A legal system’s ‘official story’ is its shared account of the law’s structure and sources, which members of its legal community publicly advance and defend. In some societies, however, officials pay lip service to this shared account, while privately adhering to their own unofficial story instead. If the officials enforce some novel legal code while claiming fidelity to older doctrines, then which set of rules—if either—is the law? We defend the legal relevance of the official story, on largely (...) Hartian grounds. Hart saw legal rules as determined by social rules accepted by a particular community. We argue that this acceptance requires no genuine normative commitment; agreement or compliance with the rules might even be feigned. And this community need not be limited to an official class, but includes all who jointly accept the rules. Having rejected these artificial limits, one can take the official story at its word. This paper aims to measure the quality of all Romanian cities’ websites in 2019 and 2022, before and after the disruptive event of COVID-19. Since the official websites are the core instrument of e-governance, the changes in the quality of Romanian cities’ websites reflect the changes in the development of urban e-governance in Romania. The COVID-19 lockdowns and contact restrictions and the moving of most activities into the online environment had the potential to impact the performance of Romanian cities’ websites (...) significantly and catalyze the progress of local e-governance. The quality of Romanian cities’ official websites was measured using an adapted survey instrument proposed by Holzer and Kim and Manoharan, Melitski, and Holzer. The tool covers five critical criteria of website quality or performance: personal data security, usability, content, services, and citizen participation. The research results may seem contrary to expectations: the improvements of websites have been incremental rather than transformational. Although our research provides only a case study, we may assert that the reform of traditional administration remains a step-by-step process. Our study’s main contribution consists in showing that the progress of e-governance is an incremental process even in a situation of emergency that requires the moving of most activities into the online environment. It is the intention of this paper is to introduce some contemporary relevance of Descartes’ dualism with special reference to Gilbert Ryle’s criticism. Ryle’s explicit target in The Concept of Mind is what he calls the “official doctrine”, which results, he tells us, at least in part from Descartes’ appreciation that Galilean methods of scientific discovery were fit to provide mechanical explanations for every occupant of space, together with Descartes’ conviction that the mental could not simply be a more complex (...) variety of the mechanical. Whether or not every aspect of the resulting “two-world” view is properly attributed to Descartes. It is familiar view, which has widely become known as Cartesianism in Anglo-American philosophy. One of the lessons of the COVID-19 pandemic is that the lay public relies immensely on the knowledge of public health officials. At every phase of the pandemic, the testimony of public health officials has been crucial for guiding public policy and individual behavior. The reason is simple: public health officials know a lot more than you and I do about public health. As lay people, we rely on experts. This seems straightforward. But the COVID-19 pandemic has (...) shown that public health officials seem undecided as to what, precisely, their role is; are they providing the public information as it presents itself, or are they informing the public in a way that produces a desired or optimal outcome? In this article, I answer the following question: what are public health officials morally obligated to tell the public? As I see it, these are the main options: (1) public health officials should tell the full truth, regardless of outcome; or (2) they should tell partial truths or lies that are aimed to promote a socially optimal outcome. My answer to this question is that public health officials are only allowed to lie under very narrow and rare conditions. -/- . (shrink)

Emergency situations require individuals to make important changes in their behavior. In the case of the COVID-19 pandemic, official recommendations to avoid the spread of the virus include costly behaviors such as self-quarantining or drastically diminishing social contacts. Compliance (or lack thereof) with these recommendations is a controversial and divisive topic, and lay hypotheses abound regarding what underlies this divide. This paper investigates which cognitive, moral, and emotional traits separate people who comply with official recommendations from those who don't. In (...) four studies (three pre-registered) on both U.S. and French samples, we found that individuals' self-reported compliance with official recommendations during the COVID-19 pandemic was partly driven by individual differences in moral values, disgust sensitivity, and psychological reactance. We discuss the limitations of our studies and suggest possible applications in the context of health communication. (shrink)

I examine the impact of the presence of anarchists among key legal officials upon the legal positivist theories of H.L.A. Hart and Joseph Raz. For purposes of this paper, an anarchist is one who believes that the law cannot successfully obligate or create reasons for action beyond prudential reasons, such as avoiding sanction. I show that both versions of positivism require key legal officials to endorse the law in some way, and that if a legal system can continue (...) to exist and function when its key officials reject the reason-giving character of law, then we have a reason to re-examine and amend legal positivism. In “The Applied Epistemology of Official Stories” (2023), Tim Hayward offers a thorough and convincing rejection of Neil Levy’s claim that we ought to defer to official stories from relevant epistemic authorities. In this response, I take no issue with Hayward’s criticism of Levy. Rather, I suggest that Hayward’s position could go further, and he already implies a deeper problem with the concept of an ‘official story’. In fact, I’m so swayed by several of his claims against things called ‘official (...) stories’, that, in this essay, I investigate the feasibility of a generalist position towards ‘official stories’. This study aims to examine the Islamic Theological School that was opened in Nicosia back in 1932 to meet the chaplain needs of the Cypriot Muslims. In this context, how the Islamic Theological School was welcomed among the groupings of the period, its physical structure, teaching staff, and students were all addressed within the framework of the education program and the closure process. The "Foundation Files" in the National Archives and Research Department in the TRNC and the newspaper collections of (...) the period and the "British Colonial Documents" in the Archives of the General Directorate of the Foundations of Cyprus are the main sources of our research. Documentation method, which is one of the qualitative research methods, was used in the study. In this context, the documents that could be accessed in the researches related to the subject of the study are examined and described for the objectives of the study. In conjunction with the madrasas in Cyprus becoming dysfunctional until the end of the 1920s, the wrecked Great Madrasah building in Nicosia, which had the purpose of training personnel such as imams, preachers, chaplains and muezzins for the mosques, was demolished and a school called Islamic Theological School was built instead. The opening of the Islamic Theological School led to important debates between the two opposition groups of the time, the Halkçılar and the Evkafçılar. Halkçılar are the group of people who advocate the adoption of the revolutions and reforms of the newly established Turkish Republic also by Turkish Cypriots. For this reason, they strongly criticized the opening of the Islamic Theological School on the grounds that it would cause reactionism and bigotry. On the other hand, the concept of Evkafçılar is used for people who represent tradition and are close to the current British rulers. Evkafçılar advocated the opening of the Islamic Theological School by stating that it was a social need. Accordingly, both groups used the press effectively as a means of conveying their own thoughts. The halkçı group used the newspapers called "Söz" and "Masum Millet" and the evkafçılar group used the newspaper called "Hakikat" as a means to convey their views to the society. In the shadow of the discussions between the two groups, the Islamic Theological School, which was built in 1932 in place of the wrecked Great Madrasah building in the northeast of Selimiye (Hagia Sofia) Mosque in Nicosia, was built as a single-floor building and a gable roof system was used on its roof. Funds were appropriated by Education (Hatib Ahmed Efendi) Foundation for supplying the school's materials such as tables, chairs, cabinets, sofas, and armchairs. In 1932, when the Islamic Theological School began educating, there were only three professors and one teacher in its teaching staff. Hürremzâde Hakkı Efendi, one of the professors, was both the school director and the Fatwa Emin. One of the other professors was an imam and the other one was a fatwa clerk. And Muallim Ahmed Fehim Efendi undertook the duty of imamate. According to the documents examined, the aforementioned faculty members have taught religious and human sciences-oriented courses in the school. As far as we can identify from the documents open to research in the archives, in the years between 1932 and 1950, when the Islamic Theological School was open, a total of 11 students were educated in this school. In the first year of this school, which started education with three students only, students were given a monthly scholarship of 15 shillings. In addition, the students were both able to practice as assistants to muezzins in the mosques during the month of Ramadan and they were also provided with economic support. After graduation, the students were nominated as imams, muezzins and devirhan. The Islamic Theological School was closed in 1950 because there was no student demand. Despite the fact that 11 people received education in 18 years between the school's opening year 1932 and 1950, and the annual reports published by General Directorate of Foundations stated that the Islamic Theological School continued its services satisfactorily under the upervision of its Fatwa Emin, these statements were unrequited in reality. The Islamic Theological School started to serve in the shadow of the debates between the opposition groups of its time. The parties of the discussions are divided into two groups: Halkçılar and Evkafçılar. The first group opposed the opening of the school by claiming that the financial resources of the General Directorate of Foundations would be spent unnecessarily and that the students to be educated would be raised with reactionism and bigoted ideas. The second group, Evkafçılar, approached the issue with a need-centred approach and defended the necessity of a school to educate religious officials. The mentality of the populist group reflects the ideology of the young Turkish Republic and this is clearly seen in their defence mechanisms. Evkafçılar, on the other hand, did not pay the required attention to the Theological School despite their discourses of necessity. As a result, the power struggle of these two groups aiming to hold the leadership of the Turkish Cypriots caused the Theological School to be adversely affected. Very low salaries of religious officials working in existing mosques and low fees being paid to the graduates of the Theological School who were employed in mosques were other factors that reduced the demand for Theological School. As a result, those who saw low-paid religious officials who had difficulty even getting along did not seek education to become religious officials and their families never pointed such way to them. The fact that a very limited number of students attended Theological School did not lead General Directorate of Foundations to alternative solutions. As the Islamic Theological School was not well organized, the issue of religious officials was felt more and more by the muslim people in the following years in Cyprus where many villages do not even have religious officials. In his recent article in Philosophy and Public Affairs, 'The Paradox of Voting and Ethics of Political Representation', Alexander A. Guerrero argues it is rational to vote because each voter should want candidates they support to have the strongest public mandate possible if elected to office, and because every vote contributes to that mandate. The present paper argues that two of Guerrero's premises require correction, and that when those premises are corrected several provocative but compelling conclusions follow about the rationality (...) of voting and duties of elected officials: (A) Voting is typically rational for the members of a political party’s base; (B) Voting is often (but not always) irrational for “swing” voters (i.e. independent voters who are not affiliated with any political party, as well as “undecided” voters who are considering voting across party lines); and (C) Elected officials have a moral duty to respond to changing levels of popular support once in office, as indicated by properly monitored and corroborated public opinion polls of constituents, functioning more as delegates the lower their level of popular support. Finally, I suggest that the last of these conclusions has wide-ranging implications for political ethics. I illustrate these implications by focusing on the questions -- under debate in the 2016 US Presidential election cycle -- of whether a sitting President has a moral duty to nominate or not nominate a new Supreme Court justice during his or her final year in office, and similarly, whether US Senators have a moral duty to obstruct, or not obstruct, confirmation of the President’s eventual nominee. What is well known is that people will show automatic, unconscious physiological and psychological responses to just about anything they are exposed to—images, sounds, touch, odors, ideas, (...) people. So muscle reading to find out their true feelings is not radical at all, unlike using it as a dousing stick (more muscle reading) to do “paranormal science”. Hawkins describes the use of decreasing tension in the muscles of an arm in response to increases in cognitive load thus causing the arm to drop in response to the constant pressure of someone’s fingers. He seems unaware that there is a long established and vast ongoing research effort in social psychology referred to by such phrases as ‘implicit cognition’, ‘automaticity’ etc., and that his use of ‘kinesiology’ is one tiny section. In addition to muscle tone (infrequently used) social psychologists measure EEG, galvanic skin response and most frequently verbal responses to words, sentences, images or situations at times varying from seconds to months after the stimulus. Many, such as Bargh and Wegner, take the results to mean we are automatons who learn and act largely without awareness via S1 and many others such as Kihlstrom and Shanks say these studies are flawed and we are creatures of S2. Though Hawkins seems to have no idea, as in other areas of the descriptive psychology of higher order thought, the situation regarding “automaticity” is still as chaotic as it was when Wittgenstein described the reasons for the sterility and barrenness of psychology in the 30’s. According to Warriner (1969) a simple way of defining land reforms is to name it “the redistribution of property or rights in land for the benefit of the landless, tenants and farm labourers”. Land reforms are mainly characterised by the government’s change of laws, regulations or customs regarding land ownership. Land reforms deal with the government in power distributing property which is in most times agricultural land. In some instances it also involves the distribution of land from the more powerful (...) or wealthy group of people such as nobles and bourgeoisie and giving potions of the land to the less powerful in society especially during the start of the post-colonial error in most countries in Southern Africa. During the pre-colonial period, land or pieces of land belonged to different ethnic groups, clans and lineages but now in the post-colonial land reform programs were to introduce individual ownership of land. There are many reasons why the government (both colonial and post-colonial) embark on land reforms and some of the factors influencing them include political reasons such promoting communism or socialism, social reasons such as separating the blacks from the whites and creating social stratification and economic reasons such as facilitating private investments and raising the country’s economic growth of the agricultural sector just but to mention a few reasons. Though some of the government’s reasons to embark on land reforms appear to be noble, local communities refuse these land reforms since they create social stratifications, at times increase poverty, destroy the matrilineal societies and are more political in nature rather than a means to better the people’s lives especially during the colonial error. The essay below will vividly portray why the government embarks on land reform programs and why local people resist these reforms using examples from both colonial and post-colonial Southern African countries. The official definition of ‘pain’ by the International Association for the Study of Pain (IASP) hasn’t seen much revision since its publication in 1979. There have been various criticisms of the definition in the literature from different quarters: that the definition implies a dubious metaphysical dualism, that it requires a strong form of consciousness as well as linguistic abilities, that it excludes many vulnerable groups that are otherwise perfectly capable of experiencing pain, that it has therefore unacceptable practical as well (...) as ethical consequences, that it is unhelpful to the health-care professional as an operational definition, that it is too narrow, and many others. In my view, most of these criticisms depend on misunderstandings or on uncharitable interpretations. My aim is to go over the definition, clarify some potential ambiguities, and argue that these criticisms don’t cut much ice. At the end, I will present a few slightly reworded versions of the definition that I claim are more felicitous and capture the original intended meaning by the members of the taxonomic committee in a much better and transparent way that avoids all the major extant criticisms in the literature. The official definitions that appear at the beginning of four of the five parts of the "Ethics" do not include an account of "existence." However Spinoza does provide a definition of “existence” in the scholium to proposition 45 of Part 2. This is an odd place for such an important doctrine, and all the more so given that the account there differs from anything resembling commonsense. A particularly important, pressing, philosophical question concerns whether Confederate monuments ought to be removed. More precisely, one may wonder whether a certain group, viz. the relevant government officials and members of the public who together can remove the Confederate monuments, are morally obligated to (of their own volition) remove them. Unfortunately, academic philosophers have largely ignored this question. This paper aims to help rectify this oversight by moral philosophers. In it, I argue that people have a moral obligation to (...) remove most, if not all, public Confederate monuments because of the unavoidable harm they inflict on undeserving persons. In the first section, I provide some relevant historical context. In the second section, I make my unique harm-based argument for the removal of Confederate monuments. When you type the word “serendipity” in a word-processor application such as Microsoft Word, the autocorrection engine suggests you choose other words like “luck” or “fate”. This correcting act turns out to be incorrect. However, it points to the reality that serendipity is not a familiar English word and can be misunderstood easily. Serendipity is a very much scientific concept as it has been found useful in numerous scientific discoveries, pharmaceutical innovations, and numerous humankind’s technical and technological advances. Therefore, there (...) have been many books written around the concept. So why do we need this additional book? This is not just another book about serendipity. It has evolved from the Editor’s question lingering for a decade after finishing his widely cited article (coauthored with Prof. Nancy K. In recent years official Roman Catholic documents have addressed the ecological crisis from the perspective of Catholic social teaching. This expansion of Catholic social thought addresses the social and ecological question. This paper links environmental and human ecology with the concept of sustainability and proposes an interpretation of the common good and a definition of sustainability within Catholic social teaching. Our treatment of sustainability and Catholic social teaching includes: an analysis of the ecological processes that sustain nature; insights from human (...) ecology, and an examination of models of sustainability as a foundation for re-structuring society to promote the common good. The paper provides a summary of the historical expansion of the common good within modern Catholic social thought, and concludes with an ecological interpretation of the common good and a definition of sustainability within the Catholic understanding of justice. The practice of official apology has a fairly poor reputation. Dismissed as ‘crocodile tears’ or cheap grace, such apologies are often seen by the public as an easy alternative to more punitive or expensive ways of taking real responsibility. I focus on what I call the role-playing criticism: the argument that someone who offers an apology in public cannot be appropriately apologetic precisely because they are only playing a role. I offer a qualified defence of official apologies against this objection, (...) considering them through the lens of fiduciary duties. This focus draws our attention to formal or impersonal relationships that are nevertheless normatively rich, capable of sustaining trust, concern, and care. At the same time, I highlight several pitfalls for fiduciary apologisers, including the tension between apology as a mode of truth telling and the duty of confidentiality. I consider whether the fiduciary apologiser, in reflecting on her fiduciary obligations, has ‘one thought too many’ for genuine apology, and argue that the issue of mixed motives is not limited to fiduciary contexts, cautioning against excessive idealism in our conception of apology. I conclude with some reflections on possible conflicts between fiduciary obligations and the conscientious desire to apologise. (shrink)

The official birth of hysterical anorexia is attributed to the French alienist Ernest Charles Lasègue (1816-1883). Starting from his 1873 article, anorexia as a ‘new’ psychopathological picture is subjected to extensive clinical and theoreticalstudy. This paper is not an analysis about the process through which anorexia was formalized as specific psychiatric condition. Rather, it focuses on another important issue: the possibility that the ‘same’ disorder may have different meaning depending on the historical period considered. Furthermore, it is asserted that the (...) study of every pathological form is conditioned by social, individual and cultural conditions. For example, in the same year the English Sir William Gull publishes a paper about “anorexia nervosa” which is described in a different way depending on the different perspective. Lasègue’s description is a way of seeing a kind of sufferance, that is he ‘sees’ this pathology through the hysterical paradigm. Starting from these considerations, this article discusses the construct of ‘hysterical anorexia’ trying to understand why, in late nineteenth century France, hysteria and anorexia were viewed as two aspects of the same specific disorder. Finally, it is discussed why anorexia gradually emerged as an independent mental disorder just after the death of Charcot (1893). (shrink)

In the Essay Concerning Human Understanding, Locke insists that all knowledge consists in perception of the agreement or disagreement of ideas. However, he also insists that knowledge extends to outer reality, claiming that perception yields ‘sensitive knowledge’ of the existence of outer objects. Some scholars have argued that Locke did not really mean to restrict knowledge to perceptions of relations within the realm of ideas; others have argued that sensitive knowledge is not strictly speaking a form of knowledge for Locke. The Catholic Church never officially endorses political candidates but rather respects the freedom of its faithful to vote according to the dictates of their conscience. However, in the last presidential elections, some Catholic bishops and priests in the Philippines publicly and openly supported the presidential candidacy of Vice President Leni Robredo while urging the rest of the faithful to do the same. These bishops and priests anchored their position on their shared belief that voting for Robredo was the only rightful (...) and moral option because of her clean track record, non-involvement in any act of corruption, and principled approach in governance. In contrast, her political archnemesis Ferdinand “Bongbong” Marcos, Jr. had long been embroiled in several allegations of corruption, non-payment of taxes, and fakery of educational attainments. Hence, for these bishops and priests, voting for Marcos Jr. was both wrong and immoral. And yet, the election results hit them with a big “slap in the face,” as more than 31 million Filipinos (majority of whom are Catholics) cast their votes for Marcos Jr., while only 15 million voted for Robredo. This outcome, no doubt, raises the question: Why did the repeated calls of these bishops and priests go unheeded? In this paper, I will attempt to answer this question by subjecting the political moralism of these Catholic leaders to some objective postmodern evaluation. To do this, I will employ the postmodern thoughts of Nietzsche, Lyotard, and Rorty as a lens to examine why many Filipino Catholics today no longer buy the political moralism of their religious leaders. The suite of secretive national security programs initiated in the US since 9/11 has created debate not only about the merits of targeted killing, torture, secret detention, cyberwar, global signals intercepts, and data-mining, but about the very secrecy in which these programs were conceived, debated by government officials, and implemented. Law must be revealed to those who are expected to comply with its demands. Law is a mere pretext for coercion if the laws permitting the government to coerce people (...) for non-compliance are concealed. The purpose of this essay is to determine whether inhabitants of a liberal state—a type of state tracing the legitimacy of its coercive actions to the consent of the governed—also need to know the internal protocols and legal findings of the government agencies ostensibly serving them. To put this question another way, what, if anything, may government agencies in liberal states keep secret? (shrink)

The verb to legitimate is often used in political discourse in a way that is prima facie perplexing. To wit, it is often said that an actor legitimates a practice which is officially prohibited in the relevant context – for example, that a worker telling sexist jokes legitimates sex discrimination in the workplace. In order to clarify the meaning of statements like this, and show how they can sometimes be true and informative, we need an explanation of how something that (...) is officially illegitimate can have a kind of ersatz legitimacy conferred on it, and how this can occur even when the actor ‘doing the legitimating’ lacks formal authority. I examine one putative explanation centred around the phenomenon of normalization, and I highlight some advantages that this account has in comparison to an alternative explanation, one that makes reference to the phenomenon of licensed authority. During the coronavirus pandemic, communities have faced shortages of important healthcare resources such as COVID-19 vaccines, medical staff, ICU beds and ventilators. Public health officials in the U.S. have had to make decisions about two major issues: which infected patients should be treated first (triage), and which people who are at risk of infection should be inoculated first (vaccine distribution). Following Beauchamp and Childress’s principlism, adopted guidelines have tended to value both whole lives (survival to discharge) and life-years (survival (...) for years past discharge). This process of collective moral reasoning has revealed our common commitment to both Kantian and utilitarian principles. For Kant, respecting people’s rights entails that we ought to value whole lives equally. Therefore we ought to allocate resources so as to maximise the number of patients who survive to discharge. By contrast, the principle of utility has us maximise life-years so that people can satisfy more of their considered preferences. Although people are treated impartially in the utilitarian calculus, it does not recognise their equal worth. Subjecting Kantian ethics and utilitarianism to the process of reflective equilibrium lends support to the idea that we need a pluralistic approach that would accommodate our moral intuitions regarding both the equal value of whole lives and the additive value of life-years. One of the primary concerns in animal research is ensuring the welfare of laboratory animals. Modern views on animal welfare emphasize the role of animal sentience, i.e. the capacity to experience subjective states such as pleasure or suffering, as a central component of welfare. The increasing official recognition of animal sentience has had large effects on laboratory animal research. The Cambridge Declaration on Consciousness (Low et al., University of Cambridge, 2012) marked an official scientific recognition of the presence of sentience (...) in mammals, birds, and cephalopods. Animal sentience has furthermore been recognized in legislation in the European Union, UK, New Zealand and parts of Australia, with discussions underway in other parts of the world to follow suit. In this paper, we analyze this shift towards recognition of sentience in the regulation and practice in the treatment of laboratory animals and its effects on animal welfare and use. (shrink)

In this paper, I propose a critique of the naturalist version of the Desire-Based Reasons Model. I first set the scene by spelling out the connection between naturalism and the Model. After this, I introduce Christine Korsgaard’s circularity argument against what she calls the instrumental principle. Since Korsgaard’s targets, officially, were non-naturalist advocates of the principle, I show why and how the circularity charge can be extended to cover the naturalist Model. Once this is done, I go on to investigate (...) in some detail the different ways of responding to the circularity challenge. I argue that none of these responses succeed, at least not without serious costs to their advocates. I then end the paper with a brief summary and some concluding remarks. (shrink)

There is an internal connection between ecclesiology, the teaching about the Church that we call academic ecclesiology, and mission, which is the inner heart of the Church and becomes visible through different practices. For the Orthodox Church involved in the ecumenical movement, there is a struggle to balance ecclesiology (theology) with ecumenical mission and dialogue (practice) in a divided Christian world. Nevertheless, the recent Synod of Crete (June 2016) addressed some important elements of this struggle. I have in mind, for (...) example, the act to accept the historical name of other non-Orthodox Christian Churches and Confessions that are not in communion with it. Also, this is the first Synod of the Orthodox Churches in modern times at which ecumenical dialogue, especially in the World Council of Churches, is officially affirmed. Because of mission dialogue has to continue, “if we wish never to ‘put an obstacle in the way of the gospel of Christ’ (1 Cor 9:12).” The present paper highlights those statements of the Holy and Great Council which have direct relevance for discussing the relation of ecclesiology and mission. I assert that we should understand firstly the document Relations of the Orthodox Church with the Rest of the of the Christian World and only then reflect upon The Mission of the Orthodox Church in Today’s World (MOCT). Furthermore, I will make some references to the other texts which were central for this conference: The Cape Town Commitment (CTC), Together Towards Life (TTL) and Apostolic Exhortation Evangelii Gaudium (EG). I conclude by exposing briefly my reflections after reading these mission documents and by formulating some agenda points for further work in theology of mission. (shrink)

After a fatal police shooting in the United States, it is typical for city and police officials to view the family of the deceased through the lens of the law. If the family files a lawsuit, the city and police department consider it their legal right to defend themselves and to treat the plaintiffs as adversaries. However, reparations and the concept of “reparative justice” allow authorities to frame police killings in moral rather than legal terms. When a police officer (...) kills a person who was not liable to this outcome, officials should offer monetary reparations, an apology, and other redress measures to the victim’s family. To make this argument, the article presents a philosophical account of non-liability hailing from self-defense theory, centering the distinction between reasonableness and liability. Reparations provide a non-adversarial alternative to civil litigation after a non-liable person has been killed by a police officer. In cases where the officer nevertheless acted reasonably, “institutional agent-regret” rather than moral responsibility grounds the argument for reparations. Throughout the article, it is argued that there are distinct racial wrongs both when police kill a non-liable black person and when family members of a black victim are treated poorly by officials in the civil litigation process. There is a need to bring about a revolution in the philosophy of science, interpreted to be both the academic discipline, and the official view of the aims and methods of science upheld by the scientific community. At present both are dominated by the view that in science theories are chosen on the basis of empirical considerations alone, nothing being permanently accepted as a part of scientific knowledge independently of evidence. Biasing choice of theory in the direction of simplicity, unity (...) or explanatory power does not permanently commit science to the thesis that nature is simple or unified. This current ‘paradigm’ is, I argue, untenable. We need a new paradigm, which acknowledges that science makes a hierarchy of metaphysical assumptions concerning the comprehensibility and knowability of the universe, theories being chosen partly on the basis of compatibility with these assumptions. Eleven arguments are given for favouring this new ‘paradigm’ over the current one. (shrink)

Many times, what we say proves to be wrong. It might turn out that what we took to be a comforting remark was, in fact, making things worse. Or that a joke was inappropriate. Or that yelling out loud was rude. More importantly for this paper, there are plenty of cases in which what we said turns out to be false: we spoke without paying attention, we were misinformed or tricked, or we made a reasoning mistake. -/- A particular instance (...) of this latter phenomenon is when someone changes their perspective and doesn't find their previous assertions true anymore. For example, imagine that you used to like licorice as a child, and that you went around saying things like "Licorice is tasty." But, growing up, you find licorice too strong and quite boring; your tastes have changed. While the taste of licorice itself has not changed, you are not going around anymore uttering "Licorice is tasty." In fact, in certain cases, you might even think that what you said in your childhood was wrong - at least in light of your present preferences. -/- Sometimes we "take back" the assertions we made when we realize they are no longer true. Such speech acts of taking back can be performed in various ways: more formally, as effected in a court of law or when an official speaks to the press, or more informally in our day-by-day interactions. These acts of taking back are known as retraction. Retraction is usually achieved by employing certain linguistic markers ('I was wrong', 'I was mistaken', 'I retract', "Scratch that' etc.) that signal that the retractor takes their previous speech act to be faulty in a certain way. -/- This phenomenon has formed the basis for a popular argument used by relativists about a variety of natural language expressions (predicates of taste, epistemic modals, moral and aesthetic claims etc.) in support of their view. Recently, several considerations (mostly from contextualists about the same expressions), both from the armchair and based on empirical studies, have been offered to undercut the support retraction was thought to provide for relativism. In this paper, I consider and re-evaluate that support in light of both types of considerations, showing that neither of them decisively undermines it. However, to survive the contextualist counterattack, the relativist needs to pay a price: that is, she will be forced to make some concessions or rethink certain claims. I show what I think those concessions should be and what needs to be rethought (and how). The upshot is that, while the support retraction offers relativism is not as strong as initially believed, appeal to retraction remains a legitimate move in the debate. In section 1, I introduce the views in the debate and clarify the phenomenon of retraction and its dialectical role. Some academics and state officials in Indonesia argue for the adoption of Pancasila as a scientific paradigm for the country's scientific endeavours. They believe that using Pancasila as a foundation could give Indonesian science a distinct and unique character. However, this article seeks to reevaluate the feasibility of Pancasila as a scientific paradigm. By reviewing the literature on Pancasila and the philosophy of science, it arrives at the conclusion that Pancasila cannot serve as a scientific paradigm, either in a (...) narrow or comprehensive sense. Two primary reasons support this conclusion. Firstly, Pancasila lacks the necessary characteristics of a well-established scientific achievement. As a result, it cannot function as a scientific paradigm in the narrow sense defined by Kuhn. Secondly, Pancasila carries theological baggage that surpasses science’s capacity to accommodate it. This aspect prevents Pancasila from becoming a comprehensive scientific paradigm. Consequently, I propose that Pancasila is more suitable as an axiological basis for science, rather than a scientific paradigm. Unlike a scientific paradigm, this axiological foundation does not fall within the epistemic scope of science. (shrink)

Tainted political symbols ought to be confronted, removed, or at least recontextualized. Despite the best efforts to achieve this, however, official actions on tainted symbols often fail to take place. In such cases, I argue that political vandalism—the unauthorized defacement, destruction, or removal of political symbols—may be morally permissible or even obligatory. This is when, and insofar as, political vandalism serves as fitting counter-speech that undermines the authority of tainted symbols in ways that match their publicity, refuses to let them (...) speak in our name, and challenges the derogatory messages expressed through a mechanism I call derogatory pedestalling: the glorification or honoring of certain individuals or ideologies that can only make sense when members of a targeted group are taken to be inferior. This paper is a study of Conspiracy Theory, the theory according to which the causes which explain the occurrence of many events and phenomena are not the officially advertised causes which the public media present us with; rather, the events and phenomena in question should be viewed as the work of agents and agencies that operate in secret in the service of projects that may or not be publicly known. The paper discusses the relation between theory and evidence and compares (...) conspiracy theories to others, especially scientific theories. Two conclusions emerge. Firstly, a theory should not be rejected merely on the ground that it is a conspiracy theory. This article focuses on issues relating to legal normativity, emphasizing the way these matters have been elaborated in the works of Kelsen and Hart and later commentators on their theories. First, in Section 2, the author offers a view regarding the nature of law and legal normativity focusing on Kelsen's work (at least one reasonable reading of it). The argument is that the Basic Norm is presupposed when a citizen chooses to read the actions of legal officials in a (...) normative way. In this Kelsenian approach, all normative systems are structurally and logically similar, but each normative system is independent of every other system – thus, law is, in this sense, conceptually separate from morality. Second, in Section 3, the author turns to Hart's theory, analyzing the extent to which his approach views legal normativity as sui generis. This approach raises questions regarding what has become a consensus view in contemporary jurisprudence: that law makes moral claims. The author shows how a more deflationary (and less morally-flavored) understanding of the nature of law is tenable, and may, in fact, work better than current conventional (morality-focused) understandings. SUMMARY The research focuses on the three main political parties in Albania, namely Socialist Party, Democratic Party and Socialist Movement for Integration. Its objectives are to measure the Intra-Party Democracy(IPD) in the Albanian political parties and to explore the meaning that party members attach to it. The IPD is understood and broken down into categories and sub-categories so that parties in particular and all interested actors in the field of political parties and democracy could understand, which component of IPD parties (...) are performing better and where they are performing worse. IPD is measured against two dimensions: inclusiveness and decentralization. Inclusiveness denotes the extent to which party members have the right to express their opinions and participate in the decision-making process. With decentralization is understood the process which makes possible the decentralization of the decision-making process from the highest national party level to party sub-national levels and party members. In a decentralized party, subnational party units enjoy a certain level of autonomy from the party in the center. The analysis is based on both primary and secondary data. Content analysis of party statutes particularly focuses on measuring IPD, while focus groups with party members and interviews with high-ranking officials of the political parties are used to explore the meaning that party members have on IPD, as well as validate content analysis findings. The main findings are: -/- Content Analysis of Party Statutes: Parties do have rules that govern their internal life, however these rules need to be improved in order to strengthen IPD. Especially problematic were the provisions for the role of the executive committee and party president, which provide these two institutions, especially the leader of the party with powers that don’t hold him/her accountable to the party members and middle level organs. Furthermore, members were not sufficiently involved in the procedures of candidate nominations for MPs, in the election of the national Executive and Executive Committee and in the election of the Party President. The analysis also finds that voting procedures are not sufficiently at place to allow members express their will and participate in the decision-making process and that members are not or little consulted in terms of programmatic issues. The analysis of the relationship between the national and subnational levels of party organization revealed that the center of the party has accumulated power to the detriment of the subnational units which enjoy little autonomy in the decision-making process. -/- Focus Groups and Interviews: The study finds that party members linked system-level democracy with IPD and that they have a very clear understanding if IPD: what it is and how it could be achieved. They linked IPD with the structure and organization of the party, seeing it as an important instrument that allows for decentralization of power and integration of rank and file into the decision-making process. The party members considered the statute as an important educational political tool and invoked it whenever disputes rose or decisions had to be taken. They linked IPD with the electoral system and considered that closed list proportional was a system that strengthened the power in the hands of the few at the party top executive level and weakened IPD. According to Jago (2014a), logical omniscience is really part of a deeper paradox. Jago develops an epistemic logic with principles of indeterminate closure to solve this paradox, but his official semantics is difficult to navigate, it is motivated in part by substantive metaphysics, and the logic is not axiomatized. In this paper, I simplify this epistemic logic by adapting the hyperintensional semantic framework of Sedlár (2021). My first goal is metaphysical neutrality. The solution to the epistemic paradox should not require (...) appeal to a metaphysics of truth-makers, situations, or impossible worlds, by contrast with Jago’s official semantics. My second goal is to elaborate on the proof theory. I show how to axiomatize a family of logics with principles of indeterminate epistemic closure. (shrink)

In this article, I discuss a trivialization worry for Hartry Field’s official formulation of the access problem for mathematical realists, which was pointed out by Øystein Linnebo. I argue that various attempted reformulations of the Benacerraf problem fail to block trivialization, but that access worriers can better defend themselves by sticking closer to Hartry Field’s initial informal characterization of the access problem in terms of general epistemic norms of coincidence avoidance.

The speech act of inquiry is generally treated as a default kind of asking questions. The widespread norm states that one inquires whether p only if one does not know that p. However, the fact that inquiring is just one kind of asking questions has received little to no attention. Just as in the declarative mood we can perform not only assertions, but various other speech acts, like guesses or predictions, so in the interrogative mood we can also make various (...) speech act types. I propose a speech-act-theoretic account of a distinct kind of question that I label exam questions. According to the proposed account, one performs an exam question p only if (i) one has access to the answer to p, and (ii) one does not officially know whether the hearer knows the answer to p. Exam questions satisfy all the necessary requirements of being a distinct kind of speech act. Additionally, my proposal contributes to the recent expansion of the normative approach to a variety of speech acts. (shrink)

Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. The traditional Javanese tembangs created by Sunan Kalijaga, especially Lir ilir and Kidung Rumekso ing Wengi, have an extraordinary depth of philosophical meaning when associated with Javanese culture. Therefore, this research aims to explore and analyze the philosophical meanings contained in the two tembangs and find out how the spiritual messages in the tembangs are still relevant to the conditions of society in the modern era. The sources of data for this research are (1) interviews with Sunan Kalijaga's descendants, artists (...) in Demak Regency, Demak Regency officials, (2) historical records and scientific articles about Sunan Kalijaga, and (3) direct observation in Demak Regency. This research uses Ferdinand de Saussure's semiotic theory to find out the deeper meaning of the text of the two tembangs. For data validation, this research uses the triangulation method, in order to compare all available data and find a common thread of reliability to be presented as scientific data. In the interpretation stage, the researcher tried to explore the messages contained in the two tembangs, which were analyzed from the lyrics of the tembangs and the opinions of experts found in Demak Regency. The results show that both tembangs contain philosophical teachings on how to achieve wisdom and peace in every episode of human life. They also teach about the importance of establishing a good relationship with God. In addition, this study also revealed that the spiritual messages in these two tembangs are still relevant as a reflection of everyone's spiritual journey in the modern era. (shrink)

The political actions of Martin Heidegger raise a compelling question to those concerned with philosophy: How was one of the most important philosophers of the 20th century willing to ally himself with Nazism and what does this mean for philosophy? This question has been raised and brushed aside from the end of the Second World War, when Heidegger was formally accused for his involvement with Hitler's regime and forbidden to attain any official teaching position henceforth. Important thinkers, like his colleague (...) and friend in the pre-war years, Karl Jaspers. testified then against him. But Heidegger's fame rose again above his indignity in the 1950s, when Hannah Arendt in the USA and Jean-Paul Sartre in France, among others, began once again to spread the word of his philosophy and translate his works. These problems have recently intensified after the posthumous publication of Heidegger's Black Notebooks (Schwarze Hefte) in 2014, containing his notes from 1931-1941. Their publication caused seismic tremors in the field of philosophy, with Heidegger's opponents considering themselves finally vindicated by his own pen, and his supporters trying to separate thinking from actual life. However, the influence of Heidegger's thought - as well as that of other representatives of German anti-humanist nationalistic conservatism, such as Oswald Spengler - continues to spread, not only in academic but also in broader social and political circles. In the face of this spreading influence, which is combined with the influence of some disciples such as Nick Land or Giorgio Agamben, a biographical-type confrontation is not enough. We should confront Heidegger directly at the core of his philosophy. We cannot afford to ignore him or bury him under superficial gossip. Instead, we should confront him philosophically. We might be able to clear the ground for such a confrontation, if we resort to the philosophical concepts of autonomy, temporality, and human freedom. In my opinion, the most important philosophical challenge to Heideggerian thought, in this context, has been expressed by Cornelius Castoriadis. In the following chapters, I will argue in favor of this position, outlining the Castoriadian philosophy of time in contrast to the Heideggerian and highlighting the main points of their opposition. The book is divided into two parts. Part one, "Castoriadis against Heidegger" deals with the basic concepts and arguments of both philosophers around human existence, the individual, society, and temporality. We start by presenting Heidegger's scandal in the social-historical context but also with the help of Hannah Arendt's last assessment of the thinker. We move on to outline the basic concepts and structures of Heidegger's philosophical thinking in parallel with Castoriadis' criticism as regards politics, ontology and technoscience. Part two, "Time and existence" first examines the relevant approaches of Lukacs and Ricoeur in comparison to Heidegger and Castoriadis, to elucidate the basic concept of temporality and then presents an outline of Castoriadis' insights on time and existence, before finally applying these concepts to contemporary social-historical phenomena that redefine and transform human existence and social temporalities, like space exploration, digital cyberspaces and online communications. //////// -/- "This book is a tour de force that excites those who agree or disagree with the philosophy of Heidegger. Standing is a peculiar norm, allowing for deflecting that is rejecting offhand and without deliberation interventions such as directives. Directives are speech acts that aim to give directive-reasons, which are reason to do as the directive directs because of the directive. Standing norms, therefore, provide for deflecting directives regardless of validity or the normative weight of the rejected directive. The logic of the normativity of standing is, therefore, not the logic of invalidating directives or of competing with directive-reasons but of (...) ‘exclusionary permission’. That is, standing norms provide for permission to exclude from practical deliberation directive-reasons if given without the requisite standing, regardless of their normative weight. As such, standing is a type of second-order norm. Numerous everyday practices involve the deflection of directives, such as pervasive practices of deflecting hypocritical and officious directives. Of various possible models, the one that best captures the normative structure of these practices of deflection is the standing model. Accordingly, the normativity of standing is pervasive in our everyday practices. Establishing that standing, although a neglected philosophical idea, is a significant and independent normative concept. (shrink)

What does it mean to intentionally not perform an action? Is it possible to not perform an action out of resistant intention? Is there sufficient language for talking about this kind of behavior in the social sciences? In this article, a nonnormative vocabulary of not doings including resistant intentional omissions is developed. Unlike concepts that describe official, overt, and public resistance, James Scott’s everyday resistance and Albert Hirschman’s exit have made it possible to talk about the resistant inactions of agents (...) in the social sciences. But in order to grasp the ordinariness of this kind of oppositional behavior, philosophy of intentional omissions is used. (shrink)
