Whataboutism, eine weit verbreitete Argumentationsstrategie in Debatten über den Israel-Gaza-Krieg, lenkt oft durch Gegenfragen von der eigentlichen Kritik ab. Doch trotz seines schlechten Rufs kann Whataboutism auch positive Auswirkungen haben.

Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies stellt die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will, vor ein Problem: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. Durch eine Rekonstruktion und Kritik der sozialphilosophischen Debatte um Freiheit in Foucaults Werk lässt sich der Begriff der Freiheit als Kritik systematisch bestimmen. So kann – mit Foucault gegen Foucault – gezeigt werden, dass er nur innerhalb einer pluralistischen und liberalen Demokratietheorie gedacht werden kann. (shrink)

Teil I »Psychologische Ästhetik für transdisziplinäres Design« -/- Kapitel I »Empirische Ästhetik – Der Konflikt zwischen leichter Verarbeitbarkeit, sparsamer Codierung und neuronaler Aktivierung im Beobachtersystem. Eine Untersuchung über das Wesen der ästhetischen Erfahrung. -/- Jede Designpraxis verlangt täglich eine Vielzahl von Entscheidungen, welche die Wahl von „Etwas vor dem Hintergrund anderer Möglichkeiten“ darstellen. Diese lassen sich als Probleme einer Präferenz-Ästhetik interpretieren, wobei innerhalb eines Repertoires von Alternativen die attraktivste gewählt wird. Eine empirische Ästhetik ist somit ein notwendiger Bestandteil von (...) Designtheorie. Die Überlegung, wer in welcher Situation warum was bevorzugt, führt zur Forschungsfrage: »Was ist der elementare Mechanismus für eine ästhetische Erfahrung?« In der Literatur zur empirischen Ästhetik finden sich vier wesentliche Theorie-Gruppen: (1.) Es wird eine Präferenz für einfach zu verarbeitende Stimuli behauptet und z.B. mit der Processing Fluency begründet. (2.) Andere Ansätze erklären eine maximale Stimulation des Beobachters durch komplexe Objekte zum Ideal, was auch die ästhetische Erfahrung maximieren soll. (3.) Eine dritte Gruppe vermeidet die Probleme der ersten beiden, indem eine mittlere Komplexität als Präferenz behauptet wird. (4.) Und schließlich gibt es Ansätze, die auf eine integrierende Theorie letztlich verzichten und einzelne Phänomene bzw. Effekte katalogisieren. Eine Liste ungelöster Probleme formuliert die Minimal-Anforderungen an eine integrierende Theorie. Hiermit wird geprüft, ob bzw. inwieweit die Integrative Ästhetik von Schwarzfischer (2008 und 2014) jene Probleme lösen kann. Dieser Ansatz schlägt spezifische Re-Codierungs-Prozesse als basalen Mechanismus jeder ästhetischen Erfahrung vor. Hierzu wird ein Prozess-Modell entwickelt, welches die Integrative Ästhetik überprüfbar macht. Bei der Modellbildung werden manche Konzepte der Integrativen Ästhetik erweitert und andere präzisiert. Auch die Anwendungsmöglichkeiten werden durch das Modell vielfältiger, da es nicht nur als Erklärungsmodell, sondern zudem als Gestaltungsmodell einsetzbar ist. Insgesamt zeigt die Überprüfung der Integrativen Ästhetik und des Modells, dass die Gütekriterien in einem vielversprechenden Maß erfüllt werden. Die grundsätzliche Quantifizierbarkeit wird aufgezeigt sowie die Relevanz und die Anwendbarkeit für das Design nachgewiesen. Die Forschungsfrage kann somit als hinreichend beantwortet gelten: »Der elementare Mechanismus für eine ästhetische Erfahrung scheint ein Re-Codierungs-Prozess zu sein (der auf der Nutzung von In­varianzen basiert), welcher extensionale Daten zu intensionalen Gestalten transformiert, wobei eine Ressourcen-Entlastung stattfindet und der Gültigkeitsbereich der Codierung erweitert wird (was nach Jean Piaget als Dezentrierung bezeichnet wird) – was jeweils durch eine ‚Beobachtung zweiter Ordnung‘ festgestellt wird.« -/- Teil II »Transdisziplinäre Ästhetik im Dialog« -/- Kapitel II.A »Profane und heroische Beobachtungs-Experimente: Kunst-Ästhetik als methodisches Artefakt.« -/- Es reicht nicht, eine Liste mit vorgeblich ‚schönen Dingen‘ zu erstellen, um ‚das Schöne‘ zu verstehen. Piaget & Garcia (1989) unterscheiden drei Stufen in jedem Erkenntnis-Prozess: 1. isolierte Fakten, die unabhängig von einander analysiert werden; 2. konkrete Transformationen, durch welche diese Fakten mit einander verbunden sind; 3. eine Struktur, die alle denkbaren Fälle konstruierbar macht. Sie nannten diese drei Stufen ‚intra‘, ‚inter‘ und ‚trans‘. Dies kann auf das ‚höhere Erkenntnisvermögen‘ angewandt werden wie auf das ‚niedere‘. Wissenschaftlichkeit setzt nach Popper die Falsifizierbarkeit einer Theorie voraus – und damit Prognosefähigkeit. Prognosen müssen über den Bereich der bereits bekannten Fälle hinausgehen, und finden sich folglich primär in der Piaget-Phase ‚trans‘. Diese ist davon gekennzeichnet, dass es über die Gegenstände hinausgeht (‚trans-objekt‘). Zu häufig werden Artefakte nur beschrieben (‚intra-objekt‘) oder einzelne, zufällig bekannte Transformationen von Material in Artefakte bzw. von Artefakt in Verständnis aufgezählt (‚inter-objekt‘). Erst eine ‚Integrative Ästhetik‘ jenseits von zufälligen Semantiken, jenseits von sozialen Exklusions-Rhetoriken der Künstler und der ‚Leisure-Class-Eliten‘ (nach Veblen) und jenseits der Hierarchisierung von Wahrnehmungs-Modi kann den Anspruch einlösen (‚trans-objekt‘). Daraus folgen u.a. separierbare Semantiken spezifischem Maßstabs, die sich überhaupt erst dann z.B. als ‚konventionelle Kunst-Auffassung‘ beobachten lassen. Zentrierungen auf solche Semantiken können demnach „als Kunst missverstanden werden“ – obwohl sie keineswegs das allgemeine Prinzip repräsentieren, sondern stets nur Spezial­fall bleiben. -/- Kapitel II.B »Das Gehirn als Hypothesenmaschine – Ästhetische Prozesse als Selbst-Test im Beobachter-System.« -/- Die historische Trennung zwischen Techne, Poiesis und Aisthesis scheint nach der „konstruktivistischen Wende“ obsolet geworden zu sein. Jede Beobachtung kann als Handlung betrachtet werden und setzt adaptive Aspekte schon voraus. Jedoch fehlte bislang eine tragfähige konstruktivistische Ästhetik, deren Gültigkeitsbereich hinreichend groß ist: So ist die Beschränkung auf Kunst ebenso unnötig wie jene auf Kommunikation in sozialen Systemen (also auf „Kunst-Diskurse“) oder auf eine Produktions-, Werk- bzw. Rezeptions-Ästhetik. Die definitorische Auflösung des Kunst-Begriffes (z.B. bei Gernot Böhme) löst diese Schwierigkeiten nicht. Im Wesentlichen bleibt die resultierende phänomenologische Ästhetik eine Rezeptions-Ästhetik. Ähnlich begrenzt bleibt der Anwendungsbereich der Informations-Ästhetik mit kybernetischen Wurzeln. Auch die Einbettung in eine evolutionäre Ästhetik oder Neuroästhetik scheint problematisch. Daher muss eine „Integrative Ästhetik“ sehr unterschiedliche Sichtweisen in sich vereinigen. Inzwischen klassisch zu nennende kybernetische, systemtheoretische oder informations-ästhetische Ansätze verwenden meist die Logik einer Bottom-Up-Verarbeitung (Input-Processing-Output), wie sie auch die kognitive Psychologie der zweiten Hälfte des 20. Jahrhunderts dominierte. Dass laut Schlicht et al. (2013: S.475) selbst im visuellen Kortex nur ca. 5% der neuronalen Verknüpfungen bottom-up verschaltet sind (und der „Rest” von 95% top-down oder lateral arbeitet), stellt auch die empirische Ästhetik vor Probleme. Dieser Beitrag stellt jene Integrative Ästhetik vor, welche diese Antworten auf diese Fragen zu geben vermag – und den genannten Beschränkungen nicht unterliegt. Der elementare Prozess einer ästhetischen Erfahrung besteht hier in einer Re-Codierung von extensionalen Daten zu intensionalen Codierungen. Durch die sparsamere Codierung stellt dies eine erhebliche neuronale Entlastung dar und erhöht zudem beträchtlich den Gültigkeitsbereich des Codierten. Vom Beobachter-System wird dies subjektiv als Dezentrierung (nach Piaget) positiv erlebt. Zentral ist, dass es nun mit einem einheitlichen methodischen Rahmen möglich ist, entweder bottom-up die Wahrnehmung zu analysieren oder top-down die subjektive Motivation (z.B. die erlebte Autonomie oder die erlebte Entlastung) des Akteurs zu thematisieren. Die Richtung der Prozesse wird umkehrbar. Zudem wird die konstruktivistische Wahrnehmungs-Handlung zu einer Art von Selbst-Test des Wahrnehmungs-Systems: „Funktioniere ich sensorisch und kognitiv überhaupt? Funktioniere ich korrekt, also konsistent? Und, funktioniere ich effizient?“ -/- Kapitel II.C »Beobachtende Systeme – Dezentrierende Gestalt-Integration als Basis einer Ästhetik des Alltags.« -/- An der ästhetischen Erfahrung irritiert traditionell, dass der Effekt bekannt ist, nicht aber die Ursachen und der funktionale Mechanismus. Dies leistete Mystifikationen Vorschub, was zu diversen metaphysischen Kunst-Ästhetiken führte: Der Künstler als Schamane oder Magier. Dieser Beitrag möchte dagegen einen systemsemiotischen Ansatz für eine empirische Ästhetik vorstellen. Die aktive Rolle des Beobachters im Wirkungszusammenhang soll den Blinden Fleck erhellen, aufgrund dessen sich das Phantom eines passiven Rezipienten und „quasi-aktiver“ ästhetischer Objekte so hartnäckig halten konnte. Ausgehend von gestalttheoretischen Überlegungen wird Gestalt als implizite, algorithmische Codierung begriffen. Neuere empirische Ergebnisse der „Neuro-Ökonomie“ postulieren einen Effekt der „kortikalen Entlastung“ (bei der Forschung nach der Wirkung von Marken). Der hier vertretene Ansatz verknüpft nun beide Aspekte und glaubt, daraus eine konsistente Theorie für die empirische Ästhetik des Alltags entwickeln zu können. Es muss jedoch ein weiterer Aspekt hinzu genommen werden, den Piaget „Dezentrierung“ nennt. Ästhetische Erfahrung wird dann definierbar als das Erlebnis eines Umcodierungs-Prozesses – oder genauer: als das Erlebnis einer dezentrierenden Gestalt-Integration durch das beobachtende System. Sowohl beobachtende Systeme als auch Gestalt-Integrationen sind in unserem Ansatz als multiple zu denken. Eine semiotische Differenzierung ist nun entscheidend: Die herkömmliche Informations-Ästhetik thematisierte nur die syntaktischen Aspekte des Stimulus, ohne den Beobachter in seiner aktiven Rolle zu begreifen. Gestalt-Integrationen samt deren dezentrierender Wirkung sind jedoch auch in semantischer und pragmatischer Hinsicht zu finden. Diese werden im Beitrag dargelegt. Denn erst so kann die Vielschichtigkeit ästhetischer Erfahrungen erklärt werden, wo z.B. syntaktische und pragmatische Aspekte konkurrieren können. Auch vordergründig destruktive Akte und Artefakte sind dann als Gestalt-Integrationen anderer Dimensionen oder differierender Bezugssysteme begreifbar. (Dies streift etwa auch Fragen der Ressourcen-Allokation.) Zudem muss die Kontingenz von Beobachtungs-Maßstäben, Wahrnehmungs-Modi, Struktur-Determinanten (des beobachtenden Systems) und kultur-semiotischen Prägungen mit in Betracht gezogen werden. Erst hierdurch wird der Möglichkeitsraum potenzieller Gestalt-Integrationen (der eigentlich aus einem präsentationalen und einem repräsentationalen Raum besteht) prinzipiell beschreibbar. Wenn auch die Probleme bzw. Grenzen der praktischen Durchführbarkeit entsprechender Analysen nicht unterschlagen werden sollen: Die Möglichkeiten entsprechen gut den Erfordernissen zur ästhetischen Analyse des menschlichen Alltages – schließen die Lebenswelten von nicht-anthropozentrischen Seinsformen aber wohl methodisch aus. Dieser Beitrag möchte ich primär eine empirische Ästhetik zur Diskussion stellen, die mir als Rahmen für die weitere Forschung sehr leistungsfähig erscheint. Und doch ist nichts weniger als ein theoriebildender Ansatz das Vorhaben. Eine der Konsequenzen aus diesem Ansatz ist die These, dass es sich bei Kants Diktum vom „interesselosen Wohlgefallen“ zwar für das Individuum um ein Apriori handelt, bei der Gattung Mensch jedoch evolutionär um ein Aposteriori. Oder sind sie Ursache neuer Ungleichheiten, Machtverhältnisse und Konflikte? In den Auseinandersetzungen zu diesen Fragen haben sich heterogene Theorien über die Organisation von Staat, Ökonomie und internationalem System herausgebildet, die politische und ökonomische Diskurse und Praxen bis in die Gegenwart prägen. Der vorliegende Aufsatz stellt den Versuch dar, die normative Seite von Wittgensteins Frühwerk herauszuarbeiten und dabei an seinem Ansatz insofern Kritik zu üben, als gezeigt wird, wie sehr dessen Implikationen mit unseren üblichen ethischen Vorstellungen in Konflikt stehen. Die Arbeit hat aber auch einen etwas wohlwollenderen Aspekt: Sie versucht zu zeigen, wie Wittgensteins scheinbar widersinnige Ansichten so formuliert werden können, daß sie zumindest begreifbar erscheinen. Zu diesem Zweck beginnen wir mit der Untersuchung des demjenigen Wittgensteins erstaunlich ähnlichen ethischen Ansatzes, (...) wie er von einem seiner frühen väterlichen Freunde vertreten wurde, nämlich von Karl Kraus. In his recently published posthumous works "Prefiguration" and "The Rigorism of Truth" Hans Blumenberg surprisingly steps into the area of political history that he had left widely unconsidered in "Work on Myth". While "Prefiguration" tackles the “demonic” aspects of Napoleon and Hitler that Blumenberg tries to dismantle and bring into derision, in "Rigorism of Truth" he attacks Hannah Arendt's phrase of the Banality of Evil in relation to the Jerusalem trial against Adolf Eichmann in 1961. In this latter issue Blumenberg (...) defends the demonic he sees culminated in the form of Eichmann to assert what he calls the “mythical dimension“ in the Israeli process of nation-building. To him, Eichmann represents a prototypical demon incarnate that must be slaughtered by the heroic character seen in young state Israel. This obviously turns Blumenberg's criticism of Napoleon and Hitler into an affirmation of political myths that, on the face of it, appears to be a contradiction in terms. The essay focuses on this theoretical tension and tries to point out that significance (“Bedeutsamkeit”) is not only a necessity for individual self-assertion (“Selbstbehauptung”) but also a category of communality that must be handled with care. Obwohl die SSSSK und der Rest des Weltmilitärs riesige Summen für fortschrittliche Hardware ausgeben, ist es sehr wahrscheinlich, dass WW3 (oder die kleineren Engagements, die dazu führen) von softwaredominiert wird. Es ist nicht ausgeschlossen, dass die SSSSK, mit wahrscheinlich mehr Hackern (Codern), die für sie arbeiten, als der Rest der Welt zusammen, zukünftige Kriege mit minimalen physischen Konflikten gewinnen wird, nur indem sie ihre Feinde über das Netz lähmt. Keine Satelliten, keine Telefone, keine Kommunikation, keine Finanztransaktionen, kein Stromnetz, kein Internet, (...) keine fortschrittlichen Waffen, keine Fahrzeuge, Züge, Schiffe oder Flugzeuge. Es wird wahrscheinlich innerhalb weniger Jahrzehnte über den Inseln im Südchinesischen Meer oder Taiwan passieren, aber da sie weltweit Militärstützpunkte errichten, könnte es überall passieren (siehe Crouching Tiger etc.). Zukünftige Konflikte werden Hardkill- und Softkill-Aspekte mit den erklärten Zielen der KPC haben, den Cyberkrieg zu betonen, indem sie Kontrollsysteme aller militärischen und industriellen Kommunikation, Ausrüstung, Kraftwerke, Satelliten, Internet, Banken und jedes mit dem Netz verbundene Gerät oder Fahrzeug hacken und lähmen. Die eudaimonistische Tugendethik sieht sich, was ihre innere Struktur anbelangt, standardmäßig mit den Vorwürfen des Egoismus und Anthropozentrismus konfrontiert, was auch das Projekt einer ökologischen Tugendethik zu gefährden scheint. Der vorliegende Artikel versucht, ausgehend von der Tugendethik Erich Fromms, eine neue Perspektive auf diese Standardvorwürfe zu entwickeln, indem er den theoretischen Implikationen nachgeht, die die Anerkennung der Biophilie – der Liebe zum Leben – als eine der Tugenden des Menschen für den Frommschen Ansatz hat. Die zunächst noch exegetisch ausgerichtete Diskussion (...) der werkinternen Relation von humanistischer und biophiler Ethik bei Erich Fromm leitet schließlich zu einer stärker systematisch ausgerichteten Diskussion der inneren Dynamik von selbst- und umweltbezogenen Tugenden im tugendhaften Akteur über. In diesem Zuge wird deutlich gemacht, dass das selbstbezogene Streben nach eigener Eudaimonie und das umweltbezogene Streben nach der Förderung des Objekts der eigenen Liebe zwar durchaus miteinander in einen Konflikt geraten können, dass dieser Konflikt aber nicht zur Selbstauslöschung der Tugendethik führt, sondern stattdessen im tugendhaften Akteur eine produktive Dynamik entfaltet. Die klassische Gegenüberstellung von Anthropozentrismus und Biozentrismus innerhalb der Ethik lässt sich auf diese Weise unterlaufen. (shrink)

Der Aufsatz beschäftigt sich am Beispiel des deutschen "Kopftuchstreits" mit der rechtlich-politischen Auseinandersetzung um subjektive Rechte innerhalb des liberalen Rechtsstaats. Wie Christoph Menke in seiner Deutung der für den politischen Liberalismus wesentlichen politischen Konflikte gezeigt hat, bezieht sich diese Auseinandersetzung vorrangig auf zwei Fragen: Wer sollte Anspruch darauf genießen, ein politisches Subjekt zu sein, das heißt, als Gleiche oder Gleicher berücksichtigt zu werden? Welche Ansprüche politischer Subjekte könneen als schützenswerte Verwirklichung subjektiver Rechte gelten? Der vorliegende Beitrag beschäftigt sich vorwiegend mit (...) der Frage, wie die politischen Konflikte des letztgenannten Typs auf die rechtliche Auseinandersetzung um Grundrechte abfärben. Damit wende ich mich gegen ein Verständnis der Grundrechte, das diese als Garant der ethischen Neutralität eines liberalen Gemeinwesens ansieht. Ich möchte zeigen, dass der Sinn subjektiver Rechte in der liberalen Demokratie zwar unter anderem genau darin besteht, dass sie partikulare ethische Wertvorstellungen neutralisieren und die Bürgerinnen und Bürger innerhalb eines vernünftigen Rahmens vor Unterdrückung schützen. Wie eine Analyse der Entscheidungen des Bundesverfassungsgerichts (BVerfG) zum "Kopftuchstreit" zeigt, wird diese Funktion aber stets zugleich durch die partikulare Interpretation gleicher Rechte unterminiert. Dies bezeichne ich als die Dekonstruktion der Neutralität, die sich im Recht vollzieht. (shrink)

Der vorliegende Beitrag ist als ein Versuch zu verstehen, dem polnischen Leser eine recht seltsame Position aus der Reihe der deutschsprachigen Lodzaica, nämlich die 1913 im Verlag August Grüning in Pabianice herausgegebene Sammlung von Witzen und Anekdoten mit dem Titel 'Ne Mütze voll Witze aus Lodz und Pabianice’, näherzubringen. Der Verfasser des schmalen Bändchens, der sich hinter dem Pseudonym Wilfried Spectator verbirgt, ist Reinhold Piel, ein Deutscher aus Pabianice. Als Satelitenstadt von Łódź, der sich damals sehr rasch entwickelnden Textilmetropole, bildete (...) auch Pabianice in jenen Jahren zweifelsohne ein Teil des in ganz Europa einmaligen und eigenartigen multikulturellen und multiethnischen Tigcls. Reinhold Piel stellte sich mit seinem Büchlein die Aufgabe, ein Sammelporträt der Mentalität des typischen Vertreters jenes Tigels von Kulturen und Sprachen zu zeichnen. In der mehrere disparate Elemente integrierenden Gemeinschaft funktionierte der Humor sicherlich als eine Art Sicherheitsventil, mit dessen Hilfe man bestrebt war, Fremdes zu „zähmen“ und Konflikte zu entschärfen. Scheinbar abstrakte, „auslachende“ Beispiele haben sich wahrscheinlich ebenfalls vortrefflich als Methode bewährt, andere diplomatisch zu sensibilisieren, aber auch eigene Nachteile und Unzulänglichkeiten mit Abstand zu sehen. Der universale Charakter der Anekdote als literarisches Genre beruht u.a. auf ihrer Ahistorizität und Konkretheit zugleich, ihr narratives Werkzeug hingegen - die individualisierte Sprache des multiethnischen Milieus - liefert hervorragenden StolT für sprachwissenschaftliche Forschung. Ein besonders interessanter Aspekt ist dabei vor allem die Frage nach der Übersetzbarkeit bzw. Unübersetzbarkeit von Kulturidiomatik. Um dem Leser entgegenzukommen und ihm den historischen und informativen Wert der besprochenen Sammlung bewusst zu machen, wird im Anhang - zum ersten Mal in der polnischen Sprache - eine Auswahl von besonders charakteristischen Witzen der genannten Sammlung von R. Was wissen Sie über Kosovo? Nicht genug. Nicht genug jedenfalls über objektive, wertfrei vorgegebene Fakten, mit deren Hilfe man verantwortungsethische Bewertungen des NATO-Angriffs begründen könnte. Trotzdem halte ich drei wertende Aussagen über den Kosovo-Konflikt für vernünftig. Sie lauten (in alphabetischer Reihenfolge): Der bewaffnete Kampf der Albaner im Kosovo war moralisch falsch. Die Militäreinsätze der Serben im Kosovo waren moralisch falsch (schon vor Beginn der NATO-Bombardements und erst recht danach). Und schliesslich: Die Luftschläge des Westens gegen Serbien waren moralisch falsch. (...) Insbesondere diese letzte Behauptung ist der Zielpunkt des Aufsatzes. Mein Plädoyer für diese Behauptung verläuft auf einem dritten Weg zwischen der gesinnungsethischen Position pazifistischer Rigoristen und der verantwortungsethischen Position ihrer Kontrahenten. Die grundlegende Richtlinie für meine Untersuchung besteht darin, keine Behauptungen als objektiv auszugeben, die in Wirklichkeit auf Wertungen beruhen. Schon beim Blick auf die Vorkriegs- und Kriegsgeschehnisse im Kosovo kommen wir nicht ohne die Hilfe von Werten aus; und ich plädiere dafür, diese Geschehnisse im Lichte einer verzweifelten Menschenliebe anzusehen: Daraus ergibt sich eine neue Form von Pazifismus. Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

Die philosophischen, traditionellen Ansätze zur Moral beruhen hauptsächlich auf metaphysischen und theologischen Konzepten und Theorien. Unter den traditionellen Ethikkonzepten ist die göttliche Befehlstheorie die prominenteste (DCT). Gemäß der DCT gibt Gott der Menschheit moralische Grundlagen durch ihre Schöpfung und durch Offenbarung. Moral und Göttlichkeit sind seit der fernsten Zivilisation untrennbar. Diese Konzepte tauchen in einen theologischen Rahmen ein und werden hauptsächlich von den meisten Anhängern der drei abrahamitischen Traditionen angenommen: Judentum, Christentum und Islam: dem bedeutendsten Teil der menschlichen Bevölkerung. Die (...) göttlichen Befehlstheorien halten den Glauben und die Offenbarung für ihre Grundlage und unterliegen nicht strikt der Demonstration. Die Gegner der Gottesbefehlskonzeption der Moral, gegründet auf der Unmöglichkeit der Demonstration ihrer metaphysischen und religiösen Annahmen, haben seit vielen Jahrhunderten (obwohl erfolglos) versucht, ihre Bedeutung zu devalvieren. Sie hielten das Argument, dass es keine materiellen Beweise und logische Kohärenz zeigt und aus diesem Grund nicht für wissenschaftliche oder philosophische Zwecke berücksichtigt werden kann. Es ist nur ein Glauben und sollte daher verstanden werden. Abgesehen von diesen extremen Gegensätzen widersprechen viele andere Konzepte den Theorien des göttlichen Befehls, in der einen oder anderen Weise, teilweise oder vollständig. Von der klassischen griechischen Philosophie bis heute behaupten viele Philosophen und Sozialwissenschaftler, dass Moral nur ein Konstrukt ist und somit kulturell relativ und kulturell bestimmt ist. Dies führt jedoch zu vielen weiteren Diskussionen und stellt die Herausforderung dar, die Bedeutung der Kultur, welche Elemente der Kultur moralisch bestimmend sind, und schließlich die Grenzen dieser Relativität zu bestimmen. Moralischer Determinismus behaupten, dass alles, was mit menschlichem Verhalten zusammenhängt, einschließlich der Moral, bestimmt wird, sobald der freie Wille nicht existiert. In jüngerer Zeit haben moderne Denker argumentiert, dass es eine strenge Wissenschaft der Moral gibt. Doch trotz der Erklärung mehrerer Tatsachen und Beweise kann die wissenschaftliche Methode allein nicht den gesamten Inhalt und die volle Bedeutung der Ethik erleuchten. Das Verständnis der Moral erfordert eine breitere Wahrnehmung und eine Einigung unter den Philosophen, die sie nie erreicht haben. Das Universum und die Atmosphäre, die diese Forschung beinhaltet, sind die Herrschaften all dieser konzeptionellen Konflikte, die aus objektiver und evolutionärer Sicht beobachtet werden. Ungeachtet dieser Umstände und ihrer intrinsischen Bedeutung sind diese Fragen jedoch weit entfernt vom methodischen Ansatz einer analytischen Diskussion über objektive Moral, die in der Tat das Ziel und den Umfang dieser Arbeit ist. Wir sollten diese prominenten traditionellen Theorien kurz überprüfen, weil diese Arbeit eine vergleichende Studie beherbergt, und ihre Annahmen unterscheiden sich zumindest tief von allen herkömmlichen Theorien. Daher wird es notwendig, dem Leser direkte und spezifische Elemente des Vergleichs für gültige Kritik anzubieten, ohne unterbrechende Forschung. Doch auch wenn wir die traditionellen Theorien für diesen vergleichenden und kritischen Expositionszweck überdenken, werden sie als „aliena materia" an der Seite unserer primären Anliegen gehalten werden. Unabhängig von der Gültigkeit eines oder aller der Elemente dieser Diskussion und ihrer Bedeutung als philosophisches Universum unserer Forschung, ist der Zweck dieses Werkes, dass die Existenz und die Bedeutung der prähistorischen moralischen Archetypen, die direkt aus den grundlegenden sozialen Bedürfnissen und Anstrengungen für das Überleben demonstrierten Archetypen sind, die Definition der wesentlichen Grundlage der Ethik, ihre Aggregation in das kollektive Unbewusste und die entsprechende logische Organisation und Übertragung auf die evolutionären Stadien des menschlichen Genoms und verschiedene Raum-Zeit-Beziehungen, unabhängig von jeder zeitgenössischen Erfahrung der Individuen. Das durch diese Archetypen definierte System bildet ein evolutionäres menschliches soziales Modell. (shrink)

In this chapter, against the backdrop of campus responses to Israel and Gaza, I consider the mission of the university and whether that mission is served by institutional neutrality. On my view, it is not so easy (and may be impossible) to prise apart universities’ core functions and “public matters.” I argue that institutional neutrality is at best a useful fiction and at worst a way of concealing universities’ commitments and reinscribing the status quo. Along the way, I (...) offer a primer on academic and expressive freedoms in the context of universities, and on the importance of articulating and balancing core university values, including the duty of care. In seiner "Psychologie der Weltanschauungen" hat Karl Jaspers erstmals die seelischen Quellen und geistigen Typen der Weltanschauungen und der Philosophie aus psychologischer Sicht dargestellt. Ziel und Aufgabe seiner Untersuchung war es, zu verstehen, welche irreduziblen Grundkräfte die Seele bewegen, um das menschliche Leben auch noch in den Grenzsituationen bewältigen zu können. Dazu unterscheidet Jaspers zwischen Einstellungen, Weltbildern und Geistestypen als Elementen der jeweiligen Weltanschauung. Um das Leben des menschlichen Geistes zu verstehen, muss man nach Jaspers zwischen aktuellen Wertungen, abstrahierten Werten, (...) persönlichen und kollektiven Wertehorizonten, situativen Wertekollisionen und diversen Wertehierachien unterscheiden. An Wertentscheidungen und Werturteilen sind nicht nur Gefühle, sondern auch der Verstand und der Wille beteiligt. Das Leiden ist der gemeinsame Grundzug aller Grenzsituationen, wie z.B. Kampf, Schuld und Tod, ist das Leiden der Menschen an etwas Unabänderlichen des menschlichen Daseins. In den Grenzsituationen kommt es nicht selten zu einem existenziellen Konflikt zwischen Hoffnung und Verzweiflung und verschiedene Geistestypen bedürfen eines existenziellen Haltes und letzten Grundes ihrer Existenz. Nach jaspers gibt es vier Typen der Reaktion auf die Grenzsituationen: Resignation, Weltflucht, Heroismus und Religiosität. Verbreiteter sind heute jedoch Versuche der Bewältigung durch Hedonismus und Konsumismus, die keinen letzten Halt bieten, sondern nur eine tiefere Verzweiflung kaschieren. (shrink)

The study aimed to identify the role of administrative procedures and systems in enhancing the performance of the educational institutions in the Islamic University in Gaza. To achieve the research objectives, the researchers used the analytical descriptive approach to collect information. The researchers used the questionnaire distributed to three categories of employees at the Islamic University (senior management, faculty members, their assistants and members of the administrative board). A random sample of 314 employees was selected and 276 questionnaires were (...) retrieved with a recovery rate of 88.1%. The Statistical Analysis Program (SPSS) was used to enter process and analyze data. The results of the research showed a positive role for the administrative procedures and systems in enhancing the performance of the Islamic University from the point of view of the members (senior management, teaching staff and their assistants and the administrative body), where the relative weight of all the paragraphs (73.728%). The analysis of the results revealed that the administrative procedures at the Islamic University in Gaza are used to an acceptable degree. The relative weight of all the paragraphs is 70%. This indicates a relationship between administrative procedures and regulations and the performance of the Islamic University in the Gaza Strip. The study found that there was a good degree of approval from the sample regarding the administrative procedures and their relationship to the job performance. There exist a sufficient degree of powers to the deans and department managers to carry out their tasks, with the use of plans as control tools. And that there are rules and procedures provided for decision-making in the University Council. It also has full powers to manage the university to improve the teaching and learning environment. The researchers also recommended a number of recommendations, including the need to follow up on the procedures and systems of management and update them continuously in the light of changes that may occur and to ensure the existence of a strong system of electronic information systems within the university. There is a need to provide mechanisms for obtaining information about the surrounding external environment, and effective mechanisms to provide managers with the necessary information in a timely manner. The importance of providing channels of communication that enables staff to communicate information about any violations and breaches. The study also recommended the follow-up, review, procedures and administrative systems, and work to modify them in line with the mission of the university and the objectives that the university seeks to reach. The aim of the research is to identify the relationship between the performance criteria and the achievement of the objectives of supervision which is represented in the performance of the job at the Islamic University in Gaza Strip. To achieve the objectives of the research, the researchers used the descriptive analytical approach to collect information. The questionnaire consisted of (22) paragraphs distributed to three categories of employees of the Islamic University (senior management, faculty members, their assistants and members of (...) the administrative board). A random sample of 314 employees was selected, 276 responses were retrieved with a return rate of 88.1%. The SPSS program was used to enter, process, and analyze the data. The results of the study showed a positive relationship between the performance criteria and the achievement of the control objectives represented by the job performance in the Islamic University from the point of view of the members (senior management, faculty and their assistants and the administrative board). The researchers also recommended a number of recommendations, including the provision of an appropriate level of control system components today through the continuous updating and development of performance standards and the need to provide the necessary physical and financial resources to continue the development and achievement within the university. Expand the development of technology in the various activities of the university through the construction of a complete and integrated system to support the control systems in the university to suit its size. The researchers also recommended the follow-up, review of the performance standards and work to modify them in line with the mission of the university and the goals that the university seeks to reach. In der Medizin gehören Kinder neben Ausländern, Behinderten und psychiatrisch Erkrankten zu den besonders vulnerablen Patientengruppen. Im Folgenden soll die Frage nach der Würde der Kinder in medizinethischer Hinsicht behandelt werden. Dazu werden drei Thesen erläutert und begründet: (1.) das Prinzip der Menschenwürde kann nicht ganz außer Acht gelassen werden, wenn Kinder als Patienten in medizinethischer Hinsicht thematisiert werden; (2.) das Prinzip der Menschenwürde wird in der Medizinethik nicht schon vollständig durch die medizinethischen Prinzipien der Patientenautonomie und der Fürsorge für (...) die Patienten abgedeckt; (3.) die habituelle und bewusste Achtung der Würde des Menschen bringt immer wieder neue und bisher noch wenig beachtete Aspekte des medizinischen, therapeutischen und pflegerischen Umgangs mit Patienten und Kindern als Patienten ans Licht. Diskussionen über den Gehalt des Prinzips der Menschenwürde gehen nicht nur in der Medizinethik, sondern auch in anderen Bereichen der angewandten Ethik in der Regel von Erwachsenen aus. Erwachsene gelten als die paradigmatischen Subjekte und Objekte der Wahrnehmung, Zuschreibung und Anerkennung von Würde. Meistens denkt man nur an Erwachsene, wenn man darauf besteht, dass die menschliche Würde (1.) vom moralischen und rechtlichen Standpunkt aus grundsätzlich zu achten ist, (2.) unter bestimmten psychologischen, sozialen und politischen Umständen gefährdet ist und (3.) in bestimmten Handlungssituationen mit anderen ethischen Forderungen in Konflikt geraten kann. Bei Erwachsenen ist es relativ leicht, ethische Intuitionen darüber, ob in bestimmten medizinischen Handlungssituationen die Würde eines Menschen verletzt wird, zu formulieren und zu begründen. Denn bei Erwachsenen steht die Würdeverletzung in einem engen Zusammenhang mit der Berücksichtigung verschiedener ethischer Forderungen: (1.) nach Achtung der willentlichen Selbstbestimmung und der normativen Autonomie, (2.) nach Berücksichtigung von persönlichen Lebenszielen und Wertpräferenzen, (3.) nach Bewahrung von mutmaßlichen Lebenschancen (4.) nach Berücksichtigung personaler Bedürfnisse nach Anerkennung, Gegenseitigkeit, Intimität, Integrität, etc. sowie (5.) nach Wahrnehmung und Anerkennung der unverwechselbaren Individualität des Anderen. Die Angemessenheit und Erfüllbarkeit dieser ethischen Forderungen hängt nun aber von soziologischen und psychologischen Gegebenheiten ab, die bei Kindern je nach Altersgruppe und individueller Ausprägung nicht in gleicher Weise gegeben sind. Deswegen soll hier gezeigt werden, welche besondere und zusätzliche Rolle eine medizinethische Erinnerung an die Würde der Kinder im Spannungsfeld zwischen Autonomie und Fürsorge spielen kann. Dabei zeigt sich, dass es gerade die Achtung vor der Würde des Kindes ist, die uns überhaupt erst ermöglicht, das Kind als Kind und damit als ein eigenständiges Subjekt und als ein besonderes menschliches Wesen zu entdecken. The overall findings of the current study suggested the presence of a statistically significant relationship between resources (physical, software, and human and organizational) for the computerized management information systems and the development of performance in the Electricity Distribution Company in Gaza. The study recommended the following: The need to strengthen the company's management interest in the potential of computerized management information systems and using them in the computerization of all the company's activities. And the need to involve workers and users in the design of computerized management information systems and assessment and development process. And strengthen the relationship between users and information systems personnel in the department responsible for the system. And it is essential that the company is developing the infrastructure for information technology in general, and computerized management information systems, in particular for the development of performance. And increase interest in providing resources (physical, software, and human and organizational) for the computerized management information systems. This study aims to look at the role of the practice of excellence strategies in education in achieving sustainable competitive advantage for the Higher educational institutions of the faculty of Engineering and Information Technology at Al-Azhar University in Gaza, a model, and the study considered the competitive advantage of educational institutions stems from the impact on the level of each student, employee, and the institution. The study was based on the premise that the development of strategies for excellence in (...) education, and its implementation is a vital important prerequisite to achieve sustainable competitive advantage in higher educational institutions. The study followed a systematic exploratory descriptive methodology through review of the theoretical literature, and the adoption of the experience of the Faculty of Engineering and Information Technology at Al-Azhar University in Gaza as a model for its unique experience in the field of excellence in education. The study results showed that the most important are: There is a strong correlation between the level of exercising excellence strategies in education and the achievement of higher educational institutions to the sustainable competitive advantage. The results include a general required number of important sub results on the subject of the model - Faculty of Engineering and Information Technology at Al-Azhar University in Gaza as follows: - The student considered the academic focus of the operation in the development process of the workers’ skills, particularly academics at the university helps to distinguish students and increase the employment rate after graduation. - The existence of consistency in development efforts and quality improvement for all three levels (student, employee, and the university), and this contributes to the Faculty excellence. - The Faculty has been able to achieve competitive advantages by offering excellent services without harming the efficiency, and this alone is a great success because improving service properties requires great investments, which negatively affect the continued institutional development. The study also reached a set of recommendations as follows: - The need to exercise excellence strategies in education, excellence reward at the national level, and those higher educational institutions follow the criteria for measuring the competitive advantages of its institutions always. - There is a need to increase efforts to implement programs of excellence, the allocation of adequate time, reward outstanding efforts as well. There is a necessity for each faculty to achieve competitive advantage and sustainability, using the general philosophies of competitive advantage, but with a different strategically content from what is in the private commercial sector, it reflects the Faculties mission and objectives, depending on making improvements and excellence in processes that ensure the safety of its outputs. As well as the need to find a balance between the work of teaching and research work of the faculty members, this has important implications regarding the criteria used in the process of excellence evaluation. The study recommended the adoption of strategies for excellence in education on a national public policy level mainly in the processes of change in higher education institutions. The need to support the existence of a common understanding of the efforts of excellence to create a general culture that appreciates excellence in faculties and universities. This underlines the need for transparent, fair rewards systems, to encourage innovation in education. The need to conduct a comprehensive surveys on the graduates of faculties and universities including the areas of employment and skills, because that will give accurate indications of the graduates and will help to establish a link to a more precise about the relationship of excellence strategies with the competitive advantages. After being recalled to Beijing in 1510 for evaluation and reassignment in the wake of his two-year exile to Guizhou and his period of service as a magistrate, Wang Yangming was assigned to a succession of posts at the capital that kept him there through 1512. During that short time, he remained disillusioned with the Ming court and high politics and chose to put his energies into fostering a philosophical movement. He believed that by restoring the “way of master-disciple relations (...) and friendship,” he could help propagate the learning of the sages. To that end, he held jiangxue gatherings with colleagues and friends and carried on an active correspondence. In those venues, Wang Yangming engaged others with his ideas about the goal of sagehood, the obstacles to attaining it, and the methods for overcoming those obstacles. The following article reconstructs this critical period in Wang Yangming's philosophical development and the intellectual movement he sought to foster, as well as the status of his philosophy as of this point in time. -/- . Israel Gottlieb Canz’s Uberzeugender Beweiß, first published in 1741 and reprinted here in its second, expanded edition stands as his most influential discussion of the soul’s immortality, with one contemporary pronouncing it to be “one of the best [treatments of immortality] that we have.” In this text, Canz seeks to augment and supplement traditional Wolffian proofs by considering, first, the grounds for the soul’s immortality that are contained in its own nature and, second, the grounds for the same that (...) are found in God. In addition, Canz extends his treatment to include a detailed discussion of the souls of children and he offers speculations concerning the soul’s condition in the afterlife. On account of its systematic presentation and original argumentation, Canz’s Beweiß represents a key contribution to Leibniz-Wolffian rational psychology, and through the critical reaction it generated it would help shape the debate concerning the soul’s immortality for years after its original publication. When philosophers consider factors compromising autonomy in consent, they often focus solely on the consent-giver’s agential capacities, overlooking the impact of the consent-receiver’s conduct on the consensual character of the activity. In this paper, I argue that valid consent requires justified trust in the consent-receiver to act only within the scope of consent. I call this the Trust Condition (TC), drawing on Katherine Hawley’s commitment account of trust. TC constitutes a belief that the consent-receiver is capable and willing to act (...) as we expect from them. If such trust is not warranted, I argue, consent lacks the appropriate normative grounds. After establishing TC, I explore its application in the sexual arena, asserting that due to the non-contractual dimensions of sexual activity — such as the dynamic nature of sexual desires and the absence of external factors effectively binding sexual partners to the terms of consent—trust is warranted in sexual consent by means of care. I define care as a special sensitivity and attention toward the partner’s will and discuss how this approach leads to safer intimate relationships in practice. (shrink)

In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...) violated, we nonetheless regard those cases as instances of autonomy. Therefore, autonomy does not necessarily require endorsement. Instead, I propose that the nature of the relevant highest-order volition dictates the procedure that should be established in one’s desire structure for its fulfillment. In the second part, I discuss how an agent may effectively consent to the violation of their decision by another person. Ordinary consent typically refers to actions but fails to communicate one's higher-order desires or commitments. To address this limitation, I propose a practical tool that accomplishes this by signaling shifts in the normative context where the agents are interacting. (shrink)

The research aims to identify the trends of Palestinian higher educational institutions in Gaza Strip as learning organizations from the perspective of senior management in the Palestinian universities in Gaza Strip. The researchers used descriptive analytical approach and used the questionnaire as a tool for information gathering. The questionnaires were distributed to senior management in the Palestinian universities. The study population reached (344) employees in senior management is dispersed over (3) Palestinian universities. A stratified random sample of (182) (...) employees from the Palestinian universities was selected and the recovery rate was (69.2%). Statistical analysis (SPSS) program was used for analysis and processing the data. The study found the following results: There is an agreement about: the importance of the focus of "organizational structure" with an average approval, the importance of "technological infrastructure" axis with high approval, and the importance of "strategic" with an average approval. The results concluded that the study sample agree on the importance of "organizational dimension" highly. The results showed that the sample believe that the "strategic leadership" level in the universities got medium-approval. There is a fair level agreement about the axis of interest "teams / committees". There is an agreement about the importance of the "human dimension" moderately. The results showed that the sample is highly agreed about the importance of focus of the "knowledge management", and the focus of the "continuing education". They agreed weakly to somewhat about the importance of the focus of "scientific research", moderately agree about the importance of the center of "institutional culture", agree moderately on the importance of "cognitive dimension". The results showed that the sample largely agree on the importance of the focus of "strategic partnerships and alliances". They agree highly on the axis "keep up with the labor market" and on the focus of the importance of "technology incubators". The results showed that the sample moderately agree about the importance of the theme on "consulting and training", the importance of the focus of "social responsibility", and the focus of the "Community dimension". The study found a group of recommendations including: there is a need to provide suitable environment that achieve learning organizations. There is a need to develop the technological infrastructure (hardware, software, networks, databases, and human skills) because of the great advantages that they offer. The universities need to adopt knowledge management in the academic and administrative departments because knowledge is the core of the work of these departments. The establishment of technology incubators in universities to adopt outstanding university research projects, to protect, to supports, and to market them; furthermore, to develop the capabilities and skills of employees in the field of information technology. In this paper I discuss the nature of halakhic facts and I frame the discussion in a broader meta-ethical context. Most of the existing literature on the philosophy of halakha has focused on the contrast between ‘Halakhic Realism’ and ‘Halakhic Nominalism’. This theoretical contrast is vague and includes a wide range of theories. Inspired by the meta-ethical literature, I propose to focus the discussion on views that can be called ‘Halakhic Naturalism’ and ‘Halakhic Non-naturalism’. I present, develop and distinguish between (...) different meanings of 'naturalism' and consider arguments for and against 'Halakhic Naturalism'. The purpose of this paper is twofold: First, to present and demonstrate the fruitful encounter between meta-ethics and the philosophy of halakha. The study aimed to identify Design Thinking and its use in NGOs in Gaza Strip. In order to achieve the objectives of the study and to test its hypotheses, the analytical descriptive method was used, relying on the questionnaire as a main tool for data collection. The study society was one of the decision makers in the local NGOs in the Gaza Strip. The study population reached 78 local NGOs in Gaza Strip. The overall inventory of the (...) possible study community was based mainly on the use of the SPSS in processing and analyzing the data obtained through the survey tool. Smart-PLS was also used to construct the structural equation model (SEM) Analyzing the relationship between study variables. The study found that Design Thinking mediates the relationship between the management of process design and decision making with a holistic effect. The study showed the interest of local NGOs in creating a good mental image in the local community. And the ownership of local NGOs to the expertise and technical skills required to implement the projects, and showed the adoption of local NGOs in their activities to meet the needs of the beneficiaries and their wishes, and local NGOs analyze the problem, and causes, through data relevant to the decision, based on reference data for decision-making. The main recommendations of the study are: The need for senior management in the local NGOs in Gaza Strip to adopt the methodology of design thinking because of its impact on the sustainability of the projects, design the technical feasibility study and meet the wishes of the beneficiaries. This paper aims to identify the decision support systems and their role on the strategic management development in the Universities- Case Study: Islamic University of Gaza. The descriptive approach was used where a questionnaire was developed and distributed to a stratified random sample. (230) questionnaires were distributed and (204) were returned with response rate (88.7%). The most important findings of the study: The presence of a statistically significant positive correlation between the decision support systems and strategic management in the (...) Islamic University in Gaza, and this shows that there is a role for decision support systems in strategic management development. The senior management is convinced of the importance of strategic management of the organization, and this conviction paid to clearly understand the process of the development of strategic management and thus led to a commitment to this process to improve its performance. There is an impact on the strategic management of the capabilities available for the use of decision support systems, and the type of decision support systems used, while there is little effect of top management support for the use of decision support systems. Also, the results showed that there were no statistically significant differences between the averages of the respondents answers attributed to personal data. The research also concluded a series of recommendations: The Islamic University of Gaza need to develop its infrastructure of decision support systems when it develops the strategic management. It should increase its interest in organizational potential through the necessity of a separate unit for decision support systems. As well as increased interest in the physical and technical capabilities available to decision support systems through continuity in keeping pace with technological means and techniques, continued support of senior management in the organization of strategic management for its positive role on decision support systems, that senior management will continue in the organization in creating a culture of strategic management, and it should encourage employees to participate in the strategic management process. The purpose of this research is to identify the extent of the efficiency of the internal control environment in the Palestinian higher educational institutions in Gaza Strip from the perspective of employees in the Palestinian universities in Gaza Strip, where researchers used in the study five universities. The researchers adopted in their study the descriptive and analytical approach. The research community consists of administrative employees and academic employees with administrative duties. Senior management or the University Council was excluded. (...) The study population compromises of (392) employees. A stratified random sample was chosen and (197) questionnaires were distributed. (160) questionnaires were received back with a return rate of (81.2%).The researchers used a questionnaire to collect that which then was analyzed using (SPSS) to get the results. The research found the following results: the absence of a fundamental difference between the responses of males and females. The lack of significant difference between the responses of the respondents attributed to the variable age. The lack of significant difference between the responses of the respondents attributed to the variable of years of service. And the existence of a fundamental difference between the responses of the respondents attributed to the university variable. The existence of a fundamental difference between the responses of the respondents attributed to the Qualification variable. The existence of a fundamental difference between the responses of the respondents attributed to the administrative level variable. The research found a group of recommendations including: the need to raise awareness of censorship as the basis for the protection of employees in all administrative levels from making mistake.Updating the systems and instructions of control periodically and parallel with the scientific progress and technology.Benefit from regional and international experiences in the application of internal control standards which commensurate with the administrative system of the institution. Nie Bao 聶豹 (1487–1563) was a Neo-Confucian philosopher and scholar-official of sixteenthcentury Ming China. In his Ming ru xue an 明儒學案 (Case studies of Ming Confucians), Huang Zongxi 黃宗羲 placed him in the Jiangxi (Jiangyou 江右) group of Wang Yangming followers. Nie Bao met the influential founder of the Ming School of Mind in 1526 and was inspired by his teaching of the innate knowing (liangzhi 良知). However, he differed from other followers in his quietist approach to realizing and extending (...) this knowledge. While developing his ideas over the course of two decades, as a holder of the highest civil service examination degree, Nie Bao also held a series of impactful official positions, and earned a reputation for effectiveness and integrity. However, he was also the unwitting victim of factionalism at the Ming court, which led to his imprisonment in 1548. The goal of this article is to provide a sketch of Nie Bao’s political trajectory and intellectual development from his early years until his imprisonment, as well as translation of significant passages pertaining to that trajectory and development. By the time of his imprisonment, Nie Bao had articulated the essential elements of his philosophy of returning to the root (by which he meant silence), and attaining centeredness and, with that, his unique interpretation of his teacher’s central tenet. Halakha consists of a variety of laws that determine the halakhic status of various actions. Halakhic laws, by their very nature, have a general aspect in that they apply to all similar actions under similar conditions. In this paper, I examine, from a philosophical-analytical point of view, the relationship between the general aspect of the halakhic laws and the fact that these laws apply to particular actions. After the introduction, this paper is divided into three parts. First, I distinguish between (...) two competing theses regarding the "metaphysical order" between the general aspect of halakhic law and its individual cases. The first one, I call 'Halakhic Generalism', according to which the general aspect of Halakhic law has essential precedence. The second one I refer to as 'Halakhic Particularism', according to which the general aspect of the halakhic law is nothing more than a generalization of all its individual cases. In the second part of the paper, I argue that the particularist position has the power to justify a unique and puzzling halakhic principle. According to this principle, in cases of normative over-determination where the same action is forbidden due to two different halakhic laws, then "a prohibition does not apply to a prohibition". Finally, I compare the reasoning I offer for this principle to alternative justifications of said principle. I argue that, compared to the alternatives, the particularist position provides the best explanation for the principle. (shrink)

The study aimed at identifying the personal variables and their effect in promoting job creation in Gaza Strip through business incubators. The researchers used the descriptive analytical approach to achieve the study objectives. The study population consisted of 92 of the pilot projects benefiting from the three business incubators in Gaza Strip (Palestinian Information Technology Incubator, UCAS Technology Incubator and Business and Technology Incubator). And to guide students to scientific disciplines that help them in entrepreneurship after graduation, whether starting a small business or self-employment, support females to entrepreneurship as most of the entrepreneurs are male, in addition to stimulating males as well. The study investigated the management of students’ academic failure among secondary school students for high productivity in Obingwa Local Government Area of Abia State. The study was guided by two research questions and two hypotheses. Descriptive survey research design was used while the population of the study comprised thirty public secondary schools. A sample size of 10 secondary schools was selected from the 30 public secondary schools using stratified random sampling technique. Self-designed instrument entitled “Management Students’ Academic Failure Questionnaire” (MSAFQ) (...) was utilized. The validity of the instrument was ensured. Test retest method was used and reliability co-efficient of 0.80 and 0.83 was obtained through Cronbach Alpha Statistics. Mean was used to answer the research questions while Z-test statistics was used to test the hypotheses at 0.05 level of significant. The findings include but not limited to: lack of instructional material and inability of the teachers to stimulate students are causes of academic failures among students. It is therefore recommended that the government or appropriate agency should ensure adequate supply of functional instructional resources and teachers’ should do well to motivate students to learn thereby save students from incessant failures that could mar their future and life expectations. The problem of evil is a perennial issue in metaphysics, philosophy of religion and theology. In Yorùbá thought, it has been approached, appraised, and conceptualised by scholars from different perspectives, usually in the form of thesis and antithesis. For instance, Ẹ̀bùn Odùwọlé and Kazeem Fáyẹmí disagree on whether or not the problem arises in Yorùbá thought and on its nature or formulation, if it does. Relying on the Western logical formulation of the problem, Odùwọlé maintains that the problem of evil (...) arises in Yorùbá thought exactly like it does in Western thought; hence, for her, the problem of evil is universal. Against this view, Fáyẹmí contends that the philosophical problem of evil does not arise at all in Yorùbá thought; hence, the problem, according to him, is not universal. Employing the methods of critical exposition and analysis, however, I maintain a position different from those of the two scholars mentioned. I contend, on the one hand, that the existence of the philosophical problem of evil in Yorùbá thought does not necessarily imply the logical formulation of the problem as we have in the West. On the other hand, however, I maintain that the absence of the logical formulation of the problem of evil in Yorùbá thought does not directly imply the absence of the philosophical problem of evil in it. I therefore approach the interpretation of the philosophical problem of evil in Yorùbá thought from an existentialist perspective, drawing insights from some relevant verses of Ifá. -/- . (shrink)

In this paper, we intend to promote an analysis of the use of the artificial language Heptapod B in Story of Your Life written by Ted Chiang and in its filmic adaptation, Arrival, written by Eric Heisserer and directed by Denis Villeneuve in relation to the authors’ views on the metaphysics of time. In both literary and filmic texts, the glossopoeia is used as a plot device upon which the alien race’s time perception is constructed and explicated in connexion with (...) the strong metaphor provided by Fermat’s principle of least time. Throughout the article, we discuss these hybrid interfaces of literature, cinema and science, researching the stories’ specific diegeses, the writers’ own elicitations as well as various texts on the Philosophy of time. This paper aims to identify Performance development and its relationship to demographic variables among users of computerized management information systems in Gaza Electricity Distribution Company. This research used two dimensions. The first dimension is demographic variables among users of computerized management information systems and the second dimension the Development of Performance. The control sample was (360) questioners were distributed and (306) were retrieved back with a percentage of (85%). Several statistical tools were used for data analysis and hypotheses testing, (...) including reliability correlation using Cronbach’s alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggested The results showed that: demographic variables among users of computerized management information systems have a positive relationship on the development of performance in Gaza Electricity Distribution Company, there were no statistically significant differences between the perceptions of respondents about performance development and its relationship to demographic variables among users of computerized management information systems in Gaza Electricity Distribution Company which attributable to gender variable, there exist a significant relationship between perceptions of the respondents for each of the resources (physical, software, and human) for computerized management information systems attributed to variable (age), there are no significant differences in the fields of (organizational resources) for computerized management information systems and (development of performance) attributable to variable (age) and that can be explained by the fact that the senior management deals with job titles not with age, there are significant differences between the perceptions of the respondents for each of the fields of resources (physical, software, and organizational) for computerized management information systems attributed to variable (educational qualification), the presence of a statistically significant differences between the perceptions of the respondents for each of the fields of "organizational resources for demographic variables among users of computerized management information systems " and ”development of performance” due to the variable (years of service), there is no statistically significant differences between respondents' perceptions about the fields of resources (physical, software, and human) for computerized management information systems attributed to variable (years of service). The study recommended the following: The need to strengthen the company's management interest in the use of computerized management information systems in all the systems components and elements as being an important variable which contributes to the development of performance. Strengthening the relationship between the users of information system and personnel systems in the department responsible for the system so that employees understand the technological and technical information needed by all users of information systems. It is essential that the company develop the infrastructure for information technology in general, and computerized management information systems, in particular for the development of performance. Increasing attention to provide material resources of equipment and devices used in the computerized management information system, and the interest in providing technical resources for management information systems keeping pace with technological means and modern techniques and work on the training of personnel to use those systems. Greater attention to human resource computerized management information systems “specialized technicians and end-users" through a variety of disciplines working in the field of computerized management information systems. The current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at Gaza Electricity Distribution Company resources explores the status of demographic variables among users of computerized management information systems and their relationship to the development of performance in Gaza Electricity Distribution Company increasing interest in Computerized management information systems through continuity, keeping pace with technological means and modern techniques. Human mind has undergone a complex evolution throughout the history of our genus, Homo. The brain structures and processes that make this mental activity possible have been the result of a series of evolutionary patterns not only biological but also cultural, so it is possible to assume that consciousness did not emerge with the same characteristics in our predecessors. One of the most distinctive features that reflects the conscious image of the archaic man is the absence of a dualistic interpretation (...) of reality. This apparition stem from our analytical mind as an exaptation, commonly assigned to the activity of the left hemisphere which is attributed to play a greater role in linguistic activity. This paper introduces the idea that, along with other abilities such as linguistic predisposition, spatial perception and pattern recognition, human beings are also born with an innate tendency to interpret and represent the surrounding world in antithetical terms, that is, in antinomies. The idea of Self as an exaptation arises from the cultural development of our species closely influenced by the ripening of our cognitive structures and the evolution of human natural language. This illusory perception of Self also conditions scientific activity, giving birth to a new form of knowledge that attributes a new value judgment to man and life. (shrink)

The research aims to identify the impact of the strategic orientations (Vision, Mission, goals) on crisis management agency, international relief in Gaza, the researchers used the descriptive and analytical approach and a survey for collection data, amounted to community size (881), and the study sample (268), and the sample was a stratified random. SPSS program used for entry, processing and analysis of data. The most important findings of the study: The results showed that the organization develop a clearly written (...) vision, mission and strategic goals and the organization's strategic objectives are consistent with the vision and mission of the organization. The results also showed that the organization develop a clear stage objectives framed with time bass which can be achieved on the ground. The employees in the organization's behavior comes within a disciplined set of principles and values that underpin the organization. Also the concept of the organization vision and mission are familiar for the employees. In general the views of the research sample agreed that there is a presence of strategic orientations (vision, message, goals). A direct positive correlation between the presence of strategic orientations (vision, mission and goals) and crisis management (before, during and after the crisis) in the international relief agency in Gaza. The research also concluded a series of recommendations, Researchers consistently recommend the continuous existence of strategic orientation and continue to develop the vision, mission and objectives in a clearly written method. In addition to that, the organization must develop in advance plans to deal with crises, taking into account past experience in this field through a specialized team, hold continuous meetings and discussions and workshops with the emergency team who has previous experience in dealing with crises. The problem of revisionism, or efforts to deny and censor the incontrovertible history of known genocides, is a growing one. It is now clear that denial is inevitably a phase of the genocidal process, extending far beyond the immediate politically expedient denials of governments who are currently engaging in genocidal massacre or have just recently done so—i.e., the Chinese government's abject denials of the killings of some 5,000 in Tiananmen Square, or the Sri Lanka government's denials of the state-organized massacre (...) of 5,000 Tamil. Denials of genocide continue long after the event by a variety of groups and people, including successor governments or successor enemies of the victim people, such as anti-Semites against Jews, Turks against Armenians, and bigots and celebrants of violence and murder of all sorts. But such denials also occur—and this is the most perplexing fact—among a variety of not obviously malevolent people, including intellectuals who, in the process of calling for a better world, effectively exonerate, support, encourage, and participate in denials of a known genocide, implicitly condoning and even celebrating its occurrence, meanings, and portents for the future. This article is an effort to study and analyze this latter phenomenon, which has been little recognized. Together with previous essays on the psychology of more explicit malevolent denials of genocide, the intention is to generate a broader psychological theory of denials of genocide and revisionism by proposing that there are also a variety of “innocent denials” of the factual reality or significance of known cases of genocide, and a variety of “innocent disavowals of violence” which in truth celebrate the violence. These “innocent denials” join with the well-known explicit bigots in creating a vast panorama of dangerous denials of genocides and implicit calls to new genocides in our world. (shrink)

How children seek knowledge and evaluate claims may depend on their understanding of the source of knowledge. What shifts in their understandings about why scientists might disagree and how claims about the state of the world are justified? Until about the age of 41/2, knowledge is seen as self-evident. Children believe that knowledge of reality comes directly through our senses and what others tell us. They appeal to these external sources in order to know. The attainment of Theory of Mind (...) (ToM) at this age is commonly seen as the significant shift in development in understanding disagreements in knowledge claims. Children attaining ToM understand that someone exposed to incorrect or incomplete information might have false beliefs. Disagreement, then, is still attributed to objective sources of knowledge. The current study examines the later developing Interpretive Theory of Mind (iToM) as the basis for children’s understanding of how people with access to the same information might disagree and what this means for how to provide justification for a knowledge claim. Fourteen 2nd graders with the most iToM responses to four tasks and 14 with the fewest iToM responses were selected from a larger sample of 91. In analyses of interviews about a story in which two experts make different claims about a scientific phenomenon, those in the high iToM group noted subjective perspective and processes as the source of disagreement and suggested the need for investigation as the means to knowing. In contrast, those in the low iToM group mostly could not explain the source of disagreement and held that knowledge is acquired from external sources. A comparison of the interviews regarding the science story 2 years later allows for a qualitative description of the development. Those in the low iToM group showed more general recognition of subjective and constructive processes in knowing whereas those in the high iToM group identified interpretive processes and the relativity of perspectives with implications for how observations were conducted and interpreted. The research aims to identify the reality of modern methods applied in the process of performance assessments of employees in the municipalities of Gaza-strip, Complete Census method of community study was used, (571) questionnaires were distributed to all members of the community study, (524) questionnaires were recovery with rate of (91.76%). The most important findings of the study: There were statistically significant relationship differences between the applications of modern methods in the performance assessments of employees in the municipalities of (...) Gaza-strip. There was statistically significant relationship between the evaluation criteria that fit the required performance and the application of standards evaluations on performance of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the use of methods, models for the evaluation of appropriate functions and the application of the performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the feedback and the application of performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the efficient, professional assessors and the application of the performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the extent of awareness of subordinates, participation in the evaluation of their performance and the application of the performance assessments of employees in the municipalities of Gaza-strip. The research also concluded a series of recommendations, including: that the design of evaluation models must be done with the participation of the employees and inform them of it, and that a date must be set to provide feedback and discuss the results with them, that they should be allowed grievance in front of an ad hoc committee in accordance with the known system. Direct manager must inform employees of their performance assessment date, discuss the results of the evaluation with them, and others should be involved with the direct manager of employees in their performance evaluation. The application of modern methods of performance evaluation through the good and purposeful planning should be used, analyzing and employing the results in administrative decisions regarding the employees, and the application of modern methods must be used in an effective and efficient performance evaluation.
