O presente trabalho tem por objetivo fornecer uma resposta à crítica direcionada pelo jurista Fábio Konder Comparato ao formalismo jurídico de Kant. Explicarei porque essa crítica se equivoca quando identifica, na Doutrina do Direito de Kant, uma Teoria do Direito incompleta e insatisfatória. Para tanto, pretendo mostrar que o propósito do filósofo alemão não era apresentar uma teoria do direito, mas sim uma Metafísica do Direito. O que explica, por conseguinte, a razão para o direito ter sido concebido como um (...) conceito puro. Além disso, a fim de determinar o significado do formalismo jurídico, ocupar-me-ei da crítica hegeliana ao suposto formalismo ético de Kant, bem como da resposta a essa crítica. (shrink)

This essay examines some of the ways in which the assumption of the essential finitude of the human mind, in contrast to the infinitude of God’s mind, bears on Leibniz’s and Kant’s accounts of our representational capacities. This examination reveals several underappreciated similarities between their views, but also some notable differences that help us pinpoint where and in what ways Kant departs from his celebrated predecessor. Wittgenstein famously criticizes the philosophical practice of analyzing the meaning of words outside their ordinary use in everyday language, whereby often self-made pseudo-problems arise. In order to shed further light on Wittgenstein’s critique, this article makes use of the Remarks on the Philosophy of Psychology. First, starting from the remark in Vol. I, §52, his criticism of the philosophical method of selection and generalization is explained in detail. Next, I give a brief outline of Wittgenstein’s own way of philosophizing by (...) reference to a selection of comments concerning the use of psychological words in everyday language, which will also further elucidate his critique. Finally, I enter into the question which significance everyday language according to Wittgenstein has for philosophy. (shrink)

A popular story about Kant's relation to Leibniz presents Kant as a Leibniz-Wolffian by education who, inspired by his encounter with the teachings of Newton and Hume, took on the project of reconciling Leibniz-Wolffian metaphysics with Newtonian science and of responding to epistemological skepticism, a project that led him further and further away from his Leibniz-Wolffian roots and culminated in the total rejection of the Leibniz-Wolffian philosophy in the Critique of Pure Reason. In this essay, four shortcomings of the popular (...) story are identified and several suggestions are made about how to amend and expand the story in order to overcome these shortcomings. Furthermore, some of the most important Leibnizian doctrines that influenced Kant are collected and their role in Kant's philosophy is discussed. (shrink)

Die Aufgabe der Philosophie besteht nicht darin, den moralischen Zeigefinger zu erheben und vorzugeben, was man tun soll und was nicht. Vielmehr zeigt die Philosophie unterschiedliche Argumente auf, weshalb die eine oder andere Haltung vertretbar oder aus gewissen Gründen gegebenenfalls vertretbarer ist als eine andere. Insofern eine Gesellschaft an Klugheit interessiert ist und sich einer zukünftigen Entwicklung verantwortungsvoll stellt, kann die Philosophie eine wertvolle Aufgabe übernehmen: Die Methode, analytisch das Für und Wider abzuwiegen, bedeutet nicht zuletzt viel Arbeit und Aufmerksamkeit (...) für das Detail. Wie beispielsweise das Kapitel zur Grünen Gentechnik (Seite 6) zeigt, sind die Diskussionen um die zu fällenden moralischen Urteile nicht an ein externes Gremium zu delegieren. Im Gegenteil: Die Diskussion sollte innerhalb der Gesellschaft stattfinden, einerseits um den unterschiedlichen Haltungen Platz zu geben, andererseits aber, weil nur auf diese Weise ein echter Konsens zu Stande kommen kann. Die Rolle der Philosophie zeigt sich ähnlich auch, wenn es um die für die pluralistische Gesellschaft zentrale Toleranz geht. Die wertenden Einstellungen der Bürgerinnen und Bürger verdienen es, ernst genommen zu werden und offen diskutiert zu werden. Nur durch eine tiefgreifende Auseinandersetzung lässt sich verhindern, dass populistische Wortführer mit eigennützigen, aber aufmerksamkeitsstarken Argumenten von den Themen ablenken, die ernsthaft angegangen werden möchten: Die Vision einer friedlichen und freiheitlichen Gesellschaft, das demokratische Ideal, wird nicht mit dem Verweis auf die „Krise“ aufgegeben. Verantwortung interessiert die Bürgerinnen und Bürger schliesslich eben doch mehr, als Donald Trumps neuste Lüge. Das philosophische Themendossier zeigt, dass die akademische Philosophie viel leis-tet, um eine oberflächliche Auseinandersetzung mit gesellschaftlich und zukunftsrelevanten Themen zu verhindern. Auch wenn das auf den ersten Blick nach viel Anstrengung klingt, so zeigt der zweite Blick, dass darin viel Wohlwollen zugunsten der Gesellschaft steckt. Es lohnt sich, den Mut aufzubringen, sich intensiv mit den eigenen Werturteilen auseinanderzusetzen und das Auge vom eigenen Wohl auch auf das Wohle aller schweifen zu lassen. Philosophie kann „ansteckend“ sein und viel Freude hervorrufen: Gerade dann, wenn man neue Ideen mit dazu gewinnt oder andere Argumente für bereits gefasste Entscheidungen kennenlernt. Die Philosophie entwickelt sich fortlaufend weiter und bleibt somit mehr denn je: stets aktuell. (shrink)

In this article, we explore some of the roles of cameras in policing in the United States. We outline the trajectory of key new media technologies, arguing that cameras and social media together generate the ambient surveillance through which graphic violence is now routinely captured and circulated. Drawing on Michel Foucault, we suggest that there are important intersections between this video footage and police subjectivity, and propose to look at two: recruit training at the Washington state Basic Law Enforcement Academy (...) and the Seattle Police Department’s body-worn camera project. We analyze these cases in relation to the major arguments for and against initiatives to increase police use of cameras, outlining what we see as techno-optimistic and techno-pessimistic positions. Drawing on the pragmatism of John Dewey, we argue for a third position that calls for field-based inquiry into the specific co-production of socio-techno subjectivities. (shrink)

Further M-logic contains an object theory. With both the logical part and the object part we achieve a formal calculus that is able to express many metaphysical dogmas.

„Im Grunde gibt es nur die Liebe“, sagte Picasso einst. Kaum ein Mensch durchläuft sein Leben, ohne früher oder später von jenen Gefühlen gebeutelt zu werden, welche als Liebe bezeichnet werden. Aber was ist Liebe überhaupt? Gibt es klare Kriterien, die Liebe notwendigerweise aufweist? Welchen Einfluss haben die kulturellen Vorbedingungen auf unsere Vorstellungen von Liebe?

In this chapter, we outline the range of argument forms involving causation that can be found in everyday discourse. We also survey empirical work concerned with the generation and evaluation of such arguments. This survey makes clear that there is presently no unified body of research concerned with causal argument. We highlight the benefits of a unified treatment both for those interested in causal cognition and those interested in argumentation, and identify the key challenges that must be met for a (...) full understanding of causal argumentation. In the last two decades, WORDNET has evolved as the most comprehensive computational lexicon of general English. In this article, we discuss its potential for supporting the creation of an entirely new kind of information resource for public health, viz. MEDICAL WORDNET. This resource is not to be conceived merely as a lexical extension of the original WORDNET to medical terminology; indeed, there is already a considerable degree of overlap between WORDNET and the vocabulary of medicine. Instead, we propose a (...) new type of repository, consisting of three large collections of (1) medically relevant word forms, structured along the lines of the existing Princeton WORDNET; (2) medically validated propositions, referred to here as medical facts, which will constitute what we shall call MEDICAL FACTNET; and (3) propositions reflecting laypersons’ medical beliefs, which will constitute what we shall call the MEDICAL BELIEFNET. We introduce a methodology for setting up the MEDICAL WORDNET. We then turn to the discussion of research challenges that have to be met in order to build this new type of information resource. Gibt es Bedingungen, die erfüllt sein müssen, damit man von einer Gemeinschaft – in Abgrenzung zu „Gesellschaft“ – sprechen kann?

Um was geht es beim Bedingungslosen Grundeinkommen? Und weshalb ist es auch ein Thema der Philosophie? Sollte die Gesellschaft grundsätzlich hinterfragen, was unter dem Begriff „Arbeit“ zu verstehen ist? Würde das Grundeinkommen Gerechtigkeit ermöglichen oder verunmöglichen?

Dieses Themendossier zeigt auf, mit welchen Themen sich die Philosophie befasst und wem die Philosophie was nützt. Wo heutzutage Philosophinnen und Philosophen wirken, wird ebenso betrachtet, wie die Frage, weshalb es sich überhaupt lohnt zu philosophieren.

Dieses Heft befasst sich mit der Bedeutung und der fortlaufenden Entwicklung der Wirtschaftsethik. Es wird gezeigt, wie die Wirtschaftsethik auf die aktuellen Krisen reagiert, warum einem Unternehmen eine moralische Verantwortung zukommt und was man sich unter ethischen Managementprinzipien vorstellen könnte.

Gibt es einen Zusammenhang zwischen Politik und Philosophie? Bei Fragen, wie sich der Staat legitimieren lässt, was Gerechtigkeit ist oder welche Rolle Interkulturalität, Toleranz und Anerkennung in der heutigen Gesellschaft spie- len, bietet die Philosophie Antworten und Denkanstösse.

Dieses Dossier befasst sich mit der Gleichstellung der Geschlechter: Wie muss man sich Gleichberechtigung in der Kindererziehung vorstellen? Können auch Männer Feministen sein? Was ist feministische Philosophie? Welche philoso- phischen Theorien gibt es zu Männern und Frauen?

Ist ein gutes Leben gleichzusetzen mit einem glücklichen Leben? Lässt sich Glück antrainieren? Wie gestaltet sich ein gutes Leben im Alter? Solcherlei Fragen, aber auch die Untersuchung, ob nur eine moralisch gute Lebensführung ein gutes Leben ermöglicht, werden im vorliegenden Dossier bearbeitet.

Wie wird Wissenschaft in der Gesellschaft wahrgenommen? Diese Frage lässt sich nicht leicht beantworten: Ist die gesellschaftliche Wahrnehmung von Wis- senschaft von Misstrauen geprägt? Oder von Unwissen über die Funktionswei- se von wissenschaftlicher Forschung?

The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. The present study examines how online instruction during the COVID pandemic impacted learning and performs a partial replication of a study by Hahn et al. (2012), which compared students’ testing outcomes of the Major Field Test in Business (MFTB) and the Comprehensive Business Exam (CBE). Our results find that online instruction during the 2020-2021 pandemic isolation period had no significant impact on pre- and post-COVID testing outcomes for either exam. It was further found that the question set employed by the (...) CBE exam appears to have changed from the pre- to the post-COVID testing timeframes, making this exam questionable for assurance of learning purposes when compared to prior year results. (shrink)

A large body of work has demonstrated the utility of the Bayesian framework for capturing inference in both specialist and everyday contexts. However, the central tool of the framework, conditionalization via Bayes’ rule, does not apply directly to a common type of learning: the acquisition of conditional information. How should an agent change her beliefs on learning that “If A, then C”? This issue, which is central to both reasoning and argumentation, has recently prompted considerable research interest. Este artigo pretende mostrar que e como ocorrem, na Doutrina da virtude de Kant, problemas relativos aosentido e referência dos juízos e conceitos fundamentais dessa obra, isto é, problemas semânticos. Tendo em vistaesse fim, explicitaremos de forma breve o desenvolvimento dessa problemática na filosofia prática de Kant e, em seguida, realizaremos a análise da Doutrina da virtude a partir do ponto de vistasemântico, a fim de identificar os mencionados problemas e as soluções fornecidas por Kant para estes problemas. -/- This (...) paper intends to show what and how problems related to the sense and reference of the fundamental judgments and concepts in Kant's Doctrine of virtue happen, that is, semantic problems. Hegel's most interesting and controversial claims about nonconceptual knowledge arise in contexts of value. This paper examines the relation between nonconceptual and conceptual knowledge in Hegel's Phenomenology, specifically in connection with early Greek aesthetics. I take up Hegel's claim that the ancient Greeks expressed in their myths, religious narratives, sculpture, and artistic materials certain high powered philosophical truths which they shouldn't express in words. I raise a paradox about his claims and show how his claims about ineffable knowledge clash with (...) his general propositional criterion of knowledge, namely, that for something to count as knowledge it must be expressible in words. However I argue that Hegel's thoughts about the matter were coherent and I solve the paradox. (shrink)

Suppose that two competing norms, N1 and N2, can be identified such that a given person’s response can be interpreted as correct according to N1 but incorrect according to N2. Which of these two norms, if any, should one use to interpret such a response? In this paper we seek to address this fundamental problem by studying individual variation in the interpretation of conditionals by establishing individual profiles of the participants based on their case judgments and reflective attitudes. To investigate (...) the participants’ reflective attitudes we introduce a new experimental paradigm called the Scorekeeping Task. As a case study, we identify the participants who follow the Suppositional Theory of conditionals (N1) versus Inferentialism (N2) and investigate to what extent internally consistent competence models can be reconstructed for the participants on this basis. After extensive empirical investigations, an apparent reasoning error with and-to-if inferences was found in one of these two groups. The implications of this case study for debates on the proper role of normative considerations in psychology are discussed. (shrink)

In this paper, new evidence is presented for the assumption that the reason-relation reading of indicative conditionals ('if A, then C') reflects a conventional implicature. In four experiments, it is investigated whether relevance effects found for the probability assessment of indicative conditionals (Skovgaard-Olsen, Singmann, and Klauer, 2016a) can be classified as being produced by a) a conversational implicature, b) a (probabilistic) presupposition failure, or c) a conventional implicature. After considering several alternative hypotheses and the accumulating evidence from other studies as (...) well, we conclude that the evidence is most consistent with the Relevance Effect being the outcome of a conventional implicature. This finding indicates that the reason-relation reading is part of the semantic content of indicative conditionals, albeit not part of their primary truth-conditional content. (shrink)

As we enter the 2020s, global poverty is still a grave and persistent problem. Alleviating and eradicating poverty within and across the world’s societies requires a thorough understanding of its nature and extent. Although economists still standardly measure absolute and relative poverty in monetary terms, a consensus is emerging that poverty is a socially relational problem involving deprivations in multiple dimensions, including health, standard of living, education and political participation. The anthology Dimensions of Poverty advances the interdisciplinary debate on multidimensional (...) poverty, and features contributions from leading international experts and early career researchers (including from the Global South). This introductory chapter gives an overview of formative debates, central concepts and key findings. While monetary poverty measures are still dominant in public and academic debate, their explanatory power has been drawn into question. We discuss relevant criticisms before outlining the normative concepts that can inform both multidimensional poverty and monetary measures, including basic capabilities, basic needs and social primary goods. Next, we introduce several influential multidimensional poverty indices, including the Human Development Index and the Multidimensional Poverty Index. The anthology shows in detail how such measures can be improved, from a variety of disciplinary perspectives. It shows that there are different methods of poverty research that require further investigation, including participatory studies, (value) surveys, public consensus building, the constitutional approach, and financial diaries. Finally, we show that there is an ongoing problem of epistemic asymmetries in global poverty research, and discuss responsibility for addressing poverty, including the responsibilities of academics. The remainder of the chapter is dedicated to a more detailed preview of the volume’s 20 contributions, which are assembled along the following five themes: (I) poverty as a social relation; (II) epistemic injustices in poverty research; (III) the social context of poverty; (IV) measuring multidimensional poverty; and (V) country cases. 'Hands Tied' brings together two very different films about hands: Maria Lassnig's Palmistry (1973) and Ayesha Hameed's A Rough History (of the Destruction of Fingerprints) (2016). These works are contextualised and their scope extended further by a roundtable discussion featuring participants Rachel Aumiller, Sam Dolbear, Nadine El-Enany, Amelia Groom, Clio Nicastro, Anja Sunhyun Michaelsen, and M. Ty., who discuss their relation to fate, work, pleasure, touch, and surveillance.
