Systemkonstitution und Systemkonstruktion. Das erlaubt Fichte, die philosophische Methode in ihrer Strenge von der Methode der Mathematik abzuheben. -/- The author analyzes the methodological basis of Fichte's transcendental philosophy. As a decisive point, he works out the paradigm shift that Fichte carried out. Im Artikel wird weiterhin insbesondere das methodische Vorgehen Fichtes und dessen Dogmatismuskritik analysiert. Para ello, el sujeto trascendental experimentó una profunda historización a través del intento de desarrollar una fenomenología del espíritu. Aim Excellent organization of the internal processes is essential for a well-functioning health care system. Particularly, the process of treatment and interaction with the patients is important because the perception of treatment and interaction has a direct relation to the patients’ satisfaction. The latter has a strong influence on the recovery of the patients. The impact of the maturity level of the treatment and interaction process on patient orientation is investigated at the example of an extensive survey of hospital managers (...) in Ukraine. -/- Method The analysis is based on an empirical data collection conducted with hospital managers and their deputies in a large Ukrainian city, which is acknowledged as a ‘model city’ with regard to a comprehensive health care reform in the country. By means of the Business Process Maturity Model (BPMM) we have tested our hypothesis that a high level of process maturity leads to a high level of patient orientation. For this purpose, we have developed a scale for measuring the level of process maturity and have checked the method on validity and reliability. A total of 79 hospital managers and deputies, who represent all public health care facilities of the city (hospitals, primary care clinics, etc.), participated in the study. -/- Results The study reveals a clear relationship between the level of maturity of the treatment and interaction process and the level of patient orientation of the respective health care facility. The variance, which is explained by the independent variable process maturity level, is 16.3 %. All formative dimensions have a strong significant influence on the construct “patient orientation”. Likewise the maturity level of the treatment and interaction process shows a strong significant influence on patient orientation. -/- Conclusion For health care facilities it is of great importance to achieve a high maturity level of the treatment and interaction process to live up to the claim of being patient oriented. The maturity of the process can be tested using the questionnaire developed in the course of our study. (shrink)

Background The health care sector is experiencing a drastic transition all over the world. This has an impact not only on the way hospitals, clinics, special-care homes etc. are organized, but also on patients, personnel and other stakeholders involved. The consequences of changes for both physicians and patients are investigated using a comprehensive health care reform in Ukraine as an example. -/- Methods The analysis is based on empirical data collected from general physicians in 2 Ukrainian cities. Based on the (...) Job Demands-Resources Model, we developed a set of hypotheses and tested them using the structural equation modelling technique. A total of 178 general physicians (81% of the approached population) participated in the study. -/- Results Our investigation reveals a clear relationship between the organizational job demands (additional tasks, structural changes, new processes) and their psychological effects (e. g., burnout). The latter have a negative impact on cooperation of physicians in hospitals leading to lower patient satisfaction. -/- Discussion and Conclusions Change in health care is inevitable. The example of Ukraine shows that openness of hospitals towards change reduces the probability of physicians’ burnout and, eventually, increases patient satisfaction. We strongly suggest applying the process management approach in order to increase openness to change, especially in turbulent times. (shrink)

Background: Mental health professionals working in correctional contexts engage a double role to care and control. This dual loyalty conflict has repeatedly been criticized to impede the development of a high-quality alliance. As therapeutic alliance is a robust predictor of outcome measures of psychotherapy, it is essential to investigate the effects of this ethical dilemma. Methods: This qualitative interview study investigates patients’ perceptions of their therapists’ dual role conflict in court-mandated treatment settings. We interviewed 41 older incarcerated persons using (...) a semi-structured interview guide, the interviews were subsequently analyzed following thematic analysis. Results: We first present the patients’ perceptions of their treating psychotherapist’s dual loyalty conflict, which was linked to their overall treatment experience. In a second step, we outline the study participants’ reasons for this judgment, which were most commonly linked to feelings of trust or betrayal. More specifically, they named certain therapist characteristics and activities that enabled them to develop a trustful therapeutic alliance, which we grouped into four topics: respecting the patient’s pace and perceived coercion; patient health needs to be first priority; clarity in roles and responsibilities; and the art of communication – between transparency and unchecked information sharing. Discussion: Developing a high quality alliance in mandatory offender treatment is central due to its relationship with recovery and desistance. Our findings show that some therapists’ characteristics and activities attenuate the negative impact of their double role on the development and maintenance of the alliance. To increase the effectiveness of court-mandated treatments, we need to support clinicians in dealing with their dual role to allow the formation of a high quality therapeutic alliance. Our qualitative interview study contributed to this much-needed empirical research on therapist’ characteristics promoting a trustful relationship in correctional settings. (shrink)

In this article I place Jurgen Habermas' recent turn to a "post-secular society" in the context of his previous defence of a "postmetaphysical" view of modernity. My argument is that the concept of "postsecular" introduces significant normative tensions for the formal and pragmatic view of reason defended by Habermas in previous work. In particular, the turn to a "post-secular society" threatens the evolutionary narrative that Habermas espoused in The Theory of Communicative Action, The Philosophical Discourse of Modernity or Postmetaphysical Thinking, (...) according to which modern "communicative" reason dialecticlly supersedes religion. If this narrative is undermined, I argue, the claim to universality of "communicative" reason is also undermined. Thus, the benefits Habermas seeks to obtain from translation of religion are offset by a destabilization of tenets central to a "postmetaphysical" view of modernity. (shrink)

Jürgen Habermas ha dedicato più di trent’anni dei suoi studi alle scienze sociali al fine di definire, attraverso la ricostruzione delle tradizioni di pensiero in esse presenti, un quadro teorico di riferimento che orienti i programmi della ricerca storico-sociale. Al pari dei grandi classici del pensiero sociologico, egli ha cercato di affrontare i “problemi della società nel suo insieme” esplicitando gli assunti, i metodi e gli obiettivi della teoria sociale come presupposto indispensabile per un’indagine che ampli i confini disciplinari della (...) sociologia, da un lato, alla riflessione filosofica, dall’altro alla ricerca storiografica. Nel lungo itinerario della sua formazione scientifica questo programma rappresenta il filo conduttore nell’analisi dei “sistemi culturali”, dei “sistemi sociali”, dei “sistemi della personalità” e, soprattutto, nella “teoria dell’evoluzione sociale”, dalla ricostruzione delle condizioni necessarie alla genesi antropologica delle forme socio-culturali di vita – l’“ominizzazione” – sino all’esame della logica e della dinamica di sviluppo delle “formazioni sociali” che egli suddivide in primitive, tradizionali, moderne e contemporanee. Nella Postfazione all’edizione italiana di Profili politico-filosofici (2000), una raccolta che contiene scritti di quarantacinque anni di studi (1953-1998), Leonardo Ceppa sottolinea i due aspetti essenziali dell’opera di Habermas: “la coerenza teorica” e il “carattere assimilatorio”. Habermas non è un pensatore “rivoluzionario” ma un “riformista” che, ricorrendo a un’immagine ingegneristica, all’isolamento del “pensiero che scava fossati” preferisce “costruire ponti” tra i campi del sapere. Questa ricerca si segnala per il tentativo di recepire criticamente le acquisizioni specialistiche delle scienze sociali e della filosofia finalizzando questa tensione apprenditiva alla costruzione di un quadro generale. Nato dai nostri colloqui seminariali, di cui mantiene la forma dialogica dei “turni di parola”, il presente volume focalizza lo sguardo sulle società contemporanee – ripercorrendone la struttura, le sfide presenti e gli scenari futuri – e sulla funzione sociale della sociologia. Ne scaturisce un’indagine di fenomeni fondamentali per comprendere le trasformazioni della modernità: la modernizzazione, il capitalismo organizzato, lo stato sociale, la democrazia politica, la diversità culturale, l’opinione pubblica nell’epoca dei media, la globalizzazione, la crisi ecologica, le disuguaglianze mondiali, i conflitti nazionalistici, il terrorismo islamico, la secolarizzazione, l’ingegneria genetica, l’integrazione europea e la politica mondiale. Nel riordinare i temi sociologici da lui proposti abbiamo cercato di sistemare l’analisi delle società contemporanee a un livello che non si accomodi sul piano dei commenti troppo facili che gli intellettuali, i politici e la gente comune amano fare sull’attualità e che, mantenendo una visione d’insieme sull’opera, chiarisca il testo e i suoi punti ciechi. Il volume si propone come uno strumento di lavoro che accompagni a una lettura critica. Sullo sfondo rimane la domanda se Habermas riesca davvero a conseguire, nei suoi itinerari attraverso la “storia delle idee”, la coerenza logica e la profondità d’indagine necessarie a “sistematizzare” le ricerche delle scienze sociali. Alcune perplessità avvalorate dal confronto con i testi e con la letteratura critica ci hanno suggerito di riservare ai problemi metodologici uno studio specifico che chiarisca il concetto di “scienza ricostruttiva” e ne illustri le applicazioni nell’ambito delle teorie della riproduzione culturale, della socializzazione e dell’evoluzione delle formazioni sociali – uno studio le cui linee sono solo anticipate nell’Introduzione. Il programma di ricerca e la sua recezione critica, relativamente agli assunti della teoria dell’evoluzione sociale. Riprendendo una felice espressione di Karl Popper, ci auguriamo di aver raggiunto la chiarezza argomentativa e la semplicità linguistica dovuta al lettore, confidando nella “cooperazione amichevole-ostile di molti scienziati”. The paper is focused on the criticisms that theorists of political constitutionalism raise against legal constitutionalism, especially with regard to the idea of representation and political sovereignty. At the same time, the intention is to reconstruct the debate between legal and political constitutionalism in contemporary liberalism, starting from the so-called counter-majoritarian difficulty. This debate concerns two different approaches: the political one rejects the idea of judicial review by the Supreme Court because it may establish a possible rule of the (...) judges (Michelman; Dworkin). It defends the role of Parliament in constitutional matters, in contrast with the role of the Supreme Court, inasmuch as – according to them – it is not open to political participation. Parliament is considered the only place in which we can exercise our constitutional power and in which our rights could be adequately protected (Bellamy; Waldron; Tushnet; Goldoni). On the other hand, legal constitutionalism upholds the idea of judicial review, defending the role of the Supreme Court as “exemplar of public reason” (Rawls 1993). This article tries to answer to three fundamental questions about constitutional democracy under the banner of political liberalism: 1. What do we mean by counter-majoritarian difficulty? 2. What is the answer that legal and political model of constitutionalism give to this question? 3. What is the role of constitutional courts in democratic regimes and what is their authority within the State? (shrink)

This article addresses the Conings case – a Belgian soldier, currently wanted for threatening Belgium’s top virologist Marc Van Ranst and the illegal possession of weapons in a terrorist context. It moreover argues for a more situated analysis of Belgium’s far-right extremism by looking at its complex political climate.

Habermas’s postmetaphysical reading of Kierkegaard is paradigmatic for his understanding of religion. It shows, why Habermas reduces religion to fideism. Therefore the paper reconstructs Habermas’s reception of Kierkegaard and compares it with the accounts of Dieter Henrich and Michael Theunissen. Furthermore it demonstrates how Habermas makes use of Kierkegaard’s dialectics of existence to formulate his postmetaphysical thesis of a cooperative venture.

This paper discusses a dialectic whereby the law not only influenced medical thinking in late nineteenth-century Germany, but also underwent medicalization of its own initiative. At the end of the 1880s, social legislation was crucial in initiating the German discourse on traumatic nervous disorders. By employing doctors as medical experts in court, the law also created a new experiential realm for doctors, altering their behavior toward patients and shifting their focus from therapy to investigation. However, in the wake of (...) their experiences in court, doctors developed a dual etiology of traumatic symptoms, which included the law itself as a pathogenic element with the power to aggravate symptoms. Two medical views of law can be distinguished: some doctors claimed that it was the desire to receive the pensions offered under social legislation that induced workers to perpetuate and exaggerate their symptoms; others argued that since pension claims embroiled claimants in intimidating legal proceedings, the pathogenic effect of social legislation stemmed from fear rather than greed. The paper discusses Habermas` contribution to a debate between him and Joseph Ratzinger, at the time the prefect of the Congregation for the Catholic faith. Habermas is criticized for his tendency to adopt openly anti-enlightenment positions.

Domestic courts have attained prominent status in the international human rights system. While adjudicating individual claims and interpreting legal provisions, domestic courts have conveyed meanings that are integral to the working of the international human rights system. The dynamism of domestic courts is an undeniable quality, through which they incorporate diverse perspectives based on principles linked to individual sovereignty, justice, peace, etc. In this paper, the role of the Indian Supreme Court has been discussed in light of three landmark (...) decisions where the court applies international and domestic human rights standards to substantiate its interpretations. In light of the cases of Navtej Singh v. Union of India, Joseph Shine v. Union of India, and KS Puttaswamy v. Union of India, the paper examines the approach of the court under five broad headings: (a) the domestic context, (b) autonomy and determination, (c) constitutional parameters and validity of laws (d) vulnerability, and (e) other courts and other contexts. In the near future we may be able to manipulate human embryos through genetic intervention. Jürgen Habermas has argued against the development of technologies which could make such intervention possible. His argument has received widespread criticism among bioethicists. These critics argue that Habermas's argument relies on implausible assumptions about human nature. Moreover, they challenge Habermas's claim that genetic intervention adds something new to intergenerational relationships pointing out that parents have already strong control over their children through education. In this paper (...) a new approach to Habermas's theory is suggested which makes clear that he has a strong point against genetic intervention. A more charitable reading of Habermas with respect to his assumptions concerning human nature is presented. Moreover, Habermas's assumption concerning the power of genetic controlling is evaluated. By means of a close comparison of genetic and educational control it is shown that Habermas's argument relies on much weaker assumptions than generally understood. (shrink)

The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, (...) a critical analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. Should the law recognize an elephant’s right to be released from solitary confinement? The New York State Court of Appeals—the highest court in the State of New York—will consider this question on May 18. At issue is an Asian elephant named Happy. But happy she is not. Every human being has a right to bodily liberty because they have strong interests that this right protects. Domestic courts are often quoting foreign case law on human rights. The conversation pursued through cross-referencing across jurisdictions has added to the globalization of international human rights standards. As the practice is gaining ground and becoming a more permanent feature of domestic judgments, its relevance needs to be examined. A closer look at the practice will bring forth a more realistic understanding of the approaches of domestic courts and the advantages which they offer to the institution. This paper raises few (...) questions on the value and influence of cross-referencing in the area of human rights. Questions in this regard can be posed as to (a) whether cross-referencing is reflective of an emerging consensus on the subject matter? (b) Is it strategic for domestic courts to quote foreign case law? (c) Is the practice of cross-referencing simply a trend or an urge to belong to a community of courts? (d) Is the practice of relevance towards the implementation and advancement of international human rights standards? The topic can shed light on broader themes including the universality of human rights, contestations/disagreements over human rights standards, and the measure of acceptability of international human rights standards within domestic settings. This paper discusses the practice, its role and influence in relation to international human rights standards. Three judgments [of the courts of Nepal, India and Singapore] addressing the human rights and homosexuality agenda have been illustrated for discussion. (shrink)

Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply (...) with some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

Since Jürgen Habermas' speech for the Peace Price of the German Book Trade in October 2001, secular reason – personified by one of its main protagonists – has been able to debate with religion anew. For the purpose of an unbiased encounter between philosophy and religion, Habermas introduced the term “postsecular” back then in order to emphasize that this dialogue was inevitably necessary, all the more in the face of religiously motivated terrorism. Nonetheless, this willingness to debate was accompanied by (...) the conviction that secular reason itself, as a matter of fact, would be “ideologically neutral”. However, taking the necessity of accomplishing the confrontation with “world” (Weltbewältigung) seriously, the reflection on world view as a whole unveils its implied tasks of granting metaphysical and existential certainty (metaphysische Sicherheit), therefore resulting in the statement that there cannot be a neutral world view at all. Only dialogue as exchange of beliefs generates the general framework within which the discursive issues of world views are separated from their existential aspects, thus enabling a reasonably conducted debate without endangering the existential certainty of its participants. As a consequence, the neutrality of world views exclusively rests in dialogue and is no unique feature of secular reason at all. Eventually, this leads to the reconsideration of the conditions that must be given for an argument to be called “rational”. The article tries to point out that an argument in political contexts, whether given by a religious or a secular person, should only be acknowledged rational if it takes at least all living people – regardless of their group affiliations – into account. This interview with Professor Dr Jürgen Stolzenberg, board member of the Kant-Gesellschaft and co-editor of the Kant-Lexikon (2015), explores a wide range of topics — from Leibniz and Wolff to Heidegger and Husserl. The leading idea of Stolzenberg’s philosophical research is the justification of the principle of modern subjectivity in Kant’s philosophy and its transformations until our days. He discusses the meaning and development of the concept of self-consciousness and the understanding of subjectivity in Kant’s ethics as well as in (...) Fichte’s philosophy. Stolzenberg shows the significance of Heidegger’s philosophical relations with Kant, Fichte, and the Neo-Kantians. He outlines the reasons which explain the different structures of the philosophical theories after Kant in comparison with the structure of Kant’s philosophy itself. Answering the question of Kant’s role in affirming the value of human dignity, he emphasises the non-empirical essence of this concept as it is presented in Kant’s ethics and as it should be defended against recent critics. According to Stolzenberg, the principle of modern subjectivity proves to be fruitful in understanding the development of the history of modern music, too. (shrink)

The evolution of Habermas follows that of Rawls in Political Liberalism, where the principles of justice are traced back to a historical background and no longer derived from an original position as in A Theory of Justice; and even Rawls, curiously enough, while he made his own the criticism in a broad sense Hegelian, of opponents such as Walzer,continued not to recognize the debt he now owed them. Appropriations of the opponents' objections, withdrawals disguised as victories, ad hoc distinctions and (...) so on, are common staple in disputes between thinkers, phenomena that it would be too easy to dismiss with accusations of tendentiousness or lack of rigour. -/- . The paper aims to explore the contour of internet regulation with a thread of Brand X , which navigates through constitutionalism, separation of powers, as well as business and economic or political implications enshrined behind it. An exemplary insight with the Korean case was adverted that could lead to the comparative perspective of internet law and regulation for the future research. The research was conducted by employing qualitative investigation, mainly relying on textual analysis and documentary examination. The outcome of research (...) generally corroborates with our assumption that i) the increasing administrative state will variegate the traditional interplay of three branches, ii) expert bureaucracy stands at the core of policy shaping because of the necessary new concept of market and policy specialization, iii) the role of US government is not only pioneering, but also influential as a regulator, but comparatively with differing national jurisdictions if not a negligible implications on the international competition or even conflict.
