Rawls acknowledges the analogy between his conception of the moral personality and the thought of Kant. However, many philosophers have discussed that similarity. This article aims to evaluate the Kantian foundation of Rawlsian liberty. Specifically, it assesses the idea of personal autonomy. The conclusion is that certain interpretation of Kant, which incorporates both his thinkings on the moral law and on happiness as an intrinsic purpose of the human being, allows the acknowledgement of the aforementioned analogy, and thus enables (...) a better understanding of the Rawlsian idea of freedom. The purpose of the article is to analyze the relational theory of personal autonomy proposed by Catriona Mackenzie. First, the theoretical context of the theory is shown, including key features and examples of relational theories of personal autonomy. Then Mackenzie's theory is presented, according to which seven conditions of autonomy should be distinguished. The conditions are grouped into three separate axes: self-determination, self-governance, and self-authorization. According to the theory, none of the conditions is necessary, and the assessment of (...) the level of an individual's autonomy is to be contextual. Finally, an attempt is made to assess the value of the conception proposed by the Australian scholar. It is argued that the condition of authenticity of practical identity should be replaced with the condition of coherence of practical identity. It is also suggested that for the theory to be useful in assessing the autonomy of decisions it should be supplemented with two further conditions: the coherence of a decision made by a person with her practical identity, and the absence of controlling influence such as coercion, persuasion, and manipulation. Paul Ricoeur argues that narration is lived life. Therefore, human experience has a narrative dimension, ie, it has a narrative structure and every effort you want to make for the human need to consider the narrative. For this reason, the text theory is converted to Ricoeur in a general model for the study of human action, since this is conceived as an open work to anyone who can read it. Given this general framework for discussion, we have deepened the notion (...) of the patient as “text”, and described their richness for reflection of bioethics and medical act, rescuing the value of listening, prudence, responsibility and rediscovering a place for the principle of autonomy and casuistry. -/- Paul Ricoeur sostiene que la narración es vida vivida. Por lo tanto, la experiencia humana posee una dimensión narrativa, es decir, tiene una estructura narrativa y todo esfuerzo que quiera dar cuenta de lo humano tendrá que contar con lo narrativo. Por esta razón, la teoría del texto se convierte para Ricoeur en un modelo general para el estudio de la acción humana, pues esta es concebida como una obra abierta a cualquiera que pueda leer. Este manual sobre tecnologías para un envejecimiento activo y saludable, también conocido como Vida Asistida Activa (Active Assisted Living – AAL en sus siglas en inglés), ha sido creado como parte de la Acción COST GoodBrother, que se ha llevado a cabo desde 2020 hasta 2024. Las Acciones COST son programas de investigación europeos que promueven la colaboración internacional, uniendo a investigadores, profesionales e instituciones para abordar desafíos sociales importantes. GoodBrother se ha centrado en las cuestiones éticas y de privacidad (...) relacionadas con la monitorización empleando cámaras y micrófonos en entornos de provisión de cuidados. El objetivo ha sido garantizar que, mientras las tecnologías AAL ayudan a las personas mayores y a los individuos vulnerables, sus derechos de privacidad y protección de datos se mantengan como una prioridad. Este manual está diseñado para guiar en el papel que juegan las tecnologías AAL en la mejora de la calidad de vida de personas mayores, sus cuidadores y personas con discapacidades. Las tecnologías AAL ofrecen herramientas para quienes enfrentan desafíos cognitivos o físicos. Pueden mejorar la independencia, asistir en las rutinas diarias y promover un entorno de vida más seguro. Sin embargo, el aumento de estas tecnologías también plantea preguntas importantes sobre la protección de datos y la autonomía del usuario. A~través de estudios de casos prácticos, este manual explora escenarios reales en los que se aplican las tecnologías AAL. Ofrecen información sobre sus beneficios y desafíos. PT. A noção de “pessoa”, pensada a partir do legado antropológico e filosófico do ocidente, afirma-se como uma unidade corporal e espiritual que determina a sua singularidade no seio da comunidade. A “pessoa” assim perspectivada assume uma importância destacada na reflexão ética das aplicações científicas de artificialização da vida humana. Muito concretamente, a noção de “pessoa” deve contribuir para a fundamentação ética das terapêuticas de transplantação. A transplantação representa um dos mais notáveis avanços da medicina do século XX e com (...) um impacto incontornável na prestação de cuidados de saúde. Os transplantes são considerados o tratamento mais eficaz para patologias crónicas que afectam a funcionalidade de determinados órgãos vitais, restituindo ao doente uma melhoria na sua saúde e/ou qualidade de vida. O sucesso desta terapêutica é, no entanto, condicionado pela disponibilização de pessoas que queiram fazer dádiva de si, do seu próprio corpo, para o bem-estar de outrem. Deste modo, a doação, realizada após a morte da pessoa ou ainda em vida, enfrenta vários desafios técnicos, mas também, e principalmente, desafios éticos. A nossa dissertação centra-se na reflexão ética da doação de órgãos e tecidos para transplante e no impacto que a dádiva de uma parte específica do corpo pode comportar na noção de “pessoa”. Deste modo, ao mesmo tempo em que se procura promover a doação de órgãos para aumentar o número de transplantes, também se vão delineando estratégias para salvaguardar a integridade corporal do dador e a eminente dignidade que o constitui como pessoa. As estratégias consistem fundamentalmente num diálogo entre o princípio de autonomia, que determina a singularidade da pessoa, e o princípio de solidariedade, que é desencadeado pela relação com o outro. Estes princípios éticos, articulados e uma vez cumpridos, são os alicerces da doação voluntária e altruísta, e impedem a instrumentalização e exploração da pessoa dadora. -/- EN. The western anthropological and philosophical notion of ‘person’ emerges as a corporal and spiritual entity, which determines his singularity at the level of community. From this perspective, the notion of ‘person’ holds an important place in ethical considerations concerning the scientific applications of artificial manipulation of human life. More precisely, the notion of ‘person’ must contribute towards the ethical basis of transplant therapeutics. The transplantation of human organs and tissues is one of the most notable advances in twentieth century medicine, and, as such, has had an unquestionable impact on health care practice. Transplants are now seen as the best treatment for chronic diseases that impair the function of some vital organs, improving the patient health and/or quality of life. The success of organs transplantation depends entirely upon the altruism of people giving their bodies for the well-being of others. Organ donation, performed during life or after death, raises not only technical, but also mainly ethical challenges. This work focuses on the ethical considerations associated with human organs and tissue donation for transplantation and on the impact that a donation of an organ has on the notion of ‘person’. At the same time that one recognizes the need to increase the number of organs for transplanting, there is also the need to preserve the donor’s corporal integrity and his eminent dignity. Strategies to preserve the donor’s corporal integrity and dignity must take into consideration the dialogue between the principle of autonomy, which is characterized by the singular entity, and the principle of solidarity, born out of one’s relationship with those around you. These ethical principles, once engaged and fulfilled, are the bases of a voluntary and altruistic donation, and prevent the donor from becoming a mere instrument and being exploited as such. El consentimiento informado del paciente se inserta en el ámbito de su autonomía decisoria. Aunque presenta un sustrato corporal, este aparece combinado con elementos de índole moral que presuponen una noción concreta de persona como libre y autónoma. Tanto de las definiciones doctrinales como del material normativo se desprende que se trata de una posición jurídica subjetiva del paciente, alternativamente calificada como una “pretensión” o “derecho subjetivo en sentido estricto”, en términos hohfeldianos; un “derecho negativo de defensa”, o una (...) “inmunidad”. En España, el Tribunal Constitucional ha vinculado el consentimiento informado del paciente al derecho fundamental a la integridad física y moral (15 CE), lo cual permite plantear el análisis en clave iusfundamental. Con todo, se advierten dudas e incompatibilidades entre la explicación habitual del consentimiento informado, su fundamento constitucional y su regulación jurídica. El objetivo del presente libro consiste en proporcionar una definición integral del consentimiento informado como derecho subjetivo del paciente y como manifestación de un derecho fundamental, a partir de una óptica poliédrica que aporta certeza en la práctica asistencial y jurídica. // The patient's right to informed consent is inserted within the scope of his decisional autonomy. Although it has a bodily background, it is combined with features of moral nature, which presupposes a concrete notion of the person as free and autonomous. Both, doctrinal approaches and normative legal material show that it is a subjective legal position of the patient, being alternatively qualified as a Hohfeldian “claim” or a “subjective right in a strict sense”; a "negative right" or an "immunity." The Spanish Constitutional Court has linked the informed consent of the patient to the fundamental right to physical and moral integrity (15 CE), which allows us to propose a fundamental rights-based analysis. Nonetheless, doubts and inconsistencies are perceived between the customary explanation of informed consent, its constitutional foundation and its legal regulation. The aim of this book is to provide a comprehensive definition of informed consent as subjective right of the patient and expression of a fundamental right, from a multi-fold perspective that provides certainty in both legal and health care practice. In society, human vulnerability is linked to many causes, such as poverty, injustice, discrimination and disease, among others. In the midst of this panorama of external factors that place people in situations of vulnerability, some see clearly - though others less so - a vulnerability that is inherent to the human person, simply because it exists. This approach to vulnerability is considered a conditio humana that affects everyone. Precisely because it is a human condition, vulnerability is closely related to autonomy. (...) For this reason, in this article we have tried to deepen the relationship between autonomy and vulnerability, focusing on an anthropological vulnerability and determining whether vulnerability is an obstacle to autonomy, since vulnerability and autonomy seem to be the representatives of polar opposites: one that is limited and can do nothing or very little, and the other that can do everything and has no limits. -/- La vulnerabilidad humana está asociada en la sociedad a múltiples causas, tales como la pobreza, la injusticia, la discriminación, las enfermedades, entre otras. En medio de este panorama de agentes externos que lleven a los seres humanos a situaciones vulnerables, se deja ver, para unos claramente, para otros no tanto, una vulnerabilidad propia a la persona humana por el simple hecho de existir. Uno de los enfoques de la vulnerabilidad es considerarla como una conditio humana que nos afecta a todos, asunto que ha sido insistentemente ratificado por el pensamiento contemporáneo. Justamente, por ser una conditio humana, la vulnerabilidad se encuentra en estrecha relación con la autonomía. Es así que en este trabajo nos hemos propuesto ahondar en ese entramado de autonomía y vulnerabilidad, tomando el enfoque de la vulnerabilidad antropológica con el fin de describir la interrelación entre dichos principios y determinando si la vulnerabilidad constituye un “freno” o no para la autonomía, pues vulnerabilidad y autonomía parecen ser los representantes de dos polos opuestos, el del que se encuentra limitado y no puede hacer nada o hace poco, y el del que puede hacerlo todo sin ningún límite. El objetivo de este artículo es clarificar la noción de «vida auténtica» tal y como es descrita por Joan Roura-Parella en su última obra Tema y variaciones de la personalidad (1950). Por «vida auténtica» se entiende una vida autogobernada, que permite al individuo realizar su propia singularidad y, por tanto, preservar su autonomía y dignidad como persona. Una vida dominada por factores ajenos al propio individuo, sean cuales sean éstos, es una vida alienada, que no permite el desarrollo del (...) individuo en tanto la persona que es. Se señala la relevancia filosófica de la propuesta de Roura-Parella, que es la de ofrecer una justificación no-evidencial para una forma de vida cristiana, agapística. De acuerdo con Roura-Parella, una forma de vida basada en la entrega amorosa para con el prójimo está justificada en tanto que ésta es el resultado último de nuestra propia condición natural, constituyendo así un acto de afirmación personal y siendo, por tanto, condición necesaria para gozar de una vida auténtica — «la vida alcanza su hondo sentido al salirse de sí misma para darse a los demás» (Roura-Parella, Tema y variaciones de la personalidad, 1950, p. 229). Se señalan las diferencias y semejanzas de la propuesta de Roura-Parella con respecto a las de Miguel de Unamuno y Joaquim Xirau, autores que fueron cercanos a Roura-Parella y quienes, aunque partiendo de razonamientos distintos a los de Roura-Parella, también concibieron la entrega amorosa para con el prójimo como un acto de afirmación personal. El emergente paradigma educativo del aprendizaje ubicuo está dando lugar a nuevos entornos virtuales de aprendizaje. El objetivo de este estudio es contribuir a esta transformación en los procesos de aprendizaje para avanzar en el dominio del inglés, con un diseño didáctico innovador inspirado en el concepto de ‘entorno personal de aprendizaje’, con el uso de vídeos de YouTube. Los resultados demuestran el potencial pedagógico de los PLE, su eficacia no sólo a nivel cognitivo sino también como experiencia emocional. (...) En 2007, la Declaración sobre los Derechos de los Pueblos Indígenas fue adoptada por la Asamblea General con la mayoría de los estados miembros de las Naciones Unidas. La declaración tiene relevancia para cualquiera que esté al mando o en contacto con los pueblos indígenas. Un efecto central de la dominancia de la cultura globalizada sobre culturas indígenas es la asimetría de la percepción e influencia mutua. Debido a los efectos de la presión social externa de la globalización los pueblos (...) indígenas tienen poca libertad de elección. Ejercer su derecho a una autonomía cultural en educación y estilo de vida es muy difícil para los indígenas. Por parte de gobiernos, problemas con los derechos sobre la tierra son un obstáculo para reconocer la autonomía de los pueblos indígenas. Algunos artículos de la declaración de derechos indígenas son presentados que tienen relevancia para personas externas, como investigadores o turistas, en contacto con personas indígenas. -/- The Declaration on the Rights of Indigenous peoples is an instrument to combat inequalities on an international level. However, the implementation is still a matter of disregard and conflict, as states are reluctant to give up their privileges. Yet, with the Declaration, a foundation has been laid to claim acceptance and respect of indigenous lifestyles, the use of their territories by themselves, the passing-on of culturally specific knowledge to the next generations, and other aspects. The new situation of International Law also brought along consequences for any external person contacting an indigenous culture, be it scientists, tourists or others. (shrink)

This paper deals with Veronica Rodriguez-Blanco’s answer to the paradox of the normativity of law: How can autonomous self-legislating persons act, without compromising their autonomy and their will, following legal rules? Regarding Rodriguez-Blanco’s answer, I offer two main critiques. The first one is based on Rodriguez-Blanco’s comments to David Enoch’s paper in which I argue against the idea that a descriptive theoretical account of law can, and should, give an answer to general problems of normativity due to the fact that (...) a theoretical approach that engages in questions about the normativity of law cannot be purely descriptive, therefore against Rodriguez-Blanco I conclude that Enoch’s answer is the only response a descriptive account is able to offer. The second criticism focuses on Rodriguez-Blanco’s response to the paradox and argues that her solution is not, in fact, a descriptive one, but one that relies on strong normative premises, which as it turns out defend a perfectionist perspective towards the law.Resumen:Este trabajo analiza la respuesta que Veronica Rodriguez-Blanco propone para resolver la paradoja de la normatividad del derecho: ¿Cómo es posible que una persona autónoma actúe siguiendo los mandatos de normas jurídicas sin comprometer su autonomía ni su voluntad? El autor ofrece dos críticas a la respuesta de Rodriguez-Blanco. La primera de ellas está basada en los comentarios que Rodriguez-Blanco ha hecho sobre la propuesta de David Enoch. En este punto, el autor argumenta en contra de la idea según la cual una perspectiva descriptiva del derecho puede, y debe, tratar de responder a los problemas generales de la normatividad del derecho. De acuerdo con el autor, una perspectiva que pretenda dar respuesta a los problemas de la normatividad del derecho no puede ser una perspectiva puramente descriptiva. En este sentido, el autor sostiene que la respuesta que ofrece Enoch es la única respuesta que una perspectiva descriptiva del derecho puede dar. La segunda crítica está dirigida a la respuesta que Rodriguez-Blanco da sobre la paradoja de la normatividad. En este segundo punto el autor argumenta que la perspectiva de Rodriguez-Blanco no es una perspectiva descriptiva como ella presume, sino que adopta una perspectiva normativa la cual, además, está comprometida con una idea perfeccionista del derecho. Comentaba en el Prólogo a la 1ª edición que nos cuesta distinguir las técnicas de los métodos y aceptar que la buena investigación clínica es la que se realiza con método riguroso. Este método reposa en cuatro pilares: que la pregunta o cuestión formulada sea relevante, que esté enunciada de manera precisa y operativa, que sea abordada o respondida con el mejor medio disponible en cada circunstancia, y que evite redundancias o repeticiones de cuestiones que ya han sido examinadas por (...) otros investigadores. Añadía que es imprescindible una dosis de curiosidad y de entusiasmo por lo que se examina. Como se ha dicho con frecuencia, el ensayo clínico es, entre los métodos de investigación clínica, el "patrón oro", el que, gracias a su característica inherente (la distribución aleatoria), está sujeto a menores posibilidades de sesgos. Esta consideración no ha cambiado. Sin embargo, mayor validez interna del método no implica mayor relevancia de los resultados obtenidos. Actualmente es común examinar protocolos de ensayos clínicos bien diseñados, cuyo "único" problema es que pretenden evaluar aspectos de escaso interés farmacológico, terapéutico, epidemiológico o sanitario. ¿Qué interés tiene la evaluación del quinto fármaco de una serie en una indicación para la que ya hay cuatro análogos que le han precedido en su desarrollo? ¿Qué interés tiene la evaluación de un nuevo hipocolesterolemiante o de un nuevo fármaco para la osteoporosis si no se conocen, respectivamente, el impacto de la hipercolesterolemia como factor de riesgo de cardiopatía isquémica o la epidemiología de las fracturas en mujeres postmenopáusicas en nuestro medio? En relación con estos ejemplos, tendría mucho más interés conocer los determinantes epidemiológicos y la historia natural de la cardiopatía isquémica en nuestro medio y conocer la epidemiología de las fracturas "espontáneas" y su impacto sobre la demanda asistencial; para ello serían de mucha utilidad métodos de investigación cuya validez intrínseca podría ser considerada "subóptima" en comparación con el ensayo clínico. En los últimos años ha irrumpido con fuerza en numerosísimas publicaciones el concepto de la "medicina basada en pruebas". Esta moda refleja en parte la importancia que de manera creciente reguladores e industria farmacéutica han concedido a los ensayos clínicos: se ha alcanzado un consenso global sobre la necesidad de demostrar la "eficacia" de los nuevos medicamentos por medio de ensayos clínicos controlados. De este modo, los organismos reguladores y autoridades sanitarias exigen ensayos clínicos como uno de los elementos necesarios para obtener el registro de un nuevo medicamento. Como consecuencia, se realizan y publican muchos más ensayos clínicos que antaño, y actualmente se pueden encontrar ensayos que sustentan la eficacia de la mayoría de los medicamentos disponibles en indicaciones específicas. Si hace unos años bastaba con examinar si había ensayos clínicos que demostraran la eficacia de un determinado medicamento antes de adoptarlo como uno de los de uso común (o de incluirlo en el formulario de un hospital), en la actualidad estas decisiones son más complejas, y se basan sobre todo en una consideración atenta de los objetivos, los métodos y los resultados de cada ensayo o de otros estudios destinados a evaluar eficacia, seguridad, conveniencia o comodidad y coste. Un buen clínico debe saber a la vez leer críticamente las publicaciones científicas y producir información relevante. Leer críticamente significa evaluar la pertinencia de los problemas investigados, los métodos aplicados y la interpretación de los resultados obtenidos. Producir información relevante implica saber identificar los problemas que deben y pueden ser objeto de investigación, formularlos, y ser protagonista (generalmente como parte de un equipo) de la elaboración del plan de investigación. En los últimos años se han publicado varios textos similares al que tiene en sus manos, todos ellos de gran calidad. El presente no pretende ser el más exhaustivo, sino sobre todo interesar a los profesionales sanitarios en el apasionante campo de la investigación clínica, en su sentido más amplio, estimulando la autonomía del lector para investigar un problema o una situación, y para aprender a leer las publicaciones científicas clínicas. Su lectura debe contribuir a que términos como "doble ciego", "p<0,05", "casos y controles", etc. dejen de ser fetiches-misterios, para convertirse en herramientas conceptualmente sencillas, útiles para la evaluación de la actividad asistencial. Esta nueva edición está muy ampliada respecto a la anterior. Se han reorganizado las generalidades sobre los objetivos y métodos de la investigación clínica, se han ampliado algunos aspectos del ensayo clínico, como el análisis de subgrupos, los aspectos estadísticos y éticos y las publicaciones sobre ensayos clínicos, se han añadido cuatro nuevos capítulos, sobre efectividad y eficacia, metaanálisis, ensayos en un solo paciente y farmacoeconomía, y el Glosario ha sido revisado y ampliado (sobre todo con términos de farmacocinética, desarrollo preclínico de fármacos, estadística y biotecnología genética), e incluye casi 750 términos. Para su elaboración me he basado en numerosos textos y diccionarios,a aunque he reformulado la mayoría de las definiciones y he optado por añadir en ocasiones algún comentario personal a muchas de ellas. Carles Vallvé ha escrito el capítulo sobre Normas de Buena Práctica Clínica. La época en la que vivimos se caracteriza por una doble y profunda crisis antropológica y educativa lo que hace que la misión educativa sea particularmente vulnerable. Ésta, entendida como el acompañamiento personal de los alumnos en el proceso de crecimiento, en vista del logro de la capacidad de aplicar los conocimientos y la comprensión y una autonomía de juicio de los alumnos, puede aparecer como un terreno accidentado para caminar. Si además, junto a esto, el objetivo de (...) la educación fuera perseguir una formación integral: humana e intelectual, capaz de formar personalidades maduras y equilibradas, capaces de convivir con los demás en el mundo, nos toparíamos con una aporía aparentemente indestructible. El sabio intenta superar la aporía de la necesidad e imposibilidad de una educación integral del hombre en la posmodernidad y posthumanismo y utiliza la investigación filosófico-pedagógica como recurso para superar esta aporía. La valentía de educar para el bien es el resultado de un itinerario de reflexión e investigación realizado en la doble vía de una profunda teoría filosófico-pedagógica y de una percepción empírica, adquirida a lo largo de relaciones educativas prolongadas y, a veces complejas, vividas en primera persona con los sujetos de la formación. En particular, la práctica educativa de los últimos años parece mostrar cada vez más inequívocamente la urgencia de una renovación de la educación que pase por la fundación de una nueva ciencia de los valores, capaz de encarnarse progresivamente en los pliegues de la historia. Il dilemma «autonomia del politico-autonomia del sociale» ha le sue radici in quello tra trascendenza e immanenza, e si riproduce nel corso di tutta l’elaborazione teorica di Laclau e Negri, dagli scritti degli anni ’70 fino agli interventi più recenti. Queste due impostazioni teoriche si intersecano in un dialogo a distanza, la cui analisi permette di cogliere gli aspetti salienti di differenziazione e i motivi profondi di incompatibilità, ma anche di dimostrare che, considerato in questi termini, tale dilemma non ha (...) soluzione. Questo intervento si propone di indagare la dicotomia tra «sociale» e «politico» in Negri e Laclau tramite un’attenzione particolare alle categorie di immanenza e trascendenza, con l’obiettivo di mostrare come le due posizioni si escludano a vicenda poiché entrambe formulate nei termini di un aut aut tra «politico» e «sociale» dove i due lemmi vengono esclusivamente giocati uno contro l’altro. Così facendo, i due non affrontano realmente la questione del rapporto tra «sociale» e «politico», ma scelgono semplicemente una delle due parti escludendo – o contrastando – l’altra. Per prima cosa, verrà fatta emergere l’autonomia del politico all’opera nei lavori di Laclau: in un percorso a ritroso dagli scritti più recenti (a partire dalle critiche che egli muove a Negri e Hardt) fino ai primi testi pubblicati, verrà mostrata la priorità che Laclau attribuisce al «politico» a discapito del «sociale», e come in questa impostazione sia fondamentale il rifiuto della categoria di immanenza. In secondo luogo, l’attenzione verrà dedicata agli interventi di Negri dagli anni ’70 ad oggi, compresi alcuni «scambi diretti» con Laclau. Verrà evidenziato il modo in cui Negri, per sfuggire all’autonomia del politico, elabora una autonomia del sociale in cui il rapporto tra «sociale» e «politico» viene concepito unicamente come conflittuale, ovvero come tentativo continuo del «politico» e della sua trascendenza di annichilare il «sociale» e le sue potenzialità costituenti. In conclusione, si osserverà che i termini in cui Negri e Laclau concepiscono il «sociale» e il «politico» a partire dalle categorie di trascendenza e immanenza (e le rispettive «autonomie» che producono) impediscono di pensare un rapporto tra «sociale» e «politico» che preveda una interazione tra lotte sociali e organizzazione politica, e dunque escludono la possibilità da una parte che le lotte sociali si consolidino nel tempo e formalizzino le loro conquiste immediate, dall’altra che le organizzazioni politiche non si svuotino della loro sostanza restando meri simulacri. In our article (Zawadzki and Adamczyk 2021), we analyzed threats that novel memory modifying interventions may pose in the future. More specifically, we discussed how optogenetics’ potential for reversible erasure/deactivation of memory “may impact authenticity by producing changes at different levels of personality.” Our article has received many thoughtful open peer commentaries for which we would like to express our great appreciation. We have identified two main threads of objections. They are related to the potential applicability of optogenetics as a (...) therapeutic memory modification technology (MMT) in humans—applicability thread, and the normative value of authenticity, that is, the assumption that preserving authenticity is valuable (either in general or in the particular approach we adopted)—normative thread. Both of these threads concern fundamental issues: The former deals with the scientific credibility of the case vignette on which our discussion is based, and the latter deals with the normative weight of our considerations. We think that addressing both of them can be instructive in a broader context as they reflect a more general disagreement among neuroethicists about the very purpose and method of our discipline. Nel suo intento di rinnovare il nostro modo di comprendere l’esistenza e questa stessa comprensione, Morin spiega una retorica affatto singolare che si contraddistingue per il ricorso ‘disinvolto’ a concetti filosofici e scientifici già consolidati, ma reinterpretati nel suo quadro concettuale, ed a termini da egli stesso coniati. Per tali ragioni, oltre che per le parole non italiane e quando è specificato altrimenti, mi servirò del corsivo tutte le volte che riferisco un concetto originale del filosofo francese. Ciò non solo (...) per mantenermi il più possibile fedele alla lettera dei suoi scritti ma anche e soprattutto per rendere l’intenzione locutoria, ovvero l’enfasi e a tratti la ‘drammaticità’ del suo discorso. Per tutte le citazioni, non solo di Morin, uso le virgolette doppie e tra parentesi quadre inserisco eventuali miei interventi. Le virgolette singole intendono il senso lato di un termine. Quando invece impiego concetti scientifici o filosofici nel significato tecnico che hanno acquisito all’interno del loro orizzonte disciplinare (quindi non nell’interpretazione di Morin, per intenderci), mi servo dei caporali. Una precisazione ulteriore merita il concetto di complessità organizzazionale che rientra tra quelli che hanno guadagnato a Morin la critica di abusare di neologismi. Tale concetto si propone di mettere in rilievo il carattere attivo e creativo della complessità. In francese questa differenza emerge chiaramente perché egli cambia organisation con organisaction. In italiano essa può rendersi per iscritto con organizz-azione ma nel parlato si può apprezzare meglio nell’attributo appunto organizzazionale. La messe di note a corredo del testo si propone, oltre che fornire ulteriori approfondimenti, confronti e una puntuale fonte bibliografica, di mettere in rilievo la coerenza che au fonde il «sistema» di idee elaborato da Morin mantiene al suo interno e, forse a dispetto delle sue stesse intenzioni, con il pensiero filosofico occidentale (fin dalla sua denominazione come metodo). Recent epistemology has focused almost exclusively on propositional knowledge. This paper considers an underexplored area of epistemology, namely knowledge of persons: if propositional knowledge is a state of mind, consisting in a subject's attitude to a (true) proposition, the account developed here thinks of interpersonal knowledge as a state of minds, involving a subject's attitude to another (existing) subject. This kind of knowledge is distinct from propositional knowledge, but it exhibits a gradability characteristic of context-sensitivity, and admits of shifty thresholds. (...) It is supported by a wide range of unexplored linguistic data and intuitive cases; and it promises to illuminate debates within epistemology, philosophy of religion, and ethics. (shrink)

What is it for a person to have style? Philosophers working in action theory, ethics, and aesthetics are surprisingly quiet on this question. I begin by considering whether theories of artistic style shed any light on it. Many philosophers, artists, and art historians are attracted to some version of the view that artistic style is the expression of personality. I clarify this view and argue that it is implausible for both artistic style and, suitably modified, personal style. In fact, (...) both theories of style crack along the same line, which suggests that they can indeed be mutually illuminating. I articulate and defend a view of personal style according to which, roughly, having style is a matter of expressing one’s ideals. I show how this illuminates the widely neglected value of personal style and propose a new, analogous theory of individual artistic style: artistic style is the expression of the ideals the artist has for her art. Our aim in this entry is to articulate the state of the art in the moral psychology of personal identity. We begin by discussing the major philosophical theories of personal identity, including their shortcomings. We then turn to recent psychological work on personal identity and the self, investigations that often illuminate our person-related normative concerns. Phineas Gage’s story is typically offered as a paradigm example supporting the view that part of what matters for personal identity is a certain magnitude of similarity between earlier and later individuals. Yet, reconsidering a slight variant of Phineas Gage’s story indicates that it is not just magnitude of similarity, but also the direction of change that affects personal identity judgments; in some cases, changes for the worse are more seen as identity-severing than changes for the better of (...) comparable magnitude. Ironically, thinking carefully about Phineas Gage’s story tells against the thesis it is typically taken to support. (shrink)

The personal identity relation is of great interest to philosophers, who often consider fictional scenarios to test what features seem to make persons persist through time. But often real examples of neuroscientific interest also provide important tests of personal identity. One such example is the case of Phineas Gage – or at least the story often told about Phineas Gage. Many cite Gage’s story as example of severed personal identity; Phineas underwent such a tremendous change that Gage (...) “survived as a different man.” I discuss a recent empirical finding about judgments about this hypothetical. It is not just the magnitude of the change that affects identity judgment; it is also the negative direction of the change. I present an experiment suggesting that direction of change also affects neuroethical judgments. I conclude we should consider carefully the way in which improvements and deteriorations affect attributions of personal identity. This is particularly important since a number of the most crucial neuroethical decisions involve varieties of cognitive enhancements or deteriorations. (shrink)

While first-person methods are essential for a science of consciousness, it is controversial what form these methods should take and whether any such methods are reliable. I propose that first-person experiments are a reliable method for investigating conscious experience. I outline the history of these methods and describe their characteristics. In particular, a first-person experiment is an intervention on a subject's experience in which independent variables are manipulated, extraneous variables are held fixed, and in which the subject makes a phenomenal (...) judgement about the target experience of the investigation. I examine historical and contemporary examples of first-person experiments: Mariotte’s demonstration of the visual blind spot, Kanizsa’s subjective contours, the Tse Illusion, and investigations of the non-uniform resolution of the visual field. I discuss the role that phenomenal contrast plays in these methods, and how they overcome typical introspective errors. I argue that their intersubjective repeatability is an important factor in their scientific status, however, it is not the only factor. That they control for extraneous factors and confounds is another factor which sets them apart from pseudoscience (e.g., the perception of auras), and hence another reason for classifying them as genuine experiments. Furthermore, by systematically mapping out the structure of visual experience, these methods make scientific progress. Praises of such first-person experimental approaches may not always be sung by philosophers and psychologists, but they continue to flourish as respectable scientific methods nevertheless. (shrink)

In this paper I outline and defend a new approach to personal-identity—personal-identity non-cognitivism—and argue that it has several advantages over its cognitivist rivals. On this view utterances of personal-identity sentences express a non-cognitive attitude towards relevant person-stages. The resulting view offers a pleasingly nuanced picture of what we are doing when we utter such sentences.

What’s the difference between those psychological posits that are ‘me” and those that are not? Distinguishing between these psychological kinds is important in many domains, but an account of what the distinction consists in is challenging. I argue for Psychological Constructionism: those psychological posits that correspond to the kinds within folk psychology are personal, and those that don’t, aren’t. I suggest that only constructionism can answer a fundamental challenge in characterizing the personal level – the plurality problem. The (...) things that plausibly qualify as personal are motley. Other attempts at accounting for the personal level either cannot accommodate this plurality, or cannot explain what unifies the personal. Given arguments others have given for a pluralistic conception of folk psychology, constructionism explains and predicts this plurality in a systematic and unified way, thereby solving the plurality problem. The literature acknowledges a distinction between immoral, amoral and moral management. This paper makes a case for the employee (at any level) as a moral agent, even though the paper begins by highlighting a body of evidence which suggests that individual moral agency is sacrificed at work and is compromised in deference to other pressures. This leads to a discussion about the notion of discretion and an examination of a separate, contrary body of literature which indicates that some individuals in (...) corporations may use their discretion to behave in a socially entrepreneurial manner. My underlying assumption is that CSR isn’t solely driven by economics and that it may also be championed as a result of a personal morality, inspired by employees’ own socially oriented personal values. A conceptual framework is put forward and it is suggested that individuals may be categorized as Active or Frustrated Corporate Social Entrepreneurs; Conformists or Apathetics, distinguished by their individualistic or collectivist personal values. In a discussion of the nature of values, this paper highlights how values may act as drivers of our behavior and pays particular attention to the values of the entrepreneur, thereby linking the existing debate on moral agency with the field of corporate social responsibility. Este trabalho é uma breve análise do livro eletrônico ― tomado como meio de comunicação relevante para a educação e a cultura no futuro próximo ― centrada nos potenciais e desafios que ele apresenta em relação a acesso e autonomia. A análise visa apontar tendências gerais relativas às características das plataformas de leitura (dispositivos leitores e softwares), particularmente para leitores. Essas tendências são extrapoladas a partir de um pequeno número de exemplos ou casos já existentes. O trabalho avalia as restrições (...) à autonomia impostas pelo caráter proprietário das plataformas de leitura atuais, bem como seus efeitos sobre a mercantilização do livro, e esboça alternativas possíveis, ligadas a padrões abertos de arquivos, software livre e hardware livre. Conclui relacionando esse novo meio à chamada “era do acesso” (RIFKIN) ― evidenciada pela transição da propriedade à licença de uso dos livros ―, e avaliando as principais consequências possíveis (positivas e negativas) dessa transformação. There has been a call for a potentially revolutionary change to our existing understanding of the psychological concept of personal identity. Apparently, people can psychologically represent people, including themselves, as multiple individuals at the same time. Here we ask whether the intransitive judgments found in these studies truly reflect the operation of an intransitive concept of personal identity. We manipulate several factors that arbitrate between transitivity and intransitivity and find most support for transitivity: in contrast to prior work, (...) most participants do not make intransitive judgments when there is any reason to favor one individual over another. People change which single individual they personally identify with, depending on which individual competes more strongly or weakly for identity, rather than identifying with both individuals. Even when two individuals are identical and therefore both entitled to be the same person, we find that people make more transitive judgments once they understand the practical commitments of their responses (Experiment 4), and report not being able to actually imagine two perspectives simultaneously when reasoning about the scenario (Experiment 5). In short, we suggest that while people may make intransitive judgments, these do not reflect that they psychologically represent identity in an intransitive manner. (shrink)

Many philosophers think that we should use a lottery to decide who gets a good to which two persons have an equal claim but which only one person can get. Some philosophers think that we should save identified persons from harm even at the expense of saving a somewhat greater number of statistical persons from the same harm. I defend a principled way of justifying both judgements, namely, by appealing to the decreasing marginal moral value of survival chances. I identify (...) four desiderata that, I contend, any such justification should satisfy, and explain how my account meets these desiderata, unlike some previous accounts. (shrink)

There has been a growing interest in research concerning memory modification technologies (MMTs) in recent years. Neuroscientists and psychologists are beginning to explore the prospect of controllable and intentional modification of human memory. One of the technologies with the greatest potential to this end is optogenetics—an invasive neuromodulation technique involving the use of light to control the activity of individual brain cells. It has recently shown the potential to modify specific long-term memories in animal models in ways not yet possible (...) with other MMTs. As the therapeutic potential of optogenetics has already prompted approval of the first human trials, it is especially important and timely to consider the opportunities and dangers this technology may entail. In this article, we focus on possible consequences of optogenetics as an MMT by analyzing fundamental threats potentially associated with memory modifications: the potential disruption of personality and authenticity. The unusually loyal supporters of Donald Trump are often described as a cult. How can we understand this extreme phenomenon in U.S. politics? We develop theoretical expectations and use the Big Five personality dimensions to investigate whether Trump's most loyal supporters share personality characteristics that might make them inclined to cult-like support. We find that (1) Trump's supporters share high levels of Conscientiousness; (2) this is substantively and statistically distinguishable from the commonly identified association between Conscientiousness and Conservatism; and (3) (...) the association is highly robust to a range of sensitivity tests. Our main findings are robust across two surveys. Study 1 is an online survey conducted in 2021 designed specifically for this project. Study 2 is the 2016 American National Election Study (ANES). Este trabajo tiene como objetivo examinar cómo el legado kantiano de la razón crítica sigue vigente, pues se sostiene en un imperativo teórico fundado en la autonomía. Tal como argumento, este imperativo «categórico-teórico» se estructura gracias a la primacía de la razón práctica por sobre la razón teórica. El ensayo está estructurado en tres secciones. En la primera discuto brevemente el compromiso con la verdad propio de la ética de Sócrates y Platón, quienes inauguran el racionalismo crítico, según Popper. (...) Luego, en la segunda sección examino la filosofía kantiana y su propuesta, la cual ciertamente influye en el «Tratado contra el Método» de Paul Feyerabend. Finalmente, en la tercera sección, analizo la conexión entre razón crítica y razón teórica. En particular, muestro que la primera gobierna la segunda, y que la autonomía es parte de la naturaleza racional humana. Dicha naturaleza ciertamente explica por qué la razón crítica sigue vigente en la época contemporánea. (shrink)

The popularity of theodicy over the past several decades has given rise to a countermovement, “anti-theodicy”, which admonishes attempts at theodicy for various reasons. This paper examines one prominent anti-theodical objection: that it is hubristic, and attempts to form an approach to theodicy which evades this objection. To do so I draw from the work of Eleonore Stump, who provides a framework by which we can glean second-personal knowledge of God. From this knowledge, I argue that we can derive (...) a theodicy which does not utilise the kind of analytic theorising anti-theodicists accuse of intellectual hubris. (shrink)

In Reasons and Persons, Parfit (1984) posed a challenge: provide a satisfying normative account that solves the Non-Identity Problem, avoids the Repugnant and Absurd Conclusions, and solves the Mere-Addition Paradox. In response, some have suggested that we look toward person-affecting views of morality for a solution. But the person-affecting views that have been offered so far have been unable to satisfy Parfit's four requirements, and these views have been subject to a number of independent complaints. This paper describes a person-affecting (...) account which meets Parfit's challenge. The account satisfies Parfit's four requirements, and avoids many of the criticisms that have been raised against person-affecting views. (shrink)

I want to examine the implications of a metaphysical thesis which is presupposed in various objections to Rawls' theory of justice.Although their criticisms differ in many respects, they concur in employing what I shall refer to as the continuity thesis. This consists of the following claims conjointly: (1) The parties in the original position (henceforth the OP) are, and know themselves to be, fully mature persons who will be among the members of the well-ordered society (henceforth the WOS) which is (...) generated by their choice of principles of justice. (2) The OP is a conscious event among others, integrated (compatibly with the constraints on knowledge and motivation imposed on the parties) into the regular continuity of experience that comprises each of their ongoing constitutes lives. (3) The parties in the OP thus are, and regard themselves as, psychologically continuing persons, partially determined in personality and interests by prior experiences, capable of recollection and regret concerning the past, anticipation and apprehensiveness regarding the future, and so on. Although the continuity thesis as stated above is not at odds with any of the conditions that define the OP, its exegetical validity is a matter for discussion. I shall be concerned to argue that if it is indeed contained in or a consequence of Rawls' theory, then it casts into doubt the capacity of the OP to generate or justify any principles of justice at all. On the other hand, if the continuity thesis is viewed as dispensable and unnecessary to the Rawlsian enterprise, then Rawls is correct in maintaining the irrelevance of the question of personal identity to the construction of his moral theory. In this case, the contract-theoretic, instrumentalist justification for the two principles of justice (henceforth the 2PJ) needs to be supplanted by a modified conception of wide reflective equilibrium. The considerations that form the bulk of this discussion then may be understood as providing a rationale for Rawls' recent revisions in the model of justification on which his theory of justice rests, and for his increasing emphasis on us as moral mediators between the OP and the WOS. Now I want to consider the question of whether or not, given the textual evidence, anything like the continuity thesis is stated or implied by Rawls, and what problems for his theory, if any, turn on a positive or negative answer to this question. -/- . According to second‐personal approaches to moral obligation, the distinctive normative features of moral obligation can only be explained in terms of second‐personal relations, i.e. the distinctive way persons relate to each other as persons. But there are important disagreements between different groups of second‐personal approaches. Most notably, they disagree about the nature of second‐personal relations, which has consequences for the nature of the obligations that they purport to explain. This article aims to distinguish these groups from (...) each other, highlight their respective advantages and disadvantages, and thereby indicate avenues for future research. (shrink)

When involved in a disagreement, a common reaction is to tell oneself that, given that the information about one’s own epistemic standing is clearly superior in both amount and quality to the information about one’s opponent’s epistemic standing, one is justified in one’s confidence that one’s view is correct. In line with this natural reaction to disagreement, some contributors to the debate on its epistemic significance have claimed that one can stick to one’s guns by relying in part on information (...) about one’s first-order evidence and the functioning of one’s cognitive capacities. In this article, I argue that such a manoeuvre to settle controversies encounters the problem that both disputants can make use of it, the problem that one may be wrong about one’s current conscious experience, and the problem that it is a live possibility that many of one’s beliefs are the product of epistemically distorting factors. I also argue that, even if we grant that personal information is reliable, when it comes to real-life rather than idealized disagreements, the extent of the unpossessed information about one’s opponent’s epistemic standing provides a reason for doubting that personal information can function as a symmetry breaker. Many philosophers hypothesize that our concept of personal identity is partly constituted by the one-person-one-place rule, which states that a person can only be in one place at a time. This hypothesis has been assumed by the most influential contemporary work on personal identity. In this paper, we report a series of studies testing whether the hypothesis is true. In these studies, people consistently judged that the same person existed in two different places at the same time. This (...) result undermines some widely held philosophical assumptions, supports others, and fits well with recent discoveries on identity judgments about inanimate objects and non-human animals. A paper of Roger Crisp’s four years ago contained arguments that seemed to imply that having deep personal relationships does not constitute an element of well‐being. The lesson to draw from that paper of Crisp’s, according to a recent journal article of mine, is that one’s having a deep personal relationship does constitute an element of one’s well‐being on condition that one’s affection for the other person is merited. On person-affecting views in population ethics, the moral import of a person’s welfare depends on that person’s temporal or modal status. These views typically imply that – all else equal – we’re never required to create extra people, or to act in ways that increase the probability of extra people coming into existence. -/- In this paper, I use Parfit-style fission cases to construct a dilemma for person-affecting views: either they forfeit their seeming-advantages and face fission analogues of the problems (...) faced by their rival impersonal views, or else they turn out to be not so person-affecting after all. In light of this dilemma, the attractions of person-affecting views largely evaporate. What remains are the problems unique to them. (shrink)

Daniel Dennett's distinction between personal and subpersonal explanations was fundamental in establishing the philosophical foundations of cognitive science. Since it was first introduced in 1969, the personal/subpersonal distinction has been adapted to fit different approaches to the mind. In one example of this, the ‘Pittsburgh school’ of philosophers attempted to map Dennett's distinction onto their own distinction between the ‘space of reasons’ and the ‘space of causes’. A second example can be found in much contemporary philosophy of psychology, (...) where Dennett's distinction has been presumed to be equivalent to Stephen Stich's distinction between doxastic and subdoxastic states. Both these interpretations of the personal/subpersonal distinction, and also Dennett's own philosophical views of the mind, go beyond the personal/subpersonal distinction itself. They each involve supplementing the distinction between personal and subpersonal explanations with metaphysical claims about the relationship between the two kinds of explanation and the entities they posit. I argue for the moral relevance of a category of individuals I characterize as far-persons. Following Gary Varner, I distinguish near-persons, animals with a " robust autonoetic consciousness " but lacking an adult human's " biographical sense of self, " from the merely sentient, those animals living "entirely in the present." I note the possibility of a third class. Far-persons lack a biographical sense of self, possess a weak autonoetic consciousness, and are able to travel mentally through time a distance (...) that exceeds the capacities of the merely sentient. Far-persons are conscious of and exercise control over short-term cognitive states, states limited by their temporal duration. The animals in question, human and nonhuman, consciously choose among various strategies available to them to achieve their ends, making them subjects of what I call "lyrical experience:" brief and potentially intense pleasures and pains. But their ends expire minute-by-minute, not stretching beyond, I say metaphorically, the present hour. I conclude by discussing the moral status of far-persons. (shrink)

This paper seeks to determine the extent to which individuals with borderline personality disorders can be held morally responsible for a particular subset of their actions: disproportionate anger, aggressions and displays of temper. The rationale for focusing on these aspects lies in their widespread acknowledgment in the literature and their plausible primary association with blame directed at BPD patients. BPD individuals are indeed typically perceived as “difficult patients” (Sulzer 2015, Bodner et al. 2011), significantly more so than schizophrenic or depressive (...) patients (Markam 2003). The “responsibility question” for patients with BPD has already been raised (Martin 2010, Zachar & Potter 2009, Bray 2003), but this paper tackles it from a novel perspective. First, I narrow down the category of things for which the responsibility question is specific to individual with BPD. After that, I argue that some of the diagnosis criteria of BPD such as emotional instability or impulsivity might serve as excusing factors targeting the “control condition” on moral responsibility. Second, this paper also considers another widely accepted condition on moral responsibility: the epistemic condition. The view defended in the paper is that the answer to the responsibility question for individuals with BPD, concerning both the control condition and the epistemic condition, hinges on an understanding of their epistemic profile. After clarifying First-Person Realism by reference to parallel debates in the metaphysics of modality and time, I survey eight different arguments in favor of First-Person Realism.
