Must we choose between reducing material substances to collections of properties, a’ la Berkeley and Hume or positing bare particulars, in the manner of Locke? Having repudiated the notion that a substance could simply be a collection of properties existing on their own, is there a viable alternative to the Lockean notion of a substratum, a being essentially devoid of character? E.J. Lowe and Michael Loux would answer here in the affirmative. Both recommend hylomorphism as an upgrade on (...) the metaphysics of the British empiricists: treating a material substance as its essential 'form,' this embodied 'substance' universal being, in turn, the substratum in which its 'accidents' inhere. Here, I evaluate this Aristotelian metaphysics, identifying the advantages it enjoys over the empiricist's alternatives pertaining to dependence, unity, identity, change, and the distinction between essential and accidental properties. Philosophy, that most misunderstood of intellectual pursuits, is often mocked; and no part of philosophy is as often mocked as metaphysics. The image of the ‘speculative metaphysician’ dreaming up abstract pictures of the world has been held up for ridicule by poets, playwrights, novelists, journalists as well as by other philosophers. The Logical Positivists in the first half of the 20th Century rejected all metaphysical speculations as ‘meaningless’ since they could not be verified by scientific experiment; in the later part (...) of the century, Wittgenstein criticised systematic metaphysics as being a kind of intellectual disease resulting from our reading false pictures of the world into the grammar of our language. The common suspicion underlying many of these attacks is that ultimately, all metaphysics is a kind of nonsense, and that metaphysicians don’t really know what they are talking about. This suspicion is not new. Nicolas-Sébastien Chamfort commented in 1796, ‘I am tempted to say of metaphysicians what Scaliger used to say of the Basques: they are said to understand one another, but I don’t believe a word of it.’ Some contemporary philosophers may agree. In this paper I explore Michael Loux’s important distinction between “tropes” and “tropers”. First, I argue that the distinction throws into relief an ambiguity and discrepancy in the literature, revealing two fundamentally different versions of trope theory. Second, I argue that the distinction brings into focus unique challenges facing each of the resulting trope theories, thus calling into question an alleged advantage of trope theory—that by uniquely occupying the middle ground between its rivals, trope theory is able to (...) recover and preserve the insights of these views. The concept of universal in Aristotle’s philosophy has several aspects. 1) Universal and plurality Aristotle posits universal (καθόλου) versus particular (καθ᾿ ἕκαστον) each covering a range of elements: some elements are universal while others are particulars. Aristotle defines universal as ‘that which by nature is predicated (κατηγορεῖσθαι) of many subjects’ and particular as ‘that which is not’ so. (OI ., I, 7, 17a38-b1) The plurality of possible subjects of universal is what Aristotle insists on. The inclusion of the notion of (...) ‘plurality’ in the definition of universal might make us expect to have ‘singularity’ in the definition of particular. So, when Aristotle says that universal is that which is naturally predicable of many subjects, we expect him to define the particular as ‘that which is predicable of one subject only.’ Nonetheless, Aristotle does not and indeed cannot define it this way. We cannot find a text in which he defines particular as such simply because particulars are not predicable of any subject unless we regard their predication of themselves a predication, which Aristotle does not, at least in a genuine sense. Thus, he defines a particular only negatively. Hence, the capability of predication of a plurality is indeed the capability of predication itself because the particular cannot be predicated of anything. A particular is that which cannot be predicated of anything (or: of anything else, if saying of a thing of itself is to be considered as predication). It is ‘numerically one’ and what of which the universal is predicated (Met., B, 999b34-1000a1). Those that cannot be predicated of anything, or particulars, are of two kinds: primary substances and individual accidents. Besides Categories we can hardly find a text where Aristotle discusses individual accidents maybe because they are of much less importance for him compared with substances. However, substances are what he mentions repeatedly so that we can confine particulars to substances. In fact, it is substance that Aristotle considers so repeatedly as what cannot be predicated. As the main particulars and individuals, substances are posited as the main things that are not universal. The closeness of the two concepts of ‘substance’ and ‘unpredicability’ is to the extent that he ignores individual accidents and makes these concepts equal and as the opposite of universal: ‘what is not predicated of a subject is said a substance (οὐσία λέγετα τὸ μὴ καθ᾿ ὑποκειμένου) but what is always said of some subject is called a universal.’ (Met., Z, 1038b15-16. cf. Met., B, 1003a7-9) Therefore, since particulars cannot be predicated of any subject and, thus, every predication is necessarily a predication of a plurality of subjects, the inclusion of ‘plurality’ in the definition of universal is either i) in the sense of ‘representation’ or it must be regarded as ii) an unnecessary addition mentioned just for clarification or iii) only for avoiding cases where something is predicated of itself. By the first we mean this: though a substance is not said of anything, it represents some one thing and there is some one thing that is that substance. A universal, on the other hand, can represent a plurality of things. There is, however, a third possibility that has no essential difference with the sense of representation. Aristotle might have ‘arbitrary predication’ in mind when he suses ‘plurality’ in the definition of universal: while a particular can be the arbitrary predicate of just one thing, a universal can be predicated, both really and arbitrarily, of many things. Whatever Aristotle’s intention was, what is important for our investigation is this: Aristotle uses the notion of plurality in the definition of universal in spite of the fact that it is not necessary. What this implies is that this notion is so important for Aristotle that albeit every predictability is a predictability of a possible plurality, he adds the notion of plurality. What makes this notion important, I believe, is that he has something like a class in mind when he defines a universal because the notion of plurality is indistinguishable from a class. 2) Universal and whole; particular and part In Aristotle, the concepts of universal and whole are so close: ‘That which is true of a whole class and is said to hold good as a whole (which implies that it is a kind of whole) is true of a whole in the sense that it contains many things by being predicated of each, and that each and all of them, e.g. man, horse, god, are one because all are living things (τὸ μὲν γὰρ καθόλου καὶ τὸ ὃλως λεγόμενον ὡς πολλὰ περιέχον τῷ κατηγορεῖσθαι καθ’ ἑκάστου καὶ ἓν ἃπαντα εἶναι ὡς ἑκαστον, ...). Phil Corkum points to Aristotle’s distinction between quantitative and integral wholes in Met., 5, 26, 1023b26-33 where a quantitative whole is called homoiomerous, as the sum of animal while an integral whole, e.g. a house, is called heteromerous. He links the notion of homoiomerous to the notion of indivisibility of individuals (in 1b6-9 and 3b10-18) and indivisibility of universals. He believes that in PrA., I, 4, 25b32-26a2 it is the transitivity of mereological containment that is discussed. 3) Universal is common between instances Universal is common (κοινόν) between all the plurality of subjects it can be predicated of because what belongs to more than one thing must be common between them. (Met., Z, 1038b10-12) In the Same way, what is common cannot be a particular and, thus, a substance. (Met., Z, 1040b23-24) An individual or substance is a ‘this’ and a ‘this’ cannot be what common indicates simply because it is here in ‘this’ and can be nowhere else while common must be common between several things. In fact, what can be indicated by a common is indeed a ‘such.’ (Met., B, 1003a7-9) 4) Universal is the same in its instances We have a universal i) in all of its instances and ii) in the same way (ταὐτὸ ἐπὶ πὰντων). (Met, Γ, 1005a9-10) While the first point is evident (otherwise how could it be their universal?), the second point might seem not only ambiguous but the cause of many problems. For Aristotle, therefore, a universal must be ‘one’ in number and not many. This numerically one universal is the very universal for all its instances. It is the same universal that is predicated on each of its instances. This sameness is not, however, a mere homonymous sameness or the sameness of a homonymous word. All these three points, namely oneness, sameness and rejection of mere homonymous sameness are asserted in Aristotle’s own words τι ἕν καὶ τὸ αὐτὸ ἐπὶ πλειόνων μη ὁμώνυμον. (PsA., A, 11, 77a8-9) This non-homonymous unity is asserted also in PsA., A, 24, 85b15-16. 5) Universal as predicate Contrary to substance that cannot be a predicate, universal is what cannot be prevented from being in the place of predicate. Therefore, Aristotle distinguishes universal from subject because while the latter must necessarily be capable of being a predicate, though it might take the position of subject as well, the latter does not necessarily have such a capability especially when it is a this because it cannot be a predicate in such a case: ‘For the subject and universal differ in being or not being a ‘this’; like man and body and soul are the subject of accidents while the accident is something like musical or white.’ (Met., Θ, 1049a27-30) This indicates that a universal is basically different from subject and although it can be posited in the place of subject, it is the position of predicate that is its position as a universal. In Metaphysics, Z, 13, Aristotle asserts that ‘no universal can be substance.’ The same is asserted in Met., I, 1053b16-17 cf. 1060b21. As James H. Lesher points out, Aristotle’s position is that ‘nothing predicated universally is a substance.’ 6) Universal in substance In Met., 10388b8-9 Aristotle says that no universal is a substance. While a universal cannot be a substance in the way essence (to ti en einai) is, it is, Aristotle asserts, ‘in’ it (ἐν τούτῳ δὲ ἐνυπάρχειν) (Met., Ζ, 1038b16-18). Aristotle’s examples are: animal in man and horse. A universal is ‘in’ the thing it is its universal. But in what sense a universal can be in a thing? It cannot be in it as ‘in a subject’, which is denied in Categories for secondary substances. If we check the senses of being in, we can find some other senses of ‘being in’ some of which are compatible with this sense of ‘being in.’ Michael J. Loux believes that contrary to his earlier works like Peri Ideaon and Organon in which the immanence of universals signals a reproduction of the platonic two worlds picture, in his later works like Physics and Metaphysics, when Aristotle tells us that universals are in particulars he means that they are ‘components of or ingredients in sensible particulars.’ In Metaphysics (Δ, 1014b3-9) Aristotle compares elements with universals and call them ‘the most universal things because elements are present either in all or in many things. 7) Logos is of universal Not only universals have logos (Met., Z, 1038b18-19) but ‘Every logos and every science is of universals and not of particulars.’ (Met., K, 1059b25-26) The reason is that they are the same: the logos of the unjiversal ‘circle’ is nothing but ‘being circle’ and the logos of the universal ‘soul’ is ‘being soul.’ (Met., Z, 1035b33-1036a2) The same is said about definition. (Met, Z, 1036a27-29) 8) Universal: in the soul Contrasting individuals, universals are in the soul (So., 3, 5, 417b22-23; cf. PsA., B, 19, 100a6-7). Aristotle also says that the form, i.e. the essence, of the artwork is in the soul. (met., Z, 1032a32-b2) Moreover, as Michael J. Loux points out, ‘the Peri Ideon tells us that we need universals to serve as the objects of noetic acts.’ 9) Universal: not beside individual In spite of the fact that demonstration creates the opinion that demonstrating is based on the existence of universals as existing among the existing things, they do not have existence besides individuals (PsA., A, 24, 85a31-35; Met, Λ, 1071a19-23). Aristotle believes that universals of a P-series (B203, 71) are not παρὰ τὰ εἴδη: 999a6ff. Also check De Anima, II, 3, 414b20-25 10) Primary or commensurate universal Aristotle distinguishes ‘πρῶτον καθόλού’ (PsA., B, 17, 99a33-35) literally meaning ‘primary universal’ but mostly, and truly, translated as commensurate universal. While a universal merely ‘μὴ ἀντιςτρέφει,’ a primary universal ‘ᾧ ἓκαςτον μὲν μὴ ἀντιςτρέφει’ (PsA., B, 17, 99a33-35). Aristotle mentions three conditions for a commensurate universal. It is an attribute that i) belongs to every instance of its subject (without exception!!!), and this belonging is ii) essentially and iii) qua that subject itself (ᾗ αύτό). (PsA., A, 4, 73b26-28) However, he insists that the second and the third conditions are indeed the same. (PsA., A, 4, 73b28-30) The first condition he paraphrases as ‘to belong to any random instance of that subject’ and the second and the third as ‘when the subject is the first thing to which it can be shown to belong.’ (PsA., A, 4, 73b32-74a3) Aristotle’s example is ‘the equality of its angles to two right angles’. This attribute is not a commensurate universal of figure due to the first condition: it cannot be demonstrated of any figure. Nonetheless, though it can be demonstrated of every isosceles because every isosceles has angles equal to two right angles, it is not a commensurate universal of isosceles due to the other conditions: it is not predicated of isosceles qua isosceles but qua triangle. These conditions seem to be like regulators: they organize everything to match to the right group. The method of finding commensurate universal is like test and error method based on elimination: you must eliminate each of the higher or lower universals and check if the attribute remains or not. The commensurate universal is that which remains in between eliminated universals. (cf. PsA., A, 5, 74a37-b4) Brad Inwoodpresents an understanding of commensurate universal that is different from what I have understood and, thus, must be checked: ‘These universals are propositions in which, for example, ‘all A are B’ is true and which are still true universal statements if converted: ‘all B are A’ is also true.’ -/- . Raimo Tuomela’s most important contribution to the philosophy of collective intentionality was his development of the notion of the we-mode. In my chapter I extend the notion of we-mode to that of role-mode, the mode in which individual and collective subjects feel, think and act as occupants of roles within groups and institutional structures. I focus on how being in role-mode is manifest in the minds of subjects and on the following points. First, I argue that both we-mode and role-mode (...) are best thought of as further modifications of I-consciousness, respectively we-consciousness. Second, role-mode is further characterized by the fact that subjects will take positions as role occupants that they won’t take as mere individuals, or we-mode group members, or in other roles. Third, such divergences are only possible against a background of agreements between positions taken in different modes. Fourth, such divergences are also grounded in decision making procedures and the accessibility and admissibility of sources of evidence. Fifth, role-mode goes all the way down, that is, it is also manifest in how subjects feel, move and comport themselves when they occupy their roles. Frege argued for the force-content distinction not only by appealing to the logical and fictional contexts which are most closely associated with the “Frege point", but also based on the fact that an affirmative answer to a yes-no question constitutes an assertion. Supposedly this is only intelligible if the question contains a forceless thought or proposition which an affirmative answer then asserts. Against this I argue that this fact more readily supports the view that questions operate on assertions and other (...) forceful acts themselves. Force is neither added to propositions as on the traditional view, nor is it cancelled as has recently been proposed. Rather higher-level acts such as questioning, but also e.g. conditionalizing, embed and present assertoric or directive acts that are forceful and committal, while suspending commitment to them. The Frege point confounds different varieties of force and the question whether something is merely presented for consideration with the question what is so presented. Force is representational: through assertoric and directive force indicators subjects non-conceptually present positions of theoretical or practical knowledge, while interrogative acts indicate positions of wondering which strive for such knowledge. In this paper I propose three steps to overcome the force-content dichotomy and dispel the Frege point. First, we should ascribe content to force indicators. Through basic assertoric and directive force indicators such as intonation, word order and mood, a subject presents its position of theoretical or practical knowledge of a state of affairs as a fact, as something that is the case, or as a goal, as something to do. Force indicators do not operate on truth- or satisfaction evaluable (...) entities as on the traditional view, but complete and unify them. Second, higher-level acts such as interrogative, logical and fictional acts create higher-level unities that may suspend commitment to the assertions and directions they operate on. But they do not cancel their force, but transfer the meaning of force indicators into the new unities they create. For example, in the context of asking a theoretical or practical question, the assertoric or directive force indicator now presents the kind of knowledge the subject is seeking. Third, the Frege point conflates different varieties of force. We neither need Frege’s assertion sign, nor Hare’s neustic, nor Hanks’s cancellation sign, but only ordinary force indicators and interrogative, logical and fictional markers. Propositions are not forceless contents to which a subject commits by forceful acts, but forceful acts put forward by higher-level acts which may suspend commitment to them. (shrink)

This article articulates a framework for normatively assessing influence operations, undertaken by national security institutions. Section I categorizes the vast field of possible types of influence operations according to the communication’s content, its attribution, the rights of the target audience, the communication’s purpose, and its secondary effects. Section II populates these categories with historical examples and section III evaluates these cases with a moral framework. I argue that deceptive or manipulative communications directed at non-liable audiences are presumptively immoral and illegitimate (...) for liberal states, as are deceptive operations aimed at an unjust end, or even operations aimed at a just end where secondary effects are forecast to be disproportionate to the proximate end. This essay develops a theory of identities, selves, and ‘the self’ that both explains the sense in which selves are narratively constituted and also explains how the self relates to a person's individual autobiographical identity and to their various social identities. I argue that identities are the contents of narratively structured representations, some of which are hosted individually and are autobiographical in form, and others of which are hosted collectively and are biographical in form. These identities, in turn, give rise (...) to selves of various sorts—true selves, autobiographical selves, public and private selves, merely possible selves, and so on—which are the characters (or presupposed subjects) that appear in our various identities. Although the theory I develop bears some obvious affinities with the view that selves are fictional characters, the two views are in fact distinct, for reasons explained at the end. (shrink)

To many, the idea of autonomous weapons systems (AWS) killing human beings is grotesque. Yet critics have had difficulty explaining why it should make a significant moral difference if a human combatant is killed by an AWS as opposed to being killed by a human combatant. The purpose of this paper is to explore the roots of various deontological concerns with AWS and to consider whether these concerns are distinct from any concerns that also apply to long-distance, human-guided weaponry. We (...) suggest that at least one major driver of the intuitive moral aversion to lethal AWS is that their use disrespects their human targets by violating the martial contract between human combatants. On our understanding of this doctrine, service personnel cede a right not to be directly targeted with lethal violence to other human agents alone. Artificial agents, of which AWS are one example, cannot understand the value of human life. A human combatant cannot transfer his privileges of targeting enemy combatants to a robot. Therefore, the human duty-holder who deploys AWS breaches the martial contract between human combatants and disrespects the targeted combatants. We consider whether this novel deontological objection to AWS forms the foundation of several other popular yet imperfect deontological objections to AWS. (shrink)

In this paper I outline the PAIR account of joint attention as a perceptual-practical, affectively charged intentional relation. I argue that to explain joint attention we need to leave the received understanding of propositions and propositional attitudes and the picture of content connected to it behind and embrace the notions of subject mode and position mode content. I also explore the relation between joint attention and communication.

There may be a limit on our capacity to suppress anthropocentric tendencies toward non-human others. Normally, we do not reach this limit in our dealings with animals, the environment, etc. Thus, continued striving to overcome anthropocentrism when confronted with these non-human others may be justified. Anticipation of super artificial intelligence may force us to face this limit, denying us the ability to free ourselves completely of anthropocentrism. This could be for our own good.

I propose a framework, derived from moral theory, for assessing the moral status of intelligent machines. Using this framework, I claim that some current and foreseeable intelligent machines have approximately as much moral status as plants, trees, and other environmental entities. This claim raises the question: what obligations could a moral agent (e.g., a normal adult human) have toward an intelligent machine? I propose that the threshold for any moral obligation should be the "functional morality" of Wallach and Allen [20], (...) while the upper limit of our obligations should not exceed the upper limit of our obligations toward plants, trees, and other environmental entities. Van Fraassen’s (1989) infamous best of a bad lot objection is widely taken to be the most serious problem that afflicts theories of inference to the best explanation (IBE), for it alleges to show that we should not accept the conclusion of any case of such reasoning as it actually proceeds. Moreover, this is supposed to be the case irrespective of the details of the particular criteria used to select best explanations. The best of a bad lot objection is predicated (...) on, and really only requires, the idea that in any real case of IBE where one hypothesis is favored as best over those with which it competes, it is always the case that it is more likely that the true explanation is to be found in the set of unformulated and unconsidered logical alternatives to the set of actually considered hypotheses. On this basis, Van Fraassen believes that accepting the conclusion of IBEs so understood is irrational and this is simply because such inferences are supposedly not probative. In this paper the best of a bad lot objection will be addressed and it will be shown that Van Fraassen’s notorious criticism of IBE depends on a problematic conflation of two notions of rationality and thus that his criticism of IBE involves a damning equivocation. In essence, he conflates ideal standards of rationality with epistemic standards of rationality and, in so doing, makes it appear to be the case that we should not accept the conclusions of IBEs. But, when we disambiguate the concepts of rationality at work in the argument Van Fraassen’s conclusion simply does not follow. (shrink)

I make what I believe is a spirited and lively treatment for the necessary abandonment of scientific materialist ontology in light of numerous difficulties that have arisen within the materialist approach when examined in the light of contemporary physics. Every effort is made to ensure that it is aimed at a non-specialized, intelligent audience (except for this abstract). Within this approach every attempt is made to avoid the jargon employed by specialists, which still remaining accurate. I make a case for (...) the abandonment of materialism in favor of a specific brand of idealism that fits with what cutting edge science requires at its epistemological foundation, but does not lead to disqualifying shortcomings that occasionally accompany some idealist prescriptions. I move from the suggested idealist remedy to how this idealism may mitigate aspects of the arrow of time dilemma. I also suggest this its employment in conjunction with holographic modeling may be especially efficacious in the contemporary scientific endeavor. (shrink)

In a recent paper, William Hasker has responded to a paper of mine criticizing his argument for theological incompatibilism. In his response, Hasker makes a small but important amendment to his account of freedom. Here I argue that Hasker’s amended account of freedom is false, that there is a plausible alternative account of freedom, and that the plausibility of this alternative account shows that Hasker’s argument for theological incompatibilism relies on a dubious premise.

I develop a contractualist theory of just intelligence collection based on the collective moral responsibility to deliver security to a community and use the theory to justify certain kinds of signals interception. I also consider the rights of various intelligence targets like intelligence officers, service personnel, government employees, militants, and family members of all of these groups in order to consider how targets' waivers or forfeitures might create the moral space for just surveillance. Even people who are not doing anything (...) prejudicial to other states' security can be modeled as ceding rights against diagnostic collection--light touch collection limited to ascertaining if someone is likely an intelligence threat--as part of their duty to support just foreign institutions. Foreign intelligence officers could not perform the same job potential targets can reasonably demand their intelligence agencies perform on their behalf without this ceding of rights. More invasive forms of collection can only be justified if officers can reasonably model their citizens consenting to being the target of the same sort of collection by adversary states. (shrink)

Case studies about institutional pressures encouraging dishonesty in the US Navy.

The distinction between the force/mode of speech acts and intentional states and their propositional content has been a central feature of analytic philosophy since Gottlob Frege and Bertrand Russell. In this introduction we present the distinction and its motivation and review some recent challenges to it that appeal to the problem of the unity of the proposition, in order to give the reader a sense of the current state of debate to which the contributions of this volume respond.

This article reviews an epochal change in international thinking about physical punishment of children from being a reasonable method of chastisement to one that is harmful to children and troubling to families. In addition, the article suggests shifts in thinking about physical punishment were originally pioneered as part and parcel of the dismantling of national laws granting fathers’ specific rights to admonish children under conventions of patria potestas. A comparative historical framework of analysis involving two case studies of Ireland and (...) Ghana illustrates non-unilinear pathways of international convergence towards the prohibition of physical punishment. The comparative historical analysis highlights the 1930s and 1940s as an era when Ireland began to reject patria potestas and religious or judicial rulings which allowed for children to be given ‘a good beating’ in family and school settings. However, from the same period, Ghana is seen to experience Christian remonstrations not to ‘spare the rod’ leading to the ‘conventional’ tradition of ‘this is how we do it here’. Two case studies serve to illustrate that banning physical punishment was less controversial in Ireland where allied traditions of patria potestas and disciplinarian Christian beliefs had lost their moral hegemony than in Ghana where such beliefs still held influence. The article concludes overall that normative campaigns against physical punishment of children emanate from a coherent paradigm of family policy where childcare, education, and well-being of children are embedded as everyday societal responsibilities rather than privatised or patriarchal familial obligations. I argue against the claim that it is trivial to state that Sidgwick used the method of wide reflective equilibrium. This claim is based on what could be called the Triviality Charge, which is pressed against the method of wide reflective equilibrium by Peter Singer. According to this charge, there is no alternative to using the method if it is interpreted as involving all relevant philosophical background arguments. The main argument against the Triviality Charge is that although the method of (...) wide reflective equilibrium is compatible with coherentism (understood as a form of weak foundationalism) as well as moderate foundationalism, it is not compatible with strong foundationalism. Hence, the claim that a philosopher uses the method of wide reflective equilibrium is informative. In particular, this is true with regard to Sidgwick. (shrink)

The suite of secretive national security programs initiated in the US since 9/11 has created debate not only about the merits of targeted killing, torture, secret detention, cyberwar, global signals intercepts, and data-mining, but about the very secrecy in which these programs were conceived, debated by government officials, and implemented. Law must be revealed to those who are expected to comply with its demands. Law is a mere pretext for coercion if the laws permitting the government to coerce people for (...) non-compliance are concealed. The purpose of this essay is to determine whether inhabitants of a liberal state—a type of state tracing the legitimacy of its coercive actions to the consent of the governed—also need to know the internal protocols and legal findings of the government agencies ostensibly serving them. To put this question another way, what, if anything, may government agencies in liberal states keep secret? (shrink)

How can the law be characterized in a theory of collective intentionality that treats collective intentionality as essentially layered and tries to understand these layers in terms of the structure and the format of the representations involved? And can such a theory of collective intentionality open up new perspectives on the law and shed new light on traditional questions of legal philosophy? As a philosopher of collective intentionality who is new to legal philosophy, I want to begin exploring these questions (...) in this paper. I will try to characterize the law in terms of the layered account of collective intentionality that I have introduced in some earlier writings (Schmitz 2013; 2018). In the light of this account I will then discuss a traditional question in the philosophy of law: the relation between law and morality. I begin by giving a brief sketch of the layered account in the next section. Collective intentionality should be understood in terms of experiencing and representing others as co-subjects, rather than as objects, of intentional states and acts on different layers or levels. I distinguish the nonconceptual layer of the joint sensory-motor-emotional intentionality of joint attention and joint bodily action, the conceptual level of shared we-mode beliefs, intentions, obligations, values, and so on, and the institutional level characterized through role differentiation, positions taken in role-mode, e.g. as a judge or attorney, and writing and other forms of documentation. In the third section I introduce a set of parameters for representations such as their degree of richness, of context-dependence, of density and differentiation of representational role and of durability and stability, which can be used to more precisely distinguish different layers. I also put forward the hypothesis that these properties are connected and tend to cluster, and that higher levels can only function and determine conditions of satisfaction against lower level ones. In the fourth and final section I critically discuss the sharp positivistic separation of morality and the law according to which whether something is a law is completely independent of its moral merits. I argue that this only seems plausible if we take an observational stance towards the law, but not towards morality. When we treat them the same way, it rather appears that the moral attitudes of the co-subjects of a society will determine whether and to what extent they will accept its legal order. I conclude by proposing to think of the law as being itself an institutionalized form of morality. (shrink)

This effort attempts to evaluate the claims of Daryl Bem and Dean Radin regarding psi research, in a manner that should lend itself accessible to a non-specialist, intelligent reader. Admitting the difficulties that claims of psi create in the philosophy of science, it examines in particular the work of Bem and his methodologies in light of contemporary research and its requirements. Briefly examining more than a dozen complaints about his findings, no compelling evidence was discovered that would adequately invalidate his (...) results. Evidence from Radin from his met-analyses of psi research in conjunction with other reputable sources were included. (shrink)

In diesem Aufsatz argumentiere ich, dass die Standardauffassung von Propositionen und propositionalen Einstellungen inadäquat ist, ein Artefakt der gegenwärtig herrschenden theorielastigen Auffassung von Intentionalität, Sprache und Rationalität, und skizziere eine alternative Auffassung. Im folgenden Abschnitt belege ich erst einmal die These der Theorielastigkeit anhand einiger Beispiele vor allem aus der gegenwärtigen analytischen Philosophie. Der dritte Abschnitt erklärt, wie diese Theorielastigkeit im Standardverständnis von Propositionen und propositionalen Einstellungen verkörpert ist. Im vierten Abschnitt argumentiere ich, dass dieses Standardverständnis der Proposition zwei unvereinbare (...) Rollen zuweist. Sie kann nicht sowohl einen Sachverhalt repräsentieren, der Gegenstand praktischer genauso wie theoretischer Stellungnahmen sein kann, als auch wie eine theoretische Stellungnahme Wahrheitswertträger sein. In den folgenden Abschnitten versuche ich eine partielle Diagnose, wie es zu dieser Auffassung kommen kann: gewisse Formen der Neutralisierung von Stellungnahmen durch das bloße „in den Raum stellen“ (fünfter Abschnitt), durch fiktionale Kontexte (sechster Abschnitt) und den Kontext logischer Verknüpfungen (der so genannte „Frege-Punkt“; siebter Abschnitt) werden verwechselt mit der Neutralität zwischen dem Praktischen und Theoretischen, zwischen Wollen und Wahrheit, die die Standardauffassung erfordern würde. Der achte Abschnitt skizziert in groben Umrissen ein alternatives Bild. Demnach wird eine Repräsentation eines Sachverhalts erst durch die dazu kommende theoretische oder praktische Position zu einer Stellungnahme und damit zum Träger eines Erfüllungswerts. Die Bereiche des Praktischen und des Theoretischen sind parallel strukturiert und unterschieden sich im Wesentlichen nur durch die Verschiedenheit der Passrichtungen. Grundlegende rationale Operationen wie Deduktion, Abduktion und Induktion können auf praktischen Stellungnahmen genauso ausgeführt werden wie auf theoretischen. Im neunten Abschnitt verorte ich die tieferen Wurzeln der Theorielastigkeit in dem Verlangen, das Praktische an die dem Theoretischen eigene Form der Objektivität zu assimilieren. Dieses Verlangen muss aber fruchtlos bleiben, und die dem Praktischen eigene Form der Objektivität wird so verfehlt. Der letzte Abschnitt deutet an, wie sich Werturteile in dem skizzierten Rahmen deuten lassen. (shrink)

Abstract. The dissertation defends the thesis that the mind-body problem arises against the background of the elimination of the manifest physical world, and that the only satisfactory response to it is to take back that elimination and thus to dissolve the problem. Various materialist and dualist responses are shown to be inadequate. They are only different forms of ontological fundamentalism – physics fundamentalism and consciousness fundamentalism – that lead to ultimately meaningless metaphysical constructions. By contrast, on the ontologically pluralist view (...) outlined here, the fact that the entire spatiotemporal world has a physical microstructure is compatible with a naive realism with regard to both the manifest physical world and to consciousness. We only need to ascribe physical microstructures to both while identifying neither with these structures. After an introduction that identifies the elimination of the manifest physical world in modernity as the metaphysical background of the mind-body problem and describes the dilemmatic situation created by the typical reactions to it, the first chapter attempts to clarify what consciousness is. The second chapter then discusses some of the standard formulations of the so-called “puzzle” or “mystery” of consciousness. It is shown that these cannot be transformed into a genuine, answerable question. The notion that other macrophenomena can be explained much better than consciousness, perhaps even in a completely transparent way, is revealed to be an illusion, an artefact of the tacit elimination of the manifest physical world. In the third chapter, the thesis that consciousness has spatial properties is defended against various forms of skepticism. The fourth chapter begins the debate with the mind-body identity theory by discussing various positions on identity statements in the philosophy of language. This discussion leads to the conclusion that the idea of informative identity statements is meaningless. On this basis, the notion of an empirically contentful so-called “scientific identification” of consciousness phenomena with their neuronal correlates is criticized in the fifth chapter. The sixth chapter argues that it is possible to dissolve the problem of mental causation if a physiological and ultimately also a microphysical structure is ascribed to consciousness. In a concluding reflection it is explained what it means that the present suggestion amounts to a dissolution rather than a solution of the traditional mind-body problem. Zusammenfassung. In dieser Arbeit wird die These vertreten, dass das Leib-Seele- Problem vor dem Hintergrund der Elimination der manifesten physischen Welt entsteht und die einzig befriedigende Reaktion darauf nur sein kann, diese Elimination wieder rückgängig zu machen und das Problem damit aufzulösen. Materialistische und dualistische Reaktionen werden als unzulänglich erwiesen. Sie sind nur verschiedene Formen eines ontologischen Fundamentalismus – Physikfundamentalismus und Bewusstseinsfundamentalismus – der zu letztlich sinnlosen metaphysischen Konstruktionen führt. Dagegen ist nach dem hier vertretenen ontologischen Pluralismus die Tatsache, dass die gesamte raumzeitliche Welt eine physikalische Mikrostruktur hat, mit einem naiven Realismus sowohl in Bezug auf die manifeste physische Welt als auch in Bezug auf das Bewusstsein vereinbar. Wir müssen nur beiden eine physikalische Mikrostruktur zuschreiben ohne sie mit dieser zu idenfizieren. Nachdem in der Einleitung die Elimination der manifesten physischen Welt in der Neuzeit als der metaphysische Hintergrund des Leib-Seele-Problems identifiziert und die durch die typischen Reaktionen darauf entstehende dilemmatische Aus- gangssituation beschrieben worden ist, klärt das erste Kapitel, was Bewusstsein ist. Im zweiten Kapitel werden dann einige gängige Formulierungen des so genannten „Bewusstseinsrätsels“ vorgestellt. Es wird gezeigt, dass diese sich nicht in eine wirklich beantwortbare Frage transformieren lassen. Die Vorstellung, dass sich andere Makrophänomene wesentlich besser erklären lassen als das Bewusstsein, oder gar in vollständig transparenter Weise, wird als Illusion, als Artefakt der stillschweigenden Elimination der manifesten Welt erwiesen. Im dritten Kapitel wird die These, dass das Bewusstsein räumliche Eigenschaften hat, gegen verschiedene Formen der Skepsis verteidigt. Im vierten Kapitel beginnt die Auseinandersetzung mit der Identitätstheorie mit einer Diskussion sprachphilosophischer Positionen zu Identitätsaussagen, die die These begründet, dass die Vorstellung informativer Identitätsaussagen sinnlos ist. Auf dieser Grundlage wird im fünften Kapitel die Vorstellung einer empirisch gehaltvollen so genannten „wissenschaftlichen Identifikation“ von Bewusstseinsphänomenen mit ihren neuronalen Korrelaten kritisiert. Im sechsten Kapitel wird gezeigt, dass sich das Problem mentaler Verursachung auflösen lässt, wenn man Bewusstseinsphänomenen eine physiologische und letztlich auch physikalische Mikrostruktur zuschreibt. In einer Schlussbetrachtung wird erläutert, warum der Vorschlag in dieser Arbeit eine Auflösung statt einer Lösung des Leib-Seele-Problems darstellt. (shrink)

In seiner vielfältigen Gestalt dient er als Ausgangspunkt, um den Hintergrund der europäischen Kultur zu erkunden.

The following proposes an interpretation of Husserl's sustained exegetical commentary on Leibniz's metaphysics from 1922 (Hua XIV 298300), with reference to textual and historical resources. The leading historical index for the following interpretation is a minor contribution to Leibniz scholarship from 1917 by Dietrich Mahnke, a work with which Husserl was intimately familiar. Textual references are to works by Husserl which would have been available to Mahnke- i.e., the Logische Untersuchungen and Ideen—I as well as relevant notes and lectures from (...) the period ni question. Husserl's brief manuscript from 1922, I claim, can be read as a critique of the Mahnke interpretation that attempts to provide a more expansive and thorough-going phenomenological explication of Leibniz' doctrine of universal harmony. Thereby, Husserl offers some important clues as to how he himself understands his own uses of the terms "monad" and "monadology." The phenomenological reformation of Leibnizian Monadology must be understood as a methodological reconception with internal reference to Husserl's own theory of intersubjectivity. (shrink)

This chapter will develop standards for assessing individual moral responsibility for collective action. In some cases, these standards expand a person’s responsibility beyond what she or he would be responsible for if performing the same physical behavior outside of a group setting. I will argue that structural differences between two ideal types of groups— organizations and goal- oriented collectives— largely determine the baseline moral responsibility of group members for the group’s collective action. (Group members can be more or less responsible (...) for collective action beyond that baseline due to personal qualities like knowledge of the intended collective outcome.) The same individual physical behavior can make the member of a goal-oriented collective responsible for the entire collective action to an equal degree with her fellow group members, whereas the typical organization member is only responsible for his contributory action. The article assesses different models of professional ethics and develops a model which sees professional imperatives as the institutionally-guided expression of foundational moral principles. This article uses the model to assess the moral pressures placed on interrogators in undercover operations in which a detective poses as a suspect in pre-arraignment holding. While highly effective, the level of empathetic rapport required risks incurring compassion fatigue and burn out on the part of detectives.

An assessment of Martha Nussbaum's capabilities approach with respect to religion. I contend that her contribution to John Rawls's project of political-liberalism would be less accommodating of religion, specifically illiberal religions, than it desires to be. This feature weakens the capabilities approach as a foundation for inclusive and stable political institutions in pluralistic societies.

This paper will address the moral implications of non-coercive interrogations in intelligence contexts. U.S. Army and CIA interrogation manuals define non-coercive interrogation as interrogation which avoids the use of physical pressure, relying instead on oral gambits. These methods, including some that involve deceit and emotional manipulation, would be mostly familiar to viewers of TV police dramas. As I see it, there are two questions that need be answered relevant to this subject. First, under what circumstances, if any, may a state (...) agent use deception or manipulation in the course of his or her duties? Second, if there are classes of persons who, by their activities, lose a legitimate expectation for honest-dealing, how are state agents to proceed when the identity of such persons is unclear? This chapter addresses the morality of two types of national security electronic surveillance (SIGINT) programs: the analysis of communication “metadata” and dragnet searches for keywords in electronic communication. The chapter develops a standard for assessing coercive government action based on respect for the autonomy of inhabitants of liberal states and argues that both types of SIGINT can potentially meet this standard. That said, the collection of metadata creates opportunities for abuse of power, and so judgments about the trustworthiness and competence (...) of the government engaging in the collection must be made in order to decide whether metadata collection is justified in a particular state. Further, the moral standard proposed has a reflexive element justifying adversary states’ intelligence collection against one another. Therefore, high-tech forms of SIGINT can only be justified at the cost of justifying cruder versions of signals intelligence collection practiced by a state’s less-advanced adversaries. (shrink)

A brief overview of the Christian just war tradition, with case studies.

This article discusses the rights enjoyed by irregular combatants in detention, that is, members of organized groups (who may be fighting an insurgency or engaging in terror attacks) who fail to qualify for POW status. The paradigmatic example of such a detainee would be an al-Qaeda agent.

Mark Coeckelbergh starts his book with a very powerful picture based on a real incident: On the 9th of January 2020, Robert Williams was wrongfully arrested by Detroit police officers in front of his two young daughters, wife and neighbors. For 18 hours the police would not disclose the grounds for his arrest (American Civil Liberties Union 2020; Hill 2020). The decision to arrest him was primarily based on a facial detection algorithm which matched Mr. Williams’ driving license photo with (...) the picture of a man who was suspected of watch theft two years earlier. Not only did the computer ‘get it wrong’ as one of the detectives said, when Mr. Williams made them aware that the picture of the suspect obviously wasn’t resembling him, the probably unreliable algorithm very likely contributed to racial discrimination (Hill 2020). It is well documented that many available facial detection algorithms at this time had significant problems (e.g. a comparably high false positive rate) with respect to black persons, like Mr. Williams (NIST 2019). Multiple causes may exist, such as unbalanced training datasets and insufficient optimization. Coeckelbergh compares the disturbing case of Mr. Williams with a political interpretation of Franz Kafka’s The Trial, where the protagonist, Josef K., is accused of an unspecified crime by an opaque, oppressive and absurd bureaucracy: “In the 21st-century United States, Josef K. is black and is falsely accused by an algorithm, without explanation” (p. 2).
