Uncertainty replaces the conviction that rationality may be founded, ultimately. Comments on and exemplified by Zygmunt Bauman's "Intimations of postmodernity" (1992), the Quality-of-life discussion (Nussbaum & Senn (eds.) 1993) and "reflexive modernization" (Ulrich Beck, 1994). Uncertainty as a principle leads to the "imperative of responsibility" (Hans Jonas, 1984).

This essay uses Ulrich Beck’s concept of risk society to understand the threat of catastrophic climate change. It argues that this threat is “abstract-corporeal”, and therefore a special kind of threat that poses special kinds of epistemic and ecological challenges. At the center of these challenges is the problem of human vulnerability, which entails a complex form of trust that both sustains and threatens human survival.

This paper explores the concepts of modernity as interpreted by classical theorists of modernity such as Karl Marx, Max Weber, Emile Durkheim and contemporary theorists of modernity such as Anthony Giddens and Ulrich Beck. All of the three classical theorists of modernity introduce a single dominant force which is the basic dynamic of transformation for understanding the inherent features of modernity. For Marx, the major transformative power shaping the modern world is capitalism. As a result, for him, modernity shows (...) itself in capitalism. For Durkheim, the major transformative power shaping the modern world is industrialism. Weber focuses on rationalization as expressed in technology, capitalism and bureaucracy. Hence, he saw that one of the main drivers of change throughout modernity is rationality. For Giddens, modernity is developed due to the interactions of many institutions and each level specified by classical theorists plays a part. Thus, for him, modernity has four institutional dimensions: capitalism, industrialism, surveillance, and military power. Beck discusses modernity by distinguishing two phases of modernity. The first of which is simple modernity which is very much coextensive with industrial society. The axial principle of industrial society is the distribution of goods. The second phase, emerged out of simple modernity and began in the second half of the twentieth century, is reflexive modernity. Thus, the axial principle of the second modernity is the distribution of dangers. But, the second modernity, for Beck, is still, and at the same time, an industrial society since it is mainly industry that is involved in the creation of risk. In general, the concept of modernity discussed by both the three classical theorists of modernity and the two contemporary thinkers are mutually inclusive rather than exclusive. As a result, modernity has four main parts: capitalism, industrialism, surveillance and military power. (shrink)

In “Risk Based Passenger Screening in Aviation Security: Implications and Variants of a New Paradigm”, Sebastian Weydner-Volkmann describes the current paradigm shift from ‘traditional’ forms of screening to ‘risk based passenger screening’ (RBS) in aviation security. This paradigm shift is put in the context of the wider historical development of risk management approaches. Through a discussion of Michel Foucault, Herfried Münkler and Ulrich Beck, Weydner-Volkmann analyses the shortcomings of such approaches in public security policies, which become especially evident in (...) the aviation security context. As he shows, the turn towards methods of RBS can be seen as an attempt to address a trade-off ‘trilemma’ between the effective provision of security, the implied costs for industry and passengers, and the ethical, legal and societal implications of the screening procedures. In order to analyse foreseeable outcomes of embracing RBS, he differentiates three prototypical variants of the new paradigm on the basis of their main referent and rationale. For each variant, he then subsequently assesses the implications for the ‘trilemma’, after having unveiled the criteria of analysis that will necessarily have to be followed within a serious appraisal of RBS methods. As questões sociais, que até então podiam estar localizadas em países ou em blocos de países, também se tornaram mundializadas, e vários pensadores passaram a refletir sobre temas chamados de pós-modernos, hipermodernos ou simplesmente contemporâneos, e que afetam um país, uma região ou todo o mundo. A Sociologia contemporânea, porém, mantém uma relação significativa com as grandes vertentes da Sociologia anterior: • a marxista ou histórico-estrutural, com suas variações; • a durkheimiana ou funcionalista, com o desenvolvimento de um neofuncionalismo; • a weberiana ou compreensiva, com o desenvolvimento da fenomenologia e da hermenêutica; • a teórica e pragmática estadunidense, com variadas linhas. Além dessas vertentes, pensadores como Jean-Gabriel de Tarde e Georg Simmel, que estavam um tanto esquecidos, pelo menos no Brasil, em razão da ênfase em Émile Durkheim, num caso, e em Max Weber, em outro, retomaram seus lugares de destaque. Essas vertentes inspiraram outros tantos pensadores, que – refletindo sobre a realidade em que vivem, mesclando ou não contribuições de diferentes linhas teóricas e formulando uma série de conceitos – demonstram as possibilidades e a diversidade do pensamento sociológico e fazem a Sociologia avançar muito no processo de compreensão da realidade contemporânea. A combinação de diversas vertentes teóricas torna difícil fazer qualquer enquadramento ou mesmo tentar classificar determinados autores. Muitos analistas veem nisso uma crise de paradigmas na Sociologia contemporânea. Essa “crise” poderia ser entendida do ponto de vista epistemológico; entretanto, sempre houve diversidade de epistemologias na Sociologia. In this article, I critically reassess Iris Marion Young's late works, which centre on the distinction between liability and social connection responsibility. I concur with Young's diagnosis that structural injustices call for a new conception of responsibility, but I reject several core assumptions that underpin her distinction between two models and argue for a different way of conceptualising responsibility to address structural injustices. I show that Young's categorical separation of guilt and responsibility is not supported by the writings of Hannah (...) Arendt, which Young draws on, and that it is also untenable on independent systematic grounds. Furthermore, I argue that several of Young's other criteria fail to clearly demarcate two distinct phenomena. I therefore propose to transcend Young's distinction between two models in favour of a related, but conceptually different distinction between two forms of responsibility: interactional and structural. Embracing this terminology facilitates the conceptualisation of the general features of responsibility that are shared by both forms, including their retrospective and prospective time-direction and their applicability to individual, joint and group agency. The distinction between interactional and structural responsibility also yields a more compelling general account of the role of background structures, and of blame within ascriptions of political responsibility. Unconscious perceptions have recently become a focal point in the debate for and against naive realism. In this paper I defend the naive realist side. More specifically, I use an idea of Martin’s to develop a new version of naive realism—neuro-computational naive realism. I argue that neuro-computational naive realism offers a uniform treatment of both conscious and unconscious perceptions. I also argue that it accommodates the possibility of phenomenally different conscious perceptions of the same items, and that it can answer (...) a further challenge to naive realism raised by Berger and Nanay. The phenomenal particularity thesis says that if a mind-independent particular is consciously perceived in a given perception, that particular is among the constituents of the perception’s phenomenology. Martin, Campbell, Gomes and French and others defend this thesis. Against them are Mehta, Montague, Schellenberg and others, who have produced strong arguments that the phenomenal particularity thesis is false. Unfortunately, neither side has persuaded the other, and it seems that the debate between them is now at an impasse. This paper aims to (...) break through this impasse. It argues that we have reached the impasse because two distinct conceptions of phenomenology—a “narrow” conception and a “broad” conception—are compatible with our what-it-is-like characterizations of phenomenology. It also suggests that each of these two conceptions has its own theoretical value and use. Therefore, the paper recommends a pluralistic position, on which we acknowledge that there are two kinds of phenomenology: narrow phenomenology and broad phenomenology. The phenomenal particularity thesis is true only with respect to the latter. (shrink)

In our target article, we argued that the number sense represents natural and rational numbers. Here, we respond to the 26 commentaries we received, highlighting new directions for empirical and theoretical research. We discuss two background assumptions, arguments against the number sense, whether the approximate number system represents numbers or numerosities, and why the ANS represents rational numbers.

The increasing use of opioid treatment agreements has prompted debate within the medical community about ethical challenges with respect to their implementation. The focus of debate is usually on the efficacy of OTAs at reducing opioid misuse, how OTAs may undermine trust between physicians and patients and the potential coercive nature of requiring patients to sign such agreements as a condition for receiving pain care. An important consideration missing from these conversations is the potential for racial bias in the current (...) way that OTAs are incorporated into clinical practice and in the amount of physician discretion that current opioid guidelines support. While the use of OTAs has become mandatory in some states for certain classes of patients, physicians are still afforded great leeway in how these OTAs are implemented in clinical practice and how their terms should be enforced. This paper uses the guidelines provided for OTA implementation by the states of Indiana and Pennsylvania as case studies in order to argue that giving physicians certain kinds of discretion may exacerbate racial health disparities. This problem cannot simply be addressed by minimising physician discretion in general, but rather by providing mechanisms to hold physicians accountable for how they treat patients on long-term opioid therapy to ensure that such treatment is equitable. Consumer boycotts have become a frequent form of social protest in the digital age. The corporate malpractices motivating them are varied, including environmental pollution, lack of minimum labour standards, severe mistreatment of animals, lobbying and misinformation campaigns, collaboration or complicity with illegitimate political regimes, and systematic tax evasion and tax fraud. In this article, I argue that organised consumer boycotts should be regarded as a legitimate and purposeful instrument for structural change, provided they conform to a number of normative criteria. (...) In order to show this, the practice and empirical context of consumer boycotts are first outlined. I then lay out and refute three general objections to this practice. Although each of these objections fails, their discussion generates insights concerning the normative standards with which boycotters must comply if they want their campaigns to be both legitimate and successful. These normative criteria are detailed along the lines of two guiding principles, proportionality and transparency. In the final step, I elaborate on structural change as the deeper purpose of consumer boycotts. (shrink)

This essay is a close reading analysis of Plato's Eutyphron coming to the conclusion that Plato's Socrates is still a model for an open minded, but critical attitude towards the ethical and metaphysical claims of religions.

In the early 1980’s van Inwagen presented the Direct Argument for the incompatibility of determinism with moral responsibility. In the course of the ensuing debate, Fischer, McKenna and Loewenstein have replied, each in their own way, that versions of the Direct Argument do not pose even a prima facie threat to compatibilism. Their grounds were that versions of the Direct Argument all use the “Transfer NR” inference rule in a dialectically problematic way. I rebut these replies here. By so doing, (...) Marya Schechtman has raised a series of worries for the Psychological Continuity Theory of personal identity (PCT) stemming out of what Derek Parfit called the ‘Extreme Claim’. This is roughly the claim that theories like it are unable to explain the importance we attach to personal identity. In her recent Staying Alive (2014), she presents further arguments related to this and sets out a new narrative theory, the Person Life View (PLV), which she sees as solving the problems as well (...) as bringing other advantages over the PCT. I look over some of her earlier arguments and responses to them as a way in to the new issues and theory. I argue that the problems for the PCT and advantages that the PLV brings are all merely apparent, and present no reason for giving up the former for the latter. (shrink)

Emile Borel regards the Banach-Tarski Paradox as a reductio ad absurdum of the Axiom of Choice. Peter Forrest instead blames the assumption that physical space has a similar structure as the real numbers. This paper argues that Banach and Tarski's result is not paradoxical and that it merely illustrates a surprising feature of the continuum: dividing a spatial region into disjoint pieces need not preserve volume.

Leising and colleagues propose a 10-step checklist that they argue will facilitate “a better personality science.” Although we agree with many of the proposed steps, whether the checklist separates “good research” from bad is an empirical matter. A critical component of Leising and colleagues’ steps toward improving scientific standards in personality center around consensus building. There are several critical ways in which the methods for building consensus in psychology could have unintended negative consequences. Creating a better science requires a shift (...) in academia’s reward structures. The current system rewards producing more publications with little reference to contributions to those publications. CRediT offers a simple yet effective way of weighing the quality of researcher contributions rather than quantity alone. Finally, the target article is the latest to join in calling for more formal theory. If psychology is to improve theory, then psychologists must be trained in theory. These systemic issues are pervasive and cannot be fixed without changing the evaluation system of academia and subsequently the reward system that supports it. Including the CRediT taxonomy in CVs offers a simple yet effective way of weighing the quality of researcher contributions rather than quantity alone. (shrink)

The paradox of the concept horse has often been taken to be devastating for Frege’s ontological distinction between objects and concepts. I argue that if we consider how the concept-object distinction is supposed to account for the unity of linguistic meaning, it transpires that the paradox is in fact not paradoxical.

The distinction between perception and cognition frames countless debates in philosophy and cognitive science. But what, if anything, does this distinction actually amount to? In this introductory article, we summarize recent work on this question. We first briefly consider the possibility that a perception-cognition border should be eliminated from our scientific ontology, and then introduce and critically examine five positive approaches to marking a perception–cognition border, framed in terms of phenomenology, revisability, modularity, format, and stimulus-dependence.

Obwohl Jaspers in seiner Philosophie Methoden und Motive der Phänomenologie Husserls und der Hermeneutik Diltheys aufgenommen hatte, hat er sich nicht besonders für die Leibphilosophie interessiert. Das bedeutet jedoch nicht, dass der menschliche Leib in seinem Denken gar nicht vorkommt. Aber es handelt sich bei ihm jedoch nicht um ein Schlüsselthema, sondern um ein randständiges Phänomen. Der menschliche Leib ist bei Jaspers die vitale Basis der überlieferten Trias von Leib, Seele und Geist. Damit steht Jaspers in der klassischen Traditionslinie des (...) europäischen Denkens von Platon und Aristoteles bis zu Descartes und Kant. Anders als beim platonischen Sokrates gibt es bei Jaspers jedoch keine Herabsetzung des Körpers oder Abwertung des Leiblichen. Und anders als in der subversiven Tradition der empiristischen Skepsis gibt es bei ihm aber auch keine Vernachlässigung des Geistes. Im Vergleich des Menschen mit den Tieren ist der Geist nicht nur irgendein beliebiges, auf Sprache, Denken und Vernunft basierendes Merkmal, das den Menschen zufällig von den Tieren unterscheidet, sondern die wesentliche menschliche Eigenart, die es zu verstehen gilt, wenn man die spezifisch menschliche Art und Weise des Daseins in der Welt verstehen möchte, die Jaspers 'Existenz' nennt. Existenz zu verstehen ist die eigentliche Aufgabe der Philosophie, zumal die Wissenschaften dies nicht leisten können. (shrink)

In § 6 of his General Psychopathology (1st edition 1913) Jaspers distinguished between drives, wants and volitions as three different and irreducible kinds of motivational phenomena which are involved in human decision making and which may lead to successful actions. He has characterized the qualitative differences between volitions in comparison with basic vital drives and emotional wants such as being (a.) intentional, (b.) content-specific and (b.) directed towards concrete objects and actions as goals. Furthermore, Jaspers has presented and discussed three (...) kinds of pathological problems about motivation and willing. (1.) The first kind is impulsive action or impulsive behaviour, as e.g. in psychoses or personality disorders, which he compares with instinctive action which are both without any previous hesitation, deliberation and reflection of any presumable consequences, but still very different with respect to their motivational content. (2.) The second kind of pathological problems about motivation and willing are the inhibitions of the will and Jaspers is discussing two major kinds of them: (a.) the energetic or motivational inhibition of the will which is an inability of willing due to the mere lack of any drives and motives, as in the case of any severe and pathological depression; (b.) the cognitive inhibition of the will which is due to the pathological inability to be aware of and understand properly the complexity and difficulty of real life situations in order to solve some given tasks by appropriate decision making, as e.g. in some cases of schizophrenia. (3.) The third kind is a pathological weakness of the will which is extraordinary and not familiar to normal human adults. This pathological kind of weakness of the will consist in the complete causal ineffectiveness of the subjectively felt impulse of willing which is not leading to any inward and outward observable action, such as e.g. as a movement of the limbs or some verbal utterance. This pathological weakness of the will is a complete ineffectiveness of the volitional impulse and therefore different from what philosophers discuss under the heading of weakness of the will which presuppose some evaluation of the intended resp. realized action as ethically, morally or religiously right or wrong. Finally, there are three kinds of normal or non-pathological weakness of the will, as discussed by philosophers: (A.) ethical weakness of the will as in Aristotle’s disagreement about akrasia with the Platonic Socrates; (B) moral weakness of the will as in Kant’s analysis of the absence or failure of any specific moral reasoning by pure practical reason as opposed to mere strategic and pragmatic reason or as the occurrence of a self-deceptive “dialectics of the exception“; (C.) religious weakness of the will as in Pauls personal insight about the incoherence between his high spiritual aspirations and his factual ethical achievements. On a now orthodox view, humans and many other animals possess a “number sense,” or approximate number system, that represents number. Recently, this orthodox view has been subject to numerous critiques that question whether the ANS genuinely represents number. We distinguish three lines of critique – the arguments from congruency, confounds, and imprecision – and show that none succeed. We then provide positive reasons to think that the ANS genuinely represents numbers, and not just non-numerical confounds or exotic substitutes for (...) number, such as “numerosities” or “quanticals,” as critics propose. In so doing, we raise a neglected question: numbers of what kind? Proponents of the orthodox view have been remarkably coy on this issue. But this is unsatisfactory since the predictions of the orthodox view, including the situations in which the ANS is expected to succeed or fail, turn on the kind of number being represented. In response, we propose that the ANS represents not only natural numbers, but also non-natural rational numbers. It does not represent irrational numbers, however, and thereby fails to represent the real numbers more generally. This distances our proposal from existing conjectures, refines our understanding of the ANS, and paves the way for future research. (shrink)

The view that an account of personal identity can be provided in terms of psychological continuity has come under fire from an interesting new angle in recent years. Critics from a variety of rival positions have argued that it cannot adequately explain what makes psychological states co-personal (i.e. the states of a single person). The suggestion is that there will inevitably be examples of states that it wrongly ascribes using only the causal connections available to it. In this paper, I (...) describe three distinct attacks on the psychological continuity theory along these lines. While I acknowledge that a number of interesting issues arise, I argue that the theory can withstand all three attacks. (shrink)

When people suffer they always suffer as a whole human being. The emotional, cognitive and spiritual suffering of human beings cannot be completely separated from all other kinds of suffering, such as from harmful natural, ecological, political, economic and social conditions. In reality they interact with each other and influence each other. Human beings do not only suffer from somatic illnesses, physical pain, and the lack of decent opportunities to satisfy their basic vital, social and emotional needs. They also suffer (...) when they are not able to experience and grasp any meaning of life even if such suffering is not quite as obvious as most forms of physical, social and emotional suffering. Suffering from the lack for the sense of the meaning of life is a special form of emotional, cognitive, and spiritual suffering. Although all human beings share the same basic human need for some meaning of life, the fulfilment of this need is highly individual and personal. Although all forms of human suffering can be a challenge to the meaning of life, the personal conditions of suffering usually are a stronger challenge for the meaning of life. Among the personal conditions of human suffering, the Grenzsituationen cannot be cancelled or raised at all, but only accepted and coped with as existential aspects of the conditio humana. According to Karl Jaspers these are: death, suffering, struggling, guilt, and failing. The challenge for human beings to cope with these Grenzsituationen is a way to move from the mere Being-there to true human Existence. (shrink)

African perspectives on personhood and personal identity and their relation to those of the West have become far more central in mainstream Western discussion than they once were. Not only are African traditional views with their emphasis on the importance of community and social relations more widely discussed, but that emphasis has also received much wider acceptance and gained more influence among Western philosophers. Despite this convergence, there is at least one striking way in which the discussions remain apart and (...) that is on a point of method. The Western discussion makes widespread use of thought experiments. In the African discussion, they are almost entirely absent. In this article, we put forward a possible explanation for the method of thought experiment being avoided that is based on considerations stemming from John Mbiti’s account of the traditional African view of time. These considerations find an echo in criticism offered of the method in the Western debate. We consider whether a response to both trains of thought can be found that can further bring the Western and African philosophical traditions into fruitful dialogue. (shrink)

In the last two decades, Davidson’s event-argument hypothesis has become very popular in natural language semantics. This article questions that event-based analyses actually add something to our understanding of the respective phenomena: I argue that they already find their explanation in independently motivated grammatical assumptions and principles which apply to all kinds of modification. Apart from a short discussion of Davidson’s original arguments in favour of his hypothesis, I address Larson’s event-based account of the distinctions between stage-level vs. individual-level modification (...) and adverbial vs. adjectival modification in the nominal domain. I argue that his analysis of the former reduces straightforwardly to the grammatical structure of the nominal phase. As for the latter, I provide reasons which motivate a re-description of the phenomenon in terms of sensitivity to descriptive content rather than events. I argue that, so described, the phenomenon can be explained in terms of interface conditions, given a phasal architecture of grammar. (shrink)

Brandom’s philosophical programme can be seen as a reversion of the traditional order of explanation in semantics. Whereas traditional semantic theories start with a grip on a notion like truth or reference, Brandom argues that it is also possible to begin with an analysis of the speech acts of what one is doing by making a claim in order to explain representational notions like truth and objectivity. Evaluating the explanatory values of Brandom’s theory, it therefore is necessary to ask to (...) what extent Brandom’s analysis of our linguistic practices is able to explain what other theories start with. That is, can linguistic practices in Brandom’s sense give an account of why we are capable of referring to language-external objects? And can they make evident why we take truth and falsity not to depend upon our beliefs or claims but upon an extra-linguistic reality? After a short discussion of Brandom’s answer to the first question, I argue that Brandom’s answer to the second is not sufficient and that it does not seem to be possible to give a sufficient answer within his theory. A technical artefact is often described in two ways: by means of a physicalistic model of its structure and dynamics, and by a functional account of the contributions of the components of the artefact to its capacities. These models do not compete, as different models of the same phenomenon in physics usually do; they supplement each other and cohere. Coherence is shown to be the result of a mapping of role-contributions on physicalistic relations that is brought about by the concept (...) of function. It results a sandwich-like structure of the two models, which can be reconstructed as a two-sorted theory element. (shrink)

In The Border between Seeing and Thinking, Ned Block argues that the distinction between perception and cognition should be grounded in representational format. I object that cognition is multifaceted, and includes representations with the same format as some perceptual representations. We can save Block’s view by interpreting it as concerning the border between one elite species of cognition—namely, propositional thought—and everything below it, including perception. But that leaves the border between perception and cognition in general unexplained. To fill this gap, (...) I recommend my stimulus-dependence account of the border and reply to objections Block raises against it. This brings into relief a category of mind that is crucial to understanding human infants and nonhuman animals—namely, nonpropositional cognition, which sits between perception and propositional thought. Building on Christopher Peacocke’s account of analog perceptual contentand my own account of analog perceptual vehicles, I defend three claims: that theperception of magnitudes often has analog contents; that the perception of magni-tudes often has analog vehicles; and that the first claim is true in virtue of the second—that is, the analog vehicles help to ground the analog contents.

There are two ways of thinking about instants of time: "spatial" accounts emphasize the similarities between instants and places; "modal" accounts focus on the parallels between times and possible worlds. My aim in this paper is to draw attention to one respect in which times are more similar to possible worlds than they are to places.

Im diesem Aufsatz nehme ich die Popularität des Verantwortungsbegriffs in der Alltagssprache zum Anlass, um seinem Verhältnis zum Pflichtbegriff auf den Grund zu gehen. Dabei unterziehe ich den Verantwortungsbegriff zunächst einer allgemeinen Analyse. Anschließend diskutiere ich in Gestalt von Indeterminismus, Amoralismus und Interaktionismus drei Modi der missbräuchlichen Verwendung dieses Begriffs. Dabei handelt es sich jedoch bei genauerer Betrachtung um allgemeine rhetorische Verschleierungsstrategien, die nicht an die Verwendung des Verantwortungsbegriffs gebunden sind, sondern in der kommunikativen Bezugnahme auf moralische Forderungen generell auftreten (...) können. Dies verdeutlicht auch die anschließende Analyse des Pflichtbegriffs, der einige grundlegende Ähnlichkeiten zum Verantwortungsbegriff aufweist. Ex negativo zeigt sich so jedoch, wie ein nicht missbräuchlicher Rekurs auf beide philosophischen Grundbegriffe möglich ist. Darüber hinaus werden auch die Unterschiede dieser Termini deutlich. Der Pflichtbegriff ist trotz einiger wesentlicher Gemeinsamkeiten weniger vielseitig als der Verantwortungsbegriff und daher zumindest in der Auseinandersetzung mit einigen Themen der praktischen Philosophie weniger gut als Grundbegriff geeignet. Gleichwohl zeigt sich, dass die Frage „Verantwortung oder Pflicht?“ uns vor eine falsche Alternative stellt, wenn sie im ausschließenden Sinn verstanden wird. (shrink)

This paper argues that the Fairtrade certification system represents an illuminating example of the challenge of systematically determining consumer and entrepreneurial responsibilities in our global age. In taking up the central question of what, if anything, may be called ‘just’ or ‘fair’ in Fairtrade, I more precisely argue for a two-fold thesis: that a meaningful evaluation of Fairtrade must consider both an interactional and an institutional understanding of global responsibilities to promote justice and that Fairtrade can be better defended against (...) several popular objections from the perspective of a theory that adequately differentiates between interactional responsibilities and institutional responsibilities of promoting justice under unjust circumstances. The thought-experiment presented by Bernard Williams in 'The self and the future' continues to draw the attention of writers in the debate about personal identity. While few of them agree on what implications it has for the debate, almost all agree that those implications are significant ones. Some have even claimed that it has consequences not only for personal identity, but also concerning the viability of thought-experiment as a method. This paper surveys what these consequences might be at both levels (...) - as a substantive contribution to the debate on identity, and as to what it shows about the usefulness of thought-experiments. It argues ultimately that thought-experiments like Williams's do provide a useful philosophical tool as long as we temper our expectations of them, and that it offers some support to a view of personal identity but one which is at odds with Williams's own view. Mill (1872, 1874) is an early proponent of the thesis that economics has a special domain in which it can operate relatively independently of findings from other sciences. Contra Mill, I argue that this so-called separateness-thesis is best defendedunder an externalist interpretation of Rational Choice Theory (RCT). Mill’s defence is consistent with an internalist interpretation of RCT. Internalism holds that RCT depicts psychological mechanisms operating in economic agents. I argue that such a defence fails to establish separateness, because it makes (...) economics highly depended on psychological findings. However, externalism understands RCT as an adequate description of how agents react to incentives if certain environmental structures are present. Under this interpretation, we can defend separateness by investigating which features of an environmental structure will lead agents to behave in accordance with RCT. Thereby, we can derive indicators that enable us to demarcate a separate domain for economics. (shrink)

This article is concerned with the place counterfactual reasoning occupies in South African law, and how philosophy might be able to help the law. I point out some of the more important and unavoidable uses of counterfactual reasoning in our law. Following this I make some suggestions as to how philosophy, and especially informal logic, can be of help to the law. Finally, I make some suggestions as to how the law in turn can help philosophy.

In seiner ‘Existenzerhellung der Freiheit’ reflektiert Jaspers, das Problemfeld der Freiheit in einem Kontrast zu den Begriffen, Phänomenen und Bedingungen der Unfreiheit und der Grenzen der Freiheit. Dem Problemfeld der Freiheit kann man im Denken und Handeln nur dann gerecht werden, wenn man nicht nur zwischen den verschiedenen Begriffen und Phänomenen der Freiheit unterscheidet, sondern auch zwischen den verschiedenen Begriffen und Phänomenen von Grenzen der Freiheit, wie z.B. durch die allgemeine Naturgesetzlichkeit und die menschliche Natur, durch besondere Bedingungen in Natur, (...) Kultur und Gesellschaft, durch gesundheitliches Befinden und individuelle Persönlichkeit, durch situative Begrenzungen, normative Forderungen und konkrete Grenzsituationen, wie z.B. von Leiden, Kampf, Schuld, Wagnis und Tod zeigen. Jaspers hat sich zum Problemfeld der Freiheit sowohl in seiner Allgemeinen Psychopathologie, in seinen pathographischen Untersuchungen, in seiner Psychologie der Weltanschauung und in einigen seiner philosophischen Schriften geäußert. Im zweiten Band seines frühen Hauptwerkes Philosophie mit dem Titel Existenzerhellung hat er jedoch eine umfassende Abhandlung zu dem komplexen Problemfeld der Freiheit verfasst. Dort behandelt Jaspers fast alle wesentlichen Begriffe und Phänomene der Freiheit bis hin zu seiner Konzeption einer existenziellen Freiheit. Jaspers geht anfangs von einem unbestimmten Begriff der Freiheit aus, dem kein bestimmtes Phänomen entspricht und der deswegen nur Illusionen erzeugen und einem ideologischem Denken dienen kann. Dann aber unterscheidet Jaspers zwischen verschiedenen Begriffen und Phänomenen der Freiheit. Dabei scheint er nicht nur wie die meisten zeitgenössischen Philosophen an Locke und Hume, Kant und Brentano, Wilhelm von Humboldt und John Stuart Mill anzuknüpfen, sondern auch an die Konzeptionen des Selbstbewusstseins bei Hegel, Fichte und Schelling. Da sich Jaspers nicht zuletzt auch mit den Schriften von Kierkegaard und Nietzsche auseinandergesetzt hat, gelangt er zu einer besonders umfangreichen und differenzierten Diskussion des ganzen Problemfeldes der Freiheit in der Moderne. Jaspers hat jedoch nicht nur verschiedene Freiheitsbegriffe und -phänomene unterschieden, sondern er hat auch zu den überlieferten Denkweisen im Form einer existenzphilosophischen Erhellung der Freiheit Stellung genommen. Dabei hat Jaspers’ Stellungnahme anders als viele zeitgenössische Beiträge über Freiheit und Determinimus den deutlichen und bewahrenswerten Vorzug, dass sie die unverfügbare und irreduzible Subjektivität der Willensfreiheit anerkennt. Damit knüpft Jaspers an Kants Einsicht an, dass der Freiheit des menschlichen Willens und ihrer praktischen Wirksamkeit immer nur die subjektive Evidenz inneren Erlebens zukommen kann. Dies unterscheidet sie von der Wahl- und Handlungsfreiheit, die man auch in konkreten Handlungssituationen objektiv feststellen kann. Der Freiheit des menschlichen Willens kommt damit weder die Objektivität empirischer Erkenntnis noch metaphysische Notwendigkeit zu. Die subjektive Evidenz des Erlebens eines freien Willens spricht nach Jaspers jedoch auch gegen einen weltanschaulichen, methodischen oder metaphysischen Determinismus, der sie aufgrund seiner Annahme einer kausal geschlossenen Wirklichkeit leichtfertig für eine bloße Illusion hält. Eine deterministische Weltanschauung oder Philosophie kann der condition humaine zumindest dann nicht gerecht werden, wenn sie die evidente Subjektivität eines freien Willens nicht auf eine plausible Art und Weise integriert. Jaspers’ wird der potentiellen Freiheit des menschlichen Willens dadurch gerecht, dass er ihre unverfügbare und irreduzible Subjektivität versteht und akzeptiert und erst gar nicht den abwegigen Versuch macht, sie durch eine objektivierende Einstellung zu objektivieren, wissenschaftlich zu erklären oder gar zu beweisen. Neidische Gedanken, neidische Gefühle, neidische Menschen sind im alltäglichen Leben gegenwärtig. Kaum vergeht ein Tag, an dem man nicht mit dem Phänomen des Neides konfrontiert wäre. Bei sich selbst mag man ihn schon gar nicht, denn der Neid ist ein schmerzliches und unschönes Gefühl. Obwohl der Neid ein alltägliches Phänomen ist, bleibt er im Alltag ein weitgehend tabuisiertes Thema: Über den Neid spricht man entweder gar nicht oder nur selten. Falls man doch über den Neid spricht, dann zumeist über den (...) Neid der Anderen. Den Neid der Anderen kann man nämlich als einen gewissen Triumph verbuchen: entweder als eine Art von Anerkennung des eigenen sozialen Status oder als ein Genuss dessen, was man bei den Anderen an Neid erregenden Gütern vorzuweisen hat. Der kleine Mann erfreut sich am Neid der Anderen. Entfremdet von der unmittelbaren Freude am eigenen Tun und Lassen sowie von den Früchten seiner Arbeit kann er sie nur noch auf dem Umweg über die Erniedrigung der Anderen erleben. Der Spießer braucht den neidischen Blick der kleineren Anderen, um zu bemerken, was er ist und was er hat. Denn der Spießer weiß nicht, wer er ist, und weil er nicht weiß, wer er ist, muss er ersatzweise wenigstens wissen, was er ist, und er ist vor allem das, was er erreicht hat und was er hat. Our perception of where touch occurs on our skin shapes our interactions with the world. Most accounts of cutaneous localisation emphasise spatial transformations from a skin-based reference frame into body-centred and external egocentric coordinates. We investigated another possible method of tactile localisation based on an intrinsic perception of ‘skin space’. The arrangement of cutaneous receptive fields (RFs) could allow one to track a stimulus as it moves across the skin, similarly to the way animals navigate using path integration. We applied (...) curved tactile motions to the hands of human volunteers. Participants identified the location midway between the start and end points of each motion path. Their bisection judgements were systematically biased towards the integrated motion path, consistent with the characteristic inward error that occurs in navigation by path integration. We thus showed that integration of continuous sensory inputs across several tactile RFs provides an intrinsic mechanism for spatial perception. (shrink)
