En el presente texto me interesa demostrar que la moral es parte integrante de todo orden social. Lo haré destacando la manera en que los elementos morales de la interacción social están directamente vinculados a los procesos comunicativos de generación de significados, ala vez que determinados por las relaciones de poder entre los sujetos interactuantes. Para efecto de este trabajo entenderé la moral como una especial forma de comunicación que remite a señalamientos de aprecio o desprecio entrelos actores Parto de (...) la idea de que por lo general en la interacción el no seguimiento de las normas socialmente dominantes tiende a generar una reacción de desprecio hacía el infractor de la norma. En la segunda parte de mi texto analizaré dos tipos posibles de actitud del actor frente al orden moral: la adaptación prácticay la búsqueda de reconocimiento. In this text I am interested in demonstrating that morality is an integral part of every social order. I will do so by highlighting the way in which the moral elements of social interaction are directly linked to the communicative processes of generating meanings, while being determined by the power relations between the interacting subjects. For the purposes of this work I will understand morality as a special form of communication that refers to signs of appreciation or contempt between the actors. It is based on the idea that in general in interaction, failure to follow the socially dominant norms tends to generate a reaction of contempt towards the offender of the norm. In the second part of my text I will analyze two possible types of attitude of the actor towards the moral order: practical adaptation and the search for recognition. (shrink)

Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

Across various fields it is argued that the self in part consists of an autobiographical self-narrative and that the self-narrative has an impact on agential behavior. Similarly, within action theory, it is claimed that the intentional structure of coherent long-term action is divided into a hierarchy of distal, proximal, and motor intentions. However, the concrete mechanisms for how narratives and distal intentions are generated and impact action is rarely fleshed out concretely. We here demonstrate how narratives and distal intentions can (...) be generated within cognitive agents and how they can impact agential behavior over long time scales. We integrate narratives and distal intentions into the LIDA model,and demonstrate how they can guide agential action in a manner that is consistent with the Global Workspace Theory of consciousness. This paper serves both as an addition to the LIDA cognitive architecture and an elucidation of how narratives and distal intention emerge and play their role in cognition and action. (shrink)

Call ‘a substance’ a person who is at home in a relatively stable and unified sense-making framework: a social structure that to some degree specifies which categories are important for interpreting reality, which goals are worth pursing, which character traits are admirable, etc. Call ‘an accident’ a person who is not at home in one such framework. It is tempting to think that being a substance is preferable, but I present some considerations for thinking otherwise. Mexican philosophers Emilio Uranga and (...) Jorge Portilla, I argue, present notions of accidentality as decolonial tools. Uranga’s account enables Mexicans to have positive valuation of their being independently of the approving gaze of the colonizers and their standards of value. Portilla’s thought distinguishes between pernicious accidentality resulting from the disintegration of sense-making frameworks and authentic accidentality as a condition for freedom, self-creation, and ultimately for individual and communal liberation. I suggest a way of extending Stalnaker’s account of assertion to allow for centered content. In formulating his account, Stalnaker takes the content of assertion to be uncentered propositions: entities that are evaluated for truth at a possible world. I argue that the content of assertion is sometimes centered: the content is evaluated for truth at something within a possible world. I consider Andy Egan’s proposal for extending Stalnaker’s account to allow for assertions with centered content. I argue that Egan’s (...) account does not succeed. Instead, I propose an account on which the contents of assertion are identified with sets of multi-centered worlds. I argue that such a view not only provides a plausible account of how assertions can have centered content, but also preserves Stalnaker’s original insight that successful assertion involves the reduction of shared possibilities. The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. Astrobiocentrism is a vision that places us in a scenario of confirmation of life in the universe, either as a second genesis or as an expansion of humanity in space. It manages to raise consistent arguments in relation to questions such as what would happen to knowledge if life were confirmed in the universe, how would this change the way we understand our place in the cosmos? Astrobiocentrism raises a series of reflections in the context of confirmed discovery, and it (...) develops concepts that work directly with what would happen after irrefutable evidence has been obtained that we are not alone in space. Unlike biocentrism or ecocentrism, the astrobiocentric view is not limited to the Earth-centric perspective, and for it incorporates a multi-, inter- and transdisciplinary understanding. Therefore, the aim of this paper is to make a reflection on the astrobiocentric issues related to the challenges and problems of the discovery of life in the universe and the expansion of mankind into space. What are the implications for human society, and for our institutions of higher learning, of the discovery of a sophisticated extraterrestrial intelligence (ETI) operating on and around Earth? This book explores this timely question from a multidisciplinary perspective. It considers scientific, philosophical, theological, and interdisciplinary ways of thinking about the question, and it represents all viewpoints on how likely it is that an ETI is already operating here on Earth. This paper critically addresses the logics of exceptionality inherent to emerging regulations of the gender field, with a focus on Spain’s recent self-determination-based regulation of gender. To achieve this, it offers a biopolitical analysis of the concept of “public order” and its influence on gender governance, drawing parallels to Agamben’s concept of the state of exception and exploring the connections between contemporary regulations and the gendered public order of nineteenth-century France. Finally, it analyzes the exclusions and restrictions that the Spanish (...) trans law reserves for migrants, non-binary people, and minors, contributing to the ongoing discourse on the limitations to gender autonomy in contemporary Western societies. Based on Maldonado-Torres’s formulation of the term, we conceive the decolonial turn as a form of liberating and decolonising reason beyond the liberal and Enlightened emancipation of rationality, and beyond the more radical Euro-critiques that have failed to consistently challenge the legacies of Eurocentrism and white male heteronormativity (often Eurocentric critiques of Eurocentrism). We complement Maldonado-Torres’s account of the decolonial turn in philosophy, theory and critique by providing an analysis of the trajectories of academic philosophy and clarifying the (...) relevance of decolonising philosophy and of the decolonial turn for current efforts in transforming philosophy in face of the challenges of social movements such as the Third World Liberation Front and Black Lives Matter in the United States, and Rhodes Must Fall in South Africa and England. After a brief analysis of the trajectory and current status of philosophy as a discipline in the modern Western research university, we provide examples of the decolonial turn and of decolonising philosophy in three areas: the engagement with (1) Asian and (2) Latin American philosophies, and (3) debates in the philosophy of race and gender. El ciclo de protestas que se abrió en las primaveras árabes ha servido para revitalizar la reflexión teórica sobre el modo en que los procesos de agenciamiento político son indisociables de los modos de producción de los espacios de coalición. From the thought of mid-twentieth century Mexican philosopher Jorge Portilla, I develop an account of what I call ‘ethics of ethnic identity,’ which include: a) a set of norms of agency grounded in ethnic identity, or ethnic norms of agency—reasons for action and obligations that spring from a given ethnic identity, and b) a type of normativity governing these ethnic norms of agency. I argue that one of the theoretical advantages of this account is that it fares well with respect (...) to human flourishing, moral obligations, and freedom and autonomy. I also develop an account of ethics of ethnic identity from Christine Korsgaard’s account of the sources of normativity and use it as a sophisticated foil against which my elaborations of Portilla’s views can be fruitfully contrasted. La performatividad es un concepto relativamente reciente. J. L. Austin lo introdujo en la filosofía del lenguaje en la década de los cincuenta para designar aquellas expresiones que, en las circunstancias apropiadas, hacen justo aquello que dicen que hacen (como cuando alguien exclama «te lo prometo»). Desde entonces ha sido sometido a intensos procesos de discusión, crítica y resignificación que lo han conducido a terrenos de reflexión teórica, filosófica y política progresivamente alejados de su contexto originario. Este libro explora, entre (...) todos los trayectos posibles en el interior de estos debates, el modo en que la preocupación de Austin por comprender cómo hacemos cosas con palabras llegó a derivar en lo que Judith Butler, como feminista, como filósofa y como teórica queer, hace con la performatividad. Con este fin se atiende, en primer lugar, a un contexto genealógico en el que confluyen trabajos y discusiones explícitas sobre la performatividad lingüística (como los de Jacques Derrida, Jonathan Culler o Shoshana Felman) junto a la obra de otros autores que, si bien no la tratan explícitamente, ha-cen posible su particular recepción por parte de Butler, como Michel Foucault. En segundo lugar, se trata de entender la reformulación de la performatividad en el ámbito de las identidades sexuales y genéricas, con la que Butler desplaza género y sexo del conjunto de las cosas que somos al orden de las cosas que hacemos. Las relaciones entre cuerpo y lenguaje, materia y textualidad, sexo y género sufren así una transformación con efectos de largo alcance sobre la filosofía, los estudios de género y las políticas identitarias. El intercambio de críticas entre Butler y autores como Seyla Benhabib, Nancy Fraser o Pierre Bourdieu contribuye a entender parte de esos efectos, y también a profundizar en algunas de las prioridades políticas de nuestra autora: la resistencia a los efectos excluyentes de la normatividad genérica y, en particular, del sistema «dos sexos, dos géneros», en dirección a una versión más abierta, inclusiva y proliferante de la identidad. A continuación, se plantea una genealogía queer de los usos de la teatralidad en las formas contemporáneas del activismo urbano. A partir del encuentro entre ambas líneas temporales defiendo, en diálogo con la obra reciente de Judith Butler, la importancia de la (...) dimensión performativa de las intervenciones individuales en espacios de protesta para entender el alcance movilizador de la acción colectiva. A body schema is an agent's model of its own body that enables it to act on affordances in the environment. This paper presents a body schema system for the Learning Intelligent Decision Agent (LIDA) cognitive architecture. LIDA is a conceptual and computational implementation of Global Workspace Theory, also integrating other theories from neuroscience and psychology. This paper contends that the ‘body schema' should be split into three separate functions based on the functional role of consciousness in Global Workspace Theory. (...) There is (1) an online model of the agent's effectors and effector variables (Current Body Schema), (2) a long-term, recognitional storage of embodied capacities for action and affordances (Habitual Body Schema), and (3) "dorsal" stream information feeding directly from early perception to sensorimotor processes (Online Body Schema). Leibniz’s account of moral necessity does double heavy-duty: it aims a) to provide explanations of divine choices without rendering these divine choices metaphysically necessary, thus permitting for divine freedom; and b) to ground the conviction that God did the best God could have done in creating the world, or Leibnizian Optimism. I present a novel interpretation of what Leibniz calls ‘the principle of the best’ as a second-order will to do what is best (read de dicto) that grounds a set (...) of subjunctive conditionals of divine freedom. These conditionals encode what God would do (namely the best) if God were to deliberate about creating one of a set of mutually exclusive options which are metaphysically possible for God to create. I argue that this reading of the principle of the best enables Leibnizian moral necessity to do the mentioned double heavy-duty. (shrink)

Vamos a tratar de comprender la concepción de la identidad en la obra de Butler, fundamentalmente a partir de El género en disputa. Profundizaremos para ello en su teoría de la performatividad, tratando tanto a los autores que posibilitaron su desarrollo (Austin, Derrida) como a algunos de sus críticos (especialmente Seyla Benhabib y Pierre Bourdieu). Nos preocupan especialmente las discusiones en torno a la constitución discursiva del sujeto, y el modo en que se plantea la oposición entre estar constituido por (...) el discurso y estar determinado por él. Trataremos finalmente de comprender el lugar de la obra de Butler en el panorama general del feminismo contemporáneo, explorando algunas de las razones que impiden interpretarla como un desplazamiento teórico que permanezca en el marco de la teoría feminista. Can a person from Latin America be a Catholic, or a feminist, or a democratic socialist in an authentic way? These identities come from Europe, and given the colonial history of Latin America, it seems reasonable to think that decolonizing the Latin American mind is a condition for its authenticity. Further, it seems reasonable to think that decolonization itself requires extirpating ideas and identities originating from the colonizers, especially those used to establish the colonial order. Thus, it seems that Latin (...) Americans cannot adopt such identities; authentic decolonization demands otherwise. In this paper I argue that the thought of twentieth century Mexican philosopher Jorge Portilla provides a persuasive account of the nature of authentic self-creation that allows for a kind of decolonization that makes it conceptually possible for Latin Americans to be Catholics, feminists, or democratic socialists in an authentic fashion. That is, authentic decolonization of the mind, I argue, need not involve a blanket rejection of identities originating from the colonizers; instead, it can be understood as a particular kind of authentic self-creation: one that is appropriately sensitive to the colonial history of the identities freely chosen by the agent. De se attitudes seem to play a special role in action and cognition. This raises a challenge to the traditional way in which mental attitudes have been understood. In this chapter, we review the case for thinking that de se attitudes require special theoretical treatment and discuss various ways in which the traditional theory can be modified to accommodate de se attitudes.

In this paper I examine an argument that has been made by Patrick Grim for the claim that de se knowledge is incompatible with the existence of an omniscient being. I claim that the success of the argument depends upon whether it is possible for someone else to know what I know in knowing (F), where (F) is a claim involving de se knowledge. I discuss one reply to this argument, proposed by Edward Wierenga, that appeals to first-person propositions and (...) argue that this response is unsuccessful. I then consider David Lewis’s theory of de se attitudes involving the self-ascription of properties. I claim that, according to this theory, there are two senses in which someone else can know what I know in knowing (F). I then argue that the second sense allows for the compatibility of de se knowledge with the existence of an omniscient being. (shrink)

I consider whether the self-ascription theory can succeed in providing a tenseless (B-theoretic) account of tensed belief and timely action. I evaluate an argument given by William Lane Craig for the conclusion that the self-ascription account of tensed belief entails a tensed theory (A-theory) of time. I claim that how one formulates the selfascription account of tensed belief depends upon whether one takes the subject of selfascription to be a momentary person-stage or an enduring person. I provide two different formulations (...) of the self-ascription account of tensed belief, one that is compatible with a perdurantist account of persons and the other that is compatible with an endurantist account of persons. I argue that a self-ascription account of tensed beliefs for enduring subjects most plausibly involves the self-ascription of relations rather than properties. I argue that whether one takes the subject of self-ascription to be a momentary personstage or an enduring person, the self-ascription theory provides a plausible B-theoretic account of how tensed belief and timely action are possible. Leibniz claims that for every possible substance S there is an individual concept that includes predicates describing everything that will ever happen to S, if S existed. Many commentators have thought that this leads Leibniz to think that all properties are had essentially, and thus that it is not metaphysically possible for substances to be otherwise than the way their individual concept has them as being. I argue against this common way of reading Leibniz’s views on the metaphysics of modality. (...) I develop a model in which individual concepts are innocent; that is, individual concepts are divine ideas that permit God to know everything that will ever happen to all possible substances, if created, but these individual concepts neither require that all properties are had essentially nor require that it is metaphysically necessary for substances to be the way their individual concepts have them as being. Si concebimos el bienestar como condición para que se dé auténtica dignidad en la vida individual y/o colectiva, entre diferentes especies y generaciones de especies, lo cierto es que cabría colegir que la dignidad no tiene una única naturaleza ni, en relación a la que cupiera definir como la más conveniente o necesaria o justa, se instituye conforme a idénticos grados. La (esencia de la) dignidad sería, por consiguiente, relativa. Analicemos esto.

The current assessment of behaviors in the inventories to diagnose autism spectrum disorders (ASD) focus on observation and discrete categorizations. Behaviors require movements, yet measurements of physical movements are seldom included. Their inclusion however, could provide an objective characterization of behavior to help unveil interactions between the peripheral and the central nervous systems. Such interactions are critical for the development and maintenance of spontaneous autonomy, self-regulation and voluntary control. At present, current approaches cannot deal with the heterogeneous, dynamic and stochastic (...) nature of development. Accordingly, they leave no avenues for real-time or longitudinal assessments of change in a coping system continuously adapting and developing compensatory mechanisms. We offer a new unifying statistical framework to reveal re-afferent kinesthetic features of the individual with ASD. The new methodology is based on the non-stationary stochastic patterns of minute fluctuations (micro-movements) inherent to our natural actions. Such patterns of behavioral variability provide re-entrant sensory feedback contributing to the autonomous regulation and coordination of the motor output. From an early age, this feedback supports centrally driven volitional control and fluid, flexible transitions between intentional and spontaneous behaviors. We show that in ASD there is a disruption in the maturation of this form of proprioception. Despite this disturbance, each individual has unique adaptive compensatory capabilities that we can unveil and exploit to evoke faster and more accurate decisions. Measuring the kinesthetic re-afference in tandem with stimuli variations we can detect changes in their micro-movements indicative of a more predictive and reliable kinesthetic percept. Our methods address the heterogeneity of ASD with a personalized approach grounded in the inherent sensory-motor abilities that the individual has already developed. (shrink)

There is currently disagreement about whether the phenomenon of first-person, or de se, thought motivates a move towards special kinds of contents. Some take the conclusion that traditional propositions are unable to serve as the content of de se belief to be old news, successfully argued for in a number of influential works several decades ago.1 Recently, some philosophers have challenged the view that there exist uniquely de se contents, claiming that most of the philosophical community has been under the (...) grip of an attractive but unmotivated myth.2 At the very least, this latter group has brought into question the arguments in favor of positing special kinds of content for de se belief; I think they have successfully shown that these arguments are not as conclusive, or fully articulated, as many have taken them to be. In this paper I will address these challenges directly and I will present and defend an argument for the conclusion that the phenomenon of de se thought does indeed motivate the move to a special kind of content, content that is uniquely de se. First, I characterize a notion of de se belief that is neutral with respect to friends and foes of uniquely de se content. I then argue for a determination thesis relating de se belief to belief content: that there is no difference in de se belief without a difference in belief content. I argue that various proposals for rejecting this determination thesis are unsuccessful. In the last part of the paper, I employ this determination thesis to argue for the existence of a type of belief content that is uniquely de se. (shrink)

In this paper I consider two strategies for providing tenseless truth-conditions for tensed sentences: the token-reflexive theory and the date theory. Both theories have faced a number of objections by prominent A-theorists such as Quentin Smith and William Lane Craig. Traditionally, these two theories have been viewed as rival methods for providing truth-conditions for tensed sentences. I argue that the debate over whether the token-reflexive theory or the date theory is true has arisen from a failure to distinguish between conditions (...) for the truth of tensed tokens and conditions for the truth of propositions expressed by tensed tokens. I demonstrate that there is a true formulation of the token-reflexive theory that provides necessary and sufficient conditions for the truth of tensed tokens, and there is a true formulation of the date theory that provides necessary and sufficient conditions for the truth of propositions expressed by tensed tokens. I argue that once the views are properly formulated, the A-theorist’s objections fail to make their mark. However, I conclude by claiming that even though there is a true formulation of the token-reflexive theory and a true formulation of the date theory, the New B-theory nonetheless fails to provide a complete account of the truth and falsity of tensed sentences. What is the relationship between Frege’s puzzle and the puzzle of the de se? An increasingly influential view claims that the de se puzzle is merely an instance of Frege’s puzzle and that the idea that de se attitudes pose a distinctive theoretical challenge rests on a myth. Here we argue that this view is misguided. There are important differences between the two puzzles. First, unlike Frege puzzle cases, de se puzzle cases involve unshareable Fregean senses. Second, unlike Frege puzzle (...) cases, de se puzzle cases cannot be resolved by objective information alone. Further, there seem to be pure cases of each puzzle: instances of the de se puzzle which do not have a Fregean structure, and instances of Frege’s puzzle, which do not involve de se attitudes. We conclude that the two puzzles are fundamentally different and that the traditional theory of attitudes needs to be amended. (shrink)

El propósito de este estudio es analizar las principales causas de los movimientos poblacionales en Colombia como consecuencia de factores ambientales, en especial, del cambio climático, en vista de discernir una distinción no solo conceptual, sino metodológica entre dos categorías de movimiento poblacional: la migración forzada y el desplazamiento forzado. De este modo, se dará cumplimiento a los siguientes objetivos específicos: 1) examinar la concordancia entre los factores causales que configuran temporalmente los fenómenos de migración y de desplazamiento forzado y (...) 2) elucidar si todo desplazamiento forzado está oculto en un evento migratorio. En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación. El objetivo de esta investigación es analizar, desde tres dimensiones, los derechos del ser humano, en contraste con los derechos de las má-quinas: (1) la inteligencia natural frente a la inteligencia artificial, (2) el aspecto intelectivo (sense) y el aspecto emotivo (sensibility) de la razón y (3) el aspecto de la corporalidad cibernética de los androides, respecto de la corporalidad orgánica de los seres humanos (incluidos, claro está, los cíborgs). La delimitación implica cuestionar hasta qué punto es plausible predicar derechos (...) Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...) a more liberal, and also somehow less parochial and ideological, road for legal theory. This is – it is argued in the paper – the programme, or better, the promise we can find in Herbert Hart’s main work, The Concept of Law. The article tries to render this promise more transparent while, nonetheless, not eschewing the blind sides of its narrative and argumentative strategy. (shrink)

When are we, in fact, arguing? Even one and the same author may offer more than one definition of what he understands by argumentation: this is partly because the problem of argumentation is not confined to a single area of knowledge or of practical life. Definitions of argumentation are as varied as the different positions taken on the question of what exactly we do when we argue. Be that as it may, we are struck by the fact that the problem (...) of argumentation (above all in its application to hypothetic-inductive methods) has not been analysed as a problem linked to interpretation. La réflexion sur l’éthique et la participation des jeunes et des enfants à l’aménagement com- porte au moins deux dimensions : d’une part, les justifications d’une telle participation ; d’autre part, les problèmes que la pratique participative fait émerger et face auxquels les cadres de réfé- rence conventionnels (non participatifs) ne sont pas toujours utiles. Le présent article aborde ces deux dimensions et explore leurs liens à la lumière de trois méthodes distinctes en matière de théorie morale, soit l’éthique déontologique, (...) l’éthique conséquentialiste et l’éthique de la vertu. Sur la base d’une expérience participative d’aménagement inscrite dans le programme Grandir en Ville de l’UNESCO, certaines contradictions entre les principes d’une pratique participative avec des enfants et la manière dont les problèmes éthiques sont parfois gérés sont mises en évidence. Knowledge, like other things of value, can be faked. According to Hawley (2011), know-how is harder to fake than knowledge-that, given that merely apparent propositional knowledge is in general more resilient to our attempts at successful detection than are corresponding attempts to fake know-how. While Hawley’s reasoning for a kind of detection resilience asymmetry between know-how and know-that looks initially plausible, it should ultimately be resisted. In showing why, we outline different ways in which know-how can be faked even when (...) a given performance is successful; and in doing so, we distinguish how know-how can be faked (no less than know-that) via upstream and downstream indicators of its presence, and within each of these categories, we’ll distinguish (in connection with detection resilience) both faking symptoms and (various kinds of) criteria. The unappreciated resilience of faked knowledge-how to successful detection highlights a largely overlooked dimension of social-epistemic risk – risk we face not just in our capacity as recipients of testimony, but in our capacity as both (would-be) apprentices and clients of knowledge-how.
