This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have (...) been deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. History appears already to the young Gramsci as a system of forces in unstable balance, which struggle to position themselves on the side of history, to identify with it. For this reason, in his reading of Marxism, the unity of history is a result, the product of a successful strategy of hegemony building. This article reviews the Gramscian theory of hegemony and tries to show its coherence with the philosophy of praxis, that is, with the notion of the fundamentally practical (...) nature of reality. In particular, it is argued that, on the one hand, a crisis of hegemony must be understood as disintegrating a hegemonic system, which allows subordinated hegemonic moments to emerge; on the other hand, the crisis itself is determined by the formulation of hegemonic discourses that try to escape their condition of subordination. Se diserta sobre “RESISTENCIA TRIBUTARIA” JUSTIFICADA EN EL ECUADOR. Ello, porque gobierno del presidente Daniel Noboa estableció todo un “paquete” de “impuestos de guerra”, como la Contribución Temporal de Seguridad (CTS); un incremento del IVA, a discreción del presidente de la República, el pechaje del sector construcción, transferencias al exterior y otros impuestos. Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica (en adelante, la Ley), publicada en el Registro Oficial, Suplemento No. 516 del (...) 12 de marzo de 2024, trayendo a discusión los aspectos jurídicos que vician de posible inconstitucionalidad dicha Ley, con fundamento en la normativa constitucional y tributaria de Ecuador. Con la Ley, dado el contexto de su aprobación, el gobierno creó un ´impuesto de guerra´, para financiar una guerra inexistente, partiendo del hecho que la Corte Constitucional del Ecuador estableció que en el país no existe un “Conflicto Armado Interno” (CAI). Así lo estableció en sus Dictámenes 5-24-EE/24 del 9 de mayo de 2024 y 6-24-EE/24 del 13 de junio de 2024, en los que declaró inconstitucionales los decretos ejecutivos No. 250 de 30 de abril de 2024 y 275 del 22 de mayo de 2024, relacionados con el Estado de Excepción que ha regido en Ecuador desde el 10 de enero de 2024, soportado éste en la presunta existencia de un CAI, “decertado” y reconocido sin fundamento jurídico, pese a que no cumple con los supuestos fácticos y normativos fijados, con fuerza ius cogens, por el Derecho Internacional Humanitario (DIH)7 para ser calificado como tal. El ´impuesto de guerra´, fijado en la Ley, por inconstitucional, es confiscatorio. Los Dictámenes, en el plano de la reflexión tributaria, reflejan la patética violación al principio de la constitucionalidad y de la legalidad fiscal, resultando viciada de nulidad absoluta la Ley y, con ella, la configuración del tributo, porque el hecho imponible (CAI) es inexistente, implicando que el presupuesto establecido por la Ley para configurar cada `impuesto de guerra´ jamás tendrá materialización práctica (por inexistente) y nunca tendrá validez jurídica (por inconstitucional), resultando en un tributo confiscatorio, surgido contra la Carta Fundamental y evidente fraude a la legalidad tributaria del país, en perjucio del patrimonio personal o corporativo de los contribuyentes, residentes fiscales o establecimientos permanentes en el país a los que somete a un pago indebido sancionado en el artículo 122 10 , concordado con los artículo 306 al 307 del Código Tributario del Ecuador. La nulidad absoluta e ineficacia del hecho imponible, por inconstitucional, deriva en la invalidez plena y la irrelevancia constitucional del inexistente hecho generador del tributo -proveniente de un acto de naturaleza jurídica - por la no realización fáctica, tangible y concreta del presupuesto generatriz establecido (CAI) en la Ley para su configuración. Como consecuencia, nunca jamás surge válidamente la obligación tributaria, cuya exigencia resulta ineficaz, por ilegal e ilusoria. La obligación tributaria, tiene que calificarse, en tal sentido, como no nacida lícitamente en el ámbito fiscal. Con ello, habría de resultar confiscatorio el pago de la alicuota del `impuesto de guerra´ fijado por el gobierno ecuatoriano de modo inconstitucional abusando del ejercicio del poder tributario relacionado con la urgencia en materia económica. Ante las hondas repercusiones económicas que genera en la población y el sector productivo del país, se describen las posibles vías institucionales disponibles en la regulación ecuatoriana para impugnar la Ley ante la Corte Constitucional del Ecuador -o en la jurisdicción constitucional- sin menoscabo de la eventual activación de la competencia derogatoria de la Asamblea Nacional frente a la misma. Se reafirma el principio de justicia tributaria y la vigencia del Estado social de derechos y de justicia consagrado en la República del Ecuador y la plena efectividad de los derechos y garantías fundamentales de los hermanos ecuatorianos ubicados en la posición de destinatarios de un "impuesto de guerra" tan arbitrario como inconstitucional, que riñe con el enunciado constitucional y convencional del respeto a la dignidad humana y la incolumidad de la propiedad privada frente a actuaciones del Estado que representan un claro abuso en el ejercicio del poder público en desmedro de la legalidad fiscal, generador de un supuesto de patética injusticia tributaria adoptada a contracorriente de toda regulación en materia de impositiva con la publicación de la Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica. En la lucha contra conductas gubernamentales transgresoras de la dignidad humana y frente a leyes inconstitucionales que afectan los derechos fundamentales, la libertad económica y la propiedad privada de los hermanos contribuyentes ecuatorianos y sus empresas afectadas. Este esfuerzo intelectual, realizado por nuestra familia de abogados, es una reverencia a la gesta de nuestros libertadores y un llamado al pueblo ecuatoriano económicamente afectado a resistir, por medios institucionales, frente al pago de impuestos arbitrarios e ilegales que atentan contra los principios fundamentales del orden público económico previsto en la Ley Fundamental. Lo anterior, como una singular expresión reglada, lícita y avanzada de dar al traste con una ley orgánica fiscal tan arbitraria como injusta, activando los mecanismos de protección de los derechos fundamentales constitucionalmente establecidos en el Ecuador. La pretensión judicial traduciría, mutatis mutandis, en la activación institucional de la añeja figura de la "resistencia tributaria" (objeción fiscal, desobediencia tributaria), que, en sus orígenes, nació como expresión de la desobediencia civil frente a leyes impositivas injustas, con el precedente del escritor estadounidense Henry David Thoreau, encarcelado por negarse a pagar un tributo electoral, reticente a contribuir con la continuidad de la esclavitud y la financiación de la Guerra entre México y EEUU, basado en la idea de que las personas deben priorizar su conciencia sobre la obediencia a leyes injustas. -/- . This paper analyzes the current crisis of the global industrial civilization as a coincidence of external and internal reasons, mainly as a coincidence of economic and environmental crises tendencies. The analysis is based on Habermas´ distinction between four types of social formation, and according to their internal organizational principles and an extent of their social and system integration, also types of crises that can occur in the given type of the social formation. The paper shows that the common reason (...) of economic and environmental crises which are a part of system crisis of industrial civilization is an imperative of growth. This imperative, as Habermas points out, is the immanent principle of institutions and systems of capitalism. Economic and demographic growth of industrial civilization based on capitalism principles has reached its limits. However, all types of social formation, institutions and civilizations are also determined by the imperative of sustainability. The current crisis is then characterized as a display of antagonism between the imperative of growth and imperative of sustainability. This antagonism creates a new category of transformation for sustainable societies or revolution conflicts in states that break environmental and economic limits of growth. These conflicts result from food and water shortages and could bring a growing instability into the world or lead into the collapse of the industrial civilization. (shrink)

The article situates Marx’s crisis theory within the discipline of political economy, explains its relationship to mainstream economics, charts economic crises that have happened since the 1840s, and explains Marx’s crisis theorem of the fall in the rate of profit. In conclusion, the 2008 economic crisis, and the notion of crisis in general, are speculatively considered. This article presents possible answers, and their respective probabilities, to the question, ‘What are the consequences of the present global crisis in the proximate future of the World System?’ It also attempts to describe the basic characteristics of the forthcoming ‘Epoch of New Coalitions’ and to forecast certain future conditions. Among the problems analyzed in this paper are the following: What does the weakening of the economic role of the USA as the World System centre mean? In recent debates about the replication crisis, two positions have been dominant: one that focuses on methodological reforms and one that focuses on theory building. This paper takes up the suggestion that there might be a deeper difference in play, concerning the ways the very subject matter of psychology is construed by opposing camps, i.e., in terms of stable effects versus in terms of complexity. I argue that each gets something right, but neither is sufficient. As a response to the COVID-19 crisis, governments have turned to various discretionary measures such as cash transfers to consumers and businesses with mixed results. Universal Basic Income (UBI) is back on the agenda as well. One of the main advantages of UBI, as scholars like F.A. Hayek, Milton Friedman, and James M. Buchanan have argued, is that it does not depend upon competent and benevolent government discretion—which is often in short supply—but upon pre-established rules. This paper argues that (...) the UBI scheme holds tentative promise from the point of view of improving the institutional crisis preparedness of a complex socioeconomic order. The pre-established rules of UBI buttress the rule of law framework that improves the ability of economic agents to spontaneously coordinate their actions in times of crisis characterized by radical uncertainty, disequilibrium shocks, and institutional instability. Furthermore, UBI combines the distribution of fungible resources with the delegation of independent decision-making power to millions of crisis-struck individuals and communities. Compared to discretionary tax-and-transfer schemes, the rules of UBI therefore appear more compatible with the polycentric discovery of novel solutions from the bottom-up. In times of crisis, UBI may be relied upon as one cornerstone of what I shall call the permanent crisis management framework. Having such a permanent scheme may minimize - although it does not altogether eliminate - the need for discretionary transfers, targeted intervention, and technocratic management in times of crisis. However, this theoretical model of UBI as a facilitator of polycentric crisis preparedness faces several practical challenges that need to be addressed in further research. (shrink)

This article presents the topic of crisis in the context of prevention in pastoral workers. It points to the possibility of coping with crisis and thus offers a theological view of overcoming it. It is based on the theoretical points of view and practical experience of pastoral workers. En diversas ocasiones se han producido tensiones entre el Tribunal Constitucional y el Tribunal Supremo, que han trascendido a la opinión pública y que han sido motivo de debates, tanto en la doctrina como en la arena política. -/- Estas tensiones se agudizaron con ocasión de la famosa condena por responsabilidad civil de los Magistrados del Tribunal Constitucional por parte de la Sala Primera del Tribunal Supremo; y que ha sido causa de que el legislador haya introducido en la reforma (...) de la Ley Orgánica del Tribunal Constitucional una serie de medidas tendentes a fortalecer la posición institucional del máximo intérprete de la Constitución. -/- En este trabajo tratamos de acercarnos a estas tensiones, tanto cuando interviene la Sala Primera del Tribunal Supremo, como cuando interviene la Sala Segunda y la relevancia que tiene cada episodio. -/- A esta situación, se une la fuerza jurídica con la que se acaba de dotar al Tribunal Constitucional con motivo de la reciente reforma de su ley orgánica. El Tribunal Constitucional dispone ahora del instrumento del artículo 4 de la Ley Orgánica del Tribunal Constitucional, que pretende garantizar la fuerza vinculante de su jurisprudencia que ya se desprendía de la Constitución y su ley orgánica. -/- Es necesario estudiar si esta reforma va a ser o no suficiente para garantizar de forma definitiva la supremacía del Tribunal Constitucional en nuestro sistema jurídico-constitucional; y en qué medida esta reforma afecta al equilibrio institucional existente. -/- También se reflexiona, en último lugar, sobre la conveniencia de una articulación distinta del sistema de responsabilidad de los Magistrados constitucionales, que, sin restarles independencia, les dote de una mayor legitimidad en el ejercicio de su función. Inflationary cosmology has been widely accepted due to its successful predictions: for a “generic” initial state, inflation produces a homogeneous, flat, bubble with an appropriate spectrum of density perturbations. However, the discovery that inflation is “generically eternal,” leading to a vast multiverse of inflationary bubbles with different low-energy physics, threatens to undermine this account. There is a “predictability crisis” in eternal inflation, because extracting predictions apparently requires a well-defined measure over the multiverse. This has led to discussions of anthropic (...) predictions based on a measure over the multiverse, and an assumption that we are typical observers. I will give a pessimistic assessment of attempts to make predictions in this sense, emphasizing in particular problems that arise even if a unique measure can be found. (shrink)

World Crisis and Underdevelopment examines the impact of poverty and other global crises in generating forms of structural coercion that cause agential and societal underdevelopment. It draws from discourse ethics and recognition theory in criticizing injustices and pathologies associated with underdevelopment. Its scope is comprehensive, encompassing discussions about development science, philosophical anthropology, global migration, global capitalism and economic markets, human rights, international legal institutions, democratic politics and legitimation, world religions and secularization, and moral philosophy in its many varieties.

Conflict is a ubiquitous feature of community life, and communities based on inquiry are no exception. Sometimes, conflict escalates into crisis. A crisis may help a community by providing opportunities for its members to recognize and ameliorate their shortcomings, but it may also destroy a community or limit its ability to sustain productive projects. In this discussion, I articulate two orientations towards crisis: crisis-philia (loving crises and seeking them out) and crisis-phobia (fearing crises and seeking (...) to avoid them). I argue, drawing heavily from my experience as a participant in the Summer Seminar of the Institute for the Advancement of Philosophy for Children, that neither orientation is satisfactory. Instead of crisis-philia or crisis-phobia, we ought to get into the habit of inquiring, as a community, about whether our current obstacles to accomplishing our work derive from being constrained by too much (imperfect) structure or from too little stability. When we find it is the former, we ought to seek crises; when we find it is the latter, we ought to avoid crises. After making my case, I offer an example of what it looks look like to implement this conclusion in practice. (shrink)

What does it mean to study places in ‘crisis’ and how does that affect the research done on the ‘rural’? To be considered to be in crisis is not really new as any literature review of rural studies indicates. And yet, we live now in a new context, with new challenges for ‘rural’ research, in particular that of sustainability. Sustainability is the new policy focus and is increasingly reflected in research on rural Europe. Although scholars are beginning to (...) theorize on what is sustainable in and for rural areas, our intention is to take this further. We theorize on what the focus on crisis and, increasingly on sustainability, means for the research we do and the knowledge we produce on rural Europe. Our aim is to bring attention to the politics of past and present knowledge production on the rural to be able to imagine just and sustainable futures. In an analysis of literature primarily from Sweden and the UK, we argue that two construals, that of a rural crisis and that of rural–urban polarization, have set the tone for rural studies and may have overshadowed a more plural approach. We outline what might be needed from rural research to meet future challenges and what the notion of sustainability, with its emphasis on the entanglements of the social, economic and environmental, might mean for the future of rural research. The present crisis of truth, the "post-truth" crisis, puts the philosophy of truth in a new light. It calls for a reexamination of the tasks of the philosophy of truth and sets a new adequacy condition on this philosophy. One of the central roles of the philosophy of truth is to explain the importance of truth for human life and civilization. Among other things, it has to explain what is, or will be, lost in a post-truth era. Clearly, (...) the deflationist answer that the role of truth is to serve as a tool of generalization and oblique endorsement will not do. My account of truth in this paper addresses this task. Truth, I argue, is first and foremost a human value. Its importance to our life/civilization lies, not exclusively, but principally, in the centrality of this value to our humanity. I investigate the ramifications of this answer to the issues discussed in the contemporary philosophy of truth, and I end with a comparison of the substantivist and deflationist approaches to truth in light of this new perspective. The crisis of our times is science in a world without wisdom. The immense intellectual success of modern science and technology have given some of us unprecedented powers to act, which has led to all the great benefits of the modern world, and to the grave global crises we now face. Before modern science, we lacked the power to do too much damage to ourselves or the planet; now we have science, wisdom has become, not a private luxury but (...) a public necessity. Unless we learn to become a bit wiser, sooner or later we will destroy ourselves. But how can we learn to become wiser? We can learn from the last place many would look - namely science! We can learn from scientific progress how to achieve social progress towards a wiser world. This is in fact an old idea. It goes back to the 18th century French Enlightenment. But, in developing the idea, the philosophes of the Enlightenment made three gross blunders. They failed to capture correctly the nature of the progress-achieving methods of science; they failed to generalize these methods properly; and, most disastrously of all, they applied their misconstrued scientific method, not to the social world directly, not to the task of making social progress towards an enlightened world, but instead to the task of improving knowledge of social phenomena, to the task of developing social science. This botched version of the profound Enlightenment idea was developed throughout the 19th century, and built into universities in the early 20th century with the creation of disciplines of social science. As a result, academic inquiry today is a botched version of what we need. Instead of giving priority to problems of living, and devoting itself to helping humanity acquire a bit more wisdom, academia today devotes itself to the pursuit of knowledge. That is the key disaster of our times. Our institutions of learning seek knowledge, but fail disastrously to devote themselves to helping humanity acquire a bit more wisdom. If the world is to acquire global wisdom, it needs institutions of learning rationally devoted to the task. As a matter of supreme urgency, we need to bring about a revolution in academia so that the basic task becomes, not just to acquire knowledge, but to seek and promote social wisdom. (shrink)

In this paper I try to clarify and systematize some contributions with regard to (a) the main aspects of crisis situations that impose the management of emotions, (b) the correlation of certain social emotions with the factors that trigger them and their related tendencies to act, (c) the essential elements of emotional experience, (d) the differentiation of appropriate emotional reactions to a crisis situation from the inappropriate ones; (e) the in-stances in which emotions can be managed, and (f) (...) the balance between rationality and affectivity in the organization’s response to the risks or crises which it faces. By means of logical correlations I arrived at the following conclusions. Regardless of the social sphere in which the crisis makes itself felt, regardless of its type, phase or damage control strategies, the rational control of emotions contributes significantly to overcoming the crisis situation. Beyond the specificities, crises involve digressions form the norms of rightful conduct, breaches of the social norms that support institutions (as spontaneous order structures) and maladaptive reactions to reality. They can be corrected through a good management of emotions, with the caveat that we are not dealing with a problem of knowledge, but rather with one of will and character. All people can identify the adaptive emotional responses to a crisis situation, but only a few prefer them and train assiduously to use them. (shrink)

The present crisis of foundations in Fundamental Science is manifested as a comprehensive conceptual crisis, crisis of understanding, crisis of interpretation and representation, crisis of methodology, loss of certainty. Fundamental Science "rested" on the understanding of matter, space, nature of the "laws of nature", fundamental constants, number, time, information, consciousness. The question "What is fundametal?" pushes the mind to other questions → Is Fundamental Science fundamental? → What is the most fundamental in the Universum?.. Physics, (...) do not be afraid of Metaphysics! Levels of fundamentality. The problem №1 of Fundamental Science is the ontological justification (basification) of mathematics. To understand is to "grasp" Structure ("La Structure mère"). Key ontological ideas for emerging from the crisis of understanding: total unification of matter across all levels of the Universum, one ontological superaxiom, one ontological superprinciple. The ontological construction method of the knowledge basis (framework, carcass, foundation). The triune (absolute, ontological) space of eternal generation of new structures and meanings. Super concept of the scientific world picture of the Information era - Ontological (structural, cosmic) memory as "soul of matter", measure of the Universum being as the holistic generating process. The result of the ontological construction of the knowledge basis: primordial (absolute) generating structure is the most fundamental in the Universum. (shrink)

The Crisis of European Sciences and Transcendental Phenomenology (Crisis) marks the culmination of Husserl’s Genetic Phenomenology and the beginning of a new philosophy of science, one that viewed science not as a fact but as a problem that needed philosophical understanding. For Husserl, the crisis of Galilean Science is born out of the severance of its relation to the life-world and the erroneous identification of “Nature” with its constituted mathematical or quantifiable object. In the phenomenological philosophy of (...) science, science is a tradition formed through human praxis, like any other cultural enterprise. Objectivity in scientific praxis is a regulative principle constituted by the consensus of judgements of the scientific community. The continuity of scientific knowledge shows in its unity of propagated transference of meaning, the sedimentation of which is carried through language. Despite the scientific world being ontologically grounded in the life-world, Husserl sought to preserve the autonomy of both worlds. To fully appreciate the implications of Husserl’s contribution to the philosophy of science, this paper identifies the ‘spatial turn’ that Husserl brought in through his “less mathematical, more physical” notion of life-world with the 90° shift in the social studies of science that Latour proposed. The life-world fuses “Nature” and “Society” as one ontological entity that gives rise to science, moving away from a one-dimensional science that kept the ontology of science grounded in one of those poles alone. Despite the limits of Husserlian phenomenological epistemology, Crisis radically departed from positivism, the then-official philosophy of science, embracing historicity and language to broaden our discourse on science and even coming close to certain later developments in Philosophy of Science. Husserl’s meditations on spatiality also urged a transition to the contemporary understanding of space, opening possibilities of dialogue with Foucault. (shrink)

Current globalization has its predecessor in the global market of the 19th century. In that time, the main sign of globalization was de socialization of the economy. That globalization ended during World War I as a result of applying the liberal ideology of de socialization to an economy. An attempt to rebuild the global market after World War I led to the global economic crisis (1929 1932), which in Germany allowed Nazis to take over and finally led to World (...) War II. In result of this development after the war, the idea of a welfare state arose in Western Europe. However, the problems brought about by realization of this idea led to further globalization and consequently to the rebuilding of the global market. It is clear that current globalization rebuilds also the process of de socialization of the economy. It seems that this causes the repetition of radicalizations from left to right extremist movements. The current global economic crisis or the combination of energy and environmental crises could end the current globalization trend in the same way as it was brought to an end in the first half of the 20th century. The recent so-called crisis of replication continues to dominate psychology’s methodological landscape. It is argued here that the apparent renaissance of Popperian thinking that characterises some of the key responses to the crisis of replication is fundamentally flawed. In essence, there is a serious lack of any sustained and rigorous treatment of ontology that underpins much of the current debate about replication and Popper’s falsificationist approach. The overriding problem is that the replication debate reflects the methodologist tendency for (...) mainstream psychologists to avoid or gloss over crucial ontological questions. In contradistinction, this article (a) underscores the primacy of ontology; (b) delineates and applies a critical realist stratified ontology to psychology; (c) utilises the latter as a springboard from which to argue for Popper’s methodological “retirement”; and (d) revindicates the indispensability of context and the subtlety of psychological phenomena in arguing for the intrinsic limits of replication and experimentalism in general. Popper’s (1983, 2002) philosophy of science has enjoyed something of a renaissance in the wake of the replication crisis, offering a philosophical basis for the ensuing science reform movement. However, adherence to Popper’s approach may also be at least partly responsible for the sense of “crisis” that has developed following multiple unexpected replication failures. In this article, I contrast Popper’s approach with that of Lakatos (1978) as well as with a related but problematic approach called naïve methodological falsificationism (...) (NMF; Lakatos, 1978). The Popperian approach is powerful because it is based on logical refutations, but its theories are noncausal and, therefore, potentially lacking in scientific value. In contrast, the Lakatosian approach considers causal theories, but it concedes that these theories are not logically refutable. Finally, NMF represents a hybrid approach that subjects Lakatosian causal theories to Popperian logical refutations. However, its tactic of temporarily accepting a ceteris paribus clause during theory testing may be viewed as scientifically inappropriate, epistemically inconsistent, and “completely redundant” (Lakatos, 1978, p. 40). I conclude that the replication “crisis” makes the most sense in the context of the Popperian and NMF approaches because it is only in these two approaches that the failure to replicate a previously corroborated theory represents a logical refutation of that theory. In contrast, such replication failures are less problematic in the Lakatosian approach because they do not logically refute theories. Indeed, in the Lakatosian approach, replication failures can be temporarily ignored or used to motivate theory development. (shrink)

In times of crisis, when current theories are revealed as inadequate to task, and new physics is thought to be required—physics turns to re-evaluate its principles, and to seek new ones. This paper explores the various types, and roles of principles that feature in the problem of quantum gravity as a current crisis in physics. I illustrate the diversity of the principles being appealed to, and show that principles serve in a variety of roles in all stages of (...) the crisis, including in motivating the need for a new theory, and defining what this theory should be like. In particular, I consider: the generalised correspondence principle, UV-completion, background independence, and the holographic principle. I also explore how the current crisis fits with Friedman’s view on the roles of principles in revolutionary theory-change, finding that while many key aspects of this view are not represented in quantum gravity, the view could potentially offer a useful diagnostic, and prescriptive strategy. This paper is intended to be relatively non-technical, and to bring some of the philosophical issues from the search for quantum gravity to a more general philosophical audience interested in the roles of principles in scientific theory-change. The replication crisis (also called the replicability crisis and the reproducibility crisis) is an ongoing methodological crisis in which the results of many scientific studies are difficult or impossible to reproduce.

Yablo suggests a ‘hostage crisis’ occurs when an unproblematic statement ϕ entails, and is therefore hostage to, a problematic statement ψ. Yablo proposes a technical solution to this kind of problem by diminishing ϕ to ϕ*, where ϕ* does not entail ψ and thus is not hostage to it. I argue that Yablo’s proposal is unnecessary because the original, undiminished ϕ does not in fact entail ψ. This is what Yablo calls a ‘defiant’ position. I defend defiance by arguing (...) that ϕ and ψ are of different metaphysical weights, which I show through an analysis of their use of quantification. (shrink)

Agonism as a political theory emphasizes the ontological aspect of conflict in human political interaction. This article aims to shed light on the political practice of agonism – and in doing so on its limits – by viewing 'crisis discourse' as an agonistic political practice. As my analysis of the Dutch Socialist Party and the Freedom Party’s speech in the European Sovereign Debt Crisis shows, crisis discourse aimed to (re)create a ‘people’ and to justify radical change in (...) economic and social structures. Crisis discourse is employed to construct an 'other' that can be based on ethnic and nationalist terms and to justify retroactive application of the law and the stripping of Dutch citizens of their rights. This attention to crisis discourse as an agonistic political practice highlights an unease within agonism itself: where must the agonist accepts limits to the conflict and contestation she so values? The article starts with Chantal Mouffe's answer to this question - her insistence that legitimate conflict must always recognize the shared values of equality and liberty - and proceeds to show that Mouffe's view unnecessarily relies on a deliberative democratic desire for consensus. Other than Mouffe, I draw on Honig’s emphasis of perpetual contestation to propose that the issue of limits can be best answered by reference to the core of agonistic thought: the preservation of the struggle over political norms and processes. It is not shared values or even a shared political space that matters, but that the political space of the ‘people’ – however contested membership therein might be – remains a place that the 'other' can re-enter. In it, Arran Gare analyses the conjunction between the environmental crisis, the globalisation of capitalism and the disintegration of the culture of modernity. It explains the paradox of growing concern for the environment and the paltry achievements of environmental movements. Through a critique of the philosophies underlying approaches to the environmental crisis, Arran Gare puts forward his own, controversial theory of a (...) new postmodern world view. This would be the foundation for the environmental movement to succeed. What is to be learned from the chaotic downfall of the Weimar Republic and the erosion of European liberal statehood in the interwar period vis-a-vis the ongoing European crisis? This book analyses and explains the recurrent emergence of crises in European societies. It asks how previous crises can inform our understanding of the present crisis. The particular perspective advanced is that these crises not only are economic and social crises, but must also be understood as crises of public (...) power, order and authority. In other words, it argues that substantial challenges to the functional and normative setup of democracy and the rule of law were central to the emergence and the unfolding of these crises. The book draws on and adds to the rich ’crises literature’ developed within the critical theory tradition to outline a conceptual framework for understanding what societal crises are. The central idea is that societal crises represent a discrepancy between the unfolding of social processes and the institutional frameworks that have been established to normatively stabilize such processes. The crises at issue emerged in periods characterized by strong social, economic and technological transformations as well as situations of political upheaval. As such, the crises represented moments where the existing functional and normative grid of society, as embodied in notions of public order and authority, were severely challenged and in many instances undermined. This article analyzes the global causes of the contemporary crisis and the possibilities to eliminate the most acute problems that have generated this crisis. According to the UN report, one-third of India’s population is migrant, and the migration pattern is mainly from the rural area to the city. The workers in India migrate seasonally, temporarily, or for the long term. The Covid-19 situation created hazardous setbacks in the lives of Indian migrants. It was a time of social psychological and emotional trauma. The Covid-19 situation manifested the dilemma that who is responsible for the migrant workers. The fact that they were objectified, and their human (...) dignity was not protected amidst the interventions of the Supreme Court of India and the Central and State Governments being the context, the paper attempts to consider the question “How can the policy makers collaboratively bring positive impact in the lived experiences of the migrant workers?” as the theme of the paper. Policymakers guided by the philosophical wisdom that respects and supports human dignity can change the lives of migrants undergoing a crisis. (shrink)

The paper studies, within the framework of Martin Heidegger's narrative of the history of metaphysics, two perspectives on the unity of being: the "protometaphysical" perspective of Parmenides, the thinker of the "first beginning" of Western philosophy, and the postmetaphysical perspective of Heidegger, situated in the ongoing transition from the Hegelian and Nietzschean end of metaphysics to a forthcoming "other beginning" of Western thought. Both perspectives involve a certain "crisis", in the literal sense of the Greek krisis, "distinction," "decision." Parmenides' (...) goddess exhorts the thinker to decide for being in the sense of pure intelligible accessibility or presence and to exclude all references to non-accessibility and non-presence. This is the foundation of the Parmenidean thesis of the unity of being. In the Heideggerian perspective, by contrast, meaningful presence is seen as constituted precisely by references to a withdrawing meaning-context, to background dimensions that in themselves are not immediately present. Since presence is constituted only in terms of non-presence, the "decision" or "crisis" between presence and non-presence is an unresolvable and irreducible feature of postmetaphysical thinking. The highly contagious 2019 novel coronavirus disease (COVID-19) outbreak has not only impacted health systems, economies, and governments, it has also rapidly grown into a global health crisis, which is now threatening the lives of millions of people globally. While, on one hand, medical institutions are critically attempting to find a cure, on the other hand, governments have introduced striking measures and policies to curtail the rapid spread of the disease. Although COVID-19 has achieved pandemic status and is predominantly (...) viewed as a biomedical issue, it is argued that it should also be treated as a psychological crisis. This paper also reviews the literature to examine and comment on the detrimental effects of isolation, which has been enforced as one of the primary preventative measures to manage the spread of COVID-19. This paper further outlines key recommendations that should be addressed across different levels to buffer against the known adverse effects of isolation, which is especially relevant for the current COVID-19 situation, where a large proportion of the global population is isolated, confined, and/or quarantined. The European ideals – as well as the idea of Europe per se – are faced with a serious challenge due to recent migration crisis: it is not just the reflexes, the effectiveness and the policies, but also the consistency, the principles and the justification of the notion of the European Union that is in stake. Kant’s concept of universal hospitality could probably provide a good way out of this conundrum: while hospitality has largely been viewed as a solidarity-related (...) imperfect duty towards others, that is, a less compelling duty that allows moral agents for certain latitude concerning the occasions and the degree of its implementation, Kant’s views allow for a totally different perspective, and, in my view, a much more philosophically nuanced one: hospitality might also be considered as an autonomy-based duty owed to others, and in this respect could count as a perfect, morally compelling duty. To the extent that the concept of Europe consists in humanitarian ideals that are based upon a strong philosophical humanistic tradition, I consider my claim to be in perfect harmony with the true spirit of Europe. If objectification of subject is (...) juxtaposed with resultant objectification of women, nature, ‘other’, knowledge and idea or Reason or Dharma, it would certainly validate the hypothesis of the essay. The main hypothesis of the essay is as to how objectification of subject on the plane of sciencitization of philosophy and violation of Krishna pure monism-one has become all and inherent knowledge and , and its subversion by muses have led to the crisis of world. The objectification of subject or consciousness or spirit in sciences seems to be cause and effect of objectification of the Woman, Nature, Other, Knowledge and Reason or Idea or Dharma. When one has become all or creator has become creation, the plurality and difference is transitory which appear to have been assigned the permanent value. The transitory value has been given permanence, while the permanent has been dislodged from discourse, conveniently tucked to the abstract. La actual crisis sanitaria nos invita a repensar el actual modelo de salud, así como sus implicaciones antropológicas, sociales y económicas. A partir de una breve historia del concepto de salud, en este artı́culo tratamos de evidenciar los cambios que ese mismo concepto ha implicado a nivel de relación médico-paciente y a nivel de relaciones sociales. Un nuevo paradigma de salud, más ajustado a los nuevos fenómenos globales que están aconteciendo, implica también una critica a los enfoques individualistas, reduccionistas, (...) tecnocráticos y economicistas que se encontraban en la raı́z del “antiguo” modelo de salud. Por último, proponemos el modelo One Health como una posible respuesta a los problemas teóricos del “antiguo paradigma” de salud, fuertemente enfatizados por la crisis sanitaria actual. (shrink)

The results of forensic science are believed to be reliable, and are widely used in support of verdicts around the world. However, due to the lack of suitable empirical studies, we actually know very little about the reliability of such results. In this paper, I argue that phenomena analogous to the main culprits for the replication crisis in psychology are also present in forensic science. Therefore forensic results are significantly less reliable than is commonly believed. I conclude that in (...) order to obtain reliable estimates for the reliability of forensic results, we need to conduct studies analogous to the large-scale replication projects in psychology. Additionally, I point to some ways for improving the reliability of forensic science, inspired by the reforms proposed in response to the replicability crisis. (shrink)

Desire is an important philosophical topic that deeply impacts everyday life. Philosophical practice is an emerging trend that uses philosophical theories and methods as a guide to living a eu‐ daimonic life. In this paper, we define desire philosophically and compare different theories of desire in specific Eastern and Western traditions. Based on the Lacanian conceptual–terminological triad of “Need‐Demand‐Desire”, the research of desire is further divided into three dimensions, namely, the subject of desire, the object of desire, and the desire (...) itself. The concept of desire is then an‐ alyzed from this triad and these three dimensions through different philosophical theories. This paper selects Buddhism as the representative of Eastern tradition, and Stoicism as the representative of the West, paying special attention to Stoicism’s “spiritual exercises” following Pierre Hadot. By exploring and comparing the Buddhist paths to liberation from suffering (i.e., the Four Noble Truths and the Noble Eightfold Path) and the two theoretical pillars in Stoicism (i.e., the notions of “living according to nature” and “the dichotomy of control”), practical guidance is then provided for un‐ derstanding and regulating desire in times of crisis. This understanding and regulation of desire constitutes a philosophical therapy for today’s troubles, particularly those caused by excessive or irrational desires. (shrink)

WINNER OF THE SIMON HAILWOOD ESSAY PRIZE. This paper discusses the problem of alienation from nature, considered through the phenomena of reification and de-objectification. I propose understanding alienation as the result of a distorted relation between the subjective and the objective and I suggest a tentative solution via the combination of two ethico-political practices: releasement and reappropriation. In doing so, I put forward a structural-ethical critique and response to our current ecological crisis.

The paper discusses the concept of "crisis" in the context of the city of Detroit's bankruptcy under the rule of the Governor-appointed Emergency Manager. In their recent book, Judith Butler and Athena Athanasiou discuss the concept of dispossession in all its complexity, in the context of enforced austerity measures in Europe and a global Occupy movement. The concept of “dispossession” clarifies how we actually depend on others in a sustained social world, that in fact the self is social. I (...) will use their reflections as a springboard for analysis of the imposition of an emergency manager on the City of Detroit and the subsequent bankruptcy hearings for the city, which along with the mortgage and foreclosure crisis and now recent water shut-offs have resulted in dispossessing the poorest of the poor from their modest possessions. However Detroit is also the scene of a robust response, as people take to the streets in acts of solidarity to demand their city back. As Athena and Butler caution, activists should not fall into reinforcing the disastrous concept of personhood reinforced by possession. There are other ways of engaging with each other politically to forge a common cause that escape the negative aspects of “possession.” The project of getting people together at the grassroots, knowing each other, finding strength in leaning on each other, finding confidence to challenge the status quo that is tearing communities apart – that is the activism that is ongoing in Detroit. This is the lightly revised text of my commentary/response to David Carr’s keynote address, “Phenomenology of Crisis,” at the 2024 meeting of the Husserl Circle.

The paper tries to examine the effects of economic crisis on philosophical considerations of distributive justice. It tackles the problem of a radical increase in scarcity as a condition of justice. Instead of assuming a relatively fixed (“moderate”) level of scarcity as a background against which justice in distribution obtains, the paper examines what happens when this level risks falling below and how does that change our views of distributive justice. It takes upon the recent events in the United (...) States to construe a specific philosophical model and ask how crisis distribution, where that favors wealthier actors, can be justified. By analyzing the crisis distribution principle, it ultimately aims to suggest that moderate scarcity should not be seen as a mere condition, but an important and vital object of justice. As such it falls within, not beyond legitimate obligations of democratic governance. (shrink)

One of the most interesting aspects of Leibniz's philosophy is the distinction between "art" and "nature"; the core of this matter is the possibility (or even the impossibility) of distinguishing as clearly as possible between two ontological domains: on one hand the products of technique (such as "artificial machines"), on the other hand all the beings that can be defined as natural ("natural machines"). The question raised in this paper is if it is possibile to build ontological criteria which can (...) be clear enough to distinguish between the products of nature and those of technique in the field of the "res" that they are.
