The field of Latin American philosophy has established itself as a relevant subfield of philosophical inquiry. However, there might be good reasons to consider that our focus on the subfield could have distracted us from considering another subfield that, although it might share some geographical proximity, does not share the same historical basic elements. In this paper, I argue for a possible and meaningful conceptual difference between Latin American Philosophy and Indigenous philosophy produced in Latin America. First, I raise what (...) I call Mariátegui’s Solidarity Challenge to show that there might be some neglectful treatment of the philosophical views of different Indigenous groups. I then depart from Mariátegui and engage in a critical exercise to show that even he would be guilty of failing in his own solidarity demands. I follow that by drawing out some implications of the argument. I first sketch how this differentiation would play out against the political project of “Mestizaje,” a project that seems to inform some of the Latin American philosophical tradition. I then speculate about the kinds of duties that the field of Latin American philosophy might have towards the field of Indigenous Philosophy produced in Latin America. (shrink)

From our perspective, we believe that it is necessary to abandon the idea that all those who suffer from SI or SA are mentally ill, which causes them to be stigmatized and subjected to psychiatric treatment, when what they need is a different vision of life as well as adaptive strategies to employ a new philosophy. Public policies should consider implementing programs that reinforce cognitive flexibility in addition to character strengths.

Francisco Sanches (1551–1623) was an important figure in the history of philosophical scepticism, and most specifically in the later sixteenth and early seventeenth century. Sanches gained notoriety through his controversial text, That Nothing is Known. His skeptical ideas concerning what could be known of the phenomenal world, influenced the work of other philosophers like René Descartes. In fact, in the last twenty-five to thirty years, his work has at last been acknowledged as having served as a background source of Descartes’ (...) refutation of scepticism. Sanches was not only a philosopher; he was also a physician, and a professor of medicine – a fact that doubtlessly tempered his scepticism. In recent years, there has been a growing interest in Sanches, as he has come to be seen as a significant philosopher in the history of scepticism, along with Montaigne, Descartes, and Hume. Some contemporary thinkers have gone as far as comparing his notion of language and metaphysics to that of someone like Wittgenstein. (shrink)

This paper explores various notions of aesthetic affordance recently developed through embodied, situated and enactive approaches to aesthetic experience by Maria Brincker and Shaun Gallagher, and the similarities and differences between them and the idea of affective affordance put forward by Joel Krueger and Giovanna Colombetti. This discussion is a way to try to offer some answers to the question of what aesthetic affordances particularly afford compared to affective affordances. I will focus on the affordances that we perceive during various (...) aesthetic experiences in which we find ourselves more moved by the object, event or person(s) causing the experience than we had anticipated. I will argue that these experiences emerge as opportunities to carry out an active exploration of aspects of the narrative self that we feel is related to features of the experience; and that one particular brain network likely to be involved in these experiences – i.e. the default network – might help us to understand how these experiences meaningfully change our relationship with ourselves and with the social context of which we are a part. En el presente trabajo intentaré ofrecer un análisis crítico de la teoría de la justicia, que comprende tanto la redistribución como el reconocimiento. Para dicho objetivo, en principio, retomaré los ejes centrales del debate entre Fraser y Honneth en torno a la teoría crítica de la justicia, para luego ponerlos en juego con una lectura de la teoría de la justica ensanchada de Kant. Mostraré que a partir del dualismo de Kant, que comprende una doctrina del derecho y una doctrina (...) de la virtud, se puede avanzar en distintas formas de abordar la justicia social, sin reducir una a la otra. Apoyaré esta tesis en una lectura republicana de la justicia kantiana, por una parte, y en una lectura de la ética política kantiana a partir de los deberes de virtud y la comunidad ética, por la otra. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that (...) we must think of the value of epistemic states as consisting in more than simply accuracy. Recent years have seen a heightened focus on the study of minimal forms of awareness during sleep to advance the study of consciousness and understand what makes a state conscious. This focus draws on an increased interest in anecdotical descriptions made by classic Indian philosophical traditions about unusual forms of awareness during sleep. For instance, in the so-called state of witnessing-sleep or luminosity sleep, one is said to reach a state that goes beyond ordinary dreaming and abide in a state (...) of just awareness, a state in which one is not aware of anything else other than one’s own awareness. Moreover, for these traditions, this state is taken to be the essence or background of consciousness. Reports on such a state opens the door to exciting new lines of research in the study of consciousness, such as inquiry into the so-called “objectless” awareness during sleep—states of awareness that lack an ordinary object of awareness. In this two-staged research project, we attempted to find the phenomenological blueprints of such forms of awareness during sleep in 18 participants by conducting phenomenological interviews, informed by a novel tool in qualitative research, the micro-phenomenological interview (MPI) method. Following a phenomenological analysis, we isolated a similar phase across 12 reported experiences labelled as ‘nothingness phase’ since it described what participants took to be an experience of ‘nothingness’. his common phase was characterised by minimal sense of self—a bodiless self, yet experienced as being ‘somewhere’—, the presence of non-modal sensations, relatively pleasant emotions, an absence of visual experience, wide and unfocused attention, and an awareness of the state as it unfolded. Subjective rights enjoy limited import in Kelsenian theory for whereas the concept of duty underlies every legal norm, that of rights is merely possible and only emerges when the imposition of the sanction attached to the breach of the duty is made dependent upon a subject's will to bring legal action. The presence of secondary norms establishing certain duties of medical professionals on informed consent displays the existence of correlative reflex rights of patients. Yet, together with secondary norms, Western legal (...) systems typically institute norms of competence enabling patients to take legal action when those duties correlative to their reflex right to informed consent have been infringed. Thus, informed consent constitutes a set of subjective legal positions of patients and medical professionals. Despite its excessive formalism and questionable neutrality, the Kelsenian approach permits to define and clearly distinguish patients' genuine rights from mere aspirations devoid of legal basis. El primero tiene que ver con el concepto de imagen y la interpretación sobre el cine que ya venía siendo una constante —aunque marginalmente— en estas clases de Deleuze. Seguidamente, el segundo momento tiene que ver con la relación entre poder y resistencia que arroja como resultado una interpretación del pensamiento de Foucault por parte de Deleuze como (...) una obra viva y en constante construcción. En el presente trabajo se aborda críticamente la concepción de igualdad en la institución del matrimonio en Kant. Argumentaré que dicha igualdad no se sostiene si consideramos al sexismo y a la homofobia en los que incurre Kant en sus escritos jurídicos, éticos y antropológicos. En cambio, propondré repensar la institución del matrimonio al retomar, por un lado, las críticas al sexismo y la homofobia en el pensamiento kantiano, y por otro lado, al considerar la idea del reconocimiento ético y (...) jurídico en su pensamiento maduro. This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. En este trabajo nos proponemos contribuir a demostrar como el sistema crítico kantiano se manifiesta en el Anuncio de la próxima conclusión de un tratado de paz perpetua en la filosofía, y cómo este opúsculo contribuye a dilucidar la doctrina de la sabiduría en relación a la razón práctica como fin último de la humanidad. Para nuestro propósito, primero, abordaremos el estado de guerra en que se encuentra el estatus de la filosofía. Segundo, exploraremos el método de la filosofía crítica (...) para asegurar una metafísica posible. Tercero, focalizaremos en la prioridad práctica de la filosofía y en el fin último de la humanidad entendido como bien supremo. Finalmente, expondremos cómo las tesis desarrolladas junto a dos preocupaciones morales de Kant, la naturaleza de la filosofía y la humanidad, nos conducen hacia la idea del progreso y a la esperanza de una paz perpetua. El objetivo del presente artículo es evaluar la posición de Kant sobre la relación entre la autoridad política y la felicidad, poniendo el foco en la declaración que realiza en Teoría y Praxis sobre la posibilidad de que el poder supremo jurídico dirija sus leyes a la felicidad. Esto parece contradecir uno de los principios nodulares de su doctrina del derecho, a saber, que el poder político tiene como límite la legislación jurídica sobre concepciones privadas del bien y de la (...) felicidad. Por ello, para dar solución a la aparente contradicción, en primer lugar, introduciré dicho problema a la luz de la distinción kantiana entre el derecho y la ética. Luego, argumentaré que Kant adopta una posición anti-eudaimonista política, y propondré que las leyes de las que aquí habla no están dirigidas a la “felicidad”, que es un principio privado y subjetivo, sino a la salus publica, que se entiende como la conservación de la constitución del Estado. Por último, consideraré que este “bienestar público” debe ser garantizado por el derecho no sólo con respecto a lo que sucede al interior del Estado, sino también más allá de sus fronteras. (shrink)

Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Diversas fuentes culturales explican los orígenes del marcado individualismo imperante en nuestras sociedades actuales. Posiblemente, una de las manifestaciones más aclamadas de este individualismo sea la primacía de la autonomía individual, elemento clave en la articulación y fundamentación de las posiciones jurídicas subjetivas presentes en la práctica totalidad de los ordenamientos jurídicos contemporáneos, y como resultado de la expansión de la cultura occidental. Sin embargo, en ocasiones, el peso otorgado a la autonomía se antoja desproporcionado, especialmente cuando conduce a la (...) inobservancia, ya sea total o parcial, del bien común o alguna de sus manifestaciones, presupuesto de toda relación social y exigencia del principio de justicia. Junto a la autonomía, en tanto que elemento necesario para el florecimiento individual, la búsqueda del bien común debe asimismo servir a la configuración de los diversos instrumentos de decisión política y jurídica que regulan la vida en común, lo que requiere el justo equilibrio de los intereses en juego, tal y como aconseja el principio de proporcionalidad. El paradigma de las enfermedades contagiosas proporciona un claro ejemplo de lo anterior, pues la protección de la salud pública, entendida como una manifestación del bien común, no solo justifica, sino que incluso exige la restricción de ciertas posiciones jurídicas subjetivas que sirven a la especificación de la autonomía individual de sus titulares. The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

Concebir los derechos como una protección no-paternalista de los intereses de sus titulares supone aceptar que su aspecto más relevante consiste en la provisión de una competencia para renunciar o consentir su inobservancia por terceros, lo cual no tiene por qué coincidir con la mejor estimación de sus intereses, aun cuando estos últimos juegan un papel importante en la justificación de las posiciones jurídicas implicadas. A partir de la tesis de la correlatividad, los conceptos jurídicos fundamentales de W.N. Hohfeld y (...) una tesis de la combinación que armoniza los elementos de la voluntad e interés en la explicación de los derechos, en el presente artículo se tratará de mostrar por qué afirmar el carácter inalienable de los derechos contradice la función que estos desempeñan en los ordenamientos jurídicos modernos. // The understanding of rights as non-paternalistic protections of its holder’s concerns entails that the most important aspect of them is the provision of a power either to waive or to consent their encroachment by others, which does not necessarily coincide with the best appraisal of his/her interests, even when they play an important role in the justification of the subjective legal positions. From the correlativity thesis, the fundamental legal conceptions devised by W.N. Hohfeld and a combination thesis that merges the elements of will and interest in the explanation of rights, I will try to show why to stand up for the inalienable character of rights contradicts the function they perform in modern legal systems. Originally formulated as a theory of perception, ecological psychology has shown in recent decades an increasing interest in language. However, a comprehensive approach to language by ecological psychology has not yet been developed, as there is neither a naturalist philosophy of language nor one that takes ecological psychology as its scientific background. Our goal here is to argue that a subject naturalist and non-factualist framework can open the possibility of an expressivist analysis of perceptual judgments that is compatible with the (...) ecological understanding of perception, showing that such utterances do not work as descriptions of facts or states-of-affairs, but rather say something about the practical requirements necessary to display a perceptual vocabulary. We will also argue that this approach allows an understanding of perceptual content as clusters of socially-mediated affordances. If our proposal is sound, it would constitute a first and fruitful approximation toward establishing a naturalist link between embodied cognitive science and philosophy of language. (shrink)

The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. A partir de los postulados de una concepción semántica de norma y su clasificación en reglas y principios, Robert Alexy ha enunciado una tesis fuerte de la separación, al concebir que entre ambos tipos de normas no solo existe una diferencia gradual, sino también cualitativa. En este contexto, los principios son descritos como mandatos de optimización, caracterizados por un cumplimiento gradual en atención a las posibilidades reales y jurídicas, y a través de la denominada técnica de la ponderación. A pesar (...) de las objeciones recibidas, la vigencia de esta tesis resulta incuestionable, sirviendo todavía de inspiración a las nuevas generaciones de juristas interesados en la Teoría del Derecho. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

El consentimiento informado del paciente se inserta en el ámbito de su autonomía decisoria. Aunque presenta un sustrato corporal, este aparece combinado con elementos de índole moral que presuponen una noción concreta de persona como libre y autónoma. Tanto de las definiciones doctrinales como del material normativo se desprende que se trata de una posición jurídica subjetiva del paciente, alternativamente calificada como una “pretensión” o “derecho subjetivo en sentido estricto”, en términos hohfeldianos; un “derecho negativo de defensa”, o una “inmunidad”. En España, el Tribunal Constitucional ha vinculado el consentimiento informado del paciente al derecho fundamental a la integridad física y moral (15 CE), lo cual permite plantear el análisis en clave iusfundamental. Con todo, se advierten dudas e incompatibilidades entre la explicación habitual del consentimiento informado, su fundamento constitucional y su regulación jurídica. El objetivo del presente libro consiste en proporcionar una definición integral del consentimiento informado como derecho subjetivo del paciente y como manifestación de un derecho fundamental, a partir de una óptica poliédrica que aporta certeza en la práctica asistencial y jurídica. // The patient's right to informed consent is inserted within the scope of his decisional autonomy. Although it has a bodily background, it is combined with features of moral nature, which presupposes a concrete notion of the person as free and autonomous. Both, doctrinal approaches and normative legal material show that it is a subjective legal position of the patient, being alternatively qualified as a Hohfeldian “claim” or a “subjective right in a strict sense”; a "negative right" or an "immunity." The Spanish Constitutional Court has linked the informed consent of the patient to the fundamental right to physical and moral integrity (15 CE), which allows us to propose a fundamental rights-based analysis. Nonetheless, doubts and inconsistencies are perceived between the customary explanation of informed consent, its constitutional foundation and its legal regulation. The aim of this book is to provide a comprehensive definition of informed consent as subjective right of the patient and expression of a fundamental right, from a multi-fold perspective that provides certainty in both legal and health care practice. A widespread Western conception about the sanctity of the human body and its parts prevents from any morally acceptable disposition of these objects. However, this entails nothing but a dualistic conception of the human being as a composite of detachable parts — namely, body and mind. Understood as the antechamber of legal rights, moral rights perform an important — yet frequently overlooked — justifying function that permeates the political discourse. Although the connection among moral, political and legal discourses should be (...) properly acknowledged, certain boundaries are to mediate among each scope for the sake of certainty and accuracy. Intermediate realities, as the so-called human rights, serve to connect the moral and legal domains, still they also blur the lines along which the discourse is deployed. Moral entities are essentially inalienable, to the extent that they demarcate the moral status of the subject. By contrast, legal rights are essentially negotiable and, thus, alienable. The controversial instance of bodily rights will serve to test the assertions above. (shrink)

Jellinek define “estatus” como la “relación con el Estado que califica al individuo”. Su teoría distingue cuatro tipos: pasivo o subiectionis, negativo o libertatis, positivo o civitatis y activo o de la ciudadanía activa. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. La cuestión versa sobre la posición de los derechos de defensa en la tesis de Jellinek y si es viable su empleo en la conceptualización de los actuales derechos fundamentales. (shrink)

This dissertation focuses on teleology and functions in biology. More precisely, it focuses on the scientific legitimacy of teleofunctional attributions and explanations in biology. It belongs to a multi-faceted debate that can be traced back to at least the 1970s. One aspect of the debate concerns the naturalization of functions. Most authors try to reduce, translate or explain functions and teleology in terms of efficient causes so that they find their place in the framework of the natural sciences. Our approach (...) here is radically different, as we question the premise that teleological explanations are disguised causal explanations. On the contrary, we defend that they are acceptable in natural sciences and in biology in particular. We challenge the idea that teleological explanations are immature causal explanations, as well as the idea that teleology and functions are some sort of intentional explanations. We therefore reject the accusations of anthropomorphism, vitalism and finalism. On the contrary, we defend that teleology, causality and intentionality correspond to different, autonomous and complementary modes of representation of the outside world. -/- ———[FRANÇAIS]——— -/- Ce travail de thèse porte sur la téléologie et les fonctions en biologie. Plus précisément, il porte sur la légitimité scientifique des attributions et des explications téléofonctionnelles en biologie. Il s’inscrit dans le cadre d’un débat à plusieurs facettes que l’on peut faire remonter au moins jusqu’aux années 1970 et qui est encore très actif aujourd’hui. L’un des aspects du débat porte sur la naturalisation des fonctions, c’est-à-dire sur la manière de les réduire, de les traduire ou de les expliciter en termes de causes efficientes de sorte qu’elles trouvent leur place dans le cadre des sciences de la nature. Notre approche ici est radicalement différente, car nous remettons en question la prémisse selon laquelle les explications téléologiques seraient des explications causales déguisées. Nous défendons au contraire qu’elles sont acceptables en tant que telles aussi bien de façon générale que dans le domaine scientifique et en particulier en biologie. De façon générale, nous remettons en question l’idée selon laquelle la pensée téléologique serait une pensée causale immature, ainsi que sa dépendance présumée vis-à-vis de la psychologie, c’est-à-dire de l’intentionnalité. Nous rejetons donc les accusations d’anthropomorphisme, de vitalisme et de finalisme formulées contre elle. Nous défendons au contraire que la téléologie, la causalité et l’intentionnalité correspondent à des modes différents, autonomes et complémentaires de représentation du monde extérieur. (shrink)

Is the boundary between the normal and the pathological real or fiction? Are health and disease just a matter of fact or are they value-laden? Here we present some examples of how alleged diseases can be invented and propagated by the industry (disease mongering) or by the methodology of medical science itself. We show that the boundary between health and disease is blurred and depends on individual and social representations, culture relative ways of categorising things and people, and by the (...) society’s degree of medicalisation. However, we do not mean that it is not real, rather that it is more complex than expected, as the subjectivity of social constructions and individual experiences makes them no less real. Finally, we conclude that health and disease belong to both objective and subjective kinds of reality, so the fictional can be real. (shrink)

A xurisprudencia constitucional española (STC 37/2011, de 28 de marzo, entre outras) ten establecido como fundamento do consentimento informado o dereito á integridade física e moral (art. 15 CE). O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. Entre las virtudes de la explicación de Gewirth, destaca su potencial para delimitar el objeto de los derechos humanos y contener la expansión incontrolada del discurso de los derechos. Al ceñirse al contexto de la acción y a los rasgos necesarios para la agencia intencional, dicha explicación proporciona un fundamento basado en la autonomía y libertad de los agentes intencionales prospectivos, tan solo limitadas por aquellas exigencias racionales derivadas de la igual consideración del status moral de todos los demás agentes (...) intencionales prospectivos quienes, en última instancia, se identifican con la humanidad en su conjunto mediante las ideas implícitas de reciprocidad y responsabilidad moral por los actos propios. En definitiva, el argumento de Gewirth desemboca en el PCG para proporcionar un fundamento racional de los derechos humanos limitado a la estructura normativa de la acción, la agencia intencional prospectiva potencial o actual de todos los seres humanos y los bienes necesarios para la acción intencional: la libertad y el bienestar. El imperativo cultural de la monogamia impregna toda la arquitectura jurídica del Estado y, al mismo tiempo, la excede, saturando las relaciones sociales de formas no siempre evidentes. A partir de ese presupuesto, este trabajo se centra, geográficamente, en Brasil y, temporalmente, en el contexto abierto por la pandemia de covid-19, con el objetivo de defender la hipótesis de que la monogamia se ha visto reforzada en cuanto principio organizador del campo de la sexualidad y de las relaciones de parentesco (...) durante el episodio pandémico. El análisis propuesto pretende alertar, además, sobre las formas en que las normas de excepción implementadas durante las crisis pandémicas se sedimentan en el cuerpo social, pasando así a formar parte constitutiva del orden público. Architecture and human-built structures are embedded with speciesist practices of domination over the environment, where humans are considered special and superior to other species. This (hu)man exceptionalism has driven architecture and the built environment to be conceived in opposition to ‘nature’, dominating natural terrains and consequently displacing or instrumentalizing the many other species that are given little to no ethical consideration. This way of intervening in the world is leading to the existential questions that must be posed given our global (...) climate crisis. A reframing of human intervention as ‘built environment’ placed in opposition to the ‘natural environment’ of supposedly passive nature, is urgently needed. The motivation for this paper is rooted in a deep concern for the role of humans in the climate crisis and a realization that architecture as a discipline is complicit in elevating the human category above all other beings in nature. There are biases embedded in the practices and teaching of architecture that need to be interrogated and reflected upon, starting with the role models and ideals that we unwittingly operate within. To contextualize the idea of human exceptionalism in architecture, we will explore deep-seeded ideals in architecture linked to the concept of Rectitude as a form of ‘rightness’ -or correct- mode of intervening in the world, conceptualized by Western men as a human-centric practice distinct from nature-made. Supported by Ecofeminist thought, the aim is to open alternative models for world-building and housing humans on earth living in its sixth extinction. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. We explore solutions to mitigate the inconsistency. (shrink)

Materialism has been the subject of extensive and rich controversies since Robert Boyle introduced the term for the first time in the 17th century. But what is materialism and what can it offer today? The term is usually defined as the worldview according to which everything real is material. Nevertheless, there is no philosophical consensus about whether the meaning of matter can be enlarged beyond the physical. As a consequence, materialism is often defined in stark exclusive and reductionist terms: whatever (...) exists is either physical or ontologically reducible to it. This conception, if consistent, mutilates reality, excluding the ontological significance of political, economic, sociocultural, anthropological and psychological realities. Starting from a new history of materialism, the present book focuses on the central ontological and epistemological debates aroused by today’s leading materialist approaches, including some little known to an anglophone readership. The key concepts of matter, system, emergence, space and time, life, mind, and software are checked over and updated. Controversial issues such as the nature of mathematics and the place of reductionism are also discussed from different materialist approaches. As a result, materialism emerges as a powerful, indispensable scientifically-supported worldview with a surprising wealth of nuances and possibilities. (shrink)

The present paper tries to answer the question _Is religious education compatible with the purposes of liberal education?_ This work argues that it is possible, and desirable, that democratic states built on liberal ideals include religious education in all schools since increasing the number of options among which the future citizen may choose the conception of the good with which he or she wishes to live is a condition for autonomy as one of its educational purposes. However, the proposal is (...) not based on religious confessional education, which by itself does not satisfy the liberal educational goals, but is redefined from the common noahide principles compatible both religious confessions and non-religious views of morality and citizenship. “Conciencia”, la sección inicial de la Fenomenología de Hegel, se ocupa de la comprensión del mundo físico que nos rodea. La sección siguiente, “Autoconciencia”, comienza a considerar nuestra comprensión de nosotros mismos y de los otros. Este orden de discusión no es ni arbitrario ni meramente conveniente. Por el contrario, una de las principales lecciones que hemos de aprender hacia el final del desarrollo de la “conciencia” es que nuestra mejor concepción del mundo que es el objeto de nuestras actividades (...) cognitivas es inteligible solo como una parte de un relato que además considera la naturaleza del sujeto que se dedica a tales actividades. La razón para esta transición expositiva es un aspecto importante en el idealismo de Hegel. En este capítulo ofrezco una reconstrucción racional de un argumento que veo como el soporte de esta transición y del tipo de idealismo que esta implica. (shrink)

La performatividad es un concepto relativamente reciente. J. L. Austin lo introdujo en la filosofía del lenguaje en la década de los cincuenta para designar aquellas expresiones que, en las circunstancias apropiadas, hacen justo aquello que dicen que hacen (como cuando alguien exclama «te lo prometo»). Desde entonces ha sido sometido a intensos procesos de discusión, crítica y resignificación que lo han conducido a terrenos de reflexión teórica, filosófica y política progresivamente alejados de su contexto originario. Este libro explora, entre (...) todos los trayectos posibles en el interior de estos debates, el modo en que la preocupación de Austin por comprender cómo hacemos cosas con palabras llegó a derivar en lo que Judith Butler, como feminista, como filósofa y como teórica queer, hace con la performatividad. Con este fin se atiende, en primer lugar, a un contexto genealógico en el que confluyen trabajos y discusiones explícitas sobre la performatividad lingüística (como los de Jacques Derrida, Jonathan Culler o Shoshana Felman) junto a la obra de otros autores que, si bien no la tratan explícitamente, ha-cen posible su particular recepción por parte de Butler, como Michel Foucault. En segundo lugar, se trata de entender la reformulación de la performatividad en el ámbito de las identidades sexuales y genéricas, con la que Butler desplaza género y sexo del conjunto de las cosas que somos al orden de las cosas que hacemos. Las relaciones entre cuerpo y lenguaje, materia y textualidad, sexo y género sufren así una transformación con efectos de largo alcance sobre la filosofía, los estudios de género y las políticas identitarias. El intercambio de críticas entre Butler y autores como Seyla Benhabib, Nancy Fraser o Pierre Bourdieu contribuye a entender parte de esos efectos, y también a profundizar en algunas de las prioridades políticas de nuestra autora: la resistencia a los efectos excluyentes de la normatividad genérica y, en particular, del sistema «dos sexos, dos géneros», en dirección a una versión más abierta, inclusiva y proliferante de la identidad. ¿Dónde, cuándo, cómo, queer? Organizados en tres secciones que dialogan mientras se alejan entre sí, en espiral, los ensayos aquí reunidos cubren un arco temporal que se remonta a los orígenes de los estudios queer, durante los primeros años de la crisis del VIH, y alcanza a la pandemia de Covid-19. El resultado es un libro concebido como un viaje entre pandemias, durante el cual la propia noción de estudios queer se ve afectada, desbordada y, en última instancia, deslocalizada, en (...) su relación con un heterogéneo conjunto de frentes críticos. Quien busque en él la famosa “agenda queer”, no la encontrará. En su lugar, encontrarán motivos para la reflexión crítica quienes, ante los excesos del dogmatismo, prefieran optar por el valor transformador del disenso. (shrink)

El arte no es solamente una fuente inagotable de goce estético, es además una huella, una evidencia de nuestro pasado histórico. A partir del arte es posible remitirnos a nuestra raíz cultural, y es por eso que la obra artística constituye una parte importante del patrimonio de un pueblo. Es evidente el estrecho vínculo entre el patrimonio artístico y la identidad cultural; por eso es importante dar un justo valor a ese patrimonio que, a su vez, se reflejará en la (...) consolidación de una identidad propia. De esas expresiones tomamos únicamente las de la arquitectura de algunas iglesias barrocas. En ellas podemos notar una serie de variables del mestizaje cultural. La arquitectura del barroco novohispano, como uno de los lenguajes del arte, generó una reflexión sobre la identidad del individuo iberoamericano. (shrink)

Many pragmatist and non-representational approaches to cognition, such as the enactivist, have focused on the relations between actions, affectivity, and habits from an intersubjective perspective. For those adopting such approaches, all these aspects are inextricably connected; however, many questions remain open regarding the dynamics by which they unfold and shape each other over time. This paper addresses a specific topic that has not received much attention: the impact on future behavior of not fulfilling possibilities for social interaction even though their (...) fulfillment is desirable within a given context. Inspired by Gibson’s theory of affordances and Dewey’s account of habits, these situations will be characterized as events where an agent does not act upon an inviting affordance for social interaction due to a conflict which he or she experiences between given concerns, needs, and social norms. This conflict leads to a sense of unfulfillment that may eventually bring about a crisis and revision of habits. Through specific examples, this work presents the potential impact of the connection between affordances, habits, and affectivity on everyday situations. It therefore represents an exploration of the common ground between pragmatism and enactivism and an attempt to contribute to a process-based approach to social interaction. (shrink)

El trabajo explora críticamente la idea de una justificación débil o pen última de la moral enmarcándola en el conjunto de la filosofía de Tugendhat, reordenan do sus escritos éticos y discriminando los diversos aspectos que incluye dicha idea. Entre ellos, revisa el concepto formal de moral, ligado a los sentimientos, antes de centrarse en el punto crucial: la fundamentación de la ética moderna. Aquí se distingue, por un lado, la justificación comparativa de un contractualismo igualitario frente a otras alternativas (...) teóricas y, por otro, los motivos que pueden llevar (more heideggeriano, en realidad) a un individuo autónomo a entenderse en términos morales. According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. Aunque no puede hablarse en sentido estricto de una teoría moral del existencialismo a la manera de los grandes sistemas y modelos éticos de occidente, sí existen muchos argumentos que respaldan una versión en la cual es discutida la moral tradicional en contraposición a la posibilidad de una moral de la situación apoyada por las tesis más importantes de los existencialistas. Simone de Beauvoir ha elaborado un conjunto de textos donde esta posibilidad es expuesta.

De acuerdo con una caracterización filosófica estándar, el comportamiento humano se hace inteligible a partir de estados mentales, atendiendo especialmente a dos relaciones explicativas: la racionalidad y la causalidad. En el presente artículo evaluaremos cuán adecuada es dicha caracterización respecto a las explicaciones que se dan en las psicoterapias contextuales. Nuestro análisis establece varias respuestas por la negativa. Por un lado, el objetivo de estas terapias no es la comprensión ni la evaluación normativa, por lo que la racionalidad no juega (...) allí un rol explicativo. A su vez, el rol de la causalidad es secundario en la evaluación diagnóstica, dado que en esa etapa del proceso terapéutico es la función de los comportamientos la que busca elucidarse. Finalmente, sostenemos que la intervención terapéutica de estas psicoterapias se centra en explicaciones causales, aunque no desde el modelo de sentido común que la caracterización filosófica supone. Sugerimos, por la positiva, que las explicaciones del comportamiento en psicoterapias contextuales son híbridas: al evaluar apelan a explicaciones funcionales y al intervenir a explicaciones causales. Social ontology focuses on questions about the reality of human categories. The typical examples are gender and race. Common questions about them are: Do they exist? What is their nature? Do they exist in the best possible way? Meanwhile, the philosophy of psychiatry has been discussing the reality of psychopathology, what is the best way to classify mental disorders, and whether it is possible to define them without normative vocabulary. I think there is something not only strange but inadequate about (...) these discussions being held apart. Particularly, I hold that by being held separately these discussions are philosophically incomplete. In this paper, I argue that these debates are parallel in crucial aspects, but more importantly that they can benefit from each other if they start a dialogue. I suggest some paths we can take to start fruitful discussions and offer examples of the kind of outcomes we can expect. However, my main contribution is to sketch a common framework to map current discussions, make comparisons between them, and, more importantly, guide new research. (shrink)

The most recent work by Jürgen Habermas tries to revalue religion in today's society. For this he tries to find genealogical connections between secular content and the worldviews that emerged in the Axial Age, including Jewish monotheism. In this article we try to propose that a genealogical approach to monotheism from the perspective of those involved would have to start from the context of undetected origin that constitutes the ethical universalism of Judaism: the Noahide code. To do this, we analyze (...) narrative and conceptual elements of axial and non-axial cultures and show their parallels with the seven laws of the children of Noah as the moral core of humanity.
