The subject of this essay-based dissertation is Hume’s natural philosophy. The dissertation consists of four separate essays and an introduction. These essays do not only treat Hume’s views on the topic of natural philosophy, but his views are placed into a broader context of history of philosophy and science, physics in particular. The introductory section outlines the historical context, shows how the individual essays are connected, expounds what kind of research methodology has been used, and encapsulates the research contributions of (...) the essays. The first essay treats Newton’s experimentalist methodology in gravity research and its relation to Hume’s causal philosophy. It is argued that Hume does not see the relation of cause and effect as being founded on a priori reasoning, similar to the way in which Newton criticized non-empirical hypotheses about the causal properties of gravity. Contrary to Hume’s rules of causation, the universal law does not include a reference either to contiguity or succession, but Hume accepts it in interpreting the force and the law of gravity instrumentally. The second article considers Newtonian and non-Newtonian elements in Hume more broadly. He is sympathetic to many prominently Newtonian themes in natural philosophy, such as experimentalism, critique of hypotheses, inductive proof, and the critique of Leibnizian principles of sufficient reason and intelligibility. However, Hume is not a Newtonian philosopher in many respects: his conceptions regarding space and time, the vacuum, the specifics of causation, the status of mechanism, and the reality of forces differ markedly from Newton’s related conceptions. The third article focuses on Hume’s Fork and the proper epistemic status of propositions of mixed mathematics. It is shown that the epistemic status of propositions of mixed mathematics, such as those concerning laws of nature, is that of matters of fact. The reason for this is that the propositions of mixed mathematics are dependent on the Uniformity Principle. The fourth article analyzes Einstein’s acknowledgement of Hume regarding special relativity. The views of the scientist and the philosopher are juxtaposed, and it is argued that there are two common points to be found in their writings, namely an empiricist theory of ideas and concepts and a relationist ontology regarding space and time. Inspired by american pragmatism and Hans Joas' proposal of an affirmative genealogy, I argue in this paper that a genealogical inquiry (both on the biografical and on the historical level) can explain what motivates individuals to moral agency better than Kantian moral philosophy, without renouncing an historically-informed conception of universal moral values.

The critical target of my paper is the normativist stance of Kantian meta ethics. After a very short introduction, I develop a characterization of contemporary mainstream Kantism as a conjunction of a normativist claim, a rationalist claim and a proceduralist claim. In the subsequent section I make the case against the normativist claim by drawing a counterexample, and defend the relevance of such counterexample as a reason that defeats the appeal of the Kantian approach to meta ethics. I finally conclude (...) by highlighting the main reasons why the challenge my counterexample rises are not answerable within a Kantian framework. (shrink)

The main goal of this dissertation is to offer both an interpretation to the theory of singular representations as presented by Leibniz in his writings from the 1680’s, as well as a hypothesis of a criticism made by Kant to what we take to be the cornerstones of such a theory. These cornerstones consist in (i) the Principle of Identity of Indiscernibles (ii) the Doctrine of the Complete Notion of the Individual Substance (iii) the Intensional Definitions of the Truth Values. Once the writings in which (ii) and (iii) are presented only began to be published in the XIX century, we argue in favor of the plausibility of such a hypothesis by means of logical arguments, which intend to show that Kant could have deduced (ii) and (iii) from Leibniz’ commitment to (i) as well as to the existence of a parfaite représentation of ordinary objects in the divine understanding, and historical arguments, which intend to show that Kant could have had access to both (ii) and (iii) and even ascribed these to Leibniz by means of Meier’s Auszug aus der Vernunftlehre and Wolff’s Philosophia Rationalis sive Logica. We will add to these, also textual arguments in order to show that there is in Kant’s philosophy not only a critique to (i), but also to (ii) e (iii), as well as an interpretation of what this criticism consists in. This philosophical anthropology tries to explore the basic categories of man’s being in the worlds using a special quantum meta-ontology that is introduced in the book. Quantum understanding of space and time, consciousness, or empirical/nonempirical reality elicits new questions relating to philosophical concerns such as subjectivity, free will, mind, perception, experience, dialectic, or agency. The authors have developed an inspiring theoretical framework transcending the boundaries of particular disciplines, e.g. quantum philosophy, metaphysics of consciousness, philosophy of mind, phenomenology of space and (...) time, and ontological relativity. The thesis examines the theoretical relationship between law and ethics. Its methodology is informed by both the existentialist tradition of ethical phenomenology and the natural law tradition in legal theory. The main claim of the thesis is that a phenomenological analysis of ethical experience, as suggested by the writings of existentialist authors such as Jean-Paul Sartre and Emmanuel Levinas, provides important support for the natural law tradition. This claim is developed and defended through detailed engagement with the natural law theory (...) of John Finnis. Specifically, I contend that Finnis’ account of moral reasoning as applying the principles of practical reasonableness to a context of self-evident, basic values gains significant support from a phenomenological theory of ethical experience. Finnis’ emphasis on the irreducible role of choice in moral deliberation also finds support in the existentialist tradition. However, I criticise some key aspects of Finnis’ theory, including his emphasis on the transcendental character of the basic values and his account of legal obligation. I begin by outlining some central features of the existentialist approach to philosophy. I advance an interpretation of existentialism as ethical phenomenology. I then discuss some possible methodological connections between the existentialist and natural law traditions. This discussion provides the methodological framework for the remainder of the thesis. The thesis develops and defends a substantially original theory of the relationships between law, ethics and politics. The exposition begins with an account of the relationship between law and community that draws upon the work of Finnis and G. W. F. Hegel. I then outline a phenomenological theory of ethical experience, drawing in particular on the writings of Sartre and Levinas. I employ this phenomenological account of ethics to develop a conception of moral reasoning as reflective, good faith engagement with pre-reflective social judgements of ethical significance. This view of ethical experience and moral reasoning is then used as the basis for an examination of the concept of law and its relationship to political discourse. I turn next to the notions of legal authority and obligation. I argue that law, in the focal sense of the term, presents a generic, peremptory obligation that is necessarily moral in character. In the course of the argument, I critically discuss the conceptions of legal authority proposed by Joseph Raz, Adolf Reinach, H. L. A. Hart, John Rawls, Finnis, Jacques Derrida and Hans Kelsen. This view of legal obligation entails there are fundamental moral conditions that positive rules must satisfy to qualify as law, in the focal sense. I explore the nature of the moral framework created by these conditions through a detailed analysis of the ethical foundations of political discourse. I argue that political discourse is founded upon an ontological apprehension of the nature of humans as free, ethical beings, which finds expression in a developed notion of political freedom. I suggest that the distinction between positive and negative forms of freedom advanced by Isaiah Berlin is best understood in terms of the different types of political claims invoked by those conceptions. I develop this theory by reference to the work of Charles Taylor, Gerald C. MacCallum, Wesley Newcomb Hohfeld, W. D. Ross, Robert Nozick and F. A. Hayek. I conclude by discussing the role of ethical experience in the interpretation of legal materials. I argue that ethical judgements play an irreducible role in constructing the natural interpretive context for judicial reasoning. I engage with the work of Hart, Lon L. Fuller, Martin Heidegger, Hans-Georg Gadamer, Ferdinand de Saussure and Ronald Dworkin, among others. In the final substantive chapter of the thesis, the potential for ethical judgements to play a constructive role in judicial action is illustrated through a detailed discussion of the doctrine of government neutrality. Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)

Philosophy becomes speculative when it raises questions about the ultimate nature of being and thought. What does it mean to be? What does it mean to think? How are being and thought related? What does it mean to ask these questions? These questions have occupied a central place in philosophy throughout history, but have led a shadow existence in twentieth-century thought, which has cut the tie between reason and these fundamental questions, leaving the questions in the twilight, and reason instrumentalised. (...) A.N. Whitehead (1861-1947), one of the founders of analytic philosophy and co-author (with Bertrand Russell) of Principia Mathematica, is one of the few contemporary thinkers to have developed an explicit speculative philosophy. Unsurprisingly, his philosophy has played a marginal role in academic debates. In this study, the methodological foundation of Whitehead’s speculative thought is reconstructed. On the basis of a systematic and historical examination of the nature of the question of being, Whiteheads ontology of the event as the passage into novelty emerges in its full scope, allowing the reader to understand why and to what extent Whitehead has walked a different path than other contemporary thinkers. His philosophy contains a conception of reason that is not alien to newness and creativity while being more than procedural or pragmatic, and a mode of understanding existence that brings out the acuteness of freedom, value and legitimacy, as well as the unity of things, of thought and nature. In order to show what is really happening in this philosophy, the received interpretation of Whitehead’s ontology is radically dismantled. The central thought, that to be means to happen, is explained in a process of reiteration and gradual clarification, examining traditional philosophical problems in metaphysics and epistemology (on topics like: nature and matter, knowledge, categorical structure, freedom and necessity, truth and meaning, modality) from its perspective. What emerges is a philosophy in which the temporality of being, when taken seriously, changes the status of familiar problems and dualisms and offers possibilities for thought, which previously did not exist. Whitehead “hears” the classical questions of philosophy in a new way. Beyond the trenches of twentieth-century philosophy, Whitehead’s speculative thinking contains many elements that will be of value to those studying the foundations of thought today and looking for new directions. In a time when the dualism of nature and man is maintained cynically in our economies and dismantled, but only in a biologistic fashion and therefore only seemingly, as a cover-up, in science and philosophy, Whitehead’s new and creative way of hearing, and answering, old questions about ultimate concerns, when understood properly, is more up to date than ever before. Some artworks are called sublime because of their capacity to move human imagination in a different way than the experience of beauty. The following discussion explores how Van Gogh’s The Starry Night along with some of his other late landscape paintings accomplish this peculiar movement of imagination thus qualifying as sublime artworks. These artworks constitute examples of the higher aesthetic principles and must be judged according to the cosmological-aesthetic criteria for they manage to generate a transition between ethos and phusis (...) and present them in unity. Here, referring to Heraclitean, Kantian, Nietzschean and Heideggerian metaphysics and aesthetics, I propose that the principles of motion and transition be the new cosmologic-aesthetic categories for the judgment of sublime artworks as well as for the understanding of the world (Weltanschauung) they represent. Kant makes a much-unexpected confession in a much-unexpected place. In the Criticism of the third paralogism of transcendental psychology of the first Critique Kant accepts the irrefutability of the Heraclitean notion of universal becoming or the transitory nature of all things, admitting the impossibility of positing a totally persistent and self-conscious subject. The major Heraclitean doctrine of panta rhei makes it impossible to conduct philosophical inquiry by assuming a self-conscious subject or “I,” which would potentially be in constant motion like (...) other thoughts. For it rules out the possibility of completely detached reasoning which necessitates an unchanging state of mind. In this paper, Kaplama uses panta rhei to critically examine the philosophical shortcomings and contradictions of Kantian and Enlightenment ethics. In his examination, he specifically focuses on the teleological nature of Kant’s principle of freedom and ideal of moral autonomy which have dominated the Enlightenment thought. By doing so, he argues that it is essentially inaccurate to posit Überlegenheit (the state of being superior to nature) as the foundation of philosophical inquiry mainly because this would contradict the Enlightenment’s claim to constitute a rupture from classic and medieval metaphysics and would render Enlightenment a mere extension of Christian metaphysics. As in Christianity, Überlegenheit presupposes two separate realms, the actual (contingent) and ideal (pure) realms of thought and assumes that the transcendence commences from the level of the late metaphysical/teleological construction of the ‘subject’ who is completely persistent, self-conscious and immune to change. He then substantiates these points with reference to the philosophical roots of ethnic prejudice displayed by the post-Enlightenment colonialists and the missionaries in Fiji and the Pacific. This brief critical examination of the post-Enlightenment ethnocentrism will be conducted under the following three points: a) On the Enlightenment’s teleological and universalistic understanding of humanity and the concept of progress versus the Fijian concepts of the continuity of life, regeneration, and reproduction b) On the Enlightenment’s ideal of the free-willing and independent individual subject versus the Fijian ideas of 'the cord', reciprocity, and vanua, and c) On the Enlightenment’s (and Christianity’s) strict dualism between physics and metaphysics, nature and human mind, body and soul versus the Fijian bio-centrism, the sanctity of vanua and the cosmological concept of mana. the article explores the putatively non-metaphysical – non-voluntarist, and even non-causal – concept of freedom outlined in Hegel’s work and discusses its influential interpretation by robert Pippin as an ‘essentially practical’ concept. I argue that Hegel’s affirmation of freedom must be distinguished from that of Kant and Fichte, since it does not rely on a prior understanding of self-consciousness as an originally teleological relation and it has not the nature of a claim ‘from a practical point of view’.

This paper aims to evidence the meaning of “ontology of present”, a concept elaborated by Michel Foucault, and intends to elucidate the philosopher’s idea that subjectivity is historically formed. The context of the concept’s emergence will be analyzed, considering Foucault’s studies on the ancient greco-roman moral, in which he discuss the role of liberty and autonomy in the development of citizens. To the philosopher, the ontology of present consists in a critic of the domination and subjugation mechanisms, produced by disciplinary (...) and control societies. With this critic, Foucault pictures theoric tools to analyze the actuality, making possible to transform the historical processes of subjectification. This thesis seeks to understand the nature of and relation between science and philosophy articulated in the early work of the French philosopher Gilles Deleuze. It seeks to challenge the view that Deleuze’s metaphysical and metaphilosophical position is in important part an attempt to respond to twentieth century developments in the natural sciences, claiming that this is not a plausible interpretation of Deleuze’s early thought. The central problem identified with such readings is that they provide an insufficient explanation of the (...) nature of philosophy’s contribution to the encounter between philosophy and science that they discern in Deleuze’s work. The philosophical, as opposed to scientific, dimension of the position attributed to Deleuze remains obscure. In chapter 1, it is demonstrated that this question of philosophy’s contribution to intellectual life and of how to differentiate philosophy from the sciences is a live one in Deleuze’s early thought. An alternative, less anachronistic interpretation of the parameters of Deleuze’s early project is offered. The remaining chapters of the thesis examine the early Deleuze’s understanding of the divergence between philosophy and science. Chapter 2 gives an account of Deleuze’s metaphilosophy, alongside a reconstruction of his largely implicit early understanding of science. The divergent intellectual processes and motivating concerns that account for Deleuze’s understanding of the differentiation of science and philosophy are thus clarified. In chapter 3, Deleuze’s use of mathematical and physical concepts is examined. It is argued that these concepts are used metaphorically. In chapter 4, the association between modern science and the Deleuzian concept of immanence that has been proposed by some Deleuze scholars is examined and ultimately challenged. The thesis concludes with some reflections on the significance of Deleuze’s early work for contemporary debates concerning the future of continental philosophy and the nature of philosophy more generally. This paper is founded on a close reading of Kant’s Opus Postumum in order both to explore the essential motivation that drove Kant to write a last comprehensive magnum opus and, by doing so, to show the essential link between his aesthetics and the idea of Übergang, the title of this last work. For this work contains not only his dynamical theory of matter defining motion as preliminary to the notions of space and time, and the advanced version of his (...) philosophy of natural science, but also his arguments for the phenomenal validity of the metaphysical foundations, his teachings on the aesthetic human faculties of judgment and Anschauung, and the discernment of the transcendental philosophy from Platonic idealism carrying it to a cosmological level, i.e. Kant’s insertion of the concept of cosmotheoros. Since the process of transition is an aesthetic process based on human senses, intuitions and judgments, the argument will follow that in order to explicate Übergang, we need to reconcile cosmology, as the oldest branch of philosophy dealing with the interactions between the cosmic forces and the ways they affect human life, with aesthetics, as the youngest branch of philosophy dealing with how we sense, intuit and judge the form and motion of matter. Therefore, in the last analysis, Übergang becomes rather a cosmologic-aesthetic principle similar to the Heraclitean logos. Another building block of the paper is the fruitful comparison between the Kantian sublime and Nietzschean Dionysian, which are going to be construed as the aesthetic theories on human understanding representing the transition from nature to art. For they are not only conceptual – aesthetic but also dynamic – cosmological theories due to their reference both to nature and to human nature. (shrink)

Originally published in 1996, this book presents and analyses children’s reasonings about fundamental metaphysical problems. The first part describes dialogues with children that were constructed on the basis of Descartes’ _Mediations on First Philosophy_ and which look at children’s ideas about the relationships between true and false knowledge, mental images and physical objects, mind and body, personal existence and the external world, dreams and reality, and the existence of the Supreme Being, among others. The second part of the book draws (...) on concepts that children of various ages have about psychological and metapsychological aspects of human reality such as: cognitive and moral development; personal freedom and responsibility; the relationships between conscious and unconscious; living and non-living; and about the fundamental drives of an individual for development and expansion of his or her needs and passions, for eternal life, and for the dreamlike world of fulfilled wishes. The book presents a systematic empirical and theoretical study of the problems, some of which were touched on in Piaget’s early writing but which he later abandoned and which were only sporadically illuminated by other authors, whereas others were completely new to research in developmental psychology at the time. It will still be a helpful guide for developmental psychologists, teachers, educationalists, social workers, lawyers, and other professionals interested in the knowledge that 4- to 14-year-old children have about the most fundamental aspects of reality and human beings. This article calls into question the notion that seventeenth-century authors such as Descartes and Leibniz straightforwardly conceived the mind as something "outside" nature. Descartes indeed did regard matter as distinct from mind, but the question then remains as to whether he equated the natural world, and the world of laws of nature, with the material world. Similarly, Leibniz distinguished a kingdom of final causes (pertaining to souls) and a kingdom of efficient causes (pertaining to bodies and motions), but the question (...) remains as to whether he equated nature with the second kingdom alone, or included both kingdoms within nature. Although Kant sundered Leibniz's envisioned connection between the two kingdoms, even he did not place mind fully outside nature. (shrink)

Like all reasoning, practical reasoning is a process that takes a person from some of her existing mental states to a new mental state. Theoretical reasoning concludes in a belief; practical reasoning in an intention. This paper concentrates on instrumental reasoning, a species of practical reasoning in general. It argues that instrumental reasoning is correct if the content of the reasoning is a valid derivation, just as theoretical reasoning is correct if its content is a valid derivation. It also argues (...) that neither theoretical nor practical reasoning gives a reason for its conclusion. If a piece of reasoning is correct, it concludes in a state - a belief or an intention - that is rationally required by the states it is derived from, but rationally requiring a conclusion is not the same as giving a reason for it. Luciano Floridi develops the first ethical framework for dealing with the new challenges posed by Information and Communication Technologies. He establishes the conceptual foundations of Information Ethics by exploring important metatheoretical and introductory issues, and answering key theoretical questions of great philosophical interest.

This paper proposes a new reading of the interaction between subjectivity, reflection and freedom within Foucault’s later work. I begin by introducing three approaches to subjectivity, locating these in relation both to Foucault’s texts and to the recent literature. I suggest that Foucault himself operates within what I call the ‘entanglement approach’, and, as such, he faces a potentially serious challenge, a challenge forcefully articulated by Han. Using Kant’s treatment of reflection as a point of comparison, I argue that Foucault (...) possesses the resources to meet this challenge. The key, I contend, is to distinguish two related theses about reflection and freedom: Foucault’s position is distinctive precisely because he accepts one of these theses whilst rejecting the other. I conclude by indicating how this reading might connect to the longstanding question of Foucault’s own right to appeal to normative standards. (shrink)

An existential interpretation of student angst in Chinese universities raises issues of autonomy and freedom. The governance arrangements in China create a conflict for Chinese students who in their coursework are urged to become critical-minded and open-minded. In this essay, Kant’s moral theory provides access to this phenomenon. His theory of duty–rationality–autonomy–freedom relates the liberty of thought to principled action. Kantian ideals still influence western business and university practice and they become relevant in China as that country modernises. The abilities (...) of graduates which officials say the country needs—insightfulness, creativity, innovation, progressiveness and commitment—are only achievable by professionals who are independent minded, rational and who commit to act on their own conclusions. Such people are Kant’s autonomous persons. Chinese students increasingly confront a conflicted educational environment. Universities require students to think, analyse and argue. An outcome of this deliberation is freedom, as construed by Kant as an ‘inner’construct. When students are unable to exercise Kantian freedom in matters which concern them they experience the angst of freedom. Students may carry a burden derived from bridles on information and authoritarian restrictions on dialogue. (shrink)

My aim in this paper is to analyze the way in which Edmund Husserl deals with the problem of the constitution of image in his writings. The difference between a common thing and a work of art lies in the fact that the ‘thing’ is submitted as an object to perception, while the work of art is the product of the human capacity called imagination or fantasy (Phantasie). Therefore, the difference between perception (which is an objectifying act) and imagination (which (...) refers to a mental representation) is the fundamental difference Husserl operates with in his analysis of the phenomenological problem of the image building. I also want to show that Husserl’s analysis of the constitution of the image is fundamental in the understanding of the work of art (aesthetic phenomena including) and of its difference from a common thing. From the point of view of the History of Philosophy, the Husserlian analysis presupposes the overcoming of the classical opposition between subject and object, and the aesthetic experience is one of the (privileged) ways through which this overcoming can be achieved. After giving a short outline and interpretation of the Tractatus, I give reasons why we should view the Wittgenstein of the Tracatus as a kind of Kantian philosopher.

George Santayana appears emotionally distant and personally uncommitted in many of his writings. In what may have been a related phenomenon, he does not seem to have committed to any school of philosophy, but rather to draw from many of the available schools when it suited him. In this article, we assess his constantly changing use of different philosophies and its implications for both philosophy and politics.

Dignity, according to some recent arguments, is a useless concept, giving vague expression to moral intuitions that are better captured by other, better defined concepts. In this paper, I defend the concept of dignity against such skeptical arguments. I begin with a description of the defining features of the Kantian conception of dignity. I then examine one of the strongest arguments against that conception, advanced by Arthur Schopenhauer in On the Basis of Morality. After considering some standard accounts of dignity, (...) showing how they fail adequately to address Schopenhauer’s concern, I propose and defend a new account of dignity, drawing on the ontology of Jean-Luc Nancy. This study deals with responsibility as part of innovation. By nature, innovation gives birth to development for the organization and can only be at the core of any strategy within an ever-increasingly global economic context. However it also raises new questions stemming mostly from the impossibility to forecast the success of the innovations. More precisely, the questions raised by innovation also concern its consequences on society as a whole. Today, the innovator should understand his responsibility, the consequence of each innovation. (...) Moreover, common acceptance of the word ‘responsibility’ raises some questions about its use and how it should be understood. What does ‘responsibility’ mean? Who is responsible and for what? Through the notion of ‘care’, we aim at providing an evolution of responsible-innovation. The concept of ‘innovation-care’ is centered on people and more precisely focuses on taking care of them. The purpose of innovation-care is indeed to innovate and keep up with the level of productivity necessary to any organization while taking into account the essential interdependence between the status of the innovator and that of the citizen. L'immagine del "grembo materno della natura" da cui la ragione umana si deve emancipare per guadagnare la libertà è usata da Kant in uno scritto polemico contro Herder, Mutmasslicher Anfang der Menschengeschichte , che può essere considerato una risposta al libro decimo delle Ideen zur Philosophie der Geschichte der Menschheit, uscito nel 1785. Seguendo il racconto biblico, anche Kant pone la prima coppia umana in un "giardino", un luogo sicuro e ben fornito di alimenti; ma il vero inizio della storia (...) è fatto consistere nella rottura di questo equilibrio ad opera della ragione che gradualmente si è sottratta alla tutela della natura, imparando un po' alla volta a dominarla. Kant dichiara di condividere l'ideale rousseauiano di una cultura che non neghi la natura dell'uomo ma la promuova in quella che dovrà diventare la sua condizione fondamentale di esistenza, che è la libertà. Pone tuttavia questo ideale come termine finale del processo storico, non come condizione da recuperare nella sua purezza iniziale, ritornando alle origini, come invece appariva nella visione della storia proposta da Herder, che avrebbe su questo punto frainteso il pensiero di Rousseau. The image of the "womb of nature", from which human reason must emancipate itself in order to gain freedom, is used by Kant in a pamphlet against Herder. This was the Mutmasslicher Anfang der Menschengeschichte , which can be considered a response to the tenth book of Herder's Ideen zur Philosophie der Geschichte der Menschheit, published in 1785. Following the biblical account, Kant imagines the first two human beings in a "garden", a place safe and well-stocked with food; but the real beginning of history consists in the disruption of this balance produced by reason. Human reason gradually removes itself from the protection of nature, learning gradually to dominate nature. Kant shares Rousseau's idea of a culture that does not deny the nature of man, but promotes it in order to attain the fundamental condition of human existence, which is freedom. However, this ideal remains only as the final term of historical process, not as a condition to be regained in its original purity. The latter was the vision of history proposed by Herder, who on this point misunderstood the thought of Rousseau. (shrink)

Henry Shue’s model of basic rights and their correlative duties provides an excellent framework for analysing the requirements of global distributive justice, and for theorising about the minimum acceptable standards of human entitlement and wellbeing. Shue bases his model on the claim that certain ‘basic’ rights are of universal instrumental value, and are necessary for the enjoyment of any other rights, and of any ‘decent life’. Shue’s model provides a comprehensive argument about the importance of certain fundamental goods for all (...) human lives, though he does not consider health or health care in any significant detail. Adopting Shue’s model, I argue that access to health care is of sufficient importance to the enjoyment of any other rights that it qualifies as what Shue describes as a ‘basic’ right. I also argue that the basic right to health care is compatible with the basic rights model, and is required by it in order to for it to achieve its goal of enabling right holders to enjoy any decent life. In making this claim I also explore the requirements of the basic right to health care in terms of Shue’s triumvirate of duties and with reference to several key examples. (shrink)

I argue in this paper that some of the most basic commitments of Kantian ethics can be understood as grounded in the dynamic of sense that Merleau-Ponty describes in his Phenomenology of Perception. Specifically, I argue that Merleau-Ponty’s account supports the importance of universalizability as a test for the moral permissibility of particular acts as well as the idea that the binding character of the moral law is given as something like a fact of reason. But I also argue that (...) Merleau-Ponty’s account of reversibility suggests an important dimension of moral experience that is given in the experience of contact and that is underthematized in moral philosophies like Kant’s that emphasize the role of universalizability. Finally, I advance a positive account of moral experience that is centered on the idea of tact as ambiguous imperative. (shrink)

The aim of this thesis will be to give an elucidation of Nietzsche’s ideal of the post-moral autonomous individual: to give a picture of what Nietzsche takes such an individual to look like, and to show how this picture relates to some of Nietzsche’s most fundamental philosophical concerns. Overall, my argument will be that autonomy, or rather the degree of autonomy that a person possesses, is a function of the power of that person in relation to the other people and (...) forces, and of their ability to extend their will over long periods of time. Moreover, the achievement of the highest degrees of autonomy, and by extension the achievement of the greatest levels of power, requires imposing an ethic upon one’s actions and one’s self. There are several features that this ethic must have if it is adequately to perform its function: it must be self-chosen rather than simply picked up from one’s surroundings, it must act to give unity to the most diverse collection of collection of drives and affects possible for the person who holds it, and it must be well tailored to fit their specific natural constitution. In order to establish this I will focus on four main issues: the significance of the sovereign individual of GM II: 2, the role of ethics/values in Nietzsche’s ideal of autonomy, the relation between Nietzsche’s deflationary account of consciousness and his views of freedom, and the notion of unity at play in Nietzsche’s writings. I will also offer some thoughts on the coherence of Nietzsche’s ideal of autonomy with his thoughts on life-affirmation. (shrink)

The late 19th-century Ignorabimus controversy over the limits of scientific knowledge has often been characterized as proclaiming the end of intellectual progress, and by implication, as plunging Germany into a crisis of pessimism from which Liberalism never recovered. My research supports the opposite interpretation. The initiator of the Ignorabimus controversy, Emil du Bois-Reymond, was a physiologist who worked his whole life against the forces of obscurantism, whether they came from the Catholic and Conservative Right or the scientistic and millenarian Left. (...) Du Bois-Reymond’s doubt that scientists would ever elucidate consciousness must therefore be seen as an endorsement, and not a rejection, of his faith in reason. (shrink)

This thesis is concerned with Arendt’s political theory, particularly those elements of it concerned with political institutions. It treats her work as a response to a mis-conceptualisation of politics as being fundamentally formed of rulership and command, which is to say that she opposes treating sovereignty as an essential component of political practice. What Arendt offers, as an alternative, is a full-fledged account of how politics could operate in the absence of sovereignty. This thesis argues that it is a coherent (...) picture, consistent across the course of her work. A particularly important element of this consistency is the closeness of fit between the material which forms the basis of Arendt’s understanding of politics and her account of political foundations. To do so, the thesis begins with a discussion of Arendt’s concept of ‘action’, which forms the basis of her understanding of politics. One of the most distinctive features of this is the importance of individual initiative, understood as responsiveness to the already given. This part of action is an essential part of linking it harmoniously to those other elements of her work which appear here. Arendt’s work on ‘judgment’ is the focus of its own chapter; it is important because judgment is Arendt’s conceptualisation of political discussion modelled on opinion, which has previously been treated as a late-career development, is here treated as consistent with and, essentially, an extension of, certain features of action. On the basis of this combined reading of action and judgment, it is possible to read Arendt’s description of political foundations as an example of the same kind of political activity. Contra Honig’s reading of the political foundation as an opportunity for resistance, this thesis treats it as a political act which invites the participation of later citizens. Finally, an account of Arendt’s institutional thought is completed by presenting her description of the ‘council system’ in combination with Thomas Jefferson’s ‘ward system’. The two combine to form an example of political organisation which both does without a reliance on sovereignty and maximises opportunities for meaningful political engagement. (shrink)

The Bounds of Logic presents a new philosophical theory of the scope and nature of logic based on critical analysis of the principles underlying modern Tarskian logic and inspired by mathematical and linguistic development. Extracting central philosophical ideas from Tarski’s early work in semantics, Sher questions whether these are fully realized by the standard first-order system. The answer lays the foundation for a new, broader conception of logic. By generally characterizing logical terms, Sher establishes a fundamental result in semantics. Her (...) development of the notion of logicality for quantifiers and her work on branching are of great importance for linguistics. Sher outlines the boundaries of the new logic and points out some of the philosophical ramifications of the new view of logic for such issues as the logicist thesis, ontological commitment, the role of mathematics in logic, and the metaphysical underpinning of logic. She proposes a constructive definition of logical terms, reexamines and extends the notion of branching quantification, and discusses various linguistic issues and applications. (shrink)

In the Groundwork, Immanuel Kant famously argued that it would be self-defeating for everyone to follow a maxim of lying whenever it is to his or her advantage. In his recent book Signals, Brian Skyrms claims that Kant was wrong about the impossibility of universal deception. Skyrms argues that there are Lewisian signaling games in which the sender always sends a signal that deceives the receiver. I show here that these purportedly deceptive signals simply fail to make the receiver as (...) epistemically well off as she could have been. Since the receiver is not actually misled, Kant would not have considered these games to be examples of deception, much less universal deception. However, I argue that there is an important sense of deception, endorsed by Roderick Chisholm and Thomas Feehan in their seminal work on the topic, under which Skyrms has shown that universal deception is possible. In death penalty debates, advocates on both sides have advanced a staggering number of arguments to defend their positions. Many of those arguments fail to support retaining or abolishing the death penalty, and often this is due to advocates pursuing a line of reasoning where the conclusion, even if correctly established, will not ultimately prove decisive. Many of these issues are also interconnected and shouldn’t be treated separately. The goal of this paper is to provide some clarity about which specific (...) issues really determine whether the institution of capital punishment is morally permissible. The issues can be broadly grouped into three categories: substantive; procedural (comparative); and procedural (noncomparative). Substantive debates regard the inherent moral status of the death penalty, while procedural debates regard how the death penalty is applied in practice, with two types of injustice that can result. Substantive issues have the potential to be the most decisive, for if the death penalty is inherently immoral there’s no need to even raise procedural questions. However, it appears difficult for either side to make a clearly compelling argument on substantive grounds. In regards to the procedural arguments, the concerns of noncomparative justice lead to stronger arguments than the comparative concerns, for the irrevocable nature of the death penalty can play a role in the former but not the later. Overall, abolitionists have a clear advantage in this debate, as they only have to make their case on one of these fronts, while supporters must defend themselves on all three fronts. (shrink)

Kracauer’s rehabilitation in the 1990s sidelined his Marxist framework of the middle-to-late Weimar era in favour of the then still dominant if decaying paradigms of poststructuralism and postmodernism. It was also silent on the relationship between Kant and Marxism in Kracauer’s work. This essay addresses these weaknesses by arguing that Kracauer transcoded the structure of Kant’s ‘problematic’ around reification into a Marxist framework in the middle-to-late Weimar period. The essay considers how Kracauer conceived the mass ornament as a site of (...) reification and critical pedagogy. It explores his strategies of de-reification and their overlap with Walter Benjamin and the ruptures and continuities between the radical Weimar work and his later Theory of Film. The essay argues that the Theory of Film can be better understood as a transcoding of Kant’s philosophy of the aesthetic in the third Critique into the film camera itself, although the Marxian framework of the Weimar period is now considerably attenuated. This work represents a research on the nature of the causal efficiency of law, i.e. on how the political command is communicated by authority and received by those who must obey it. In the words of political philosophy of aristotelic tradition, it is the classical problem of the “government over free and equal men”, i.e., the problem of compatibility between political government and the freedom of human act and political rights. In the words of kantian practical philosophy, the problem consists (...) in the compatibility between individual’s moral autonomy and juridical system’s heteronomy, i.e. it consists in justifying the dominion of one man over another one, so that the citizen obeys the laws without any kind of submission to a will other than his own. The question requires particular attention to the problem of the nature of political bonds, as communication of political command is necessarily founded on what is common to the members of political society. The work is divided in two parts. The first one proposes a model of practical philosophy whose fundamental structure is common to all major political thinkers of modern times. This model consists in a “moral of obligation” founded on the opposition between law (must) and freedom (will), originated on nominalistic scholastic voluntarism. Within this structure, the problem assumes the form of a dilemma: if law comes from our own will (autonomy), then it becomes necessary to explain how it is possible to command over oneself; if law comes from a will other than our own, then it becomes necessary to explain the difference between law and mere force. In this context, the theories of Hobbes and Rousseau are studied as the theoretical matrix of modern political philosophy and as the two dialectical poles of this opposition. The conclusions derived from the study of these two thinkers are then applied to Kelsen and Kant respectively. The second part proposes a reconstruction of classical philosophy’s position about this problem, meaning by “classical” the tradition that begins with Plato, continues with Aristotle and reaches a new summit with Saint Thomas Aquinas. In this part of the work, a “classical” model of practical philosophy, common to these three authors, is presented. This model consists in an “order of loves”. Two fundamental theses are proposed. The first one is that law is a rational communicable order, whose efficacy is founded on participation of the act of “imperium” of authority in individual’s subjective “imperium” over his own acts. The second one is that the principle of this communication consists in “political concord”, i. e. a “useful friendship” about the ends of society, and that the concrete realization of this order in the citizen’s soul is political virtue, which is analogue to man’s virtue with the same platonic analogy that exists between man’s soul and the city or the State. The aim of this work is to elucidate the meaning of 'infinity' from a phenomenological perspective, especially within the framework of Husserl’s theory of knowledge and perception. In the first chapter I firstly sketch the basics of Husserl’s phenomenology of knowledge. Thereafter I delve into the questions concerning the reduction to the 'reellen Bestand', which is hold to be the ground of verification of purports in the "Logical Investigations". I then propose an interpretation of the categorial intuition as directed to (...) the laws an 'Auffassung' follows when it organizes the sensual contents related to an object. In the second chapter I briefly expound Husserl’s phenomenology of perception and I show how perception can be hold as an intentional experience. Afterwards I concentrate on the constitution of space and of thing (Ding). I show in which sense the structures of both constitutions are dependent on the sensations and kinesthesis (i.e. proprioceptions) experienced by the subject. In the third chapter I finally deal with the problem of infinity. I face some recent interpretations of Husserl’s theory of perception according to which infinity is somehow intertwined in and even intuited through thing-perception (Dingwahrnehmung). I claim that thing-perception can not be hold as an access to infinity, i.e. no thing-perception is a perception of something as infinite. Following I show how some other kinds of sensual experience can correspond to a perception of infinity. On the base of some Husserl’s manuscripts and through a brief confrontation with Kant’s Analytic of the Sublime I sustain that infinity can be sensually intuited in the senses of limitlessness and of formlessness. I then show that categorial intuition is necessary in order to constitute the meaning of mathematical infinity, i.e. an endless whole of discrete parts. In fact, the idea of such an “entity” is dependent on the capacity of grasping the law of a serial production. In the conclusion I establish that mathematical infinity is the only kind of infinity which can not find any sensual correlate. This is due to the fact that it is a meaning composed by two contradictory prescriptions: 'reach the limitless' and 'go on without an end'. I consequently argue that the idea of infinity is grounded on sensual experience and does not need any supernatural origin. (shrink)
