I shall argue that you can substantially refute the most persuasive variety of solipsism by taking its most plausible version seriously, and then showing that it is not rational to hold, once one understands the nature of actualist metaphysical commitments.1 In the first section, I argue that the only viable form of solipsism involves de dicto self-reference. In the second, I argue that this position involves a claim of contingent identity, for which some actual worlds are those where solipsism is (...) not the case. Whereas epistemology seeks to establish the foundations of conceptual cognition (Erkenntnis), Dilthey places the epistemology of the human sciences within a larger context of the knowledge (Wissen) embodied in social practices and historical forms of life. This study examined the relationship between psychopathy and two components of empathy including a cognitive component (e.g., perspective-taking ability) and an affective component (e.g., compassion) in a community sample. The Psychopathic Personality Inventory Short Form was used to assess psychopathy and several psychological measures were used to test empathy including the Interpersonal Reactivity Index, the Diagnostic Analysis of Nonverbal Accuracy-2, and the Test of Self Conscious Affect -3. Across instruments, psychopathy (as a unitary construct) appeared to be negligibly correlated with (...) perspective-taking scales and negatively correlated with the affective components of empathy. Findings indicated that the emotional deficits were noted most prominently for the behavioral component of psychopathy. Results also showed that higher psychopathy scores in community participants were linked to higher levels of antisocial conduct. (shrink)

In this paper I argue that textualism is far less attractive as a theory of written law than some of its modern proponents think. For it is not usually sensible to expect the grammatical meaning of a provision to determine its appropriate legal meaning. Esta enciclopédia abrange, de uma forma introdutória mas desejavelmente rigorosa, uma diversidade de conceitos, temas, problemas, argumentos e teorias localizados numa área relativamente recente de estudos, os quais tem sido habitual qualificar como «estudos lógico-filosóficos». De uma forma apropriadamente genérica, e apesar de o território teórico abrangido ser extenso e de contornos por vezes difusos, podemos dizer que na área se investiga um conjunto de questões fundamentais acerca da natureza da linguagem, da mente, da cognição e do raciocínio humanos, bem (...) como questões acerca das conexões destes com a realidade não mental e extralinguística. This paper reviews the central points and presents some recent developments of the epistemic approach to paraconsistency in terms of the preservation of evidence. Two formal systems are surveyed, the basic logic of evidence (BLE) and the logic of evidence and truth (LET J ), designed to deal, respectively, with evidence and with evidence and truth. While BLE is equivalent to Nelson’s logic N4, it has been conceived for a different purpose. Adequate valuation semantics that provide decidability are given (...) for both BLE and LET J . The meanings of the connectives of BLE and LET J , from the point of view of preservation of evidence, is explained with the aid of an inferential semantics. A formalization of the notion of evidence for BLE as proposed by M. Fitting is also reviewed here. As a novel result, the paper shows that LET J is semantically characterized through the so-called Fidel structures. Some opportunities for further research are also discussed. (shrink)

What is a fake artwork? This is seldom asked in aesthetics even though judging an artwork as excellent or original implicitly posits criteria for fraudulent or dubious artworks as well. This article presents Nelson Goodman’s proposal of how we are to understand fakes. It will criticize his predominantly cognitive approach for failure of incorporating a sense of aesthetic value, thereby leaving the possibility of artworks which are fakes but nevertheless originals unexplained. Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus (...) epistemological circular argument). However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. Naturwissenschaften, Mathematik und Logik waren für Nelson von zentraler Bedeutung. Er pflegte bereits als Jugendlicher intensive Kontakte zu Naturwissenschaftlern und Mathematikern. Dadurch erhielt er Anregungen, die von Anfang an seine philosophischen Ansätze beeinflussten. Inspiriert von der Kant-Fries’schen Philosophie und der Axiomatik der Mathematik, konzipierte Nelson seine Philosophie als exakte Wissenschaft. Wie Kant und Fries betrachtete Nelson die Suche nach den allgemeinen Prinzipien der Naturwissenschaften als Hauptaufgabe der Naturphilosophie. Ergebnis dieser kritischen Analyse ist ein System von metaphysischen Grundsätzen (...) der Naturwissenschaft. Nelson übernimmt Kants Lehre von den Grundsätzen des reinen Verstandes. Keine empirisch gefundene Gesetzmäßigkeit könne diesen Grundsätzen widersprechen. Für die Gesetze der Newton’schen Mechanik hätten, so meint Nelson, Kant und Fries diesen Nachweis erbracht. Deshalb formulierte Nelson das sogenannte Postulat der Mechanistik, gemäß dem alle Naturerscheinungen auf mechanische Vorgänge zurückgeführt werden können. Das starre Festhalten an diesem Postulat veranlasste ihn zur Ablehnung bedeutsamer physikalischer Konzeptionen (z. B. des auf der Elektrodynamik basierenden Relativitätsprinzips, des Nahwirkungskonzepts und des Atommodells). Das „Relativitätsprinzip der Elektrodynamik“ lehnte er mit dem Argument ab, es verhindere die Anwendung der dritten Analogie der Erfahrung, da es den Verzicht auf den Begriff der Gleichzeitigkeit von Naturerscheinungen erzwinge. Eine kritische Nelson-Rezeption muss der Historizität etlicher Thesen Nelsons Rechnung tragen, aber zugleich die Bedeutsamkeit von Kernaussagen Nelson’scher Naturphilosophie im Hinblick auf die modernen Naturwissenschaften untersuchen. Das ist auch die Zielrichtung des vorliegenden Beitrages. Der erste Teil beleuchtet Nelsons wissenschaftliches Umfeld. Einerseits wird untersucht, welche Wissenschaftler Nelson beeinflussten, andererseits soll dargestellt werden, welcher Personenkreis an der Fortentwicklung der Nelson’schen Naturphilosophie beteiligt war. Beispielhaft sollen daran anschließend zwei Themenbereiche aus seinem reichhaltigen Werk disktiert werden, denen besonders im Hinblick auf aktuelle philosophische Diskussionsschwerpunkte Bedeutsamkeit zukommt. Im zweiten Teil werden nämlich Nelsons Betrachtungen zum Verhältnis von Freiheit und Naturnotwendigkeit sowie seine Unterscheidung zwischen wissenschaftlicher und ästhetischer Naturbetrachtung besprochen. Der Beitrag beansprucht nicht, die Rezeptionssgeschichte und den Inhalt von Nelsons Naturphilosophie sowie die aktuelle Bedeutsamkeit seiner Thesen im Detail darzustellen aufzuarbeiten. In Fact, Fiction and Forecast, Nelson Goodman claims that the problem of justifying induction is not something over and above the problem of describing valid induction. Such claim, besides suggesting his commitment to the collapse of the distinction between the context of description and the context of justification, seems to open the possibility that the new riddle of induction could be addressed empirically. Discoveries about psychological preferences for projecting certain classes of objects could function as a criterion for determining (...) which predicates are after all projectible. In this paper, I argue that Goodman's claim must be construed within his project for constructional definitions, which is methodologically oriented by reflective equilibrium. The description of inductive practice is committed to the articulation of the extension of the class selected by the predicate ‘valid induction’. The mutual adjustment between theoretical considerations and inductive practice involved in the proposal of a definition of ‘valid induction’ must preserve that practice as much as possible, there is no way to get rid of entrenchment. Empirical discoveries about the psychological mechanism that underlies projections may help that adjustment but they cannot substitute the role played by the entrenchment of predicates. (shrink)

Goodman sustentou que o ajuste mútuo entre inferências indutivas particulares e princípios indutivos constitui a única justificação necessária para ambos. Porém, a sua caracterização desse ajuste, posteriormente denominado de “equilíbrio reflexivo”, foi superficial. Isso levantou dúvida sobre a sua adequação. Neste artigo, argumento que o equilíbrio reflexivo, corretamente caracterizado, fornece a única justificação necessária e a melhor que podemos dar para a prática indutiva.

The contribution examines Goodman’s conception of philosophy, in particular his remark that his project can be understood as a «critique of worldmaking». It is argued that, despite dealing with epistemological questions, the general theory of symbols and worldmaking does not answer them. Rather, it can be conceived as a practical conception comparable to Kant’s critique of reason or to Wittgenstein’s critique of language games, i. e. , as a philosophy of world orientation. It is claimed that Goodman himself could not (...) articulate this dimension of his position appropriately as he kept using the language of epistemology. Yet many aspects of his thinking become much clearer if they are interpreted within a non-epistemological frame. (shrink)

Some reflections on Nelson Goodman’s ontological pluralism (as emerging from his Ways of Worldmaking) and its influence on contemporary philosophy, taking the querelle with Quine in the columns of The New York Review of Books as a starting point.

Um argumento esquecido em um verdadeiro arsenal de guerra que Espinosa se dedicou a reunir contra o que considerava um dos maiores, senão o maior, empecilho para que os homens alcançassem a verdadeira felicidade, a saber, o falso conceito que possuem da liberdade humana quando a tomam por uma liberdade de arbítrio, contrária a toda e qualquer necessidade. Argumento forjado, certamente, com boa dose de ironia e ânimo polemista contra um objetor que se diz defensor do cartesianismo, e, portanto, em (...) certa medida contra Descartes. Apresentar um argumento que envolva a referência a situações oníricas contra a concepção cartesiana de liberdade como poder dos contrários é, certamente, pretender fazer o feitiço virar contra o feiticeiro. No entanto, para além desse encanto particular e quase anedótico, creio que esse argumento contribui com um bom ponto à inesgotável discussão sobre a natureza da liberdade, debate caro às inquietações filosóficas do nosso querido amigo. Ponto para cuja elucidação espero poder contar com sua ajuda, pois, como se poderá ver na sequência, minha compreensão do argumento é ainda bastante preliminar. Duas traduções porque as cartas onde esse argumento muito provavelmente surgiu pela primeira vez não contam ainda, até onde eu saiba, com uma tradução para a língua portuguesa que permita um acesso mais fácil ao pensamento do filósofo. This paper advocates a new reading of Nelson Goodman’s new riddle of induction. According to Ian Hacking, this famous problem conveys a “pure nominalism”, as it grounds Goodman’s denial regarding the existence of natural kinds. While this interpretation is somewhat convincing, it suffers the major flaw of not corresponding to what Goodman himself understood by “nominalism”. Nominalism, in a goodmanian sense, is indeed primarily a technical demand, which stems from the so-called “calculus of individuals”. I argue that this mereological (...) definition of nominalism allows to understand the new riddle of induction afresh. As a result, Goodman’s riddle is “hyper-nominalist”, i.e., nominalist in a distinct and stronger sense than what Hacking suggested. (shrink)

Lawrence Nelson (2018) criticizes conscientious objection (CO) to abortion statutes as far as they permit health care providers to escape criminal liability for what would otherwise be the legally wrongful taking of a pregnant woman’s life by refusing treatment (i.e. abortion). His key argument refers to the U.S. Supreme Court judgment (Roe v. Wade 1973) that does not treat the unborn as constitutional persons under the Fourteenth Amendment. Therefore, Nelson claims that within the U.S. legal system any vital (...) interests of pregnant women must always take precedence over fetuses’ interests. While agreeing with the main thesis of the article, we believe that the author’s argument neither vindicates his claim, nor explains why those who believe that fetuses are equally protectable human beings do not have the right to refuse to perform an abortion in lifethreatening emergency circumstances (AE). Therefore, the main aim of our commentary is to outline, by referring to our earlier works on conscientious objection in health care (Z_ uradzki 2016) and cultural exemptions (Ciszewski 2016), a better and universalizable argumentative path that would lead to the same conclusion. Nelson Goodman notoriously distinguished between autographic works, whose instances should be identified by taking history of production into account, and allographic works, whose instances can be identified independently of history of production. Scholars such as Jerrold Levinson, Flint Schier, and Gregory Currie have criticized Goodman’s autographic/allographic distinction arguing that all works are such that their instances should be identified by taking history of production into account. I will address this objection by exploiting David Davies’ distinction between e-instances and p-instances (...) of a work, thereby restating the autographic/allographic distinction. Then, I will show that this way of restating this distinction leads us to effective accounts of relevant related phenomena such as forgery, plagiarism, and digital technologies. Finally, I will show the theoretical advantages of my account of the autographic/allographic distinction in comparison with an alternative account recently proposed by Jason D’Cruz and P.D. Magnus. O exame ultrassonográfico é uma ferramenta diagnóstica de grande relevância na rotina veterinária, uma vez que, apresenta ampla difusão entre os atendimentos de animais e permite a avaliação de órgãos e estruturas de forma não invasiva, segura e rápida, auxiliando na determinação de diversas afecções, levando ao tratamento adequado e contribuindo de forma positiva no prognóstico do paciente. Atualmente, em muitos casos, a avaliação testicular não faz parte da rotina ultrassonográfica em exames de ênfase abdominal, devido à sua localização anatômica (...) no escroto, podendo assim levar ao diagnóstico limitado e ao tratamento inadequado do paciente quando na ausência da avaliação dos testículos, posto que diversas são as afecções testiculares que podem acometer cães e que apresentam características ultrassonográficas de fácil detecção. Dentre as principais alterações observadas por meio da ultrassonografia, os casos de orquite, criptorquidismo, torção e também neoformações neoplásicas testiculares correspondem à maior casuística, sendo o método ultrassonográfico um exame com 98% a 100% de sensibilidade e acurácia para diagnóstico destas. Dessa forma, o objetivo deste artigo de revisão bibliográfica é elucidar a importância da avaliação testicular em exames ultrassonográficos de rotina, discorrendo inicialmente sobre os aspectos anatômicos e ultrassonográficos, e posteriormente acerca das afecções mais comumente diagnosticadas na rotina veterinária, apresentando ainda as alterações ultrassonográficas causadas no parênquima testicular. Currently, in many cases, testicular evaluation is not part of the ultrasound evaluation in exams with abdominal emphasis, due to its anatomical location in the scrotum, which can lead to limited diagnosis and inadequate treatment of the patient in the absence of ultrasound evaluation of the testicles, since there are several testicular affections that can affect dogs and that present ultrasonographic characteristics that are easily detected. Among the main alterations observed during ultrasonographic exams, cases of orchitis, cryptorchidism, torsion and also testicular neoplastic neoformations correspond to the largest sample, with the ultrasonographic method being an exam with 98% to 100% sensitivity and accuracy for their diagnosis. Thus, the aim of this literature review article is to elucidate the importance of testicular evaluation in routine ultrasound examinations, initially discussing the anatomical and ultrasound aspects, and later on the most commonly diagnosed conditions in the veterinary routine, also presenting the ultrasound changes caused in the testicular parenchyma. The purpose of this essay is to advocate the ideas of Wilhelm Worringer, John Dewey, and Nelson Goodman on the roles of perception, empathy, emotion, and enjoyment in aesthetic experience. I will attempt to do this by offering a novel interpretation of some of these thinkers’ insights from a biological perspective. To this end, I will consider the following questions. What is an aesthetic experience? Does such a thing exist at all? If yes, is there a correlation between the (...) concept of the aesthetic and perception? Is it possible, then, to find a biological basis for aesthetic experience? My argument is that a fresh analysis of the aesthetics of Worringer, Dewey, and Goodman, in light of some of the discoveries and theories of the cognitive neurosciences – such as the biological correlations of emotions, the “as-if-body-loop” theory, the discovery of mirror neurons, and the phenomenon of embodied simulation – may provide a contribution to longstanding philosophical problems relating to the nature of aesthetic experience. Para la construcción teórica que permitirá el análisis de Noticia de un secuestro (1996), me baso en el establecimiento del carácter sociológico que poseen las disciplinas de la Literatura y la Criminología (la manera de organizar la sociedad, mediante determinadas leyes y normas), además de poseer otras similitudes (dimensiones artística, interpretativa y escrita), tal como las señala Pérez (2006). El modo de articular estas propuestas resulta algo problemático, pues no hay un nexo interdisciplinario que esté total e intelectualmente elaborado, según (...) lo sostienen Nelson, Treichler y Grossberg: dificultad que no permitiría contextualizar, teorizar y cuestionar las bases con las que se trabajan. Por tal motivo, los Estudios Culturales tienen una funcionalidad necesaria: su metodología no cuenta con garantías sobre el privilegio que se les otorga a las estructuras internas de lo interdisciplinario. Maps and mapping raise questions about models and modeling and in science. This chapter archives map discourse in the founding generation of philosophers of science (e.g., Rudolf Carnap, Nelson Goodman, Thomas Kuhn, and Stephen Toulmin) and in the subsequent generation (e.g., Philip Kitcher, Helen Longino, and Bas van Fraassen). In focusing on these two original framing generations of philosophy of science, I intend to remove us from the heat of contemporary discussions of abstraction, representation, and practice of science and (...) thereby see in a more distant and neutral light the many productive ways in which maps can stand in analytically for scientific theories and models. The chapter concludes by complementing the map analogy – i.e., a scientific theory is a map of the world – with a model analogy, viz., a scientific model is a vehicle for understanding. (shrink)

No final do manuscrito, que atualmente se encontra no Museu Britânico, Berkeley registrou a data de 11 de janeiro de 1707/8. Berkeley tinha então 23 anos de idade. Os dois ensaios aqui traduzidos: “Uma visita a uma glândula pineal”, publicado originalmente em 21 de abril de 1713 no número 35 do Guardian e a “A glândula pineal (continuação)”, publicado no dia 25 de abril, no número 39, formam uma unidade não apenas pela referência a ideia de glândula pineal concebida por Descartes como ponto de interação entre a alma e o corpo, mas também pela forma literária e pelo pseudônimo comum. Eles fazem parte de um conjunto de quatorze (...) ensaios atribuídos a George Berkeley, reunidos e publicados pela primeira vez apenas em 1871, no volume III da edição organizada por A. C. Fraser. Os ensaios publicados no Guardian foram escritos durante a permanência de Berkeley em Londres em 1713, quando Jonathan Swift (1667-1745) e Richard Steele (1672-1729), seus conterrâneos, contribuiriam para lhe abrir caminho no ambiente literário inglês. O principal objetivo de Berkeley ao publicar os ensaios foi o de defender o teísmo cristão contra os “livre-pensadores” da época, assumidos como materialistas e ateus. A partir do século XIX, a teoria democrática foi desenvolvida com base no confronto entre duas doutrinas políticas: o liberalismo e o socialismo. O liberalismo é um projeto que defende as limitações dos poderes governamentais, buscando a proteção dos direitos econômicos, políticos, religiosos e intelectuais dos membros da sociedade. Ou seja, para os liberais o poder do Estado deve ser limitado, pois eles acreditam que a verdadeira liberdade depende da menor interferência possível do Estado e das leis nesses direitos. A (...) defesa do liberalismo tem como principal representante Benjamin Constant. Membro da Assembleia Nacional Francesa, escreveu a obra A liberdade dos antigos comparada com a dos modernos, na qual afirma que a liberdade dos modernos, que deve ser promovida e desenvolvida, é a liberdade individual na relação com o Estado (ou seja, as liberdades civis e políticas), enquanto a liberdade dos antigos, que se tornou impraticável, é a liberdade de participação direta na formação das leis.1 Outros autores como, como o francês Alexis de Tocqueville2 e o inglês John Stuart Mill3 , defenderam a ideia de que a única estrutura democrática compatível com o Estado liberal seria a democracia representativa. Uma passagem interessante para o nosso debate sobre a democracia é o princípio do dano, de Stuart Mill. Por esse princípio, cada indivíduo tem o direito de agir como quiser desde que suas ações não prejudiquem outras pessoas. Se a ação afeta diretamente apenas a pessoa que a está realizando, a sociedade em tese não tem o direito de intervir, mesmo que o indivíduo esteja prejudicando a si próprio. Contudo, se os indivíduos fizerem algo ruim para si mesmos ou para sua propriedade podem indiretamente prejudicar a coletividade, já que ninguém vive isolado, devendo por isso ser impedidos de fazê-lo. Stuart Mill isenta desse princípio aqueles que são incapazes de se governar. Em síntese, todo o processo de democratização, como se deu nos Estados liberais democráticos, consiste numa transformação mais quantitativa do que qualitativa do regime representativo. Ou seja, o avanço da democracia nesses regimes ocorre em duas direções: no alargamento gradual do direito do voto e na multiplicação dos órgãos representativos. Para a doutrina socialista, o sufrágio universal é apenas o ponto inicial do processo de democratização do Estado, enquanto para o liberalismo é o ponto de chegada. Alguns dos principais teóricos do socialismo, como Antonio Gramsci4 e Rosa Luxemburgo5 , afirmam que o aprofundamento do processo de democratização na perspectiva das doutrinas socialistas ocorre de dois modos: por meio da crítica à democracia representativa (e da retomada de alguns temas da democracia direta) e pela ampliação da da participação popular e do controle do poder por meio dos chamados “conselhos operários”. Em outras palavras, a diferença crucial entre a democracia dos conselhos e a democracia parlamentar é que a primeira reconhece ter havido um deslocamento dos centros de poder dos órgãos tradicionais do Estado para a grande empresa, na sociedade capitalista. Por isso, o controle que o cidadão pode exercer por meio dos canais tradicionais da democracia política não é suficiente para impedir os abusos de poder. Logo, o controle deve acontecer nos próprios lugares de produção, e seu protagonista é o trabalhador real, não o cidadão abstrato da democracia formal. Mais recentemente, na metade do século XX, surgiu a corrente pluralista. Os pluralistas, em particular Robert Dahl6 , cientista político estadunidense, não procuravam estabelecer uma definição abstrata e teórica acerca da democracia, mas, por meio da observação das experiências de sistemas políticos, estipularam alguns requisitos mínimos: funcionários eleitos, eleições livres justas e frequentes, liberdade de expressão, fontes de informação diversificadas, autonomia para associações e cidadania inclusiva. Com base nesses critérios são caracterizadas quatro estruturas de governo: hegemonias fechadas, que são regimes em que não há disputa de poder e a participação política é limitada; hegemonias inclusivas, regimes em que não há disputa de poder, mas ocorre participação política; oligarquias competitivas, regimes nos quais há disputa de poder, mas com limitada participação política; e poliarquias, regimes em que não há disputa de poder e participação política ampliada. Joseph Schumpeter (1883-1950), economista austríaco, criticou as teorias clássicas de democracia, especialmente na relação estabelecida entre a democracia e a soberania popular7 . Para o autor, a definição clássica de democracia supõe duas ficções incapazes de resistir a uma análise realista: a existência do bem comum e a universalidade da racionalidade dos indivíduos. Para Schumpeter, a unidade da vontade geral, que constituiria o bem comum, e a racionalidade dos indivíduos seriam mitos, porque, para ele, esses elementos se tornaram irracionais por não conseguirem definir coerentemente suas preferências diante da influência da propaganda e de outros métodos de persuasão. Dessa forma, Schumpeter rompe com a ideia de democracia como soberania popular para propô-la como método, um tipo de arranjo institucional (de governos) para alcançar decisões políticas. Assim, sugere a superação do impedimento provocado pela irracionalidade das massas, reduzindo sua participação na política ao ato da produção de governos (ato de votar). As atribuições político-administrativas ficariam a cargo das elites eleitas. Essa é uma postura polêmica, na medida em que propõe uma redução da participação popular. Contrário a essa visão, o cientista político canadense C. B. Macpherson8 , sustenta que a liberdade e o desenvolvimento individual só podem ser alcançados plenamente com a participação direta e contínua dos cidadãos na regulação da sociedade e do Estado. Macpherson defende uma transformação estruturada em um sistema que combine partidos competitivos e organizações de democracia direta, que criam uma base real para a existência da democracia participativa. Mas, para que esse modelo pudesse se desenvolver, seria necessário que os partidos políticos se democratizassem, com princípios e procedimentos de democracia direta, complementada e controlada por organizações geridas por pessoas comuns, em seus locais de trabalho e nas comunidades locais. Na teoria das elites, o poder político pertence ao restrito círculo de pessoas que toma e impõem decisões a todos os membros que tenha de recorrer, como ação radical, à força. Ainda na doutrina liberal, mas opondo-se ao pluralismo, existem os elitistas, que utilizam o termo “elite” como referência a grupos sociais superiores de vários tipos. O termo seria empregado no pensamento social e político somente no final do século XIX. Essas teorias sociológicas, propostas pelos pensadores Vilfredo Pareto (1848-1923), sociólogo e economista francês; Gaetano Mosca (1858-1941), cientista político italiano, e Robert Michels (1876-1936), sociólogo alemão radicado na Itália, defendem que em toda sociedade existe apenas uma minoria, que, por diversos motivos, vem a se tornar detentora do poder. Pareto afirmava que existe uma “circulação das elites”, ou seja, uma minoria de pessoas que se alternam no poder. Mosca justifica o poder das elites governamentais pelo fato de serem uma minoria articulada e organizada, enquanto os governos seriam uma classe numerosa, mas dividida e desorganizada. Ao estudar as formações partidárias, Michels destacou como a própria estrutura das organizações favorecia o surgimento das elites e sua longa permanência no poder. Nas palavras de Michels, essa estabilidade das elites no poder é a “lei de ferro das oligarquias”. Ao longo dos últimos séculos foram construídas diversas interpretações e teorias acerca dos objetivos e conteúdos da democracia. Na prática, a democracia pode ser um modelo de governo que amplia as capacidades de desenvolvimento social, político e econômico, com base em princípios de igualdade e cidadania, ou se tornar uma simples “regra” para formar governos que não priorizem necessariamente o atendimento das demandas sociais. O presente artigo deseja observar como a crônica esportiva de futebol (especialmente a produção textual de Nelson Rodrigues e José Lins do Rego) consegue engendrar, em sua narrativa, mundos possíveis que, mesmo com atributos ficcionais, se vinculam à referencialidade dos fatos ocorridos no esporte. Utilizando-se o arcabouço teórico de Umberto Eco e de David Lewis, o objetivo aqui é refletir acerca desse exercício de isomorfismo linguístico, bem como desvelar as estratégias altermundistas utilizadas.

This is a comprehensive critique of the Heidegger problem and while putting forward a critique of Heidegger; it establishes the sanctity of Levinas. In the process of doing so; the reviewer touches on the problems of not considering Edith Stein in a book of this sort. When I got my tenure in India, one wisecrack on the board of interviewers asked me how Kit Marole influenced Shakespeare. I knew that he was just quoting Wayne C Booth's stuff on Macbeth. John (...) E Drabinski and Eric S Nelson are not those wisecrack sorts. They are serious scholars and this review gives them their due. They have shown the Janus nature of the Nazi, Heidegger who was instrumental in gassing Edith Stein, who needs to be known more throughout the academy, which COVID 19 has successfully destroyed. And we need Levinas and Stein to rebuild a world which will be mediated soon by drones and inane webinars and contactless nonsense. This reviewer suggests that we read this book with great care. The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. Machine learning algorithms may radically improve our ability to diagnose and treat disease. For moral, legal, and scientific reasons, it is essential that doctors and patients be able to understand and explain the predictions of these models. Scalable, customisable, and ethical solutions can be achieved by working together with relevant stakeholders, including patients, data scientists, and policy makers.

Central to this chapter is a basic philosophical concept of the nature of modern science which exists amongst positivists, like Auguste Comte, who rejects as illegitimate all that cannot be directly observed in the investigation and study of any subject. Our daily experience of the nature of science continues to give us reasons to unlearn what can be considered as prejudices and errors in our conception of the nature of science. Consequently, the question "what is the nature of modern science?" (...) still perplexes us, and the answers we provide to this question often reveal how distorted our vision of history and thought has become over the years. This chapter shall, via the method of critical analysis in philosophy pass through Comte's three stages of arriving at the truth. This approach rejects as non-scientific all that cannot be directly observed in the investigation and study of any subject against Whitehead's approach in which he tries to make a “dispassionate consideration of the nature of things, antecedently to any special investigation into their details”. This is a standpoint Whitehead terms “metaphysical.” This explains why he developed a comprehensive metaphysical system for the understanding of science, society, and self as found in his major texts. In this light, science cannot be done without taking metaphysics into account. (shrink)

Early Daoism, as articulated in the Daodejing and the Zhuangzi, indirectly addresses environmental issues by intimating a non-reductive naturalistic ethics calling on humans to be open and responsive to the specificities and interconnections of the world and environment to which they belong. "Dao" is not a substantial immanent or transcendent entity but the lived enactment of the intrinsic worth of the "myriad things" and the natural world occurring through how humans address and are addressed by them. Early Daoism potentially corrects (...) both anthropocentrism and biocentrism in environmental ethics by disclosing the things themselves in the context of the selfcultivation of life. Given increasing environmental devastation and the dominance of views, practices, and institutions reducing nature to a background and/or raw material for human activity, this "ethics of encounter" discloses the life of things as inexhaustibly more than human projects and constructs, extending ethical recognition and responsibility beyond social relations and the social self. This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. Psychiatry has witnessed a new wave of approaches to clinical phenotyping and the study of psychopathology, including the National Institute of Mental Health’s Research Domain Criteria, clinical staging, network approaches, the Hierarchical Taxonomy of Psychopathology, and the general psychopathology factor, as well as a revival of interest in phenomenological psychopathology. The question naturally emerges as to what the relationship between these new approaches is – are they mutually exclusive, competing approaches, or can they be integrated in some way and used (...) to enrich each other? In this opinion piece, we propose a possible integration between clinical staging and phenomenological psychopathology. Domains identified in phenomenological psychopathology, such as selfhood, embodiment, affectivity, etc., can be overlaid on clinical stages in order to enrich and deepen the phenotypes captured in clinical staging (‘high resolution’ clinical phenotypes). This approach may be useful both ideographically and nomothetically, in that it could complement diagnosis, enrich clinical formulation, and inform treatment of individual patients, as well as help guide aetiological, prediction, and treatment research. The overlaying of phenomenological domains on clinical stages may require that these domains are reformulated in dimensional rather than categorial terms. This integrative project requires assessment tools, some of which are already available, that are sensitive and thorough enough to pick up on the range of relevant psychopathology. The proposed approach offers opportunities for mutual enrichment: clinical staging may be enriched by introducing greater depth to phenotypes; phenomenological psychopathology may be enriched by introducing stages of severity and disorder progression to phenomenological analysis. I argue that a Kantian inspired investigation into animal morality is both a plausible and coherent research program. To show that such an investigation is possible, I argue that philosophers, such as Korsgaard, who argue that reason demarcates nonhuman animals from the domain of moral beings are equivocating in their use of the term ‘rationality’. Kant certainly regards rationality as necessary for moral responsibility from a practical standpoint, but his distinction between the noumenal and phenomenal means that he can only (...) establish it as a marker for morality from a theoretical standpoint. This means that when it comes to evaluating the moral capabilities of others, rationality can be neither necessary nor sufficient for morality, leaving open the possibility of other empirical markers for moral responsibility. I argue that the higher faculties, character, implicit knowledge of universality, and antecedent practical pleasures (which provide a way to distinguish between morally motivated behaviour and other types of socially motivated behaviour) can all serve as empirical markers for morality. There is empirical evidence that at least some animals have conceptual capabilities and therefore the empirical marker of the higher faculties. In addition, there is suggestive evidence that merits further investigation for the other three markers. While this will not provide a definitive answer on whether animals are capable of acting morally, it will provide a Kantian outlook that can be used to evaluate empirical and philosophical work on animal morality. Many philosophers have wrongly assumed that there is an asymmetry between the problem of induction and the logocentric predicament (the justification of deductive inferences). This paper will show that the demand for justification, for the very inferences that are required for justification, is deeply problematic. Using a Wittgensteinian approach, I will argue that justification has an internal relation with deductive and inductive inferences. For Wittgenstein, two concepts are internally related if my understanding of one is predicated on my understanding of (...) the other. Separating the two concepts so that one can be applied to the other is then a misunderstanding of role that these concepts play. (shrink)

Daoism and Environmental Philosophy explores ethics and the philosophy of nature in the Daodejing, the Zhuangzi, and related texts to elucidate their potential significance in our contemporary environmental crisis. This book traces early Daoist depictions of practices of embodied emptying and forgetting and communicative strategies of undoing the fixations of words, things, and the embodied self. These are aspects of an ethics of embracing plainness and simplicity, nourishing the asymmetrically differentiated yet shared elemental body of life of the myriad things, (...) and being responsively attuned in encountering and responding to things. These critical and transformative dimensions of early Daoism provide exemplary models and insights for cultivating a more expansive ecological ethos, environmental culture of nature, and progressive political ecology. This essay is about the significance of communication and the ineffable for the question of hermeneutics. I argue that Friedrich Schleiermacher’s hermeneutics needs to be interpreted in the context of his early religious thought and that the play between communication and what resists and withdraws from communication provides an alternative conception of the tasks of hermeneutics. Hermeneutics is not only constituted by what is said and what is left unsaid but, further, by that which is unsayable. Finally, the relation and (...) non-relation of meaning and the ineffable is articulated in its ethical import by exploring the questions of alterity, singularity and responsiveness. (shrink)

In paradigmatic Confucian (Ruist) discourses, emotion (qing) has been depicted as co-arising with human nature (xing) and an irreducible constitutive source of human practices and their interpretation. The affects are concurrently naturally arising and alterable through how individuals react and respond to them and how they are or are not cultivated. That is, emotions are relationally mediated realities given in and transformed through how they are felt, understood, interpreted, and acted upon. Confucian discourses have elucidated the ethical character of the (...) emotions and sought to understand and cultivate emotional life as a hermeneutical and ethical task in establishing expectable patterns of human flourishing that orient virtues, roles, and relations. In this chapter, I explore the extent to which classical Ruist and Neo-Confucian discourses offer hermeneutical models for interpreting the complex interconnections between moral psychology and their mediations in the ethical life world. By examining a range of Confucian sources, the author argues that Confucian “moral psychologies” clarify affective dimensions of human existence within the interpersonal nexus of ethical life and indicate ways of cultivating affective awareness for relationally understanding and interpreting others, one’s world, and oneself.
