In Ancient Greece, the figure of the hero was identified as a demigod, possessed of altruistic and virtuous deeds. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. English Abstract: Through the presentation of the history of social justice in global constitutional discourse, this article aims to demonstrate that, although in Colombia there is not a constitutionalized purpose or principle of social justice, as in other countries, the modern notion of distributive justice, also called social justice today, is implicit in the Constitution of 1991 because it enshrined as mandatory rules the three main elements of its meaning at the time of its promulgation: the principle of social rule (...) of law, the principle of human dignity and the right to a material equality. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, la (...) extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

INTRODUÇÃO A técnica da inseminação artificial tornou possível aumentar o impacto na descendência de touros geneticamente superiores em termos de produção láctea das filhas. Com a transferência de embriões é possível aumentar o impacto da fêmea sobre (...) a população das filhas. A transferência de embriões data de 1890, ano em que Heape obteve o nascimento de coelhos transferindo ovócitos fecundados de uma fêmea para outra. A partir de 1930, é repetida uma série de experiências para desenvolver a técnica e aplicá-la em ovinos, caprinos (1934) e bovinos (1951) como espécies mais idôneas para a reprodução. A Inglaterra e os Estados Unidos estabeleceram as bases para o comércio de embriões durante os anos sessenta e setenta. De forma resumida, a transferência de embriões implica na estimulação da produção de ovócitos mediante a aplicação de hormônios: cerca de 6-8 dias após a cobrição dessas fêmeas ou da sua inseminação artificial, os óvulos fertilizados são extraídos dos órgãos genitais da fêmea doadora por perfusão ou lavagem com soluções biológicas controladas e testadas, originando-se uma deposição dos gametas fecundados nas fêmeas receptoras que serão encarregadas de levar adiante a gestação e o parto sem influência sobre as produções do novo indivíduo. 2. MANEJO DAS FÊMEAS DOADORAS É relativamente fácil obter um embrião, uma vez que pode origina-se a partir do cio natural das vacas cíclicas. No entanto, a fim de otimizar a técnica, o normal é «superovular» a fêmea doadora e obter um número superior de gametas fecundadas após cada lavagem ou perfusão das genitais. A maioria das fêmeas doadoras são tratadas com gonadotrofinas (PMSG) ou com hormônios estimuladores da foliculogênese (FSH). Estes hormônios invertem a atresia normal de folículos permitindo uma maturação, que em condições normais não se realizaria. O mecanismo exato do funcionamento destas hormonas não é totalmente claro. A superovulação multiplica por um fator de 10 o número de ovócitos recuperados no caso das vacas, ovelhas e cabras, mas apenas por um fator 2 ou 3 no caso das porcas. Existe um acordo geral sobre a utilização das gonadotrofinas; a PMSG deve ser aplicada durante a transição da fase luteica para a folicular, ou seja, no 16º dia do ciclo. As doses de gonadotrofinas variam entre 1500 e 3000 UI em bovinos, aumentando a resposta e a variabilidade individual com o aumento da dose. A resposta ao tratamento varia de acordo em função de diversos fatores. Neste contexto, merecem especial atenção a espécie, a raça, a época e a conformação corporal do animal, bem como o lote de fabricação da preparação hormonal (quadro 7.1). Estudos demonstram que, nos bovinos, as raças de corte respondem melhor ao tratamento do que as raças leiteiras. O FSH também é utilizado para superovulação em várias espécies. Nos ovinos, injetam-se 2 mg desta hormona 12 horas antes da retirada das esponjas, aplicando-se mais três injeções, com um intervalo de 12 horas, até 24 horas após a retirada das esponjas, o que corresponde a um total de 8 mg de FSH injetados por tratamento e animal. Às vezes, e dependendo do país, existem dificuldades para a obtenção desse hormônio em condições de pureza adequada para que o tratamento proporcione o resultado esperado. Nas vacas dadoras devem ter passado mais de 50 dias após o último parto: também ser animais cíclicos, encontrar-se num nível nutricional elevado e em aumento, sem deficiências especificas alimentares. Existe uma indicação de suplementação das fêmeas doadoras com minerais essenciais antes do tratamento. 3. OBTENÇÃO DE EMBRIÕES Uma vez as fêmeas doadoras inseminadas, entre o sexto e o oitavo dia, procede-se a coleta dos embriões. Para isso, atualmente se utilizam cateteres de obtenção transcervical (tipo Foley, Rusch. etc.) munidos de uma bola insuflável na sua extremidade que permite criar um compartimento estanque na parte distal do córneo uterino e proceder ao arrasto dos embriões ali localizados. Para obter esta «lavagem» utiliza-se uma solução aquosa tamponada: o meio mais frequentemente utilizado é o tampão fosfato salino (PBS: pH = 7; PO = 280 - 290 mOsm/kg) suplementado com antibióticos e proteínas. Depois de recuperado o meio de lavagem, os embriões devem ser isolados do volume total, avaliados segundo critérios do Manual da Sociedade Internacional de Transferência de Embriões de acordo com seu estado de desenvolvimento. Código numérico para determinar o grau de desenvolvimento embrionário: N° 1: ovócito não fertilizado ou embrião de uma célula (1 dia). N° 2: Identifica embriões com 2 a 16 células (2-4 dias). N° 3: Identifica mórulas adiantadas (5-6 dias). N° 4: Identifica mórulas compactas de 6 dias de idade. N° 5: blastocisto adiantado (7 dias). N° 6: blastocisto (7-8 dias). N° 7: blastocisto expandido (8-9 dias). N° 8: blastocisto eclodido (9 dias) a partir do nono ou décimo dia o blastocisto já está fora da zona pelúcida. Além da classificação por estado de desenvolvimento, a referida Sociedade Internacional estabeleceu uma categorização dos embriões com base na qualidade dos mesmos. Assim os denomina: 1: excelente; 2: bom; 3: regular; 4: degenerado. Segundo as investigações de diversos autores especialistas no tema não devem ser transferidos embriões que não tenham sido classificados como excelentes ou bons. A obtenção dos embriões pode ser realizada em uma clínica, em unidades móveis especializadas, ou na própria fazenda. Em todo o caso, a doadora não deve apresentar quaisquer sintomas clínicos de doença, sendo esta responsabilidade direta do veterinário. O rebanho de onde provém a doadora deve estar livre de medidas cautelares sanitárias. Os técnicos devem estar adequadamente limpos e preparados para esta atuação, em um lugar tranquilo e que permita a colocação de equipamentos e material em condições limpas e seguras. 4. TÉCNICAS DE TRANSFERÊNCIA DE EMBRIÕES Recomenda-se que os embriões sejam transferidos o mais rápido possível depois da recuperação. A fêmea receptora deve apresentar um ambiente uterino o mais semelhante possível ao da fêmea doadora. Isto quer dizer que a receptora também será mantida num sistema de sincronização para que coincida o mais possível o estágio de desenvolvimento embrionário com seu correspondente estado uterino. A margem de assincronia para evitar efeitos indesejáveis é de ± 24 horas. Os métodos hormonais de sincronização são análogos aos das doadoras. As técnicas para a deposição dos embriões no seu novo habitat podem ser igualmente cirúrgicas e não cirúrgicas, mas devido aos problemas do uso de anestésicos em técnicas cirúrgicas, as transferências foram direcionadas para modelos não-cirúrgicos ou transcervicais. Este método é baseado na utilização do colo uterino de forma análoga como é realizada na inseminação artificial. Devido às relações entre o embrião e o ovário, as porcentagens de fertilidade são aumentadas ao serem depositadas no corno ipsilateral no ovário que se encontra ativo. A utilização desta técnica implica na obtenção de mais fêmeas gestantes. O uso de novilhas como fêmeas receptoras aumenta também a taxa de gestações a partir de uma maior facilidade de manejo, uniformidade na resposta hormonal e um custo mais baixo. O fator humano ou habilidade do técnico que realiza esta técnica também constitui um fator que influencia decisivamente no êxito da transferência, encontrando-se variações de 20 a 60% devidas a este fator. 5. CONTROLES SANITÁRIOS Com a utilização da inseminação artificial, verificou-se que, embora as tecnologias reprodutivas colaborativas fossem mais avançadas em termos de técnicas destinadas a aumentar a produtividade individual, da mesma forma, podem constituir um perigo de contaminação e de dispersão de doenças estrangeiras para o grupo ou rebanho para onde são transferidos os novos genes. Neste contexto, a transferência embrionária (TE) deve realizar-se tendo em conta os riscos que pode implicar uma manipulação inadequada. Uma vez mais, a Sociedade Internacional (IETS) na Reunião Regional da OIE (Oficina Internacional de Epizootias) estabeleceu as normas em 1985 para que a TE pudesse ser utilizada como meio para controle de doenças na pecuária. Para que a utilização da TE se realize sem risco para a saúde, é necessário ter em conta um certo número de regras e condições específicas que evitem os riscos de contaminação. O embrião está separado do meio externo por três barreiras de proteção: o corpo da mãe, o útero por si só e a terceira, e mais importante, pela zona pelúcida, a qual nos animais domésticos tem demonstrado ser totalmente impermeável a qualquer elemento patogênico, desde que fique intacta. Portanto, o risco de contaminação dos embriões pode vir por duas vias diferentes: a) Fatores extrínsecos - por invasão dos agentes patogênicos na cavidade uterina principalmente. Isto está relacionado com o estado sanitário médio do país, região ou rebanho de origem. b) Fatores intrínsecos - Segundo Thibier podemos considerar diferentes fontes potenciais de contaminação, que segundo o risco sanitário se classificam nas seguintes ordens: 1° Zigoto. 2° Penetração. 3° Absorção. 4° Armazenamento. 5° Exame. 6° Transferência. Os esforços para que os embriões se tornem livres de contaminação devem ser semelhantes aos que são efetuados com os animais vivos e com as doses seminais. O momento mais perigoso encontra-se entre a coleta das células fecundadas e a sua deposição, após seu exame, no trato reprodutivo da receptora. As condições em que o referido processo deve ser realizado encontram-se detalhadas no manual da Sociedade Internacional de Transferência de Embriões (IETS). 6. REGRAS DA IETS A transferência de embriões é a via mais segura para a troca de genes. No entanto, os técnicos devem esforçar-se por manter todas as regras e normas sanitárias para que a coleta e a manipulação dos embriões se realizem sob condições de absoluta garantia higiênica e sanitária. A transferência embrionária implica, pela primeira vez na história da medicina veterinária, que a vigilância sanitária não se aplica estritamente ao animal, uma vez que, na sua fase "in vitro", está inteiramente sob o controle do técnico. Por conseguinte, não haverá futuro para este tipo de biotecnologia se, paralelamente, não houver um elevado nível de garantia de que não «servirá» para não disseminar ou difundir doenças. As conclusões da Sociedade Internacional de Transferência de Embriões (IETS) na sua reunião anual de 14 de Janeiro de 1992 estabelecem, tendo em conta a revisão efetuada em 1991 pela Subdireção de Investigação e pelo Comitê de Importação e Exportação, uma classificação das doenças. Esta classificação corresponde às seguintes categorias: Categoria 1 - Doenças ou agentes de doenças para as quais foram recolhidas provas suficientes para afirmar que o risco de transmissão é negligenciável, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência: a) Leucose bovina enzoótica. b) Febre aftosa (bovinos). c) Língua azul (bovinos). d) Brucelose bovina. e) Rintraqueíte infecciosa bovina. f) Doença de Aujeszky. Categoria 2 - Doenças para as quais foram recolhidas provas substanciais que indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência, mas para as quais é necessário verificar os dados existentes através de novas transferências: a) Peste suína clássica. Categoria 3 - Doenças ou agentes de doenças para as quais os resultados preliminares indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados, entre a coleta e a transferência, mas para os quais essas verificações preliminares devem ser corroboradas por dados experimentais complementares "in vitro" e "in vivo": a) Peste bovina. b) Diarreia viral bovina. c) Língua azul (ovinos). d) Febre aftosa (suínos, ovelhas e cabras). e) Campylobacter fetus (ovinos). f) Doença vesicular do porco. g) Peste suína africana. h) Prurido lombar (ovinos). i) Haemophilus somnus. Categoria 4 - Doenças ou agentes de doenças que foram ou são objeto de trabalhos preliminares: a) Vírus Akabane (bovino). b) Estomatite vesicular (bovinos e suínos). c) Chlamydia psittaci (bovinos e suínos). d) Ureaplasma/micoplasmose (bovinos e caprinos). e) Maedi-visna (ovino). f) Adenomatosa pulmonar (ovino). g) Prurido lombar (caprinos). h) Língua azul (caprinos). i) Artrite e encefalite caprina. j) Parvovírus (suíno). k) Enterovírus (bovinos e suínos). I) Leptospirose (suíno). m) Herpesvírus 4 dos bovinos. n) Mycobacterium paratuberculose (bovinos). o) brucelose ovina. p) Doença de Border (ovinos). q) Vírus parainfluenza 3 (bovinos). r) Agente da encefalopatia espongiforme bovina. É interessante salientar que apenas seis doenças estão incluídas na categoria 1 (a mais segura). Isso não significa que as outras doenças tenham um risco maior, apenas indica que o risco de transmissão das doenças da categoria 1 é irrelevante, estatisticamente falando. É importante assinalar que as doenças mais importantes dos bovinos se situam na categoria 1. Isto significa que a incidência do embrião patogênico nos bovinos parece ser perfeitamente controlável, desde que sejam adotadas metodologias adequadas. Isto serve também como linha de defesa adicional para que o técnico centre sua atenção e cuidados entre a fase de obtenção e a de transferência. 7. SITUAÇÃO ATUAL DA TRANSFERÊNCIA DE EMBRIÕES ANIMAIS NO BRASIL O Brasil é um dos grandes responsáveis mundiais pela implantação da tecnologia na reprodução animal, sendo assim, o país conseguiu inserir-se no mercado internacional como um dos maiores produtores de embriões in vivo e in vitro. Nas últimas duas décadas, especialmente entre os anos de 1997 e 2017 o país passou por importantes transformações nesse segmento, dentre essas transformações vale destacar a posição relativa do Brasil no contexto mundial. O Brasil passou de referência regional, nos anos 1990, para se tornar o maior produtor mundial de embriões entre os anos 2012 e 2013, sendo líder no uso e na produção de embriões in vitro. Os primeiros registros da TE produzidos in vivo no Brasil datam da década de 1980, e uma década depois o país já tornara-se referência e detinha um mercado consolidado de produção e TE na espécie bovina. Não obstante, no ano de 1997 o país ainda era referência apenas no contexto regional, detendo 68,3% dos embriões transferidos na América Latina, esse percentual corresponde a 24.085 embriões de um total de 35.254 produzidos na América Latina. Esse percentual regional representa apenas 6,6% de toda a produção mundial de embriões in vivo, que produziu, em 1997, 360.656 embriões in vivo. Nos últimos anos, o mercado de embriões, principalmente o bovino, teve retração moderada de -2,5% ao ano entre 2003 e 2018, porém essa retração contrasta com o ligeiro crescimento observado a partir dos anos 2000 conforme figura 1: Figura 1: Produção de embriões bovinos no Brasil no período 1996-2018, total e por tecnologia adotada (in vivo[IVD] ou in vitro [IVP]). Em 2018, o mercado de embriões bovinos manteve-se inalterado se compararmos com os três anos anteriores, houve reduções nós segmentos de corte, leite e no total comparado ao ano de 2017. Em 2014, a produção de embriões para melhoramento do gado leiteiro teve seu ápice, porém de lá para cá esse mercado manteve-se estagnado como demonstra a tabela 2. Tabela 2: Produção de embriões bovinos no Brasil em 2018, estratificada por segmento e por tecnologia adotada (in vivo ou in vitro). 7.1 Crise, economia e mercado de embriões A indústria de embriões reflete, em maior ou menor grau, o momento da economia brasileira. Apesar do segmento agropecuário ser um setor em constante crescimento no país, ao qual, sem dúvidas, em meio a inúmeras crises mantém-se em constante crescimento. Porém vale ressaltar que esse mercado é emergente e está refletido em paralelo com os bens produzidos pelo país, como demonstra a figura 2. Figura 2: Produção de embriões bovinos e variação no produto interno bruto (PIB) no Brasil, no período 1996-2018. Cada vez mais o setor agropecuário do Brasil investe em novas tecnologias que maximizem o mercado e que melhore a produção dos animais seja no segmento corte ou leite. Segundo a OCDE, 1997, essa indústria da produção de embriões é um conjunto de novas técnicas e processos, frutos do desenvolvimento técnico-científico, que chega ao mercado e - o mais importante - o transforma. Logo, todas essas técnicas e biotecnologias visam, além da alta produção e do lucro, o melhoramento e a suplementação alimentícia da população mundial que está em crescente avanço. A evolução da tecnologia embrionária no país, seja para o melhoramento dos equinos para os esportes como as vaquejadas, hipismo, corridas, etc., onde são investidos tempo, dedicação e dinheiro para formar um novo animal que apresente força, conformação, conversão alimentar e que custa milhões, em muitos casos, não só dos equinos, mas também dos caprinos, ovinos, suínos e até mesmo os bovinos onde o mercado da TE é mais presente e aquecida, venceu os estigmas do “modismo” e o chamado “elitismo”, porém deve enfrentar novos desafios, em especial num contexto de forte concentração do mercado de genética e de concorrência globalizada. Mesmo com todos esses avanços e retrocessos, essa relativização dos números demonstra que um percentual bastante reduzido das fêmeas bovinas que estão em idade reprodutiva é utilizado para a técnica da transferência de embriões, e que o mercado brasileiro ainda tem um grande potencial de crescimento no setor de produção in vivo e in vitro. 8. RESUMO E PRIMEIRAS CONCLUSÕES Ao longo deste trabalho pretendi realizar uma revisão sumária sobre um tema de grande importância presente, e sobretudo futura; referir-me à transferência embrionária. Atualmente, esta técnica atingiu um grau notável de penetração, a nível prático, no gado leiteiro. No entanto, num futuro mais ou menos longínquo, não temos dúvidas quanto a esta técnica, pelas vantagens indubitáveis que apresenta a nível de avanço genético, que será aplicada em outras espécies úteis ao homem. Na minha exposição, tentei dar especial ênfase a dois aspectos: as técnicas de transferência, incluindo as normas IETS e os controles sanitários a serem efetuados. Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that (...) we must think of the value of epistemic states as consisting in more than simply accuracy. The complex world of thought and sensitivity in the sphere of contemporary art has entailed the revision and exclusion of disciplines aimed at providing a model to explain and conceptualize reality. Art history, as one such discipline, has had many of its contributions questioned from Gombrich’s epistemological reformulation to the postmodern discourses, which extol the death of the author, the post-structuralist idea of tradition as a textual phenomenon, and the declaration of the death of history as a consequence of the (...) hybridization of disciplines and of other bran- ches of human knowledge. Nevertheless, it can be demonstrated that proposals as those by Julius von Schlosser and Giulio Carlo Argan enclose reflections and methodological aspects which can help us face the task of understanding and visualizing the mediating role of historians in the culture of sensitivity, and the art modulations that have resulted from the blows of history and that, in turn, have shaped both art and art history into what they are or can be to us today. The philosophical conception of mechanistic explanation is grounded on a limited number of canonical examples. These examples provide an overly narrow view of contemporary scientific practice, because they do not reflect the extent to which the heuristic strategies and descriptive practices that contribute to mechanistic explanation have evolved beyond the well-known methods of decomposition, localization, and pictorial representation. Recent examples from evolutionary robotics and network approaches to biology and neuroscience demonstrate the increasingly important role played by computer simulations and mathematical (...) representations in the epistemic practices of mechanism discovery and mechanism description. These examples also indicate that the scope of mechanistic explanation must be re-examined: With new and increasingly powerful methods of discovery and description comes the possibility of describing mechanisms far more complex than traditionally assumed. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

The field of Latin American philosophy has established itself as a relevant subfield of philosophical inquiry. However, there might be good reasons to consider that our focus on the subfield could have distracted us from considering another subfield that, although it might share some geographical proximity, does not share the same historical basic elements. In this paper, I argue for a possible and meaningful conceptual difference between Latin American Philosophy and Indigenous philosophy produced in Latin America. First, I raise what (...) I call Mariátegui’s Solidarity Challenge to show that there might be some neglectful treatment of the philosophical views of different Indigenous groups. I then depart from Mariátegui and engage in a critical exercise to show that even he would be guilty of failing in his own solidarity demands. I follow that by drawing out some implications of the argument. I first sketch how this differentiation would play out against the political project of “Mestizaje,” a project that seems to inform some of the Latin American philosophical tradition. I then speculate about the kinds of duties that the field of Latin American philosophy might have towards the field of Indigenous Philosophy produced in Latin America. (shrink)

Les dernières décennies ont vu apparaître une nouvelle approche de l’histoire de la philosophie liée à la tradition analytique. L’auteur propose de montrer dans cette étude le lien entre la naissance de l’approche analytique de l’histoire de la philosophie et le travail réalisé par trois figures de l’histoire de la philosophie médiévale au XXème siècle : Kretzmann, Pinborg et Kenny. El arte no es solamente una fuente inagotable de goce estético, es además una huella, una evidencia de nuestro pasado histórico. A partir del arte es posible remitirnos a nuestra raíz cultural, y es por eso que la obra artística constituye una parte importante del patrimonio de un pueblo. Es evidente el estrecho vínculo entre el patrimonio artístico y la identidad cultural; por eso es importante dar un justo valor a ese patrimonio que, a su vez, se reflejará en la (...) consolidación de una identidad propia. De esas expresiones tomamos únicamente las de la arquitectura de algunas iglesias barrocas. En ellas podemos notar una serie de variables del mestizaje cultural. La arquitectura del barroco novohispano, como uno de los lenguajes del arte, generó una reflexión sobre la identidad del individuo iberoamericano. (shrink)

Diariamente vemos noticias sobre políticos irresponsables que rechazan el consejo que los expertos basan en los modelos científicos, o nos encontramos con notas periodísticas que distorsionan los hechos o las teorías. En México, diariamente somos testigos —tanto que se ha vuelto un chiste recurrente— de la evidente incapacidad de la comunidad periodística para cubrir informes técnicos, así como de la dificultad que tienen muchos columnistas para comprender incluso los más básicos conceptos de la estadística. Además, muchas veces nos preguntamos por (...) qué los científicos y las organizaciones de salud parecen estar cambiando constantemente de opinión, contradiciéndose entre sí, o no terminan de ponerse de acuerdo. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. Social ontology focuses on questions about the reality of human categories. The typical examples are gender and race. Common questions about them are: Do they exist? What is their nature? Do they exist in the best possible way? Meanwhile, the philosophy of psychiatry has been discussing the reality of psychopathology, what is the best way to classify mental disorders, and whether it is possible to define them without normative vocabulary. I think there is something not only strange but inadequate about (...) these discussions being held apart. Particularly, I hold that by being held separately these discussions are philosophically incomplete. In this paper, I argue that these debates are parallel in crucial aspects, but more importantly that they can benefit from each other if they start a dialogue. I suggest some paths we can take to start fruitful discussions and offer examples of the kind of outcomes we can expect. However, my main contribution is to sketch a common framework to map current discussions, make comparisons between them, and, more importantly, guide new research. (shrink)

50 years after its introduction, brain death remains controversial among scholars. The debates focus on one question: is brain death a good criterion for determining death? This question has been answered from various perspectives: medical, metaphysical, ethical, and legal or political. Most authors either defend the criterion as it is, propose some minor or major revisions, or advocate abandoning it and finding better solutions to the problems that brain death was intended to solve when it was introduced. Here I plead (...) for a different approach that has been overlooked in the literature: the philosophy of science approach. Some scholars claim that human death is a matter of fact, a biological phenomenon whose occurrence can be determined empirically, based on science. We should take this claim seriously, whether we agree with it or not. The question is: how do we know that human death is a scientific matter of fact? Taking the philosophy of science approach means, among other things, examining how the determination of human death became an object of scientific inquiry, exploring the nature of the brain death criterion itself, and analysing the meaning of its core concepts such as “irreversibility” and “functions”. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. This dissertation focuses on teleology and functions in biology. More precisely, it focuses on the scientific legitimacy of teleofunctional attributions and explanations in biology. It belongs to a multi-faceted debate that can be traced back to at least the 1970s. One aspect of the debate concerns the naturalization of functions. Most authors try to reduce, translate or explain functions and teleology in terms of efficient causes so that they find their place in the framework of the natural sciences. Our approach (...) here is radically different, as we question the premise that teleological explanations are disguised causal explanations. On the contrary, we defend that they are acceptable in natural sciences and in biology in particular. We challenge the idea that teleological explanations are immature causal explanations, as well as the idea that teleology and functions are some sort of intentional explanations. We therefore reject the accusations of anthropomorphism, vitalism and finalism. On the contrary, we defend that teleology, causality and intentionality correspond to different, autonomous and complementary modes of representation of the outside world. -/- ———[FRANÇAIS]——— -/- Ce travail de thèse porte sur la téléologie et les fonctions en biologie. Plus précisément, il porte sur la légitimité scientifique des attributions et des explications téléofonctionnelles en biologie. Il s’inscrit dans le cadre d’un débat à plusieurs facettes que l’on peut faire remonter au moins jusqu’aux années 1970 et qui est encore très actif aujourd’hui. L’un des aspects du débat porte sur la naturalisation des fonctions, c’est-à-dire sur la manière de les réduire, de les traduire ou de les expliciter en termes de causes efficientes de sorte qu’elles trouvent leur place dans le cadre des sciences de la nature. Notre approche ici est radicalement différente, car nous remettons en question la prémisse selon laquelle les explications téléologiques seraient des explications causales déguisées. Nous défendons au contraire qu’elles sont acceptables en tant que telles aussi bien de façon générale que dans le domaine scientifique et en particulier en biologie. De façon générale, nous remettons en question l’idée selon laquelle la pensée téléologique serait une pensée causale immature, ainsi que sa dépendance présumée vis-à-vis de la psychologie, c’est-à-dire de l’intentionnalité. Nous rejetons donc les accusations d’anthropomorphisme, de vitalisme et de finalisme formulées contre elle. Nous défendons au contraire que la téléologie, la causalité et l’intentionnalité correspondent à des modes différents, autonomes et complémentaires de représentation du monde extérieur. (shrink)

The project of growing meat artificially represents for some the next best thing to humanity. If successful, it could be the solution to several problems, such as feed- ing a growing global population while reducing the environmental impact of raising animals for food and, of course, reducing the amount and degree of animal cruelty and suffering that is involved in animal farming. In this paper, I argue that the issue of the morality of such a project has been framed only (...) in terms of the best conse- quences for the environment, animals, and humans, or in terms of deontic princi- ples. I argue that to appreciate how deep and difficult this issue is, it is necessary to consider it in terms of a virtue-oriented approach. Such an approach will reveal aspects that are not apparent, not contemplated by typical approaches, but are essen- tial to our understanding of the morality of lab-grown meat. As I argue, evaluating the issue from a virtue-oriented perspective suggests that the project of in vitro meat should not be supported because it stems from unvirtuous motivations. (shrink)

Is the boundary between the normal and the pathological real or fiction? Are health and disease just a matter of fact or are they value-laden? Here we present some examples of how alleged diseases can be invented and propagated by the industry (disease mongering) or by the methodology of medical science itself. We show that the boundary between health and disease is blurred and depends on individual and social representations, culture relative ways of categorising things and people, and by the (...) society’s degree of medicalisation. However, we do not mean that it is not real, rather that it is more complex than expected, as the subjectivity of social constructions and individual experiences makes them no less real. Finally, we conclude that health and disease belong to both objective and subjective kinds of reality, so the fictional can be real. (shrink)

Many moral philosophers have criticized intensive animal farming because it can be harmful to the environment, it causes pain and misery to a large number of animals, and furthermore eating meat and animal-based products can be unhealthful. The issue of industrially farmed animals has become one of the most pressing ethical questions of our time. On the one hand, utilitarians have argued that we should become vegetarians or vegans because the practices of raising animals for food are immoral since they (...) minimize the overall happiness. Deontologists, on the other hand, have argued that the practices of raising animals for food are immoral because animals have certain rights and we have duties toward them. Some virtue ethicists remain unconvinced of deontic and consequentialist arguments against the exploitation of animals and suggest that a virtue-based approach is better equipped to show what is immoral about raising and using animals for food, and what is virtuous about ethical veganism. A partire da tale riflessione, l'articolo esamina come le società attuali, multiculturali e globalizzate, siano chiamate oggi a compiere una scelta: abbracciare la sintesi dell'eterogeneo oppure rispettare e far rispettare la presenza inevitabile del dissidio. Nella prima occorrenza si corre il rischio di (...) trasformare il diritto in succedaneo dell'ordalia e di accendere la guerra di tutti contro tutti. Nella seconda, invece, si sperimenta la costruzione d'interazioni di tipo dipolare le quali, pur non potendo garantire contro lo scatenamento smisurato della violenza, riescono potenzialmente ad arginarlo. Queste ultime, infatti, spostano la misura della sopravvivenza dall'esclusione delle ostilità alla loro elusione, dal rifiutare il conflitto all'addomesticarlo, dal rinunciare allo sforzo muscolare al calibrarlo. En metafísica contemporánea, es común trabajar bajo una metodología basada en virtudes teóricas. En caso de disputa, esta metodología nos aconseja elegir la teoría que mejor satisfaga las virtudes teóricas estándar: precisión empírica, fecundidad, poder unificador, consistencia y simplicidad. Sin embargo, no hay consenso sobre cómo deben frasearse tales virtudes, ni sobre cómo ponderarlas. Aquí me concentraré en ofrecer razones a favor de una manera de frasear el principio de parsimonia ideológica, una especie de simplicidad. Defiendo que dicho principio debería (...) decir que, dadas dos teorías T1 y T2, ceteris paribus, si T1 postula menos tipos de expresiones primitvas que T2, entonces es más probable que T1 sea una teoría fiel a que T2 lo sea. Se elabora en qué consiste la cláusula ceteris paribus, qué quiere decir "postular menos tipos de expresiones primitivas" (parsimonia ideológica cualitativa) y en qué consiste la fidelidad teórica. Architecture and human-built structures are embedded with speciesist practices of domination over the environment, where humans are considered special and superior to other species. This (hu)man exceptionalism has driven architecture and the built environment to be conceived in opposition to ‘nature’, dominating natural terrains and consequently displacing or instrumentalizing the many other species that are given little to no ethical consideration. This way of intervening in the world is leading to the existential questions that must be posed given our global (...) climate crisis. A reframing of human intervention as ‘built environment’ placed in opposition to the ‘natural environment’ of supposedly passive nature, is urgently needed. The motivation for this paper is rooted in a deep concern for the role of humans in the climate crisis and a realization that architecture as a discipline is complicit in elevating the human category above all other beings in nature. There are biases embedded in the practices and teaching of architecture that need to be interrogated and reflected upon, starting with the role models and ideals that we unwittingly operate within. To contextualize the idea of human exceptionalism in architecture, we will explore deep-seeded ideals in architecture linked to the concept of Rectitude as a form of ‘rightness’ -or correct- mode of intervening in the world, conceptualized by Western men as a human-centric practice distinct from nature-made. Supported by Ecofeminist thought, the aim is to open alternative models for world-building and housing humans on earth living in its sixth extinction. (shrink)

Franz Brentano is not usually associated with mathematics. Generally, only Brentano’s discussion of the continuum and his critique of the mathematical accounts of it is treated in the literature. It is this detailed critique which suggests that Brentano had more than a superficial familiarity with mathematics. Indeed, considering the authors and works quoted in his lectures, Brentano appears well-informed and quite interested in the mathematical research of his time. I specifically address his lectures here as there is much less to (...) be found about mathematics in his published works. Besides Brentano’s own work, it is quite remarkable to see that practically all of his better-known students sooner or later produced a work on the philosophy of mathematics. This also encourages the supposition not just of a common interest in the matter, but of a common theoretical core. All this prompts the question: Can we speak of a Brentanist philosophy of mathematics? (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. We explore solutions to mitigate the inconsistency. (shrink)

Some metaphysicians believe that metaphysical modality is explainable by the essences of objects. In §II, I spell out the definitional view of essence, and in §III, a working notion of metaphysical explanation. Then, in §IV, I consider and reject five natural ways to explain necessity by essence: in terms of the principle that essential properties can't change, in terms of the supposed obviousness of the necessity of essential truth, in terms of the logical necessity of definitions, in terms of Fine's (...) logic of essence, and in terms of the theory of real definitions. I will conclude that the present evidence favours rejecting the hypothesis that modality is explainable by essence. (shrink)

The debate over ape personhood is of great social and moral importance. For more than twenty-five years, attorney Steven Wise has been arguing that animals who have cognitive complexities similar to humans should be legally granted basic rights of au- tonomy. In my view, granting personhood status and other rights to great apes are at- tainable goals. But how should we go about it?

Marcus William Hunt argues that when co-parents disagree over whether to raise their child (or children) as a vegan, they should reach a compromise as a gift given by one parent to the other out of respect for his or her authority. Josh Millburn contends that Hunt’s proposal of parental compromise over veganism is unacceptable on the ground that it overlooks respect for animal rights, which bars compromising. However, he contemplates the possibility of parental compromise over ‘unusual eating,’ of animal-based (...) foods obtained without the violation of animal rights. I argue for zero parental compromise, rejecting a rights-oriented approach, and propose a policy that an ethical vegan parent and a non-vegan co-parent should follow to determine how to raise their children. Empiricist philosophers like Carnap invoked analyticity in order to explain a priori knowledge and necessary truth. Analyticity was “truth purely in virtue of meaning”. The view had a deflationary motivation: in Carnap’s proposal, linguistic conventions alone determine the truth of analytic sentences, and thus there is no mystery in our knowing their truth a priori, or in their necessary truth; for they are, as it were, truths of our own making. Let us call this “Carnapian conventionalism”, conventionalismC and cognates for (...) short. This conventionalistC explication of the a priori has been the target of sound criticisms. Arguments like Quine’s in “Truth by Convention” are in our view decisive: the truth of conventionalismC requires that the class of logical truths and logical validities be reductively accounted for as conventionally established; however, no such reduction is forthcoming, because logic is needed to generate the entire class from any given set of conventions properly so-called. Granted that conventionalismC is untenable, we want to take issue with a different, usually made criticism. Although the argument uncovers some difficulties for the way conventionalist claims are defended by some of its advocates, we will try to show that it fails. The criticism thus stands in the way of a proper appreciation of why the Carnapian account of the a priori is not correct. We will try to illustrate this by showing that the criticism we will dispute would dispose of conventionalist claims not only regarding philosophically problematic cases – logical and mathematical truths –, but also regarding cases for which they have some prima facie plausibility. One such case is that of truths that follow from mere abbreviations, “nominal” definitions; ‘someone is a bachelor if and only if he is an unmarried adult male’ can serve at this point for illustration. We will try to articulate a clear sense in which the contents of assertion such as this can be truths by convention. We do not need to prove that a conventionalist claim is true in those cases; it is enough for us to show that it is intelligible, for the arguments we will confront question even this. (shrink)

This paper explores the scope and limits of rational consensus through mutual respect, with the primary focus on the best known formal model of consensus: the Lehrer–Wagner model. We consider various arguments against the rationality of the Lehrer–Wagner model as a model of consensus about factual matters. We conclude that models such as this face problems in achieving rational consensus on disagreements about unknown factual matters, but that they hold considerable promise as models of how to rationally resolve non-factual disagreements.

Evolutionary adaptation has been suggested as the hallmark of life that best accounts for life’s creativity. However, current evolutionary approaches still fail to give an adequate account of it, even if they are able to explain both the origin of novelties and the proliferation of certain traits in a population. Although modern-synthesis Darwinism is today usually appraised as too narrow a position to cope with all the complexities of developmental and structural biology—not to say biosemiotic phenomena—, Darwinism need not be (...) if we separate metaphor from reality in natural selection in order to show the axiological complexity of this concept. In this article I will begin by discussing recent criticism, by Mauro Antonelli and Werner Sauer, of the ontological interpretation of Franz Brentano’s concept of intentionality, as formulated by i.a. Roderick Chisholm. I will then outline some apparent inconsistencies of the positions advocated by Antonelli and Sauer with Brentano’s formulations of his theory in several works and lectures. This new evaluation of (unpublished) sources will then lead to a sketch of a new approach to Brentano’s theory of intentionality. Specifically, it (...) will be argued that the notion of “intentional object” is inherently and un- avoidably ambiguous in every act of external perception, due to the fact that we can only have improper intentions directed at the external world. One challenge faced by aesthetics is the development of an account able to trace out the continuities and discontinuities between general experience and aesthetic experiences. Regarding this issue, in this paper, I present an enactive model of some raw cognitive dynamics that might drive the progressive emergence of aesthetic experiences from the stream of general experience. The framework is based on specific aspects of John Dewey’s pragmatist philosophy and embodied aesthetic theories, while also taking into account research in ecological psychology, (...) cognitive sciences, and dynamic systems theory. The model focuses on dynamically relevant nodes at the pre-reflective and the reflective side of experience that would work as nested rhythmic constraints at different cognitive timescales with the potential to shunt experiences toward the aesthetic in everyday situations. My proposal constitutes a way to explore aesthetic experiences from an enactive perspective that regards them as transformative events in which cognitive processes entrain and are entrained by changes taking place in the environment, the brain, and the body. En nuestro artículo, analizaremos las diferencias y similitudes que podemos encontrar en el uso de diagramas entre dos prácticas matemáticas de la antigüe-dad. Mostraremos que no existe un solo uso posible de éstos, sino que tienen que considerarse como herramientas de razonamiento creadas y manipuladas de acuerdo con los propósitos de cada tradición. Argumentaremos que las diferencias en los procedimientos y organizaciones del conocimiento que ambas tradiciones presentan no implican ningún tipo de valoración acerca de su mayor o menor "matematicidad", (...) ya que ambas tradiciones llegaron a resultados matemáticos suficientemente generales y precisos, hecho que es característico de investigaciones matemáticas a un nivel teórico. The main discourses on art during the nineteenth century defined the artist as a spirit that should express their unbridled creativity, and overall that had the strength to express its total personal autonomy from institutional processes of culture. Thus, Manet’s work A bar at the Folies—Bergere contains substantial elements that express and help us to understand both the role of the artist, as the crisis of meaning in the work of modern art and problematic public sphere, treated by Haberma's as (...) the field of social life in which we can develop our public opinion, and that is determined by common sense and rational consensus. In this sense, this article leverages how A bar at the Folies—Bergere questions the social representation of not only the public but the legitimizing institutions that support an artistic truth, to point to an x—ray that presents the structure and the gap between the public and artists, between artistic expression and cultural significance, and thus presents the cultural crisis warned by artists. En el presente texto se sostiene que las categorías de primeridad, segundidad y terceridad —y las relaciones posibles entre ellas— revelan las operaciones lógicas de relación y ley en el trabajo de Charles Sanders Peirce. Para ello, se muestra su importancia a través de paralelismos con otras triadas del filósofo norteamericano. Para dicho propósito, el texto se divide el texto en tres momentos. El primer momento consiste en exponer la operación de la triada principal: primeridad, segundidad y terceridad. En esta (...) caracterización se pondrá especial énfasis en la descripción del tratamiento de lo indeterminado hecho por las operaciones de la ley y la relación en las categorías1. En segundo lugar, se reconstruye la operación peirceana de las tricotomías en el razonamiento lógico. Finalmente, se concluye recapitulando los puntos tratados, a la vez que se sugieren las razones del carácter tríadico de las categorías en Peirce y sus supuestos. (shrink)

In Overlooking Conventions Michael Devitt argues in defence of the traditional approach to semantics. Devitt’s main line of argument is an inference to the best explanation: nearly all cases that linguistic pragmatists discuss in order to challenge the traditional approach to semantics are better explained by adding conventions into language, in the form of expanding the range of polysemy or the range of indexicality (in the broad sense of linguistically governed context sensitivity). In this paper, we discuss three aspects of (...) a draft of Devitt’s Overlooking Conventions, which was discussed at a conference in Dubrovnik in September 2018. First, we try to show that his rejection of Bach’s distinction between convention and standardization overlooks important features of standardization. Second, we elaborate on Devitt’s argument against linguistic pragmatism based on the normative aspect of meaning and show that a similar argument can be mounted against semantic minimalism. While Devitt and minimalists have a common enemy, they are not allies either. Third, we address a methodological difficulty in Devitt’s view concerning a threat of over-generation and propose a solution to it. According to the Principle of Alternative Possibilities, an agent is morally responsible for an action of hers only if she could have done otherwise. The notion of a robust alternative plays a prominent role in recent attacks on PAP based on so-called Frankfurt cases. In this paper I defend the truth of PAP for blameworthy actions against Frankfurt cases recently proposed by Derk Pereboom and David Widerker. My defence rests on some intuitively plausible principles that yield a new understanding of (...) the concept of a robust alternative. I will leave aside whether PAP also holds for praiseworthy actions -/- Según el Principio de Posibilidades Alternativas, un agente es moralmente responsable de una acción sólo si hubiera podido actuar de otro modo. La noción de alternativa robusta desempeña un papel prominente en ataques recientes al PPA basados en los llamados casos Frankfurt. En este artículo defiendo el PPA para la culpabilidad moral frente a casos Frankfurt propuestos recientemente por Derk Pereboom y David Widerker. Mi defensa descansa en algunos principios intuitivamente plausibles que dan lugar a una comprensión nueva del concepto de alternativa robusta. No trataré la cuestión de la verdad del PPA para acciones moralmente laudables. (shrink)

En este artículo reconstruyo y analizo las respuestas de los escépticos académicos a la objeción de apraxia. Esta objeción afirma que el escepticismo es una doctrina imposible de practicar puesto que sus tesis conducen a la apraxia, esta es, un estado de privación o imposibilidad de acción. Las respuestas a la objeción se dividen en dos clases. La primera prueba que el asentimiento no es una condición necesaria para realizar acciones, por lo que la recomendación escéptica de suspender global y (...) permanentemente el asentimiento no conduciría a la apraxia. La segunda prueba que es posible deliberar y orientar racionalmente nuestras acciones sin impresiones aprehensivas, por lo que la tesis escéptica de que no existen impresiones aprehensivas tampoco conduciría a la apraxia. Tras unas breves consideraciones generales, en la primera parte de este artículo presento las respuestas de Arcesilao y en la segunda parte las repuestas de Carnéades. (shrink)

The author examines an essay by Maurizio Torrini on the scientific revolution and libertinism. Studying the reception of Galileo’s discoveries in European philosophical culture, Torrini highlights the misunderstandings and instrumental uses that libertines made of Galilean astronomy. The scientific revolution and libertinism had independent paths and even when their paths crossed, no fusion emerged between the two components. Only at the end of the seventeenth century did apologetics unify libertinism and Galilean science into one doctrine to facilitate their condemnation.
