Esta obra hace referencia a una serie de reflexiones sobre diferentes enfoques de investigación, algunos clasificables como “cualitativos” otros no, y que se encuentran en pleno proceso de elaboración; otras, a falencias ya señaladas en la literatura tradicional sobre las limitaciones de la investigación positivista, aunque actualizadas a los conocimientos que ahora tenemos hoy en día. Cubre, por tanto, aspectos metodológicos (con recomendaciones para la acción) y epistemológicos, o sea, ejemplos sobre cómo se debe proceder en determinadas situaciones o como (...) pensarlos desde una perspectiva epistemológica. Ha sido pensada para roles tan diversos como el de educador, líderes sociales, directores de escuela o especialistas, y aunque nos hubiese complacido dedicar más páginas a unos y otros, la centralización en las tradiciones investigativas parecía más conveniente. Pensamos que, de esta manera, el lector puede conseguir lecturas más frescas sobre diferentes tópicos que son de aplicación múltiple para diferentes campos. (shrink)

In this paper, I argue for a new solution to Mary’s puzzle in Jackson’s famous knowledge argument. We are told that imprisoned Mary knows all facts or truths about color and color vision. On her release, she learns something new according to B-type of materialism and according to property dualism. I argue that this cognitive improvement can only be accounted for in terms of what Schellenberg has recently called “capacitism,” namely the claim that that experience is constitutively a matter of (...) discriminating and singling out particulars by employing perceptual capacities. Of course, I am not claiming that knowing the phenomenal character is simply the possession of abilities, let alone that the phenomenal character is a sort of know-how. That is why my claim is not affiliated with Lewis and Nemirow's ability hypothesis position. I take for granted here a sort of property-representationalism, according to which the phenomenal character of experience supervenes on the cluster of properties that the respective experiences represent. On her release, Mary acquires those perceptual abilities on the basis of which she learns to discriminate all shades of color. And after applying her old physical concept RED to the shade of red, she comes to know what it is like to experience red (propositional knowledge). (shrink)

This chapter is devoted to the discussion of religious freedom and the anti-racist fight in the Black Diaspora in Latin America, considering the historical processes that involve such discussion, including legal apparatus such as Human Rights and local legislation. Therefore, as a starting point, we take the historical conditions of the emergence of Candomblé in Brazil, that are linked to the trafficking of enslaved African peoples and their resistance to keep alive in their memories, their religious beliefs and their worldviews. Wherefore, it is a discussion in which religious freedom is not dissociated from the anti-racist struggle in the case of Brazil, where, in the 20th century, the myth of racial democracy is produced in the light of studies carried out by Gilberto Freyre in the midst of the 1922 post-week modernist movement. A militância política de Jorge Amado no Partido Comunista é um capítulo à parte na história do comunismo no Brasil, que completou 100 anos no dia 25 de março. Ela também é algo marcante em sua obra, a ponto da crítica literária brasileira, de tradição uspiana, considerá-la uma forma de panfleto partidário da nossa esquerda. Nesta exposição, pretende-se realizar uma breve discussão acerca de suas lutas políticas, das quais se destacam as questões religiosa e racial, que levaram Jorge Amado a (...) criar um projeto de lei, no período que exerceu o mandato de deputado constituinte pelo PCB, em 1946, assegurando a liberdade religiosa no Brasil. Aqui, também se destaca a sua amizade com o povo de candomblé que lhe honrou com títulos, como o de Obá de Xangô e Ogã de Iansã; além da forma como a crítica o rotulava de regionalista e escritor panfletário. Contudo, esta é uma forma de homenagear tanto o mais famoso dos doze Obás de Xangô da Bahia, quanto o Partidão, nesse seu centenário. Em termos metodológicos, trata-se de uma leitura ensaística foucaultiana sobre esses fatos e acontecimentos que marcaram duplamente a vida de Jorge Amado e do Comunismo no Brasil, já que lançamos mão de uma parte da maquinaria teórica do militante comunista do PCF (Partido Comunista Francês), Michel Foucault, como vontade de verdade, comentário, discurso, autoria, obra, descontinuidade (na continuidade) e dispersão. Este estudo tem como objetivo principal discutir qual o lugar da memória nas pesquisas históricas empreendidas pelo filósofo francês Michel Foucault, o qual foi responsável pelo desenvolvimento de duas frentes metodológicas de trabalho: a arqueologia do saber e a genealogia do poder, conhecidas hoje como arqueogenealogia foucaultiana. Ao longo de mais de 30 anos dedicados a estas pesquisas, Michel Foucault ganhou projeção nacional e internacional pela sua inquietante forma de aliar a militância política com o trabalho acadêmico, demonstrando, com isso, (...) qual era o papel do intelectual frente aos desafios e demandas no mundo do pós-guerra. Recebeu a maior honraria no mundo da intelectualidade francesa ao ser eleito professor do célebre Collège de France, assumindo, por mais de uma década, a cátedra história dos sistemas de pensamentos. Em uma de suas últimas entrevistas, declarou que todos os seus gestos tinham como principal objetivo: criar a história como os seres humanos se tornam sujeitos em nossa cultura. Esta declaração deixa evidente qual o lugar que a história ocupa em sua obra, mas qual seria o lugar da memória nesses seus empreendimentos? Por que a história aparece em seu trabalho como lugar privilegiado enquanto a memória tem um lugar de coadjuvante? São estas as reflexões iniciais que buscamos realizar neste nosso trabalho. Neste capítulo, vamos tratar do discurso-corpo demarcado pelas utopias em justaposição com as heterotopias em duas produções cinematográficas do horror francês contemporâneo. Dessa forma, o corpo que operamos é feito de discurso, ou seja, todo seu tecido, seus órgãos, seus sistemas, seus ossos são discursos sobrepostos pelo visível e pelo dizível, da mesma forma, como demonstrou Foucault na obra O Nascimento da Clínica em 1963.

Os corpos no cinema estão sob a ordem de um olhar soberano que nos diz para onde devemos olhar e como devemos fazer isso. É um olhar poderoso que tudo sabe e tudo pode. Um olhar que nos posiciona não como simples espectadores, mas como sujeitos. É a partir daí que buscamos compreender como se arquitetam o medo, ou seja, qual é a ordem do cinema de horror, tecido com a pena do medo? Nessa arquitetura, os corpos aparecem como lugares (...) para vigiar e punir em espaços utópicos e heterotópicos. Espaços de memórias. Espaços de poder vigiar e punir. Espaço onde se impõe uma posição de sujeito, um poder sobre o sujeito. Portanto, os corpos no cinema de horror são artefatos para uma arqueologia do medo, escrita pelo poder do horror sobre estes corpos. Daí nosso interesse por esses lugares. Para demonstrar essa arqueologia, utilizaremos dois filmes franceses, produzidos em 2007, Frontière(s) e À l’interieur como espaços de horror construídos para o medo pelas vias da utopia e heterotopias pensadas por Michel Foucault, filósofo do presente, do nosso presente para compreender como se arquitetam tal medo por meio de sua história arqueológica, prática de um espaço chamado Labedisco/UESB. Contemporary theories of consciousness are based on widely different concepts of its nature, most or all of which probably embody aspects of the truth about it. Starting with a concept of consciousness indicated by the phrase “the feeling of what happens” (the title of a book by Antonio Damásio), we attempt to build a framework capable of supporting and resolving divergent views. We picture consciousness in terms of Reality experiencing itself from the perspective of cognitive agents. Each conscious experience is (...) regarded as composed of momentary feeling events that are combined by recognition and evaluation into extended conscious episodes that bind cognitive contents with a wide range of apparent durations (0.1 secs to 2 or more secs, for us humans, depending on circumstances and context). Three necessary conditions for the existence of consciousness are identified: a) a ground of Reality, envisaged as an universal field of potentiality encompassing all possible manifestations, whether material or 'mental'; b) a transitional zone, leading to; c) a manifest world with its fundamental divisions into material, 'informational' and quale-endowed aspects. We explore ideas about the nature of these necessary conditions, how they may relate to one another and whether our suggestions have empirical implications. (shrink)

This study takes up the discussion held by Philippe Sabot in Foucault, Sade and the Enlightenment when it came the Marquis de Sade's work uses in studies conducted by Michel Foucault from Madness and Civilization to The Will to Knowledge. What interests us know of this relationship? This is the main question that guided our study.

Causal reasoning and game-theoretic reasoning are fundamental topics in artificial intelligence, among many other disciplines: this paper is concerned with their intersection. Despite their importance, a formal framework that supports both these forms of reasoning has, until now, been lacking. We offer a solution in the form of (structural) causal games, which can be seen as extending Pearl's causal hierarchy to the game-theoretic domain, or as extending Koller and Milch's multi-agent influence diagrams to the causal domain. We then consider three (...) key questions: i) How can the (causal) dependencies in games - either between variables, or between strategies - be modelled in a uniform, principled manner? ii) How may causal queries be computed in causal games, and what assumptions does this require? iii) How do causal games compare to existing formalisms? To address question i), we introduce mechanised games, which encode dependencies between agents' decision rules and the distributions governing the game. In response to question ii), we present definitions of predictions, interventions, and counterfactuals, and discuss the assumptions required for each. Regarding question iii), we describe correspondences between causal games and other formalisms, and explain how causal games can be used to answer queries that other causal or game-theoretic models do not support. Finally, we highlight possible applications of causal games, aided by an extensive open-source Python library. (shrink)

The ethical philosophy of Emmanuel Levinas is typically associated with a punishing conception of responsibility rather than freedom. In this chapter, our aim is to explore Levinas’s often overlooked theory of freedom. Specifically, we compare Levinas’s account of freedom to the Kantian (and Fichtean) idea of freedom as autonomy and the Hegelian idea of freedom as relational. Based on these comparisons, we suggest that Levinas offers a distinctive conception of freedom—“finite freedom.” In contrast to Kantian autonomy, finite freedom constitutively involves (...) standing in certain social relations with others. And in contrast to Hegelian relational freedom, the social relations involved in finite freedom are not defined by mutual recognition, but by feelings of separation and even antagonism. Along the way, we promote a reading Levinas’s Totality and Infinity as a Hegel-style story of Bildung (development), and show how, on Levinas’s view, freedom can develop or mature in the life of the individual. O presente trabalho busca refletir, no sentido derridiano, sobre o ensino do Português Língua Estrangeira (PLE) à luz do Quadro Europeu Comum de Referência para a aprendizagem, ensino e avaliação de línguas (QECR). Tal documento, juntamente com o Portfólio Europeu das Línguas, se apresenta como um instrumento essencialmente linguístico para a harmonização do ensino de línguas vivas europeias e com uma perspectiva intercultural. Dessa forma, o QECR advoga que o ensino de língua deve promover o desenvolvimento do aprendiz, da sua (...) identidade em resposta à experiência enriquecedora da diferença na língua e na cultura. Exige-se do aluno muito mais do que simplesmente imitar ou memorizar. O QECR busca descrever exaustivamente aquilo que o aprendiz de uma língua, no nosso caso o PLE, tem que aprender para ser capaz de comunicar, interagir e quais os conhecimentos e habilidades ele tem de desenvolver para serem eficazes na sua atuação. A descrição abrange também o contexto cultural dessa língua. Sendo assim, o QECR é mais uma alternativa para aqueles que trabalham com o português na modalidade de língua 2 (PLE) no sentido da compreensão das alteridades, da cidadania e da democracia num mundo sem fronteiras em que “Navegar é preciso”, i.e., interagir, dialogar. É bem conhecida a divergência entre as posições de Gottlob Frege e Bertrand Russell com relação ao tratamento semântico dado a sentenças contendo termos singulares indefinidos, ou seja, termos singulares sem referência ou com referência ambígua, tais como ‘Papai Noel’ ou ‘o atual rei da França’ ou ‘1/0 ’ ou ‘√4’ ou ‘o autor de Principia Mathematica’. Para Frege, as sentenças da linguagem natural que contêm termos indefinidos não formam declarações e portanto não são nem verdadeiras nem falsas. Já para (...) as sentenças da matemática, Frege defende que elas precisam ser corrigidas através da convenção forçada de uma referência não ambígua. Russell, por outro lado, aceita os termos indefinidos e propõe, através de sua teoria das descrições definidas, uma maneira de avaliar as sentenças em que eles ocorrem; e Quine amplia a teoria de Russell para abranger também os nomes com problemas de referência. Na prática da matemática são comuns os termos singulares indefinidos, sem referência, tais como ‘1/0 ’, ou com referência ambígua, tais como ‘√4’. Apesar de não haver uma sistematização rigorosa desta situação entre os matemáticos, há, no entanto, um conjunto de regras convencionais que tradicionalmente costumam ser aplicadas no tratamento matemático dos termos indefinidos. Nossa proposta é tomar a convenção matemática como inspiração e modelo para apresentar uma interpretação semântica formal para as descrições definidas e os nomes e utilizá-la como um argumento que favorece a abordagem de Russell relativamente à de Frege. Much of the ontology made in the analytic tradition of philosophy nowadays is founded on some of Quine’s proposals. His naturalism and the binding between existence and quantification are respectively two of his very influential metaphilosophical and methodological theses. Nevertheless, many of his specific claims are quite controversial and contemporaneously have few followers. Some of them are: (a) his rejection of higher-order logic; (b) his resistance in accepting the intensionality of ontological commitments; (c) his rejection of first-order modal logic; and (...) (d) his rejection of the distinction between analytic and synthetic statements. I intend to argue that these controversial negative claims are just interconnected consequences of those much more accepted and apparently less harmful metaphilosophical and methodological theses, and that the glue linking all these consequences to its causes is the notion of extensionality. Neste artigo analisamos o conceito de eu quantificado a partir na Perspectiva de Segunda Pessoa, segundo a qual a eu-dade, ou pessoalidade, é atualizada em relações contexto-dependentes de total ou parcial transparência cognitiva não redutíveis aos aspectos considerados nas perspectivas de primeira ou de terceira pessoa. O eu quantificado designa o indivíduo que realiza medições sobre si mesmo por meio de tecnologias ubíquas em rede para obter um suposto maior autoconhecimento, instanciando, segundo alguns autores, um ponto de vista de Quarta (...) Pessoa constituído por relações de alteridade (pessoa-máquina-pessoa) emergentes, em especial, em um cenário sociocultural permeado por tecnologias ubíquas e análises de big data. Procuraremos problematizar a tese de que o automonitoramento digital promoveria um aprofundamento do autoconhecimento, defendida pelos postuladores da quantificação do eu. Procuraremos mostrar que a coleta de dados sobre si mesmo por meio de tecnologias ubíquas não favorece necessariamente a constituição/atualização da pessoalidade porque o automonitoramento digital mediado pode interferir significativamente nos modos de interação social da Segunda Pessoa e no autoconhecimento que tal interação pode promover. The purpose of this article is to support the logical incompatibility of the opposing views as a criterion for characterizing disagreements as genuinely metaphysical. That is, I intend to argue that a specific dispute is a metaphysical disagreement only when the conflicting views are governed by different logics. If correct, this criterion would not only help to separate merely verbal from genuine metaphysical debates, but it also would ground an argument against deflationism, guaranteeing the substantiality and relevance of metaphysics. La hipótesis principal es que las películas de terror se muestran como una nueva forma de vigilancia y control (...) social del cuerpo. Schizophrenia is usually described as a fragmentation of subjective experience and the impossibility to engage in meaningful cultural and intersubjective practices. Although the term schizophrenia is less than 100 years old, madness is generally believed to have accompanied mankind through its historical and cultural ontogeny. What does it mean to be “mad”? The failure to adopt social practices or to internalize cultural values of common sense? Despite the vast amount of literature and research, it seems that the study of schizophrenia (...) and of the psychoses is suffering from a generic disintegration. In this introduction, we offer an historical overview of the variety of theories and approaches to schizophrenia. We also provide an overview of how the authors in this volume attempt an integrative account where training, practice, theory and research are considered as parts of a larger whole. This is a varied and pluralistic volume, and it is up to the readers to make use of different chapters according to their own needs. (shrink)

This paper addresses Fichte’s puzzle of self-consciousness. I propose a new reading of “Fichte’s original insight,” inspired by Pareyson’s general reading, which I call here the “Fichtean metaphysical turn in transcendental philosophy.” Against the mainstream view in Fichte’s scholarship, I argue that Fichte’s and Kant’s views do not concur regard- ing the primary reference of the “I”, namely spontaneous agency in thinking, which Fichte calls “Tathandlung”. Yet, their views do, in fact, concur when Fichte claims that this spontaneous agency in (...) thinking is the “essence” or the underlying nature of the self, which Kant denies. Regarding this, I take the side of Fichte. But how is Fichte’s original insight supposed to solve the puzzle of self-consciousness? At that transcendental level, the puzzle does not arise because there is no need for self-identification in the first place. Transcendental self-knowledge results from the sui generis intellectual Selbstanschauung that everyone has of oneself as sheer spontaneous agency in thinking. But at the empirical level, the puzzle does not arise either and for the same reason. Reference to the embodied self dispenses with any self-identification because it is based on the fundamental metaphysical relation everybody has to their own body, namely identity. (shrink)

In this paper I draw together the notion of the absent referent as proposed by Carol J. Adams, and the notions of literal and symbolical sacrifice by eating the other — or ingestion — advanced by Jacques Derrida, to characterize how animals are commonly perceived, which ultimately forbids productive arguments for vegetarianism. I discuss animals as being literally and definitionally absent referents, and I argue, informed by Derrida’s philosophy, that it is impossible to aim at turning them into present referents (...) without reinforcing symbolic ingestion by linking symbolic ingestion to epistemic appropriation or conceptualization. With this, I highlight the ethical importance of discussing symbolic ingestion in animal philosophy. (shrink)

Tentar-se-á mostrar que o poder inverso — o poder de corromper moralmente — não se verifica (ou não se verifica tão facilmente): apelar-se-á à resistência imaginativa humana (...) que parece impedir que o Homem exporte perspetivas morais que violentam o seu próprio posicionamento axiológico. Recently, the practice of deciding legal cases on purely statistical evidence has been widely criticised. Many feel uncomfortable with finding someone guilty on the basis of bare probabilities, even though the chance of error might be stupendously small. This is an important issue: with the rise of DNA profiling, courts are increasingly faced with purely statistical evidence. A prominent line of argument—endorsed by Blome-Tillmann 2017; Smith 2018; and Littlejohn 2018—rejects the use of such evidence by appealing to epistemic norms that (...) apply to individual inquirers. My aim in this paper is to rehabilitate purely statistical evidence by arguing that, given the broader aims of legal systems, there are scenarios in which relying on such evidence is appropriate. Along the way I explain why popular arguments appealing to individual epistemic norms to reject legal reliance on bare statistics are unconvincing, by showing that courts and individuals face different epistemic predicaments (in short, individuals can hedge when confronted with statistical evidence, whilst legal tribunals cannot). I also correct some misconceptions about legal practice that have found their way into the recent literature. (shrink)

Recent years have seen fresh impetus brought to debates about the proper role of statistical evidence in the law. Recent work largely centres on a set of puzzles known as the ‘proof paradox’. While these puzzles may initially seem academic, they have important ramifications for the law: raising key conceptual questions about legal proof, and practical questions about DNA evidence. This article introduces the proof paradox, why we should care about it, and new work attempting to resolve it.

What is it to be mentally healthy? In the ongoing movement to promote mental health, to reduce stigma, and to establish parity between mental and physical health, there is a clear enthusiasm about this concept and a recognition of its value in human life. However, it is often unclear what mental health means in all these efforts and whether there is a single concept underlying them. Sometimes, the initiatives for the sake of mental health are aimed just at reducing mental (...) illness, thus implicitly identifying mental health with the absence of diagnosable psychiatric disease. More ambitiously, there are high-profile proposals to adopt a positive definition, identifying mental health with psychic or even overall well-being. We argue against both: a definition of mental health as mere absence of mental illness is too thin, too undemanding, and too closely linked to psychiatric value judgments, while the definition in terms of well-being is too demanding and potentially oppressive. As a compromise, we sketch out a middle position. On this view, mental health is a primary good, that is, the psychological preconditions of pursuing any conception of the good life, including well-being, without being identical to well-being. ABSTRACT A thriving project in contemporary epistemology concerns identifying and explicating the epistemic virtues. Although there is little sustained argument for this claim, a number of prominent sources suggest that curiosity is an epistemic virtue. In this paper, I provide an account of the virtue of curiosity. After arguing that virtuous curiosity must be appropriately discerning, timely and exacting, I then situate my account in relation to two broader questions for virtue responsibilists: What sort of motivations are required for epistemic (...) virtue? And do epistemic virtues need to be reliable? I will sketch an account on which curiosity is only virtuous when rooted in a non-instrumental appreciation of epistemic goods, before arguing that curiosity can exhibit intellectual virtue irrespective of whether one is reliable in satisfying it. Recent work takes both philosophical and scientific progress to consist in acquiring factive epistemic states such as knowledge. However, much of this work leaves unclear what entity is the subject of these epistemic states. Furthermore, by focusing only on states like knowledge, we overlook progress in intermediate cases between ignorance and knowledge—for example, many now celebrated theories were initially so controversial that they were not known. -/- This paper develops an improved framework for thinking about intellectual progress. Firstly, I argue (...) that we should think of progress relative to the epistemic position of an intellectual community rather than individual inquirers. Secondly, I show how focusing on the extended process of inquiry (rather than the mere presence or absence of states like knowledge) provides a better evaluation of different types of progress. This includes progress through formulating worthwhile questions, acquiring new evidence, and increasing credence on the right answers to these questions. I close by considering the ramifications for philosophical progress, suggesting that my account supports rejecting the most negative views while allowing us to articulate different varieties of optimism and pessimism. I argue that traditional views on which beliefs are subject only to purely epistemic assessment can reject demographic profiling, even when based on seemingly robust evidence. This is because the moral failures involved in demographic profiling can be located in the decision not to suspend judgment, rather than supposing that beliefs themselves are a locus of moral evaluation. A key moral reason to suspend judgment when faced with adverse demographic evidence is to promote social equality—this explains why positive profiling is (...) dubious, along with more familiar cases of negative profiling, and why profiling is suspect even when no particular action is at stake. My suspension-based view, while compatible with revisionary normative positions, does not presuppose them. Philosophers of all stripes can reject demographic profiling both in thought and deed. If I were asked to put forward an ethical principle which I considered to be especially certain, it would be that no one can be responsible, in the properly ethical sense, for the conduct of another. Responsibility belongs essentially to the individual. The implications of this principle are much more far-reaching than is evident at first, and reflection upon them may lead many to withdraw the assent which they might otherwise be very ready to accord to this view of responsibility. But if the difficulties do appear to be insurmountable, and that, very certainly, does not seem to me to be the case, then the proper procedure will be, not to revert to the barbarous notion of collective or group responsibility, but to give up altogether the view that we are accountable in any distinctively moral sense. Should we use the same standard of proof to adjudicate guilt for murder and petty theft? Why not tailor the standard of proof to the crime? These relatively neglected questions cut to the heart of central issues in the philosophy of law. This paper scrutinises whether we ought to use the same standard for all criminal cases, in contrast with a flexible approach that uses different standards for different crimes. I reject consequentialist arguments for a radically flexible standard of proof, (...) instead defending a modestly flexible approach on non-consequentialist grounds. The system I defend is one on which we should impose a higher standard of proof for crimes that attract more severe punishments. This proposal, although apparently revisionary, accords with a plausible theory concerning the epistemology of legal judgments and the role they play in society. (shrink)

The concept of the analyst's presence gained attention almost 60 years ago through the writings of the French analyst Sacha Nacht and the Hungarian-British Michael Balint. Anna Freud earlier spoke of the related, but rather ambiguous term "real person of the analyst," which has been widely discussed by many authors since. Both terms- presence and real person- appear frequently in the psychoanalytic literature, usually without much definition or conceptual clarity. Authors have used them in different ways, but in general their (...) intention has been to contrast the analyst's reality as a person with his function as a transference and fantasy object, perhaps as a corrective to the perceived austerity of the classical « one-person » model. Lacan's work represents an exception in attempting to escape the dialectic between intra and inter-psychic, but at the cost of eliminating the influence of the analyst as another subject. In contrast to metapsychologic theories of the mind, the author argues that "real presence" can be better understood as part of the phenomenologic experience of intersubjectivity, The co-presence of the analyst is fundamental to the encounter, rather than an accidental or intentional disruption. Criminal juries make decisions of great importance. A key criticism of juries is that they are unreliable in a multitude of ways, from exhibiting racial or gendered biases, to misunderstanding their role, to engaging in impropriety such as internet research. Recently, some have even claimed that the use of juries creates injustice on a large-scale, as a cause of low conviction rates for sexual criminality. Unfortunately, empirical research into jury deliberation is undermined by the fact that researchers are unable to (...) study live juries. The indirect sources of evidence used by researchers suffer from various problems, the most important of which is dubious levels of ecological validity. Real jury research—studying live jury deliberation—is controversial. However, as I argue, the objections to it are unconvincing. There is in fact a moral imperative to facilitate real jury research. Despite playing an important role in epistemology, philosophy of science, and more recently in moral philosophy and aesthetics, the nature of understanding is still much contested. One attractive framework attempts to reduce understanding to other familiar epistemic states. This paper explores and develops a methodology for testing such reductionist theories before offering a counterexample to a recently defended variant on which understanding reduces to what an agent knows.

A question, long discussed by legal scholars, has recently provoked a considerable amount of philosophical attention: ‘Is it ever appropriate to base a legal verdict on statistical evidence alone?’ Many philosophers who have considered this question reject legal reliance on bare statistics, even when the odds of error are extremely low. This paper develops a puzzle for the dominant theories concerning why we should eschew bare statistics. Namely, there seem to be compelling scenarios in which there are multiple sources of (...) incriminating statistical evidence. As we conjoin together different types of statistical evidence, it becomes increasingly incredible to suppose that a positive verdict would be impermissible. I suggest that none of the dominant views in the literature can easily accommodate such cases, and close by offering a diagnosis of my own. (shrink)

Legal epistemology has been an area of great philosophical growth since the turn of the century. But recently, a number of philosophers have argued the entire project is misguided, claiming that it relies on an illicit transposition of the norms of individual epistemology to the legal arena. This paper uses these objections as a foil to consider the foundations of legal epistemology, particularly as it applies to the criminal law. Jury science is fraught with difficulty. Since legal and institutional hurdles render it all but impossible to study live criminal jury deliberation, researchers make use of various indirect methods to evaluate jury performance. But each of these methods are open to methodological criticism and, strikingly, some of the highest-profile jury research programmes in recent years have reached opposing conclusions. Uncertainty about jury performance is an obstacle for legal reform—ongoing debates about the ‘justice gap’ for complainants of sexual offences has rendered (...) these problems stark. Thomas Reid's philosophy of mind, epistemology, and philosophy of language all rely on his account of signs and signification. On Reid's view, some entities play a role of indicating other entities to our minds. In some cases, our sensitivity to this indication is learned through experience, whereas in others, the sensitivity is built in to our natural constitutions. Unlike representation, which was presumed to depend on resemblances and necessary connections, signification is the sort of relationship that can occur without any (...) intrinsic ties between the sign and the thing signified. Of particular interest is the priority Reid gives to natural signs. Reid deploys his robust account of natural signs in a way that allows him to sidestep some skeptical worries common in the early modern period, as well as in grounding “artificial” human languages like English or Cantonese on a more basic human capacity for communication, that is, itself, the result of our sensitivity to natural signs of other people's minds. Abstract: The Pull Bayesian Significance Test (FBST) for precise hy- potheses is applied to a Multivariate Normal Structure (MNS) model. In the FBST we compute the evidence against the precise hypothesis. This evi- dence is the probability of the Highest Relative Surprise Set (HRSS) tangent to the sub-manifold (of the parameter space) that defines the null hypothesis. The MNS model we present appears when testing equivalence conditions for genetic expression measurements, using micro-array technology.

This paper defends the heretical view that, at least in some cases, we ought to assign legal liability based on purely statistical evidence. The argument draws on prominent civil law litigation concerning pharmaceutical negligence and asbestos-poisoning. The overall aim is to illustrate moral pitfalls that result from supposing that it is never appropriate to rely on bare statistics when settling a legal dispute.

The notion of understanding occupies an increasingly prominent place in contemporary epistemology, philosophy of science, and moral theory. A central and ongoing debate about the nature of understanding is how it relates to the truth. In a series of influential contributions, Catherine Elgin has used a variety of familiar motivations for antirealism in philosophy of science to defend a non- factive theory of understanding. Key to her position are: (i) the fact that false theories can contribute to the upwards trajectory (...) of scientific understanding, and (ii) the essential role of inaccurate idealisations in scientific research. Using Elgin’s arguments as a foil, I show that a strictly factive theory of understanding has resources with which to offer a unified response to both the problem of idealisations and the role of false theories in the upwards trajectory of scientific understanding. Hence, strictly factive theories of understanding are viable notwithstanding these forceful criticisms. (shrink)

O artigo apresenta uma análise das formas literárias de Mt 20,20-28, que narra o pedido da mãe dos filhos de Zebedeu e a resposta de Jesus a respeito do servir. Será aplicado o referencial teórico proposto por Klaus Berger, em As formas literárias do Novo Testamento. Com a aplicação da análise formal a perícope é classificada com um gênero abrangente que contém características de texto simbulêutico, epidíctico e dicânico. Mediante um diagrama são identificados os subgêneros, que são categorias menores em (...) níveis diferentes e que aparecem combinados na perícope. A teoria comunicativa dos gêneros prioriza a relação autor/leitor e releva a importância do ambiente vital como sustentava a tese clássica dos gêneros literários de M. Dibelius e R. Bultmann. Assim os sinais e formas usados no texto produzem o efeito nos ouvintes/leitores. Eles permanecem no modelo dos dominadores do mundo ou vão aderir ao modelo de Jesus? Vão reproduzir a racionalidade da dominação ou a do serviço? A argumentação classificada como simbulêutica em Mt 20,26 visa modificar os pressupostos usados pelos ouvintes para julgar e tomar decisões. O critério não será o poder dominação, mas o serviço, o que resulta em relações igualitárias na comunidade de Mateus. Quem quiser tornar-se grande, deve ser servidor, não o primeiro, mas o último. This essay aims to expose the metaphysical underpinnings of enactivism. While enactivism relies heavily on rejecting the traditional mind-body problem by excluding the familiar thought experiments that favor phenomenal dualism, the crucial point that is overlooked is instead the brain-body problem, specifically the crucial interaction between the brain and the bodily limbs in their embodied activities of perception and cognition. If enactivism is correct, differences in sensory experience necessarily entail differences in embodied activity—this is the metaphysical core of enactivism, which (...) we think is entirely wrong. We will argue that a physical or biological body ("Körper") is configured or shaped into a perceptually living body ("Leib") by brain patterns and not by embodied activity or by the so-called sensorimotor contingencies. Undoubtedly, embodied actions influence sensory perception. However, since variations in embodied actions do not necessarily lead to variations in sensory experience, they are not metaphysically constitutive of these experiences (supervenience claim). The goal of this paper is show how an initially appealing objection to David Hume's account of judgment can only be put forward by philosophers who accept an account of judgment that has its own sizable share of problems. To demonstrate this, I situate the views of John Locke, David Hume, and Thomas Reid with respect to each other, so as to illustrate how the appealing objection is linked to unappealing features of Locke's account of judgment.
