I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. Moral subjectivism is commonly associated with out-of-favour theories like, e.g., Alfred Ayer’s emotivism or John Mackie’s error theory. This paper approaches the field against the background of the attitudinal character of morality and religion. The possibility of a brand of moral subjectivism is established which is common to Ayer’s and Mackie’s theories in name only yet still has significant merits. The perspective from action theory and the philosophy of mind suggests that the problem of moral obligation, central to moral philosophy, (...) is more convincingly dealt with by subjectivism than by its rivals: In contrast to realism or even relativism (with which subjectivism is often confused), subjectivism can help to explain the peculiarities of obligation without forcing us to disregard the parallel problem in the field of religion. This finding calls into question the rationale for, as well as the success of, central assumptions in ontology and semantics which the realist so freely hands out in order to make his point: If religious facts and the truth-aptness of religious judgements will not explain religious obligation, moral facts and the truth-aptness of moral judgements will not help the moral realist either. So unless we do not wish to simply cast the problem of moral obligation aside, in future, moral subjectivism must be seriously considered as a worthwhile position in its own right. I argue against the Standard View of ignorance, according to which ignorance is defined as equivalent to lack of knowledge, that cases of environmental epistemic luck, though entailing lack of knowledge, do not necessarily entail ignorance. In support of my argument, I contend that in cases of environmental luck an agent retains what I call epistemic access to the relevant fact by successfully exercising her epistemic agency and that ignorance and non-ignorance, contrary to what the Standard View predicts, are not (...) modal in the sense that knowledge is. After responding to objections, I conclude by sketching an alternative account of ignorance centered on the notions of epistemic access and epistemic agency. (shrink)

Entiendo la acción filosófica como un proceso doble de crítica axiomática y construcción teórica. Cuando esta acción se aplica a las construcciones simbólicas de nuestra identidad, la llamo mitopoética. Por motivos evidentes, este libro no puede sino aspirar a ser el bosquejo de un mapa epistemológico a gran escala de las narraciones de la identidad humana, esquema que he dividido en tres partes. En las dos primeras, defino una estructura conceptual que será utilizada en la tercera para desarrollar una teoría (...) de la acción mítica. La primera es una introducción general a los problemas de la mitología tal y cómo han sido tratados desde el punto de vista de la filosofía de la religión, la lingüística, la historia, la estética y la epistemología, fundiendo todos en un concepto más general de antropología filosófica. La segunda parte está dedicada a la definición de las emociones y a la comprensión de su centralidad en relación a la racionalidad y la estructura de los mitos. A partir de los procesos de desarrollo semántico-emocional del lenguaje, construyo una teoría de la racionalidad continua, en la que los ritos animales son entendidos como protomitos, y los rituales y mitos humanos como un desarrollo simbólico enario de unos protocolos generales de supervivencia. Ambas partes son, entonces, una discusión sobre los elementos conceptuales necesarios para comprender las estructuras mítico-rituales, definidas y tratadas en la tercera sección, en la que defino las propiedades de las acciones miméticas interpretativas, o acciones míticas, y examino las diferentes configuraciones que han tomado a lo largo de nuestro desarrollo simbólico. El libro concluye con un análisis de los condicionamientos generales para el desarrollo de futuras estructuras míticas. Mi punto de partida ontoepistemológico es evolucionista, emergentista y constructivista, una postura que queda mejor expresada a partir de la teoría de la racionalidad continua, de inspiración aristotélica, que parte de que los procesos vitales muestran -en diferentes estados de complejidad- la propiedad de la inteligencia. The paper unfolds a non-modal problem for (moderate) meta-linguistic descriptivism, the thesis that the meaning of a proper name (e.g. ‘Aristotle’) is given by a meta-linguistic description of a certain type (e.g. ‘the bearer of “Aristotle”’). According to this theory, if ⌜α⌝ is a proper name, it is a sufficient condition for the name’s being significant that the description ⌜the bearer of ⌜α⌝⌝ is significant. However, a quotational expression may be significant even when the expression quoted is not. Therefore, proper (...) names and their corresponding descriptions cannot be synonymous, and the corresponding descriptions cannot be viewed as giving the meanings of proper names. So, even if it was immune to Kripke-style modal criticisms, moderate meta-linguistic descriptivism would still seem to founder on the rocks of the opacity of quotation. (shrink)

Among the many ways to evaluate the rationality and adequacy of belief, the relationship between two dimensions is of particular interest: the epistemic dimension and the moral dimension. A belief is epistemically rationalwhen it is supported by the evidence and it is morally adequatewhen its formation and holding is sensitive to moral features of the situation. According to the traditional view, known as purism, the moral domain does not directly impact the epistemic domain. However, there is debate in the literature (...) about the existence of immoral beliefs that seem, at first sight, epistemically rational. These beliefs that contain apparent normative conflict raise the challenge of explaining how different forms of normativity are related. Non-traditional theories hold that there is an encroachment of moral factors in epistemic rationality. Moral encroachment is the view that moral features can affect the epistemic status of a belief, for example, influencingthe threshold of sufficient evidence for rational belief. This idea produces a natural answer to the conflict problem: it wouldn’t exist because moral contexts make immoral beliefs also epistemically irrational. In this paper, I’ll argue that immoral beliefs can’t be epistemically rational, so there is no conflict. This, however, is not due to moral encroachment. It happens because immoral beliefs are never actually supported by the evidence. They are immoral because they are insensitive to moral contexts andepistemically irrational because they are insensitive to available evidence. This account is compatible with purism and, since it is the most parsimonious theory, we should adopt purism. (shrink)

The application of Artificial Intelligence (AI) in healthcare and epidemiology undoubtedly has many benefits for the population. However, due to its environmental impact, the use of AI can produce social inequalities and long-term environmental damages that may not be thoroughly contemplated. In this paper, we propose to consider the impacts of AI applications in medical care from the One Health paradigm and long-term global health. From health and environmental justice, rather than settling for a short and fleeting green honeymoon between (...) health and sustainability caused by AI, it should aim for a lasting marriage. To this end, we conclude by proposing that, in the upcoming years, it could be valuable and necessary to promote more interconnected health, call for environmental cost transparency, and increase green responsibility. What is discrimination and what makes wrongful discrimination wrong? Even after an ever-rising tide of research over the course of the past twenty-five or so years these questions still remain hard to answer. Exercising candid and self-critical hindsight, Larry Alexander, who contributed his fair share to this tide, thus remarked: “All cases of discrimination, if wrongful, are wrongful either because of their quite contingent consequences or perhaps because they are breaches of promises or fiduciary duties.” If this is true it (...) raises serious doubts as to how wrongful discrimination can be a moral wrong in itself. Also, the question comes up as to who it is who breaches a promise or a fiduciary duty. This paper defends the view that the substance of these remarks is better understood by couching them in a political approach towards discrimination. Against this background, they give rise to real and pressing concerns. Once we conceptualise the realm political along Hobbesian lines as the battleground comprising both the private sphere of the individual and the public sphere of the commonwealth it emerges that discrimination has different significance with regard to these respective spheres. In order to illustrate this, I adopt Kasper Lippert-Rasmussen’s descriptive account of discrimination as „differential treatment on the basis of membership of a socially salient group“ and the common view that wrongful discrimination is wrong because it is harmful, disrespectful, or both. In the private sphere the case can be made for morally permissible cases of discrimination. Sexual discrimination due to sexual self-determination with consequently freely choosing your sexual or romantic partner is the central case in point. Where somebody feels unfairly rejected and consequently hurt neither the charge of harm inflicted nor that of disrespect endured need be justified. No “breach of promises or fiduciary duties” is involved. The case is different, however, when it comes to the fiduciary of power. In discriminating, he who exercises the power of the commonwealth necessarily breaches a promise and a fiduciary duty. Discrimination thus appears to be more of a problem of political philosophy than one of applied ethics. In this article, we develop a new approach to integrating philosophical phenomenology with qualitative research. The approach uses phenomenology’s concepts, namely existentials, rather than methods such as the epoché or reductions. We here introduce the approach to both philosophers and qualitative researchers, as we believe that these studies are best conducted through interdisciplinary collaboration. In section 1, we review the debate over phenomenology’s role in qualitative research and argue that qualitative theorists have not taken full advantage of what philosophical phenomenology (...) has to offer, thus motivating the need for new approaches. In section 2, we introduce our alternative approach, which we call Phenomenologically Grounded Qualitative Research (PGQR). Drawing parallels with phenomenology’s applications in the cognitive sciences, we explain how phenomenological grounding can be used to conceptually front-load a qualitative study, establishing an explicit focus on one or more structures of human existence, or of our being in the world. In section 3, we illustrate this approach with an example of a qualitative study carried out by one of the authors: a study of the existential impact of early parental bereavement. In section 4, we clarify the kind of knowledge that phenomenologically grounded studies generate and how it may be integrated with existing approaches. (shrink)

To cope with the intersubjective and communicative deficiencies of Heidegger's Analytics of Existence, Hans-Georg Gadamer developed a theory of language whose nature is at one time phenomenological and ontological. Inspired by Plato's dialectics and Aristotle's ethical and rhetorical works, Gadamer sees human linguistic capabilities as the defining trait of all that is human. Language lives in conversation, dialogically structuring all social and cultural relations. Language is the ambit in which human beings and their historical world take place. In Gadamer's thought, (...) logos replaces being as the ontological support. In such a way, Gadamer's hermeneutical philosophy seeks to fill the void opened by the 20th Century deconstruction of Metaphysics. (shrink)

Longtermism should not be wrongly defined as the view that we should act so that the future is as good as possible for human beings and their descendants; rather, longtermists should be concerned with what the long-term future may be like for all sentient beings. This includes nonhuman animals, as different risks of future suffering may afflict them. Indifference toward their interests could lead to the worsening of their use as resources, quantitatively and qualitatively. The Modern concept of truth, which subjects truth to certainty, broke the harmonious relation between reality and truth, that prevailed in Ancient and Medieval Philosophy. Hans-Georg Gadamer thinks that the main task of contemporary Philosophy is to recover the original harmony of being and knowledge. To shed light on the nature of this problem, we expound the metaphysical-theological foundation of truth, which is at the roots of Aristotelian and Thomistic Philosophies. Specifically, we analyze here the relation between being, truth and (...) logos in the Aristotelian treatise Perì Hermeneías, and in its Thomistic commentary. (shrink)

Much of what has been discussed in the theory of reference in the last twenty-five years is strongly influenced by considerations centring on the business of devising a semantics for quantified modal logic. In this context, discussion of the property of rigidity plays an important role. This property is conceived of as a semantic modal property that distinguishes proper names from descriptions. It is argued that there is a semantic modal asym- metry between expressions of these types. In this talk (...) I shall challenge this assumption. By examining the intuitive Kripkean argument or test employed I arrive at two rather nonconformist results: Firstly, it seems that the test does not establish a genuine semantic asymmetry: Rigidity appears to be a pragmatic property. Secondly, the test does not seem to demonstrate an asymmetry at all: When applied correctly it suggests that both proper names and descriptions (even discounting notorious cases like “the even prime”) can be used rigidly—or so I shall argue. Este artigo apresenta um quadro conceitual para examinar a questão do especismo. Começa definindo-o como a consideração ou tratamento desfavorável injustificado daqueles que não pertencem a uma determinada espécie. A seguir, esclarece alguns dos mal-entendidos comuns acerca do que é e do que não é o especismo. Depois disso, argumenta contra a confusão entre (1) os diferentes modos em que se pode defender o especismo; e (2) as diferentes posições que assumem o especismo como uma de suas premissas. Dependendo se (...) essas últimas aceitam ou não outros critérios para a consideração moral à parte do especismo, podem ser posições especistas simples ou combinadas. Mas o especismo segue sendo em todos os casos a mesma ideia. Finalmente, este artigo examina o conceito de antropocentrismo, que define como o tratamento ou consideração desfavorável daqueles que não são membros da espécie humana. O conceito de antropocentrismo difere do de especismo e do de misoteria (animadversão para com os animais não humanos). Não obstante, pode-se concluir que o antropocentrismo é uma forma de especismo, à luz do que indicam, entre outros, o argumento da sobreposição de espécies e o argumento da relevância. (shrink)

Phenomenology has been adapted for use in qualitative health research, where it’s often used as a method for conducting interviews and analyzing interview data. But how can phenomenologists study subjects who cannot accurately reflect upon or report their own experiences, for instance, because of a psychiatric or neurological disorder? For conditions like these, qualitative researchers may gain more insight by conducting observational studies in lieu of, or in conjunction with, interviews. In this article, we introduce a phenomenological approach to conducting (...) this kind of observational research. The approach relies on conceptual grounding to focus a study on specific aspects of the participants’ experiences. Moreover, the approach maintains the openness to novel discoveries that qualitative research requires while also providing a structured framework for data collection and analysis. To illustrate its practical application, we use examples of hemispatial neglect—a neurologic disorder in which patients characteristically lack awareness of their own illness and bodily capacities. However, the approach that we describe can be applied more broadly to the study of complex illness experiences and other experiential alterations. (shrink)

Existen conceptos clave en las diversas ciencias (ya sean formales, naturales, biosociales o sociales) como “teoría” o “modelo” que están aún hoy sujetos a un amplio debate epistemológico, i.e. desde la teoría del conocimiento, y centrada en el estudio del conocimiento científico en particular. Los científicos, pues, construyen y utilizan diferentes nociones que cargan tras de sí realmente con un exhaustivo debate extracientífico sobre su naturaleza. En este trabajo se ofrecerán algunas aclaraciones y propuestas formales de definición sobre tales nociones (...) desde la filosofía de la ciencia del astrofísico y filosofo Gustavo Esteban Romero (G. E. Romero). En concreto se ensayaran unas definiciones formales de “teoría” y “modelo”, para las ciencias actuales (y otras disciplinas pasibles de su aplicación), y se contextualizarán estas ideas en el debate sobre la estructura y organización de los saberes científicos. Philosophical action theory seems to be in pretty good shape. The same may not be true for the study of human action in economics. Famous is the rant that the study of human action in economics gives reason to tremble for the reputation of the subject. But how does this come about? Since economic action is about action, the broader study must surely have a strong impact on the more specific field. The paper sets out, from the ground up, how (...) an essential concept in economic theory–the concept of competition–can fundamentally benefit from insights derived exclusively from analytical action theory broadly conceived. In doing so, the paper delivers on an old Austrian promise: it is sometimes claimed that Austrian economists understand competition better than most economists. This may be a bold claim, since Austrian economists have neither traced the understanding of subjectivity to its very origin (the theory of intentionality), nor have they traced their sympathy for methodological individualism in relation to market processes to its very ground (the theory of (human) action). This paper aims to fill this gap. Moreover, by grounding an Austrian view of competition in analytic action theory, it succeeds in avoiding the serious problems of the dominant equilibrium approach. By explaining competition as rivalry, the paper draws on the philosophy and logic of human action to bring the (economic) agent back into play. In this way, a case is made for an integrated view of Austrian theory as an amalgam of Austrian economics and analytic action theory. (shrink)

Una de las tesis que tradicionalmente han sido defendidas por la tradición del positivismo jurídico es la tesis coactiva, según la cual el derecho consiste en un conjunto de normas coactivas, en el sentido de impuestas por medio de la fuerza. Pero, sin abandonar esta corriente, ha habido históricamente diversas maneras de entender las relaciones entre derecho y fuerza. Si, pues, hasta comienzos del s. XX era opinión común la idea de que el derecho constituía un conjunto de mandatos o (...) normas de conducta cuya eficacia se garantizaba a través de la amenaza del uso de la fuerza coactiva a los transgresores de aquéllas; a lo largo del siglo pasado, empero, algunos autores muy destacados dieron en sostener la opinión de que la fuerza disponible por jueces y funcionarios venía a constituir sustancialmente el objeto mismo de toda regulación jurídica. Según esta última concepción, el derecho tendría primordialmente la función de articular las condiciones de legitimidad para el uso de la fuerza, designando a los sujetos a los que se encomienda tal uso y determinado los casos y modalidades en los que pueda utilizarse. Entre quienes sustentan la primera tesis, que afirma que la fuerza constituye la garantía del derecho, es lugar común citar a Austin y, a menudo, se cita también a Jhering. Entre los defensores de la segunda tesis común es habitual mencionar a Kelsen, Olivecrona y Ross, habiéndose sustanciado una polémica entre Bobbio y Olivecrona en punto a determinar si fuera menciona Olivecrona o fue Kelsen el primero en adoptarla. Sin embargo, es problemático incluir a Jhering dentro del primer grupo y no dentro del segundo, en cuyo caso habría que atribuirle la primera formulación histórica de la tesis. Este trabajo, de carácter histórico, parte de la citada polémica y trata de verificar la constancia de la segunda tesis en las obras no sólo de Kelsen y Olivecrona, sino sobre todo de Jhering. This article examines and rejects the view that nonhuman animals cannot be recipients of justice, and argues that the main reasons in favor of universal human rights and global justice also apply in the case of the international protection of the interests of nonhuman animals. In any plausible theory of wellbeing, sentience matters; mere species membership or the place where an animal is born does not. This does not merely entail that regulations of the use of animals aimed at reducing (...) their suffering should be implemented. It actually supports the end of such use, as well as other positive steps to provide help and to promote what is good not only for domesticated animals, but also for those living in the wild. Another reason to bring the protection of animals' interests into the international arena is that it is at this level that numerous animal exploitation industries enjoy the protection of different agreements and institutions. It does not follow from this that changing international law should be animal advocates' first priority, but it does follow that they should conduct their work internationally and not limit it to their own countries. El artículo pretende provocar un acercamiento a la enseñanza de la estadística descriptiva y probabilística, con el diseño de experiencias didácticas basadas en experiencias de maestros que aprenden de maestros a través de la implementación de tecnologías de información y comunicación, con el fin de implementar un recurso concreto para la modelación y estructuración de situaciones en las que las diferentes distribuciones de probabilidad se pueden implementar pedagógicamente. Como estrategia pedagógica, se persigue más que “hacer datos”, conseguir la familiaridad del (...) concepto, con el cual los estudiantes colombianos están enfrentados en particular dentro del componente de estándares básicos de pensamiento aleatorio y variacional (MINISTERIO DE EDUCACIÓN NACIONAL -MEN-, 2006). La estrategia, para el cuerpo de docentes del área de matemáticas y estadística, constituye una metodología dirigida a la conformación de un banco de alternativas innovadoras para trabajar didácticamente en estos conceptos tanto en su didáctica, como en su forma de implementar el software libre GeoGebra. La perspectiva de la propuesta se materializa en la expresión reflexiva de estrategias de enseñanza continuamente mejoradas. En cuanto a la estadística descriptiva e inferencial, se persigue el desarrollo de actitudes positivas de maestros y de estudiantes frente a la cotidianidad y al mundo de la vida, en donde las actividades suelen involucrar situaciones contextualizadas en las que se demanda del lenguaje estadístico. Whipple disease is a rare, infectious, disease first described from a single case by Whipple in 1907. As well as characterising the clinical and pathological features of the condition, Whipple made two suggestions regarding its aetiology. These were either than the disease was caused by an infectious agent, or that it was of metabolic origin. As the disease is now thought to be caused by infection with the bacterium Tropheryma whipplei, historical reviews of the history of the disease typically mention (...) only the first of these suggestions. In this paper, we therefore revisit Whipple’s other theory. We argue that a diverse and often successful research programme was developed around this mechanism of disease causation which gave rise to many useful findings on the condition. Adam Smith said that ‘the propensity to truck, barter and exchange one thing for another is common to all men, and to be found in no other race of animals.’ Smith addressed the mark of the man economical, and there is no denying that this is the peculiar way he acts: clearly, to truck, barter and exchange is to act in a certain way. Austrian economics adopts this way of looking at the realm of economics. It prides itself as a (...) theory of human action. This claim seems ill-founded as long as so important a contribution as Ludwig von Mises’s praxeology remains insufficiently understood. In this paper, I address Barry Smith’s charge that in praxeology ‘other core notions, in addition to the concept of action, have been smuggled into and the theory is therefore not purely analytic’. I offer logical proofs of two cornerstone theorems of praxeology, the uneasiness theorem and the scarcity theorem, and thus provide vindication. Also, the findings support Mises’s controversial claim that economics is a priori founded in action theory. Thus, Carl Menger’s dream to lay foundations to economics and the other social sciences may have come true in the guise of praxeology. (shrink)

The reception of the translations of Aristotelian and pseudo-Aristotelian works at the University of Paris in the thirteenth century promoted a new understanding of the sciences as specialized fields of knowledge. The huge amount of translations required a new organization of knowledge, which included novel subjects and categories. Among these there is a very special case, namely the pseudo-Aristotelian De plantis, translated from Arabic into Latin and then back into Greek to be re-translated into Latin again. De plantis was included (...) in the new curriculum in Ripoll 109, and constituted the main source for botanical studies until the sixteenth century. Throughout this paper we will explore the reception and impact of De plantis in both the Arabic and the Latin traditions. We aim to show its foundational role in the development of botany as a theoretical discipline within the natural sciences. (shrink)

El presente trabajo analiza el concepto de ciudadanía y algunas de sus implicaciones en el marco de las democracias occidentales actuales. Partiendo de la premisa de que ser ciudadano supone una determinada relación con un Estado, se revisan algunas de las fundamentaciones clásicas del concepto y se concluye que lo relevante es la variedad de derechos sustantivos que el Estado reconoce a sus sujetos políticos. La esencia de ser ciudadano se desvela revisando el repertorio de derechos a los que su (...) estatuto jurídico permite acceder. Se reflexiona desde ese punto de partida sobre el momento actual, advirtiendo que la pérdida de peso político de los Estados merma derechos ciudadanos y provoca la desafección hacia la política tradicional creando nuevas formas de participación política, cuyos riesgos y virtualidades son destacados. Finalmente, se señala la necesidad de generar estructuras de poder en las que los ciudadanos tengan la posibilidad de ejercer sus derechos políticos y cómo dicha pretensión está ligada al ideal del ciudadano cosmopolita y a instituciones internacionales que den cabida a la diversidad cultural. Se concluye apuntando el papel decisivo que juega la reflexión ética en el reconocimiento de valores mínimos que permitan alcanzar acuerdos que se traduzcan en derechos universalizables. (shrink)

Um das achtzehnte Jahrhundert herum zogen verschiedene Denker dem Staat eine auch heute noch vielbeachtete Grenze: Religion ist Privatsache. Fragen der Religion lägen jenseits dessen, wo der Staat legitimerweise wirken könne. Diese Forderung nach einer Trennung von Staat und Religion wird heute wesentlich als eine Frage der Gewissensfreiheit gedeutet. Wo wir Gewissensfreiheit missachten, erlegen wir Individuen unzumutbare Gewissensnöte auf Der Laizismus bewahrt damit die Unverletzlichkeit religiöser Einstellungen. Gewissensfragen gibt es jedoch nicht nur in der Religion. Es gibt sie auch in (...) der Moral, und sogar in individuellen Lebensperspektiven und Weltanschauungen jenseits von Religion und Moral. Wer Denkern wie Jefferson und Humboldt folgen will, muss daher weiter gehen. Der Aufsatz entwickelt die Konsequenzen für einen in Hobbes und Locke gründenden Kontraktualismus. Ich deute Gewissensgründe als politischen Zustimmungsvorbehalt, der dem kontraktualistischen Gemeinwesen strikte Neutralität abverlangt. Gewissensfreiheit zu missachten zerstört daher das politische, das „Locke'sche" Vertrauen, welches das Gemeinwesen trägt. *—————* Around the eighteenth century, several theorists came to advocate the separation of religion and state. In various ways they argued that all that concerns religion lies beyond the sphere of the state's activity. This "wall of separation" is today often understood as a matter offreedom of conscience. Wherefreedom of conscience is infringed, man 's soul is burdened beyond what the individual can bear. The separation of religion and state thus protects the inviolability of religious attitudes. However, matters of conscience are not exclusively religious. They can be moral, or even pertaining to individual worldviews beyond morality or religion. Those who want to follow thinkers like Jefferson or Humboldt must therefore go beyond their call. This paper investigates the consequences for contractarianism in the spirit of Hobbes and Locke. I suggest conscientious reservations are implied conditions for contractarian consent which oblige the commonwealth to strict neutrality in matters offreedom of conscience. To infringe uponfreedom of conscience thus destroys the band ofthe commonwealth, i.e., political, "Lockean" trust. -/- . (shrink)

Currently, anomalous lived temporality is not included in the main diagnostic criteria or standard symptom checklists. In this article, we present the Transdiagnostic Assessment of Temporal Experience, a structured interview that can be used by researchers and clinicians without a comprehensive phenomenological background to explore abnormal time experiences in persons with abnormal mental conditions regardless of their diagnosis. When extensive data gathered by this scale are available, it will be possible to delineate well-defined anomalous lived temporality profiles for each psychopathological (...) disorder. This instrument may also prove useful for clinicians by providing a more refined assessment of relevant psychopathological symptoms and an in-depth understanding of the patient’s abnormal behaviour as related to specific types of time experience. In the first part of the article, we provide a brief overview of the phenomenological concept of temporality, including pre-phenomenal and phenomenal time, synthesis, conation and synchronization, and of abnormal time experiences in persons affected by psychopathological conditions. In the following part, we describe the basic structure of the interview that comprises seven categories corresponding to the abnormal features of lived temporality: anomalies of synchrony, of time structure, of implicit time flow, of explicit time flow, and anomalous experiences of the past, the present and the future. The paper also includes a section on administration and scoring of the TATE scale, the complete interview and a Likert table for quantifying the frequency, intensity and interference with daily life of the phenomena explored. El presente trabajo discute esa tesis y sostiene que la teoría de Bunge busca construir y evaluar un sistema de valores y de normas, de forma rigurosa y sin arbitrariedad, a partir de conocimientos fácticos y valores de los evaluadores. This book offers a philosophical account of memory. Memory is remarkably interesting from a philosophical point of view. Our memories interact with mental states of other types in a characteristic way. They also have some associated feelings that other mental states lack. Our memories are special in terms of their representational capacity too, since we can have memories of objective events, and we can have memories of our own past experiences. Finally, our memories are epistemically special, in that beliefs formed (...) on the basis of our memories are protected from certain errors of misidentification and justified in a way which does not rely on any cognitive capacity other than memory. The aim of the book is to explain these features of memory. It proposes that memories have a particular functional role which involves past perceptual experiences and beliefs about the past and suggests that memories have a particular content as well; they represent themselves as having a certain causal origin. The book then accounts for the feelings associated with our memories as the experience of some of the things that our memories represent; things such as our own past experiences, or the fact the memories originate in those experiences. It also accounts for the special justification for belief afforded by our memories in terms of the content that memories have. The resulting picture is a unified account of several philosophically interesting aspects of memory. (shrink)

The theory of the just price is commonly assumed to have three sources: Political philosophy of Greek antiquity, scholastic ethics of the High Middle Ages, and the Roman law of obligations of late antiquity. While closer inspection confirms this holds for the first two worlds of thought the latter assumption seems ultimately unfounded. The paper claims that the evidence notoriously presented on behalf of that assumption – two rescripts attributed to Roman emperor Diocletian, namely Codex Iustinianus 4.44.2 and 4.44.8 – (...) ultimately points in another direction. Offering both an analysis and an alternative reading of the rescripts an integrated interpretation is given that reconciles them with the “liberalistic spirit of Roman law”. Also, it is explained why, from the point of view of legal and social philosophy, the fact that Roman law refrains from introducing a moral aspect to the institute of price fixing speaks in favour of Roman law rather than against it. Resumen Hermenéutica y toma de decisiones en ética clínica La moderna hermenéutica se interesa por las condiciones de posibilidad de la comprensión humana. Sus aportaciones son de indudable interés para el campo de la ética biomédica, donde médico y paciente tratan de comprenderse mutuamente con el fin de concretar determinado proyecto de cuidados. Sin embargo, esta aproximación está lejos de ser aprovechable para formar una pauta concreta de cara a la toma de decisiones en este campo. La hermenéutica acierta al (...) poner el centro de gravedad en el diálogo, en lugar de en el método, pero olvida que, en Gadamer, el diálogo está dirigido a la verdad. Esto es lo que se tratará de poner de manifiesto en este trabajo, intentado establecer la conexión de dicha noción con las de bien, historia y comunidad. -/- Abstract Modern hermeneutics deals with the conditions of the possibilities of human understanding. Its contributions are particularly pertinent to clinical ethics, where patient and doctor seek to mutually understand one another in order to establish a determined care plan. Nevertheless, this approach is far from useful for the formulation of a concrete standard for decision making in this area. Hermeneutics is effective in putting the focus on dialogue, rather than method. But it overlooks the fact that dialogue, according to Gadamer, is directed towards truth. The present article aims to highlight this point, and seeks to establish the connection between this notion of truth and ideas of good, history and community. -/- Resumo Hermenêutica e a tomada de decisões em ética clínica A hermenêutica moderna interessa-se pelas condições de possibilidade da compreensão humana. Indubitavelmente, os seus contributos são de interesse para a ética biomédica, na qual o médico e o paciente tratam de compreender-se mutuamente a fim de concretizar um determinado projeto de cuidados. No entanto, esta perspectiva está longe de poder ser utilizada como padrão concreto para a tomada de decisões neste campo. A hermenêutica tem razão ao colocar o centro de gravidade no diálogo e não no método, entretanto, esquece-se de que, em Gadamer, o diálogo está orientado para a verdade. É precisamente isso que se pretende evidenciar neste trabalho, procurando estabelecer-se a conexão entre a referida noção de verdade com as noções de bem, história e comunidade. (shrink)

Illness and injury are often accompanied by experiences of bodily objectification. Medical treatments intended to restore the structure or function of the body may amplify these experiences of objectification by recasting the patient’s body as a biomedical object—something to be examined, measured, and manipulated. In this article, we contribute to the phenomenology of embodiment in illness and medicine by reexamining the results of a qualitative study of the experiences of nurses and patients isolated in an intensive care unit during the (...) first wave of COVID-19. Drawing upon the phenomenological concept of embodiment—as developed in the work of Edmund Husserl, Maurice Merleau-Ponty, Jean-Paul Sartre, and Emmanuel Levinas—we reconsider how bodily objectification manifests in complex clinical encounters. We show that, in these settings, objectification is not simply the unilateral act of a clinician objectifying a patient. Rather, both clinicians and patients reported a variety of objectifying experiences influenced by their interactions, the immediate context of the intensive care milieu, and the broader atmosphere of a global pandemic. In light of these findings, we argue that bodily objectification in illness and medicine can often be more complicated than typically presented in the phenomenological literature. (shrink)

En el presente trabajo se utiliza el problema ético de la automatización en transportes y vehículos dotados de inteligencia artificial (IA) para un análisis crítico de las diferentes posiciones éticas y morales clásicas. Debido a la intersección de la IA con los campos de investigación de la bioética, la nomoética y la tecnoética, existe un hilo conductor en sus fundamentos. Además, se juzga necesario para este propósito, así como por rigurosidad, hacer uso de una cantidad mínima de herramientas formales y (...) exponer un proyecto de una teoría ética actualizada, sistémica y materialista, que sobrepase a sus sistemas rivales. Así, se pretende ofrecer las bases para una teoría alterna más fecunda y explicar cómo las posiciones éticas tradicionales pueden ser obsoletas, si no directamente inaplicables, para afrontar la automatización inteligente y problemas morales similares, en la actualidad. Resumen: Todo hecho debe ser narrado para ser objeto de examen valorativo. Pero este examen depende, en parte, de cómo aquél sea narrado. Algunos autores han señalado el valor democrático que posee el enfoque narrativo, en la medida en que permite que una narración sea construida a partir de diferentes puntos de vista. El problema es que estos puntos de vista pueden conducir a soluciones alternativas o incluso antagónicas, fenómeno no infrecuente en una sociedad multicultural como la nuestra. Desde un (...) punto de vista estrictamente narrativo, el mejor relato es el más persuasivo. Pero esto nos aboca al relativismo, puesto que la eficacia de un relato está en función del auditorio ante el que se argumenta. En este trabajo se ha intentado poner de manifiesto que sólo se alcanza a comprender la verdadera contribución de la narrativa si nos situamos, no tanto en el plano de los hechos, como en el plano de la normatividad. La tesis que aquí se sostiene es que la utilidad del enfoque narrativo está en función del valor arquetípico del modelo o estándar de conducta que eventualmente contenga una determinada narración. Entronca así directamente con la noción de razón práctica, más allá de sus específicos puntos de conexión con algunas de las metodologías bioéticas más importantes. Abstract: Every fact must be narrated in order to be subject of value judgement. But this value judgement depends partly on how that fact is narrated. Some authors have highlighted the democratic value of the narrative approach, because of its admission of different points of view to construct a story. The problem is that these points of view can easily lead to alternative solutions o even opposing ones. This phenomenon is not rare in our multicultural society. From an strictly narrative point of view, the best story is the most persuasive. But this lead us to relativism, because the efficacy of an story relies on the audience towards the argumentation is developed. In this work we have tried to bring to light that the genuine contribution of the narrative approach is not achieved if we stay on the level of facts and we do not pass to the level of normativity. We suggest the thesis that the utility of narrative approach is a function of the archetypical standard of behavior that a story may content. So this approach, beyond its specific connections with some of the most prominent bioethical methodologies, become directly connected with the notion of practical reason. (shrink)

We claim that scientists working with deep learning (DL) models exhibit a form of pragmatic understanding that is not reducible to or dependent on explanation. This pragmatic understanding comprises a set of learned methodological principles that underlie DL model design-choices and secure their reliability. We illustrate this action-oriented pragmatic understanding with a case study of AlphaFold2, highlighting the interplay between background knowledge of a problem and methodological choices involving techniques for constraining how a model learns from data. The methods of philosophical consultation vary enormously according to the practitioners who conceive and apply them. In this paper, we discuss the conceptions and methods we have been carrying out for several years in this field, such as philosophical naturalism, the dual requirement, first steps, anagogy and discrimination, thinking the unthinkable, switching to the "second floor", and being philosophical. Our methodology is mainly inspired by the Socratic maieutic, where the philosopher questions his interlocutor, invites him to identify the stakes of (...) his discourse, to conceptualize it by distinguishing key terms in order to implement them, to problematize it through a critical perspective, to universalize its implications. This practice has the specificity of inviting the subject to move away from a mere sensation to allow him a rational analysis of his speech and of himself, a sine qua non condition for deliberating on the cognitive and existential stakes which must be made explicit at first. The removal from oneself that this unnatural activity presupposes, for which it requires the assistance of a specialist, poses a certain number of difficulties, e.g., frustration, speech as a pretext, the issue of truth, pain and epidural. Finally, some additional exercises are very useful for the reflection process, such as establishing connections, real speech, order, universal and singular, and accepting the pathology. (shrink)

In this essay, I reflect on the implications of intellectual virtues in scientific endeavor. To this end, I first offer a depiction of scientific endeavor by resorting to the notion of academic attitude, which involves aspects concerning the generation and possession of knowledge. Although there are differences between these activities, they have in common the engagement of diverse intellectual agents (scientists). In this sense, I analyze how intellectual virtues are linked to 1) scientific research tasks, such as theory appraisal, and (...) 2) those tasks of vigilance and intervention in the uses of scientific knowledge. I conclude that intellectual virtues play a leading role in achieving higher quality scientific research and adequate foresight on the uses and impacts of scientific findings. In this order of ideas, I propose an agenda for further inquiries on these matters, highlighting the relevance of reflecting and empirically researching the relationship between intellectual virtues and science, as well as cultivating intellectual virtues in various stages of scientific training. Resumen: Tomado en serio, el empirismo parece abocar a la negación de los derechos humanos; al menos entendidos como expresión de la naturaleza humana. Bajo esta óptica, K. Olivecrona rechaza explícitamente todo Derecho natural, por considerarlo una noción metafísica. En cambio, cuando describe el Derecho positivo, se encuentra con que éste parece asegurar un determinado orden de valores. Olivecrona, además de describir este dato, en diversos escritos asume dichos valores e incluso los defiende. Esta última postura no es muy coherente (...) con una metodología que niega el conocimiento moral. Seguramente por ello, con el paso del tiempo, Olivecrona va abandonando la defensa de dichos valores e, incluso, marginando su interés por constatarlos empíricamente. El Derecho queda reducido a mera fuerza organizada y monopolizada por el Estado. Pero esta renuncia escamotea otro hecho empírico: la opción general y radical a partir de la segunda Guerra mundial de los modernos sistemas constitucionales por separar ley y derechos, constituyendo a los más básicos como fundamento del orden político y jurídico. A la vista de este fenómeno, pensamos que no sólo es posible explicarlo, sino que incluso se puede justificar, en la medida en que la institucionalización de estos derechos fundamentales no es sólo moralmente debida, sino, de un modo más específico, jurídicamente debida. -/- Abstract: Seriously taken, empiricism seems to lead to the denial of human rights; at least if they are understood as the expression of human nature. In this optic, K. Olivecrona explicitly rejects any natural law, for being a metaphysical notion. However, when he describes positive law, he finds that it apparently assures a specific set of values. Olivecrona, besides describing this datum, accepts and defends these values in various writings. This last choice is not very coherent with a methodology which denies moral understanding. Probably this is the reason why he gradually abandons the defence of those values and progressively drops his interest in validate them empirically. Law is reduced to a mere organized force monopolized by the State. But this renunciation overlooks another empirical fact: after the Second World War modern constitutional systems have generally and radically opted to separate Law and rights and moreover some of these have been set up as the basis of the political and legal order. In view of this phenomenon, we strongly believe that it is possible to explain it, but even to justify it, considering that the institutionalization of these fundamental rights is based on a specific demand of justice. En el marco de los estándares profesionalizantes de la academia, con sus “rankings” y productividad científica, las humanidades subsisten. Una explicación de este fenómeno es que, según la ontología social, las razones para la acción independiente de deseos son piezas clave en la educación. Por ello, dichas razones, que constituyen obligaciones, también serían claves para el desarrollo de las humanidades. Aquí examino de qué forma el individualismo y la competencia tensionan la dinámica entre deseos y obligaciones. Ciertamente, el mercado valora (...) más la satisfacción de deseos que la teorización sobre la intencionalidad colectiva y su producto: la civilización humana. (shrink)
