Resumen Este trabajo consiste en un análisis histórico de textos que proceden de un expediente archivístico de Cartagena de Indias entre 1715 y 1717. Los autos son textos administrativos que poseen diversas funciones en las relaciones institucionales entre metrópoli y colonias, tal como la de “emitir opinión”. En la tipología textual indiana, esta función se denomina consulta o parecer, y se caracteriza por el uso de un predicado de tipo doxástico. Para el análisis hemos adoptado las perspectivas teóricas (...) del análisis histórico del discurso y de la sociopragmática histórica. El estudio se completa con un análisis cuantitativo que permite resaltar cuáles son los rasgos lingüísticos a los que se vincula la intensificación y la atenuación en el subtipo debate dentro del registro legal en el español de la Cartagena del siglo XVIII. La conclusión sugiere que los recursos lingüísticos encontrados aumenta la intención persuasiva de la argumentación característica de los autos cartagineses. (shrink)

This doctoral thesis examines the phenomenon of Filipinization, specifically understood as the ideological construction of a “Filipino identity” or ‘Filipino subject-consciousness” within the highly determinate context provided by the Filipino ilustrado nationalists such as José Rizal, Marcelo H. del Pilar and their fellow propagandists inasmuch as it leads to the nineteenth (19th) century construction of the modern Philippine nation. Utilizing Jacques Derrida’s deconstructive thinking, this study undertakes a genealogical critique engaged on the concrete historical examination of what is meant by (...) the term “Filipino” across a select historical timeline (1864-1898) and the various notions of Filipino identity implied by the different contexts within which the term “Filipino” has been employed. More specifically, it undertakes a selective philosophical excavation of three seminal texts in the history of Filipinization, viz.: 1) the Manifiesto of Padre Jose Burgos; 2) the writings of the Filipino ilustrados in La Solidaridad; and 3) Jose Rizal’s Annotations on Dr. Antonio de Morga’s Sucesos de las Islas Filipinas. -/- The philosophical claim of this work is the idea that Filipinization, taken as the differential construction of Filipino identity, is the effective translation of the colonial epistemic violence of Eurocentric racism and its consequent “horror of absolutism” into the homo-hegemony of Filipino nationalisms. By fetishizing the notion of a carefully constructed and essential “Filipino-identity,” Filipinization and the current nationalist discourses that utilize them, unwittingly, stands complicit with the same colonial violence and hegemony that they wish to combat. This happens precisely when the very structures of colonial oppression, on the ideological and practical levels, are transmogrified into nationalist ideals that assume legal and political power unto themselves in a self-referential and self-legitimating fashion. -/- Three processes will demonstrate the above thesis: first, by examining historical texts and setting itself against established nationalist historiographies, a genealogical analysis of the term “Filipino” reveals it as a pliable signifier whose semantics have evolved through time. From its originary referent in the Spanish criollo (creole), it has come to refer to people who would have been otherwise entirely alien to this class, viz., the mestizos (both Spanish and Chinese), the principalia (native elite), and eventually, the lowland Catholicized natives themselves. The historical hermeneutic of this identity-discourse in Padre José Burgos’ Manifiesto yields the fact that what gives the term “Filipino” its semantic consistency as a class concept is its essential constitution as a Hispanic and Catholic identity. -/- Second, from this semantic identification of the term “Filipino” as a Hispano-Catholic identity, we proceed to clarify the meaning of Filipinization in terms of the nationalist propaganda carried out by the Filipino ilustrados in the fortnightly periodical La Solidaridad. Here, the specific ilustrado construction of Filipino identity as a Spanish citizen (ciudadano Español) is revealed precisely as a political and legal construct that served as the basis for their own politics of social inclusion/exclusion. Filipinization can only be applied to those who have been hispanized and Christianized and never to those tribes who have resisted and remained outside Spanish colonial authority. Filipinization is thus revealed as a process of Hispanization and Christianization whereby the recipients of Spanish colonial hegemony are transformed into the religiously docile bodies of the Spanish Empire. -/- From this highly determinate context, the study proceeds to examine Rizal’s ontological grounding of collective Filipino-ness in the mythological construction of the pre-hispanic past as the source of a unique Filipino ancestrality. In his work on de Morga’s Sucesos, what is revealed is a mythologization that grounds a native, essential Filipino identity within a past unscathed by the Spanish colonial experience. Such mythologization, however, can only be possible through an anachronistic nationalist interpretation of historical data. Here, Filipinization is revealed as an exclusive prerogative, a nationalist program by which Rizal and the ilustrado class can combat the evils and excesses of the Spanish colonial enterprise. Ironically, though, this same struggle for emancipation also became an instrument by which the ilustrado class can retain their unjustified position of power over those who belonged to the colonial underside, thus, securing the possibility of perpetuating their own ilustrado bourgeois class interests. -/- Such discursive complicity is the essence of the myth of Filipinization: it presents nationalist identity discourse as an anti-colonial enterprise while being underlined by an economy of motives designed to cater primarily to the exclusive interests of the elite and ilustrado class. Thus, instead of securing the genuine, inclusive emancipation of all colonial subjects and a more humane existence for the poor and suffering majority, ilustrado nationalism has, ironically, merely reinforced those operative structures of colonial discrimination and oppression when the ilustrados: 1) grounded their racial theory upon the very same discourse of Eurocentric superiority that they are precisely supposed to question and 2) claimed a patrimony over Filipinas as their exclusive sovereign inheritance. These two factors illustrate how the manifest transfer of power from the Spanish Empire to the Philippine sovereign nation (and later as a nation-state) illustrate how Filipinization merely has transmogrified the face of Spanish colonialism into its new, subtle, and worse form in Filipino nationalism. -/- In this vein, the existence of the 19th century modern Philippine nation merely masked and deferred the crisis that was supposed to transfer power from the Spanish Empire to the multitude of the poor and suffering native indio majority. This crisis became all the more difficult to address be-cause of the duplicitous character of the discourse of Filipinization itself. It has not only effectively transferred power into the hands of the nationalist elite but also captured authentic emancipatory discourse within the identity-trap against which it can only hope to get out. This study concludes with the claim about the impossibility of ever escaping and overcoming the epistemic and practical violence necessarily contained within the historical discourse of colonialism. Or simply, we have no language or discourse that would enable us to overcome the complicity of Filipinization with the very (epistemic) violence against which it has set itself. (shrink)

The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

Digital COVID certificates are a novel public health policy to tackle the COVID-19 pandemic. These immunity certificates aim to incentivize vaccination and to deny international travel or access to essential spaces to those who are unable to prove that they are not infectious. In this article, we start by describing immunity certificates and highlighting their differences from vaccination certificates. Then, we focus on the ethical, legal, and social issues involved in their use, namely autonomy and consent, data protection, equity, (...) and international mobility from a global fairness perspective. The main conclusion of our analysis is that digital COVID certificates are only acceptable if they meet certain conditions: that they should not process personal data beyond what is strictly necessary for the aimed goals, that equal access to them should be guaranteed, and that they should not restrict people’s autonomy to access places where contagion is unlikely. We conclude that, if such conditions are guaranteed, digital COVID certificates could contribute to mitigating some of the most severe socioeconomic consequences of the pandemic. (shrink)

We will examine how the diversity of historical sources affects the portrayal of the Balkan Slavs by following two writings that notably differ. First is De Аdministrando Imperio, written in the X century. Our second source is the Chronicle of the Priest of Duklja about which very little is known. The two sources have a strong influence on our understanding of the earliest history of the Slavs that dwell in the Western Balkans. Hence, on our understanding of the modern (...) nations, i.e. Croats and Serbs. These sources are so different when regarding their historicity, time of composition etc. But in terms of myths, we see the same patterns: coming of pagan peoples in Roman Dalmatia, story of their origin, how they were baptised, who were their rulers, what kind of dynasties they had, when did it happen and many more. Following this general ethnogenetic and mythological framework, we will try to conclude the relationship between myth and the identity of a European populace. To achieve this goal, we used qualitative and quantitative content analysis and provided their narrative networks of the mentioned texts. These networks illustrate patterns of connections between different ethnogenetic elements in the writings that serve to form groups identities of interest. (shrink)

This study resumes the discussion undertaken by Ulpiano Bezerra de Menezes, historian, archaeologist and museologist at the University of São Paulo, the first to “decolonize the history of Art in the Americas”. At the same time, this resumption is in charge of paying homage to this researcher who found the mistakes and gaps left by European scholars who were at the service of Eurocentric colonialism and its Eurocentric culture. However, the central objective of this text is to contribute to (...) this process of decolonization, expanding the discussion that began in the 1980s. Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. Finally, with the help of some brief case studies, the author hopes to provide a minimum framework useful to understand how social justice can be realized through law. (shrink)

If there is an area of discourse in which disagreement is virtually absent, it is mathematics. After all, mathematicians justify their claims with deductive proofs: arguments that entail their conclusions. But is mathematics really exceptional in this respect? Looking at the history and practice of mathematics, we soon realize that it is not. First, deductive arguments must start somewhere. How should we choose the starting points (i.e., the axioms)? Second, mathematicians, like the rest of us, are fallible. Their (...) ability to recognize whether a putative proof is correct is not infallible. In most cases, disagreement over the correctness of a putative proof is, however, evanescent. Once an error is spotted and communicated, the disagreement disappears. But this is not always the case. Sometimes it is recalcitrant; that is, it persists over time. In order to zoom in on this type of disagreement and explain its very possibility, we focus on a single case study: a decades-long (1921-1949) controversy between Federigo Enriques and Francesco Severi, two prominent exponents of the Italian school of algebraic geometry. We suggest that the instability of the mathematical community to which they belonged can be explained by the gap between an abstract criterion of rigor and local criteria of acceptability. It is this instability that made the existence of recalcitrant disagreement over putative proofs possible. We do not condemn speculative mathematics but rather its pretense of being rigorous mathematics. In this respect, we show that the overly self-confident Severi and the more intuitive, visionary Enriques had a completely different attitude. (shrink)

Scholarly debates on the Critique of Pure Reason have largely been shaped by epistemological questions. Challenging this prevailing trend, Kant's Reform of Metaphysics is the first book-length study to interpret Kant's Critique in view of his efforts to turn Christian Wolff's highly influential metaphysics into a science. Karin de Boer situates Kant's pivotal work in the context of eighteenth-century German philosophy, traces the development of Kant's conception of critique, and offers fresh and in-depth analyses of key parts of the Critique (...) of Pure Reason, including the Transcendental Deduction, the Schematism Chapter, the Appendix to the Transcendental Analytic, and the Architectonic. The book not only brings out the coherence of Kant's project, but also reconstructs the outline of the 'system of pure reason' for which the Critique was to pave the way, but that never saw the light. The discussion extends to the challenges digital mediums pose to the traditional "aura" of texts, the democratization of philosophical engagement, and the exacerbation of a digital divide among scholars. Through a nuanced (...) critique, the essay advocates for a balanced approach to digital scholarship in philosophy, emphasizing the need to harness digital tools judiciously while addressing the digital divide. The paper introduces Vailati’s life and works, investigating Vailati’s education, the relation to Peano and his school, and the interest for pragmatism and modernism. A detailed analysis of Vailati’s scientific and didactic activities, shows that he held, like Peano, a a strong interest for the history of science and a pluralist, anti-dogmatic and anti-foundationalist conception of definitions in mathematics, logic and philosophy of language. Vailati’s understanding of mathematical logic as a form of pragmatism is not a faithful interpretation of (...) Peano’s conception, but it is essential to understand the relations of Peano’s logic with other philosophical traditions and some epistemological aspects of Peano’s perspective, such as the search for a universal language. My analysis here is an attempt to bring out the main through-line in the development of Bulgarian philosophy of law today. A proper account of Bulgarian philosophy of law in the 20th century requires an attempt to find, on the one hand, a solution to epistemological and methodological problems in law and, on the other, a clear-cut influence of the Kantian critical tradition. Bulgarian philosophy of law follows a complicated path, ranging from acceptance and revision of Kantian philosophy to the (...) development of interesting theories on the logic of legal reasoning. In this paper art history and visual studies, the disciplines that study visual culture, are presented as a field whose conjectural paradigm can be used to understand the epistemic problems associated with abduction. In order to do so, significant statements, concepts and arguments from the work of several specialists in this field have been highlighted. Nineteenth-century scientist Hermann von Helmholtz’s peculiar wavering between empiricism and transcendentalism in his philosophy of science in general, and in his theory of perception in particular, is a much debated and well-documented topic in the history and philosophy of science. This contribution aims at providing a fresh angle on this classical issue, by considering Helmholtz’s account of differential consciousness against the background of a centuries-old philosophical debate between the empiricist tradition and the tradition of transcendental idealism. By placing Helmholtz’s (...) psychology against the background of a historical narrative stretching from Hume to Fichte, one can gain insight into the possible merits of his empirico-transcendentalism with regard to the problem of differentiation. More particularly, it is argued that Helmholtz’s psychology tilted towards transcendentalism when met with the classical theoretical problems of strict empiricism in dealing with the foundation of consciousness, most notably circularity and infinite regress. Without claiming that Helmholtz’s theorizing presented a self-conscious attempt to overcome the latter issues, his well-known wavering between perspectives in general, and his appropriation of the a priori in particular, might have served him well in avoiding the deadlocks of empiricism. As noted at the end, however, Helmholtz’s account produced complex philosophical problems of its own. (shrink)

This chapter examines Hegel’s conception of philosophical critique in order to shed light on the force and limits of the method that has become known as immanent critique. At least in modern philosophy, it was Kant who first conceived of critique as a form of reflection that draws its criterion from reason itself. As I argue, Hegel is deeply indebted to Kant in this respect. The chapter begins with an analysis of Hegel's seminal essay ‘On the Essence of Philosophical Criticism (...) Generally, and its Relationship to the Present State of Philosophy in Particular’, published in 1802. After a brief discussion of the Phenomenology, I turn to his Philosophy of Right. These texts make clear, I argue, that the criterion from which immanent critique takes its bearings is necessarily tainted with a particularity that it cannot affirm without losing its force. According to this account, immanent critique comes to refer to a form of reflection that is more complicated and more precarious than Kant and Hegel seem to have assumed. (shrink)

The classification of algebraic surfaces by the Italian School of algebraic geometry is universally recognized as a breakthrough in 20th-century mathematics. The methods by which it was achieved do not, however, meet the modern standard of rigor and therefore appear dubious from a contemporary viewpoint. In this article, we offer a glimpse into the mathematical practice of the three leading exponents of the Italian School of algebraic geometry: Castelnuovo, Enriques, and Severi. We then bring into focus their distinctive conception of (...) rigor and intuition. Unlike what is often assumed today, from their perspective, rigor is neither opposed to intuition nor understood as a unitary phenomenon – Enriques distinguishes between small-scale rigor and large-scale rigor and Severi between formal rigor and substantial rigor. Finally, we turn to the notion of mathematical objectivity. We draw from our case study in order to advance a multi-dimensional analysis of objectivity. Specifically, we suggest that various types of rigor may be associated with different conceptions of objectivity: namely, objectivity as faithfulness to facts and objectivity as intersubjectivity. The need to better balance the promotion of scientific and technological innovation with risk management for consumer protection has inspired several recent reforms attempting to make regulations more flexible and adaptive. The pharmaceutical sector has a long, established regulatory tradition, as well as a long history of controversies around how to balance incentives for needed therapeutic innovations and protecting patient safety. The emergence of disruptive biotechnologies has provided the occasion for regulatory innovation in this sector. This article investigates the (...) regulation of advanced biotherapeutics in the European Union and shows that it presents several defining features of an adaptive regulation regime, notably institutionalized processes of planned adaptation that allow regulators to gather, generate, and mobilize new scientific and risk evidence about innovative products. However, our in-depth case analysis highlights that more attention needs to be paid to the consequences of the introduction of adaptive regulations, especially for critical stakeholders involved in this new regulatory ecosystem, the capacity and resource requirements placed on them to adapt, and the new tradeoffs they face. In addition, our analysis highlights a deficit in how we currently evaluate the performance and public value proposition of adaptive regulations vis-à-vis their stated goals and objectives. (shrink)

The paper points out three serious problems in Ruud ter Meulen’s view of solidarity and of its role in healthcare ethics. First, it is not clear whether and to what extent ter Meulen expects normative concepts to be rooted in existing social practices: his criticism of liberal theories of justice seems to imply a different view on this issue than his implicit assumption that normative concepts are independent from social and historical trends. Second, it is not clear at which level (...) his notion of solidarity is meant to be applied: does it provide principles for individuals or for institutions? Nor is it clear at what level of generality it should work: is it meant for healthcare institutions or for states, for citizens or for healthcare practitioners? Third, it is not at all clear how the communitarian and the universalist aspirations in his conception of solidarity can be reconciled. In light of such difficulties it is argued that within philosophical discourse solidarity can be a useful notion only if it can be clearly distinguished from existing and commonly used ethical concepts. Three examples of such narrow and specific uses of solidarity are presented. Finally, a sceptical view of confining the work of applied philosophers to articulating normative concepts is put forward and an alternative view of blending empirical and philosophical analysis is proposed. This vision of field philosophy requires serious attention and careful understanding of the circumstances and constraints within which normative recommendations operate. It is suggested that such a modest and empirically grounded understanding of normative work is a better way of honouring the belief that philosophy is rooted in social institutions and in complex webs of relations. The principal objective of this study is to present and discuss the elements that emerge from Michel Foucault's archeological undertakings, which, in our view, configure the existence of a new rhetoric that deals with what the French philosopher called the rarefaction of the subject and rarefaction of discourse in his inaugural lecture at the Collège de France (Foucault, 1996). This new rhetoric would be in charge of reflecting and analyzing the phenomena that result from both the rarefaction of the (...) subject and the rarefaction of discourse, that is, such rhetoric invests in what is responsible for imposing on the speaking subject what to say and how to say it. Therefore, it turns to certain mechanisms of control of discourses that Foucault presented in The Discourse on Language, a work that completes five decades of its publication. This Foucauldian rhetoric also has as its main function to deal with the history of the present, that is, to reflect on what we do and think at this exact moment, which, in turn, would be in charge of contributing to the history of how we became subjects in a culture like ours, at this stage of high modernity and the Information Age. From this perspective, she would be interested in the processes of identification and subjectivation that result from the ways in which we become subjects. In short, it is a study that seeks to present elements that demonstrate the emergence of a new rhetoric that emerges from the work of Michel Foucault, who, according to Deleuze (1992), increasingly invested in a generalized pragmatics. At the end of the 19th century, most professional historians – wherever they existed – deemed history to be a form of knowledge ruled by a method that bears no resemblance with those most commonly traceable in the natural sciences. The bulk of the historian’s task was then frequently regarded as being the application of procedures frequently referred to as ‘historical method’. In the context of such an emerging interest on historical methods and methodology, at least three textbooks stand (...) out: Johann Gustav Droysen’s Grundriss der Historik (Outline of the Theory of History), Ernst Bernheim’s Lehrbuch der historischen Methode (Handbook of Historical Method), and Charles Langlois and Charles Seignobos’s Introduction aux études historiques (Introduction to the Study of History). These books were quite influential in Germany, France, and elsewhere, and they very much helped promote a general idea of historical method that would become relatively consensual among historians of many nationalities by the early 20th century. Such a relative agreement on historical method sponsored both the communication and the development of a sense of disciplinary identity among historians trained within different and sometimes conflicting national traditions. It was then partially extended, partially challenged, and surely made more complex when, from the 1920s on, social and economic historians became a good part of the historiographical establishment in many countries. -/- The three books by Droysen, Bernheim, and Langlois and Seignobos were already pieced together by Rolf Torstendahl, who studied them as a group of texts that, despite their differences, contributed to shape the developments outlined above. However, Torstendahl’s primary aim was to show how Droysen, Bernheim, and Seignobos all resorted to ‘method’ as a way to circumvent skepticism against the possibility of historical knowledge, rather than investigate the internal interrelationships between the three texts. In this chapter I follow precisely this latter, not yet taken, road, focusing on crucial cross-references between the Grundriss, the Lehrbuch, and the Introduction. I intend to show that, at a general level, the schemes of historical method found in these texts are largely convergent, and that this convergence is due to Bernheim’s reading of Droysen and to Langlois and Seignobos’s reading of Bernheim. I will attempt to do it through a regressive approach that starts with an analysis of the Introduction. Aspects of the editorial history and circulation of the three texts will also be briefly addressed, as a way to illustrate their special importance within the framework of early 20th century historical theory. Because my argument calls for a focus on the most general lines of Droysen’s, Bernheim’s, and Langlois and Seignobos’s schemes of historical method, I will, for the sake of consistency, refrain from analysing in-depth the complex epistemological and ontological arguments in which those schemes are nested. At the heart of Mizrahi’s project lies a sociological narrative concerning the recent history of philosophers’ negative attitudes towards scientism. Critics (e.g. de Ridder (2019), Wilson (2019) and Bryant (2020)), have detected various empirical inadequacies in Mizrahi’s methodology for discussing these attitudes. Bryant (2020) points out one of the main pertinent methodological deficiencies here, namely that the mere appearance of the word ‘scientism’ in a text does not suffice in determining whether the author feels threatened by it. Not all (...) philosophers use the term in ‘inherently negative’ (29) or pejorative ways. In this paper, I not only corroborate Bryant’s critical claim, but argue that Mizrahi’s response to this part of Bryant’s objection is inadequate. (shrink)

This chapter is devoted to the discussion of religious freedom and the anti-racist fight in the Black Diaspora in Latin America, considering the historical processes that involve such discussion, including legal apparatus such as Human Rights and local legislation. Therefore, as a starting point, we take the historical conditions of the emergence of Candomblé in Brazil, that are linked to the trafficking of enslaved African peoples and their resistance to keep alive in their memories, their religious beliefs and their (...) worldviews. Wherefore, it is a discussion in which religious freedom is not dissociated from the anti-racist struggle in the case of Brazil, where, in the 20th century, the myth of racial democracy is produced in the light of studies carried out by Gilberto Freyre in the midst of the 1922 post-week modernist movement. This comment text brings, at the end, a part of Surveiller et Punir (Discipline and Punish), which has not been translated into Portuguese and does not appear in more than 40 editions of the Brazilian translation. It is on the back cover of the original in French, as if it were an afterword, signed by the author himself, Michel Foucault, which more than 40 years ago published by Editions Gallimard, his first copies in February 1975. Two years later, the Brazilian (...) version was published, but without this part which contains the reflection that Foucault invites us to think about at the end of his work:“Can the genealogy of modern morality be drawn from a political history of bodies?”(Foucault, 1975, p. 318, my translation). In addition to this absence, in the text in Portuguese, we have to think about why Foucault chose to put it in the final part of the book? (shrink)

A essa abordagem subjazem as teses de que feita a crítica à teleologia moral, a história tem de ser compatível com a evolução, e de que a naturalização da história implica numa naturalização da moral.Palavras-chave: teleologia - moral naturalizada - plano da natureza - teoria da história - evolucionismo.: The text reconstructs the teleological-moral foundations for the constitution of the modern science of history. The key to that reconstruction is a scrutiny of Kant's idea of "plan of nature", which is investigated in the works of Adam Smith, Hegel and Marx. In order to criticize this idea, the paper discusses the thinking of Fukuyama and argues that the connection between democracy and liberal economy is best explained by the natural human inclination towards symmetry, rather than by the notion of recognition. It also argues that Fukuyama's project finds no support in the selection of species, whereas the desire for symmetry does. The theses that underlie this approach are that, once the critique of moral teleology has been made, history must be compatible with evolution and that the naturalization of history implies a naturalization of morals. To try to understand Nietzsche’s conception of Christianity is to try to understand his conception of morality, or to try to analyze, dissect, and diagnose the forces and the relation of forces that underly it, or permeate it. These forces characterize not only the reality as Nietzsche considers it, but also the dynamic of his own writing, thought, and perspective. This is the reason why we can affirm that Nietzsche’s thought and writing are essentially, intrinsically, paradoxical. Indeed, the Nietzschean text (...) unfolds as what constantly resists and escapes the order of discourse as such, which means that it would be a frustrating undertaking to seek a key that discloses and explicates the plurality of meanings that engender and determine the development of his writing. Paradoxically, Nietzschean thought reveals itself only to the extent that it is masked, reread, repeated, rewritten, and stripped of all attempts to master it. In other words, it progresses through a continuous intermingling of forces and, consequently, of values, interpretations, and significations that are unceasingly overcoming and surpassing each other. Latin American religious political thought includes colonial Spanish and Portuguese ideologies that preceded independence but have survived into the post-independence era, authoritarian ideologies supportive of military governments in the twentieth century, and progressive liberation theologies. In this article, I present a distinct tradition: a version of classical liberal thought. This tradition is skeptical of big government, opposed to caste systems, supportive of a high degree of federalism, uneasy with militarism, and supportive of democratic institutions while affirming religious social norms. This (...) ideology was developed in northeastern Brazil in the early nineteenth century by a Carmelite activist named Frei Caneca (Brother Mug), who published a newspaper titled the Typhis Pernambucano (Tiphys of the State of Pernambuco). Cosmopolis A Review of Cosmopolitics -/- 2015/3-4 -/- Editorial Dominique de Courcelles & Paul Ghils -/- This issue addresses the general concept of “spirituality” as it appears in various cultural contexts and timeframes, through contrasting ideological views. Without necessarily going back to artistic and religious remains of primitive men, which unquestionably show pursuits beyond the biophysical dimension and illustrate practices seeking to unveil the hidden significance of life and death, the following papers deal with a number of interpretations covering a (...) wide field extending from belief to theory, from emotions to concepts, from the wisdom of personal experience to the most sophisticated doctrines. Spirit and spirituality are indeed many-faceted notions. They may refer to the intricate world of the interacting spirits which inhabit living beings in animistic traditions, without excluding a “grand force” linking human beings within a dynamic whole on which their very existence rely . They also bear upon more atomistic and either/or approaches of Western philosophy, which have become embodied in Cartesian dualism against a monotheist background, to the point of freezing the essence of individuals and culminating in the extreme individualism that characterizes our contemporaries. However, this equally refers to the opposite conception of materialism, across times and cultures, from ancient India and Greece (Cārvāka, originally known as Lokāyata, or some Buddhist doctrines for the former, Democritus or Lucretius for the latter) to more contemporary materialistic schools, whether modern or postmodern. -/- The following papers look at the contrasting forms of the philosophy and spirit of the human factor set into a whole, with no artificial disjoint between the psychical and the physical levels, as Wittgenstein put it: “And how can a body have a soul?”. This approach is not unrelated to the notion of anthropocene examined in a recent issue of Cosmopolis, with provides another comprehensive framework open to a spiritual life emerging from the very environment that generated it. -/- *** The first section of this issue was edited by Dominique de Courcelles, director at the National French Research Centre (CNRS), whom we wish to thank for collecting relevant studies relating to the religious and political questions, with a view to focusing on the war of ideas inevitably waged behind images, concepts and perceptions, taking an asymmetrical approach. To the extent that they are mindful of global/local interactions and include representations, opinions and beliefs, such disciplines as philosophy, philology, history and social sciences can provide useful studies accounting for new practices in geopolitics and a fair diplomacy. -/- In her introduction, Dominique de Courcelles first poses the question of how the religious and political spheres interrelate, with their corresponding religious demands and humanistic values. He revisits to two philosophers, John Locke and Voltaire, who thought about it from the historical reality of religious wars. The former made tolerance into a right, basing his analysis on the political-legal level, while the latter saw tolerance as a duty, from an analysis based on ethical-political criteria. -/- Mathieu Guidère examines what he calls semantic denominationalism, a term which implies religious attributes and identities, whichever national loyalties or personal belonging they may have at the same time. Since the early 2000s, thie phenomenon has expanded tremendously, compounded by the “war on terror” and the over media-oriented terrorist actions. Denominational expressions act as formal names for ordinary and high-profile players in domestic and foreign policies of democratic states. These systems reveal a receding secularization, while the powerful comeback of religious identities signals the failure of nation-states and the weakening of the humanist spirit. -/- Barbara De Poli retraces the history of a contemporary jihadism claiming its Islamic essence and asserting the truth of genuine coranic principles via the war on infidels, with a view to restoring the Caliphate. After defining the term jihad, she shows that even if this contemporary jiadism is spreading in the Muslim world, it radically departs from Islamic law and the received use of the term jihad, in so far as it is rooted in the early radical thinking of Islamic ideologues in the 20th century, starting with with Hassan al-Banna, the founder of the Muslim Brotherhood. This current has been fueled by by international conflicts since the outbreak of the war in Afghanistan, in which the so-called Western countries bear a major responsibility. -/- Abderrazak Sayadi starts from the Tunisian experience to ask the question of humanist values and democracy within the relationships between the religious and political spheres. As a historian of religion, he is brought to demystify certain islamic principles and to paying attention to the reform of law, seeing the separation of religion and politics as a precondition to a successful democratic gamble and the establishment of a renewed humanism. -/- Dominique de Courcelles reminds us that getting a better knowledge of narrations and words makes it possible to better understand how logical and rhetorical thinking works for those who wage an asymetriccal war, re-enchanting and mystifying the world to better take control. As soon as 1932, an exchange of letters between Einstein and Freud made it clear that, in order to free man from fatality and war, education understood as culture was fundamental. Such illustrations as the exécution of Oussama ben Laden and the Caliph’s speech in Mossoul show that a premiminary analysis of images and words is essential to a fair diplomacy conducted by people from civil society, whose culture and wisdom allow justice and force to speak together and better resist war. -/- Marcel Boisard thinks that on the day the guns fall silent, exhausted by war, we will not return to the state borders that have prevailed for a century as an outcome of the Sykes-Picot agreement of 1916. It is time to prepare the “day after”, which will be a huge challenge. To this end, a summit of Middle-East nations is urgently needed to globally decide the fate of those peoples. On the condition that we know who the enemy is and accept to name it, to understand the history of the countries, groups and alliances, and to question any false or self-interested sense of certainty. -/- *** In the second section, Paul Schafer provides the author’s experiences to explain how culture, from the artistic to the biological, has the power to to open the doors to spirituality, from the inner self to the global environment. He asks himself whether a relative permanence of spirituality can arise from the specific moments that characterize it. Laurent Ledoux synthesizes the conclusion of a symposium held on 22 January 2015 on the links between philosophy and management, on the basis of the spiritual dimension conceived as “natural” and the answers it may suggest to the issues that face the organizations in a “contemporaniversal” world. Jacques Rifflet makes that question in a secular perspective, based on the wellsprings of personal commitment before it can be caught by any religious creed or scientific theory. In this sense spirituality, in alliance with reason, both inspires human consciousness and illuminates its destiny. Sami Aldeeb asks himself whether Islam can be reconciled with human rights. Caught between the belief in an absolute and final Word descended from the sky, and evidence showing that any religion is the creation of a given culture and a society situated in time and space, the Makkan and … contexts et médinois call for differentiated, if not opposite answers and exegeses. Bernard Carmona provides the outline of a dialogical framework, which is known to be a feature of debates between the various philosophical schools of classical India, exemplified here by the transdisciplinary perspective of debates within a Buddhist context. *** The articles not focused on the previous topic include a study by Landry Signé on China’s strategy, competing with the United States to control African resources. The author deals with the specific case of China’s rapprochement with Southern Sudan since Sudan was broken up. In the last paper, Goran Fejić and Rada Iveković, return to the essential role that women should play, and comments upon the role of some international legal instruments related in particular to the elimination of all forms of discrimination. The perspective is transnational and transethnic and is based on secular criteria, as regards nation-building and more generally society-building. Considering the persistence of widespread violence, whether in times of armed conflict or in times of peace, the question remains whether it is possible to fully implement rights and justice instruments. Gadamer explora el desarrollo histórico del concepto de belleza en los siglos XIX y XX, poniendo énfasis en que la belleza siguió y seguirá siendo (...) no sólo un concepto estético sino un concepto normativo. Por su lado, Marquard contextualiza las ideas de Gadamer en su marco de producción original y realiza un análisis crítico de las mismas a partir de sus propias tempranas contribuciones a una teoría de las “ya no bellas artes”.// Abstract: This text introduces the first Spanish translation of Hans-Georg Gadamer’s Schönheit [Beauty] (work written in the 1970s and posthumously published in German in 2007) and Odo Marquard’s Schönheit und Bürgerlichkeit [Beauty and Bourgeoisie], published also in 2007 as a delayed response to Gadamer’s views. Gadamer explores the historical development of the concept of beauty in the 19th and 20th centuries, emphasizing that beauty continued and will continue to be not only an aesthetic concept but also a normative concept. For his part, Marquard contextualizes Gadamer’s ideas in their original production framework and performs a critical analysis of them based on his own early contributions to a theory of the “no longer beautiful arts”. ABSTRACTThe question of how common usage could be constitutive for the meaning of linguistic expressions has been discussed by Renaissance philosophers such as Lorenzo Valla, and it also played an important role in Renaissance theories of juridical interpretation. An aspect of the analysis of common usage in Renaissance theories of juridical interpretation that concerns the role of presumption has not yet found much attention. Renaissance jurists such as Simone de Praetis, Nicolaus Everardus, and Aimone de Cravetta saw that both the (...) usage of Latin by practitioners of law and the vernacular common usage of ordinary people often differed from the technical definition of legal concepts as laid down by ancient jurists or modern legislators. In some cases, they ascribed both to Latin and to vernacular common usage the power of changing the meaning of juridical terms. Still, they were aware of the fact that matters of common usage involve always a degree of uncertainty. The methodological notion of presumption is one of the concepts that figured most prominently in Renaissance approaches to the problem of uncertainty, and, in particular, it was applied in the analysis of meaning-change of legal concepts through common usage. This paper considers the significance of the informal publication and circulation in the work of one of the most important analytic philosophers of the late 20th Century, Saul Kripke. I argue that everyday copying technologies such as tape recording and photocopying enabled academic philosophers in the 1970s and 1980s to create and reproduce living documents whose private preservation and circulation offered a way to make and maintain a community of interest, carve out a space for oral discourse and, most (...) significantly for histories of alternative print technologies, that these technologies and techniques of reproduction were essential to the composition of Kripke’s ground-breaking and revolutionary published work. The recording, transcripts and photocopies archived Kripke’s ideas and offered access to them outside of institutional publishing channels. Kripke lectured a great deal, usually without notes, and was known to be reluctant to commit his ideas to print; this ‘szamizdat’ (as he refers to it) also preserved a space for the oral as the preferred mode of communication for philosophical discourse, connecting the modern tradition with the ancients, an oral tradition held together with magnetic tape, typescript, photocopies, and digital text files. This archival study draws attention to the intermediality of Kripke's work through close examination of his acknowledgments, prefaces, and footnotes to work up a history of the everyday media inscriptions (the recordings, typescript transcriptions, photocopies etc.) and practices (the lectures, seminars, and international social networks of distribution) that underpin the production of both his published and unpublished work. This essay brings a media archaeological approach into contact with scholarship on the history of the book and intellectual history. It foregrounds the role of the oral and aural in the history of print and contributes to our understanding of circulation and reproduction as a cultural practices. (shrink)

During the 19th century, Emily Dickinson likely grappled with the intricate philosophical and theological responses to the metaphysical quandary of the body-soul duality. Philosophers constructed their arguments on empirical reasoning, contending that our bodies' existence equates to our existence. The soul, however, presented a challenge in terms of empirical evidence. Conversely, theologians championed the concept of the soul as an explanatory framework for the intricacies of the human mind. Their stance emphasized that just because the soul remains imperceptible does not (...) negate its existence; faith in both the soul and God was paramount. These two camps, philosophers and theologians, engaged in a spirited discourse. Theologians disapproved of what they perceived as the philosophers' reliance on mere intellectual speculation, while philosophers were disheartened by what they saw as fervent religious zealotry. Within this intellectual landscape, thinkers like Charles Peirce and William James engaged in lively debates at nearby Harvard University during Emily Dickinson's lifetime. In this paper, I argue that, in "I am Afraid to Own a Body," Emily Dickinson takes her speaker and readers on a transcendent journey, surpassing the limits of even the most eloquent philosophical discourse or theological teachings. The objective of this paper is to present the thesis of the Japanese-American philosopher and economist Francis Fukuyama, known as the “end of history”, to reflect on the central argument of this thesis that transhumanism represents a problem for democracy. Therefore, a conceptual analysis will be carried out, based on selected excerpts, of Fukuyama's works entitledThe end of history and the last man, Our posthuman futureand “Transhumanism”.

Ethical concerns in e-social science are often raised with respect to privacy, confidentiality, anonymity and the ethical and legal requirements that govern research. In this article, the authors focus on ethical aspects of e-research that are not directly related to ethical regulatory framework or requirements. These frameworks are often couched in terms of benefits or harms that can be incurred by participants in the research. The authors shift the focus to the sources of value in terms of which benefits (...) or harms are understood in real social situations. A central claim of this paper is that the technologies that are used for research are not value neutral, but serve to reinforce some values at the expense of others. The authors discuss databases, modelling and simulation, network analysis as examples of technologies which affect the articulation of values. A view of e-social science as a techno-scientific constellation of researchers, technologies and society, in which values are always already embedded, is put forward as a basis for a view of ethics as reflexive and active engagement, conducted with awareness. Methodological pluralism and proactive openness are also proposed as responses to this view of the ethical dimensions of e-social science. (shrink)

Developments in the realm of formal sciences and math foundations during the twentieth century were marked by important methodological advances. Such new approaches partialy owe their appearance to the abandonment of the previous paradigm. To identify how this transition occured, in this essay we observe some aspects regarding the works of Gödel and Tarski, who, under a certain interpretations, restructure epistemological bases of math's formalisms. It'll be argued that the theoretical variabilities produced in abstract sciences upon weakening previous viewpoints forced (...) to abandon some of the components of hegemonic programs. (shrink)

In this paper, I delve into the methodologies employed by scholars such as Otto Schrader, Krishna Belvalkar, Franklin Edgerton, and Vishwa Adluri to substantiate the potential existence of a Kashmiri recension of the Bhagavad Gita through the application of the lectio principle. The lectio difficilior, or "harder reading," posits that a more complex and challenging reading in a text is likely to be the older and superior one, as scribes tend to simplify intricate passages into more straightforward forms, known as (...) the lectio facilior, in later versions of a text. The lectio principle prominently shapes the discourse of these scholars regarding the plausibility of a Kashmiri recension of the Bhagavad Gita. (shrink)

This double side of the two dichotomies assures a deep comprehension of theoretical physics by avoiding both a purely philosophical analysis and a purely formal analysis, each manifestly insufficient for representing all the aspects of theoretical physics. Among the many formulations of a physical theory, e.g. Mechanics, also Mach(1) recognized technical differences only, Instead my suggestion is to consider their differences as revealing the characteristic features of their foundations. No more radical differences may exist than those concerning both their kinds of Mathematics and their kinds of Logic. As a fact, after the 20th Century within each of these sciences there exist two antagonist foundations, within Mathematics either the classical one or the constructive one(2); within Mathematical Logic either the classical logic or the intuitionist one(3). Let us take Mechanics as an instance. Being the choices of the Newton’s formulation respectively the actual infinity of the differential equations relying on the infinitesimals and the classical logic, a formulation based on the alternative choices is Lazare Carnot’s,(4) whose mathematics is no more than algebraic-trigonometric and the logic is the intuitionist one, because this formulation makes use of doubly negated propositions, whose corresponding affirmative propositions are idealistic or false; i.e. in these cases the law of double negation fails, as in intuitionist logic occurs. By considering these two dichotomies as the foundations of the physical theories, each couple of choices upon them fashions one out four models of scientific theory, which are baptized through the authors of their most representative theories: Newtonian, Carnotian, Lagrangian, Descartesian. In correspondence four versions of the principle of inertia are recognized, as suggested by respectively: Descartes. Lazare Carnot, Enriques and Cavalieri.(5) All that suggests that the four models of scientific theory may be graphically represented as a compass orientating our minds amid the so numerous physical theories. By taking these dichotomies as interpretative categories, a new interpretative history of Physics including both classical and modern physics results according to a quadrilinear development. The birth of modern physics is characterized by the two theories - Einstein’s paper on special relativity and Einstein’s first paper on quanta - whose choices are the alternative ones to those of the previously dominant physical theory, Newtonian mechanics: in the latter paper Einstein i) declares the dichotomy on the kinds of mathematics (“Introduction”) and then he chooses the discrete mathematics; ii) by using doubly negated propositions he organizes his theory in an alternative way to the deductive-axiomatic one.(6) Moreover, a new history of Philosophy of knowledge results. Kant’s first two a priori transcendental categories represent the physical interpretation of the two choices out of the four pairs of choices on the two dichotomies, i.e. the choices of the dominant theory of mechanics, Newton’s. Hegel’s dialectic was a misleading attempt of anticipating the subsequent intuitionist logic. The book starts by a comparison of different formulations of thermodynamics in order to recognize the first dichotomy on the kind of organization. In chapter 2 the dichotomy on the kind of infinity is recognized through a comparison of Newrton’s mechanics and Lazare Carnot’s. A quickly history of the other classical physical theories is illustrated in chapter 3; it results a foundational conflict between the last two theories, and hence a conflict between their opposite couples of choices. The two main theories of modern physics, special realtivity and quantum mechanics confirm the foundational role played by the two dichotomies which gives reason for the radical change in the history of theoretical physics. Indeed, the opposition of the two main pairs of choices gives reason of the crisis in theoretical physics in the early 1900s. As a global result, the book represents the first interpretation of the entire history of Physics, both classical and modern; This fact proves that the four models of scientific theories can works as a compass (that of the front cover) suggesting a direction among the many physical theories. This new history of physics leads to re-visit both Koyré’s and Kuhn’s historiographies. Their interpretative categories are interpreted and explained through the two dichotomies so that it is possible to suggest à la Koyré categories based on the alternative choices theories to Newton’s as the suitable categories for interpreting the alternative theories to Newton’s mechanics. All that suggests a new interpretation of the crucial step in the history of Western philosophy of knowledge, i.e. the passage from Leibniz to Kant: Leibniz’s suggestion of the two labyrinths of human minds may be seen as a close anticipation of the two above dichotomies. Kant applied them in order to construct the well-known four cosmological proofs, which however he misinterpreted as leading to contradictions, instead to tow different methods of investigation corresponding to the two different kinds of logic.(7) Bibliography 1. This article aims to understand the views of three prominent figures in existential literature and philosophy: Albert Camus, Søren Kierkegaard, and Fyodor Dostoevsky. The analysis focuses on exploring and explaining fundamental concepts of their philosophies, such as morality, the meaning of life, and the relationship with the divine, in order to establish a dialogue among these three authors. The underlying thread connecting these thinkers is the Socratic figure of speech, irony. Through the examination of contradictions and ironic elements present in (...) their works, the article highlights the significance of irony as a central core in their ideas, encompassing both academic discourse and the realms of literature and symbolism. The comparative method employed goes beyond contrasts, also emphasizing points of contact between the ideas expressed through the stages of existence and the personalities of the protagonists in their novels. The initial sections for each author introduce the basic concepts for general understanding. Subsequently, the main ideas are explored through analysis of their masterpieces, leading to a comparative dialogue among them. Contrasts involve the perspectives embodied by characters like Alyosha Karamazov, Meursault, and Zosima, showcasing the authors' opinions, reflecting the zeitgeist, and highlighting their divergences, ultimately providing a comprehensive view of how they influenced and criticized each other within the philosophical tradition. This paper explores the possibility of a standard legal language (e.g. English) for a principled evolution of law in line with technological development. In doing so, reference is made to blockchain networks and smart contracts to emphasise the discontinuity with the liberal legal tradition when it comes to decentralisation and binary code language. Methodologically, the argument is built on the underlying relation between law, semiotics and new forms of media adding to natural language; namely: code and symbols. In (...) what follows, I will concentrate on the study of factors that explain why such approach can be fruitful for the future of law and innovation. I have three reasons for selecting this topic. The first is a more pragmatic reason, based on my current research of law as a linguistic phenomenon. Secondly, the topic does also touch the matter on binary code language, rivalrous to legal alphabetic language. Lastly, the study aims at emphasizing the pivotal role of the jurist as an interpreter in a changing society accommodating diverging realms of reality. The study is structured as follows. Firstly, a quick exam of the traits of blockchain networks would provide the contextual link to establish the arguments in support of the need of a standard legal language. Secondly, a comparison between liberal legal institutions and theory of semiotics is set to perceive their functioning and ascertain their limits in the light of todays unprecedented changes. Thirdly, a summary on blockchain networks’ legal features would constitute the thrust behind the idea of a uniform legal language. Methodologically, the argument does also establish some relations with classical laws of physics and philosophy of media. Its aim is to demonstrate how the suggested legal interpretation and semiotic-based approach can contribute to overcome existing stumbling blocks including, but not limited to, the lack of cooperation at the international level as well as the gap in State norms when it comes to innovation. In this sense, the proposed strategies do not intend to replace current advances in the legal thought. In contrast, it seeks to harmonise their results providing a methodical approach that can concur to inform a new technique to address new controversial issues. In practice, the proposed method regarding the adoption of a uniform legal language would lower transactive costs in terms of normative coordination in the matter of international cooperation and in the definition of applicable law among different legal systems. Alternatively, it might contribute to the convergence of legal systems and/or their underlying concepts. Climate change is an existential risk reinforced by ordinary actions in afuent societies—often silently present in comfortable and enjoyable habits. This silence is sometimes broken, presenting itself as a nagging reminder of how our habits fuel a catastrophe. As a case in point, global warming has created a state of urgency among wine makers in Spain, as the alcohol level has risen to a point where it jeopardises wine quality and thereby Spanish viticulture. Eforts are currently being made to solve (...) this problem technologically by developing (non-GMO) strains of yeast that produce less alcohol. If successful, this could help save Spanish viticulture. This kind of technological solution is routinely criticised for ofering simplistic “techno-fx” solutions to solve complex societal problems. However, it is not clear what features are criticised by the notion of techno-fx and hence how to avoid this criticism. In our interpretation, the techno-fx notion is not exclusively used as a dismissive term. The notion points to a general virtue of engineering: to create technological solutions that work silently in the background. This asset of technological solutions might sometimes be problematic and sometimes not. Hence, it needs to be analysed case-by-case by paying attention to the moral relevance of the hidden implications of the technology and of the unrefective actions and habits that they facilitate. Such moral analysis will in turn inform strategies for foregrounding this technology to counteract silencing. We discuss what this means in the case of modifying yeast as a viticultural climate resilience strategy. (shrink)

In the late 18th and early to mid-19th century, the secular approach of certain German scholars towards the study of Sanskrit in Europe significantly impacted the creation of the Wales Professorship of Sanskrit at Harvard. This influence stood in stark contrast to the religious concerns of some English scholars. While these English academics were focused on assisting in converting Hindus to Christianity, their German counterparts were pioneering the field of comparative philology. This dynamic led to the establishment of the Boden (...) Professorship of Sanskrit at Oxford, the dominance of German scholars in teaching Sanskrit on the European continent, and the mentorship provided by German academics to early American scholars interested in studying India. These developments underscore the interplay between the secular, scholarly approach of German academics and the religious concerns of their English counterparts in the study of Sanskrit. (shrink)

Giacomo Leopardi, a major Italian poet of the nineteenth century, was also an expert in evil to whom Schopenhauer referred as a “spiritual brother.” Leopardi wrote: “Everything is evil. That is to say, everything that is, is evil; that each thing exists is an evil; each thing exists only for an evil end; existence is an evil.” These and other thoughts are collected in the Zibaldone, a massive collage of heterogeneous writings published posthumously. Leopardi’s pessimism assumes a polished form in (...) his literary writings, such as Dialogue between Nature and an Islander (1824)—an invective against nature and the suffering of creatures within it. In his last lyric, Broom, or the flower of the desert (1836), Leopardi points to the redeeming power of poetry and to human solidarity as placing at least temporary limits on the scope of evil. The educators of the 21st century have a great task ahead. In today’s world, the educators are expected to have a great deal of professional and personal qualities, and extraordinary skills. This descriptive-correlational study aimed to determine perceptions of college students on a well-qualified educator. The study included 123 selected college students from different colleges in Central Luzon, Philippines using a convenience sampling technique. As data collection tool, a questionnaire prepared by the researcher team was used. Some of the findings (...) of the study include: (1) the respondents answered agree on the context of professional and personal qualities that a teacher should have; (2) while in terms of the skills exhibited by an educator, it got an answer to Very Satisfactory. We also found significant differences in professional qualities, learning and innovation skills and life and career skills when grouped according to the respondent’s profile. There was low-to-moderate evidence of the relationship that existed between the qualities and skills of an educator. The results further confirmed the relationship through regression analysis and found that communication skills affect the qualities of an educator. Based on the results, we discussed and recommended practical suggestions on professional, personal and skills improvements of an educator. (shrink)

Resumo: O objetivo deste trabalho é compreender o funcionamento das dificuldades e dos obstáculos decorrentes dos procedimentos automáticos no desenvolvimento da teoria discursiva. Para esta tarefa, o material de análise é composto pelos textos analíticos resultados do projeto da Análise Automática do Discurso (AAD). A pesquisa toma o prisma de investigação da História das Ideias Linguísticas na relação com os princípios da Análise de Discurso, buscando o funcionamento discursivo do material em sua relação com os processos político-ideológicos nas suas formas (...) institucionais, disciplinares e textuais. Na releitura do arquivo disciplinar, cotejando com algumas notas, relatos e contextualizações, são descritos aspectos menos conhecidos sobre a história da AAD, mostrando a força do que é designado neste artigo como um “materialismo discursivo” desenvolvido também pelo seu encontro com a automatização/informatização. Abstract: The objective of this paper is to understand the functioning of difficulties and obstacles from automatic procedures in the development of the discursive theory. For this task, the analysis material is composed by the analytical texts of the Automatic Analysis of Discourse (AAD) project. The research takes the investigative prism of the History of Linguistic Ideas in relation with the principles of Discourse Analysis, seeking the discursive functioning of the material in its relationship with the political-ideological processes in their institutional, disciplinary and textual forms. In the rereading of the disciplinary archive, collating with some notes, reports and contextualizations slight known aspects of the history of AAD are described, showing the strength of what is designated in this paper as a “discursive materialism” developed also by its encounter with automation / informatization. This essay considers how scholarly approaches to the development of molecular biology have too often narrowed the historical aperture to genes, overlooking the ways in which other objects and processes contributed to the molecularization of life. From structural and dynamic studies of biomolecules to cellular membranes and organelles to metabolism and nutrition, new work by historians, philosophers, and STS scholars of the life sciences has revitalized older issues, such as the relationship of life to matter, or of physicochemical inquiries to (...) biology. This scholarship points to a novel molecular vista that opens up a pluralist view of molecularizations in the twentieth century and considers their relevance to current science. (shrink)

The first work that René Descartes wrote was the Compendium Musicæ in 1618, this was his first experiment with the future cartesian method. As a work of youth, the author must have studied music in your education, mainly in the college of La Flèche. Conventionally, the work of Gioseffo Zarlino had been considered the main source, because was cited in the Compendium. Since the text starts with music´s definition and eight propositions, about which the rest of work was developed; check (...) the way that them appear in other treatises of the time could help to deduce the possible musical sources that the author used.This dissertation starts with a necessary reconstitution of philosophical and musical context of the epoch, followed by an analysis of jesuits conceptions of knowledge and music. In this way, it can be considered what motivated the author to write about music, as his the debates. In resemblance to his mature work, the text proposes a methodological turn that is only perceived with the context of the time in mind. After an interpretation of the definition of the music and the eight propositions, it could be possible compare with the others works form the epoch to verify his musical sources. With this process, it could evidence the influence of Aristotle, Aristoxenus, Jean de Murs, Pontus de Tyard, Gioseffo Zarlino and Francisco de Salinas. (shrink)

The history of the science of the stars (astronomy and astrology) in fourteenth-century Byzantium is significantly intertwined with the implications of theological and philosophical controversies. A less-explored astronomical text authored by the fourteenth-century Byzantine scholar Theorodos Meliteniotes (ca. 1320–1393 CE) provides new historical factors toward a historiography of the differences between scientific and theological discourses, their development in the transition to early modern times, and the different historical developments of science in the worlds of the Eastern and Western Churches.
