In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. Esto, por medio del estudio juicioso de la normatividad y la jurisprudencia, así como de la solución de controversias que no están legisladas y les corresponde a los administradores de justicia resolverlas. Asimismo, señala la necesidad de regular los aspectos aquí planteados que, por los vacíos normativos, dificultan la realización del procedimiento médico de trasplante y donación de órganos.

The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. Entre el arte y la literatura se han generado múltiples reflexiones que han sido estudiadas por la historia del arte, la teoría literaria y la estética, entre otros. Igualmente, podemos considerar una larga tradición de artistas y escritores que se han empeñado, por medio de ensayos, críticas y manifiestos, en considerar los ámbitos y lugares de competencia de cada forma artística, así como sus lugares de similitud y diferencia en una larga tradición de préstamos interartísticos entre la palabra y la (...) imagen. En el seno de esta discusión, se quiere analizar el diálogo disciplinar entre la literatura y el arte que se da en torno a la figura del pintor post impresionista Paul Gauguin y el escritor Mario Vargas Llosa. Para ello, reflexionamos a partir de una de las obras fundamentales del pintor francés, que tiene su correspondencia y complementariedad en la obra literaria del escritor peruano. De esta manera, se presenta una revisión de una fuente literaria que propone no solo una alusión temática a la obra del pintor, sino que se enmarca bajo coordenadas estéticas, que superan los armazones de las teorías o historias meramente literarias. In Brazil, the social demand for veterinary expertise is growing. However, there is still a shortage of professionals trained in this area to apply specific knowledge to each case. Studies and research into forensic veterinary medicine are necessary for veterinary experts to assist in investigations and legal proceedings. Veterinary medicine has subjects on its curriculum that cover the knowledge needed to apply in the fields of animal health, public health and the environment. The interaction between human and veterinary medicine, as (...) well as other areas of health, is of great importance in the prevention and control of various diseases, both in animals and humans. Some cases of infectious bovine abortion have a major impact not only on cattle farming and animal health, but also on public and environmental health. The concept of "One Health" integrates human medicine and health professionals. In this context, knowledge of infectious abortive diseases that affect animal, human and environmental health is fundamental. Cattle are affected by specific infectious abortive diseases, caused by pathogens with different forms of presentation and transmission mechanisms. These include brucellosis, leptospirosis and listeriosis, which are potentially zoonotic diseases. Controlling these diseases can contribute to effective public health actions and reduce global health risks. In order to establish the diagnosis of these diseases, it is essential to properly collect specimens from live or dead animals under biosafety and biosecurity conditions, following the chain of custody for each case. These procedures allow for greater success in diagnosing the suspected agent and facilitate the investigation of other causes. Animal health standards for the prophylaxis and control of these diseases are established by specific legislation, including those of the Ministry of Agriculture, Livestock and Supply (MALS). This literature review was based on current knowledge on the Pubmed platform, Google Scholar, articles and textbooks. In this paper, we draw on developmental findings to provide a nuanced understanding of background emotions, particularly those in depression. We demonstrate how they reflect our basic proximity (feeling of interpersonal connectedness) to others and defend both a phenomenological and a functional claim. First, we substantiate a conjecture by Fonagy & Target (International Journal of Psychoanalysis 88(4):917–937, 2007) that an important phenomenological aspect of depression is the experiential recreation of the infantile loss of proximity to significant others. Second, we argue (...) that proximity has a particular cognitive function that allows individuals to morph into a cohesive dyadic system able to carry out distributed emotion regulation. We show that elevated levels of psychological suffering connected to depressive background emotions may be explained not only in terms of a psychological loss, but also as the felt inability to enter into dyadic regulatory relations with others—an experiential constraint that decreases the individual’s ability to adapt to demanding situations. Authenticity has become a widespread ethical ideal that represents a way of dealing with normative gaps in contemporary life. This ideal suggests that one should be true to oneself and lead a life expressive of what one takes oneself to be. However, many contemporary thinkers have pointed out that the ideal of authenticity has increasingly turned into a kind of aestheticism and egoistic self-indulgence. In his book, Varga systematically constructs a critical concept of authenticity that takes into account the reciprocal (...) shaping of capitalism and the ideal of authenticity. The complex world of thought and sensitivity in the sphere of contemporary art has entailed the revision and exclusion of disciplines aimed at providing a model to explain and conceptualize reality. Art history, as one such discipline, has had many of its contributions questioned from Gombrich’s epistemological reformulation to the postmodern discourses, which extol the death of the author, the post-structuralist idea of tradition as a textual phenomenon, and the declaration of the death of history as a consequence of the (...) hybridization of disciplines and of other bran- ches of human knowledge. Nevertheless, it can be demonstrated that proposals as those by Julius von Schlosser and Giulio Carlo Argan enclose reflections and methodological aspects which can help us face the task of understanding and visualizing the mediating role of historians in the culture of sensitivity, and the art modulations that have resulted from the blows of history and that, in turn, have shaped both art and art history into what they are or can be to us today. Body checking, characterized by the repeated visual or physical inspection of particular parts of one’s own body (e.g. thighs, waist, or upper arms) is one of the most prominent behaviors associated with eating disorders, particularly Anorexia Nervosa (AN). In this paper, we explore the explanatory potential of the Recalcitrant Fear Model of AN (RFM) in relation to body checking. We argue that RFM, when combined with certain plausible auxiliary hypotheses about the cognitive and epistemic roles of emotions, is able to (...) explain key characteristics of body checking, including how body checking behavior becomes habitual and compulsive. It is widely agreed that obsessive-compulsive disorder involves irrationality. But where in the complex of states and processes that constitutes OCD should this irrationality be located? A pervasive assumption in both the psychiatric and philosophical literature is that the seat of irrationality is located in the obsessive thoughts characteristic of OCD. Building on a puzzle about insight into OCD (Taylor 2022), we challenge this pervasive assumption, and argue instead that the irrationality of OCD is located in the emotions that are (...) characteristic of OCD, such as anxiety or fear. In particular, we propose to understand the irrationality of OCD as a matter of harboring recalcitrant emotions. We argue that this account not only solves the puzzle about insight, but also makes better sense of how OCD sufferers experience and describe their condition and helps explain some otherwise puzzling features of compulsive behavior. This paper aims to clarify the nature of understanding in medicine. The first part describes in more detail what it means to understand something and links a type of understanding (i.e., objectual understanding) to explanations. The second part proceeds to investigate what objectual understanding of a disease (i.e., biomedical understanding) requires by considering the case of scurvy from the history of medi- cine. The main hypothesis is that grasping a mechanistic explanation of a condi- tion is necessary for a biomedical (...) understanding of that condition. The third part of the paper argues that biomedical understanding is necessary, but not sufficient for understanding in a clinical context (i.e., clinical understanding). The hypothe- sis is that clinical understanding combines biomedical understanding of a disease or pathological condition with understanding illness, which involves some degree of personal understanding of the patient. It is argued that, in many cases, clinical understanding necessitates adopting a particular second-personal stance and using cognitive resources in addition to those involved in biomedical understanding. At least some serial killers are psychopathic serial killers. Psychopathic serial killers raise interesting questions about the nature of evil and moral responsibility. On the one hand, serial killers seem to be obviously evil, if anything is. On the other hand, psychopathy is a diagnosable disorder that, among other things, involves a diminished ability to understand and use basic moral distinctions. This feature of psychopathy suggests that psychopathic serial killers have at least diminished responsibility for what they do. I argue that psychopathic serial killers are plausibly evil in at least one recognizable sense of the term, but that they are nevertheless not likely to be responsible for many of the evils they perpetuate. Motivated by a recent trend that advocates a reassessment of the aim of medical science and clinical practice, this paper investigates the epistemic aims of biomedical research. Drawing on contemporary discussions in epistemology and the philosophy of science, along with a recent study on scurvy, this paper (1) explores the concept of understanding as the aim of scientific inquiry and (2) establishes a framework that will guide the examination of its forms in biomedical research. Using the case of Tuberculosis (TB), (...) The influence of Brentano on the emergence of Husserl's notion of intentionality has been usually perceived as the key of understanding the history of intentionality, since Brentano was credited with the discovery of intentionality, and Husserl was his discipline. This much debated question is to be revisited in the present essay by incorporating recent advances in Brentano scholarship and by focusing on Husserl's very first work, his habilitation essay (Über den Begriff der Zahl), which followed immediately after his study years (...) at Brentano, and also on manuscript notes from the same period. It is to be shown that (i) although Brentano failed to enact a direct influence on Husserl's notion of intentionality (much in line with K. Schuhmann's claim), (ii) yet the core of Brentano's notion remained operative in Husserl's theory of relations, which is seemingly influenced by John Stuart Mill and Hermann Lotze. This investigation is intended as a contribution towards the proper understanding of the complexities of Husserl's early philosophy. (shrink)

It is common to distinguish between “holist” and “reductionist” views of brain function, where the former envisions the brain as functioning as an indivisible unit and the latter as a collection of distinct units that serve different functions. Opposing reductionism, a number of researchers have pointed out that cortical network architecture does not respect functional boundaries, and the neuroanatomist V. Braitenberg proposed to understand the cerebral cortex as a “great mixing machine” of neuronal activity from sensory inputs, motor commands, and (...) intrinsically generated processes. In this paper, we offer a contextualization of Braitenberg’s point, and we review evidence for the interactions of neuronal activity from multiple sensory inputs and intrinsic neuronal processes in the cerebral cortex. We focus on new insights from studies on audiovisual interactions and on the influence of respiration on brain functions, which do not seem to align well with “reductionist” views of areal functional boundaries. Instead, they indicate that functional boundaries are fuzzy and context dependent. In addition, we discuss the relevance of the influence of sensory, proprioceptive, and interoceptive signals on cortical activity for understanding brain-body interactions, highlight some of the consequences of these new insights for debates on embodied cognition, and offer some suggestions for future studies. We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. We argue that the norms that govern vigilance and the value of self-control (...) explain culpability for unwitting omissions. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

The “received view” on Kantian ethics holds that perfect duties enjoy absolute priority over imperfect duties. More recently, several Kantian scholars have reassessed this situation, arguing that imperfect duties may remain binding even if they imply breaching a perfect duty. In this article, I argue that both positions rely on a misunderstanding of the bindingness of Kantian duties. Genuine Kantian duties, I claim, remain binding even when they cannot be fulfilled. We must always strive for a total completion of our (...) duties; what it means for us to strive for it, however, will vary depending on our peculiar situation. (shrink)

This article proposes a teleological ethical approach for the analysis of the conflict between the right to the city and the right to tourism. Unlike the understanding of this conflict through a deontological lens, which is based on universal and unconditioned moral duties, a teleological perspective allows us to observe much more underlying and intricate problems that can arise in any cultural and socio-historical context of each tourist city. By taking the teleological model of the philosopher Alasdair MacIntyre as a (...) starting point, the article suggests the basis of a framework for an ethical understanding of the complexity of teleological conflicts that can appear in the pursuit of situated internal goods —sought cooperatively— and external goods —sought competitively— within and between social practices related to both rights. As a result of the doctoral research developed by the main author (Vargas-Chaves, 2017), it was identified the evolution and perspectives of the pharmaceutical patent in the international trade system, as well as it future legal research needs in this topic, both immediate and long-term. Furthermore, a number of problems of public health were highlighted in which the patent-term-extension mechanisms have produced a lack of access to medicines.

De otra parte, regiones como Canadá, Francia, Quebec -y en diferentes grados la Unión Europea- defienden la excepción cultural. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

This essay focuses on the intriguing relationship between mathematics and physical phenomena, arguing that the brain uses a single spatiotemporal- causal objective framework in order to characterize and manipulate basic external data and internal physical and emotional reactive information, into more complex thought and knowledge. It is proposed that multiple hierarchical permutations of this single format eventually give rise to increasingly precise visceral meaning. The main thesis overcomes the epistemological complexities of the Frame Problem by asserting that the primal frame (...) of reference – within which chaotic conscious thought ultimately emerges – is essentially a synchronous representation of the four macro properties of existence plus the genetically derived causal objective, and the embodied physical and emotional reactions that even the lowliest cognitive organisms are born with, and which they automatically express as they struggle to exist within an ever-changing and often hostile environment. -/-. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. The Catholic Church is a field hospital with medics that help to spiritually heal those who recognize that they are in need of healing and who are willing to accept the cure being offered. Many of the sick ask for closeness, proximity and compassion, realities that cannot be offered simply by promoting pastoral activities. For this reason, we highlight the work of the spiritual doctor as a key element for a Church on the way out; we describe its main characteristics (...) based on the work of St. John Climacus. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. Some Comments on de Melo-Martin and Harris.

The DSM‐5 highlights two essential psychological features of anorexia nervosa (AN): recalcitrant fear of gaining weight and body image disturbance. Prominent accounts grant false beliefs about body weight and shape a central role in the explanation of AN behavior. In this article, we propose a stronger emphasis on recalcitrant fear. We show that such fear can explain AN behavior without the intermediary of a false belief, and thus without the associated explanatory burdens and conceptual difficulties. We illustrate how shifting the (...) emphasis from false belief to recalcitrant fear can supplement a number of different non‐doxastic models of AN. (shrink)

Tendo em vista que a lei de ser em relação ao sujeito cognoscente consiste em ser-consciente, a consciência, segundo Jean-Paul Sartre, sobrepõe-se ao status de modo particular de conhecimento enquanto sentido interno ou conhecimento como conhecimento de si, constituindo a dimensão de ser transfenomenal. Dessa forma, baseado no princípio fenomenológico-ontológico-existencial, o Prof. Luiz Carlos Mariano Da Rosa se detém na relação entre o fenômeno de ser e o ser do fenômeno e na irredutibilidade do ser do fenômeno ao fenômeno (...) do ser, assinalando o processo que sobrepõe o ser do fenômeno à condição fenomênica e converge para a consciência enquanto ser cognoscente enquanto é em um movimento que escapa ao enquanto é conhecido, transpondo as fronteiras da preeminência do conhecimento. Se a consciência emerge como consciência de alguma coisa em um processo cujo ser implica um ser que encerra a si como não consciente e transfenomenal, o que se impõe, segundo Sartre, não é senão a consciência como um ser que encerra a questão do seu ser enquanto ser que implica outro ser que não si mesmo. Assim, detendo-se no acontecimento da aparição do existente humano em relação ao ser enquanto descoberta de um mundo e a negação como momento essencial e primordial, o artigo assinala o motivo pelo qual o existente humano em seu ser implica a possibilidade de aparição do nada em um processo que encerra a liberdade como condição para a nadificação do nada. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. In recent decades much literature has been produced on disagreement; the puzzling conclusion being that epistemic disagreement is, for the most part, either impossible (e.g. Aumann (Ann Stat 4(6):1236–1239, 1976)), or at least easily resolvable (e.g. Elga (Noûs 41(3):478–502, 2007)). In this paper I show that, under certain conditions, an equally puzzling result arises: that is, disagreement cannot be rationally resolved by belief updating. I suggest a solution to the puzzle which makes use of some of the principles of Hintikka’s (...) Socratic epistemology. (shrink)
